El siguiente informe pericial se basa en la experiencia de investigación de los firmantes en relación a las exhumaciones de fosas comunes de la Guerra Civil y la postguerra, y al conocido como “movimiento para la recuperación de la memoria histórica” que están teniendo lugar en España desde el año 2000, que ha enfatizado sus demandas sobre la suerte de los desaparecidos y ha puesto en marcha un ciclo de exhumaciones de fosas comunes derivadas de la Guerra Civil y la (...) dictadura. En este peritaje se usan las exhumaciones del siglo XXI como indicadores de la persistencia en el tiempo de las políticas y culturas del miedo instaladas en la sociedad española durante la Guerra Civil y la dictadura, más allá de las profundas transformaciones políticas e institucionales acaecidas en el país tras la muerte de Francisco Franco. Fue presentado como parte de la documentación de la demanda de Fausto Canales contra España el 15 de septiembre de 2012 en el Tribunal Europeo de Derechos Humanos. (shrink)

Este artículo propone una conceptualización de las fosas comunes de la derrota derivadas de la Guerra Civil española (1936- 1939) y la posguerra utilizando la noción del subtierro —asimilable a una forma extrema de exilio interior bajo tierra—, cuyo origen histórico sería el mismo que el de los exiliados, desterrados o transterrados que tuvieron que abandonar España, pero cuyas condiciones de producción y cuya historia social, política, simbólica y judicial desde la guerra hasta el presente tiene características específicas. A partir del estudio de caso de dos fosas comunes exhumadas en un pequeño pueblo con ocho años de diferencia, me abordo la transformación de las exhumaciones de la Guerra Civil en España en la primera década del siglo XXI. La súbita aparición en la esfera pública de los esqueletos de civiles ejecutados por paramilitares franquistas ha suscitado acalorados debates sobre la forma de gestionar dichos restos en un estado democrático consolidado, y sobre la interpretación que debe darse a las (...) iniciativas judiciales e institucionales que se han derivado de este proceso, a veces muy controvertidas. La peculiaridad del «modelo de subcontratación de los derechos humanos» que se sigue en España en relación con los crímenes de la Guerra Civil se sitúa en una perspectiva comparativa en el marco de los discursos y las prácticas transnacionales en materia de derechos humanos. This paper offers a re-reading of the works of Umberto Eco, be they academic, journalistic or literary, with a pseudologic tone: his desire to investigate the mechanisms of lying, and their relation with fiction, falsification, error, secrecy, and conspiracy. The study will review some of his main academic texts in the fields of semiotics, rhetoric, and aesthetics, and will make some references to his recent novels and essay compilations, as well as offer an explanation of how the evolution of his (...) thoughts takes a pessimistic turn. The face of the lie, which initially was aesthetic consolation and consumerist delusion, and then a game of intelligence, a creative stimulus and an interpretive challenge, changes when serves the purpose of extortion, manipulation, and war. In short, it could be argued that Eco became increasingly disappointed by deceptions, and lost faith in fakes and forgeries. (shrink)

How can science be brought to connect with experience? This book addresses two of the most challenging problems facing contemporary neurobiology and cognitive science. Firstly, understanding how we unconsciously execute habitual actions as a result of neurological and cognitive processes that are not formal actions of conscious judgment but part of a habitual nexus of systematic self-organization. Secondly, attempting to create an ethics adequate to our present awareness that there is no such thing as a transcendental self, a stable subject (...) or soul. Algebraic quantum field theory (AQFT) puts forward three ``causal axioms'' that aim to characterize the theory as one that implements relativistic causation: the spectrum condition, microcausality, and primitive causality. In this paper, I aim to show, in a minimally technical way, that none of them fully explains the notion of causation appropriate for AQFT because they only capture some of the desiderata for relativistic causation I state or because it is often unclear how each axiom implements its respective desideratum. After (...) this diagnostic, I will show that a fourth condition, local primitive causality (LPC), fully characterizes relativistic causation in the sense of fulfilling all the relevant desiderata. However, it only encompasses the virtues of the other axioms because it is implied by them, as I will show from a construction by Haag and Schroer (1962). Since the conjunction of the three causal axioms implies LPC and other important results in QFT that LPC does not imply, and since LPC helps clarify some of the shortcomings of the three axioms, I advocate for a holistic interpretation of how the axioms characterize the causal structure of AQFT against the strategy in the literature to rivalize the axioms and privilege one among them. In this paper I draw on Einstein's distinction between “principle” and “constructive” theories to isolate two levels of physical theory that can be found in both classical and (special) relativistic physics. I then argue that when we focus on theoretical explanations in physics, i.e. explanations of physical laws, the two leading views on explanation, Salmon's “bottom-up” view and Kitcher's “top-down” view, accurately describe theoretical explanations for a given level of theory. Machines and Biology have been, since antiquity, closely related. From the zoological figures present in astronomical simulacra, through renaissance mechanical imitations of animals, through Decartes' wind pipe nerves, to present day discussions on the computer and the brain, runs a continuous thread. In fact, the very name of mechanism for an attitude of inquiry throughout the history of Biology reveals this at a philosophical level. More often than not, mechanism is mentioned in opposition to vitalism, as an assertion of the (...) validity of the objectivity principle in biology: there are no purposes in animal nature; its apparent purposefulness is similar to the purposefulness of machines. Yet, the fact that one picks machines as a set of objects comparable to living systems, deserves a closer look. What in machines makes it possible to establish such a connection? (shrink)

In this paper, we explore the issue of the elimination of sports, or elements of sports, that present a high risk of brain injury. In particular, we critically examine two elements of Angelo Corlett’s and Pam Sailors’ arguments for the prohibition of football and Nicholas Dixon’s claim for the reformation of boxing to eliminate blows to the head based on the empirical assumption of an essential or causal connection between brain injuries incurred in football and the development of a degenerative (...) brain disease known as chronic traumatic encephalopathy ; and John Stuart Mill’s rejection of consensual domination. We present four arguments to contest the validity of Corlett, Dixon’s and Sailor’s positions. Specifically, we argue that certain autonomy-based arguments undermine paternalist arguments for reform; the nature of the goods people pursue in their lives might justify their foregoing future autonomy; Mill’s argument against consensual domination draws on ambiguous and arbitrary distinctions; the lack of consensus and empirical evidence regarding CTE arising from brain injuries in sport underdetermines calls for reform. We conclude that these proposals for reforming or eliminating sports with high risks of brain injuries are not well founded. (shrink)

This article critically examines the development and consensus outputs of the Concussion in Sport Group. We examine the six Consensus Statements between 2001 and 2023 to explore the challenges that the presence of contextual forces pose to the development of effective and ethically justifiable medical guidelines to manage situations involving brain-injured athletes. First, we discuss the implicit and explicit ethical framework and goals underlining the statements. Secondly, drawing on a relational account of athlete choice, we expound on the limitations of (...) the framework, concentrating on those resulting from a simplified understanding of athlete autonomy. Thirdly, we conclude by proposing a series of recommendations to improve concussion management protocols: (1) adopting a broader understanding of autonomy built upon relational accounts, beyond just the healthcare professional-athlete relationship; (2) further minimizing conflicts of interest that increase athletes’ vulnerability and hinder decision-making ability; (3) enhancing healthcare professional training to allow better adjustment of treatment plans to athletes’ contexts; and (4) promoting research on sociocultural elements affecting athletes’ vulnerability and autonomy. In a previous paper entitled ‘Beyond Physiology: Embodied Experience, Embodied Advantage, and the Inclusion of Transgender Athletes in Competitive Sport,’ we claim that analyses of the inclusion or exclusion of transgender athletes in competitive sport must go beyond physiological criteria and incorporate the notions of embodied experience and embodied advantage. Our stance has recently been challenged as impractical and excessively exclusionary. In this paper, we address these challenges and build upon them to expand on the policy implications of our original (...) framework, highlighting that embodied experience and embodied advantage heavily influence athletic performance. We differentiate competitive fairness from justice to, with an emphasis on the inclusion of transgender women in competitive sport, formulate a justice-based argument for maximizing inclusion. Afterward, we identify ideal and nonideal policy recommendations connected to our analysis of embodied experience and embodied advantage. We ultimately advocate for a qualified inclusion that assesses potential residual (physiological and embodied) advantages while striving for justice and competitive fairness. (shrink)

The study of Plato's dialogues has traditionally oscillated between two paradigms: one that portrays the dialogues as treatises expounding doctrines and one that sees them as purely skeptical, rhetorical, or literary. This collection of new essays by twelve noted Plato scholars illustrates the fruitfulness of breaking away from those paradigms, which have divided Platonic scholarship and led it to a number of dead ends. While the essays are diverse in their approaches, each seeks to find a 'third way' to understand (...) This paper addresses the possibility of robots engaging in sports. Recently, several movies like Ex-Machina, Chappi, and Transcendence challenge the spectator to think of the consequences of creating artificial intelligences. Although we refer to athletes who have outstanding sporting performances as machines, for example, in cycling people say ‘the cyclist looked like a machine with wheels,’ the potential participation of such AI in sport has not been addressed. For our argument’s sake, we will assume that the creation of human-like robots (...) who will mirror human athletes’ behavior in the playing field will be possible. Recent advances in cybernetics and robotics point in this way. As argued in the literature on philosophy of mind, the fact that intelligent robots seem to be doing something does not imply they are actually doing it. Understood in this way, sport can be conceived as a particular ‘imitation game’ or Turing test, which permits us to distinguish between an artificial intelligence... (shrink)

In this article, we examine scholarly analyses of justice and develop a framework that can help assess the claims from the parties in the Russian state-led doping scandal, including, but not limited to, Russian athletes, non-Russian athletes, the World Anti-Doping Agency, and sport governing bodies. The two key components of this justice framework are pluralism and relationality/contextuality. We argue that a justice framework built upon these elements better captures the nature of justice. We conclude that no party in the Russian (...) state-led doping case has exclusive access to justice. Rather, all the parties have legitimate calls for justice against one another. Thus, the administration of justice will fail to serve justice, in its different meanings, for all parties. (shrink)

Filipino's love for the elderly is undeniable. However, despite the respect they have for the elderly, an increasing amount of elderly abandonment is rising in the Philippines. The drastic increase in statistics of abandonment will still grow over the years because aging is inevitable. The primary goal of this study is to dig deeper into the experiences, challenges, and coping mechanisms of abandoned senior citizens inside of a home for the aged to spread awareness about this certain topic. By the (...) use of Interpretative Phenomenological Analysis, the study come up with the following findings: (1) The abandoned senior citizens chose to be inside the facility because they don't want to be a burden in their original homes. (2) Faith and religious works affect their psychological well-being. (3) Physical appearance does not affect their self-esteem. (4) Social support boosts their psychological well-being as well. (5) One of the biggest reasons why abandoned senior citizens left their homes is being neglected to cause them to leave and stay in home for the aged (6) Lastly, people inside the facilities accepted the fact that death is drawing closer to them but they don't want to die yet. According to relevance theory, irony comprehension invariably entails the identification of some opinion or thought and the identification of the speaker’s dissociative attitude. In this paper, it is argued that it is also essential for hearers to identify not only that propositional attitude, but also the affective attitude that the speaker holds towards the source of this echo so that an optimallyrelevant interpretive outcomeis achieved. This notion comprises feelings and emotions of a non-propositional quality which affect the propositional effects obtained (...) in ironical communication. Interpretations of Einstein’s equation differ primarily concerning whether E = mc2 entails that mass and energy are the same property of physical systems, and hence whether there is any sense in which mass is ever ‘converted’ into energy. In this paper, I examine six interpretations of Einstein’s equation and argue that all but one fail to satisfy a minimal set of conditions that all interpretations of physical theories ought to satisfy. I argue that we should prefer the interpretation of Einstein’s (...) equation that holds that mass and energy are distinct properties of physical systems. This interpretation also carries along the view that while most cases of ‘conversion’ are not genuine examples of mass being ‘converted’ into energy, it is possible that the there are such ‘conversions’ in the sense that a certain amount of energy ‘appears’ and an equivalent of mass ‘disappears’. Finally, I suggest that the interpretation I defend is the only one that does not blur the distinction between what Einstein called ‘principle’ and ‘constructive’ theories. This is philosophically significant because it emphasizes that explanations of Einstein’s equation and the ‘conversion’ of mass and energy must be top‐down explanations. (shrink)

A common objection to the use of balancing tests in human rights adjudication is that it is not possible to perform a quantitative comparison between gains and losses for rights or the public good by means only of rational criteria. Here I provide a general account of the incommensurability objection, with the aim of making explicit its scope, and of dispelling some common misconceptions surrounding it. Relying on this account, I engage with recent defences of balancing against the incommensurability objection.

El presente artículo propone una lectura del Eutidemo de Platón a partir de la escena que tiene lugar en el prólogo del diálogo, en el cual un personaje misterioso critica a Sócrates y a los hermanos erísticos por la conversación que acaba de tener lugar. Defenderé que esta figura anónima esconde a Isócrates, quien en Contra los sofistas y Encomio de Helena había atacado a todos los discípulos de Sócrates por dedicarse a un tipo de actividad intelectual a su juicio (...) volcada a la pura disputa y sin utilidad para la vida cívica. Propondré que el Eutidemo constituye una respuesta a dicha crítica, en tanto que los dos modelos protrépticos de la obra le permiten a Platón distinguir su forma de emplear la dialéctica de la de otros de sus condiscípulos, principalmente los megáricos, así como sentar las bases de su proyecto filosófico-político fundado en el concepto de conocimiento. Purpose Late in 2019, massive protest demonstrations rocked both Chile and Colombia. They were an expression of discontent with the economic model and social policies implemented in both countries in recent decades. The purpose of this study is to investigate how Chilean and Colombian news websites framed these social protests and what aspects of the social movements promoted these media to public opinion. Design/methodology/approach The methodology of this research is empirical; the authors use quantitative and discourse analysis techniques to study (...) the news published by the top three most visited main news websites in each country and deduce the main frameworks emerging from them. After analyzing the framing of reality by media in 4,252 news items, the authors suggest that the main news portals in these Latin American countries not only portrayed the collective actions but also promoted interpretations that did not necessarily reflect the demands of the demonstrations. Findings The findings were that in the 2019 protests in Chile and Colombia, the media approach to collective action was not necessarily positive for the activists. This was mainly because framing in the Chilean and Colombian websites had to do with negative aspects of the movements, such as violence or economic costs. Originality/value The originality and value of this research is that despite the fact that there are abundant case studies on the relationship between social movements and media framing in the literature, this study adds to the current knowledge because it compares two Latin American countries and focuses on Web news portals. In the recently published 1924 course, Grundbegriffe der aristotelischen Philosophie, Martin Heidegger offers a detailed interpretation of Aristotle's definition of kinesis in the Physics. This interpretation identifies entelecheia with what is finished and present‐at‐an‐end and energeia with being‐at‐work toward this end. In arguing against this interpretation, the present paper attempts to show that Aristotle interpreted being from the perspective of praxis rather than poiesis and therefore did not identify it with static presence. The paper also challenges later variations of Heidegger's (...) interpretation, in particular his account of dunamis in the 1931 course on Metaphysics Theta, which insists that its mode of being is presence‐at‐hand. By arguing that this reading too is untenable, the paper concludes that Aristotle's metaphysics is not a metaphysics of presence and that his texts instead point toward a possibility of metaphysics ignored by the attempts of Heidegger and others to overcome it. Why is space 3-dimensional? The fi rst answer to this question, entirely based on Physics, was given by Ehrenfest, in 1917, who showed that the stability requirement for n-dimensional two-body planetary system very strongly constrains space dimensionality, favouring 3-d. This kind of approach will be generically called "stability postulate" throughout this paper and was shown by Tangherlini, in 1963, to be still valid in the framework of general relativity as well as for quantum mechanical hydrogen atom, giving the same constraint (...) for space{dimensionality. In the present work, before criticizing this methodology, a brief discussion has been introduced, aimed at stressing and clarifying some general physical aspects of the problem of how to determine the number of space dimensions. Then, the epistemological consequences of Ehrenfest's methodology are critically reviewed. An alternative procedure to get at the proper number of dimensions, in which the stability postulate - and the implicit singularities in three-dimensional physics - are not an essential part of the argument, is proposed. In this way, the main epistemological problems contained in Ehrenfest's original idea are avoided. The alternative methodology proposed in this paper is realized by obtaining and discussing the n-dimensional quantum theory as expressed in Planck's law, de Broglie relation and the Heisenberg uncertainty relation. As a consequence, it is possible to propose an experiment, based on thermal neutron di raction by crystals, to directly measure space dimensionality. Finally the distinguished role of Maxwell's electromagnetic theory in the determination of space dimensionality is stressed. (shrink)

Utilitarianism has been able to respond to many of the objections raised against it by undertaking a major revision of its theory. Basically, this consisted of recognising that its early normative propositions were only viable for agents very different from flesh-and-blood humans. They then deduced that, given human limitations, it was most useful for everyone if moral agents did not behave as utilitarians and habitually followed certain rules. Important recent advances in neurotechnology suggest that some of these human limitations can (...) be overcome. In this article, after presenting some possible neuro-enhancements, we seek to answer the questions, first, of whether they should be accepted by a utilitarian ethic and, second, if accepted, to what extent they would invalidate the revision that allowed them to escape the objections. Un método de investigación en historia de la filosofía basado en las estructuras conceptuales parte del supuesto de que las doctrinas filosóficas, en autores y épocas diversas, se relacionan en función de semejanzas y diferencias, no tanto por motivos puramente históricos (sucesión de sistemas) o textuales (declaraciones expresas de los auto res), cuanto por las relaciones que guardan entre sí las estructuras en que se organizan los conceptos que las constituyen. Las estrucuras concep tuales de las filosofías se articulan en (...) torno a dos principios básicos, pro venientes ambos del aristotelismo: la unión preconstitutiva de materia y forma y el uso de una doble lógica analógica de proporcionalidad propia y de atribución. La historia de la filosofía, desde el método de investigación de las estruc turas analógicas de los conceptos, trata de establecer un diálogo más fecundo entre el pasado del pensamiento occidental y la actualidad de las nuevas producciones del intelecto humano. Knives, birds' wings, and mountain slopes are used for certain purposes: cutting, flying, and climbing. A bird's wings have in common with knives that they have been 'designed' for the purpose they serve, which purpose accounts for their existence, whereas mountain slopes have come about by geological processes independently of their uses for climbing. A bird's wings differ from a knife in that they have not been designed or produced by any conscious agent; rather, the wings, like the slopes, are (...) outcomes of natural processes without any intentional causation. Evolutionary biologists use teleological language and teleological explanations. I propose that this use is appropriate, because teleological explanations are hypotheses that can be subject to empirical testing. The distinctiveness of teleological hypotheses is that they account for the existence of a feature in terms of the function it serves; for example, wings have evolved and persist because flying is beneficial to birds by increasing their chances of surviving and reproducing. Features of organisms that are explained with teleological hypotheses include structures, such as wings; processes, such as development from egg to adult; and behaviours, such as nest building. A proximate explanation of these features is the function they serve; an ultimate explanation that they all share is their contribution to the reproductive fitness of the organisms. I distinguish several kinds of teleological explanations, such as natural and artificial, as well as bounded and unbounded, some of which but not others apply to biological explanations. (shrink)

Apesar da declaração, por parte do próprio Schopenhauer, de que a sua noção de Ideia deve ser entendida no mesmo sentido da Ideia platônica, estas não são idênticas, e apesar da declarada pretensão de filiação filosófica, é preciso ter em mente as divergências entre essas concepções para bem compreender a noção schopenhaueriana de filosofia como metafísica. Do mesmo modo que Schopenhauer se pretende kantiano mas transforma radicalmente a filosofia transcendental de Kant, o mesmo ocorre com a Ideia platônica na composição (...) da metafísica da Vontade. Dentre as várias influências, as filosofias de Platão e de Kant, são o principal material a partir do qual Schopenhauer constrói sua filosofia metafísica. O objetivo do presente artigo, portanto, é mostrar como Schopenhauer, por meio da fusão de certos aspectos das filosofias de Platão e Kant, pensa solucionar as contradições inerentes à teoria platônica das Ideias como identidades puras e, deste modo, manter a noção de Ideia dos diálogos metafísicos enquanto identidades que sustentam a possibilidade de uma epistemologia no sentido do discurso racional científico-filosófico e das consequências que daí advém. En este trabajo me propongo comparar el patrón argumentativo de los sofistas del siglo V a. C. tal como son retratados en la obra de Platón con el de los erísticos del Eutidemo. Defenderé que ninguno de estos sofistas es presentado por Platón como experto en dialéctica refutativa, actividad discursiva que caracteriza a la erística. Por el contrario, el retrato platónico de Pródico, Hipias, Gorgias y Protágoras los muestra como incapaces, desinteresados u hostiles a la argumentación de tipo dialéctica.

John Stuart Mill and Jeremy Bentham are often said to have held opposed views concerning the way “the value” of different pleasures should be estimated. Mill is accused of being an inconsistent utilitarian because he thought that, when comparing the value of two pleasures, we should not forget to take their “quality” into account. Bentham, on the other hand, is said to have believed that we should take “only quantity” into consideration. By verifying what they actually wrote, and reflecting on (...) what they meant by words like “value”, “quantity”, and “quality”, we find that these allegations are largely imaginary and that the difference between Mill and Bentham on this question has (at least) been exaggerated. Bentham, for example, did not write that "quantity of pleasure being equal, pushpin is as good as poetry", as is so often reported. In his Principles of Morals and Legislation he clearly tells us why he rejects the inaccurate word “quantity”, when speaking of “the value of (a lot of) pain or pleasure”, and he explicitly introduces “quality” – both the word and the concept – in his analysis of rewards and punishments. These clarifications allow us to sort-out a few other confusions concerning utilitarianism. We explain, for example, why authors like Amartya Sen and Michael Sandel are mistaken in believing that rights and freedoms have “no intrinsic value” (only instrumental value) in utilitarian ethics. Heidegger’s recently published 1932 seminar on Plato’s Phaedrus arguably represents his most successful dialogue with Plato, where such dialogue is characterized by both the deepest affinity and the most incisive opposition. The central thesis of Heidegger’s interpretation is that the Phaedrus is not simply a logos about eros, but rather an attempt to show that eros is the very essence of logos and that logos is thereby in its very essence dia-logue. Heidegger is thus here more attuned than ever before (...) to the erotic and dialogical character of philosophy while at the same time concerned with how this conception of philosophy can lead to the eclipse of being and truth. RESUMEN Una interpretación extendida del Eutidemo sostiene que la práctica erística de la cual Platón busca distanciarse en el diálogo constituye una referencia velada a la dialéctica desarrollada por el socrático Euclides y sus seguidores megáricos. No obstante, los expertos reconocen que la segunda demostración erística pone en boca de Eutidemo y Dionisodoro dos posiciones que fueron defendidas por Antístenes, según las cuales no es posible decir falsedades ni contradecir. Este trabajo busca analizar las refutaciones de dicha sección y confrontarlas (...) con los testimonios sobre Antístenes a fin de evaluar hasta qué punto nos encontramos en presencia de los mismos argumentos. Defenderé que si bien las refutaciones del Eutidemo poseen una inspiración antisténica, principalmente respecto de las tesis que buscan sostener, las mismas se basan en una serie de supuestos ambiguos que responden más a los lineamientos de la práctica erística que a los fundamentos del pensamiento antisténico. Argumentaré, asimismo, que esta diferencia podría explicarse a partir del hecho de que el Eutidemo puede ser leído como una respuesta al Encomio de Helena de Isócrates, en donde este ataca a los socráticos por dedicarse a la erística y al desarrollo de doctrinas paradójicas, entre las cuales incluye las tesis de Antístenes. ABSTRACT A widespread interpretation of the Euthydemus claims that the Eristic practice from which Plato seeks to distance himself in the dialogue constitutes a veiled reference to the dialectics developed by the Socratic Euclid and his Megarian followers. However, experts acknowledge that the second Eristic demonstration puts two positions in the mouth of Euthydemus and Dionysodorus which were defended by Antisthenes, according to which it is not possible to say falsehoods nor to contradict. This work seeks to analyze the refutations of this section and compare them with the testimonies about Antisthenes in order to evaluate to what extent they are the same arguments. I will defend that although the refutations of the Euthydemus have an Antisthenic inspiration, mainly with respect to the theses they seek to support, these are based on a series of ambiguous assumptions that correspond more to the principles of Eristics than to the grounds of Antisthenic thought. I will also argue that the difference could be explained by the fact that the Euthydemus can be understood as a response to Isocrates ’ Encomium of Helen, where he attacks the whole Socratic circle for devoting to Eristics and to the development of paradoxical doctrines, including the theses of the Antisthesis.
