During the first few decades of the twentieth century, legal theory on both sides of the Atlantic was characterized by a tremendous amount of skepticism toward the private law concepts of property and contract. In the United States and France, Oliver Wendell Holmes and François Gény led the charge with withering critiques of the abuse of deduction, exposing their forebears' supposedly gapless system of private law rules for what it was, a house of cards built on the ideological foundations of (...) laissez faire capitalism. The goal was to make the United States Constitution and the French civil code more responsive to the realities of industrialization. Unlike the other participants in this transatlantic critique, François Gény simultaneously insisted on the immutability of justice and social utility. His “ineluctable minimum of natural law” would guide judges and jurists toward the proper social ends, replacing deduction with teleology. The problem was that nearly all of Gény's contemporaries were perplexed by his conception of natural law, which lacked the substance of the natural rights tradition of the eighteenth and nineteenth centuries and the historicist impulse of the early twentieth. No one was more perplexed than Oliver Wendell Holmes, whose more thorough going skepticism led him to see judicial restraint as the only solution to the abuse of deduction. The ultimate framework for this debate was World War I, in which both Holmes and Gény thought they had found vindication for their views. Events on the battlefield reaffirmed Gény's commitment to justice just as they reignited Holmes' existential embrace of the unknown. In a sense, the limits of their skepticism would be forged in the trenches of the Great War. (shrink)

ABSTRACT The article treats the universal history Ruins, or Meditation on the Revolutions of Empires (Les ruines ou Méditations sur les révolutions des empires) of the French cultural philosopher Constantin-François Volney (1757–1820). Using a textual, interdisciplinary study, which focuses upon Volney’s complex cultural and historical philosophical contexts, I demonstrate that his primary concern was a nearly 2500 years coherent Europe of tradition and reception: this Europe did not represent a western corner of a larger Asian landmass but, in the late (...) eighteenth century, rather offered the opportunity for a complex and harmonious unity of European peoples under French circumstances. Volney chose the ruins of the desert town of Palmyra as the starting point of his historical and philosophical reflections. As a cultural philosopher of the late Enlightenment, he looks past the divine workings of the course of history in order to take instead the finite, man-made world as his focal interest. The following pages emphasize these reflections on human history that – in the face of a melancholic mode – highlighted the cultural anthropological characteristics and committed them to the promotion of a self-creating future. Jean-François Mattéi est un philosophe français né en 1941 à Oran et décédé en 2014 à Marseille. Sa disparition laisse incontestablement un vide dans le paysage intellectuel français contemporain, car peu de voix ne se sont élevées avec tant de force et de brio pour dénoncer l'imposture de la pensée faible et du postmodernisme, ces répliques modernes de la sophistique que Platon combattait déjà vigoureusement à l'aube de la philosophie. Un premier ouvrage collectif parut en 2015, De Platon à Matrix (...) - L'Âme du monde, qui rendit hommage au penseur sur un mode complice, amical et touchant. Une chaire vit le jour au Centre Universitaire de la Méditerranée (CUM) de Nice, dont l'ambition annoncée est de prolonger l'œuvre de Mattéi en fournissant des travaux de réflexion autour du génie méditerranéen de la pensée et de la civilisation européenne.La rame à l'épaule, expression tirée de l'Odyssée, emprunte une tierce voie, qui ne relève ni de la proximité amicale ni du travail universitaire d'érudition. Ce que vise ici Baptiste Rappin, c'est en effet le cœur de la pensée de Jean-François Mattéi : à savoir que le mythe confère à la raison son sens et son horizon, et seul lui permet de s'articuler au monde. Les symboles préservent de la sorte le langage de l'autoréférentialité et de l'inarticulation barbare. Si cet essai scrute attentivement l'œuvre de Mattéi, il en ressort, du fait même de son objet, une relecture de l'histoire de la philosophie qui s'exprime à travers les analogies de l'architecture, du ciel, de l'étoile, de la musique et du tissu qui traversent la pensée européenne de ses aurores platonicienne et même pythagoricienne jusqu'à Nietzsche, Heidegger, Arendt ou encore Boutang. Adopting a communication as constitutive of organization (CCO) perspective on ethics and corporate social responsibility (CSR) invites us to create the conditions of a dialogue, discussion, or debate between various stakeholders, who can then try to confront their respective positions on a given issue, and possibly come to a decision regarding how a situation should be evaluated and/or responded to. As shown in this article, getting human stakeholders to voice their concerns about a specific situation is a way not only (...) to rationally confront multiple viewpoints on what should be done about it (à la Habermas) but also to allow elements of this situation to reveal themselves in a discussion. This is why any ethical decision has to experience a form of undecidability and surprisability. When beliefs and opinions can be called into question, it means that participants are ready to become attentive to what a situation might surprisingly call for. Communication is therefore a matter of ventriloquism, as human participants should also be considered the means by which elements of a situation manage to express themselves in a discussion, dictating specific courses of action over others. This concretely means that multiple voices can be heard in such a scene: not only the voices of the human stakeholders who speak to each other but also the voices of facts, principles, future generations, ecosystems, populations that are made to say things through these various turns of talk. Are the things of this world given to thought? Are things really meant to be known, to be taken as the objective manifestations of a transcendental conditioning power? The Western philosophical tradition, according to François Laruelle, presupposes just this transcendental constitution of the real--a presupposition that exalts philosophy itself as the designated recipient of the transcendental gift. Philosophy knows what things really are because things--all things--are given to philosophy to be known. Laruelle's trenchant essays show how this presupposition controls even (...) the ostensibly radical critiques of the philosophical tradition that have proliferated in the postmodern aftermath of Nietzsche and Heidegger. For these critiques persist in assuming that the disruptive other is in some way given to their own discourse--which shows itself thereby to be still philosophical. An effective critique of philosophy must be non-philosophical. It must, according to Laruelle, suspend the presupposition that otherness is given to be known, that thought has a fundamentally differential structure. Non-philosophy begins not with difference, not with subject and object, but with the positing of the One. From this axiomatic starting point, non-philosophy takes as its material philosophy, rethought according to the One. The non-philosophy project does not, like so much postmodern philosophy, herald the end of philosophy. It takes philosophy as an occasion to raise the question of another kind of thought--one that, instead of differentially relating to the world that it presupposes, asserts that it is ultimately, in the flesh, at One with what it can never know. Pourtant, le livre ne laisse pas de contenir une révision intéressante du modèle mécaniste que Descartes appliquait à l'explication du corps humain; il contient (...) surtout une hypothèse sur Ia structure organique, qui, nous le croyons, a joué un rôle de modèle pour un certain type de théorie de l'être vivant. Illusionism is the thesis that phenomenal consciousness does not exist, but merely seems to exist. Many opponents to the thesis take it to be obviously false. They think that they can reject illusionism, even if they conceded that it is coherent and supported by strong arguments. David Chalmers has articulated this reaction to illusionism in terms of a “Moorean” argument against illusionism. This argument contends that illusionism is false, because it is obviously true that we have phenomenal experiences. I argue (...) that this argument fails by showing that its defenders cannot maintain that its crucial premise has the kind of support needed for the argument to work, without begging the question against illusionism. I distinguish, and discuss the relations between, five types of context-shift involving indexicals. For 'intentional' indexicals - indexicals whose value depends upon the speaker's intention - we can shift the context more or less 'at will', by manifesting one's intention to do so. For other indexicals we can shift the context through pretense. Following a number of authors, I distinguish two types of context-shifting pretense, corresponding to two sets of linguistic phenomena. The fourth type of case is that of expressions (...) which are not really indexical, but perspectival, and for which we do not need to appeal to the notion of context-shift in order to account for their shifty behaviour. The fifth category I introduce and discuss is that of 'shiftable indexicals'. Do we need it, given that we already have the other four categories? My answer is a qualified 'yes'. (shrink)

In my experience, conflict and other forms of being stuck or ‘stuckness’ are related to actions, behaviour or events. If we consider a narrative paradigm, they happen in the realm of the Bruner’s ‘landscape of action’. Efforts at escaping these problem-saturated experiences mostly resort to replacing these actions, habits, modes of operation or rules with a different set of rules, without first reflecting on the intentionality or ‘why’ behind the actions. Most often this only serves to perpetuate the problem. This (...) article will attempt to show that alternating between various initiatives in the ‘landscape of action’ provides only temporary respite to the problem, if any; that the intentionality behind these actions needs to be revisited and that contemplative practice facilitate such reflection on intentionality. This is therefore an exercise in reflecting on intentionality or even purpose, that is, a teleological question. This process traverses the dimensions of ‘what’, ‘how’ and ‘why’, referring to the biology of human decision-making in the process of doing so. This article posits that this reflection may be facilitated by contemplative practices such as mindfulness and reflecting on soul. (shrink)

La métaphore est un instrument indispensable pour les analyses scientifiques. Mais elle nécessite un usage réflexif qui en précise le statut car celui-ci peut être divers et n’est pas sans effet sur la théorie comme sur diverses pratiques. Ainsi, les analystes et acteurs des transports ont usé – et probablement abusé – du recours à la physique des fluides pour leurs métaphores. Aujourd’hui, les développements de la physique, par exemple dans les domaines des fractales ou de la percolation, ouvrent des (...) perspectives nouvelles et prometteuses. Cette évolution montre aussi que les chercheurs en sciences sociales auraient intérêt à renouveler les métaphores qu’ils emploient et qui sont souvent assez archaïques. Ainsi, la référence à des espaces à n dimensions et à l’hypertexte permet de faire rebondir les analyses de Georg Simmel, bridées par le recours à une géométrie plane trop sommaire.Metaphors are indispensable tools for scientific investigation. They should be used in such a way that their status as metaphor is clear, however, for their various uses are not without consequence for theory and practice. In the area of transportation, analysts and practitioners have drawn metaphors from the physics of fluids, but recent developments in the theories of fractals and percolation offer promising perspectives. Generally speaking, as these developments suggest, social scientists stand to benefit from renewing their current metaphors, which are often quite archaic. Thus, Georg Simmel’s analyses – which are constrained by the reference to plan – stand to be revitalized by a reference to N-dimensional spaces and to hypertext. (shrink)

RésuméEst présentée une démonstration élémentaire et intuitive de ľ inégalité de Bell, démonstration accessible aux non‐spécialistes et en particulier aux philosophes. Cette inégalité, dont les prémisses sont dégagées, est valable pour toutes les théories à variables cachées locales. Or, la mécanique quantique la viole. Les conséquences qui on peut tirer de cette violation sont envisageées.

Ce livre est la première biographie consacrée à l'une des plus grandes figures intellectuelles et politiques du XXe siècle : Cornelius Castoriadis (1922-1997). Jeune résistant grec révolutionnaire menacé de mort par les staliniens, il arrive en France à l'âge de vingt-trois ans, alors que l'engouement pour l'URSS est à son zénith. Il contribue alors à créer, avec Claude Lefort et Jean-François Lyotard, l'une des branches les plus vivaces de la gauche radicale, « Socialisme ou Barbarie », qui deviendra ensuite une (...) revue mythique et l'une des grandes influences de Mai 68, notamment par sa critique de gauche des régimes dits « communistes ». Économiste, philosophe, psychanalyste, militant politique, Castoriadis est l'auteur d'une œuvre essentielle pour quiconque s'intéresse à la question de l'institution hors du cadre de l'État, dont il traite dans ce que l'on peut considérer comme l'un des maîtres ouvrages du XXe siècle, L'Institution imaginaire de la société (1975). Il n'a en effet cessé, en croisant l'analyse historienne et l'approche psychanalytique, de s'attacher à penser la conquête de l'autonomie comme condition de l'approfondissement démocratique. Fruit d'une enquête menée auprès d'une centaine de témoins, cet ouvrage permet enfin de lever le voile sur cette figure hors norme et trop méconnue, qui est restée marginale jusqu'au bout, malgré son élection comme directeur d'études à l'EHESS au début des années 1980. Celui en qui Pierre Vidal-Naquet voyait un « génie », et Edgar Morin un « Titan de l'esprit », est pourtant très certainement appelé, en ces temps de grandes turbulences des souverainetés établies, à devenir l'un des penseurs-clés du XXIe siècle. The dating of the beginning of the Third Sacred War. The interpretation of the Delphic accounts revisited. The chronology proposed by CID II for the Third Sacred War is not as assured as may appear at first sight. One must keep in mind that the reconstructions proposed there constitute no more than one possibility among others. The numbering of the pylées provides an excellent example : J. Bousquet connects it to the levying of the phocidian fine in the period after (...) the Peace of Philokrates, but other readings remain possible, even preferable. Moreover, the dating of the occupation of the sanctuary to the end of the archonship of Herakleios is based on the testimony of Pausanias, on this point very much subject to caution, as well as a very slanted reading of CID II 10 and CID II 31. Only the absence of a reunion of the college under Aristoxenos in the autumn appears to constitute a certain indicator of the phocidian occupation of the sanctuary. (shrink)

Auxiliaries are usually studied in the late Republic or the Imperial period. Despite this emphasis in modern research, auxiliaries were employed in substantial numbers during the third and second centuries BCE. Auxiliaries did make a crucial contribution to the Roman war effort in the Middle Republic, providing a substantial part of Rome’s military manpower. These troops were most often financed by the community providing them, allowing the Roman state to save a great deal of money if similar numbers of Roman (...) citizens had been deployed instead. This enabled the Roman state to significantly bolster its ability to project military power without having to implement additional financing mechanisms. Along with the use of auxiliaries, the suspension of tributum after the third Macedonian War seemed to have followed a policy of decreasing the burden of financing war for Roman assidui. (shrink)

Aussi surprenante qu’elle puisse paraître, cette question s’est posée avec une certaine intensité dans l’histoire de la pensée au lendemain de la seconde guerre mondiale. Cet article entend donner un aperçu de ces débats en confrontant la critique par Bertrand Russell, Karl Popper et Hans Kelsen de l’auteur de La République, à sa défense par Eric Voegelin, ses disciples et Leo Strauss. À l’issue de cette présentation, on pourra tenter d’apporter une réponse (...) à la question posée : celle-ci s’inspirera de la méthodologie en histoire des idées préconisée par l’école de Cambridge, qui, en un sens, n’est pas si éloignée de la méthode suivie par Leo Strauss. This book is a close reading of Jacques Lacan’s seminal essay, “The Agency of the Letter in the Unconscious or Reason Since Freud, ” selected for the particular light it casts on Lacan’s complex relation to linguistics, psychoanalysis, and philosophy. It clarifies the way Lacan renews or transforms the psychoanalytic field, through his diversion of Saussure’s theory of the sign, his radicalization of Freud’s fundamental concepts, and his subversion of dominant philosophical values. The authors argue, however, that Lacan’s discourse is (...) marked by a deep ambiguity: while he invents a new “language,” he nonetheless maintains the traditional metaphysical motifs of systemacity, foundation, and truth. This study deals with money, especially coins, and intends to circumscribe the place of coinage among cultural objects. Money cannot be described without a semiotics of culture. We shall consider the definitions of value in order to define the evaluative foundations of meaning, and discuss the recurring parallel between signs and coins. Using a theory of anthropic zones, we will then attempt to determine the conditions necessary for the creation of objects of value, which should lead to a typology of (...) the different orders of fascination. Independently of the generative and enunciative theories, the dynamic structuralism of the Saussurian tradition has made it possible to pose the problem of semiosis, understood as the individuation of the sign from a structural germ. At a higher level of complexity, the processes that preside over this individuation seem to also govern the composition of texts. Literary and pictorial examples make it possible to detect them; they confirm that reflection on the arts is a major area of general and comparative (...) semiotics. (shrink)
