Im Medizin- und Care-Diskurs zielt die Frage, wie mit Patientinnen zu kommunizieren sei, oft auf eine normativ-ethische Ebene. Dementgegen soll hier eine eher auf die epistemologische Ebene gerichtete Untersuchung der Gesprächssituation in der Diagnosestellung geleistet werden. Die Erörterung verläuft entlang der existenziellen Philosophien von Gabriel Marcel und Martin Buber. Dabei zeigt sich, dass es drei Ebenen gibt, die das Arztgespräch bestimmen. Auf der ersten Ebene befindet sich die meist asymmetrische sachliche Kommunikationssituation über medizinische und biochemische Zusammenhänge. Hier tritt die Ärztin (...) als Expertin auf. Als zweite Ebene kann man die existenziell-dialogische Situation der Begegnung zweier Menschen ausmachen. Hier besteht eine völlige Symmetrie, da die Begegnung bei Buber und Marcel nicht an besondere Einrichtungen, wie zum Beispiel Fürsorge, gebunden ist. Die dritte Ebene kehrt das ‚Machtverhältnis‘ – so man diesen Begriff nutzen will – um: Die Patientin hat, indem sie sich in einer Grenzsituation befindet, einen Wissens- und Handlungsraum, der dem der Ärztin überlegen ist. Als Betroffene kann sie beispielsweise eine mögliche Therapie ablehnen, während die Ärztin eine indizierte Therapie nicht verweigern darf. Die genaueren Lektüren Marcels und Bubers lassen weiterhin deutlich werden, wie tiefgreifend die Vorbehalte der Dialogphilosophie gegenüber Institutionen und deren Normen sind. Die Idee des informierten Einverständnisses, welche die medizinethische Debatte dominiert, erweist sich aus Bubers Perspektive als brüchig, wo affektive Innerlichkeit lediglich ein Spiegel der äußerlichen Einrichtungen ist. Der Begriff der Hoffnung wird schließlich herangezogen, um den besonderen Handlungsraum der Ärztin aus der Perspektive der Dialogphilosophie zu konkretisieren. (shrink)

Dieser Essay möchte Kants Recht nach dem Krieg kritisch analysieren und untersuchen, welchen Beitrag es für die gegenwärtige Debatte um das ius post bellum leisten kann. Es wird dabei davon ausgegangen, dass Kants Konzeption des Naturzustands den Schlüssel zum Verständnis von Kants Kriegsrecht insgesamt darstellt. Zunächst wird die Struktur des ius post bellum durch seine systematische Stellung in Kants Völkerrecht rekonstruiert. Die einzelnen Bestimmungen des Rechts nach dem Krieg werden in zwei Gruppen geteilt und für sich erläutert. Dabei wird gelegentlich (...) auf Begrenzungen von Kants Perspektive hingewiesen. Die identifizierten Grundsätze von Kants Kriegsrecht werden schließlich dazu verwendet, weitere, nicht im Recht nach dem Krieg genannte Bestimmungen zu diskutieren, die die Nachkonfliktphase betreffen.This essay tries to critically analyze Kant’s right after war. It examines the contribution of Kant’s right after war to the contemporary debate about jus post bellum. It starts with the assumption that the key to the understanding of Kant’s law of war is his conception of the state of nature. The structure of the right after war will be reconstructed by analyzing the place of the right within Kant’s law of peoples. The features of the right after war will be divided into two groups and examined. Certain limitations of Kant’s perspective will be identified. The underlying principles of Kant’s law of war will be used to discuss other, not in the right after war included features, which are related to the post bellum phase. (shrink)

ZusammenfassungDer Beitrag baut auf Niklas Luhmanns Unterscheidung zwischen verschiedenen Typen sozialer Systeme auf, nämlich Interaktionen, Organisationen und einer durch funktionale Teilsysteme strukturierten Gesellschaft. Auf dieser Basis wird der Fall zweier Schüler in einer Schweizer Sekundarschule analysiert, die ihren Lehrerinnen mit religiöser Begründung den Handschlag verweigerten. Gezeigt wird, wie dieses Ereignis von verschiedenen Systemtypen als Problem bearbeitet und jeweils unterschiedlich beobachtet wurde, wobei speziell auch die Frage nach dem Stellenwert des Teilsystems Religion gestellt wird. Insbesondere der Zeitbedarf und der Stellenwert schriftlicher (...) Kommunikation der verschiedenen Systeme erweisen sich als Faktoren, über die sich die unterschiedliche Rolle verschiedener Systemtypen in der Affäre verstehen lässt. Religion beeinflusste zunächst zwar die Interaktion im Klassenzimmer, schließlich fungierte sie aber eher als Thema von Recht, Politik und Massenmedien, als dass sich religiöse Kommunikation über den ursprünglichen Interaktionszusammenhang hinaus als einflussreich erwiesen hätte. We investigate the problem of how nonnatural entities are represented by examining university students’ concepts of God, both professed theological beliefs and concepts used in comprehension of narratives. In three story processing tasks, subjects often used an anthropomorphic God concept that is inconsistent with stated theological beliefs; and drastically distorted the narratives without any awareness of doing so. By heightening subjects’ awareness of their theological beliefs, we were able to manipulate the degree of anthropomorphization. This tendency to anthropomorphize may be (...) generalizable to other agents. God (and possibly other agents) is unintentionally anthropomorphized in some contexts, perhaps as a means of representing poorly understood.. (shrink)

The ‘Principal Principle’ states, roughly, that one's subjective probability for a proposition should conform to one's beliefs about that proposition's objective chance of coming true. David Lewis has argued (i) that this principle provides the defining role for chance; (ii) that it conflicts with his reductionist thesis of Humean supervenience, and so must be replaced by an amended version that avoids the conflict; hence (iii) that nothing perfectly deserves the name ‘chance’, although something can come close enough by playing the (...) role picked out by the amended principle. We show that in fact there must be ‘chances’ that perfectly play what Lewis takes to be the defining role. But this is not the happy conclusion it might seem, since these ‘chances’ behave too strangely to deserve the name. Richard Feynman has claimed that anti-particles are nothing but particles `propagating backwards in time'; that time reversing a particle state always turns it into the corresponding anti-particle state. According to standard quantum field theory textbooks this is not so: time reversal does not turn particles into anti-particles. Feynman's view is interesting because, in particular, it suggests a nonstandard, and possibly illuminating, interpretation of the CPT theorem. In this paper, we explore a classical analog of Feynman's view, in the context of (...) the recent debate between David Albert and David Malament over time reversal in classical electromagnetism. Moral puzzles about actions which bring about very small or what are said to be imperceptible harms or benefits for each of a large number of people are well known. Less well known is an argument by Warren Quinn that standard theories of rationality can lead an agent to end up torturing himself or herself in a completely foreseeable way, and that this shows that standard theories of rationality need to be revised. Holbein produced a drawing of Sir Thomas More and his Family which was a preparatory sketch for a larger painting. The painting was acquired by Karl von Liechtenstein-Kastelkron, Archbishop of Olomouc, Moravia, and was last recorded in 1691 as being kept in the episcopal residence in Olomouc; it is generally assumed that the painting was lost in the 1752 fire at the Archbishop's château in Kroměřiž. There are, however, five extant versions of the Family Group. The three main versions are (...) the full-sized oil on canvas, The Family of Sir Thomas More, now at Nostell Priory, and two paintings of Sir Thomas More, his Household, and Descendants: one kept at the National Portrait Gallery, the other at the Victoria and Albert Museum, London. There has been much discussion about the transformation from a family at prayer—as portrayed in the original drawing—to a conversation on Seneca. Based on editions of Oedipus prior to the Nostell painting, the history of More's descendants, and a cameo that belonged to More's family, this paper argues that the Elizabethan transformation is a story of conformity and non-conformity. The common cause principle states that common causes produce correlations amongst their effects, but that common effects do not produce correlations amongst their causes. I claim that this principle, as explicated in terms of probabilistic relations, is false in classical statistical mechanics. Indeterminism in the form of stationary Markov processes rather than quantum mechanics is found to be a possible saviour of the principle. In addition I argue that if causation is to be explicated in terms of probabilities, then it (...) should be done in terms of probabilistic relations which are invariant under changes of initial distributions. Such relations can also give rise to an asymmetric cause-effect relationship which always runs forwards in time. (shrink)

The term “judicial restraint,” applied to courts engaged in judicial constitutional review, may refer to any one or more of three possible postures of such courts, which we here will distinguish as “quiescent,” “tolerant,” and “weak-form.” A quiescent court deploys its powers sparingly, strictly limiting the agenda of social disputes on which it will pronounce in the constitution’s name. A tolerant court confirms as valid laws whose constitutional compatibility it finds to be reasonable sustainable, even though it independently would conclude (...) to the contrary. A weak-form court acts on the understanding that its pronouncements on matters constitutional will be duly open to considered rejection by other political agencies. Theory commonly tends to treat the question of judicial restraint as turning on a bedrock political value of democracy. We may also, however, understand debates over judicial restraint in the light of a different bedrock value, that of political legitimacy. Where democracy is the focal concern, debaters may tend toward conflating into one measure the three dimensions of judicial restraint. A focus on legitimacy rather tends toward a dis-bundling of the three dimensions, thus complicating the choices while also clarifying the stakes. The political philosophy of John Rawls helps us to see how and why this occurs. (shrink)

Summary Structured interviews were carried out with 176 secondary school teachers to elicit their views/opinions about their initial professional training and their later practical experience, with particular reference to classroom behaviour management. The results showed that the vast majority of teachers believe classroom management skills to be of major importance to them professionally. Nearly three?quarters of them were dissatisfied with the preparation in this area of professional skills provided by their initial training courses. Many thought that their colleagues spent too (...) much time on matters of order and control and 38% thought that they, themselves, did also. Generally, they showed an interest in attending training courses in classroom behaviour management. Many felt that such training could reduce stress among teachers and might help to reduce troublesome behaviour among their pupils. Nearly all of them thought that it would be of benefit to their younger colleagues who were just beginning their careers. (shrink)

Although risk and uncertainty are inevitable aspects of the sustainability problem, they are often neglected in the sustainability discourse, especially in the economic analysis of sustainable development. We argue that this deprives the sustainability discourse of interesting connections to risk management. We show that defining sustainability as the obligation to limit the risk of harming future individuals provides a framework in which tools from risk management, like mean-variance analysis, can be employed to analyze planning decisions and to calculate a risk-minimizing (...) policy mix. Furthermore, we discuss whether such a notion of sustainability can be an ethically tenable sustainability concept and how a positive probability of harming future individuals might be defended. Valuemetrics is an elaboration of Robert S. Hartman's innovative development in the application of an abstract system to the study of ethical problems. The system used for this purpose is a branch of logic called set theory. Set theory fulfills this role because goodness, the fundamental phenomenon of ethics, is defined axiomatically in terms of sets. The similarity of structure between certain elements of set theory and the various types and degrees of goodness makes mathematical accounting of goodness phenomena possible. (...) In the valuemetrics context, value judgments are considered as an assessment of the goodness of something. Therefore, the mathematical system for the accounting of goodness serves as a tool for objectively making many kinds of value judgments and possible attendant ethical decisions. One of the results of this conception, attributable to Hartman, is the birth of the science of ethics. The first half of the book elucidates the theory, terminology, and mathematical system used in valuemetrics, known as Hartmanean algebra. The second half is devoted to the application of this system to the measurement and development of a person's value vision, and the solution of various problems in ethics using the case study technique. Hartmanean algebra will resolve several types of problems such as the determination of right and wrong, good and bad; determining how to redress and amend instances of wrongs and badness; and how to determine when, if ever, wrongs and badness are justified. The general claims of this paper are as follows. As a result of chaotic dynamics we can usually not know what the deterministic causes of events are. There will, however, be invariant forwards transition chances from earlier types of events, which we typically call the causes, to later types of events, which we typically call the effects. There will be no invariant backwards transition chances between these types of events. This asymmetry has the same origin and explanation as the arrow (...) of time of thermodynamics. (shrink)

The book's primary concern of morally improving medicine is achieved by dividing the argument into two parts. The first defines the crisis in health-care and justifies beneficence. The second part offers practical suggestions on implementing beneficence into the system. Thinking of concepts as explicit lists of features used to pick out referents neatly is indeed mistaken; but there are other alternatives than making concepts mere pointers. These alternatives are suggested by the difference between meaning X and having the concept X, problems of conceptual change, implicit conceptual schemata, the conceptual requirements of the division of cognitive labor, and how concepts figure in perception versus language.

ZusammenfassungDas Ziel des vorliegenden Beitrags besteht darin, einige ethische Implikationen des weltweiten „outsourcing“ von Heil- und Pflegeleistungen auf dem globalen Gesundheitsmarkt aufzuzeigen. Das Augenmerk richtet sich dabei nicht allein auf die Inanspruchnahme medizinischer Leistungen in der nördlichen Erdhälfte durch eine Klientel aus der südlichen Erdhälfte und umgekehrt. Stattdessen sollen vor allem transkulturelle Facetten des Medizintourismus beleuchtet werden, die mit der gegenseitigen Konfrontation verschiedener Medizinkonzepte und dem Aufeinandertreffen unterschiedlicher kultur- und geschichtsdependenter medizinischer Vorstellungen verbunden sind. Der vorliegende Beitrag legt ein besonderes (...) Augenmerk auf den Umgang mit kulturellen Differenzen im Medizintourismus. Dabei soll die These vertreten werden, dass die Behandlung kultureller Differenz im Rahmen des weltweit florierenden Medizintourismus eine Fortsetzung bereits etablierter und verfestigter Praktiken des Kolonialismus und Neokolonialismus darstellt. Der Beitrag hebt somit auf Mechanismen kultureller Vereinnahmung und sowohl ideelle als auch materielle Verwertungspraktiken von Gesundheitsleistungen, traditioneller Medizin und Biodiversität ab.
