Equal Justice: Fair Legal Systems in an Unfair World, by Wilmot-SmithFrederick. Cambridge, MA: Harvard University Press, 2019. Pp. 256.

The authors of the papers in A Simple Matter of Justice? reject something they label “heterosexism.” Their writing is obscure, but it seems they desire a state-regimented conformity, with state-approved roles for gays, for lesbians and for others, with state hand-outs and other privileges for all manner of favoured groups, and with no possibility of anyone indulging in the pleasures of “commercial consumerism.” None of the authors appears concerned with the demand that, provided he/she does not violate anyone’s rights, the (...) state should not put any barriers in the way of the sexually active citizen. The Geography of Perversion is a dull and ponderous history of European ideas about male homosexual behaviour, which in places seems to be little more than lists of what various people said. It is appallingly written in grandiloquent language larded with daft Marxist clichés. (shrink)

With German Idealism Frederick Beiser adds to his already impressive body of work on classical German Philosophy. The aim of his book is to provide a historical account of the various forms (...) the notion of "idealism" took on in the work of Kant, Fichte, Hölderlin, Novalis, Friederich Schlegel, and Schelling. While the ruling picture of the period presents German idealism as the "metaphysics of subjectivity" blown up into mythic proportions, Beiser argues steadily and convincingly that "the development of German idealism consists not in an increasing subjectivism but in the very opposite: a growing realism and naturalism" (3).Nearly two-thirds of the book is devoted to Kant and Fichte. The treatment of Kant weighs in at just under two hundred pages, and is devoted to tracing his struggles with idealism in the pre-critical writings, the Kritik der reinen Vernunft and the Opus postumum. Unresolved Kantian problems serve as the launching pad for Fichte's "practical idealism." Beiser concentrates on Fichte's battles with skepticism and nihilism, his turn to the "primacy of the practical," and his efforts to provide a moral and inter-subjective foundation [End Page 278] for self-consciousness. The rest of the book deals with the ways in which the Kant-Fichte legacy is taken up and transformed into "absolute idealism" by the early Romantics and Schelling. Among the absolute idealists, it is Schelling—"the most inventive, brilliant, and productive" of them all (467)—who receives the most attention.It is a virtue of German Idealism that the trees of interpretive controversy are never mistaken for the idealist forest. In the body of the text, Beiser sticks closely to the task at hand, introducing the reader to the main lines of argumentation and the major philosophical stakes with exceptional skill and clarity. Scholarly debates are carried out mostly in the endnotes. This approach moves things along at a brisk pace, and makes for a refreshingly readable academic tome. It is perhaps inevitable, however, that a book of this scope will crack a little under the strain of its own weight. Three problems stand out. First, rejecting Hegel's self-aggrandizing account of the period is one thing, but it is surely overstating the case to say that the history of German idealism shows us that Hegel "was not the creative and original thinker that his history suggests or that his disciples imply" (11). Beiser's history, at least, does not justify such a claim. Pointing out that Hegelian-sounding ideas were in the air before Hegel started publishing does not suffice. Plato inherited from Parmenides the concern with "being," but this hardly makes him less of a creative and original thinker. Second, Beiser does not live up to his methodological promise to bracket "contemporary philosophical concerns and concepts" (ix). The book is littered with anachronisms. Schlegel is presented as attacking the "myth of the Given" (445-6), for example, while Schelling gives a "transcendental argument" for the self-knowledge of the absolute (589). Beiser also regularly classifies philosophers from the period as either "foundationalist" or "anti-foundationalist" (6-9, 235-9, 444-6), thus putting to work an undeniably contemporary "-ism" for which German, to this day, does not have a direct equivalent.Third, Beiser's treatment of the early German Romantics is too weak to serve as a bridge from Kant and Fichte to Schelling. While he is certainly right to insist that the early Romantics played a crucial role in the development of German idealism, he repeatedly conflates this claim with the less-than-convincing claim that they were philosophers with systematic ambitions. As a result, he seems ill at ease with their work, and has trouble dealing with the form within which they made their contributions. Take Schlegel for example. Diotima's Children is a re-examination of the rationalist tradition of aesthetics which prevailed in Germany in the late seventeenth and eighteenth century.

This paper presents the results of a study of the effect of a business ethics course in enhancing the ability of students to recognize ethical issues. The findings show that compared to students who do not complete such a course, students enrolled in a business ethics course experience substantial improvement in that ability.

In this single-blind within-subject study, autonomic and EEG variables were compared during 10-min, order-balanced eyes-closed rest and Transcendental Meditation (TM) sessions. TM sessions were distinguished by (1) lower breath rates, (2) lower skin conductance levels, (3) higher respiratory sinus arrhythmia levels, and (4) higher alpha anterior-posterior and frontal EEG coherence. Alpha power was not significantly different between conditions. These results were seen in the first minute and were maintained throughout the 10-min sessions. TM practice appears to (1) lead to a (...) state fundamentally different than eyes-closed rest; (2) result in a cascade of events in the central and autonomic nervous systems, leading to a rapid change in state (within a minute) that was maintained throughout the TM session; and (3) be best distinguished from other conditions through autonomic and EEG alpha coherence patterns rather than alpha power. Two neural networks that may mediate these effects are suggested. The rapid shift in physiological functioning within the first minute might be mediated by a ''neural switch'' in prefrontal areas inhibiting activity in specific and nonspecific thalamocortical circuits. The resulting ''restfully alert'' state might be sustained by a basal ganglia-corticothalamic threshold regulation mechanism automatically maintaining lower levels of cortical excitability. (shrink)

What is it for something to have a nature? And what is it for law to have a nature? Analysis of the concept of law has often been taken to be a search for the essential features of law, but it is not clear that the nature of a phenomenon or artifact is better explained by its essential features than by its common ones. And it is not clear that necessary truths have more explanatory value than typical truths. Especially -- (...) but not necessarily - if we recognize the possibility that law is a cluster concept, the value of explaining the widespread but not strictly necessary features of law in explaining law itself becomes more apparent. The jurisprudential project of differentiating law from other social phenomena is an important one, but the distinction may be a fuzzy one and not susceptible either to sharp demarcation or to specification of essential features of law that will assist in differentiation. But if we inquire into what typically or usually or almost always characterizes law rather than what necessarily characterizes it, we may make genuine progress in distinguishing law from the social phenomena to which it is adjacent but with which it is not congruent. Many philosophers think that descriptive uncertainty is relevant to what we subjectively ought to do. This leads to a further question: is what we subjectively ought to do sensitive to our moral uncertainty as well? Includers say yes—what we subjectively ought to do is sensitive to both descriptive uncertainty and moral uncertainty. Excluders say no—only descriptive uncertainty matters to what we subjectively ought to do (i.e., moral uncertainty is irrelevant). Excluders argue that common motivations for the subjective ought only give (...) us reason to think that descriptive uncertainty matters. This paper focuses on one motivation: accessibility. Excluders argue that accessibility does not motivate the Includers’ view because moral truths are always accessible – unlike descriptive facts which are not always accessible. My goal is to defend the Includers’ view by arguing that moral truths are not always accessible in the relevant sense. (shrink)

Many environmental thinkers are torn in two opposing directions at once. For good reasons we are appalled by the damage that has been done to the earth by the ethos of heedless anthropocentric individualism, which has achieved its colossal feats of exploitation, encouraged to selfishness by its world view—of relation-free atoms—while chanting ‘reduction’ as its mantra. But also for good reasons we are repelled, at the other extreme, by environmentally correct images of mindless biocentric collectivisms in which precious personal values (...) are overridden for the good of some healthy beehive ‘whole’. Alfred Schutz in his phenomenological studies on the social world, has systematically analyzed the nature of social relationships between individuals, and has arrived at an originating point involving intersubjectivity. This point is described by what he calls the Pure We-relationship. Comparison of Schutz's analysis of the Pure We relationship with Buber's description of his personal experience of intersubjectivity, i.e., the l-Thou relationship, reveals a remarkable convergence. For instance, fundamental to both Schutz and Buber are the notions that intersubjectivity is tied (...) to the lived presence of the self with the other (i.e., sharing of time in the stream of duration), and that the 'content' of this 'experience' is related to the being of the other. These interesting features in the works of Schutz and Buber are described by showing the similarity between the Pure We and I-Thou relationships. (shrink)

Norms are widely regarded as kinds of templates of performance, resident in agents. As such they are thought to determine unilaterally what kinds of thought or action accords with them. Under philosophical elaboration this view has led to multiple perplexities: among them the question of how there can be evaluation, justification, and rectification of such unilaterally determining entities. Sometimes one can appeal to other, supervening norms; but the need to terminate the regressive procedure typically leads to appeals to dubious "foundations," (...) to conventions, or to sheer prejudice. In a feat of surpassing acuity Wittgenstein exposed this view of norms to be inadequate in the apparently paradigm contexts to which traditionally it seemed best suited, these being those of mathematical rules and principles. An alternative general view of norms is one with important congruences with the view taken by the Critical-Pragmatic philosophy concerning the constitutive role played by norms in creating the texture of human life and thought. This view is that norms are intrinsically socio-psychological entities that interlock with each other and are rooted deeply in the practices of individuals and their communities. Embedded in these practices, norms are in principle open-textured: open to further definition and revision when serious anomalies in their extant forms are encountered. This article explores certain features of the alternative view, concentrating upon the illumination it sheds and the guidance it provides in the conduct of the fundamental philosophical activities of assessment, criticism, and revision of broad and deep personal and communal norms. Manchmal kann man sich auf andere, übergeordnete Normen berufen; aber angesichts der Notwendigkeit, überhaupt zu einem Ende zu kommen, führt das regressive Verfahren typischerweise zu einer Berufung auf zweifelhafte "Grundsätze", auf Konventionen oder auf ein bloßes Vorurteil. In einer Meisterleistung von außerordentlicher gedanklicher Schärfe hat Wittgenstein diese Sichtweise von Normen als inadäquat gerade für den scheinbar paradigmatischen Zusammenhang entlarvt, auf den sie nach traditioneller Anschauung am besten passen soll: den von mathematischen Regeln und Prinzipien. ABSTRACT This article reconstructs Nietzsche's conception of spiritual illness, especially as exhibited in various forms of the bad conscience, and asks what positive, ennobling potential Nietzsche finds in it. The relevant concept of spirit is arrived at by reconstructing Nietzsche's conception of life and then considering what reflexive life—life turned back against itself—would look like. It distinguishes four independent features of spiritual illness: the measureless drive to make oneself suffer, self-opacity, life denial, and a self-undermining dynamic in which life exhausts (...) the sources of its own vitality. The article ends by considering various suggestions as to how these features of spiritual illness might also be preconditions of great spiritual health, including the preconditions for erecting new “ideals.”.
