Health care is transitioning from genetics to genomics, in which single-gene testing for diagnosis is being replaced by multi-gene panels, genome-wide sequencing, and other multi-genic tests for disease diagnosis, prediction, prognosis, and treatment. This health care transition is spurring a new set of increased or novel liability risks for health care providers and test laboratories. This article describes this transition in both medical care and liability, and addresses 11 areas of potential increased or novel liability risk, offering recommendations to both (...) health care and legal actors to address and manage those liability risks. We live in a world of massive change, and each decade appears to move faster and faster. It is not just the inventions that are picking up speed, but the adoption of technologies is increasing by businesses and consumers. The early adaptors switch to general consumption at an increasing pace. Part of the increase in adoption is attributed to challenges such as a pandemic. Nevertheless, in general, the concepts of a VUCA (volatile, uncertain, complex, and ambiguous) are becoming a standard (...) year-on-year driven by the exponential growth of knowledge and, therefore, technology (Jari & Lauraeus, 2019). As this chapter will explain, this exponential growth in technology would not be possible without the creative surge upon us. Organizations are promoting out-of-the-box thinking and creativity. Historically, creativity was only necessary for the arts and philosophical thinkers. Creativity has moved to its rightful place as part of our problem solving. No discussion of disruption is complete without addressing the work of Harvard professor Dr. Christensen, who for over 20 years has looked in detail at the phenomenon of disruption at the technology and business model levels. Christensen was not just aware of some new technologies’ disruptive nature and provided guidelines on how organizations should view different disruptive technologies (Christensen, 1997; Christensen, 2015; Christensen et al., 2018). Here, a distinguished group of international contributors examines what we know about, feel, and hope to accomplish in real-world environments.

This paper describes the design of a control and management network (orderwire) for a mobile wireless Asynchronous Transfer Mode (ATM) network. This mobile wireless ATM network is part of the Rapidly Deployable Radio Network (RDRN). The orderwire system consists of a packet radio network which overlays the mobile wireless ATM network, each network element in this network uses Global Positioning System (GPS) information to control a beamforming antenna subsystem which provides for spatial reuse. This paper also proposes a novel Virtual (...) Network Configuration (VNC) algorithm for predictive network configuration. A mobile ATM Private Network-Network Interface (PNNI) based on VNC is also discussed. Finally, as a prelude to the system implementation, results of a Maisie simulation of the orderwire system are discussed. (shrink)

This paper argues that mathematics education curricular policy has slowly effected a reversal in the relationship between mathematics and its publics: from mathematics assuming its users to mathematics defined by its (supposed) users. Mathematics education research itself, its contribution to challenging the former notwithstanding, has often unwittingly supported this shift. While in the mid 1980s the mathematics educators propagating the teaching of mathematics by applications represented a small and unique group, by the mid 1990s those advocating teaching mathematics this way (...) had grown appreciably. A characteristic of this change in conviction is the emphasis on the importance of the context of mathematical thinking and problem-solving. Paradoxically, the consequences of the coupling of mathematics, both with utilitarianism,as other have argued, and with essentialism,as we argue in this paper, have been to narrow its scope (e.g. to a narrow version of 'numeracy') and to distance mathematics from its publics. In the paper we argue that action is needed to counter these trends, and to develop the area of the public understanding of mathematics. Otherwise policies aiming simply to 'popularize' mathematics might exacerbate these consequences. In particular, research is necessary along the lines followed by the social studies of science. For such research-by posing as pertinent the question of describing and accounting for differences between practices of knowledge production, dissemination and use-can help to avoid the assumption of a unique essence of some unitary culture called 'mathematics' and therefore a public (or publics) separated from it. I argue that that the suffering of non-human animals poses some potentially knotty difficulties for process theodicy. To respond satisfactorily to the problem of evil as it involves animals, process theists will, I argue, need either to defend some form of consequentialism or make a number of potentially plausible but certainly contestable empirical claims. I begin this internal critique by explaining the nature of the process response to the problem of evil. I explain how process thought can respond with reasonable (...) effectiveness to the general problem of the suffering of non-human animals while highlighting the special difficulty predation might be thought to pose for the process thinker. Then, I elaborate alternative consequentialist and non-consequentialist process accounts of divine goodness in the face of the harm to non-human animals caused by predation. After summarizing my analyses in the conclusion, I underscore the costs associated with these alternatives. (shrink)

The charge of homophobia, indiscriminately made in a large part of our Western culture today, is ill conceived, illogical and false. This sweeping charge may be pictured as a triangle of informal logical fallacies. The more prominent side, the one which the general public encounters first, is what I shall call the fallacy of turning the tables: the rhetorical device of making the source of criticism the object of criticism. The other side of the charge is the fallacy of equivocation. (...) The boundary of the term ‘homophobia’ is made so elastic that it can stretch around, not just phobias, but every kind of rational fear as well; and not just around every kind of fear, but also around every critical posture or idea that anyone may have about the practice of homosexuality. At the base of the charge, and undergirding the other two fallacies, is the fallacy of begging the question. A commitment to the complete acceptability of the practice of homosexuality enables its proponents to ‘know’ beforehand that all criticisms against it must originate in the defective psychology of the critic. Gary Steiner argues that ethologists and philosophers in the analytic and continental traditions have largely failed to advance an adequate explanation of animal behavior. Critically engaging the positions of Marc Hauser, Daniel Dennett, Donald Davidson, John Searle, Martin Heidegger, and Hans-Georg Gadamer, among others, Steiner shows how the Western philosophical tradition has forced animals into human experiential categories in order to make sense of their cognitive abilities and moral status and how desperately we need a new approach to animal (...) rights. Steiner rejects the traditional assumption that a lack of formal rationality confers an inferior moral status on animals vis-à-vis human beings. Instead, he offers an associationist view of animal cognition in which animals grasp and adapt to their environments without employing concepts or intentionality. Steiner challenges the standard assumption of liberal individualism according to which humans have no obligations of justice toward animals. Instead, he advocates a "cosmic holism" that attributes a moral status to animals equivalent to that of people. Arguing for a relationship of justice between humans and nature, Steiner emphasizes our kinship with animals and the fundamental moral obligations entailed by this kinship. (shrink)

Collectively, lawyers probably seek in vain to be sufficiently trusted, even when most individual lawyers appear to do their utmost to behave responsibly. Efforts to address lawyers' behavioural failures remain an important social policy objective and a professional obligation. In this article we argue that it is politically sensible and socially responsible for the legal profession to continue to address its misbehaving members in a more fundamental manner than just the post-facto disciplinary process. We suggest that pre-emptive (pre-offence), ethics self-assessments (...) may limit the later incidence of misbehaviour and assist in rehabilitation programs for disciplined lawyers. We report on an experimental approach to lawyers' discovering more about their innate ethics. We have trialled lawyers' responses to a series of concrete statements about their ethical priorities and developed a statistically valid 'scale' (or set of statements) to allow lawyers in an Australian context to observe and reflect upon, their differing ethical approaches. To date, no such a scale has been developed for lawyers' ethics. The results of this scale development process are sufficiently encouraging to justify further work on similar scales for different cultures and legal traditions, in the interest of producing a tailored, reliable and valid instrument for general pre-emptive use within each local profession. The proposition that awareness improves conscious decision-making is not revolutionary or particularly contentious. While raising lawyers' awareness of how they make choices may only make a modest contribution to enhancing the ethical quality of their professional behaviour, it nevertheless seems plausible that it will raise their awareness and is therefore a worthwhile exercise. The book is well-arranged, too, with a (...) solid sample of deconstructionist, New Historicist, Marxist, feminist, and cultural studies, and more mix-and-match theorists describing their classroom aims and means in twenty-one essays grouped into four sections. Sadoff and Cain offer elegantly evasive introductions—not only to these essays per se, but to the issues these essays purport to address. In “Surveying Theory,” David B. Downing, John Kucich, Susan S. Lanser, Lynette Felber, Donald G. Marshall, and Gary Waller lay broadly “anti-foundational” groundwork. In “Focusing,” Diana Fuss, Sandra A. Grayson, Beverly Lyon Clark, Evan Carton, Laurie A. Finke, Jonathan Arac, and Cary Nelson deconstruct things in more detail. In “Theory and Culture,” Huston Diehl, Cannon Schmitt and Donald Ulin, Lindon Barrett, Simon Gikandi, D. N. Rodowick, and Jan Gorak again widen the scope of “theorized teaching,” aiming regulation anticanonical shrapnel at every bastion of coded convention. And while readers may pause over [End Page 336] its backcover promise of “lively and accessible prose,” on the whole, the book is unusually readable for an MLA publication about theory.Since Teaching Contemporary Theory to Undergraduates is a how-to directed at true-believers, it might seem like critical blindsiding to address its fundamental assumptions rather than its tactical suggestions, to focus on its “theory” rather than on its pedagogy. Yet such a focus is not only fair but necessary. The pedagogy is in this book a pawn of the theory. And the theory is, at best, a lesson in how not to teach students how to learn. For despite all its noisy celebrations of methodological, cultural, ontological, and occasionally even human “difference,” the anthology is really a chorus of self-defeating dogma. 1 Like the virtue of variety, even the relative absence of jargon here works as much against as for the book, revealing self-contradictions so perfectly unwitting that they are twice as funny. It is a good thing, then, that the authors eventually contradict these claims, too—even if they know not that they do.The canon? In accordance with postmodern tradition, “the canon” can be calibrated to be whatever best attacks whatever other tradition a particular theorist is aiming at. It is a very modular “monolith.” And theorists never try to “overdetermine” definitions, anyway. The classroom? As an “overdetermined” site of class-struggle, “the classroom (and the academy at large) is... a social institution designed to reproduce the interests, values, and politics of the dominant social classes” (p. 104). Convention? Anything “mainstream” is so polluted with “the notion of mastery, of total and complete knowledge” that even assigning “mainstream” theorists in a theory class “reproduces that hegemony, no matter how critically we read them” (pp. 105, 61). The runoff of mainstream theorists quoted here—conventional MLA Style—makes the same point. Culture? As always already—and only—“a struggle between power and its disenfranchised shadow,” culture “systematically excludes and marginalizes disenfranchised social members” (pp. 263–64, 20–21).Education? As Paulo Freire has revealed, 2 on the one, bad, goatish, wrong Right-wing hand of God, there is the repressive “banking” model of education; on the other, good-shepherdish, right Left-wing side, there is the liberating “problem-posing” model. You are either a droning clerk bent on subduing students into serfdom, or you are a resistance fighter lighting fuses of freedom. “Instrumental activity” does “pedagogical violence,” making the teacher a tyrant and the student a victim, a “submissive imitator” in a “system” that’s “abidingly committed [End Page 337] to the vision of a white-supremacist oligarchy.” Even asking students what level of “guidance” they feel they need is imposing “rhetorical control” (pp. 32, 23, 222, 135).Facts? This is a transcript of a conversation between P F Strawson and Gareth Evans in 1973, filmed for The Open University. Under the title 'Truth', Strawson and Evans discuss the question as to whether the distinction between genuinely fact-stating uses of language and other uses can be grounded on a theory of truth, especially a 'thin' notion of truth in the tradition of F P Ramsey.

The aim of this essay is to demonstrate three main points: that many of the widespread appeals made to conscience in the time of COVID display little understanding of conscience’s fundamental nature; that they assume for conscience a sacrosanct status it does not possess; and that because of the first two points, conversation regarding conscience and COVID has generated considerable confusion. In support of these points, this paper shows what conscience is, employs St. John of the Cross’s examination of attachments (...) to suggest that possession of a well-formed conscience is frequently a most difficult achievement, and examines various expressions associated with the COVID debate to illustrate how much of the conversation has stemmed from or resulted in little real understanding. Perhaps no word has received such varied treatment from philosophers as the word ‘good’. No doubt this is largely due to the fact that it is a word with an unusually wide range of use. Aristotle, for example, realised that it is a term that can be applied to substances, qualities, relations, actions, passivities, times and places, and we may notice that he was of the opinion that the term must have different meanings when applied in these different categories. Many (...) of the usages which are distinguishable in everyday speech have given rise to corresponding theories about the nature of goodness. Indeed if we survey the history of philosophical speculation about goodness, we find that there are just about as many theories about goodness as there are distinct uses of the word ‘good’. For example, goodness has been variously described as an unique quality, as a consequential property, as a relational property, etc., and the word ‘good’ has been described as a term of commendation or approval, and its attributive, predicative and instrumental senses, to name a few, have been distinguished. Mandelbaum adopted a middle course between physicalistic scientific realism and phenomenalistic "ordinary language" direct realism. He affirmed the relevance of scientific knowledge for epistemology, but did not attempt to reduce the content of perception to physical properties. Rather, he developed a critical direct realism, according to which we see bodies by means of having phenomenal experience. This phenomenal experience was not, however, to be equated with the sense-data of the usual representative realism. Rather, it was a perception of material objects (...) by means of their qualities. In this way, he agreed with the phenomenological position of the Gestalt psychologist Wolfgang Koehler, who rejected the view that sense-data by themselves could provide an epistemic basis for knowledge claims. Koehler's position, too, may be described as a critical realism. As would Mandelbaum, he sought to give proper due to the phenomenal while also affirming its basis in a physical world of objects and brain processes. In its insistence on the reality and scientific respectability of the phenomenal, the critical realism of Mandelbaum and Koehler is distinct from the contemporaneous physicalism of Place and Smart. Volume 4 of _The Complete Works of Friedrich Nietzsche_ contains two works, _Mixed Opinions and Maxims_ and _The Wanderer and His Shadow_, originally published separately, then republished together in the 1886 edition of Nietzsche's works. They mingle aphorisms drawn from notebooks of 1875-79, years when worsening health forced Nietzsche toward an increasingly solitary existence. Like its predecessor, _Human, All Too Human II_ is above all an act of resistance not only to the intellectual influences that Nietzsche felt called upon to (...) critique, but to the basic physical facts of his daily life. It turns an increasingly sharply formulated genealogical method of analysis toward Nietzsche's persistent concerns—metaphysics, morality, religion, art, style, society, politics and culture. The notebook entries included here offer a window into the intellectual sources behind Nietzsche's evolution as a philosopher, the reading and self-reflection that nourished his lines of thought. The linking of notebook entries to specific published aphorisms, included in the notes, allows readers of Nietzsche in English to trace for the first time the intensive process of revision through which he transformed raw notebook material into the finely crafted sequences of aphoristic reflection that signal his distinctiveness as a philosophical stylist.
