When making consumption choices, people often fail to meet their own standards of both ethics and frugality. People also generally tend to demand more of others than they do of themselves. But little is known about how these different types of hypocrisy interact, particularly in relation to attitudes toward ethical consumption. In three experiments, we integrate research methods using anchoring and hypocrisy within the context of ethical consumption. Across three experiments, we find a default expectation that people should spend less (...) on consumer items than they actually do. This default position can be inverted by making the ethical context of consumption salient, whereby the expectation is then that people should spend more on consumer items than they actually do. Experiments 2 and 3 show that a moderate price anchor for ethical consumption is sufficient to shift expected standards for other people, but a higher price anchor is required to shift expected standards in personal behaviour. We discuss the countervailing roles of frugality and ethical consumption in understanding hypocrisy and ethical decision-making. (shrink)

A symposium was held at the Centre for Research in the Arts, Social Sciences and Humanities at the University of Cambridge on June 12th 2019, ‘Rethinking Repetition in a Digital Age’, at which Geoff Stead, a leading mobile tech designer, was a keynote speaker. The focus of the Cambridge UK event was on how the potentials of digital technologies—whose harms have received widespread attention—could be redirected for the social good. For Stead, this is precisely what Babbel are doing in (...) their approach to commercial digital language learning. Stead spoke to the idea of reversing our personal relationships to mechanical affordances, and finding empowerment in understanding their designed logics. I critically discuss two claims which Hannah Ginsborg makes on behalf of her account of meaning in terms of ‘primitive normativity’: first, that it avoids the sceptical regress articulated by Kripke's Wittgenstein; second, that it makes sense of the thought—central to Kripke's Wittgenstein—that ‘meaning is normative’, in a way which shows this thought not only to be immune from recent criticisms but also to undermine reductively naturalistic theories of content. In the course of the discussion, I consider and attempt to (...) shed light on a number of issues: the structure of the sceptical regress; the content of the thought that ‘meaning is normative’, and its force against reductive theories; the connection between meaning and justification; and the notion of ‘primitive normativity’. Inspired by the writings of J. M. Hinton (1967a, 1967b, 1973), but ushered into the mainstream by Paul Snowdon (1980–1, 1990–1), John McDowell (1982, 1986), and M. G. F. Martin (2002, 2004, 2006), disjunctivism is currently discussed, advocated, and opposed in the philosophy of perception, the theory of knowledge, the theory of practical reason, and the philosophy of action. But what is disjunctivism?

This paper contrasts the normative foundations of the stakeholder and shareholder theories of the firm. It demonstrates how the shareholder theory of the firm appears to have at least as much normative support as stakeholder theory and suggests that a way forward may be for a variant of pure shareholder theory to emerge.

Transitional justice scholars are increasingly concerned with measuring the impact of transitional justice initiatives. Scholars often assume that TJ mechanisms must be properly designed and ordered to achieve lasting effect, but the impact of TJ timing and sequencing has attracted relatively little theoretical or empirical attention. Focusing on Latin America, this article explores variation within the region as to when TJ occurs and the order in which mechanisms are implemented. We utilize qualitative comparative analysis to assess the impact of TJ (...) timing and sequencing on democratic development. We find little evidence for path dependency owing to the chronological order of mechanisms. We do find, however, that amnesties and trials approach a sufficient condition for democratic consolidation in Latin America; trials, however, come closest to being a necessary condition for successful democratic consolidation. The words we call slurs are just plain vanilla descriptions like ‘cowboy’ and ‘coat hanger’. They don't semantically convey any disparagement of their referents, whether as content, conventional implicature, presupposition, “coloring” or mode of presentation. What distinguishes 'kraut' and 'German' is metadata rather than meaning: the former is the conventional description for Germans among Germanophobes when they are speaking in that capacity, in the same way 'mad' is the conventional expression that some teenagers use as an intensifier when they’re emphasizing (...) that social identity. That is, racists don’t use slurs because they’re derogatory; slurs are derogatory because they’re the words that racists use. To use a slur is to exploit the Maxim of Manner (or Levinson’s M-Principle) to signal one’s affiliation with a group that has a disparaging attitude towards the slur’s referent. This account is sufficient to explain all the familiar properties of slurs, such as their speaker orientation and “nondetachability,” with no need of additional linguistic mechanisms. It also explains some features of slurs that are rarely if ever explored; for example the variation in tone and strength among the different slurs for a particular group, the existence of words we count as slurs, such as 'redskin', which almost all of their users consider to be respectful, and the curious absence in Standard English of any commonly used slurs—by which I mean words used to express a negative attitude toward an entire group—for Muslims and women. Abstract:This paper is a further development of two previous pieces of work (Moore 2002, 2005) in which modern virtue ethics, and in particular MacIntyre’s (1985) related notions of “practice” and “institution,” have been explored in the context of business. It first introduces and defines the concept of corporate character and seeks to establish why it is important. It then reviews MacIntyre’s virtues-practice-institution schema and the implications of this at the level of the institution in question—the corporation—and argues that the concept (...) of corporate character follows from, but is a novel development of, MacIntyre’s schema. The paper contrasts corporate character and virtues with the more familiar concepts of corporate culture and values. The constitutive and substantive elements of corporate character, including the essential corporate virtues, are then drawn out and illustrated with reference to the cases explored in Koehn (1998). Some expressions of English, like the demonstratives ‘this’ and ‘that’, are referentially promiscuous: distinct free occurrences of them in the same sentence can differ in content relative to the same context. One lesson of referentially promiscuous expressions is that basic logical properties like validity and logical truth obtain or fail to obtain only relative to a context. This approach to logic can be developed in just as rigorous a manner as David Kaplan’s classic logic of demonstratives. This article holds that governmental investments in quantum technologies speak to the imaginable futures of digital sovereignty and digital infrastructures, two major areas of change driven by related technologies like AI and Big Data, among other things, in international law today. Under intense development today for future interpolation into digital systems that they may alter, quantum technologies occupy a sort of liminal position, rooted in existing assemblages of computational technologies while pointing to new horizons for them. The possibilities they raise (...) are neither certain nor determinate, but active investments in them (legal, political and material investments) offer perspective on digital technology-driven influences on an international legal imagination. In contributing to visions of the future that are guiding ambitions for digital sovereignty and digital infrastructures, quantum technologies condition digital technology-driven changes to international law and legal imagination in the present. Privileging observation and description, I adapt and utilize a diffractive method with the aim to discern what emerges out of the interference among the several related things assembled for this article, including material technologies and legal institutions. In conclusion, I observe ambivalent changes to an international legal imagination, changes which promise transformation but appear nonetheless to reproduce current distributions of power and resources. After exploring MacIntyre’s (1985) practice—institution distinction, the article demonstrates its applicability to business-as-practice and to corporations as institutions. It then considers the implications of MacIntyre’s schema to ethical schizophrenia, to the claim that themarket is a source of the virtues and to the opposite claim that capitalism corrodes character. A fully worked out modern virtue ethics, based on MacIntyre’s work, is then established and the claim is made and substantiated that such an understanding of MacIntrye’s work revitalises it and makes (...) it directly applicable to business and to corporations. Arendt famously pointed out that only citizenship actually confers rights in the modern world. To be a citizen is to be one who has the ‘right to have rights’. Arendt’s analysis emerges out of her recognition that there is a contradiction between this way of conferring rights as tied to the nation-state system and the more philosophical and ethical conceptions of the ‘rights of man’ and notions of ‘human rights’ like those championed by thinkers such as Immanuel Kant who understands (...) rights belonging universally to all humans as a result of facts having to do with what it means to be human. Étienne Balibar, in his recent work, adds to this by pointing out that there is a contradictory movement between this universalizing tendency in philosophical thought and the production of the citizen-subject out of the exclusionary acts of law and force. In this article, I put Balibar’s work in dialogue with the contemporary moment where we are witnessing the re-emergence of a nativist right populism. I use Balibar to help distinguish between three modes of political existence that we find today. Two of these three are more or less well understood. They are the non-citizen, who has no – or almost no – rights in a given nation-state and the citizen who enjoys the full benefit of the rights a given nation-state has to give. The third category is what I term the ‘nominal citizen’. This last category is somewhere in between full citizenship and non-citizenship. Individuals in this last category have rights in name but are largely unable to exercise them. Understanding this last category can, among other things, help us at least partially make sense of the return of right populism and also help us see the ways in which the modern category of citizenship, with its contradictions as elaborated by Balibar, can provide a means for resistance. Jennifer Hornsby's account of human action frees us from the temptation to think of the person who acts as 'doing' the events that are her actions, and thereby removes much of the allure of 'agent causation'. But her account is spoiled by the claim that physical actions are 'tryings' that cause bodily movements. It would be better to think of physical actions and bodily movements as identical; but Hornsby refuses to do this, seemingly because she thinks that to do so (...) would be to endorse the so-called 'standard causal story'. But Hornsby misses a possibility here, for we can insist on this identity claim without endorsing the standard story if we embrace an account which parallels the disjunctive account in the philosophy of perception. This will leave us with a picture of physical action that saves the insights of Hornsby's account without succumbing to its distortions. (shrink)

This paper focuses on Mazzini as an ‘exemplary’ liberal nationalist, whose theory depends upon the difficult marriage of distinct ideological positions. The contention is not that liberalism and nationalism are necessarily incompatible, only that neglect of close textual analysis in specific cases has led to claims that are both theoretically untenable and historically misleading. By concentrating on Mazzini's theory of the state, I aim to highlight an area of his thought where he might have been expected to take full advantage (...) of available liberal argument. His failure to recognize the significance of liberal constitutional theory for a national polity should lead us to modify the conventional characterization of his view. On the wider question, a liberal nationalism may still remain a possibility; clinching arguments, however, cannot be drawn from Mazzini. (shrink)

This article relates the evolving relationship between republicanism and the problem of ‘empire’ to the changing social contexts within which republican political theory emerges in the early modern period. It is argued that the initial antagonism between republicanism and empire was a politically constituted dilemma that related to the specific configuration of economic and political power characteristic of pre-capitalist societies. With the development of capitalism in England in the early modern period, the problem of empire becomes partially resolved due to (...) the way in which the separation of economic and political power under capitalism reconstitutes the nature of empire itself. This new social context — characterized by new social, economic and political relationships specific to an emerging capitalist context — laid the foundations for the resolution of the ‘republican dilemma’ of empire and the ideological establishment of the first ‘Republican Empire’ in 18th century America. My aim in this essay is to explain how I think we should understand this thought. I suggest that, in a central class of cases, knowledge of one's intentional action is knowledge whose canonical linguistic expression is an utterance of the form “I am doing something to that G": knowledge in which the (...) subject, at once, knows himself “as self" (and so, not by observation), and knows an outer object “as other” (and so, by observation). To characterise this knowledge either as knowledge by observation, or as knowledge not by observation, is to characterise it in a manner that abstracts away from its fundamental unity. (shrink)

The use of machine learning systems for decision-support in healthcare may exacerbate health inequalities. However, recent work suggests that algorithms trained on sufficiently diverse datasets could in principle combat health inequalities. One concern about these algorithms is that their performance for patients in traditionally disadvantaged groups exceeds their performance for patients in traditionally advantaged groups. This renders the algorithmic decisions unfair relative to the standard fairness metrics in machine learning. In this paper, we defend the permissible use of affirmative algorithms; (...) that is, algorithms trained on diverse datasets that perform better for traditionally disadvantaged groups. Whilst such algorithmic decisions may be unfair, the fairness of algorithmic decisions is not the appropriate locus of moral evaluation. What matters is the fairness of final decisions, such as diagnoses, resulting from collaboration between clinicians and algorithms. We argue that affirmative algorithms can permissibly be deployed provided the resultant final decisions are fair. (shrink)

The product/process distinction with regards to “argument” has a longstanding history and foundational role in argumentation theory. I shall argue that, regardless of one’s chosen ontology of arguments, arguments are not the product of some process of arguing. Hence, appeal to the distinction is distorting the very organizational foundations of argumentation theory and should be abandoned.

A horseshoe is regarded as a lucky, perhaps even romantic, symbol of our industrial heritage. Why is it, then, that much of English literature, from Mandeville's ‘Grumbling Hive’ on, portrays business in a murky light? The paper begins with an analysis of this phenomenon and concludes that it is the institutionalisation and legitimisation of avarice and its consequential effects that gives rise to such a portrayal. A horseshoe has also been used as a convenient means of conceptualising an answer to (...) the questions this conclusion raises: ‘Who should control the corporation and for what ends?’ (Mintzberg 1985) and discussing recent developments in corporate social responsibility. Drawing on research evidence the paper demonstrates how corporations are simultaneously under pressure from society and responding to its concerns. The paper concludes that these current developments can at best ameliorate the situation, and that what is necessary is to rediscover the notion of corporate virtue, instead of putting virtue at the service of vice. In this paper the problematic nature of the morality of management, in particular related to business organisations operating under Anglo-American capitalism, is explored. MacIntyre’s critique of managers in After Virtue serves as the starting point but this critique is itself subjected to analysis leading to a more balanced and contemporary view of the morality of management than MacIntyre provides. Paradoxically perhaps, MacIntyre’s own virtues-goods-practice-institution schema is shown to provide a way of re-imagining business organisations and management and thereby holds out (...) the possibility of resolving the issue of the morality of management within such organisations. Allshorn, Geoff I believe the year in which I was born to be a very important year, perhaps not surprisingly, but particularly because of other events which would ultimately become significant in my own life.

In an earlier defense of the view that the fundamental logical properties of logical truth and logical consequence obtain or fail to obtain only relative to contexts, I focused on a variation of Kaplan’s own modal logic of indexicals. In this paper, I state a semantics and sketch a system of proof for a first-order logic of demonstratives, and sketch proofs of soundness and completeness. (I omit details for readability.) That these results obtain for the first-order logic of demonstratives shows (...) that the significance of demonstratives for logic exceeds their behavior as rigid designators in counterfactual reasoning, or reasoning about alternative possibilities. Furthermore, the results in this paper help address one common objection to the view that logical truth and consequence obtain only relative to contexts. According to this objection, the view entails that logical consequence is not formal. (shrink)

This paper argues against the view that trolley cases are of little or no relevance to the ethics of automated vehicles. Four arguments for this view are outlined and rejected: the Not Going to Happen Argument, the Moral Difference Argument, the Impossible Deliberation Argument and the Wrong Question Argument. In making clear where these arguments go wrong, a positive account is developed of how trolley cases can inform the ethics of automated vehicles.

Frege had not one but two different notions of sense, namely, that of ?Über Sinn und Bedeutung? and one implicit in a letter to Husserl of 1906 and elsewhere. This last one originates in Frege's notion of conceptual content. The distinction is used to clarify some obscurities in Frege's thought. In the last section a sort of ?explicans? of Frege's notion of conceptual content is introduced and applied to the semantic analysis of mathematics.

John McDowell espouses a certain conception of the thinking subject: as an embodied, living, finite being, with a capacity for experience that can take in the world, and stand in relations of warrant to subjects' beliefs. McDowell presents this conception of the subject as requiring a related conception of the world: as not located outside the conceptual sphere. In this latter conception, idealism and common-sense realism are supposed to coincide. But I suggest that McDowell's conception of the subject scuppers this (...) intended coincidence. The upshot is a dilemma: McDowell can retain his conception of the subject, but lose the coincidence; or he can keep the coincidence, but abandon his conception of the subject. (shrink)

The paper begins by exploring whether a “tendency to avarice” exists in most capitalist business organisations. It concludes that it does and that this is problematic. The problem centres on the potential threat to the integrity of human character and the disablement of community.What, then, can be done about it?
