O estudo desta extraordinária e multifacetada personalidade – filósofo, homem de ciência, escritor, orador exímio, pedagogo, político – e a análise da sua relação crítica com os poderes instituídos durante o período histórico (...) em apreço, dá-nos conta da enorme distância entre os projectos e intenções do movimento republicano e a obra social efectivamente conseguida pelo regime, ao mesmo tempo que se retratam as vicissitudes e os condicionamentos que a um tal resultado conduziram. Republicano de todas as horas, Leonardo nunca deixou de verberar no republicanismo aquilo que considerava serem erros de essência e de forma, desde os postulados positivistas até às lutas fratricidas em que, insensatamente, se empenharam os filhos da República. Mas também a sua palavra, celebrando momentos de heroicidade, de união, de glória, sobretudo um tributo ao povo republicano, ao povo humilde das grandes cidades, que tão abnegadamente amou a República e por ela se bateu. AI systems play an increasingly important role in shaping and regulating the lives of millions of human beings across the world. Calls for greater _transparency_ from such systems have been widespread. However, there is considerable ambiguity concerning what “transparency” actually means, and therefore, what greater transparency might entail. While, according to some debates, transparency requires _seeing through_ the artefact or device, widespread calls for transparency imply _seeing into_ different aspects of AI systems. These two notions are in apparent tension with (...) each other, and they are present in two lively but largely disconnected debates. In this paper, we aim to further analyse what these calls for transparency entail, and in so doing, clarify the sorts of transparency that we should want from AI systems. We do so by offering a taxonomy that classifies different notions of transparency. After a careful exploration of the different varieties of transparency, we show how this taxonomy can help us to navigate various domains of human–technology interactions, and more usefully discuss the relationship between technological transparency and human agency. We conclude by arguing that all of these different notions of transparency should be taken into account when designing more ethically adequate AI systems. (shrink)

In this innovative book, Gloria Frost reconstructs and analyses Aquinas's theories on efficient causation and causal powers, focusing specifically on natural causal powers and efficient causation in nature. Frost presents each element of Aquinas's theories one by one, comparing them with other theories, as well as examining the philosophical and interpretive ambiguities in Aquinas's thought and proposing fresh solutions to conceptual difficulties. Her discussion includes explanations of Aquinas's technical scholastic terminology in jargon-free prose, as well as background on medieval (...) scientific views - including ordinary language explanations of the medieval physical theories which Aquinas assumed in formulating his views on causation and causal powers. The resulting volume is a rich exploration of a central philosophical topic in medieval philosophy and beyond, and will be valuable especially for scholars and advanced students working on Aquinas and on medieval natural philosophy. Extended cognition brings with it a particular phenomenology. It has been argued that when an artifact is integrated into an agent’s cognitive system, it becomes transparent in use to the cognizing subject. In this paper, I challenge some of the assumptions underlying how the transparency of artifacts is described in extended cognition theory. To this end, I offer two arguments. First, I make room for some forms of conscious thought and attention within extended cognitive routines, and I question the close (...) association drawn between attention and effort. Second, I vindicate the importance of paying careful attention to individual differences and the diverse ways in which bodies and technologies can be experienced. I end by offering some hints toward an alternative, and more accurate, account of the phenomenology of extended cognition. (shrink)

Language is both a biological and a cultural phenomenon. Our aim here is to discuss, in an evolutionary perspective, the articulation of these two aspects of language. For this, we draw on the general conceptual framework developed by Ruth Millikan (1984) while at the same time dissociating ourselves from her view of language.

In chapter 4 of Autonomous Knowledge: Radical Enhancement, Autonomy and the Future of Knowing (OUP, 2021), Carter takes on the question of whether there is an epistemic autonomy condition on know-how, e.g. one that might rule out cases of radical performance enhancement as genuine cases of know-how. In this paper, I examine Carter’s proposal and identify an asymmetry in the way his epistemic autonomy condition is applied to enhanced and non-enhanced instances of know-how. In particular, it seems that either an (...) autonomy condition is required for all forms of knowledge-how or it is not. If it is, then a potential worry is that young children do not manifest their know-how when doing things that we would normally be inclined to say they know how to do. If it is not, then young children do manifest some forms of non-enhanced know-how. While Carter chooses the second option, I argue that it is better to choose the first one, that is, to claim that all know-how needs to be epistemically autonomous along the lines he has described. I also show how this does not exclude young children from knowing how to do things. (shrink)

According to the Extended knowledge dilemma, first formulated by Clark (Synthese 192:3757–3775, 2015) and subsequently reformulated by Carter et al. (in: Carter, Clark, Kallestrup, Palermos, Pritchard (eds) Extended epistemology, Oxford Univer- sity Press, Oxford, pp 331–351, 2018a), an agent’s interaction with a device can either give rise to knowledge or extended cognition, but not both at the same time. The dilemma rests on two substantive commitments: first, that knowledge by a subject requires that the subject be aware to some extent (...) of some features of that knowledge’s sources and, second, that cognitive processes can only be extended if the subject is mostly unaware of the external object. The overwhelming response to the dilemma by proponents of extended knowledge has been to reconcile the demands of knowl- edge with the requirement that genuine extended cognition must lack any conscious encountering of the external artifact that features in the putative extended cognitive process. My approach, thus far unexplored, will be the opposite: I show how extended cognition can be made compatible with a wide range of agential attitudes, including an active form of epistemic hygiene. Consequently, I open the door for a new way of vindicating the possibility of extended knowledge, and call into question some assumptions that lie at the core of extended cognition theory. (shrink)

Miranda Fricker has introduced the insightful notion of epistemic injustice in the philosophical debate, thus bridging concerns of social epistemology with questions that arise in the area of social and cultural studies. I concentrate my analysis of her treatment of testimonial injustice. According to Fricker, the central cases of testimonial injustice are cases of identity injustice in which hearers rely on stereotypes to assess the credibility of their interlocutors. I try here to broaden the analysis of that testimonial injustice by (...) indicating other mechanisms that bias our credibility assessments. In my perspective, the use of identity stereotypes is just one case among many biases in our credibility judgments. (shrink)

Although there is widespread agreement that our epistemic dependence on other people's knowledge is a key ingredient of our cognitive life, the role of trust in this dependence is much more open to debate. Is trust in epistemic authority—or “epistemic trust” for short—an epistemological notion in any sense, or is it simply a bridge-concept that connects our epistemological concerns to moral issues? Should we depict it in terms of the more familiar sociological notion of trust as a basis for cooperation?

In this chapter, I propose a new framework for extended epistemology, based on a second-wave approach to extended cognition. The framework is inclusive, in that it takes into account the complex interplay between the diverse embodiments of extended knowers and the salient properties of technological artifacts, as well as the environment in which they are embedded. Thus it both emphasizes and exploits the complementary roles played by these different elements. Beauty filters are automated photo editing tools that use artificial intelligence and computer vision to detect facial features and modify them, allegedly improving a face’s physical appearance and attractiveness. Widespread use of these filters has raised concern due to their potentially damaging psychological effects. In this paper, I offer an account that examines the effect that interacting with such filters has on self-perception. I argue that when looking at digitally-beautified versions of themselves, individuals are looking at AI-curated distorted mirrors. This (...) helps identify two potential cognitive effects of this behavior. First, it can elicit affective attitudes that change how individuals feel when looking at their unfiltered self-images. Second, exposure to filtered self-images might cause a perceptual normalization of such images. Finally, I argue that this form of distorted mirror gazing is a novel cultural practice for self-perception, and I highlight some ways in which this practice could be critically evaluated and ultimately changed. This paper examines what it takes for a state of knowledge-how to be extended (i.e. partly constituted by entities external to the organism) within an anti-intellectualist approach to knowledge-how. I begin by examining an account of extended knowledge-how developed by Carter, J. Adam, and Boleslaw Czarnecki. 2016 [“Extended Knowledge-How.” Erkenntnis 81 (2): 259–273], and argue that it fails to properly distinguish between cognitive outsourcing and extended knowing-how. I then introduce a solution to this problem which rests on the distribution of (...) tasks between agent and non-biological entity. On closer inspection, I show that this solution is ultimately unsatisfactory, though its failure is instructive as it illuminates the important role played by an agent’s skilled interaction with an external entity. Drawing on key anti-intellectualist ideas, as well as on insight from cognitive psychology, I propose an account according to which what ultimately matters for extending knowledge-how is whether a hybrid ability is self-regulated. In closing, I illuminate the practical value of extended knowledge-how vis-à-vis cognitive outsourcing. (shrink)

In this study, the tahrîj method, which is used in answering contemporary Fiqh issues throughout the history of Fiqh, will be described and some sample fatwas given by the High Board of Religious Affairs based on this method will be analysed. Tahrîj is firstly to define the procedural and legal principles on which the singular views of a madhhab imam is based on, and then to determine the verdict of the issues in which an opinion from that imam is not (...) conveyed, according to the rules reached. Firstly the High Board of Religious Affairs will be introduced briefly highlighting issues such the effort put forward by the Board in the answering current fiqh issues, its contributions to the unity of fatwa and that it is a continuation of the Islamic Meşîhat-ı İslamiyye in the Ottoman Empire. Tahrîj, will be defined and its types, history, and its role in the development of fiqh and in solving current fiqh issues will be explained. Among the issues resolved by the High Board of Religious Affairs by applying the Tahrîj method or by making use of this method; commercial insurance, organ transplantation, gold-based lease certificate and the effect of injection/vaccine on fasting will be analysed. Given these exemplary fatwas, it will be tried to show that the method of Tahrîj is important today as it was in the past, both in terms of maintaining the consistency of fiqh and its contribution to the development of fiqh. BackgroundThe idea that individuals are responsible for their health has been the focus of debate in the theoretical literature and in its concrete application to healthcare policy in many countries. Controversies persist regarding the form, substance and fairness of allocating health responsibility to the individual, particularly in universal, need-based healthcare systems.ObjectiveTo examine how personal health responsibility has been framed and rationalised in Norwegian key policy documents on priority setting.MethodsDocuments issued or published by the Ministry of Health and Care Services between (...) 1987 and 2018 were thematically analysed. We developed a predefined conceptual framework that guided the analysis. The framework included: the subject and object of responsibility, the level of conceptual abstraction, temporality, normative justificatory arguments and objections to the application of personal health responsibility.ResultsAs an additional criterion, personal health responsibility has been interpreted as relevant if: the patient’s harmful behaviour is repeated after receiving treatment, and if the success of the treatment is conditional on the patient’s behavioural change. When discussed as a retrospective criterion, considerations of reciprocal fairness have been dominant. When discussed as a prospective criterion, the expected benefit of treatment justified its relevance.ConclusionPersonal health responsibility appears to challenge core values of equality, inclusion and solidarity in the Norwegian context and has been repeatedly rejected as a necessary criterion for priority setting. However, the responsibility criterion seems to have some relevance in particular priority setting decisions. (shrink)

In this paper I argue that the epistemology of trust and testimony should take into account the pragmatics of communication in order to gain insight about the responsibilities speakers and hearers share in the epistemic access they gain through communication. Communication is a rich process of information exchange in which epistemic standards are negotiated by interlocutors. I discuss examples which show the contextual adjustment of these standards as the conversation goes on. Our sensitivity to the contextual dimension of epistemic standards (...) make us more responsible communicators. (shrink)

This paper reconstructs and analyzes Thomas Aquinas’ intriguing views on transeunt causal activity, which have been the subject of an interpretive debate spanning from the fifteenth century up until the present. In his Physics commentary, Aquinas defends the Aristotelian positions that the actualization of an agent’s active potential is the motion that it causes in its patient and action and passion are the same motion. Yet, in other texts, Aquinas claims that action differs from passion and “action is in the (...) agent” as subject. This paper proposes a solution for how to reconcile Aquinas’ varying claims about what transeunt causal activity is in reality. In addition to advancing understanding of Aquinas’ views on causal activity, the paper also offers insights into more general topics in his thought, such as the relationship between actualities and accidents and the nature of extrinsic accidents. This article enriches discussions about the metaphysics of normative facts with conceptual resources from social ontology that metaethics has neglected so far: the resources of Haslanger’s critical realism as social constructionism. By pointing out the viability of understanding reasons as socially constructed facts, the article shows how normative facts can be understood as features of mind-independent reality that are, however, not features of the universe independently of social practices. The move into social ontology allows us to understand normative facts as (...) mind-independent in a more substantial sense than deflationists do, by stressing individual mind-independence, while denying collective mind-independence – the subsistence independently of established human cultures. The new position can fruitfully mediate between realism, error theory and constructivism. Finally, the metaphysical nuances provided by social ontology pave the way for novel approaches to normative change and progress – thereby indicating pathways to normative theorising that many traditional metaethical positions lack. The relationship between divine and created causality was widely discussed in medieval and early modern philosophy. Contemporary scholars of these discussions typically stake out three possible positions: occasionalism, concurrentism, and mere-conservationism. It is regularly claimed that virtually no medieval thinker adopted the final view which denies that God is an immediate active cause of creaturely actions. The main aim of this paper is to further understanding of the medieval causality debate, and particularly the mere-conservationist position, by analysing Peter John Olivi's (...) neglected defence of it. A notion that comes from the toolbox of social sciences, trust has become a mainstream epistemological concept in the last 15 years. The notion of epistemic trust has been distinguished from the notion of moral and social trust, the former involves kinds of inferences about the others that are rationally justifiable. If I trust a scientist about the efficacy of a vaccine against COVID-19, I must have an epistemic justification. I am therefore rationally justified in trusting her because I have (...) an epistemic reason to justify my belief. I will challenge the distinction between epistemic and moral and social trust by pointing to several social indicators that contribute to our trustful attitudes in a reasonable way. Social indicators of reputation, values and moral commitments to values are indispensable strategies to come to trust in a rational way, an attitude that is different from merely believing the truth. I also point out the fragility of trusting experts’ reputations and stress the importance of avoiding biases in trusting other people’s reputations to make our deference to experts more robust. The aim of this commentary is to complement Haslanger’s view of cognition as a skill shaped by culture. I start by presenting an empirically oriented account of the process of enculturation based on the cognitive integration framework. I then illustrate the active role of material (and not just symbolic) culture in cognition by drawing on extended cognition theory. Finally, I argue that embedding Haslanger’s work within these two theories of cognition better serves the objectives of her project and, at the (...) same time, promotes a critical philosophy of cognitive science. Lifestyle-induced diseases are becoming a burden on healthcare, actualizing the discussion on health responsibilities. Using data from the National Association for Heart and Lung Diseases ’s 2015 Health Survey, this study examined the public’s attitudes towards personal and social health responsibility in a Norwegian population. The questionnaires covered self-reported health and lifestyle, attitudes towards personal responsibility and the authorities’ responsibility for promoting health, resource-prioritisation and socio-demographic characteristics. Block-wise multiple linear regression assessed the association between attitudes towards health responsibilities and individual (...) lifestyle, political orientation and health condition. We found a moderate support for social responsibility across political views. Respondents reporting unhealthier eating habits, smokers and physically inactive were less supportive of health promotion policies. The idea that individuals are responsible for taking care of their health was widely accepted as an abstract ideal. Yet, only a third of the respondents agreed with introducing higher co-payments for treatment of ‘self-inflicted’ conditions and levels of support were patterned by health-related behaviour and left-right political orientation. Our study suggests that a significant support for social responsibility does not exclude a strong support for personal health responsibility. However, conditional access to healthcare based on personal lifestyle is still controversial. (shrink)

We monitor the informational environment and catch reputational cues, gather signals from our informants and develop our trustful attitudes in context. I present an epistemology of reputation as a way of using social configurations to acquire information. I review the definitions of reputation that exist in the social sciences, stress the importance of the relational/social dimension of reputation as a property of entities, and put forward a definition of reputation suitable for epistemology. Avrupa Fetva Meclisi, çoğu Batı’da ikame eden hem şerî delilleri hem de vâkıayı bilen kıymetli âlimleri bünyesinde toplamış ilmi bir müessesedir. 1997 yılında Yûsuf el-Karadâvî’nin (1926-2022) başkanlığında kurulmuştur. Bu tarihten itibaren özellikle de Batı’da yaşayan müslümanları ilgilendiren ve müslüman ülkelerde gözlemlenen problemlerden ciddi manada farklılaşan önemli fıkhî meseleleri gündemine taşımış, ürettiği çözümlerle hem oradan yaşayan hem de benzer problemlerle yüzleşen Müslümanlar için referans niteliğinde karar ve fetvalara imza atarak, kendisine başvurulan ilmi bir merci haline gelmiştir. Kuruluşundan günümüze Meclis’in yapısını konu (...) edinen ve genel ya da aile hukuku veya muamelat gibi, özel bazı meseleler bağlamında izlediği fetva yöntemine ilişkin farklı dillerde bazıları akademik tarzda pek çok çalışma yapılmıştır. Meclis, 2023 yılında İstanbul’da icra ettiği toplantısını bu tarihe kadar yaptığı çalışmalar ve kendisine yöneltilen tenkitlere hasretmiş, toplantıda Meclis’i farklı yönleriyle değerlendiren çok sayıda bildiri sunulmuştur. Bu çalışma da aynı gayeye hizmet etmek maksadıyla Meclis’in fetvalarını neşrederken izlediği metodu, fıkıh ve fetva usulü kuralları bağlamında eleştirel bir bakış açısıyla değerlendirmek üzere kaleme alınmıştır. Değerlendirme, fetvanın muteber sayılabilmesi için müftüde aranan ilmi ehliyet ve adalet şartlarıyla sınırlandırılmıştır. Bu bağlamda öncelikle fıkıh meclislerinin fıkıh ilmine yaptığı katkıdan bahseden bir giriş yapılmış, ardından Meclisle ilgili tanıtıcı kısa bir malumat verilerek, “ekalliyyât fıkhı” olarak da bilinen alanda doldurduğu boşluk başta olmak üzere, diğer fıkıh meclislerinden olumlu yönde ayrıldığı hususiyetlerine değinilmiştir. Fetvanın kabul edilmesi için gerekli şartlar meşhur usul kitaplarıyla iktifa edilerek tahlil edilerek aktarılmış, Meclis’in neşrettiği fetva ve kararların bu kurallara uygunluğu tartışılarak, diğer fıkıh meclisleriyle mukayese imkânı oluşturabilmek için onlar tarafından neşredilmiş karar ve fetvalara da yer verilmiştir. Çalışmanın sonucunda Meclisin, karar ve fetvaların kimler tarafından alındığını ilan etmemek suretiyle kriter olarak belirlenen fetva usulü kurallarına riâyet etmediği anlaşılmış, diğer fıkıh meclislerinin de çoğunlukla aynı problemle malul olduğu sonucuna varılmıştır. Çalışma, tespit edilen problemlerin çözümü için bazı tavsiyelerin de yer aldığı bir sonuçla tamamlanmıştır. Çalışmanın, ulaştığı sonuçlarla fetva müesseselerinin bu faaliyeti icra ederken fetva usulü çerçevesinde hareket etmelerine rehberlik edecek ölçüler ortaya koymak suretiyle alana katkı sağlaması umulmaktadır. Bunun yanında, hangi isimle anılırsa anılsın kurumsal olarak fetva neşreden müesseselerin, özelde ise Avrupa Fetva Meclisi’nin kararlarıyla amel eden ya da karar ve fetvalarını esas alarak fetva veren veya çalışmalarında istifade eden araştırmacı ve müftülerde farkındalık oluşturması ümit edilmektedir. According to complexity economics, a speculative bubble is a paradigmatic case of emergence which forms from individual behaviour. In order to provide a more detailed ontological investigation of this ‘lower level’, this paper aims to understand what a transaction is and how people actualize their financial choices. Given that selling and buying operations may involve just machines, it is argued that collective intentionality, at least in John Searle’s version, is not successful. It would seem, therefore, that the pivotal role is (...) played by documents. The paper focuses mostly on the documents’ capacity to anchor quasi-abstract entities to reality and to attribute social and economic properties, such as property having a certain value. The latter is clearly involved in the emergence of a bubble. (shrink)

In this paper I try to challenge some received views about the role and the function of the traditional academic practice of publishing papers in peer?reviewed journals. I argue that our publishing practices today are rather based on passively accepted social norms and humdrum work habits than on actual needs for communicating the advancements of our research. By analysing some examples of devices and practices that are based on tacitly accepted norms, such as the Citation Index and the new role (...) of DOI attributions in digital publishing, I advocate an epistemically vigilant stance not only towards our ways of acquiring knowledge, but also towards the implicit norms we accept when we produce research. I show that Scotus departed from his standard theory of how God knows contingents when explaining how God knows sins. God cannot know sins by knowing a first-order act of his will, as he knows other contingents according to Scotus, since God does not directly will sins. I suggest that Scotus’s recognition that his standard theory of God’s (...) knowledge of contingents could not account for how God knows sins may have contributed to his ultimate rejection of this theory. Many countries employ systemic methods of protecting consumers from unfair business practices. One such practice is the use of abusive clauses in business-to-consumer (B2C) contracts, which unfairly impose additional obligations on the consumer or deprive them of their due rights. This article presents an information system that utilizes artificial intelligence methods to automate contract analysis and to detect abusive clauses. The goal of the system is to support the entire administrative process, from contract acquisition, through text extraction and the recommendation (...) of potentially abusive clauses, to the generation of official administrative documents that can be sent to court or to the owners of firms. This article focuses on the components that use machine learning methods. The first is an intelligent crawler that is responsible for automatically detecting contract templates on websites and retrieving them into the system. The second is a document analysis module that implements a clause recommendation algorithm. The algorithm employs transformer-based language models and information retrieval methods to identify abusive passages in text. Our solution achieved first place in a competition on the automatic analysis of B2C contracts organized by the Polish Office of Competition and Consumer Protection (UOKiK), and has since been implemented as an official tool to support the contract analysis process in Poland. Both Thomas Aquinas and John Duns Scotus were committed to the view that effects with a contingent modality exist in the created world. This is to say that there are things that could have been otherwise. This chapter explores their respective accounts of the ontological reason for why there are effects with a contingent modality. Leibniz considered Aquinas’s and Scotus’s views on this issue, concluding that they were in fundamental disagreement about the ‘root of contingency.’ This chapter first makes a (...) distinction between two different senses in which an object can have a contingent modality, one having to do with causation and the other with modes of existence. Then it applies this distinction to Aquinas’s and Scotus’s texts to show that their views on why there is contingency in creation are in fact quite similar. (shrink)

Should fear guide our actions and governments’ political decisions? A leitmotiv of common sense is that emotions are tricky, they blur our rational capacity of estimating utilities in order to plan action and thus they should be banned from any account of our rational expectations. In this paper I argue that an “heuristic of fear” is the appropriate attitude to adopt in order to cope with extreme risks. I thus defend the Precautionary Principle against the criticism put forward by Cass (...) Sunstein and other authors on the basis of a new analysis of extreme risks or “ruin-problems”. (shrink)

The verb “to conjure” is a complex one, for it includes in its standard definition a great range of possible actions or operations, not all of them equivalent, or even compatible. In its most common usage, “to conjure” means to perform an act of magic or to invoke a supernatural force, by casting a spell, say, or performing a particular ritual or rite. But “to conjure” is also to influence, to beg, to command or constrain, to charm, to bewitch, to (...) move or convey, to imagine, to visualize, to call to mind, or to remember. —Rachael DeLue 2012, para 1.When we create with our Brown hands, feminine energy, and full spirits, we conjure. To exist, survive, and thrive in these bodies is a continuous act of conjuring. Our walks conjure. Our smiles conjure. Our tears conjure. Our laughs conjure. Our words conjure. Our artworks are conjurings. We, a Black/Filipina-American woman, a Dominican-American, and a Black-American woman, are guided by our solidarity with one another and all other Black and Brown female identifying persons whose raced and gendered subjectivities exist both inside and outside of colonization, white supremacy, and patriarchy. We bring to life our colored imaginations and curiosities, and share them with the world. We are united by our need for safety, autonomy as beings, dissolution of trauma, and desire to ask, “What would happen if I…?” Imaginative, curious Women of Color founded the underground railroad, guided captured Africans and Tainos to the mountains, ignited the Civil Rights Movement, organized laborers and immigrants, birthed the #BlackLivesMatter Movement, conceived the #MeToo Movement, and so much more. Like our kindred counterparts, we have an unrelenting urge to examine, question, wonder, desire, speak to, lead, be curious, and “conjure.” As practicing artists and art educators, our critical arts-based practices are grounded in intersectional feminisms like Womanism, Black Feminist Theory, and Chicana Feminist Theory, which allow us to do these very things. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. Arthur Peacocke, biochemist and theologian, recognized that this challenge actually represents an opportunity for Christian theology to reenvision and reinterpret its traditions in ways that take into account scientific theories of evolution. In the course of his career, Peacocke offered a new paradigm for the dialogue between theology and science. This paper explores his proposals, in particular his theories of language, the God‐world relation, and the nature of God, (...) and exemplifies the impact these proposals had on his theological insights. The author argues for passing on a particular brand of feminism to next generations. The cultural archive to be passed on should be transnational, intersectional, interdisciplinary, relational and reflexive. In particular, the author focuses on processes and practices of racialization as they impact on and are practised within the discipline. In the current backlash against feminism and women’s studies in different parts of Europe, frequently divisionary tactics are deployed, by which women are pitted against each other, based on assumed immutable (...) differences which are conceived of as either ‘raciological’, ethnicized or as cultural, in such a way that ‘race’ enters again through the back door. The author argues that we need a European brand of feminism that is not complicit with the legacies of modernity, which continue to construct ‘race’. That is, we should be deeply concerned with thinking through the parameters of a viable anti-racist European women’s studies. By analysing various case studies, taken from the everyday Dutch reality at the beginning of this new millennium, the author shows the necessity and inescapability of the feminism she advocates. El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. El libro busca aportar al estudio del daño ambiental desde los avances antes descritos en la materia. (shrink)
