The discretionary powers of welfare state professionals are in tension with the requirements of the democratic Rechtsstaat. Extensive use of discretion can threaten the principles of the rule of law and relinquish democratic control over the implementation of laws and policies. These two tensions are in principle ineradicable. But does this also mean that they are impossible to come to grips with? Are there measures that may ease these tensions? We introduce an understanding of discretion that adds an epistemic dimension (...) (discretion as a mode of reasoning) to the common structural understanding of discretion (an area of judgment and decision). Accordingly we distinguish between structural and epistemic measures of accountability. The aim of the former is to constrain discretionary spaces or the behaviour within them while the aim of the latter is to improve the quality of discretionary reasoning. The focus in this article is on epistemic measures that are internally related to the main characteristic of accountability, namely justified use of discretionary power. (shrink)

Chloride channels are probably found in every cell, from bacteria to mammals. Their physiological tasks range from cell volume regulation to stabilization of the membrane potential, signal transduction, transepithelial transport and acidification of intracellular organelles. These different functions require the presence of many distinct chloride channels, which are differentially expressed and regulated by various stimuli. These include various intracellular messengers (like calcium and cyclic AMP), pH, extracellular ligands and transmembrane voltage. Three major structural classes of chloride channels are known to (...) date, but there may be others not yet identified. After an overview of the general functions of chloride channels, this review will focus on these cloned chloride channels: the CLC chloride channel family, which includes voltage‐gated chloride channels, and the cystic fibrosis transmembrane regulator (CFTR), which performs other functions in addition to being a chloride channel. Finally, a short section deals with GABA and glycine receptors. Diseases resulting from chloride channel defects will be specially emphasized, together with the somewhat limited information about how these proteins work at the molecular level. (shrink)

The debate between liberal contractualists and political perfectionists has recently changed its focus: now, the most important issue is no longer the problem of neutrality of justification but the practical problem of comprehensive inclusion of marginalized social groups. This paper argues that the contractualists′ principle of neutrality is incompatible with the principle of inclusion. The second thesis to be defended is that perfectionism is only able to assert its constructive position as a philosophy of inclusion as long as it is (...) not restricted to a vague, partial theory of the good, but is based on a comprehensive moral ideal that recognizes individuals as equals in their diversity. David Furley's work on the cosmologies of classical antiquity is structured around what he calls "two pictures of the world." The first picture, defended by both Plato and Aristotle, portrays the universe, or all that there is (to pan), as identical with our particular ordered world-system. Thus, the adherents of this view claim that the universe is finite and unique. The second system, defended by Leucippus and Democritus, portrays an infinite universe within which our particular kosmos is only one of (...) countless kosmoi. Aristotle's argument in De caelo I.9 that the world is necessarily unique is an important contribution to this debate. This argument holds interest because it shows Aristotle wrestling with an apparent inconsistency in his own philosophy, as deeply-held convictions within his cosmology collide with an equally deeply-held conviction within his metaphysics. The following three principles, each of which Aristotle appears committed to, are inconsistent: -/- The cosmic uniqueness principle. The world is necessarily unique. The cosmic form principle. The world is an ordered, structured unity. As such, the world has a form. The possibility of multiple instantiation principle. For all F, if F is a form, it is possible that there exist multiple Fs. In De caelo I.9, Aristotle argues that we can establish the uniqueness of the universe, reject the multiple instantiation principle, yet still retain the distinction between 'this world' and 'world in general,' if the following is true (as it is): the world takes up all the matter that exists. Aristotle illustrates this argument with one of the stranger analogies in his corpus: imagine an aquiline nose that takes up all the flesh in the universe. If this were so, then there could not exist any other aquiline objects whatsoever. (For this reason, we dub the De caelo I.9 argument the 'Cosmic Nose argument.') This paper is an interpretation of how this argument is supposed to proceed and an assessment of its success. The first section states the problem Aristotle is confronted with, sorts through Aristotle's various statements of the Cosmic Nose argument, which exhibit some sloppiness, and reconstructs charitably a single argument. We also spend some time examining the significance of Aristotle's example of a gigantic aquiline nose. We argue that, even charitably reconstructed, the argument appears to commit a serious modal fallacy. The remainder of the paper explores whether this modal fallacy can be overcome. We conclude that, although not a cogent argument for the uniqueness of the world (as this would require a significant revision of our current astronomy), the Cosmic Nose argument does succeed on its own terms. However, it should not be regarded as a free-standing argument for the uniqueness of the world. Instead, it depends crucially on the earlier argument in De caelo I.8 for the universe's uniqueness; De caelo I.9 should be viewed as an attempt to extend the conclusion of De caelo I.8 and to show how this conclusion can be made consistent with Aristotle's metaphysical principles about the nature of form. Using connectionist modelling, Thomas & Karmiloff-Smith (T&K-S) claim that developmental disorders in children are characterised by atypical trajectories and an ultimate functional architecture that is fundamentally different from normal. We argue that there is no empirical evidence for these claims in any developmental disorder and that the available evidence provides support for Residual Normality in both developmental and acquired disorders. We also refute the claim that modular accounts cannot encompass developmental trajectories in children with developmental disorders.

Contributors probe this relationship by way of topics from poetics of human-jellyfish interactions to a feminist reconsideration of a well-known thought experiment in thermodynamics. Two contributors analyze plant-insect encounter research to spin their own symbiotically inflected account (...) of “affective ecologies.” Technologies of human memory storage and retrieval lead one writer to interrogate how our understandings of memory and amnesia are currently under revision. Another contributor tracks the lively evolutionary and morphological theories that textile artisans manifest in material models of sea creatures. Are culture driven ethical conflicts apparent in the discourse of the protagonists? A multi-year, multi-cultural study of managers by Trompenaars and Hampden-Turner resulted in two conclusions relevant to business ethics. The first is that intercultural business conflicts can often be traced to a finite set of cultural differences. The second is that enough similarities exist between cultures to provide the grounds for conflict resolution. The research reported here gives credence to their study when applied to an ethical conflict viewed from (...) French and American perspectives. (shrink)

L. M. de Rijk supposed in 1982 that two anonymous logical tracts in the Viennese Codex 4698, fol. 18r–27v, may be the work of Martinus Anglicus to whom a tract on consequences and one on obligations are ascribed in that codex. The tract on supposition of which the Viennese codex hands down only a fragment of the beginning is contained completely in Hs I 613 of the Stadtbibliothek Mainz, fol. 20vb–21vb. This finding ensures the authorship of Martinus Anglicus and allows (...) to ascribe an Introduction into Logic in some seven parts to him. Martin’s tract on supposition and the more detailed one by Thomas Manlevelt show some resemblances in structure and content, the first being presumably the later one. This paper presents an edition of Martin’s Tractatus de suppositione from the Mainz manuscript and an introduction regarding the author and his work. (shrink)

Withholding or withdrawing life-saving ventilators can become necessary when resources are insufficient. In the USA, such rationing has unique social justice dimensions. Structural elements of dominant allocation frameworks simultaneously advantage white communities, and disadvantage Black communities—who already experience a disproportionate burden of COVID-19-related job losses, hospitalisations and mortality. Using the example of New Jersey’s Crisis Standard of Care policy, we describe how dominant rationing guidance compounds for many Black patients prior unfair structural disadvantage, chiefly due to the way creatinine and (...) life expectancy are typically considered.We outline six possible policy options towards a more just approach: improving diversity in decision processes, adjusting creatinine scores, replacing creatinine, dropping creatinine, finding alternative measures, adding equity weights and rejecting the dominant model altogether. We also contrast these options with making no changes, which is not a neutral default, but in separate need of justification, despite a prominent claim that it is simply based on ‘objective medical knowledge’. In the regrettable absence of fair federal guidance, hospital and state-level policymakers should reflect on which of these, or further options, seem feasible and justifiable.Irrespective of which approach is taken, all guidance should be supplemented with a monitoring and reporting requirement on possible disparate impacts. The hope that we will be able to continue to avoid rationing ventilators must not stand in the way of revising guidance in a way that better promotes health equity and racial justice, both to be prepared, and given the significant expressive value of ventilator guidance. This book investigates the metaphysical position of dual-aspect monism, with particular emphasis on the concept of meaning as a fundamental feature of the fabric of reality.

The Covid‐19 pandemic needs to be considered from two perspectives simultaneously. First, there are questions about which policies are most effective and fair in the here and now, as the pandemic unfolds. These polices concern, for example, who should receive priority in being tested, how to implement contact tracing, or how to decide who should get ventilators or vaccines when not all can. Second, it is imperative to anticipate the medium‐ and longer‐term consequences that these policies have. The case of (...) vaccine rationing is particularly instructive. Ethical, epidemiological, and economic reasons demand that rationing approaches give priority to groups who have been structurally and historically disadvantaged, even if this means that overall life years gained may be lower. This book offers fresh perspective on the role of phenomenology in the philosophy of physics which opens new avenues for discussion among physicists, "standard" philosophers of physics and philosophers with phenomenological leanings. Much has been written on the interrelations between philosophy and physics in the late 19th and early 20th century, and on the emergence of philosophy of science as an autonomous philosophical sub-discipline. This book is about the under-explored role of phenomenology in the development and the philosophical interpretation of (...) 20th century physics. Part 1 examines questions about the origins and value of phenomenological approaches to physics. Does the work of classical phenomenologists such as Husserl, Merleau-Ponty or Heidegger contain elements of systematic value to both the practice and our philosophical understanding of physics? On this interpretation, Arcesilaus and Carneades practiced the same, purely dialectical method -- they would elicit assent (...) to premises characteristic of their interlocutor's position and then derive unacceptable consequences exclusively on the basis of those premises. This method allowed them to remain uncommitted to the premises as well as the conclusions of their arguments. They would simply draw logical consequences from their opponents' own premises for the sake of refutation. This is in keeping with the current consensus that an ancient skeptic is one who has no beliefs, or at least no beliefs of a problematically dogmatic sort. Consequently, the methods of ancient skeptics, including Academic skeptics, are thought to be strictly negative, seeking only the elimination of belief. So when we come to Cicero's Philonian version of Academic methodology and find that it explicitly includes provisions for the acquisition of fallible beliefs, it is no surprise that commentators who are sympathetic to the dialectical interpretation tend to view.. Following much work in linguistic theory, it is hypothesized that the language faculty has a modular structure and consists of two basic components, a lexicon of (structured) entries and a computational system of combinatorial operations to form larger linguistic expressions from lexical entries. This target article provides evidence for the dual nature of the language faculty by describing recent results of a multidisciplinary investigation of German inflection. We have examined: (1) its linguistic representation, focussing on noun plurals and verb inflection (...) (participles), (2) processes involved in the way adults produce and comprehend inflected words, (3) brain potentials generated during the processing of inflected words, and (4) the way children acquire and use inflection. It will be shown that the evidence from all these sources converges and supports the distinction between lexical entries and combinatorial operations. (shrink)

Abstract Not much scholarly work is needed in order to stumble across many passages where Edmund Husserl seems to advocate an anti-realist attitude towards the natural sciences. This tendency, however, is not well-received within the secondary literature. While some commentators criticize Husserl for his alleged scientific anti-realism, others argue that Husserl's position is much more realist than the first impression indicates. It is against this background that I want to argue for the following theses: a) The basic outlook of Husserl's (...) epistemology as well as his more substantial comments regarding the natural sciences indeed result in a (sophisticated version of) scientific anti-realism which bears certain resemblances to Bas van Fraassen's constructive empiricism; b) This scientific anti-realism can be defended against the two most common objections raised in the secondary literature; c) It is only by means of this sophisticated version of scientific anti-realism that phenomenology can circumvent the problem of ?scientific objectivism? It is widely accepted that consciousness or, more generally, mental activity is in some way correlated to the behavior of the material brain. Since quantum theory is the most fundamental theory of matter that is currently available, it is a legitimate question to ask whether quantum theory can help us to understand consciousness. Several approaches answering this question affirmatively, proposed in recent decades, will be surveyed. It will be pointed out that they make different epistemological assumptions, refer to different neurophysiological (...) levels of description, and use quantum theory in different ways. 1,857 adults rated the grandparental solicitude they received in childhood. Through a simple model based on the evolutionary concepts of ontogenetically differentiated reproductive strategy and paternity confidence, an ordered discriminative pattern of grandparental caregiving was predicted and confirmed by solid main effects, based on 603 complete cases. The maternal grandmother was the most caring. Unlike prevalent gender stereotypes, she was followed by the maternal grandfather, the paternal grandmother, and the paternal grandfather. The preferential grandparental solicitude was not influenced by residential (...) distance, grandparent age, and availability of other grandparents. A predicted higher correlation for male than for female progenitors between solicitude and phenotypic resemblance could be confirmed. (shrink)

Quentin Meillassoux has recently launched a sweeping attack against ‘correlationism’. Correlationism is an umbrella term for any philosophical system that is based on ‘the idea [that] we only ever have access to the correlation between thinking and being, and never to either term considered apart from the other’. Thus construed, Meillassoux' critique is indeed a sweeping one: It comprises major parts of the philosophical tradition since Kant, both in its more continental and in its more analytical outlooks. In light of (...) this critique, the aim of this paper is twofold: On the one hand, I shall defend phenomenology against Meillassoux' main argument, the ‘argument from ancestrality’. On the other hand, I will argue that this argument, albeit unsuccessful in its original form, can be modified to pose a more serious threat. Although this modified version can also be circumvented, it forces phenomenologists to clarify their stance towards the natural sciences. (shrink)

A novel conceptual framework for theoretical psychology is presented and illustrated for the example of bistable perception. A basic formal feature of this framework is the non-commutativity of operations acting on mental states. A corresponding model for the bistable perception of ambiguous stimuli, the Necker–Zeno model, is sketched and some empirical evidence for it so far is described. It is discussed how a temporal non-locality of mental states, predicted by the model, can be understood and tested.

Implementing equity principles in resource allocation is challenging. In one approach, some US states implemented race-based prioritisation of COVID-19 vaccines in response to vast racial inequities in COVID-19 outcomes, while others used place-based allocation. In a nationally representative survey of n=2067 US residents, fielded in mid-April 2021, we explored the public acceptability of race-based prioritisation compared with place-based prioritisation, by offering vaccines to harder hit zip codes before residents of other zip codes. We found that in general, a majority of (...) respondents supported the place-based approach, and a substantial proportion supported the race-based plan. Support was higher among Democrats compared with Republicans. All US residents became eligible for vaccines on 19 April 2021 but as of this writing, equitable uptake of vaccines remains urgent not only for first doses for adults but also for boosters and for children. Our findings also provide a benchmark for future pandemic planning that racial and social justice in vaccine allocation are salient considerations for the public. The findings may furthermore be of interest to policy makers designing vaccine allocation frameworks in countries with comparable health disparities across social, ethnic and racial groups, and more broadly, for those exploring ways of promoting equity in resource allocation outside of a pandemic setting. Dual-aspect monism and neutral monism offer interesting alternatives to mainstream positions concerning the mind-matter problem. Both assume a domain underlying the mind-matter distinction, but they also differ in definitive ways. In the twentieth century, variants of both positions have been advanced by a number of protagonists. One of these variants, the dual-aspect monism due toWolfgang Pauli and Carl Gustav Jung, will be described and commented on in detail. As a unique feature in the Pauli-Jung conception, the duality of mental and (...) material aspects is specified in terms of a complementarity. This sounds innocent, but entails a number of peculiarities distinguishing their conjecture from other approaches. (shrink)

The dual-aspect monist conjecture launched by Pauli and Jung in the mid-20th century will be couched in somewhat formal terms to characterize it more concisely than by verbal description alone. After some background material situating the Pauli–Jung conjecture among other conceptual approaches to the mind–matter problem, the main body of this paper outlines its general framework of a basic psychophysically neutral reality with its derivative mental and physical aspects and the nature of the correlations that connect these aspects. Much in Responsible Research and Innovation (RRI) is part of a participatory turn within the Technology Assessment (TA) and Science and Technology Studies (STS) community. This has an influence also on the evaluation of Climate Engineering (CE) options, as it will be shown by reference to the SPICE project. The SPICE example and the call for democratisation of science and innovation raise some interesting concerns for the normative evaluation of CE options that will be addressed in the paper. It is (...) by far not clear, or so it will be argued, how much of the innovation process of CE technologies should be put in the hands of social actors and the wider public. This is due not only to special features about CE technologies but also to some more principle concerns against some features of participatory RRI approaches. Still, this does by no way mean that ethical and societal issues in the context of CE technologies should be ignored. Rather, the paper will argue that one can take a step back to expert TA linked to the evolution of approaches of ethical impact analysis in this area. This does not only lead to reconsider the emphasis on participation and democratisation of research and innovation, but also opens up for an alternative evaluative framework for CE technologies developed in the last part of the paper. Ontology, the ideas we have about the nature of reality, and epistemology, our concepts about how to gain knowledge about the world, are interdependent. Currently, the dominant ontology in science is a materialist model, and associated with it an empiricist epistemology. Historically speaking, there was a more comprehensive notion at the cradle of modern science in the middle ages. Then “experience” meant both inner, or first person, and outer, or third person, experience. With the historical development, experience has come to (...) mean only sense experience of outer reality. This has become associated with the ontology that matter is the most important substance in the universe, everything else—consciousness, mind, values, etc., —being derived thereof or reducible to it. This ontology is insufficient to explain the phenomena we are living with—consciousness, as a precondition of this idea, or anomalous cognitions. These have a robust empirical grounding, although we do not understand them sufficiently. The phenomenology, though, demands some sort of non-local model of the world and one in which consciousness is not derivative of, but coprimary with matter. I propose such a complementarist dual aspect model of consciousness and brain, or mind and matter. This then also entails a different epistemology. For if consciousness is coprimary with matter, then we can also use a deeper exploration of consciousness as happens in contemplative practice to reach an understanding of the deep structure of the world, for instance in mathematical or theoretical intuition, and perhaps also in other areas such as in ethics. This would entail a kind of contemplative science that would also complement our current experiential mode that is exclusively directed to the outside aspect of our world. Such an epistemology might help us with various issues, such as good theoretical and other intuitions. (shrink)

The emergence of mental states from neural states by partitioning the neural phase space is analyzed in terms of symbolic dynamics. Well-defined mental states provide contexts inducing a criterion of structural stability for the neurodynamics that can be implemented by particular partitions. This leads to distinguished subshifts of finite type that are either cyclic or irreducible. Cyclic shifts correspond to asymptotically stable fixed points or limit tori whereas irreducible shifts are obtained from generating partitions of mixing hyperbolic systems. These stability (...) criteria are applied to the discussion of neural correlates of consiousness, to the definition of macroscopic neural states, and to aspects of the symbol grounding problem. In particular, it is shown that compatible mental descriptions, topologically equivalent to the neurodynamical description, emerge if the partition of the neural phase space is generating. If this is not the case, mental descriptions are incompatible or complementary. Consequences of this result for an integration or unification of cognitive science or psychology, respectively, will be indicated. (shrink)

Don Ihde has recently launched a sweeping attack against Husserl’s late philosophy of science. Ihde takes particular exception to Husserl’s portrayal of Galileo and to the results Husserl draws from his understanding of Galilean science. Ihde’s main point is that Husserl paints an overly intellectualistic picture of the “father of modern science”, neglecting Galileo’s engagement with scientific instruments such as, most notably, the telescope. According to Ihde, this omission is not merely a historiographical shortcoming. On Ihde’s view, it is only (...) on the basis of a distorted picture of Galileo that Husserl can “create“ the division between Lifeworld and the “world of science“, a division that is indeed fundamental for Husserl’s overall position. Hence, if successful, Ihde’s argument effectively undermines Husserl’s late philosophy of science. The aim of this paper is to show that Ihde’s criticism does not stand up to closer historical or philosophical scrutiny. (shrink)

The concept of complementarity, originally defined for non-commuting observables of quantum systems with states of non-vanishing dispersion, is extended to classical dynamical systems with a partitioned phase space. Interpreting partitions in terms of ensembles of epistemic states (symbols) with corresponding classical observables, it is shown that such observables are complementary to each other with respect to particular partitions unless those partitions are generating. This explains why symbolic descriptions based on an ad hoc partition of an underlying phase space description should (...) generally be expected to be incompatible. When it comes to assessing the deontic status of acts and policies in the context of risk and uncertainty, moral theories are often at a loss. In this paper we hope to show that employing a multi-dimensional consequentialist framework provides ethical guidance for decision-making in complex situations. The paper starts by briefly rehearsing consequentialist responses to the issue of risk, as well as their shortcomings. By understanding the sense in which Sextus thinks reason is deceptive we may clarify his attitude towards ordinary life. The deception, like that of the Siren's song, is practical rather than epistemic. It is not a matter of leading us to assent to false or unjustified conclusions but is rather a distraction from, or even corruption of, ordinary life.

Quantum theory has provoked intense discussions about its interpretation since its pioneer days. One of the few scientists who have been continuously engaged in this development from both physical and philosophical perspectives is Carl Friedrich von Weizsaecker. The questions he posed were and are inspiring for many, including the authors of this contribution. Weizsaecker developed Bohr's view of quantum theory as a theory of knowledge. We show that such an epistemic perspective can be consistently complemented by Einstein's ontically oriented position.

Wolfgang Pauli (1900-1958) was one of the greatest physicists of the past century. He played a leading role in the development of modern physics and was known for his ruthless intellectual integrity. Pauli first became famed through the publication of his encyclopaedia article on the theory of relativity (Pauli, 1921) when he was still a student of Sommerfeld's. Einstein much admired this article, which remained a classic.

The success of medicine in the treatment of patients brings with it new challenges. More people live on to suffer from functional, chronic or multifactorial diseases, and this has led to calls for more complex analyses of the causal determinants of health and illness. Philosophical analysis of background assumptions of the current paradigmatic model. While these factors do not require a radical paradigm shift, they do give us cause to develop a new narrative, to add to existing narratives that frame (...) our thinking about medical care. In this paper we argue that the increased focus on lifestyle and shared decision making requires a new narrative of agency, to supplement the narrative of “the patient”. This narrative is conceptually linked to the developing philosophy of person-centred care. If patients are seen also as “agents” this will result in a substantial shift in practical decisions: The development and adoption of this narrative will help practitioners work with patients to their mutual benefit, harnessing the patients’ motivation, shifting the focus from treatment to prevention and preventing unnecessary and harmful treatments that can come out of our preoccupation with the patient narrative. It will also help to shift research efforts, conceptual and empirical, from “treating” and “battling” diseases and their purported “mechanisms” to understanding complex contributing factors and their interplay.
