“Tell me," Wittgenstein once asked a friend, "why do people always say, it was natural for man to assume that the sun went round the earth rather than that the earth was rotating?" His friend replied, "Well, obviously because it just looks as though the Sun is going round the Earth." Wittgenstein replied, "Well, what would it have looked like if it had looked as though the Earth was rotating?” What would it have looked like if we looked at all (...) sciences from the viewpoint of Wittgenstein’s philosophy? Wittgenstein is undoubtedly one of the most influential philosophers of the twentieth century. His complex body of work has been analysed by numerous scholars, from mathematicians and physicists, to philosophers, linguists, and beyond. This volume brings together some of his central perspectives as applied to the modern sciences and studies the influence they may have on the thought processes underlying science and on the world view it engenders. The contributions stem from leading scholars in philosophy, mathematics, physics, economics, psychology and human sciences; all of them have written in an accessible style that demands little specialist knowledge, whilst clearly portraying and discussing the deep issues at hand. Over the past fifty years, a number of approaches to the recovery of the multiple pasts of Hinduism have held the field. These include that of the discipline of History of Religions as it is constituted in North America as well as those of the Hindu nationalists, the col and post-colonial historians, and the Subaltern Studies School. None of these approaches have proven satisfactory because, for methodological or ideological reasons, none have adequately addressed human agency or historical change in their (...) accounts of the pasts out of which modern-day Hinduism has emerged. The Hindu nationalist historians hark back to an extended Vedic golden age in which religious practice remained unchanged until the corruptions spawned by the Turkish invasions of the eleventh century. Many Western indologists and historians of religion specializing in Hinduism never leave the unalterable ideal worlds of the scriptures they interpret to investigate the changing real-world contexts out of which those texts emerged. The colonial and postcolonial historians focus on the past two hundred years as the period in which all of the categories through which India continues to interpret itself—including Hinduism—were imposed upon it from without. Adducing examples of Hindu practitioners and thinkers from the colonial period, subaltern theorists and others argue that historical thought is itself alien to the authentic Indian mind. This article suggests a number of interpretive strategies for retrieving the multiple Hinduisms of the past and of the medieval period in particular as that time out of which most modern-day practices of Hinduism emerged. These include an increased emphasis on non-scriptural sources and a focus on regional traditions. (shrink)

These lectures of Heidegger on Hegel’s Phenomenology were given in the winter semester 1930–1931 in Freiburg. This was only a few years after the publication of Being and Time and Kant and the Problem of Metaphysics; much of the language harks back to those works. The lectures predate by twelve years the essay “Hegel’s Concept of Experience” and by about twenty-seven years the discussions of Hegel in Identity and Difference and “Hegel and the Greeks.” As is the case with Heidegger’s (...) course lectures, these are easier reading than the essays and books. It would be unfortunate, however, if their greater length and comparative clarity were to give them a special prominence among Heidegger’s views on Hegel, since the later treatments are more sophisticated. ABSTRACT Since the seventeenth century, scholars have been accusing each other of ‘dogmatism’. But what exactly did this mean? In exploring this question, this article focuses on philosophy and Biblical scholarship in nineteenth-century Germany. Scholars in both of these fields habitually contrasted Dogmatismus with Kritik, to the point of emplotting the history of their field as a gradual triumph of critical thinking over dogmatic belief. The article shows that charges of dogmatism derived much of their rhetorical force from such progressive (...) narratives. Especially neo-Kantian philosophers and Biblical scholars of liberal Protestant persuasion liked to depict their opponents as clinging to long-superseded modes of thought, thereby implying that these colleagues harked back to a past from which modern Wissenschaft had emancipated itself. This ‘denial of coevalness’, as Johannes Fabian calls it, demonstrates to what extent the vice of dogmatism was imbued with normative visions of how the field or, more broadly, German intellectual life should develop. The authors use empirical research into the environmental practices of 31 manufacturing small and medium-sized enterprises (SMEs) to show that ‚business performance’ and ‚regulation’ considerations drive behaviour. They suggest that this is inevitable, given the market-based decision-making frames that permeate and dominate the industry in which manufacturing SMEs operate. Since the environment is a pillar of corporate social responsibility (CSR), the findings have important implications for CSR policy, which promotes voluntary actions predicated on a business case. It is argued that (...) this approach will not alter the behaviour of manufacturing SMEs significantly because CSR practice will be regarded as an optional and costly ‚extra’ affecting core business activity. Consequently, the use and development of existing regulatory structures, providing minimum standards for many activities covered by CSR, remains the most effective means through which the behaviour of manufacturing SMEs will be changed in the short to medium-term. Another feature of the paper is the distinction made between ‚business performance’ and the ‚business case’ argument. Business performance emphasises cost reductions and efficiency whereas the business case accentuates the benefits to shareholders of good practices as their firms become more attractive to stakeholders and society. Manufacturing SMEs␣try to improve business performance because of the pressures placed on them by market-dominated decision-making frames. These frames do not encourage manufacturing SMEs to undertake voluntary actions for the benefit of wider stakeholders and society. (shrink)

Moral Rights and Their Grounds offers a novel theory of rights based on two distinct views. The first--the value view of rights--argues that for a person to have a right is to be valuable in a certain way, or to have a value property. This special type of value is in turn identified by the reasons that others have for treating the right holder in certain ways, and that correlate with the value in question. David Alm then argues that (...) the familiar agency view of rights should be replaced with a different version according to which persons' rights, and thus at least in part their value, are based on their actions rather than their mere agency. This view, which Alm calls exercise-based rights, retains some of the most valuable features of the agency view while also defending it against common objections concerning right loss. This book presents a unique conception of exercise-based rights that will be of keen interest to ethicists, legal philosophers, and political philosophers interested in rights theory. (shrink)

In this paper I defend epistemic circularity by arguing that the “No Self-Support” principle (NSS) is false. This principle, ultimately due to Fumerton ( 1995 ), states that one cannot acquire a justified belief in the reliability of a source of belief by trusting that very source. I argue that NSS has the skeptical consequence that the trustworthiness of all of our sources ultimately depends upon the trustworthiness of certain fundamental sources – sources that we cannot justifiably believe to be (...) reliable. This is a problem, I claim, because if the trustworthiness of all of our sources depends upon sources that we should not believe to be reliable, then a reflective individual should not trust any of his sources at all. The hidden cost of rejecting epistemic circularity is thus the unacceptable skeptical thesis that reflective individuals like you and I have no justified beliefs whatsoever. (shrink)

I distinguish between two conceptually different kinds of physical space: a space of ordinary material bodies, which is the space of points at which I could imaginably place the tip of my finger, or the center of a billiard-ball, and a space of elementary physical determinables, which is the smallest space of points such that stipulating what is happening at each one of those points, at every time, amounts to an exhaustive physical history of the universe. In all classical physical (...) theories, these two spaces happen to coincide – and what we mean by calling a theory “classical”, and all we mean by calling a theory “classical”, is precisely that these two spaces coincide. But once the distinction between these two spaces in on the table, it becomes clear that there is no logical or conceptual reason why they must coincide – and it turns out that a very simple way of pulling them apart from one another gives us quantum mechanics. Inferential Internalists accept the Principle of Inferential Justification (PIJ), according to which one has justification for believing P on the basis of E only if one has justification for believing that E makes probable P. Richard Fumerton has defended PIJ by appeal to examples, and recently Adam Leite has argued that this principle is supported by considerations regarding the nature of responsible belief. In this paper, I defend a form of externalism against both arguments. This form of externalism recognizes what (...) I call the phenomenon of reflective defeat: if one is justified in not believing that E makes probable P, then this defeats whatever justification one has for believing P upon the basis of E. I argue that this modified version of externalism has the virtue of accommodating the intuitions that motivate internalism, without the cost of the vicious regress that makes internalism so unattractive. In this multi-faceted study, David Clarke explores Tippett's complex creative imagination - its dialogue between a romantic's aspirations to the ideal and absolute, and a modernist's sceptical realism. He shows how the musical formations of works such as The Midsummer Marriage, King Priam, and The Vision of Saint Augustine resonate with the aesthetic and theoretical ideas of key figures (...) in modern Western culture - some known to have been influential to the composer, others not usually associated with him. Analyses of late works such as the Triple Concerto and Byzantium also speculate on Tippett's sexuality as a critical element in his creative and political consciousness. (shrink)

When patients are admitted to the hospital, they are generally expected to remain in or within close proximity to their assigned rooms in order to promote their safety and appropriate medical care. Although there are circumstances when patients may safely leave their hospital room or floor, guidance within the medical literature for the management of patient movement within the hospital are lacking. Excessive restrictions on patient movement may be seen as overly paternalistic, while lax requirements may interfere with high quality (...) care, patient safety and efficient hospital practice. As a result, guidance in the form of institutional policy is warranted. Such policy development should take into consideration the potential clinical, legal, and ethical concerns in balancing the competing values of patients’ preferences and respect for autonomy, while ensuring high quality, safe, and efficacious medical care. This paper will provide a framework for hospitals to create institution-specific patient movement policies that are fair, systematic, and transparent. (shrink)

The public forum has been connected to the functioning of democracy, expressive freedom, and the media's role in society. While the public forum's legal contours have been examined, the ethical foundation of the public forum has not. Relying on archival research, this article argues that ideas about the public forum can be traced to the pragmatism of Grenville Clark, who influenced ideas about the public forum through his work on the American Bar Association's Bill of Rights Committee.

Herbert Hochberg is one of the most influential analytical philosophers and one of the most influential critics of analytical philosophy. He disputed with almost all leading analytical philosophers, from Quine, Goodman and Wilfrid Sellars to David Lewis and David Armstrong. His point of view is ontological and he harks back to the origins of analytical philosophy where he finds unknown precursors of current views. According to the self-defense view, the moral justification of punishment is derived from the moral justification of an earlier threat of punishment for an offense. According to the forfeiture view, criminals can justly be punished because they have forfeited certain rights in virtue of their crimes. The paper defends three theses about these two views. (1) The self-defense view is false because the right to threaten retaliation is not independent of the right to carry out that threat. (2) A more (...) plausible account of the right to threaten says instead that the right to retaliate is primary to the right to threaten, and that the former right in turn arises because aggressors forfeit the right not to suffer retaliation. (3) The ?fair warning thesis,? according to which just punishment must be preceded by a threat, is less plausible than first appearances suggest and is therefore no serious obstacle to the view of threats described above. In this paper, I consider the question of whether crime victims can be said to have a moral right to see their victimizers punished that could explain why they often feel wronged or cheated when the state fails to punish offenders. In the first part, I explain what I mean by a “right to punishment” and what it is for such a right to “explain” the frustrated crime victim’s reaction. In the second part, I distinguish such a right from a (...) Lockean-style right to punish, which is also shown incapable of providing the needed explanation. In the third part I argue that it is difficult to identify any benefit such that the right to punishment could plausibly be understood as a right to that benefit. I discuss two main candidates here: the vaguely Hegelian idea that punishment is itself some sort of restitution for the wrong done to the victim; and the idea, due to Victor Tadros, that punishment is a form of compensation for wrongdoing by contributing indirectly to protecting victims from future harm. In the final section, I suggest instead that the frustrated crime victim’s reaction, when justified, is best explained, not by the violation of any right to punishment, but rather by the state’s failure to treat the victim as an equal. In this paper I criticize the standard argument for deontological egalitarianism, understood as the thesis that there is a moral claim to have an equal share of well-being or whatever other good counts. That argument is based on the idea that equals should be treated equally. I connect the debate over egalitarianism with that over comparative justice. A common theme is a general skepticism against comparative claims. I argue (i) that there can be no claim to equality based simply on (...) the fact of equal worth as that fact itself does not have any value for the supposed claim holder; and (ii) intuitions that suggest otherwise can be explained away without appealing to comparative claims. Atomism is defined as the view that the moral value of any object is ultimately determined by simple features whose contribution to the value of an object is always the same, independently of context. A morally fundamental feature, in a given context, is defined as one whose contribution in that context is determined by no other value fact. Three theses are defended, which together entail atomism: (1) All objects have their moral value ultimately in virtue of morally fundamental features; (2) (...) In this paper I discuss, on behalf of the materialist, a consideration against the modal or conceivability argument against materialism which was first voiced in the third lecture of Naming and Necessity. This consideration is based on intertheoretic identities, statements in which both terms flanking the identity sign are theoretical. I argue that the defender of the conceivability argument has trouble to account for the appearance of contingency in those types of necessary identities. In fact, intertheoretic identities pose a formidable (...) dilemma for the defender of the modal argument and actually force the antimaterialist to say more about the semantics of theoretical terms than is implicit in standard discussions of the argument. I myself consider several options in this regard, the upshot being, however, that none of the alternative semantics for theoretical terms available to the antimaterialist is good enough to achieve the twofold aim which her modal argument requires, namely, to account for the a posteriori necessity of identities of this sort and, at the same time, to preserve her antimaterialist argument. Finally, in the last part of the paper, I argue that my defense of materialism can withstand some worries coming from David Chalmers’ recent views on a priori scrutability. (shrink)

In the first book-length study of this highly influential figure, David Alderson provides detailed discussions of Eagleton's Marxism and his engagements with postmodernism, as well as an evaluation of his interventions in Irish Studies. Each of the chapters in this important intervention in current theoretical debates offers accessible contextualization of the key issues and provides detailed analyses of Eagleton's literary criticism. Heute gibt es kaum jemanden mehr, der nicht mit Fake News und Verschwörungstheorien in Berührung gekommen wäre. Mit dem globalen Aufstieg des modernen Populismus und besonders seit Donald Trumps US-Präsidentschaft konnten sie von obskuren Internetfo-ren und dem Rand der Gesellschaft weiter als je zuvor in die öffentliche Debatte vordringen. Mit der zunehmenden Nutzung sozialer Medien und Messenger-Apps wie Telegram oder WhatsApp findet scheinbares Wissen ungehindert Verbreitung und direkten Zugang zu den Smartphones und Köpfen der Menschen. Vor diesem Hintergrund ist es (...) nicht verwunderlich, dass Verschwörungstheorien und Fake News auch Einzug ins Klassenzimmer halten. Dabei stehen Lehrer*innen vor vielen offenen Fragen. Wie sind diese Behauptungen im Einzelnen zu bewerten? Was zeichnet Fake News und Verschwörungstheorien aus und was genau macht sie problematisch? Wie, selbst wenn sie klarerweise falsch und unbegründet sind, sollte damit im Klassenzimmer umgegangen werden? Sollte man sie offen diskutieren? Oder sollte man die Diskussion darüber unterbinden? Hier werden grundlegende und komplexe Fragen der freien Meinungsbildung und -äußerung berührt, zu denen Grundgesetz, Beamten- und Schulrecht nur begrenzt Auskunft geben. In diesem Beitrag wollen uns zuerst ein klares Bild davon machen, was Fake News und Verschwörungstheorien eigentlich sind, warum manche Menschen sie für wahr halten und was daran problematisch ist. Vor diesem Hintergrund soll anschließend die Frage diskutiert werden, wie aus demokratie- und bildungstheoretischer Sicht mit Fake News und Verschwörungstheorien im Unterricht umgegangen werden sollte. Memory, mother of the Muses by Zeus, has nurtured culture for nearly three millennia while her nemesis, forgetfulness, has been demonized as an agent of destruction. In the modern age, however, memory has grown increasingly burdensome, opening the way for a more positive assessment of forgetfulness. Nietzsche praises animals for an inability to remember that preserves their innocence and happiness, and Freud documents the discontents of a civilization that cannot forget. ;In tracing the recent development of these issues, the dissertation (...) focuses primarily on Walter Benjamin, Hans Blumenberg, and Thomas Pynchon. Benjamin and his anguished "angel of history" show the destructive psychological effects of trying to use human memory as a secular form of redemption. Blumenberg's philosophy of history makes it possible to trace memory's responsibility for redemption to the modern age's inflated notion of the subject. Blumenberg's work also emphasizes the importance of metaphor and narrative in mediating and creating historical understanding, and this aesthetic distance weakens memory's redemptive relation to the past. Pynchon's protagonists, too, find that their desire to make historical meaning fully present is overshadowed by their fear of such presence. By reconciling themselves to a profane aesthetic distance from the past, Blumenberg and Pynchon redeem themselves from the melancholy engendered by an overly ambitious memory. ;Thus the dissertation attempts to recover a more modest and less oppressive memory by understanding it as a way to distance rather than redeem past injustices. This reconception of the function of memory helps establish an equilibrium between the pensive memory of Benjamin's "angel of history" and the innocent oblivion of Nietzsche's animals. ;In addition to the three major figures named in the title, the dissertation devotes sections and excursuses to Friedrich Nietzsche, Sigmund Freud, Ernst Cassirer, Martin Heidegger, Virginia Woolf, Ernst Robert Curtius, Elie Wiesel, Primo Levi, Michel Foucault, and Thomas Kuhn. Translations of two essays by Blumenberg, "Pensiveness" and "Being--A MacGuffin," and a comprehensive Blumenberg bibliography are included as appendices. (shrink)

In this paper I offer a partial defense of a constitutivist view according to which it is possible to defend fundamental requirements of practical reason by appeal to facts about what is constitutive of rational agency. I show how it is possible for that approach to circumvent the ‘is’/’ought’ problem as well as the requirement that it be possible to act contrary to practical reason. But I do not attempt to establish any particular fundamental requirement. The key ideas are that (...) such a requirement is not genuine if it is arbitrary, and that it is arbitrary just in case (a) it needs explanation and (b) that explanation could not, even in principle, be provided.
