In this article, the foundations of a new principle of international relations are discussed. They are traced back to the idea of the human being as a culturally living being (homo culturalis). The new principle of harmonic power is conceptualized in the first segment by way of contrasting it with the original meaning of the concept of ‘soft power’ by Joseph S. Nye Jr. In the next part, a portion of the intension of a new concept of (...) culture is established. It serves as a conceptual background and context for the idea of harmonic power. This foundation for a new and more comprehensive concept of culture is inspired by ancient Chinese elements of thought but also by comparable elements of Indian and Graeco-Roman philosophy. In the following step, a conceptual extension of culture in four major areas, respec-tively, mutually permeable “focus fields” is outlined. The accompanying discussion in view of ancient Chinese philosophy and elements of other traditions then leads to a completion of the intension of the concept of culture. This is achieved in view of the aspect of morality in relation to the Golden Rule. In a final step, further reflec-tions are provided regarding the interrelation of the advanced concepts of harmonic power and culture discussed in the this article. Harmonic power means the essential prerequisite for the shift away from the conflict-ridden desire for monopolar world hegemony—a yearning that has revealed itself as an impasse over and over again—towards a peace-bearing, transformative future of multipolar world participation. Harmonic power is the foundation of the cultivation of a mutually beneficial socio-cultural co-evolution on a global scale. (shrink)

This article considers how global ethical matters might be approached differently in the English-speaking literature if values salient in sub-Saharan Africa and East Asia were taken seriously. Specifically, after pointing out how indigenous values in both of these major parts of the world tend to prescribe honouring harmonious relationships, the article brings out what such an approach to morality entails for political power, foreign relations and criminal justice. For each major issue, it suggests that harmony likely has implications that (...) differ from approaches that currently dominate Western thought, namely those of utility, autonomy and capability. It is conventionally understood that computers play a rather limited role in theoretical mathematics. While computation is indispensable in applied mathematics and the theory of computing and algorithms is rich and thriving, one does not, even today, expect to find computers in theoretical mathematics settings beyond the theory of computing. Where computers are used, by those studying combinatorics , algebra, number theory, or dynamical systems, the computer most often assumes the role of an automated and speedy theoretician, performing manipulations and (...) checking cases in a way assumed to be possible for human theoreticians, if only they had the time, the memory, and the precision. Automated proofs have become standard tools in mathematical logic, and it is often expected that proofs be published in a computer-checkable format. It is not surprising, then, that most philosophical work on computers in theoretical mathematics has been on computers' roles as supplementary mathematicians. Donald MacKenzie's 2001 book Mechanizing Proof demonstrates the rich potential for social and historical studies to complement the substantial analytic debate in this area of philosophy. But what of computers in theoretical mathematics behaving as computers, and not as mere mechanized mathematicians? Very little role is commonly assumed for computers working as supplements to mathematicians, rather than as supplementary mathematicians themselves. Accordingly, very little philosophy has attempted to grapple with theoretical mathematics in which computers play an essential but essentially non-theoretical role. My presentation will draw on work I conducted as a researcher in harmonic analysis on fractals at Cornell University. I will analyze the explicit and implicit conceptual apparatus employed in my and my fellow researchers' use of computers in the theoretical study of second order differential equations, such as those for sound and heat flow, on various fractal analogues of the Sierpinski gasket. Such gaskets are easy to visualize in very crude approximation in a low number of dimensions. As one increases the complexity of the gasket or the refinement of one's analysis, visualization and precise computation become impossible, and soon computers are unable to produce even approximate data to model differential equations in these situations. We thus had to carefully choose analytic approaches and methods to make our theoretical mathematics amenable to computer simulation. In my case, studying the transformation of the gaskets as they are expanded into increasingly high dimensions, computer simulation eventually required that the problem be reimagined entirely in terms of interlinked systems of parameters. This computer-approximation-driven theoretical orientation shaped my mathematical intuitions toward the problem and guided my fellow researchers and me in both theoretical and computational directions. We discovered both that computer approximation could be incredibly powerful as an aid to intuition, and that it can be incredibly difficult to transfer computer-oriented mathematics back into the purely theoretical standards of our area of specialty. I will address the philosophical implications of computer-driven theoretical mathematics, asking how computer experiments can shape both the content and standards of theoretical sciences. (shrink)

Leadership is the art of discovering and expressing one's inborn nature. It is a natural response, a way of being and doing within reality that creates a powerful influence on one's community toward greater degrees of peace and harmony on the individual and communal levels. The article is devoted to the analysis of the influence of the ancient Chinese philosophy of Taiji on artistic creativity and the development of the internal evolution of artistic culture. Taoist philosophy of nature and Confucian ethics synthesized the philosophical core of the traditional Chinese worldview with its emphasis on the simplicity and naturalness of the world order, and formed the fundamental principles of Taiji. Fundamental to Taiji, the concept of Yin and Yang emphasizes the dual nature of the existence (...) of movement and variability as a balance of opposing forces of development. The Taiji philosophy of dialectical development is supplemented by the idea of ​​the genesis of renewal energy - Qi. The main research method is the method of revitalizing traditional systems on a new intellectual basis. The method of diachronic analysis of the social situation that influenced the development of Chinese neorealism in art was used. As a result of the study, the functional significance of the influence of the principles and philosophical ideas of taiji on the evolution of neorealism is described. Using the example of the work of Chinese neorealist artists Xin Dongwan and Zheng Yi, the authors come to the conclusion that there are three driving factors of artistic motivation for creativity: internal, external and subjective. The basic principles of Taiji philosophy and ethics, such as: the naturalness of change without the use of force (Wu Wei), change as the only constant in the existence of the world and its stability, gentleness - help develop the creative power of renewal. The idea is shown that in the ancient Chinese philosophical heritage, Confucianism and Taoism became two full-fledged directions, functionally complementing each other in explaining differences in cultural, political, philosophical and social environments. In this paper, I use Kant’s theory of the aesthetic power of judgment to solve the problem of nonmoral value choice, which Kant himself did not deal with, and prove that my reconstruction can fit into Kant’s philosophy and function as a harmonization and unification of morality and happiness. First, I revisit Kant’s early view of intellectualized happiness to establish the feasibility of this project in Kant’s ethics. Second, by analogy with the contemplative judgment of taste and practical artistic (...) creation, I argue for the universal communicability of pleasure in value choice from the transcendental perspective, on the one hand, and explain the various choices by individuals in reality from the empirical perspective, on the other. Ultimately, I connect the pursuit of intellectual happiness with the fulfillment of the imperfect duty of one’s own perfection, through which a transition from nature to freedom can be accomplished in Kant’s philosophy. The focus of my dissertation is a general and comprehensive examination of Locke’s view of divine power. My basic argument is that John Locke is a theological voluntarist in his understanding of God’s creative and providential relationship with the world, including both the natural and moral order. As a voluntarist, Locke holds that God freely imposes both the physical and moral laws of nature onto creation by means of his will: this contrasts with the intellectualist perspective in which the (...) laws of nature emerge from the essences of things. For Locke, there are no intrinsically necessary laws in the created order: both physical and moral laws are arbitrary determinations of the divine will. While these laws are not intrinsically necessary, they are hypothetically necessary. Hypothetical necessity involves things that could have been otherwise, but which are necessary based on the supposition of a free action and other relevant conditions pertaining to the actor. Concerning God, we can understand hypothetical necessity in the following way: □ [ → Y]. X is a variable that ranges over a subset of contingent propositions about actions. ‘P’ is the proposition ‘God is perfect’. And Y is any proposition that is a necessary consequent of both X and P. In any possible world in which God performs X, it is the case that Y will obtain. Supposing that God decides to create beings like us, God must of necessity craft the moral laws of nature in a way that harmonizes with our nature. What grounds this necessity is that God must act consistently with the perfection of the divine nature: to give us a different law would be less than perfect. Gentili’s juridical and internationalist theory, consecrated to the individuation of a system of laws to rule the relations between sovereign actors, is based on a concept of sovereignty inspired by Bodin’s doctrine but it also elaborates classical cosmopolitanism ideal of an universal societas hominum. However, these models seem (...) difficult to conciliate. How can the interests of the State be harmonized with the natural principles of justice innate to human reason? The Golden Age of postwar capitalism has been eclipsed, and with it seemingly also the possibility of harmonizing equality and welfare with efficiency and jobs. Most analyses believe that the emerging postindustrial society is overdetermined by massive, convergent forces, such as tertiarization, new technologies, or globalization, all conspiring to make welfare states unsustainable in the future. Social Foundations of Postindustrial Economies takes a second, more sociological and more institutional, look at the driving forces of economic transformation. What, as a result, (...) stands out is postindustrial diversity, not convergence. Macroscopic, global trends are undoubtedly powerful, yet their influence is easily rivalled by domestic institutional traditions, by the kind of welfare regime that, some generations ago, was put in place. It is, however, especially the family economy that hold the key as to what kind of postindustrial model will emerge, and to how evolving tradeoffs will be managed. Twentieth-century economic analysis depended on a set of sociological assumptions that, now, are invalid. Indeed, feminist ethics produces, accesses, and engages such tools. However, work in BE and CSR consistently conflates feminist ethics and feminine ethics and care ethics. I offer clarification and invoke the analytic power of three feminist ethicists 'in action' (...) whose investigations into the "grey zones" of harms; identity and representational conventions; and "asymmetrical reciprocity" harmonize with business ethics' requirements. Was Plato a Pythagorean? Plato's students and earliest critics thought so, but scholars since the nineteenth century have been more skeptical. With this probing study, Phillip Sidney Horky argues that a specific type of Pythagorean philosophy, called "mathematical" Pythagoreanism, exercised a decisive influence on fundamental aspects of Plato's philosophy. The progenitor of mathematical Pythagoreanism was the infamous Pythagorean heretic and political revolutionary Hippasus of Metapontum, a student of Pythagoras who is credited with experiments in harmonics that led to innovations in (...) mathematics. The innovations of Hippasus and other mathematical Pythagoreans, including Empedocles of Agrigentum, Epicharmus of Syracuse, Philolaus of Croton, and Archytas of Tarentum, presented philosophers like Plato with novel ways to reconcile empirical knowledge with abstract mathematical theories. Plato and Pythagoreanism demonstrates how mathematical Pythagoreanism established many of the fundamental philosophical questions Plato dealt with in his central dialogues, including Cratylus, Phaedo, Republic, Timaeus, and Philebus. In the process, it also illuminates the historical significance of the mathematical Pythagoreans, a group whose influence on the development of philosophical and scientific methods has been obscured since late antiquity. The picture that results is one in which Plato inherits mathematical Pythagorean method only to transform it into a powerful philosophical argument about the essential relationships between the cosmos and the human being. This article is focused on the relation between peace and nonviolence. It claims that the main challenge for peace comes from the power of structural violence. This is the main form of evil in history. Today structural violence is at work in the political and economic global systems. They obey a logic of conflict. The exercise of nonviolence can avoid the tendency to transform the connection between violence, evil, dehumanization, and great organizational systems into a destiny. The dynamic that (...) is needed to effect this is to move from the primacy of automatism in political and market power to the primacy of human consciousness. Experiences such as reconciliation, democratic growth, restorative justice, and harmonization with the natural world should be considered as the effects of this systemic translation to nonviolence. The main thesis of this paper is that when we trust the results of scientific research, that trust is inevitably directed at least in part at collective bodies rather than at single researchers, and that accordingly, reasonable assessments of epistemic trustworthiness in science must attend to these collective bodies. In order to support this claim, I start by invoking the collaborative nature of most of today’s scientific research. I argue that the trustworthiness of a collaborative research group does not supervene (...) on the trustworthiness of its individual members and point out some specific problems for the assessment of epistemic trustworthiness that arise from the specific nature of today’s collaborative research. Next, I argue that the social diffusion of trustworthiness goes even further; we always also need an assessment of the trustworthiness of the respective research community as a whole. Communities, I claim, play an essential role in the epistemic quality management of science. To see why this role is indispensible, we have to appreciate the full complexity of determining what is desirable in a method of inquiry. The relevant features of a method include three different dimensions: the reliability of positive results, the reliability of negative results, and the method’s power. Every methodological choice involves a trade-off between these three dimensions. The right balance between them (the “distribution of inductive risks”, or DIR) depends on value judgments about the costs of false results and the benefits of correct ones. Conventional methodological standards of research communities impose constraints on admissible DIR and thereby harmonize the implicit value judgments. Trusting that the research community has set the limitations on DIR in a suitable way is thus always part of placing our trust in a scientific result. (shrink)

A model of copyright protection under which the law’s attention is directed towards a dematerialized, malleable essence (‘originality’, ‘labour and skill’ or ‘creativity’) has gradually evolved in the UK. This model has come to regulate all fundamental questions concerning the scope and attribution of rights. Nevertheless, until very recently, some aspects of copyright doctrine have remained incompatible with this dominant model. In certain situations, rather than focusing purely on an abstract property, the law has continued to limit a copyright owner’s (...) powers by reference to the boundaries of the material form within which a protected work is first recorded. It is argued here that, while apparently inconsistent, this approach has served an important function in justifying judicial resistance to expansionist pressures in the law. Since 2009, however, this pragmatic, focus-shifting system has been destabilized by the copyright jurisprudence of the Court of Justice. The Court’s judgments in Infopaq International A/S v Danske Dagblades Forening and subsequent cases have dramatically accelerated the pace of copyright harmonization. As a result, it is possible that UK courts may be obliged to adopt a more consistently dematerialized system of copyright law and our courts may have been deprived of tools previously employed to resist unduly broad claims to copyright protection. In the Statesman , Plato brings together--only to challenge and displace--his own crowning contributions to philosophical method, political theory, and drama. In his 1980 study, reprinted here, Mitchell Miller employs literary theory and conceptual analysis to expose the philosophical, political, and pedagogical conflict that is the underlying context of the dialogue, revealing that its chaotic variety of movements is actually a carefully harmonized act of realizing the mean. The original study left one question outstanding: what specifically, in the metaphysical order (...) of things, motivated the nameless Visitor from Elea to abandon bifurcation for his consummating non-bifurcatory division of fifteen kinds at the end of the dialogue? Miller addressed in a separate essay, first published in 1999 and reprinted here. In it, he opens the horizon of interpretation to include the new metaphysics of the Parmenides , the Philebus , and the "unwritten teachings." In her Introduction, Tymieniecka states the core theme of the present book sharply: Is culture an excess of nature's prodigious expansiveness - an excess which might turn out to be dangerous for nature itself if it goes too far - or is culture a 'natural', congenial prolongation of nature-life? If the latter, then culture is assimilated into nature and thus would lose its claim to autonomy: its criteria would be superseded by those of nature alone. Of course, nature and culture (...) may both still be seen as being absorbed by the inner powers of specifically human inwardness, on which view, human being, caught in its own transcendence, becomes separated radically in kind from the rest of existence and may not touch even the shadow of reality except through its own prism. Excess, therefore, or prolongation? And on what terms? The relationship between culture and nature in its technical phase demands a new elucidation. Here this is pursued by excavating the root significance of the 'multiple rationalities' of life. In contrast to Husserl, who differentiated living types according to their degree of participation in the world, the phenomenology of life disentangles living types from within the ontopoietic web of life itself. The human creative act reveals itself as the Great Divide of the Logos of Life - a divide that does not separate but harmonizes, thus dispelling both naturalistic and spiritualistic reductionism. Sound is one of the types of waves that can be felt by the sense of hearing (ears). In physics, the definition of sound is something that is produced from objects that vibrate. Objects that produce sound are called sound sources. The sound source that vibrates will vibrate the molecules into the air around it. Sound is mechanical compression or longitudinal waves that propagate through the medium. This medium or intermediate agent can be liquid, solid, gas. So, sound waves can (...) propagate for example in water, coal, or air. Most sounds are a combination of various vibratory signals composed of harmonic waves, but pure sound can theoretically be explained by oscillating vibrational speed or frequency measured in Hertz (Hz) vibration units and amplitude or loudness of sound with measurements in decibels (dB). The effect sounds can have on us humans is simply astounding. While everyday life becomes stressful, overcrowded and increasingly hectic, we seek ways for inner peace and balance. The power of music, felt through overtone-rich sound therapy and sound massage, can be a solution. No matter how much scientific explanation is behind it, healing through music remains fascinating, even magical. This paper introduces a new field called cymatics and sound healing with their plausible impact to spirituality and consciousness research. (shrink)

Richard Rorty believes that the combination of ironism and poetic impulse when attached to the public/private distinction, creates an opening for a type of liberalism that satisfies both the urge for individuality and the urge for solidarity. Rorty's antirealistic pragmatism leads to a society functioning very much like our own. This Dissertation dredges out some of the very contentious underlying assumptions of what Rorty feels is a philosophy-less vision. The ironic poet is Rorty's paradigm of correct modern character. Portraying this (...) poet clearly will bring out what a powerful and radical, yet paradoxically rigidly conservative, outlook he would have us adopt. ;The journey for the outlines of the poet's personality takes me through an investigation of Rorty's interest in Heidegger. While Heidegger's poet can be described in some way as a discoverer , Rorty's poet cannot. From these differing conceptions of the poet I jump to the is/ought distinction as characterized by Hume and reversed by Rorty. I argue that Rorty believes that a fact can only be found within an 'ought.' Utopianism becomes then the only legitimate hope for change. The poet becomes the ultimate option-creator. ;Next is examined Rorty's distinction between the private and public realms. The poet, in Rorty's conception, must speak and create within these two vastly divergent realms. Liberalism and its attendant base upon the isolated and transcendent individual becomes clearly to the forefront here as a grounding point . Habermas and Feyerabend are used to further characterize possible aspects of the poet. I characterize the ironist poet as a reluctant dadaist because of the limits the strong attachment to liberalism places upon him/her. ;Ultimately Rorty's central assumption that the public and private realms absolutely cannot be harmonized in one complete 'overlying' vision that does justice to both is critiqued and questioned. In the Protagoras, Socrates argues that all the virtues are the very same knowledge of human wellbeing so that virtue is all one. But elsewhere Socrates appears to endorse that the virtues-such as courage, temperance, and reverence-are different parts of a single whole. Ambiguity interpretations harmonize the conflicting texts by taking the virtue words to be equivocal, such as between theoretical and applied expertise, or between a power and its deeds. I argue that such interpretations have failed in their (...) specifics and in general, as I defend an alternative that takes into account Socrates' higher purpose in testing others, namely to show them their ignorance of virtue. Proponents of mechanistic explanations have recently proclaimed that all explanations in the neurosciences appeal to mechanisms. The purpose of the paper is to critically assess this statement and to develop an integrative account that connects a large range of both mechanistic and dynamical explanations. I develop and defend four theses about the relationship between dynamical and mechanistic explanations: that dynamical explanations are structurally grounded, that they are multiply realizable, possess realizing mechanisms and provide a powerful top-down heuristic. Four examples shall (...) support my points: the harmonic oscillator, the Haken–Kelso–Bunz model of bimanual coordination, the Watt governor and the Gierer–Meinhardt model of biological pattern formation. I also develop the picture of “horizontal” and “vertical” directions of explanations to illustrate the different perspectives of the dynamical and mechanistic approach as well as their potential integration by means of intersection points. Background: International codes of ethics play an important role in guiding professional practice in developing countries. In the occupational health setting, codes developed by international agencies have substantial import on protecting working populations from harm. This is particularly so under globalisation which has transformed processes of production in fundamental ways across the globe. As part of the process of revising the Ethical Code of the International Commission on Occupational Health, an Africa Working Group addressed key challenges for the relevance and (...) cogency of an ethical code in occupational health for an African context through an iterative consultative process. Discussion: Firstly, even in the absence of strong legal systems of enforcement, and notwithstanding the value of legal institutionalisation of ethical codes, guidelines alone may offer advantageous routes to enhancing ethical practice in occupational health. Secondly, globalisation has particularly impacted on health and safety at workplaces in Africa, challenging occupational health professionals to be sensitive to, and actively redress imbalance of power. Thirdly, the different ways in which vulnerability is exemplified in the workplace in Africa often places the occupational health professional in invidious positions of Dual Loyalty. Fourth, the particular cultural emphasis in traditional African societies on collective responsibilities within the community impacts directly on how consent should be sought in occupational health practice, and how stigma should be dealt with, balancing individual autonomy with ideas of personhood that are more collective as in the African philosophy of ubuntu. To address stigma, practitioners need to be additionally sensitive to how power imbalances at the workplace intersect with traditional cultural norms related to solidarity. Lastly, particularly in the African context, the inseparability of workplace and community means that efforts to address workplace hazards demand that actions for occupational health extend beyond just the workplace. Summary: A stronger articulation of occupational health practice with advocacy for prevention should be an ethical norm. Ethical codes should ideally harmonize and balance individual and community needs so as to provide stronger moral authority guidelines. There is a need to consider an African Charter on Bioethics as complementary and strengthening of existing codes for the region. (shrink)

Here I reexamine Duhem's question of the continuity between medieval dynamics and early modern conservation theories. I concentrate on the heavens. For Aristotle, the motions of the heavens are eternally constant (and thus mathematizable) because an eternally constant divine Reason is their mover. Duhem thought that impetus and conservation theories, by extending sublunar mechanics to the heavens, made a divine renewer of motion redundant. By contrast, I show how Descartes derives his law of conservation by extending Aristotelian celestial dynamics to (...) the earth. Descartes argues that motion is intrinsically linear, not circular. But he agrees that motion is mathematically intelligible only where divine Reason moves bodies in a constant and eternal motion. Descartes strips bodies of active powers, leaving God as the only natural mover; thus both celestial and sublunar motions are constant, and uniformly mathematizable. The law of conservation of the total quantity of motion is an attempt to harmonize the constancy derived a priori with the phenomenal inconstancy of sublunar motions. (shrink)

In this paper, we examine how organizations’ impression management evolves in response to rising stakeholder pressures regarding organizations’ corporate responsibility initiatives. We conducted a comparative case study analysis over a period of 13 years for two organizations—Exxon and BP—that took extreme initial stances on climate change. We found that as stakeholder pressures rose, their IM tactics unfolded in four phases: advocating the initial stance, sensegiving to clarify the initial stance, image repairing, and adjusting the stance. Taken together, our analysis of (...) IM over these four phases provides three key insights about the evolution of IM in the face of rising pressures. First, when faced with stakeholder pressures, it seems that organizations do not immediately resort to conforming but tend to give in gradually when pressures increase and start to come from relatively powerful stakeholders. Second, evolution of IM seems to be characterized by path dependence, i.e., even as organizations’ positions evolve, they continue to show their conviction in their initial positions and try to convey that their subsequent positions flow logically from the previous ones. Finally, IM involves navigation between symbolism and substance, and companies tend to strive toward harmonizing their symbolic and substantive actions as stakeholder pressure increases. (shrink)

Friedrich Nietzsche''s will to power, and the philosophical ediface built on this foundation, is formulated on a biologicism that is indebted to a particular post-Darwinian vision of the organism. Of the various models that attempt to formulate a comprehensive organismal biology, Nietzsche unknowingly grasped that of Elie Metchnikoff, who authored the theoretical foundation of modern immunology. Metchnikoff regarded the organism as a disharmonious entity, in constant inner strife between competing cellular activities. Immune functions were responsible for mediating harmonization, which (...) however remains an elusive ideal. This view of the organism posited an ever-changing, self-defining entity striving for self-actualization while in ceaseless inner struggle as well as in competition with the environment. The theory is no less than an epistemological response of how to establish the subject-object relation in a construct where the subject''s boundaries are dialectical and evolving. The similarity of the philosophical positions of Nietzsche and Metchnikoff regarding the Self offers rich resonance in current attempts to formulate a biomedical language appropriate to address the issues raised by these problems. This chapter considers how some international ethical matters might be approached differently in the English-speaking literature if values salient in sub-Saharan Africa were taken seriously. Specifically, after pointing out how indigenous values in this part of the world tend to prescribe relating communally, this chapter articulates a moral-philosophical interpretation of communal relationship and brings out what such an ethic entails for certain aspects of globalization, political power, foreign relations, and criminal justice. The chapter suggests that the implications of a (...) communal ethic are prima facie plausible and often prescribe changes to the status quo. Lacking the space to systematically defend communion as a fundamental value, the chapter nonetheless urges normative theorists of international politics not to neglect it, and it makes realistic recommendations for the African Union, trade organizations, diplomats, and other agents in a position to influence global policy. Liberty and Law examines a previously underappreciated theme in legal history―the idea of permissive natural law. The idea is mentioned only peripherally, if at all, in modern histories of natural law. Yet it engaged the attention of jurists, philosophers, and theologians over a long period and formed an integral part of their teachings. This ensured that natural law was not conceived of as merely a set of commands and prohibitions that restricted human conduct, but also as affirming a realm of (...) human freedom, understood as both freedom from subjection and freedom of choice. Freedom can be used in many ways, and throughout the whole period from 1100 to 1800 the idea of permissive natural law was deployed for various purposes in response to different problems that arose. It was frequently invoked to explain the origin of private property and the beginnings of civil government. Several kinds of permissive natural law were identified. Permission could be positive or negative, depending on whether it was specifically conceded by a legislator or only tacitly allowed. It could free from sin or merely remit some temporal punishment that was due. It could commend some conduct without commanding it or permit some evil without condoning it. Medieval canonists used the concept of permissive natural law to harmonize the discordant texts that they found in their sources; William of Ockham found it a powerful tool in his defense of Franciscan poverty against papal criticisms; for Richard Hooker it justified both the constitutional structure and the ritual practices of the Anglican church; John Selden used it to uphold the inviolability of contracts, most importantly the contract of government; Hugo Grotius made it a central theme in his treatment of the conduct permissible in waging war; in the eighteenth century Jean Barbeyrac and Jean-Jacques Burlamaqui associated the idea with the emerging doctrine of natural rights. THIS PAPER IS THE CO-WINNER OF THE FRED BERGER PRIZE IN PHILOSOPHY OF LAW FOR THE 1999 AMERICAN PHILOSOPHICAL ASSOCIATION FOR THE BEST PUBLISHED PAPER IN THE PREVIOUS TWO YEARS. -/- The conflict between liberal legal theory and critical legal studies (CLS) is often framed as a matter of whether there is a theory of justice that the law should embody which all rational people could or must accept. In a divided society, the CLS critique of this view is overwhelming: (...) there is no such justice that can command universal assent. But the liberal critique of CLS, that it degenerates into an unpalatable moral relativism on which there is no non-arbitrary basis between a justice that underwrites forms of domination such as slavery and a justice that condemns such forms of domination is equally powerful and compelling. I show that there is a way to harmonize both views that is subject to empirical test. -/- First I show that the most widely accepted and influential formulation of liberal justice, John Rawls' Justice as Fairness, in. e.g, A Theory of Justice, cannot avoid the relativistic challenge because it would not be accepted, as a matter of sociological fact, by real people in a divided society once the "veil of Ignorance" is removed and real people step out from the Original Position. To put it differently, different reflective equilibria are inevitable in a divided society. Given the weight that Rawls properly puts on the realizability of a conception of justice and its stability in practice, this is a fatal objection. There can be no divided society that is "well ordered" in Rawls' sense, governed by a shared conception of justice and known to be so governed. -/- I then turn to the most powerful statement of the CLS view, Milton's Fisk's relativistic account in The State and Justice. For Fisk, justice is a compromise between what the dominant groups can compel and what the the subordinate groups will acquiesce to., There is no one such compromise in any given situation, so the account is in that sense relativistic, but more deeply, it is relativistic in that it offers no non-arbitrary, non-question begging way to choose between the official justice of, e.g., a slaveholding society and and the radical justice of the slaves, which has no place for slaveholders as a group or slavery as an institution.All that Fisk can offer is an arbitrary existential choice: I'm with the slaves. (Or the slaveowners.) Most of us would find this disconcerting or even unacceptable. -/- I show that Fisk's general sort of account can be modified to allow for an non-arbitrary choice. Given general facts about human nature, societies based on domination will produce resistance that over the long run will diminish or eliminate various forms of domination. Through a sort of ratchet effect, rights won will be hard if not impossible to reverse. Societies embodying forms of domination can therefore be compared on dimensions of stability: the more domination, the more resistance, and the less stability. Such societies are inferior on the dimension of justice to more emancipatory society on the terms of both kinds of justice, official and radical. -/- This is not question begging because regimes of domination incorporate stability no less than more emancipatory social orders. The choice between official justice embodying domination and radical justice that does not is not arbitrary because it is based on a shared commitment to long term stability. Since antiquity, scholars have observed a structural tension within Plato’s Phaedrus. The dialogue demands order in every linguistic composition, yet it presents itself as a disordered composition. Accordingly, one of the key problems of the Phaedrus is determining which—if any—aspect of the dialogue can supply a unifying thread for the dialogue’s major themes (love, rhetoric, writing, myth, philosophy, etc.). My dissertation argues that “soul-leading” (psuchagōgia)—a rare and ambiguous term used to define the innate power of words—resolves the dialogue’s structural (...) tension. I clarify the conceptual and dramatic features of soul-leading by focusing on the dialogue’s uniquely prevalent use of the semantic network of “leading” and “following.” By continuing to foreground the language and drama of leading and following, I offer a new interpretation of the dialogue as a whole: the Phaedrus is Plato’s articulation of how the soul can be led into communion with reality. Chapter 1 discusses scholarly disputes about the unity of the Phaedrus and proposes that soul-leading adequately satisfies the criteria put forward for what would count as a unifying element. I argue that soul-leading unifies the dialogue both thematically and non-thematically; moreover, soul-leading is a theme capacious enough to account for the other principal contenders for unity put forward. Chapter 2 develops the ambiguous character of soul-leading by examining how the dialogue showcases dangerous forms thereof. Love and language are dangerous when they lead the soul toward goods which can never truly fulfill it. In order to clarify how love and language can mislead the soul, Socrates develops a set of accounts of how the soul is led, both internally and externally, in the three speeches on love. If the soul is to be led into communion with reality (the proper end of soul-leading), it must be led internally by the right part of the soul and externally by the right object of desire. Chapter 3 argues that all souls can, in principle, be harmonized and directed in the way that Chapter 2 requires. I show that Plato’s view of philosophy is neither elitist (i.e., some are intrinsically incapable of philosophy) nor naively essentialist. All can come into communion with reality because all are by nature equipped to do so. While Plato recognizes that there are forces which tend to prohibit one from exercising one’s capability of being rightly led, none of them are intrinsic to human nature. Chapter 4 argues that successful soul-leading require neither the leader nor the follower to be already well-disposed to what’s ultimate in order for the pair to come to a communion with what’s ultimate. Plato’s depiction of soul-leading love shows that love can itself promote the formation needed for both leader and follower to come into contact with reality. Love can do so because it is always already bound up reality in its responsiveness to beauty. Beauty itself calls the lover to itself by shining through the beautiful beloved, who acts as a reminder of transcendent Beauty. The lover mediates this same experience for the beloved. Each comes to desire the other as well as Beauty itself. Chapter 5 argues that the drama of the lovers’ formation mythically depicted in the Palinode (Chapter 4) is written into the drama of the dialogue as a whole. In the relationship between Socrates and Phaedrus, we see an enactment of love’s formative role. Likewise, in the relationship between Phaedrus and Lysias, we see an enactment of the dangerous soul-leading discussed in Chapter 2. My focus on leading and following also allows me to show the thematic significance of the drama’s setting. Chapter 6 articulates the metaphysical conditions under which one can be led into communion with reality. Transcendent Beauty invites us into communion with itself and makes possible our ascent by providing us with divine guides and images which can transport us from our ordinary experiences to the true beings. Beauty accomplishes its work—leading us in a “divine dance” where we follow the gods up to Beauty and back down to each other—through images. When we handle images of reality rightly, they lead our souls into communion with reality. Further, when we have come into communion, we’ll be inspired to be co-workers of Beauty’s soul-leading work. WilsonDuring the Romantic period, writers on both sides of the Atlantic explored the sleepwalker as a merger of holiness and horror. Emerging when scientific thinkers for the first time were connecting spirit to electricity and magnetism, the somnambulist became to certain Romantics a disclosure of the difficulty of harmonizing unseen and seen, agency and necessity. This problem prominently arose (...) in Anton Mesmer's late eighteenth-century experiments in animal magnetism, in which the sleepwalker proved a paradox: an opaque revelation of transparent currents and an unconscious vehicle of sophisticated thought. Romantics such as Coleridge embraced the somnambulist as an embodiment of these troubles involved in relating motion and meaning. Coleridge and those who responded to him saw in the hypnotized human this sobering possibility: the invisible requires the visible to make itself manifest while the visible needs the invisible to become significant. 1 This is sublime and sinister: to elevate a material form to spiritual power is transcendence; to sink the boundless into a body is grotesque.Here I explore the philosophical implications of animal magnetism, the place of the sleepwalker in the history of ideas, and the role of the hypnotized human in Romantic writers, especially Coleridge. I also meditate on relationships between matter and spirit, machine and human, word and thing. Along the way, I place the history of ideas and the works of Romantic writers in mutually illuminating dialogues. The literary texts shed fresh light on philosophical problems while the ideas reveal hidden literary elements.The somnambulistic trance had been around long before Mesmer's magnetic sleeps. For centuries, shamans had used auto-hypnosis to sound [End Page 329] their souls and other-hypnosis to cure their tribe-members' ailments. However, somnambulism could not become a scientific phenomenon until Europeans in laboratories began to study electricity and magnetism. In the early modern period, Paracelsus argued that a vital fluid courses through the cosmos. The human being draws this flow like a magnet attracts force. When the body pulls to itself evil effluvia, it falls ill. To return patients to health, Paracelsus placed magnets on painful areas. He hoped to extract the unwanted current and return it to the cosmic swirl. 2 In "magnetizing" spirit, Paracelsus opened a door for empirical inquiry into the invisible world. In 1600, William Gilbert claimed that magnets correspond to the earth: both are animated by universal attraction and repulsion. 3 By the end of the seventeenth-century, Newton proposed that things are impelled by a force that draws and repels. Newton's theory of gravity inspired natural philosophers of the next centuries to search for a principle of which the magnet and the spark are manifestations. 4During the second half of the eighteenth century and the early part of the nineteenth, natural philosophers explored electricity and magnetism with unprecedented precision. In 1752, Benjamin Franklin revealed the mystery of lightning and perhaps the spark of life. 5 Inspired by Franklin, F. C. Oetinger, J. L. Fricker, and Prokop Divisch developed a theology of electricity, based on the belief that God is the electrical current. 6 Later in the century, Luigi Galvani and Alessandro Volta debated over whether the galvanic flow might be the origin and principle of life itself. 7 A few years before Franklin harvested lightning, John Michell argued that the magnetic force is not constrained to lodestones but is possibly pervasive. Some years later, Franz Aepinus suggested that magnetism and electricity manifest a deep energy. Soon after, C. The purpose of this article is to continue the discussion on Europe’s converging criminal justice systems. In particular, I test a hypothesis that has recently appeared in the literature, which sees the jurisprudence of the European Court of Human Rights as one of the most significant factors that encourage a harmonization process between the adversarial and inquisitorial criminal justice systems of Europe. This claim is supported by examining the Court’s jurisprudence to identify decisions that led to legislative and policy amendments (...) in the domestic legal orders of the 46 member states of the Council of Europe. This account shows how an interplay currently taking place between judicial, policy, and statutory powers is marking the end of the adversarial-inquisitorial era. The Synoptic Problem is a puzzle that scholars have desired to solve since the 18th century. The discussion has a religious background, because it is about the first three canonical Gospels of the Church, namely Matthew, Mark and Luke, which came to be called the Synoptic Gospels. The discussion, in the most basic context, concentrates on the point that there is a possible relationship or connection between the Synoptic Gospels and that each one is substantially similar to another but at (...) the same time includes different aspects. This theoretical discussion separates the Gospel of John from the Synoptic Gospels and does not see it as a main source for the history of Jesus. The method of discussion is based on the reading of the Synoptic Gospels from a birds-eye-view, as seen together, and as comparatively in relation to each other. The aim of the discussion is to reach accurate historical information about Jesus and the birth of Christianity by analyzing the possible relationship between the Synoptic Gospels through their sources. Several hypotheses have been proposed for the solution of the Synoptic Problem. However, all the modern studies in the context of the problem are carried out by Western scholars. In other words, Synoptic Problem is a relatively unknown subject in the Turkish academic circles. So in this paper the aim is to draw the attention of the Turkish academy to the substance and framework of the Synoptic Problem through an introductory survey. In addition, some results that can be reached in this context will be exemplified by getting help from the redaction criticism. There have been many dimensions of these discussions. However, whether the Gospels contain contradictory information or not has always been at the forefront. Pagan writers, such as Celsus or Porphyry, criticized the Gospels in this respect. Christian writers, such as Marcion or Tatian who lived in the second century when the Gospels were not seen as canon yet, raised some suggestions based on the doubts that the Gospels were incompatible with the Jewish scriptures and contained contradictions among themselves. Marcion included a single Gospel that was close to the Gospel of Luke in his New Testament canon. Tatian made a mixed version of the four Gospels. In the next stage, the contradictions in the Gospels were explained by the Christian writers, such as Origenes or Augustine. However, the four Gospels were more prominent in this new era and they were regarded as canons by the Church. Therefore, the Christian writers’ approach to the Gospels also began to change. Origen emphasized allegorical interpretation which had been known since the Jewish philosopher Philo (d. 50) in Alexandria. Thus, he wanted to protect the contradictory texts from being seen as the source of the problem. He argued that the problem was the human mind that could not grasp the allegorical mystery of the text or the narrative in the text. Augustine had a similar approach with the suggestion that the Gospels should be read by a faithful heart. According to Augustine, it is natural that the Gospels reflect different characters because the Gospel writers describe Christ differently. In order to be able to comprehend the divine meaning in these texts, the Gospels must be read in a spiritual mood. After all, all these Christian writers aimed to respond to the criticism by the pagan writers regarding the Gospels, as well as the current suspicions in the minds of Christians.Origen was the first Christian thinker to devote an effort to solve the debates on the Gospels in a logical and systematic way. As for Augustine, he was the starting point of the Synoptic Problem since Augustine was the first to mention the links between the Gospels texts, namely the idea that the authors of the Gospels may have used each other as sources. However, in the modern sense, the Synoptic Problem has been transformed into an academic discipline by the intellectuals who followed the path of Enlightenment thinkers, such as Reimarus (1684-1768), Lessing (1729-1781), Griesbach (1745-1812), and Eichhorn (1752-1827). Because modern researchers differ from old writers based on Church ideologies, they began to demolish traditional beliefs about the Gospels. Thus, the effort to harmonize incompatible narratives in the Gospels is left aside. Indeed, the ancient writers put a lot of effort into it. Now, in the places where indirect relations can be established between the Gospels, the idea of finding the common hypothetical sources of these Gospels is prominent. The claim that the Gospels were directly connected to Jesus as a historical figure has been gradually faded away. The basis of the Synoptic Problem is the comparative reading of the Synoptic Gospels. In the modern sense, this comparison and its interpretation was made by J. J. Griesbach (1745-1812) for the first time. Griesbach was the first scholar to compare Matthew, Mark, and Luke in a way to create a synopsis. His comparison is based on a reading done by placing several passages or narratives from the Gospels side by side.Many hypotheses have been put forward for the solution of the Synoptic Problem. Two-Source Hypotheses, Four-Source Hypotheses, and Farrer Theory are the most popular ones among researchers. These views are based on Marcan Priority. In this context, independently from each other, Matthew and Luke used Mark’s text as their sources. Also, according to the Two-Sources and Four-Source Hypotheses, the authors of Matthew and Luke used another written document as their sources. This document is named the “Q” which derives from the German word “Quellen.” In this way, it is assumed that the Q-document and the Gospel of Mark are the sources of the Gospels of Matthew and Luke.The writers of the Gospels wrote their own texts by using written and oral sources. One of the scholarly methods is the redaction criticism that explores how the Gospel writers shaped the old literary documents by arranging, re-shaping, and revising them. This theory looks at whether the source used by an author is known and available today in order to understand whether how the author used his sources would provide important clues about his tendencies or ideologies. In this regard, the theory of the Marcan priority can be rendered functional along with the redaction criticism. In doing so, it is possible to reach important conclusions about Jesus and the birth of Christianity, as well as the theological and ideological ideas of the unknown authors of the Gospels of Matthew and Luke. First of all, the authors of Matthew and Luke used Mark’s text as their sources. Secondly, we have these three Gospels today. And finally, the ways in which the writers of Matthew and Luke shaped the text, phrases, or expressions of Mark reveal important results about their thoughts. The analysis shows that the authors of Matthew and Luke sometimes made additons that could be called interpolation to Mark’s text; sometimes they wanted to censor some statements in Mark; sometimes they tried to explain or clarify some statements in the Mark, or sometimes they tried to blur clear expressions and expositions in Mark's text. These authors did not do such things without a reason. They wanted to reshape Mark’s text in accordance with their theological understanding of Jesus as Christ. In this context, according to some expressions in Mark, Jesus' power had a limit. The authors of Matthew and Luke did not find these statements appropriate, because they changed Mark’s some statements to create an impression that Jesus’ power was not limited. This proves that the authors of Matthew and Luke re-arranged their resources to present Jesus as a superhuman being. Similarly, in Mark, there are lines in which Jesus declares his loyalty and servitude to the God of Israel. In such passages, he presented his personality in a low Christology context against God. However, the authors of Matthew and Luke were disturbed by such statements, because they intervened in these statements in Mark. They wanted to change some of the meanings and contexts in Mark’s text through such interventions and presented Jesus as Christ in a high Christological context to their readers. In the end, all these researches also responded to the question of to what extent the Gospels provide reliable information on a historical basis. (shrink)

BackgroundThe landscape of clinical research has evolved over the past decade. With technological advances, the practice of using electronic informed consent (eIC) has emerged. However, a number of challenges hinder the successful and widespread deployment of eIC in clinical research. Therefore, we aimed to investigate the views of various stakeholders on the potential advantages and challenges of eIC.MethodsSemi-structured interviews were conducted with 39 participants from 5 stakeholder groups from across 11 European countries. The stakeholder groups included physicians, patient organization representatives, (...) regulator representatives, ethics committee members, and pharmaceutical industry representatives, and all were involved in clinical research. Interviews were analyzed using the framework method.ResultsInterviewees identified that a powerful feature of eIC is its personalized approach as it may increase participant empowerment. However, they identified several ethical and practical challenges, such as ensuring research participants are not overloaded with information and offering the same options to research participants who would prefer a paper-based informed consent rather than eIC. According to the interviewees, eIC has the potential to establish efficient long-term interactions between the research participants and the research team in order to keep the participants informed during and after the study. Interviewees emphasized that a personal interaction with the research team is of utmost importance and this cannot be replaced by an electronic platform. In addition, interviewees across the stakeholder groups supported the idea of having a harmonized eIC approach across the European Member States.ConclusionsInterviewees reported a range of design and implementation challenges which needs to be overcome to foster innovation in informing research participants and obtaining their consent electronically. It was considered important that the implementation of eIC runs alongside the face-to-face contact between research participants and the research team. Moreover, interviewees expect that eIC could offer the opportunity to enable a personalized approach and to strengthen continuous communication over time. If successfully implemented, eIC may facilitate the engagement of research participants in clinical research. (shrink)

Art has long been said to open up a different relationship to nature for the subject than ordinary theoretical or practical knowledge allows. Instead of making nature the distanced object of our contemplation or the mere material and means of our practical constructions, art discloses to us an intelligibility of nature that reaches further than our concepts and a naturalness of ourselves that connects us with what we usually relate to as our other. Against this backdrop, it does not seem (...) surprising that the discussions about the problematic relationship to nature that have characterised the Anthropocene repeatedly turn to art and highlight its ability to overcome the problematic modern opposition of subject and object, spirit and nature, which has got us in this mess. In what follows, I want to argue, however, that art and aesthetic experience can only help here if it leads beyond the classical aesthetic paradigms of the beautiful and the sublime. The beautiful dwells in a dream of a harmonic fit between subject and nature that is precisely in question in the Anthropocene, and the sublime presents the superior power of nature only to bring out a different kind of power in the intelligent subject that remains untouched by natural might. These classical figures of aesthetic experience thus obscure how profoundly we need to revise our relation to nature in order to respond to the Anthropocene. -/- In order to see this, it is helpful to first take a look at how (I) modern aesthetics around 1800 fundamentally conceived of art as a second or other nature. Against this background, we can understand more precisely (II) in which sense the figures of natural beauty and the sublime conceive of the relationship to nature. In view of the Anthropocene, these figures threaten to become part of an aesthetic ideology. We therefore need (III) other aesthetic strategies which I will point to in the third part. (shrink)

Current models of speech motor control rely on either trajectory-based control (DIVA, GEPPETO, ACT) or a dynamical systems approach based on feedback control (Task Dynamics, FACTS). While both approaches have provided insights into the speech motor system, it is difficult to connect these findings across models given the distinct theoretical and computational bases of the two approaches. We propose a new extension of the most widely used dynamical systems approach, Task Dynamics, that incorporates many of the strengths of trajectory-based approaches, (...) providing a way to bridge the theoretical divide between what have been two separate approaches to understanding speech motor control. The Task Dynamics (TD) model posits that speech gestures are governed by point attractor dynamics consistent with a critically damped harmonic oscillator. Kinematic trajectories associated with such gestures should therefore be consistent with a second-order dynamical system, possibly modified by blending with temporally overlapping gestures or altering oscillator parameters. This account of observed kinematics is powerful and theoretically appealing, but may be insufficient to account for deviations from predicted kinematics—i.e., changes produced in response to some external perturbations to the jaw, changes in control during acquisition and development, or effects of word/syllable frequency. Optimization, such as would be needed to minimize articulatory effort, is also incompatible with the current TD model, though the idea that the speech production systems economizes effort has a long history and, importantly, also plays a critical role in current theories of domain-general human motor control. To address these issues, we use Dynamic Movement Primitives (DMPs) to expand a dynamical systems framework for speech motor control to allow modification of kinematic trajectories by incorporating a simple, learnable forcing term into existing point attractor dynamics. We show that integration of DMPs with task-based point-attractor dynamics enhances the potential explanatory power of TD in a number of critical ways, including the ability to account for external forces in planning and optimizing both kinematic and dynamic movement costs. At the same time, this approach preserves the successes of Task Dynamics in handling multi-gesture planning and coordination. (shrink)

Engaging in dialogue with African philosophy, I respond to questions raised by Thaddeus Metz on characteristics of Confucian philosophy in comparison with African philosophy. First, in both Confucian philosophy and African philosophy, harmony/harmonization and self-realization coincide in the process of person-making. Second, Confucians accept that sometimes it is inevitable to sacrifice individual components in order to achieve or maintain harmony at large scales; the point is how to minimize such costs. Third, Confucians give family love a central place in the (...) good life before extend love to the rest of the world. Fourth, the Confucian philosophy of gender equality is based on appropriate division of labor consistent with its yin-yang philosophy, rather than equal split of power in the family. Fifth, in the Confucian view, hierarchy and harmony do not necessarily contradict each other, though hierarchy is not essential to all forms of harmony. The two can co-exist. (shrink)

Autonomy is associated with intellectual self-preservation and self-determination. Shame, on the contrary, bears a loss of approval, self-esteem and control. Being afflicted with shame, we suffer from social dependencies that by no means have been freely chosen. Moreover, undergoing various experiences of shame, our power of reflection turns out to be severly limited owing to emotional embarrassment. In both ways, shame seems to be bound to heteronomy. This situation strongly calls for conceptual clarification. For this purpose, we introduce a (...) threestage model of self-determination which comprises i) autonomy as capability of decision-making relating to given sets of choices, ii) self-commitment in terms of setting and harmonizing goals, and iii) self-realization in compliance with some range of persistently approved goals. Accordingly, the presuppositions and distinctive marks of shame-experiences are made explicit. Within this framework, we explore the intricate relation between autonomy and shame by focusing on two questions: on what conditions could conventional behavior be considered as self-determined? How should one characterize the varying roles of actors that are involved in typical cases of shame-experiences? In this connection, we advance the thesis that the social dynamics of shame turns into ambiguous positions relating to motivation, intentional content,and actors’ roles. (shrink)

The present work, in two volumes, offers an exceptionally lucid guide to some of the main lines of Madhyamaka thought in Tibet and the disputes that these engendered. It constitutes an essential contribution to our knowledge of the philosophical traditions of Tibetan Buddhism, but, beyond this, merits the attention of those focusing on their Indian background and on Buddhist philosophies more generally. Indeed, Knowing Illusion is among the rare works in this area that may be profitably taken up by philosophers who are not specifically concerned with Buddhist or other Asian ways of thought, but who may wish to explore approaches beyond those of the Euro-American tradition to some of the central topics of philosophy overall: truth and falsehood, knowledge and ignorance, existence and illusion, belief and argument. Of the many interesting [End Page 1023] questions raised in Knowing Illusion, whether from the perspective of specialized Tibetan Buddhist Studies or of philosophy more broadly, only a sample can be addressed in the space of this review.The unifying thread in Knowing Illusion is a series of written disputes that were provoked by a fifteenth-century teacher belonging to the Sakyapa order of Tibetan Buddhism, Taktsang Sherab Rinchen (1405–1477), in his treatise titled Freedom from Extremes Accomplished through Comprehensive Knowledge of Philosophy (hereinafter Comprehensive Knowledge of Philosophy).2 Central to these debates was the challenge of squaring the Madhyamaka philosophy of Nāgārjuna (second century c.e.), whose teaching of ultimate emptiness (śūnyatā) seemed to undermine most—perhaps all—claims to knowledge, with the positive theory of knowledge (pramāṇa) advanced by Dignāga (fifth century c.e.) and Dharmakīrti (sixth century c.e.). The problem had already preoccupied Indian Buddhist thinkers, including philosophers Bhāviveka (sixth century c.e.) and Śāntarakṣita (eighth century c.e.), who sought to harmonize the insights of Madhyamaka with those of the pramāṇa school, and Dharmakīrti's contemporary Candrakīrti, whose trenchant interpretations of Nāgārjuna appeared to undermine the entire project of a 'theory of knowledge'.3 In Tibet, thinkers of the former camp came to be known as proponents of Svātantrika-Mādhyamika (so-called because they affirmed that emptiness could be established through positive proof, svatantra), while those allied with Candrakīrti were said to follow Prāsaṅgika-Mādhyamika (who allowed only indirect proof, reductio ad absurdum, or prasaṅga).4The debate reemerged forcefully in Tibet, and not merely as a historical exercise, in tandem with the expansion of monastic colleges there during the twelfth century, as Tibetan teachers increasingly elaborated original perspectives on the Indian classics. 1 Introduction1 In the 1980s, hermeneutics was often incorporated into deconstructionism and literary theory. Rather than focus on authorial intentions, the nature of writing itself including codes used to construct meaning, socio-economic contexts and inequalities of power,2 Gadamer introduced a different perspective; the interplay between effects of history on a reader’s understanding and the tradition(s) handed down in writing. This interplay in which a reader’s prejudices are called into question and modified by the text in a fusion of understanding (...) and topic revitalized the study of the printed word. Gadamer’s turn to language for understanding the meaning of Being also appealed to the post-modern antipathy toward modernity and metaphysics.3 If the truth and validity of interpretations are limited to communities of language, then our mode of being in history cannot but be historical. This point of view rendered Gadamer’s phenomenological hermeneutics vulnerable to the critique of moral and epistemological relativism. However, Gadamer’s theory of interpretation also stems from re-examination of the beginning of knowledge in the Pre-Socratics and Plato, and on this basis, is receptive to another dimension of inquiry than that which was trending in North America. -/- At the East-West Center, University of Hawai’i at Manoa in 1982, Chung-ying Cheng for the first time introduced onto-hermeneutics to an audience of esteemed philosophers including Li Zehou, Ren Jiyu, Feng Youlan, and Zhang Liwen.4 In contrast to schools of deconstruction and literary theory that had disengaged the interpreter from trans-historical sources of meaning and truth, Cheng explained that interpreters exist within a cosmological order inextricable from responsibility to harmonize Heaven and Earth in creative acts of interpretation. By integrating Chinese cosmology into hermeneutics through ontology, he tacitly challenged philosophers in the West to re-examine assumptions about humanity’s place in nature and by implication, Gadamer’s recovery of the beginnings of knowledge in Western philosophy. -/- Cheng’s Neo-Confucianism is inspired by the method and goals of Thomé H. Fang. The following words by Fang seem to prefigure, although in an indistinct and bundled way, aspects of Cheng’s philosophy including a Mencian theory of human nature, comprehensive observation, and creativity: “In the very process of living in concord with creative Nature, Man is charged with an ideal to be fully realized in the light of the principle of comprehensive harmony.”5 Like Fang, Cheng reinvigorates Chinese culture and language, but not solely in order to vindicate the insights of Neo-Confucianism. He has studied Western thought, from pragmatism and the analytic school to German idealism and phenomenology, to unlock and clarify philosophical concepts within the Yijing tradition and thereby render them intelligible to Anglophones. The result has been an awakening of Western scholars to the moral and cultural consequences of decoupling their thought from metaphysical foundations that are neither dogmatic nor doctrinal. -/- Not unlike the dialectic of Gadamer’s dialogue form, onto-generative hermeneutics integrates contrary positions on the same topic in order to blend both sides into a world philosophy, or as Cheng says, a “totalizing or integrative theory,”6 not to be confused with a theoretical rewording of a theory. On the contrary, the universal scope and relevance of hermeneutics stems from personal experience. Just as Gadamer, in response to faction and strife, immersed himself in Plato during the war years, and developed a method with which to harmonize opposites, so too, according to On-cho Ng, was Cheng moved by faction, strife and political persecution to develop a path toward unity.7 Gadamer taught at McMaster University in Hamilton, Ontario, and Cheng at the University of Hawai’i at Manoa among other institutions in North America. They facilitated trans-continental educational and cultural ties. Similar experiences yield similar insights irrespective of differences of time and place. Hence, authors in this issue who reside in Europe, China and North America, delineate the differences between Gadamer and Cheng, yet also, in light of Cheng’s onto-generative method and cosmology, develop integrative theories. Due to the page-budget restriction of the publisher, certain articles of this special theme will be subsequently published in the next issue. -/- 2 Integrative Theory This special issue of The Journal of Chinese Philosophy confirms a dimension of hermeneutics that Cheng has both motivated and inspired. The contributors do not abide by the conviction that since thought is mediated by language, interpretations cannot transcend culture. On the contrary, their research exemplifies the fruits of trans-historical onto-dialogical hermeneutics within limits defined by their field inquiry, organized into Parts I and II, around three themes: language, the philosophy of history and ethics. -/- Andrew Fuyarchuk introduces the theme of ontology in relation to Gadamer’s turn to language. Fuyarchuk argues that Chung-ying Cheng’s criticism of Gadamer’s hermeneutics is informed by Heidegger’s concept of Dasein and thereby overlooks how Gadamer’s Platonic-Pythagorean problem of the division between the One and Many is harmonized in the event of language, which in turn positions Gadamer in proximity to the presupposed grounds of receptivity in Cheng’s onto-generative hermeneutics. Lauren Pfister’s contributing article addresses the year 2000 meeting between Cheng and Gadamer in Heidelberg and expands the transhistorical grounds of meaning in Gadamer to matters of theology. Pfister’s summary of the written Chinese record of their conversation indicates that Cheng does not address the role of Christian philosophy and hence, the role of the inner word in Gadamer’s hermeneutics. This is important not only for detecting changes in Cheng’s philosophical development, but also for modifying his hermeneutics along the lines of a living conversation, possibilities explored by Pfister in a sequel to the article submitted to this issue. Nevertheless, by raising the issue of how Gadamer’s turn to language for understanding the meaning of Being extends possibilities in Cheng’s thought, Pfister anticipates the article by Katarina Gajdosova. She returns to the roots of Chinese thought during the Warring States period and broadens the meaning of names in recently excavated texts. Contrary to the conventions about how to understand terms, she appeals to both Heidegger’s ontology and Cheng’s notion of receptivity and creativity to reinterpret naming in relation to cosmology. Along the same lines, insofar as the event of Being is lingual, Jay Goulding captures its emergent structure in an evolving community of scholars and scholarship. He recalls his philosophical journey toward Cheng’s philosophy that begins in conversations with Gadamer at McMaster University in Hamilton, leads to Heidegger and Asian thought, expands into turning points with teachers and colleagues from various backgrounds that by increments contributed to Goulding’s formulation of “Daoist phenomenology.” -/- Although differing traditions guide their inquiries and research, Cheng and Gadamer recall the wisdom of the past to ameliorate the fragmentation in contemporary life. This leads them to re-examine the origins of philosophy; historical roots and thus sources of creative re-interpretations East and West whose affinities are developed in contributions by Hyun Höchsmann and Friederike Assandri. Höchsmann assesses convergences and divergences in the origins of Chinese and Western philosophy (Confucius and Socrates, the Yijing and Pre-Socratics) that culminates in pairing Gadamer’s understanding of paideia in the context of Plato’s political cosmology in the Timaeus with moral and social cultivation in The Western Inscription. She delineates the limits of this comparison which in turn justifies introducing Vattimo’s notion of locality. Assandri’s comparative analysis moves between India and China, Buddhism and Tang Daoism. Based on Gadamer’s argument that writing detaches concepts from their cultural moorings, she defines and applies three levels of understanding in onto-generative hermeneutics to Buddhist terms that were assimilated into the Benji Jing and in so doing clarifies essential dimensions of Daoism. -/- Contributions by Stephen Palmquist and Nicholas Brasovan position Cheng in relation to Kant and Gadamer by way of Aristotle’s ethics respectively. On the one hand, Palmquist plots Cheng’s evolving criticism of Kant’s moral philosophy and draws on crucial dimensions of Gadamer’s hermeneutics to reposition that criticism in a constructive relation to Kant’s emphasis on the philosophical conditions of morality while also indicating how religious dimensions of his thought answer Cheng’s concerns for lived moral action. For Palmquist, Gadamer enables a constructive criticism of Cheng. On the other hand, Brasovan compares Cheng’s Yijing-based account of moral deliberation with Gadamer’s Aristotelian-based ethics and reasons that in contrast to Cheng, Gadamer’s hermeneutical consciousness is disengaged from practical knowledge. For Brasovan, Cheng is a constructive critic of Gadamer. Palmquist and Brasovan’s divergent angles on Gadamer and Cheng map onto a dialectic of contrast and complementarity that constitutes the inner logic of Cheng’s philosophy. In other words, Gadamer and Cheng ought to be read alongside one another for the sake of removing discrepancies and contradictions, which constitutes the organic structure of their thinking. -/- 3 Our Mode of Being in History Is Not Historical The conversations between Cheng and Gadamer in this issue of The Journal of Chinese Philosophy pivot on language, philosophy of history and ethics within a comparative framework of analysis, but also explore the grounds that make the comparisons possible. Those grounds are informed by Chinese cosmology, and function to wrest Gadamer from the shadow of Heideggerian facticity and reposition him within the range of Cheng’s ideas about our place in nature that is embedded in his question about how mind emerges from inorganic matter.8 -/- For Gadamer scholars of Heidegger, human finitude, our ownmost individuating death ensures that hermeneutics is always open to the other as other, always on the way toward understanding the meaning of Being. To arrest the process in a concept of “the Absolute” cannot but represent someone’s point of view, and thereby render hermeneutics indistinguishable from ideology. However, insofar as finitude is defined by them in terms of an onto-theological concept of immorality, finitude is a metaphysical concept consistent with epistemologies and confuse beings with the meaning of Being. As a result, the celebrated political value of hermeneutics to always be on the way toward an understanding of the meaning of Being admits subtle variations on the same worldview that are insufficiently self-critical. -/- Gadamer scholars of Heidegger are right. A transformation in ethos and opening to the meaning of Being depends on awareness of finitude. Yet this awareness does not yield openness to more of the same, i.e., discourse structurally incapable of coming to unity but instead, for both Gadamer and Cheng, openness to a distinctly different ontological dimension of reality. As Sandra Wawrytko and So-Seong Park indicate,9 this ontological dimension is prefigured in the experience of being-as-a-whole or the totality of all possible relations in both Chinese totemic shamanistic rituals,10 and Greek Dionysian festivals.11 Through these religious experiences human ethos and therefore consciousness is expanded and elevated from being centered on one’s ownmost concerns toward an affinity with all sentient beings from insects and plants to animals. The channel for this affinity is an auditory disposition and hence, the emotions, compassion, and feeling response. -/- The capacity for an auditory disposition, or as Gadamer calls it, listening consciousness to respond to the inter-relationality and therefore inherent balance of nature is developed through music, song and dance of the religious rituals and festivals. They facilitate the unity of mind with nature. This use of music, that transforms ordinary consciousness, explains Cheng’s emphasis on the receptivity of feeling response in comprehensive observation, and Gadamer’s emphasis on openness to the other in attunement. However, an auditory disposition characteristic of pre-literate oral cultures that reveals the “All” need not rely on religion. As theorists about the evolution of language have explained,12 modern languages preserve their pre-historical past in music or prosody. That is to say, the song and dance that revealed the totality of inter-related beings to an ethos of comprehensive observation and attunement toward beings in classical civilizations is retained in the back-and-forth movement or rhythm of the dialogue form. Our mode of being in history is a mode of being in nature – through the music of language. -/- While alerting the reader to the limits of a nominalist interpretation, Gadamer expresses the inner law of the nature as follows: “in perishing there is always becoming, and in becoming there is always perishing.”13 Considered in process, opposites generate and blend into each other. This law of nature applies to everything.14 Hence, in a manner comparable to Pfister’s concluding insights, onto-dialogical hermeneutics is not only open to discrete events of otherness but moreover, to the moving structure of reality expressed, as Gajdosova suggests, in the existential moment of naming. Considered as interplay of tension and resolution with a life of its own, the dialectic of a dialogue is self-similar to the way in which an organism grows (by instinct). There is, therefore, a sense in which the art of interpretation extends the human mind into the eternal cycles of nature such that we participate in the articulation of the inner telos/homeostasis toward which all beings strive and importantly for Gadamer scholars of Heidegger, within the material limits of energy to which our embodied minds are self-evidently subject.
