Cet essai aborde la question phénoménologique fondamentale de la donation de l’apparaître. L’auteur commence par noter que la distinction husserlienne entre l’apparaître comme vécu (Erscheinen als Erleben) et ce qui apparaît (das Erscheinende) ou phénomène a été critiquée à partir de deux perspectives différentes dont Patočka et Henry sont, respectivement, deux représentants importants. Quoique tous deux critiquent la même distinction husserlienne, l’auteur montre cependant que leurs critiques prennent en réalité des directions opposées. Patočka entend développer une phénoménologie asubjective dans laquelle (...) la donation fondamentale de toute apparence se trouve dans le « se-montrer-soi-même » (Sich-selbst-zeigen) des êtres. Plutôt que dans le domaine de l’auto-donation du vécu de l’expérience (Erleben), cette phénoménologie fonde l’apparence dans la sphère phénoménologique globale du monde. Henry, quant à lui, ne rejette pas le domaine subjectif mais renforce bien plutôt son importance en radicalisant la distinction husserlienne entre l’expérience et le phénomène et en la remplaçant par la différence qu’il établit entre révélation et manifestation. La manifestation suppose toujours la distance et l’intentionnalité. La révélation, en revanche, peut être comprise comme une radicalisation de l’expérience husserlienne, puisqu’elle est un mode d’apparaître qui n’implique pas une forme de pensée (meinen) et d’intentionnalité. Elle est, en tant que telle, exempte de la distance que Henry exclut du domaine d’intériorité où se produit la révélation. L’auteur discute alors ce contraste entre Patočka et Henry et montre à quel point l’accent mis sur le monde dans l’explication de la donation donnée par le premier diffère de la relation à soi subjective qui est au cœur de l’explication de la donation offerte par le second. A concepção espinosista das relações entre o corpo e a mente é frequentemente apresentada como um modelo e uma referência na biologia e na neurobiologia contemporâneas, como testemunham as obras de Jean-Pierre Changeux, de Antonio Damasio ou de Henri Atlan. Apesar de suas profundas diferenças, esses pesquisadores expõem de maneira análoga três teses que fazem de Espinosa um precursor: o monismo psicofísico, a dualidade de expressão da unidade corpo/mente e a ausência de interação e de causalidade recíproca. Esse artigo (...) se interroga sobre as razões pelas quais Espinosa é convocado por esses pesquisadores para dar apoio às suas teorias e para abordar os diferentes usos da sua concepção das relações corpo/mente. Trata-se, portanto, de examinar a maneira pela qual eles apreendem sucessivamente essas três teses e de mensurar a pertinência de suas abordagens. (shrink)

Fruit de nombreuses annees de travail, L'essence de la manifestation est l'ouvrage majeur de Michel Henry. Frolant le millier de pages, il engloutit le lecteur qui plonge en lui, pour decouvrir une nouvelle et fulgurante philosophie de la subjectivite et de l'affectivite, tout en le menant dans les subtiles arcanes de l'histoire de la philosophie, genialement relue. Il n'en demeure pas moins que l'ouvrage est aussi une somme, qui demande sans doute quelques outils pour s'orienter dans sa complexite. Ce livre, (...) ecrit en commun par une generation renouvelee de chercheurs ayant travaille sur les archives du philosophe, voudrait aider le lecteur qui entreprend ou reprend la lecture de L'essence de la manifestation, en mettant en lumiere sa genese et sa structure, mais aussi le caractere fascinant d'un livre magistral de la philosophie d'expression francaise du 20eme siecle. In this paper I argue that Poincaré’s acceptance of the atom does not indicate a shift from instrumentalism to scientific realism. I examine the implications of Poincaré’s acceptance of the existence of the atom for our current understanding of his philosophy of science. Specifically, how can we understand Poincaré’s acceptance of the atom in structural realist terms? I examine his 1912 paper carefully and suggest that it does not entail scientific realism in the sense of acceptance of the fundamental existence (...) of atoms but rather, argues against fundamental entities. I argue that Poincaré’s paper motivates a non-fundamentalist view about the world, and that this is compatible with his structuralism. (shrink)

Henri Bergson (1859-1941) is one of the truly great philosophers of the modernist period, and there is currently a major renaissance of interest in his unduly neglected texts and ideas amongst philosophers, literary theorists, and social theorists. The practice and development of modern medicine requires large amounts of data, particularly in the domain of cancer. The future of personalized medicine lies neither with “genomic medicine” nor with “precision medicine”, but with “data medicine”. The establishment of this DM has required far-reaching changes, to establish four essential elements connecting patients and doctors: biobanks, databases, bioinformatic platforms and genomic platforms. The “transformation” of scientific research areas, such as genetics, bioinformatics and biostatistics, into clinical specialties has generated a new vision (...) of care. Molecular tumor boards are one response to these changes and are now providing better access to next-generation sequencing and new cancer treatments to patients with inoperable or metastatic cancers, and those for whom the usual treatment has failed. However, MTB face a crucial ethical challenge: maintaining and improving the trust of patients, clinicians, researchers and industry in academic medical centers supported by private or public funding rather than providing genetic data directly to private companies. We believe that, in this era of DM, appropriate modern digital communication networks will be required to maintain this trust and to improve the organization and effectiveness of the system. There is, therefore, a need to reconsider the form and content of informed consent documents at all academic medical centers and to introduce dynamic and electronic informed consent. (shrink)

HENRI BERGSON (1859-1941), philosophe français, professeur au Collège de France de 1900 jusqu´à 1921, récompensé avec le prix Nobel de littérature en 1928. Ses oeuvres majeures, écrites avec un style parfaitement accessible au lecteur non spécialisé, sont : « Essai sur les données immédiates de la conscience » (1889), « Matière et mémoire » (1896), « L´évolution créatrice » (1907) et « Les deux sources de la morale et de la religion » (1932). Dans ces études, Bergson élabore une (...) vision philosophique en opposition au matérialisme et positivisme scientifique. Concentrant sa recherche sur les intuitions individuelles, il prône la notion d´élan vital, lequel dirige le procès évolutif vers des états d´organisation de plus en plus complexes, et de là vient l´intérêt de donner prééminence à tout ce qui est spirituel et ouvertement créatif, sur tout ce qui est formel, fixé, fermé. Dans « Le rire : essai sur la signification du comique » (1900), il trouve que le comique est soulevé des que nous percevons dans les actions humaines les automatismes, répétitions ou dysfonctionnements qui contrastent avec l´essentielle spontanéité de la vie réelle. Si la vie est une évolution, alors elle doit expliquer jusqu'à la connaissance, l'intelligence, la science et la technique de l'homme, l'homo faber ; si il y a en elle de la création, alors ce n'est pas un postulat extérieur, mais dans son histoire et dans notre vie même qu'on doit l'expérimenter. dans L'évolution créatrice, Bergson pousse ainsi la théorie de l'évolution et l'expérience de la " durée " jusqu'au bout, sans admettre ni une création transcendante ni une vie sans (...) émergence ou nouveauté. Les conséquences traversent toute la science, la théorie de la connaissance, et la philosophie, de 1907 à aujourd'hui. La première édition critique des œuvres de Bergson, dans laquelle s'inscrit le présent volume, répond à un double principe : offrir d'abord le texte intégral du livre tel que l'a publié Bergson, dans sa pagination de référence inchangée ; le compléter ensuite par un dossier comportant des notes historiques et philosophiques ainsi que les variantes éventuelles du texte, une table analytique de l'ouvrage, une série originale d'index, une anthologie des " lectures " majeures et une bibliographie commentée. The ArgumentThe status of the person is analyzed as represented by the life sciences under the influence of modern physico–chemical and molecular biology.At the same time the linguistic structure of reality as seen through formalized scientific discourse is not that of a language, but rather that of operational symbolisms, so that the judeo–Greek tradition of Verb as creating and Logos as procreating — which is probably at the origin of the surprising confidence in the possibility of dominating nature through words (...) and formulae — could be suc–cessful only through the depersonalization of language.Notwithstanding appearances, the phenomena of structural and functional self–organization do not really change this situation.In this context the question of the status of the person and of the intentional subject has to be dealt with pragmatically, giving up the notion of a unified scientific theory that would take into consideration at the same time the experi–mental sciences and the human sciences as linking subjectivity and intentionality. The explanation of the phenomenon of Brownian motion, given by Einstein in 1905 and based on the kinetic–molecular conception of matter, is considered one of the fundamental pillars supporting atomism in its victorious struggle against phenomenological physics in the early years of this century. Despite the importance of the subject, there exists no specific study on it of sufficient depth. Generally speaking, most histories of physics repeat the following scheme: the discovery made by Robert Brown in 1827 , of the (...) continuous movement of small particles suspended in a fluid did not arouse interest for a long time. Finally, at the close of the century, Gouy's research brought it to the attention of the physicists. Gouy was convinced that Brownian motion constituted a clear demonstration of the existence of molecules in continuous movement. Nevertheless, he did not work out any mathematized theory that could be subjected to quantitative confirmation. All nineteenth-century research remained at the qualitative level and yet it was able to clarify some general characteristics of the phenomenon: the completely irregular, unceasing, motion of the particles is not produced by external causes. It does not depend on the nature of the particles but only on their size. The first significant measurements, carried out by Felix Exner in 1900, appeared to deny the possibility of reconciling the kinetic theory with Brownian motion. The discovery of the ultra-microscope then allowed Zsigmondy to perceive the presence of movements, which were completely analogous to Brown's, in the particles of the colloids; these movements were rather smaller in size than those invesigated up to then. Thus Zsigmondy aroused interest in the phenomenon. Finally, in 1905, Einstein succeeded in stating the mathematical laws governing the movements of particles on the basis of the principles of the kinetic–molecular theory. The following year Smoluchowski arrived at conclusions which corresponded to Einstein's. These laws received a first, rough confirmation in the years immediately following by the work of The Svedberg, Seddig and, for some historians, Henri. Then in 1908 Jean Perrin gave it a definitive confirmation. (shrink)

The objective of this study is to analyze the measurability and interfirm comparability of sustainability performance through the qualitative content analysis of 12 sustainability reports of mining firms using the Global Reporting Initiative guidelines. The systematic comparison of information disclosed in 92 GRI indicators sheds light on the reasons underlying the impossibility of rigorously measuring and comparing the sustainability performance of firms from the same sector, which are supposed to be strictly following the same reporting guideline. These reasons include qualitative (...) aspects of sustainability, lack of compliance with GRI protocols, indicator contingency, ambiguous or incomplete information, data heterogeneity, and report opacity. The study makes it possible to return to the very notion of sustainability, its meaning, and flexible application by organizations. The results are discussed from three different theoretical perspectives, each of which proposes possible and complementary explanations of the main findings. (shrink)

This article addresses the problem of legislation and adjudication in early states, offering examples from Africa and other parts of the world. It discusses the problems of legitimacy and governance, especially in the context of multi-ethnic populations. For some of its generalizations it draws upon a previous study of twenty-one early states.

ZusammenfassungAus der Sicht der offenen Transzendentalphilosophie kommt es weniger auf eine physikali‐stische Gesamttheorie der Welt an als auf eine Analyse der normativen Tätigkeiten, die wir in die‐ser ausüben. Es wird gezeigt, wie wir – vor allem auch in der Wissenschaft – selbst die Voraus‐setzungen schaffen, die es uns erlauben, aufgrund von Wertungen ausgewählte Ziele zu erreichen. Pragmatische Erwägungen bedingen in einer gegebenen Situation den Entschluss, einen bestimm‐ten Kontext abzugrenzen, indem wir die dazu erforderlichen Regeln annehmen. Dadurch erzeugen wir ein relatives (...) Apriori, das uns die Mittel liefert, um zwischen analytisch und synthetisch, zwischen Sprache und Theorie etc. zu unterscheiden.Die Methode führt zu einem pluralistischen Weltbild: Nach der Wahl der linguistischen und ontologischen Bestandteile kann die Wahrheitsfrage im Sinne Tarskis nur mehr intern geregelt werden, während sich rivalisierende Systeme als ganze allein aufgrund von pragmatischen Krite‐rien vergleichen lassen.Es werden die deskriptiven und normativen Aspekte der Begriffe des Wertes, der Norm und der Regel erörtert, um schliesslich auf die zentrale Rotle zu verweisen, die Konventionen als nicht der Willkür ausgesetzte, sondern rational begrundete Festlegungen in sämtlichen unseren Aktivitäten spielen.SummaryFollowing my conception of open transcendentalism philosophy is less concerned with a naturalistically conceived theory of the world than with the normative activities we display in this world. By our own cultural and intellectual presuppositions we create the means – scientific or others – required for the achievement of certain goals which have previously been accepted as valuable. Pragmatic considerations induce us to establish, in given situations, what 1 call contexts by adopting particular rules. We thus produce a pragmatically relativized apriori providing us with a clearcut distinction between the analytic and the synthetic, between language and theory etc.The method issues in a pluralistic world view: Once the matter concerning the choice of a linguistic system and an ontology is settled the question of truth in Tarski's sense can only be raised internally while theories as a whole are compared on purely pragmatic grounds.I discuss some descriptive and normative aspects regarding the notions of value, norm and rule in order to ascertain the primary role played by conventions in all our activities. I rid the word of the connotation of arbitrairiness often attached to it in Anglo‐Saxon philosophy by restricting its use to deliberate acts concerned with rationally justified decisions.ResumeSelon ma conception du transcendentalisme ouvert, la philosophic est moins concernée par la recherche?on;une théorie globale du monde, telle que la préconise le naturalisme, que par ľanalyse des activités normatives que nous exerçons dans celuici. One of the requirements in the Dutch regulation for euthanasia and assisted suicide is that the doctor must be satisfied ‘that the patient's suffering is unbearable, and that there is no prospect of improvement.’ In the notorious Chabot case, a psychiatrist assisted a 50 year old woman in suicide, although she did not suffer from any somatic disease, nor strictly speaking from any psychiatric condition. In Seduced by Death, Herbert Hendin concluded that apparently the Dutch regulation now allows physicians to (...) assist anyone in suicide simply because he or she is unhappy.In this paper, I reject Hendin's conclusion and in particular his description of Mrs Boomsma as someone who was ‘simply unhappy.’ After a detailed narration of her lifestory, I turn to the American philosopher Harry Frankfurt's account of volitional incapacity and love for a more accurate characterization of her suffering. Having been through what she had, she could only go on living as another person than the one she had been when she was a happy mother. That would have violated her integrity, and that she could not bring herself to do. (shrink)

Erwin Straus nourished his spirit on "Act psychology", "Gestalt psychology" and "Husserlian phenomenology" in Berlin and Göttingen, and has renewed his engagement with these problems in Lexington without renouncing his commitment to a tradition to which he has remained always faithful. It is in the realm of the psychology of perception that Erwin Straus - as did the analyses of Bergson, Gestalt psychology, and the phenomenology of Husserl - made his point of departure for his critique of sensationistic empiricism and (...) of the sensory psychophysiology from Johannes Miller to Wundt... The guiding idea of Erwin Straus, as Merleau-Ponty has so profoundly made explicit, is that the sphere of sensing, the sense of the senses, is discovered to be the constitution of the very corporeity of experience, the latter being capable of being lived only in and by a living body. As abstract an sophisticated as this primordial description of the phisical body might be insofar as it is the object and subject of phenomenology, it appears to me to be the only possible, or more simply, the only one which allows us to formulate a general law of the temporal organization of the existent, that is to say, of the human being in the proper constitution of his own becoming. The phenomenology that I have just outlined founds the system of reality as the very form of conscious being, and the organization of the psychical body as the constitution of the ego. Four theses within this framework relating perceptual and hallucinatory activity are : hallucination is virtual in perception, and that it is, as Ernest Hartman recently stated, an "ubiquitous capacity" immanent to this "psychical apparatus" of which Freud spoke, and which I prefer to call "the psychical body". That hallucinatory difficulties are real difficulties and not a simple difference of intensity between the image and sensation. The pathogenesis of hallucinations can only be theorized according to the Jacksonian model of negative and positive ; and There is a fundamental distinction between the diverse forms and levels of delirious or psychotic hallucinatory activity and hallucinatory images. The human blood coagulation system comprises a series of linked glycoproteins that upon activation induce the generation of downstream enzymes ultimately forming fibrin. This process is primarily important to arrest bleeding (hemostasis). Hemostasis is a typical example of a molecular machine, where the assembly of substrates, enzymes, protein cofactors and calcium ions on a phospholipid surface markedly accelerates the rate of coagulation. Excess, pathological, coagulation activity occurs in “thrombosis”, the formation of an intravascular clot, which in the most dramatic form (...) precipitates in the microvasculature as disseminated intravascular coagulation. Thrombosis occurs according to a biochemical machine model in the case of atherothrombosis on a ruptured atherosclerotic plaque, but may develop at a slower rate in venous thrombosis, illustrating that the coagulation machinery can act at different velocities. The separate coagulation enzymes are also important in other biological processes, including inflammation for which the rapid conversion of one coagulation factor by the other is not a prerequisite. The latter role of coagulation enzymes may be related to the old and probably maintained function of the coagulation machine in innate immunity.
