In this thought-provoking book, David Hart challenges the creation myth of post--World War II federal science and technology policy. According to this myth, the postwar policy sprang full-blown from the mind of Vannevar Bush in the form of Science, the Endless Frontier. Hart puts Bush's efforts in a larger historical and political context, demonstrating in the process that Bush was but one of many contributors to this complex policy and not necessarily the most successful one. Herbert Hoover, Karl Compton, Thurman (...) Arnold, Henry Wallace, Robert Taft, and Curtis LeMay--along with more familiar figures like Bush--are among those whose endeavors he traces.Hart places these policy entrepreneurs in the broad scheme of American political development, connecting each one's vision of the state in this apparently esoteric policy area to the central issues, events, and figures of mid-century America and to key theoretical debates. Hart's work reveals the wide range of ideas, often in conflict with one another, that underlay what later observers interpreted as a "postwar consensus." In Hart's view, these visions--and the interests and institutions that shape their translation into public policy--form the enduring basis of American politics in this important area. The early modern play Sir Thomas More, written by Anthony Munday, Henry Chettle, Thomas Dekker, Thomas Heywood, and William Shakespeare, takes an ecumenical viewpoint of the play's Catholic hero in order to conform to the expectations of the Master of the Revels and to appeal to a cross-confessional audience. The playwrights carefully construct the play within the confines of censorship by centering the play's action around More's dynamic personality instead of giving a full exposition of historical plot. More's personality (...) and famous wit function together as a means for diverting attention away from the controversy surrounding More's silent opposition to Henrician policy while subtly validating his martyrdom. The argument of this article examines the adaptation of the play's ideologically diverse source material, the playwrights’ use of martyrological conventions, and the subtle traces of Erasmian allusion and recusant rhetoric in its reading of the play. Kierkegaard steadily maintains, against Lessing, that Jesus’s contemporaries had no advantage as regards faith merely because they had personal experience of him. It is a view proposed both by Johannes Climacus and Anti-Climacus, as well as over Kierkegaard’s own signature; it is indirectly communicated and then directly communicated, and so the importance of becoming a true contemporary of Jesus can hardly be underestimated in the authorship, including the later journals. When Michel Henry considers this motif in his Phénoménologie matérielle (...) he says that it is one feature of what Kierkegaard calls “’the strange acoustics of the spiritual world’ [l’étrange acoustique du monde spirituel].” These acoustics are not those we learn about in physics: “the laws of being in common are not in fact those belonging to things and the laws of perception,” and this claim gives Henry an opportunity to continue a long standing argument with Husserl. For “here” and “there” in Henry’s account of inter-subjectivity have no relation to the intersubjectivity that is explored in the fifth of the Cartesian Meditations. Indeed, Henry goes on to say, “This spiritual acoustics, which defies the laws of perception, defines our concrete relation to the other”; that is, it gives the “how” of the relation rather than the “what” or “why.”. In between the time of John Austin and H.L.A. Hart a great legacy, and an accompanying debate, spawned out of the work of Sir ­Henry Maine. While employing a primarily comparative, historical perspective, Maine sought to scrutinize and redefine the way philosophy relates to the social sciences within jurisprudential enquiries. From this perspective, the present paper aims to reclaim and represent Maine’s work as a project in and for the philosophy of law. A project which came to inspire and (...) influence future generations of philosophers, and two subsequent schools of thought, by instigating a forgotten debate around the concept of custom, its relation to the concept law, and the status of customary law. This examination will close with a note, highlighting certain aspects the revival of Maine’s works, as well as the legacy which spawned out of them, can have generally for the philosophy of law and interdisciplinary jurisprudence, as well as more particularly for the philosophy of customary international law. This book is both a critique of the concept of the rights-holding, free, autonomous individual and attendant ideology dominant in the contemporary West, and an account of an alternative view, that of the role-bearing, interrelated responsible person of classical Confucianism, suitably modified for addressing the manifold problems of today.

In this paper several recent factor- and dimension-based models of precedential constraint are formally investigated and an alternative dimension-based model is proposed. Simple factor- and dimension-based syntactic criteria are identified for checking whether a decision in a new case is forced, in terms of the relevant differences between a precedent and a new case, and the difference between absence of factors and negated factors in factor-based models is investigated. Then Horty’s and Rigoni’s recent dimension-based models of precedential constraint are critically (...) examined. Hart Memorial Lecture: "Life’s Dominion: An Argument About Abortion and Euthanasia." Dworkin is Professor of Philosophy and Frank Henry Sommer Professor of Law at New York University. He received B.A. degrees from both Harvard College and Oxford University, and an LL.B. from Harvard Law School and clerked for Judge Learned Hand. Christof Koch and Klaus Hepp, in a recent essay in this journal1, issued a challenge to “those who call upon consciousness to carry the burden of the measurement problem in quantum mechanics.” Lest absence of a response be construed as admission of a failure of the idea that consciousness can play, via quantum measurement effects, a crucial role in neurodynamics, or that this idea has been in any rational way damaged by the arguments put forth in the cited article, I (...) respond here to that challenge. ABSTRACT Act-based theories of content hold that propositions are identical to acts of predication that we perform in thought and talk. To undergo an occurrent thought with a particular content is just to perform the act of predication that individuates that content. But identifying the content of a thought with the performance of an act of predication makes it difficult to explain the intentionality of bouletic mental activity, like wanting and desiring.
