En el presente trabajo pretendo mostrar que el pensamiento de Carl Schmitt tiene un carácter marcadamente filosófico. Más precisamente: que en la base de él se halla una teoría de la comprensión. Esa teoría de la comprensión tiene la particularidad de que se desarrolla a partir de una teoría de la comprensión jurídica, pero se extiende, en su obra, a la comprensión en general.

This paper argues that the idea of creative destruction enters the social sciences by way of Friedrich Nietzsche. The term itself is first used by German economist Werner Sombart, who openly acknowledges the influence of Nietzsche on his own economic theory. The roots of creative destruction are traced back to Indian philosophy, from where the idea entered the German literary and philosophical tradition. Understanding the origins and evolution of this key concept in evolutionary economics helps clarifying the contrasts between today’s (...) standard mainstream economics and the Schumpeterian and evolutionary alternative. L’étude scientifique du comportement animal s’est en partie développée en réaction à des excès « anthropomorphiques», où l’observateur projetait chez l’animal une forme de psychologie populaire. En conséquence, le langage théorique des représentations mentales a été largement proscrit de l’éthologie pendant une bonne partie du xxe siècle. Même si la méthodologie du behaviorisme – centrée sur l’observation et la mesure du comportement – constitue toujours la règle, l’avènement de la révolution cognitive, les études de terrain de longue durée sur des (...) populations animales dans leurs conditions naturelles, ainsi qu’un intérêt accru pour la cognition physique et sociale, ont replacé le cadre théorique des représentations mentales au premier plan. L’intérêt porté aux représentations mentales vient en partie de la capacité qu’ont certaines espèces à catégoriser, réaliser des inférences ou prendre des décisions flexibles qui vont au-delà du simple flux perceptif. In May 1969, James Foreman interrupted a religious service at Riverside Church in New York to deliver “The Black Manifesto,” which included a stunning “demand” of $500 million in “reparations” for black Americans from the white religious establishment. In the period since that date, The Manifesto has aroused rather less serious discussion than one might have thought it would. No doubt, the burden of The Manifesto has struck many whites and some blacks as so outrageous in its morality, so unrealistic (...) in its politics, so unfeasible in its economics, that intellectuals may have done a public service by consigning The Manifesto to relative neglect. Not that The Manifesto has had only unfavorable publicity, nor that the churches have ignored it; quite the contrary. What remains true, however, is that the crucial burden of The Manifesto, indeed, the precise argument it advances for reparations and compensatory justice, has not so far as I can tell received the thoughtful attention it deserves. Until it does, and is appraised with care and fairness, it is impossible either to support or to reject The Manifesto's “demands.” Let us try, then, however belatedly, to state and assess the argument of The Black Manifesto. En este ensayo propongo una aproximación al contenido de Del arte de la guerra de Maquiavelo desde la pregunta por el enemigo: ¿quién es el enemigo en Del arte de la guerra? ¿Quién es el adversario del ejército que Maquiavelo busca organizar en el libro? Dentro de la literatura secundaria sobre el florentino identifico tres tipos de respuesta a esta pregunta, lo que llamo aquí tres diferentes manifestaciones del enemigo. Según estas lecturas, el enemigo de la milicia maquiaveliana es a) (...) el cristianismo, el modo de vida instituido por esta religión; b) lo imprevisible, los accidentes cuya ocurrencia no se puede anticipar, es decir, la fortuna, y c) los grandes, cuyo deseo es el de dominar al pueblo. The article approaches Salomon Maimon’s reinterpretation of the notions of the thing in itself and the given within the framework of criticism. For Maimon they do not refer to a transcendence that is directly unattainable by knowledge. In this attempt, he tries to explain the given on the basis of the action of constitutive understanding. With this, he triggers the passage from transcendental Kantian philosophy to the idealism of Fichte. Nonetheless, his position faces the subsequent problem of explaining how the (...) constitution of the given from understanding (infinite) can become compatible with the criticism it takes on. On affirming that an uncognoscible item is the basis of knowledge, namely, infinite understanding, he set aside the explanation of knowledge in terms of what is revealed in it and in doing so would be resorting to external uncognoscible conditions. The peculiar situation of epistemology has often been remarked upon, meaning that sort of epistemology which issued from English empiricism and whose father is taken to be John Locke. Epistemology in the general sense has existed as long as there has been scientific philosophy, and in truth it has always formed the basis and core of all scientific philosophizing.

1. Of all the great natural or human rights, none has been so neglected by scholars and theorists as the right to life. Today, the salient fact about this right is the considerable disagreement over its scope, form and status. Everyone has noticed the general inflationary effect of talk about ‘human’ rights in our time, in contrast to the tidy list of ‘natural’ rights drawn up by Locke and others. Nowhere is this ballooning more noticeable than in the right to (...) life itself. For Jefferson, his predecessors and contemporaries, the right to life was simple enough; it meant “the right not to be deprived of life, … a life that God gave and nature supported.” On this basis, it is natural to see the right to life classically as having reference mainly to questions affecting the termination of life. Without much imagination, one could find this right also relevant to another class of questions, those affecting the prevention of human life. However, when one historian cautiously remarked during the Great Depression that “the right to life could be interpreted as giving the individual at least an emergency claim on society for sustenance …,” we have a significant increase in the scope of protections allegedly afforded by this right. How far this ‘emergency claim’ might reach was indicated some years later in an essay addressed to U.N.E.S.C.O. The “right of living,” it was argued. (shrink)

Putnam argues rightly that, if scientism were true, values and intentionality would be eliminable from a description of the world as it really is. But these are not eliminable, since science itself depends on them. But he wrongly believes that, if there were any viable form of metaphysics, it would have to be scientism. This article argues that, if one applies Putnam's insights and corrects his oversights, a metaphysics is possible, which, while it is based on the methods of science, (...) is not scientism, and can accommodate intentionality and value. Although existing scholarship offers critical insights into the working mechanisms of project-based research funding, little is known about the actual practice of writing grant proposals. Our study seeks to add a longitudinal dimension to the ongoing debate on the implications of competitive research funding by focusing on the incremental adjustment of the funder/fundee relationship around a common discursive practice that consists in describing and evaluating research projects: How has the perception of what constitutes a legitimate funding claim changed over time (...) and why? By investigating the normative framework enacted in the justification strategies of applicants, we shed light on the historical coevolution of the increasing competition for project funding, the epistemic culture of applicants, and grant writing rhetoric. To do this, we mobilize a comprehensive data set consisting of archival data from Europe’s oldest and largest funding agency, the Deutsche Forschungsgemeinschaft, as well as a corpus of 80 successful grant proposals written between 1975 and 2005. We find that the 1990s mark an important normative consolidation of what we consider to be a legitimate funding claim: Ensuring the success of the project and the project’s results becomes a major concern in applicant rhetoric. This time period coincides with a substantive rise in the level of competition for project funding. Yet, even though justification strategies might seem to address the same issues in grant proposals across the disciplines under investigation, the normative framework to which applicants refer differs according to the applicant’s epistemic culture. Background Informed consent is one of the key principles of conducting research involving humans. When research participants give consent, they perform an act in which they utter, write or otherwise provide an authorisation to somebody to do something. This paper proposes a new understanding of the informed consent as a compositional act. This conceptualisation departs from a modular conceptualisation of informed consent procedures. Methods This paper is a conceptual analysis that explores what consent is and what it does or does (...) not do. It presents a framework that explores the basic elements of consent and breaks it down into its component parts. It analyses the consent act by first identifying its basic elements, namely: a) data subjects or legal representative that provides the authorisation of consent; b) a specific thing that is being consented to; and c) specific agent(s) to whom the consent is given. Results This paper presents a framework that explores the basic elements of consent and breaks it down into its component parts. It goes beyond only providing choices to potential research participants; it explains the rationale of those choices or consenting acts that are taking place when speaking or writing an authorisation to do something to somebody. Conclusions We argue that by clearly differentiating the goals, the procedures of implementation, and what is being done or undone when one consent, one can better face the challenges of contemporary data-intensive biomedical research, particularly regarding the retention and use of data. Conceptualising consent as a compositional act enhances more efficient communication and accountability and, therefore, could enable more trustworthy acts of consent in biomedical science. (shrink)

What happens when management consultants enter the academic arena and offer their services to universities? In the following article, we examine this question by drawing on findings from a qualitative study based on a series of 30 interviews with senior management consultants and academic managers in Germany. The aim of this explorative study is, first of all, to provide theoretically informed observations about the working mechanisms of management consulting in academia. A second, and related objective, is to contribute to the (...) ongoing debate on the changing nature, role, and implications of managerial expertise and authority in higher education institutions. We begin our study by providing an overview of the literature on the changing nature of university management. Although these studies show a shift in the power constellation of universities from professional to managerial authority, we argue that they remain suspiciously vague as concerns the way academics and managers actually deal with this conflicting situation. By drawing on the insights of consulting studies, we then explore the stakes of consultancy in academic change projects and determine the analytical factors that will guide our qualitative analysis. Finally, we present and discuss the findings before concluding with more general remarks on the nature of academic management in German universities. (shrink)

Background: Nurses who practice limitation of therapeutic effort become fully involved in emotionally charged situations, which can affect them significantly on an emotional and professional level. Objectives: To describe the experience of intensive care nurses practicing limitation of therapeutic effort. Method: A qualitative, phenomenological study was performed within the intensive care units of the Madrid Hospitals Health Service. Purposeful and snowball sampling methods were used, and data collection methods included semi-structured and unstructured interviews, researcher field notes, and participants’ personal letters. (...) The Giorgi proposal for data analysis was used on the data. Ethical considerations: This study was approved by the Ethical Research Committee of the relevant hospital and by the Ethics Committee of the Rey Juan Carlos University and was guided by the ethical principles of voluntary enrollment, anonymity, privacy, and confidentiality. Results: In total, 22 nurses participated and 3 themes were identified regarding the nurses’ experiences when faced with limitation of therapeutic effort: (a) experiencing relief, (b) accepting the medical decision, and (c) implementing limitation of therapeutic effort. Conclusion: Nurses felt that, although they were burdened with the responsibility of implementing limitation of therapeutic effort, they were being left out of the final decision-making process regarding the same.
