For Guizot, legal sovereignty is a divine, absolute prerogative precluded from mankind. The best possible form of government is that based upon a representative system, since such a system continuosly shifts the attibution of power from one subject to another. Guizot's analysis, which also denies the modern democratic principle of the sovereignty of the will of the people, examines certain aspects common to all representative systems, such as the relationship between the elected and the electorate and between the (...) majority and the minority, independently of the extension of suffrage. In particular, Guizot examines the relationship between public opinion and the common interest in an optic which is beyond his time and proves to be very appropriate today. He consideres the common interest to be a virtual and hypothetical component of the representative relationship, pre-eminent as regards the indications ascertained through the majority vote. Food Sovereignty is a vibrant discourse in academic and activist circles, yet despite the many shared characteristics between issues surrounding food and public health, the two are often analysed in separate frameworks and the insights from Food Sovereignty are not sufficiently brought to bear on the problems in the public health discourse. In this paper, I will introduce the concept of 'self-organised community viability' as a way to link food and health, and to argue that what I call (...) the 'Health Security' paradigm requires a 'Health Sovereignty' response modelled on Food Sovereignty. Modern sovereignty is anthropocentric, constituted and organized by reference to human beings alone. Although a metaphysical assumption, anthropocentrism is of immense practical import, enabling modern states to command loyalty and resources from their subjects in pursuit of political projects. It has limits, however, which are brought clearly into view by the authoritative taboo on taking UFOs seriously. UFOs have never been systematically investigated by science or the state, because it is assumed to be known that none are extraterrestrial. Yet (...) in fact this is not known, which makes the UFO taboo puzzling given the ET possibility. Drawing on the work of Giorgio Agamben, Michel Foucault, and Jacques Derrida, the puzzle is explained by the functional imperatives of anthropocentric sovereignty, which cannot decide a UFO exception to anthropocentrism while preserving the ability to make such a decision. The originality of Foucault’s work lies in part in how he reverses the question of power, asking not how power is held and imposed, but how it is produced. In both his discussion of sovereignty and governmentality, though, Foucault skips over the res publica; a form of political organization that fits neither Foucault’s characterization of sovereignty nor the care of the self. I extend Foucault’s discussion to identify a ratio of government around the discipline of ownership by which (...) the res publica was made intelligible, its relations understood, and its logic organized. Most people assume that the natural resources of a country belong to its people. Theorists of cosmopolitan resource justice have recently questioned this assumption, arguing that extensive rights of peoples over natural resources cannot be justified. In response, defences of peoples’ resource rights, grounded in the value of self-determination, have been tepid. This paper argues against both positions. It advances the distinct thesis that popular resource sovereignty is justified as the resource rights allocation that maximizes well-being. With growing vigor, political philosophers have started questioning the Westphalian system of states as the main actors in the international arena and, within it, the doctrine of Permanent Sovereignty over Natural Resources. In this article I add to these questionings by showing that, when it comes to migratory natural resources, i.e., migratory species, a plausible theory of territorial rights should advocate a regime of shared sovereignty among states. This means that one single entity should represent their interests and (...) maybe also those of third parties, managing and making decisions over the resource as a whole. Although such a regime might be the tacit goal of existing international conventions regarding wildlife, it remains untheorized in political philosophy and largely under-theorized in international law. By presenting the critical situation of the monarch butterfly in North America, I point to the inadequacy of the compartmentalized current regime, which generates injustice in migration; namely, the phenomenon whereby range states of a given species may neglect or over-exploit it while in their territory, to the detriment of others. I suggest that more flexible and imaginative governance arrangements are needed to deal in a better way with these and similar natural resources. (shrink)

And yet the fight for who will win digital sovereignty has far-reaching societal implications. Sovereignty in premodern times evoked the dynastic figure of the 'sovereign' or territorial monarch. In modern times, it became a more abstract idea, referring to the power of the state, later of the people or 'the popular sovereign' as articulated and refined through constitutional arrangements. Today these inherited understandings of sovereignty confront various new challenges, including those of globalization, privatization of power, and the rise of sub-state nationalism. An examination of key historical writers and trends from the seventeenth (...) century onwards, including Hobbes, Bodin, Constant, Rousseau and Schmitt, brings out these developments and challenges. The question of political sovereignty must at all times be of acute academic interest, since it is practically impossible to say anything about the state without implying something about sovereignty, or vice versa. Political theory has very generally found this conception central to its inquiry; but in recent years the notion has been thrown into sharp relief by political events . In Fascism and Nazism the doctrine of state sovereignty is “made flesh” in startlingly substantial forms. These (...) modern incarnations of Leviathan , and their threat to much which has come to be deeply valued, give unprecedented importance to an age-long discussion. Political theory is not to-day, if it has ever seemed, a simply academic issue, or an “arm-chair” branch of philosophy. Not all of those who carry through revolutions, who build barricades and defend them with their lives, have a clear philosophical theory of the state; but powerful beliefs and motives they certainly have; and it daily becomes more manifest that unless the world is content to allow its political future to be determined more and more by obscure visceral impulses or crude economic motives a more intense effort to achieve and to apply true beliefs in the political field is imperative. This paper offers a new interpretation of Nietzsche’s “sovereign individual,” which appears in the second treatise of his 1887 On the Genealogy of Morality. I argue that Nietzsche’s presentation of that figure’s sovereignty is much more ambiguous than has hitherto been recognized. In contrast to scholars who argue that he is either completely free from moral conscience or entirely subservient to it, I argue that he is neither completely autonomous nor heteronomous. He surpasses the need for the enforcement of (...) custom only by internalizing it, i. e. by developing a conscience. This positions him as a crucial link in Nietzsche’s understanding of the human being’s dependence on morality. Attending to the sovereign individual’s ambiguities reveals Nietzsche’s skepticism about the possibility of autonomy within the political community. (shrink)

This article explores the tensions between cosmopolitanism and sovereignty as a means to conceptualize the ethics of European foreign policy. It starts by discussing the claim that, in order for the EU to play a meaningful role as an international actor, a definition of the common ethical values orienting its political conduct is required. The question of a European federation of states and its ethical conceptualization emerges clearly in some of the philosophical writings of the 17th and 18th centuries. (...) I seek to provide an outline of the main arguments presented by authors such as Saint Pierre, Rousseau and Kant regarding the implications of the emerging difference between cosmopolitanism and the law of nations in the ethics of international relations. The article focuses on the normative significance of the concept of sovereignty as it emerges in modern political philosophy and highlights its tensions with the ideas of moral and political cosmopolitanism. This exploration serves a double function: theoretical and practical. From the theoretical perspective it leads to a better understanding of the tensions involved in conceptualizing a common ethical orientation for the states of Europe. From the practical standpoint it sheds light on some persistent difficulties the European Union faces in trying to move beyond an intergovernmental political arrangement in the field of foreign policy. This book focuses on sovereignty referendums, which have been used throughout different historical periods of democratization, decolonization, devolution, secession and state creation. Referendums on questions of sovereignty and self-determination have been a significant element of the international political and legal landscape since the French Revolution, and have been a central element in the resolution of territorial issues from the referendum in Avignon in 1791 until today. More recent examples include Quebec, East Timor, New Caledonia, Puerto Rico and South (...) Sudan. The global aim of this book is to achieve a better empirical and legal understanding of sovereignty referendums and related problems in international and national law and politics. Popular sovereignty requires that citizens perceive themselves as being able to act and implement decisions, and that they are de facto causally connected to mechanisms of decision making. I argue that the two most common understandings of the exercise of popular sovereignty—which center on direct decision making by the people as a whole and the indirect exercise of democratic agency by elected representatives, respectively—are inadequate in this respect, and go on to suggest a complementary account that stresses the (...) central role of internally democratic and participatory political parties in actualising popular sovereignty, drawing on the democratic theory of Hans Kelsen. Self-sovereign identity solutions implemented on the basis of blockchain technology are seen as alternatives to existing digital identification systems, or even as a foundation of standards for the new global infrastructures for identity management systems. It is argued that ‘self-sovereignty' in this context can be understood as the concept of individual control over identity relevant private data, capacity to choose where such data is stored, and the ability to provide it to those who need to validate it. It is (...) also argued that while it might be appealing to operationalise the concept of ‘self-sovereignty’ in a narrow technical sense, depreciation of moral semantics obscures key challenges and long-term repercussions. Closer attention to the normative substance of the ‘sovereignty’ concept helps to highlight a range of ethical issues pertaining to the changing nature of human identity in the context of ubiquitous private data collection. The popularity of ‘food sovereignty’ to cover a range of positions, interventions, and struggles within the food system is testament, above all, to the term’s adaptability. Food sovereignty is centrally, though not exclusively, about groups of people making their own decisions about the food system—it is a way of talking about a theoretically-informed food systems practice. Since people are different, we should expect decisions about food sovereignty to be different in different contexts, albeit consonant with a core (...) set of principles (including women’s rights, a shared opposition to genetically modified crops, and a demand for agriculture to be removed from current international trade agreements). In this paper we look at the analytical points of friction in applying ideas of food sovereignty within the context of Indigenous struggles in North America. This, we argue, helps to clarify one of the central themes in food sovereignty: that it is a continuation of anti-colonial struggles, even in post-colonial contexts. Such an examination has dividends both for scholars of food sovereignty and for those of Indigenous politics: by helping to problematize notions of food sovereignty and postcoloniality, but also by posing pointed questions around gender for Indigenous struggles. The debate whether property is a limit on or the product of sovereignty envisages a tension between “the individual owner” and “the state.” But “the state” is not more than the aggregate of individuals who define theirs and others’ property rights through the state’s political process. The underlying tension between property and sovereignty is thus the tension between the economic market and the political market. Owners and others compete simultaneously at both levels to define, protect or improve the (...) value of property. There are two ways to compete in the political marketplace: by engaging in either “high visibility politics” or “low visibility politics.” Diffuse owners rely on high visibility politics promoted by agents such as political parties or trade unions and on elections, referenda and the like, whereas smaller groups of owners prefer the low politics of capturing lawmakers and state executives. When economic markets became global at the end of the Cold War, so did the political markets: property rights increasingly became defined by international agreements, by decisions of international organizations, and by the exercise of “low politics” in foreign, weaker states. The global political markets were dominated by the executive branches of a handful of relatively strong states that, in turn, were responsive to the “low politics” of special interests. The high transaction costs of cooperation among diffuse owners inhibited the parallel rise of “high politics” at the global level. The skewed global political market for property continues to favor special interests, but there are budding attempts to reclaim the space for “high politics” by national regulators and courts. Current negotiations over the so-called “Mega Regional” agreements between the United States and its trading partners will, if successful, nip these buds as they render certain property rights almost immune to the subsequent challenges of high politics. While the immediate aim of Walter Benjamin’s famous essay, “Critique of Violence,” is to provide a critique of legal violence, commentators typically interpret it as providing a further critique of state violence. However, this interpretation often receives no further argument, and it remains unclear whether Benjamin’s essay may prove analytically relevant for a critique of state violence today. This paper argues that the “Critique” proves thusly relevant, but only on condition that it is developed in two directions. The first direction (...) is conceptual, and consists in an explanation of the necessary relationship between states and violence. This explanation is found by appealing to a concept not cited in Benjamin’s text, but which, I argue, remains its implicit basis: sovereignty. According to this conceptual development, state violence is the necessary result of the state's attempt to maintain its sovereign law at the expense of emancipatory struggles to generate non-sovereign law. The second direction is genealogical, and consists in destabilizing the modern belief that justice is best served through the judicial channels of a sovereign state. Here I employ Michel Foucault’s genealogical research to demonstrate the historical contingency of state justice and, by extension, the possibility of a justice beyond the state. (shrink)

Popular sovereignty - the doctrine that the public powers of state originate in a concessive grant of power from 'the people' - is perhaps the cardinal doctrine of modern constitutional theory, placing full constitutional authority in the people at large, rather than in the hands of judges, kings, or a political elite. Although its classic formulation is to be found in the major theoretical treatments of the modern state, such as in the treatises of Hobbes, Locke, and Rousseau, this (...) book explores the intellectual origins of this doctrine and investigates its chief source in late medieval and early modern thought. Long regarded the principal source for modern legal reasoning, Roman law had a profound impact on the major architects of popular sovereignty such as François Hotman, Jean Bodin, and Hugo Grotius. Adopting the juridical language of obligations, property, and personality as well as the model of the Roman constitution, these jurists crafted a uniform theory that located the right of sovereignty in the people at large as the legal owners of state authority. In recovering the origins of popular sovereignty, the book demonstrates the importance of the Roman law as a chief source of modern constitutional thought. (shrink)

The imperativist strand of positivism derives law from an actual person or set of persons wielding a monopoly of force. The rule-based positivism of H.L.A. Hart has more sublty identified a matter-of-fact rule of recognition in place of such a sovereign one or many. But sovereignty is not a matter-of-fact of any kind; rather it is partly the product of what I call qua arguments. I reconstruct the reasoning, in the extradition case of Augusto Pinochet in the British House (...) of Lords, providing a focus for an account of the limits of legal positivism in the application of the principle par in parem non habet imperium. In this paper I reconstruct the historical significance of the concept of sovereignty and I defend its relevance against the critique of Hannah Arendt. I argue that sovereignty, understood as the concept that expresses the normative unity of the legal order, is not incompatible with plurality and constitutionalism and that it was the condition for the formation of inter state law. Further I criticize the abstract moralism that characterizes today's cosmopolitanism and the paradigm of global governance. Although the (...) significance of sovereignty is shifting in the context of globalisation, it is not becoming irrelevant because it symbolizes the right of political self-determination of a community as well as the capacity to transfer some portion of its regulatory competence to a supra-national legal order. Dimitris Vardoulakis asks how it is possible to think of a politics that is not commensurate with sovereignty. For such a politics, he argues, sovereignty is defined not in terms of the exception but as the different ways in which violence is justified. Vardoulakis shows how it is possible to deconstruct the various justifications of violence. The Sovereignty of Reason is a survey of the rule of faith controversy in seventeenth-century England. It examines the arguments by which reason eventually became the sovereign standard of truth in religion and politics, and how it triumphed over its rivals: Scripture, inspiration, and apostolic tradition. Frederick Beiser argues that the main threat to the authority of reason in seventeenth-century England came not only from dissident groups but chiefly from the Protestant theology of the Church of England. The triumph (...) of reason was the result of a new theology rather than the development of natural philosophy, which upheld the orthodox Protestant dualism between the heavenly and earthly. Rationalism arose from a break with the traditional Protestant answers to problems of salvation, ecclesiastical polity, and the true faith. Although the early English rationalists were not able to defend all their claims on behalf of reason, they developed a moral and pragmatic defense of reason that is still of interest today. Beiser's book is a detailed examination of some neglected figures of early modern philosophy, who were crucial in the development of modern rationalism. There are chapters devoted to Richard Hooker, the Great Tew Circle, the Cambridge Platonists, the early ethical rationalists, and the free-thinkers John Toland and Anthony Collins. (shrink)

Historical political entities differ in their understanding of sovereignty. This paper studies how conceptualizations of sovereignty clashed during the peace negotiations between the Spanish Monarchy and the United Provinces of the Low Countries held during the 1640s. It argues that these different understandings of sovereignty posed a significant obstacle to the signing of the peace and, once signedm remained a potential source of instability in the relationship not only between both polities but also for the internal equilibrium (...) of the Dutch Republic. The notion of biopolitical sovereignty and the theory of the state of exception are perspectives derived from Carl Schmitt’s thought and Michel Foucault’s writings that have been popularized by critical political theorists like Giorgio Agamben and Michael Hardt and Antonio Negri of late. This article argues that these perspectives are not sufficient analytical points of departure for a critique of the contemporary politics of terror, violence and war marked by a growing global exploitation of bodies, tightened management of life, (...) and endless and unpredictable abusive force. To better capture the singularity of our present condition of violence, war and terror, a supplementation of Schmitt’s and Foucault’s approaches by way of Hannah Arendt’s language of political action and agonistic engagement is useful. By bringing Arendt’s language of political agony to bear on contemporary biopolitical debates and discourses, we wish to revisit common practices of war and terror as matters of ‘agonal sovereignty’. ‘Agonal sovereignty’ allows us to peer into the ‘abyss of total violence’ that manifests itself after sovereign decisionism and biopolitical modalities of power have taken over the everyday conduct of political affairs. This book asks whether sovereignty can guarantee international equality by exploring the discourses of sovereignty and their reliance on the notions of civilisation and savagery in two historical colonial encounters: the French explorations of Canada in the 16th century and the domestic troubles linked to the Wars of Religion. Presenting the concept of 'civilised sovereignty', Mathieu reveals the interplay between the domestic and external claims to sovereignty, and offers a dynamic analysis of the theory and practice (...) of the concept. Based on extensive archival research, this book provides an in-depth intellectual picture of the theory and practice of sovereignty in early modern France by focusing on the discourses deployed by French political theorists. Mathieu applies performativity in order to denaturalise these discourses of statehood and reveals how the domestic and international constructions of sovereignty feed into one another and equally rely on appeals to civilisation and savagery. Overall, the book questions the 'myth of sovereignty as equality' and reflects on the persistence of this association despite the overwhelming empirical evidence that it institutes international hierarchies and inequalities. Driven by youth, the movement emphasized self-determination and the need for a democratic future without external control. While the U.S. can play a supportive role, its involvement must respect Bangladesh's sovereignty by fostering dialogue, supporting civil society, and investing in key sectors like education. Indigenous peoples often embrace different versions of the concept of food sovereignty. Yet some of these concepts are seemingly based on impossible ideals of food self-sufficiency. I will suggest in this essay that for at least some North American Indigenous peoples, food sovereignty movements are not based on such ideals, even though they invoke concepts of cultural revitalization and political sovereignty. Instead, food sovereignty is a strategy of Indigenous resurgence that negotiates structures of settler colonialism that (...) erase the ecological value of certain foods for Indigenous peoples. A normative account of global political organization must address three fundamental questions. One concerns the way in which political jurisdictions are to be delimited and their territorial boundaries drawn; another concerns the allocation of powers of sovereignty to those jurisdictions; the third concerns the principles for the distribution of economic benefits and burdens worldwide. The aim of my dissertation is to defend an account of global justice that extends to each of these questions. In doing so, I reject the (...) answers embodied in the prevailing international states system. ;In Chapter One, I consider one of the most sophisticated attempts to defend the states system on grounds of political morality---John Rawls's "The Law of Peoples." I argue that Rawls's defense fails because it is not adequately responsive to its own animating moral ideal, namely the ideal of popular sovereignty. Properly understood, popular sovereignty imposes on global political institutions constraints that are inconsistent with the features of the states system that Rawls defends. These constraints are expressed in two conditions: a deliberativeness condition, which ensures the integrity of the communicative structures required for rational collective will formation; and a pre-commitment condition, which ensures the willing acceptance by individuals of membership in the same polity. Together, these conditions entail a set of political human rights for individuals, and a set of self-determination rights for groups. ;Thomas Pogge has proposed a federative model of global political organization that, suitably modified, is responsive to these rights. His account calls for a federative dispersion of sovereign powers among nested jurisdictions, and incorporates a voluntaristic principle for the demarcation of borders. However, Pogge's defense is incomplete. In Chapter Two, I argue that the ideal of popular sovereignty provides the necessary foundation for his model. The same ideal leads us to reject Pogge's assertion of a universal right to democratic governance. ;In Chapter Three I articulate and defend a conception of global distributive justice that mandates transfers of wealth from more- to less-affluent societies with the disjunctive target of either immigration-pressure equilibrium---roughly, the point at which all economically motivated applications for immigration are granted---or maximal human development rates for the worst-off societies worldwide. ABSTRACTThe affinities between Jean Bodin's and King James VI/i's political theories have been recognized, and the fact that James had owned Bodin's Six livres de la république has been recorded, but Bodin's specific influence on James has remained nebulous. This article examines the evidence for James's direct engagement with Bodin, by studying James's copy of the Six livres alongside James's political treatises. Attempts to democratize the food system and make it more equitable through food sovereignty take many forms across space. In Cuba, food sovereignty is perceived as the promotion of small-scale farming methods informed by agroecology and permaculture. However, these practices are mediated by discourses of self-sufficiency in the context of the US blockade. Simultaneously, in Basque country, Spain, food sovereignty shapes community-supported agriculture initiatives, farmer union and cooperative-based work, and a deep appreciation for regional foods. In this (...) context, food sovereignty is perceived as part of the struggle to maintain Basque identity and autonomy. In this paper, I discuss how food sovereignty is defined and understood by outside actors who traveled to either Cuba or Basque country to understand how food sovereignty is being practiced in place. As educators, farmers, students, retirees, farmworker organizers, and activists meet in these spaces, I ask how do definitions of food sovereignty differ? I argue that food sovereignty ‘sits in places’ and travelers have difficulty discerning what food sovereignty is when confronted with unfamiliar practices. Findings suggest that such educational tourism is an attempt to create a meaningful space for dialogue about food sovereignty and as a touchstone it offers opportunities for participant discussions, however, understandings of food sovereignty are subject to confusion and alternate conceptions and thus, do not always travel well. Achieving energy sovereignty is increasingly gaining prominence as a goal in energy politics. The aim of this paper is to provide a conceptual analysis of this principle from an ethics and social justice perspective. We rely on the literature on food sovereignty to identify through a comparative analysis the elements energy sovereignty will most likely demand and thereafter distinguish the unique constituencies of the energy sector. The idea of energy sovereignty embraces a series of values, among (...) which we identified: (i) accessibility, to allow access to everyone, (ii) empowerment and recognition, to develop and sustain capabilities to collaboratively produce solution-oriented energy system knowledge and effectively participate in governance, (iii) stewardship and sustainability, to be able to design and manage decentralised renewable systems in view of protecting the environment, (iv) self-sufficiency, to reduce the negative shocks of exploitative business practises, (v) resilience, to maintain production capacities while withstanding socioeconomic, political, environmental and climatic shocks, (vi) peace, to establish production systems that do not involve hostile relations, (vii) transparency and self-determination, to establish democratic decision-making mechanisms that give a voice to previously underrepresented groups and limit corporate takeover (viii) gender-justice, by acknowledging the contributions of women and eliminate barriers to their empowerment. With a conceptual framework of energy sovereignty, we present a rationale that draws on the key values to be considered when formulating policy solutions for the energy sector. (shrink)

In Sovereignty he turned his attention to the relationship between the distribution of power and the creation of an ethical society. More specifically, he was concerned with the potential confusion of the body politic resulting from the development of increasingly dynamic and nebulous social conditions. The text is written in an exploratory fashion, reflecting the authorial perception of an ambiguity in modern political structures. This translated Cambridge edition, which (...) was first published in 1957, was derived from a 1955 French original. It constitutes an important contribution to post-war political theory that will remain of value to anyone with an interest in questions relating to political structures and the nature of authority. Seeking new forms of democracy, progressive politics raises a fundamental question: what is the alternative to the allegedly coherent, self-contained liberal subject that represents the project of modernity? Exploring the themes of nature, race, and the divine, this book identifies the more realistic alternative in the "relational subject": a subject that is inseparable from the global field of relations through which it emerges and yet distinct from that field because it lives a life that no one else ever has. Although the concept of food sovereignty is rooted in International Peasant Movements across the global south, activists have recently called for the adoption of this framework among low-income communities of color in the urban United States. This paper investigates on-the-ground processes through which food sovereignty articulates with the work of food justice and community food security activists in Oakland, California, and Seattle, Washington. In Oakland, we analyze a farmers market that seeks to connect black farmers to low-income consumers. (...) In Seattle, we attend to the experiences of displaced immigrant farmers from Latin America and their efforts to address their food needs following migration. In both cases, we find that US based projects were constrained by broader forces of neoliberalism that remained unrecognized by local activists. In Oakland, despite a desire to create a local food system led by marginalized African Americans, emphasis on providing green jobs in agriculture led activists to take a market-based approach that kept local food out of the economic grasp of food-insecure neighborhood residents. In Seattle, the marginalization of the immense agroecological knowledge of Latino/an immigrant farmers rendered local food projects less inclusive and capable of transformative change. Taken together, these very different cases suggest that a shift towards food sovereignty necessitates a broad acknowledgement of and resistance to neoliberalism. (shrink)

Local food initiatives are steadily becoming a part of contemporary cities around the world and can take on many forms. While some of these initiatives are concerned with providing consumers with farm-fresh produce, a growing portion are concerned with increasing the food sovereignty of marginalized urban communities. This chapter provides an analysis of urban contexts with the aim of identifying conceptual barriers that may act as roadblocks to achieving food sovereignty in cities. Specifically, this paper argues that taken (...) for granted commitments created during the birth of the modern city could act as conceptual barriers for the implementation of food sovereignty programs and that urban food activists and programs that challenge these barriers are helping to achieve the goal of restoring food sovereignty to local communities, no matter their reasons for doing so. At the very least, understanding the complexities of these barriers and how they operate helps to strengthen ties between urban food projects, provides these initiatives with ways to undermine common arguments used to support restrictive ordinances and policies, and illustrates the transformative potential of food sovereignty movements. Contemporary Foucauldian research assimilates the political with governance. This formulation dates to Foucault's emphasis on the significance of the anti-Machiavellians in introducing the concept of governance into political theory. Returning to Machiavelli, we argue that early modern political theory was instead characterized by the simultaneous problematization of ruler and ruled, and the co-constitution of sovereignty and governance. We then outline the relation of ruler and ruled in the political structure of the democratic sovereign. Concepts of both sovereignty and (...) governance are necessary to theorize the political in modernity, including the dangers that arise from fusing sovereignty and governance, as occurred during the Nazi period in Germany, when the distinction between the sovereign people and the governed population was conflated. This article holds that governmental investments in quantum technologies speak to the imaginable futures of digital sovereignty and digital infrastructures, two major areas of change driven by related technologies like AI and Big Data, among other things, in international law today. Under intense development today for future interpolation into digital systems that they may alter, quantum technologies occupy a sort of liminal position, rooted in existing assemblages of computational technologies while pointing to new horizons for them. The possibilities they (...) raise are neither certain nor determinate, but active investments in them (legal, political and material investments) offer perspective on digital technology-driven influences on an international legal imagination. In contributing to visions of the future that are guiding ambitions for digital sovereignty and digital infrastructures, quantum technologies condition digital technology-driven changes to international law and legal imagination in the present. Privileging observation and description, I adapt and utilize a diffractive method with the aim to discern what emerges out of the interference among the several related things assembled for this article, including material technologies and legal institutions. In conclusion, I observe ambivalent changes to an international legal imagination, changes which promise transformation but appear nonetheless to reproduce current distributions of power and resources. In their book entitled “Democracy and the American Party System” Austin Ranney and (Willmoore Kendall have brought a charge again the pluralists that they denied the desirability of creating sovereign state and as such, according to them, they were opponents of democracy as well as of the very idea of government. The aim of this paper is to refute their charge and thereby to establish the view that the pluralists are in fact strong supporters of democracy in the real sense (...) of the term and of popular sovereignty. What did most of them was that they made an attempt to bring to light the fact that democracy, as it is being practiced almost everywhere in the world, ultimately leads to denial of popular sovereignty, the basic element of self-government. Self-government can best be realized where the people is the real sovereign neither the state nor the numerical majority. And the government formed by the representatives elected in a traditional party-based election does not therefore, mean self-government. It can at best be called the government of the majority. Majority rule does not anyway mean democracy. It may be called ‘numbersocracy’ after the proper terminology of Ranney and Kendall. Democracy, de facto, is nothing other than majority rule that is best termed by John Calhoun, the ex-vice-president of the U.S.A, as the ‘rule by numerical majority’. ‘Numerical’ majority”, says he, “is not the people”. I strongly adhere to the pluralists’ view and therefore, conclude with an insistent assertion that numerical majority rule in disguise of democracy has in fact ruled out popular sovereignty. New data-driven technologies yield benefits and potentials, but also confront different agents and stakeholders with challenges in retaining control over their data. Our goal in this study is to arrive at a clear picture of what is meant by data sovereignty in such problem settings. To this end, we review 341 publications and analyze the frequency of different notions such as data sovereignty, digital sovereignty, and cyber sovereignty. We go on to map agents they concern, in (...) which context they appear, and which values they allude to. While our sample reveals a considerable degree of divergence and an occasional lack of clarity about intended meanings of data sovereignty, we propose a conceptual grid to systematize different dimensions and connotations. Each of them relates in some way to meaningful control, ownership, and other claims to data articulated by a variety of agents ranging from individuals to countries. Data sovereignty alludes to a nuanced mixture of normative concepts such as inclusive deliberation and recognition of the fundamental rights of data subjects. (shrink)
