"Critique is a form of thinking and acting. It is determined by its objects, yet never accesses them immediately but is always mediated through its own forms of (re)presentation. Since the end of the 18th century, there has been a dynamization and fluidization of the understanding of form, as topoi such as the break, the marginalization, the tearing and opening indicate. However, these multifarious attempts to "build on the structure through demolition" (Benjamin) testify to the dependence of all articulation on (...) the forms of (re)presentation ["Darstellung"]. As a philosophical problem, the question of form arises in critical theory from Marx to Adorno. Since the 1960s, literary practices have proliferated which generate their critical statements less argumentatively than through the programmatic use of formal means. At the same time, the writing self, along with its attitudes, reflections, affects and instruments, visibly enters the critical scene - whereas the theatrical scene as a stage of critique has been contested intensively during the 20th century. This volume examines how the interdependence of critique, object, and form translates into critical stances, understood as learnable, reproducible gestures, which bear witness to changing conditions and media of critical practice. In this article I shall propose María Zambrano's poetic reason as a suitable method for developing a knowledge of animal being. To do so, I will follow the analyses (Derrida, Coetzee) that place animal thinking in the poetic sphere, thus showing the need for a poetic/literary knowledge to make a philosophical knowledge of the animal possible. Animal writing expresses our nature in relation to animal nature; it discloses our animal interbeingness. Finally, I will point to some of the principles of (...) ecofeminist/animal ethics, like care and empathy, which arise both in what I propose to call animal writing and in Zambranian poetic reason. En este trabajo se analizan, por una parte, los datos sobre la presencia de las mujeres en los movimientos de derechos de los animales en el estado español; por otro lado, tratamos de encontrar marcos explicativos que aclaren cuál es el vínculo que conecta la sensibilidad feminista con la sensibilidad animalista. Hemos realizado un sondeo sobre el porcentaje de mujeres entre los miembros de las organizaciones animalistas más importantes de España y, con estos resultados, hemos hecho una revisión de los (...) diferentes marcos teóricos que pueden explicar esta significativa orientación de género en la defensa del bienestar animal. Por último, defendemos que hay un vínculo entre la ideología patriarcal y la explotación ecológica, en tanto que ambos comparten la dominación y la opresión de género. En este sentido, la sensibilidad animalista movilizaría sentimientos morales de fraternidad con la naturaleza. (shrink)

This study provides empirical evidence on how corporate sustainability performance (CSP), as proxied by membership of the Dow Jones sustainability index, is reflected in the market value of equity. Using a theoretical framework combining institutional perspectives, stake-holder theory, and resource-based perspectives, we develop a set of hypotheses that relate the market value of equity to CSP. For a sample of North American firms, our preliminary results show that CSP has significant explanatory power for stock prices over the traditional summary accounting (...) measures such as earnings and book value of equity. However, further analyses suggest that we should not focus on corporate sustainability itself. Our findings suggest that what investors really do is to penalize large profitable firms with low level of CSP. Firms with incentives to develop a high level of CSP not engaging on such strategy are, thus, penalized by the market. (shrink)

People reject ‘paradoxical’ inferences, such as: Luisa didn't play music; therefore, if Luisa played soccer, then she didn't play music. For some theorists, they are invalid for everyday conditionals, but valid in logic. The theory of mental models implies that they are valid, but unacceptable because the conclusion refers to a possibility inconsistent with the premise. Hence, individuals should accept them if the conclusions refer only to possibilities consistent with the premises: Luisa didn't play soccer; therefore, if Luisa played a (...) game then she didn't play soccer. Two experiments corroborated this prediction for three sorts of ‘paradox’, including a disjunctive paradox. (shrink)

The sexual assault of persons with mental disabilities occurs at alarmingly high rates worldwide. These assaults are a form of gender-based violence intersecting with discrimination based on disability. Our research on the treatment of such cases in the Canadian criminal justice system demonstrates the systemic barriers these victims face at the level of both substantive legal doctrine and trial procedure. Relying on feminist legal theory and disability theory, we argue in this paper that abuses of trust and power underlie most (...) sexual assaults of women with mental disabilities. We argue that existing Criminal Code provisions in Canada are inadequate to address this type of exploitation because courts have consistently failed to recognize that such abuses of power and trust are fundamentally inconsistent with any notion of voluntary consent. This article is concerned with Extreme Case Formulations in multiple-party TV programmes in two different languages: Spanish and English. I examine the role of ECFs in Spanish pre-electoral debates and in English panel interviews. English data is 77 minutes and 58 seconds long and comprises nine different panel interviews of political, socio-political and social issues and Spanish data is 78 minutes long and includes four political pre-electoral debates. The results will disclose that the number of ECFs found in the Spanish (...) and in the English corpora differs considerably. And in relation to the type of recording, the data will reveal that interviewers and interviewees deployed many more ECFs in political recordings than in socio-political or social recordings ; and politicians used more ECFs than any other type of interviewees. The aim of our research is to analyze how different religions influence business ethics. We develop an index of practices in the field of business ethics, made up of 19 items containing practices related to workers, consumers, products, human rights, management of ethical conflicts, and crime prevention. Also, we consider a wide range of religion affiliations. To undertake this research, we use a panel data sample composed of 11,956 firm‐year observations from 18 countries. Drawing on stakeholder theory, we posit some (...) hypotheses based on the religions considered. The results obtained show that a higher percentage of religious adherents in the country where a company does business usually involve the implementation of more ethical practices in the corporate field. These findings are obtained for Christian, Islamic, Jewish, and Hindu religions. In contrast, this does not stand for Buddhist and folk religions. Also, countries where there is no predominant religion do not show a confluence between religion and ethical corporate practices. (shrink)

A common approach for measuring the effectiveness of an education system or a school is the estimation of the impact that school interventions have on students’ academic performance. However, the latest trends aim to extend the focus beyond students’ acquisition of knowledge and skills, and to consider aspects such as well-being in the academic context. For this reason, the 2015 edition of the international assessment system PISA incorporated a new tool aimed at evaluating the socio-affective variables related to the well-being (...) of students. It is based on a definition focused on the five dimensions proposed in PISA theoretical framework: cognitive, psychological, social, physical and material. The main purpose of this study is to identify the well-being components that significantly affect student academic performance and to estimate the magnitude of school effects on the well-being of students in OECD countries, the school effect being understood as the ability of schools to increase subjective student well-being. To achieve this goal, we analyzed the responses of 234,000 students from thirty-five OECD countries to PISA 2015 questionnaires. Specifically, we considered non-cognitive variables in the questionnaires and student performance in science. The results indicated that the cognitive well-being dimension, composed of enjoyment of science, self-efficacy and instrumental motivation, as well as the test anxiety all had a consistent relationship with student performance across countries. In addition, the school effect, estimated through a two-level hierarchical linear model, in terms of student well-being was systematically low. While the school effect accounted for approximately 25% of the variance in the results for the cognitive dimension, only 5-9% of variance in well-being indicators was attributable to it. This suggests that the influence of school on student welfare is weak, and the effect is similar across countries. The present study contributes to the general discussion currently underway about the definition of well-being and the connection between well-being and achievement. The results highlighted two complementary concerns: there is a clear need to promote socio-emotional education in schools, and it is important to develop a rigorous framework for well-being assessment. Business ethics is one of the most significant demands made by institutional and individual investors, who usually require the participation of the board of directors in the planning and implementation of ethical behaviour in corporations. This is done by drawing up an ethics code and then monitoring its fulfilment. This study has a dual objective: first, to analyse the role played by the composition of the board of directors, and by that we mean its independence and the diversity of its (...) members, on the implementation and scope of an EC, and, second, to detect whether the corporate governance system moderates the level of involvement of the board in ethical issues. The findings obtained from a data panel sample made up of 760 listed companies from 12 countries for the years 2003–2009 show that the largest companies with large-sized and diverse boards implement the most developed ECs. Nevertheless, the extent of involvement of the independent directors is conditioned by the level of shareholder orientation characteristic of the system of CG in the corporation’s country of origin. Critical aspects in the field of education are currently related to low levels of socioemotional competences and high rates of school dropouts. However, there are no standard practices or guidelines for helping countries to assess and train social and emotional competences. To overcome this limitation, the project Learning to be (L2B) aims to propose a comprehensive model of the assessment and development of social and emotional competences that bring together policymakers, researchers, teachers, school authorities and learners from different participating countries: (...) Finland, Italy, Latvia, Lithuania, Portugal, Slovenia, and Spain. The project attempts to create an international framework for regulating activities and supporting teachers working on the social and emotional competences of the students and to provide tools which can be used across countries. The aim of the paper is to describe how L2B has been developed in Spain by analyzing the contributions of the international framework and extracting the specific needs in the Spanish context. Specifically, we describe two products of the project: a) the process for creating a toolkit, a tool focused on creating activities and materials for helping teachers develop social and emotional competences of students and b) the results of an exploratory study in Spain in which social and emotional competences are assessed and compared to the international framework. First, we explain the definition of social and emotional competences used for creating the toolkit. Second, we analyze responses of Spanish students to questionnaires administered before applying the toolkit in the schools. The paper describes social and emotional competences in Spain and evaluates the overlap between relevant variables in Spain and those used for developing the toolkit, the international tool. Specific needs in Spain are discussed, as well as the contribution of the project for promoting the improved development of students’ social and emotional competences, improving learning outcomes and stronger social cohesion in schools and local communities, as well as the utility of the results for creating new educational policies. What is it for history to matter? Stephen Gould argued that unpredictability is part of the answer. For example, the “fact“ that repeated replays of the history of life would end differently every time is a sign that history matters to the course of evolution. But there is a problem here: if a particular point in the past leaves open alternative possible futures, then in what sense does that point in the past matter with regard to which of the outcomes (...) occurs? We argue that unpredictability is central to the importance of history. However, it is not the unpredictability of the future, but rather the unpredictability of the past itself that is the key. History matters when a particular future depends on a particular past that was not bound to happen, but did. (shrink)

All contemporary frameworks of mental capacity stipulate that we must begin from the presumption that an adult has capacity. This presumption is crucial, as it manifests respect for autonomy and guards against prejudice and paternalism on the part of the evaluator. Given its ubiquity, we might presume that we all understand the presumption’s meaning and application in the same way. Evidence demonstrates that this is not the case and that this has led to harm in vulnerable persons. There is thus (...) strong reason to question our presumptions about the presumption of capacity. We distinguish between two main ways of understanding and applying the presumption of capacity, and advocate for the one that we argue mitigates risk of harm. Our proposed interpretation offers many advantages in that it is consonant with actual practice of capacity evaluations, precludes confused and abusive avoidance of needed evaluations, and preserves the respect for autonomy motivating the presumption in the first place. We argue that quantum theory does not allow for a generalization of the notion of classical conditional probability by showing that the probability defined by the Lüders rule, standardly interpreted in the literature as the quantum-mechanical conditionalization rule, cannot be interpreted as such.

The clearly recognized innovation in Galileo’s work on free fall has been a stimulus and a challenge for the history and philosophy of science. This article will analyze the experimental and theoretical aspects of Galileo’s work on free fall. It draws on several authors’ results to justify the claim that the research model established by Galileo remains valid today (Sections 2 and 3). The article draws this parallel with current science by focusing on Galileo’s method, way of considering scientific instruments, (...) and practice of confrontation between theory and experiments. The Galilean mode of investigation can be interpreted from a variety of possible philosophical perspectives: Section 3 examines how relevant the so-called constructivist and conventionalist perspectives are to analysis of Galileo’s innovations. Section 4 discusses Galileo’s contribution to the mathematization of science and the Platonic character of his thought. The present paper stems from the biosemiotic modelling of individual artificial cognition proposed by Ferreira and Caldas (2012) but goes further by introducing the concept of Umwelt Overlap. The introduction of this concept is of fundamental importance making the present model closer to natural cognition. In fact cognition can only be viewed as a purely individual phenomenon for analytical purposes. In nature it always involves the crisscrossing of the spheres of action of those sharing the same environmental bubble. Plus, the (...) incorporation of that concept is vital to understand the complex semiosis that sustains collective tissues, societies, regulating collective cognition and consequently cooperative action. The concept of Umwelt Overlap broadens the range of applicability of the previous model to several distinct domains allowing for example for its application to multi-agent cooperative autonomous systems. "Meaning, the complex phenomenon of individuation and the definition of identity are the core theme of this work. Grounded on a theoretical framework that gives particular emphasis to the semiotic process common to all forms of cognition, human cognitionis conceived here as specific of organisms that, in the course of their interactions, produce symbolic forms, defining the specific physical, social and cultural environments in which they evolve. Individuation, inherent to that semiotic process, is complex and double-sided. It involves, on one (...) hand, the definition of semantic identities and their acknowledgment as world objects naming; on the other hand, it comprehends the specific lexical and morphosyntactic strategies different languages have found todesignate particular entities referring. The definition of world objects and its symbolic translation presents variations from language to language. In the second part of the book, we define what we have called a 'structure-motivated ontology' to represent how this symbolic translation is accomplished in English and European Portuguese. However, more often dignity is invoked in order to argue for or against the same issue. Is it possible that a concept can be so broad that it becomes meaningless? What do we mean when we argue for moral decisions based on dignity? The main interest of this paper is to understand how different theories have influence in the anthropological study of boundaries spaces. First, I will refer to Wolf’s and Barth’s critique against the particularism of the first ethnographies. These first anthropologists maintained an isolated and separated conception of culture and consequently, they were unable to apprehend links between different human groups. In contrast, I will mention new approaches, more sensible to the differential situations in borders and the existence of transnational nets (...) among regions. Lastly, I will allude to the difficulties that three contemporary anthropologists must face, when they link these new approaches with some postmodern concepts and therefore, they cannot apprehend either the complexity of the boundaries. En este artículo se va a tratar de comprender cómo la elección del marco teórico va a tener consecuencias en la realidad estudiada, en el caso concreto de la antropología de los espacios fronterizos. En primer lugar, nos referiremos a las críticas de Wolf y Barth al particularismo característico de las primeras etnografías, dado su concepto aislado y cerrado de cultura, que les impedía reconocer los vínculos y contactos entre distintos grupos humanos. Como contraste a los particularismos, recientemente han aparecido nuevos enfoques teóricos, más atentos a las realidades fronterizas y al establecimiento de redes transnacionales entre distintas regiones; entre ellos, destacaremos las aportaciones de tres antropólogos contemporáneos quienes vinculan los enfoques transnacionales con algunos conceptos propios de la filosofía posmoderna y como consecuencia tienen dificultades aprehender la complejidad de los espacios fronterizos. L’argumentation est construite autour de quatre angles principaux : le contexte de création des premiers musées d’histoire naturelle ; l’émergence des communautés scientifiques, la prise en compte de la nécessité de la popularisation des sciences pendant le (...) processus de transition à la démocratie et le développement des centres de culture scientifique, technique et industrielle à partir 1978.This article focuses on two aspects: the strong links between political context and museum creation in Latin America, and the development of centres of scientific, technical and industrial culture to remedy the gap in high-quality scientific education. Our argument here is built up from four main angles: the context in which the first natural history museums were created, the emergence of scientific communities, the acknowledged need for science popularisation during the transition to democracy and the development, since 1978, of centres of scientific, technical and industrial culture. This paper purports toshow that it is not necessary to read the early Platonic dialogues starting from the "classic" theory of Forms. It argues, instead, that it is possibleto analyze them and, above all, to explain the use of the vocabulary of "presence" starting from the more general and prior possibility of distinguishing a subject from its accidental predicates, especially quality. The relation of "present in" or "being in" to which Plato recurs. is inherited by Aristotle. The distinction between "being (...) said about something as asubject" and "being in something as in a subject" (Categories 2) seems to be a"natural" development of Platonic ontology. It is argued that the Aristotelian conception is closer to the earlier than to the intermediate dialogues. (shrink)

The Goddess People of Avalon, a young and flourishing religious community in Glastonbury (South-England), have been defining themselvesprincipally as a revitalization of the prehistoric worship of the Great Goddess. Based on fieldwork data of the author, the article offers an introduction into the religious tradition and ritual praxis of the contemporary Goddess People. Specifically, the analysis focuses on the ritual genre of Sacred Drama with its interpretationof the general and local history of religions. The variety of recursivity (as a reference (...) to the past), which this ritual genre expresses, is examined within an analytical frame that has been developed for different forms of ritual dynamics. Particularly, the analytical concepts ritual transfer, adaptation, invention and ritual design are discussed. Within the lastyears, a change in the self-image and legitimizing strategies of the Goddess People has occurred: Whereas in their nascent years, they understood themselves as a reactualization of primordial spirituality, they tend to see themselvescurrently more as a newreligious tradition, inventing their rituals creatively and confidently. The article argues for the use of the analytical concept ritual design to describe this aspect of ritual dynamics. Thus, instead of evaluating the degree of originality of rituals from an academic point of view, the legitimizing strategiesof religious agents come to the fore. (shrink)

Vanguarda Socialista, a newspaper edited by Mário Pedrosa in Rio de Janeiro from 1945 to 1948 elaborates a socialist and democratic political proposal as an alternative to the bolshevik conception, which was believed surpassed by history. The "Russian question" lies thus at the center of the group's preoccupations. This paper tries not only to analyse the newspaper's explanation for the origins of bureaucracy in the USSR, bringing to light the contradictions which run through it, but also to establish the group's (...) affiliation to Rosa Luxemburg's ideas, in the attempt to clarify those contradictions.Vanguarda Socialista, jornal editado por Mário Pedrosa no Rio de Janeiro, de 1945 a 1948, elabora uma proposta política socialista e democrática como alternativa à concepção bolchevique, que acredita superada pela história. Nessa medida, a "questão russa" encontra-se no centro das preocupações do grupo. Este artigo procura não só analisar a explicação do jornal para as origens da burocracia na URSS, mostrando as contradições que a perpassam, como também estabelecer a filiação do grupo às idéias de Rosa Luxemburgo, na tentativa de esclarecer as referidas contradições.
