According to advocates and authors from different disciplines interested in biomedicine, biomedical research in genetics and genomics has the potential to transform medicine, the economy, society, and humanity as a whole. Believing in this potential, biomedical scientists produce knowledge and participate in the decisions concerning the orientation of this research and its applications. Through a qualitative analysis of scientists' practice-related discourse, we identified three main sources of complexity in their involvement in the "commercial revolution" of science. First, scientists insist on (...) the existence of different types of university-industry relationships. Second, they urge that the multiple realities of genetic and genomic research be acknowledged. Third, they present themselves as individuals in a diverse scientific community, each with a unique position in this commercial revolution. This paper draws attention to these complexities because they must be considered when engaging in a study of genetics and genomics advances from a research ethics perspective. (shrink)

Moral or ethical questions are vital because they affect our daily lives: what is the best choice we can make, the best action to take in a given situation, and ultimately, the best way to live our lives? Health ethics has contributed to moving ethics toward a more experience-based and user-oriented theoretical and methodological stance but remains in our practice an incomplete lever for human development and flourishing. This context led us to envision and develop the stance of a “living (...) ethics”, described in this inaugural collective and programmatic paper as an effort to consolidate creative collaboration between a wide array of stakeholders. We engaged in a participatory discussion and collective writing process known as instrumentalist concept analysis. This process included initial local consultations, an exploratory literature review, the constitution of a working group of 21 co-authors, and 8 workshops supporting a collaborative thinking and writing process. First, a living ethics designates a stance attentive to human experience and the role played by morality in human existence. Second, a living ethics represents an ongoing effort to interrogate and scrutinize our moral experiences to facilitate adaptation of people and contexts. It promotes the active and inclusive engagement of both individuals and communities in envisioning and enacting scenarios which correspond to their flourishing as authentic ethical agents. Living ethics encourages meaningful participation of stakeholders because moral questions touch deeply upon who we are and who we want to be. We explain various aspects of a living ethics stance, including its theoretical, methodological, and practical implications as well as some barriers to its enactment based on the reflections resulting from the collaborative thinking and writing process. Si l'individu éprouve un tel besoin de communiquer, on peut se demander si les définitions les plus répandues du langage permettent de comprendre ce phénomène dans sa complexité et son fonctionnement au sein des interactions.

The question of universalism and relativism is often taken to be a matter of critical reflexivity. This article attempts to present the question instead as a matter of practical, political, and always-situated concern. The attempt starts from the consideration of modern experimental sciences. These sciences usually serve as the stronghold for universalist claims and as such are a target of relativism. It is argued that the specificity of these sciences is not a method but a concern. To be able to (...) claim that they have not unilaterally imposed their definitions on the phenomena they study is the leading concern of experimenters and should be understood in terms of the following achievement: the creation of a very particular “rapport” that authorizes claiming that what is operationally defined “lends itself” to this correlation. Linking knowledge production with a creation of rapports entails a pluralization of sciences along with the pluralization of modes of concern associated with the rapport. However, resisting unilaterally imposed definitions is not enough, since with the coming “knowledge economy” the questions that this article raises will soon be part of a romantic past. Thus it concludes with a speculative touch, which may be a requiem, relating the creation of rapports with an ecology of practices akin to William James's always-under-construction pluriverse. Despite significant promotion of diversity in companies, as well as legislation for equal opportunities for women and men, it must be noted that women still remain largely in the minority in decision-making positions. This observation reflects the phenomenon of the glass ceiling that constitutes vertical discrimination within companies against women. Although the glass ceiling has generated research interest, some authors have pointed out that theoretical models have made little attempt to develop an understanding of this phenomenon and its implications. Therefore, (...) our study aims to fill this gap and to better understand the phenomenon of the glass ceiling by considering both its antecedents and its possible consequences. More precisely, we extend the model developed by Elacqua et al., proposing a more comprehensive model including organizational gender culture as a third factor in the emergence of the glass ceiling through the perception of differential treatment. We also investigated the glass ceiling’s consequences for organizational attitudes and well-being at work by considering work-to-family conflict as a possible mediator. We surveyed 320 women in managerial positions in a Belgian organization. Our study highlights the importance of all three factors in the emergence of the perception of differential treatment and, ultimately, the perception that a glass ceiling exists. Moreover, our results show that WFC fully mediates the effects of the glass ceiling on job strain and job engagement, and partially mediates the effects of the glass ceiling on job satisfaction and intention to quit. It is a well-known fact that the Śaiva nondualistic philosopher Utpaladeva (fl. c. 925–975) adopted the Sāṃkhya principle according to which the effect must exist in some way before the operation of its cause (satkāryavāda). Johannes Bronkhorst has highlighted the paradox inherent in this appropriation: Utpaladeva is a staunch supporter of the satkāryavāda, but whereas Sāṃkhya authors consider it as a means of proving the existence of an unconscious matter, the Śaiva exploits it so as to establish his monistic idealism, (...) in perfect contradiction with the Sāṃkhya dualism of matter and consciousness. How does Utpaladeva achieve this complete reversal of meaning of the satkāryavāda? The present article argues that the elliptical verses of the Īśvarapratyabhijñākārikā dealing with this issue have been partly misunderstood so far due to the loss of Utpaladeva’s own detailed commentary (Vivr̥ti) on this passage: Abhinavagupta’s two commentaries, however terse in this respect, clearly show that a crucial part of Utpaladeva’s reasoning remains implicit in the verses. The article therefore attempts to reconstruct the gist of Utpaladeva’s strategy by having recourse to various other Śaiva sources, including Somānanda’s Śivadr̥ṣṭi and Utpaladeva’s own commentary thereon. This examination shows that Utpaladeva’s appropriation of the satkāryavāda rests on a profound transformation of the Sāṃkhya notions of manifestation (abhivyakti) and potentiality (śakti), and that his criticism of the Sāṃkhya understanding of causality might target the Śaiva dualists as well as Sāṃkhya authors. BackgroundInnovations in technology have contributed to rapid changes in the way that modern biomedical research is carried out. Researchers are increasingly required to endorse adaptive and flexible approaches to accommodate these innovations and comply with ethical, legal and regulatory requirements. This paper explores how Dynamic Consent may provide solutions to address challenges encountered when researchers invite individuals to participate in research and follow them up over time in a continuously changing environment.MethodsAn interdisciplinary workshop jointly organised by the University of Oxford (...) and the COST Action CHIP ME gathered clinicians, researchers, ethicists, lawyers, research participants and patient representatives to discuss experiences of using Dynamic Consent, and how such use may facilitate the conduct of specific research tasks. The data collected during the workshop were analysed using a content analysis approach.ResultsDynamic Consent can provide practical, sustainable and future-proof solutions to challenges related to participant recruitment, the attainment of informed consent, participant retention and consent management, and may bring economic efficiencies.ConclusionsDynamic Consent offers opportunities for ongoing communication between researchers and research participants that can positively impact research. Dynamic Consent supports inter-sector, cross-border approaches and large scale data-sharing. Whilst it is relatively easy to set up and maintain, its implementation will require that researchers re-consider their relationship with research participants and adopt new procedures. (shrink)

In a thought-provoking paper, Schuklenk and Smalling argue that no right to conscientious objection should be granted to medical professionals. First, they hold that it is impossible to assess either the truth of conscience-based claims or the sincerity of the objectors. Second, even a fettered right to conscientious refusal inevitably has adverse effects on the rights of patients. We argue that the main problem with their position is that it is not derived from a broader reflection on the meaning and (...) implications of freedom of conscience and reasonable accommodation. We point out that they collapse two related but distinct questions, that is, the subjective conception of freedom of conscience and the sincerity test. We note that they do not successfully show that the standard norm according to which exemption claims should not impose undue hardship on others is unworkable. We suggest that the main reason why arguments such as no one is forced to be a medical professional are flawed is that public norms should not constrain citizens to choose between two of their basic rights unless it is necessary. In fine, Schuklenk and Smalling, who see conscience claims as arbitrary dislikes, sell freedom of conscience short and forego any attempts at balancing the competing rights involved. We maintain the authors neglect that most of legal reasoning is contextual and that the blanket restriction of healthcare professionals' freedom of conscience is disproportionate. (shrink)

Social and environmental ratings provided by social rating agencies are multidimensional. The first goal of our paper is to identify a small number of independent and relevant socially responsible (SR) dimensions reflecting a firms’ coherent posture toward social issues. We put forward that these dimensions are not exactly the same as the ESG ones (Environment, Social, and Governance). Using the six sub-ratings provided by the Vigeo rating agency, we perform a principal component analysis and we highlight three main independent SR (...) dimensions related to (1) business stakeholders (employees, customers, and suppliers), (2) societal stakeholders (environment and society), and (3) financial stakeholders (stockholders and debt holders). The second objective of our paper is to explore the link between stock returns and these three SR dimensions. Our most notable finding is that for each SR dimension, investors ask for an additional risk premium when they accept to hold non-socially responsible stocks. The cost of equity is thus lower for SR firms. The average premium over the period 2003–2010 is larger for the components “business stakeholders” and “financial stakeholders” than for the component “societal stakeholders.” The premium for this last component has only existed since the end of 2008. Since that time, environment and community involvement have become important risk factors strongly considered by investors. For the three dimensions, investors notably penalize large non-social firms and reward small social firms. (shrink)

Participation of the Public in Science: Towards a New Kind of Scientific Practice Participation of the public in science has been the object of an increasing number of social and political philosophical studies, but there is still hardly any epistemological study of the topic. While it has been objected that involvement of the public is a threat to the integrity of science, the apparent indifference of philosophers of science seems to testify to its lack of relevance to conceptions of scientific (...) activity. I argue both that it is not a threat to science and that it is relevant to philosophy of science by showing that it constitutes a new kind of epistemic practice. Two main objections to the idea that the involvement of non-scientists, with their situated perspective and contextual values, can form an epistemic practice will be addressed: the first bears on the epistemic potentialities of the cooperation between scientist and non-scientists; the second on the possibility that this cooperation takes the form of a practice. One of the specificities of education and care practices lies in the competences of the professionals to give a central role to the detailed observation of situations, in order to adjust their modalities of action. How can such observational work be developed and transformed? A participatory research-training approach aims to support the co-construction of an analytical view on observable phenomena in the course of interactions. Phénomène acoustique d’origine physiologique, elle est une réalité muable et transitoire, qui relève du sensible ; en vertu d’une représentation de type dualiste, Augustin l’oppose à diverses réalités spirituelles et intelligibles, telle la forme, qui donne sens à la voix confuse. Outre l’influence des philosophies antiques du langage, cette conception de la voix reflète l’évolution de la valeur du « verbe », de plus en plus intériorisé (...) par Augustin. La voix s’intègre à une réflexion sur l’Incarnation, comme le montrent les images où elle apparaît : le paradigme du signe linguistique la rapproche de la « chair » extérieure du Verbe ; et la personne de Jean-Baptiste, voix proprement dite, résume en lui toutes les voix annonciatrices du Christ. Our purpose in this article is to explore the reasons for the continued attractiveness of Simmel's thought today and to probe the contemporary affinities to his philosophical stance towards the world. Simmel anchored the ‘philosophical attitude' in the philosopher’s particularly developed disposition for Erlebnis, i.e. the unified pre-conceptual experience of each moment of reality and life, as well as in a particular mode of objectivating this experience. We provide an illustration of such an approach and its implications through Simmel's analysis (...) of ‘remoteness from oneself’ and the restlessness it entails in The Philosophy of Money. We argue that Simmel's attempt at phenomenologically unveiling the contours and depths of life moments and fragments, as well as his emphasis on constant movement, provide much reassurance to contemporary subjectivities. But his philosophical stance is also driven by a quasi-mystical yearning for the One that lies beneath and beyond the fragments. We propose an initial assessment of the main implications of such a stance by relating it to the philosophical path it opened up (a path directly linking to Heidegger and his followers, but also in part to Deleuze) and by placing it in what we understand to be the new philosophical situation today. Zipf famously stated that, if natural language lexicons are structured for efficient communication, the words that are used the most frequently should require the least effort. This observation explains the famous finding that the most frequent words in a language tend to be short. A related prediction is that, even within words of the same length, the most frequent word forms should be the ones that are easiest to produce and understand. Using orthographics as a proxy for phonetics, we test (...) this hypothesis using corpora of 96 languages from Wikipedia. We find that, across a variety of languages and language families and controlling for length, the most frequent forms in a language tend to be more orthographically well‐formed and have more orthographic neighbors than less frequent forms. We interpret this result as evidence that lexicons are structured by language usage pressures to facilitate efficient communication. (shrink)

The theoretical framework of this research is the vocational pedagogy theory (Pastré, 2011) in a comparative perspective (Sensevy, Mercier & Schubauer-Leoni, 2000). This paper aims to describe some results of a qualitative research. The subject is one student of a Teacher Training University in Switzerland. The focus is the analysis of work activity of this student during his training in a primary school in order to understand the relationship between the different contracts (didactic and training). The results of this research (...) showed a gap between what the student wants to teach and what he knows about this knowledge. It results an activity centered more on doing than on learning. Philosophers debate the death of philosophy as much as they debate the death of God. Kant claimed responsibility for both philosophy's beginning and end, while Heidegger argued it concluded with Nietzsche. In the twentieth century, figures as diverse as John Austin and Richard Rorty have proclaimed philosophy's end, with some even calling for the advent of "postphilosophy." In an effort to make sense of these conflicting positions—which often say as much about the philosopher as his subject—Isabelle Thomas-Fogiel undertakes the (...) first systematic treatment of "the end of philosophy," while also recasting the history of western thought itself. Thomas-Fogiel begins with postphilosophical claims such as scientism, which she reveals to be self-refuting, for they subsume philosophy into the branches of the natural sciences. She discovers similar issues in Rorty's skepticism and strands of continental thought. Revisiting the work of late-nineteenth and early-twentieth-century philosophers, when the split between analytical and continental philosophy began, Thomas-Fogiel finds both traditions followed the same path—the road of reference—which ultimately led to self-contradiction. This phenomenon, whether valorized or condemned, has been understood as the death of philosophy. Tracing this pattern from Quine to Rorty, from Heidegger to Levinas and Habermas, Thomas-Fogiel reveals the self-contradiction at the core of their claims while also carving an alternative path through self-reference. Trained under the French philosopher Bernard Bourgeois, she remakes philosophy in exciting new ways for the twenty-first century. (shrink)

We propose in this paper to construct modal logics based on mathematical morphology. The contribution of this paper is twofold. First we show that mathematical morphology can be used to define modal operators in the context of normal modal logics. We propose definitions of modal operators as algebraic dilations and erosions, based on the notion of adjunction. We detail the particular case of morphological dilations and erosions, and of there compositions, as opening and closing. An extension to the fuzzy case (...) is also proposed. Then we show how this can be interpreted for spatial reasoning by using qualitative symbolic representations of spatial relationships (topological and metric ones) derived from mathematical morphology. This allows to establish some links between numerical and symbolic representations of spatial knowledge. (shrink)

We develop a model of ideals-based accountability which we have witnessed at work in several long-thriving family businesses. The owners and managers of these firms eschew individualism and materiality in the pursuit of ethical ideals such as supporting democracy and bettering the human condition. Although accountability is to these ideals, not for outcomes such as profitability or even reputation, IBA has resulted in outstanding reputations for some firms. We characterize IBA according to its missions, leadership, culture, and stakeholder relationships. We (...) also contrast it with traditional forms of accountability and differentiate IBA from related stakeholder, stewardship, and CSR perspectives. Finally, we examine its manifestations within five long-lived family enterprises, in the process generating propositions to advance the concept. (shrink)

Grâce à une approche à la fois historienne et littéraire de la trilogie Sonne auf halbem Weg : die Istanbul-Berlin Trilogie (Soleil à mi-chemin : la trilogie Istanbul-Berlin), nous cherchons à interroger le récit à la première personne d’un parcours migratoire au féminin qui échappe aux catégories littéraires traditionnelles, entre autobiographie, roman et témoignage. Plutôt que de définir de nouveaux critères de classification, cet (...) article entend montrer l’apport d’un texte littéraire qui prend en compte le prisme du genre à la construction d’un discours historique alternatif, en rupture avec l’historiographie dominante de l’époque sur les Gastarbeiter (travailleurs invités allemands) en République fédérale d’Allemagne (seconde moitié du xxe siècle). The paper’s aim is to underline the growing phenomenon of categorization of EU migrants despite the existence of a common EU citizenship. It addresses legal categorization deriving from EU legislation and the jurisprudence of the Court of Justice of the European Union, but also factual categorization arising from host member states’ practices. The legal categorization of EU migrants reveals a clear differential treatment between economically active and inactive EU mobile citizens. Member states’ practices very often go further than legal categorization (...) by excluding poor mobile citizens, viewed as abusers of rights or as a potential threat to local public order or security. This paper also investigates the incompleteness of EU citizenship, being unable to prevent categorization of EU migrants. (shrink)

In this paper, we examine whether affect influences higher level cognitive processes. We review research on the effect of emotion on interpretation, judgement, decision making, and reasoning. In all cases, we ask first whether there is evidence that emotion affects each of these processes, and second what mechanisms might underlie these effects. Our review highlights the fact that interpretive biases are primarily linked with anxiety, while more general mood-congruent effects may be seen in judgement. Risk perception is also affected by (...) negative and positive affect. Research shows complex effects of emotion on decision making and reasoning, with emotion sometimes hindering normatively correct thinking and sometimes promoting it. There are also important effects of emotion on reasoning style. We discuss key differences between the effects of incidental affect (feeling states not related to the semantic contents of the cognitive task) and integral affect (where the feeling state is caused by or linked to the contents of the cognitive task). In the conclusion, we suggest that focusing on some of the constituent mechanisms involved in interpretation, judgement, decision making and reasoning provides a way to link some of the diverse findings in the field.
