Der Band dokumentiert Beiträge zum 18. Symposium des Mediävistenverbandes, das im Frühjahr 2019 in Tübingen stattgefunden hat. Das Thema greift aktuelle Debatten über Autorschaft, Urheberrecht, Originalität und Plagiat auf, die anzeigen, dass diese Konzepte neuerdings in Bewegung geraten sind. Die Beiträge des Bandes fragen aus unterschiedlichen Fachperspektiven, ob und inwiefern die Verfahren des Umgangs mit Autorschaft zwischen Mittelalter und Moderne am Ende stärker vergleichbar sind als gemeinhin angenommen. So werden die aus der Moderne gebildeten Kategorien von Kreativität hinterfragt und unterlaufen. (...) Zugleich zeigt sich, dass eben diejenigen Kreativitätsprozesse der Moderne, die den hohen normativen Ansprüchen einer Geniekultur nicht entsprechen, nicht einfach Defizienzerscheinungen sind, sondern Variationen vielfach geübter Techniken, zu deren Verständnis die mittelalterliche Produktivität dient. Schaffen und Nachahmen sind nicht in einen "künstlerischen" Bereich der Kultur sektorierbar, sondern sie erweisen sich als Grundstruktur menschlichen Handelns auch im wissenschaftlichen, ethischen oder religiösen Feld. Ausgehend von Erkenntnissen der Evolutionären Psychologie untersucht dieser Beitrag wichtige Funktionen, die das Bewusstsein autonomer Roboter ausfüllen kann. Gemeint sind willkürlich kontrolliertes Handeln, bewusstes Wahrnehmen, Eigenwahrnehmung, Metaerkenntnis sowie Bewusstsein des eigenen Selbst. Der Verfasser unterscheidet zwischen intrinsischer Intentionalität und Bewusstsein, führt jedoch das Argument ins Feld, dass es ebenso wichtig sei, die Erkenntnisweise eines Roboters zu verstehen. Abschließend wird, aus dem Blickwinkel der Theorie von den Protophänomenen, das für Roboter „schwierige Problem” untersucht, d.h. die Frage, ob sie zu subjektiver (...) Wahrnehmung fähig sind. In diesem Fazit & Ausblick werden nun die in der Einleitung formulierten Themenfelder, in denen wir auch die Anschlüsse an Arbeiten und Forschungsgebiete der Historischen Anthropologie gegeben sahen, wieder aufgegriffen. Dies geschieht entlang von Aspekten, die durch die responses aufgeworfen wurden, und die wir hinsichtlich unserer Forschung zu Arenen transkultureller Bildung weiterdenken. Ein wichtiger Schwerpunkt liegt dabei auf den Transmissionseffekten, die sich im Forschungsprozess, auch unter Einbezug der responses, zwischen den Forschungsfeldern – den Arenen Theater und Schule – ergeben haben. Fünfzehn Jahre nach ihrer Entstehung ist die Neuroethik ein internationales wissenschaftliches Feld mit enormer Dynamik. Innerhalb weniger Jahre wurden eigene Kongresse, Zeitschriften, Forschungsförderprogramme, Fachgesellschaften und Institute gegründet. Gleichwohl besteht erheblicher Dissens über die Definition und den Gegenstandsbereich dieses neuen Gebiets. Wir argumentieren hier für eine differenzierte Konzeption, wonach neben der Reflexion ethischer Probleme der Neurowissenschaft und ihrer überwiegend neurotechnologischen Anwendungen auch die ethische Reflexion neurowissenschaftlicher Forschung zur Moralität zur Neuroethik gehört. Dies umfasst zwar nicht neurowissenschaftliche oder neuropsychologische Studien zur (...) Moralität, wohl aber die Reflexion der Bedeutung dieser Forschung für die Ethik und das Recht. Wir geben einen Überblick über die wichtigsten Themen der Neuroethik, woraus deutlich wird, wie sehr in verschiedenen gesellschaftlichen Bereichen, auch jenseits von Medizin und Gesundheitswesen, neuroethische Fragen relevant sind. Das Potenzial der Neuroethik als eines neuen Wissenschaftsfeldes liegt darin, durch eine Verknüpfung neurophilosophischer und medizinethischer Themen sowie eine breite interdisziplinäre Vernetzung neue Antworten auf gesellschaftlich drängende Fragen zu finden. J.M. R. Lenz hat sich keineswegs als ein „vorübergehendes Meteor“ erwiesen, wie Goethe urteilte, sondern gilt inzwischen als einer der wichtigsten Autoren des 18. Jahrhunderts. Sein unglückliches Schicksal ist, vor allem über Büchner vermittelt, ein bis heute aktuelles Thema der produktiven Rezeption. Seine Werke entziehen sich aufgrund ihrer formalen und thematischen Vielschichtigkeit schnellen Deutungen. Die Rezeption von Autor und Werk in Wissenschaft, Literatur, Kunst, Musik und Film wird einbezogen. Dem ‚Lenz-Kenner‘ vermittelt das Handbuch den aktuellen Stand der Wissenschaft, aber auch neue Einsichten und damit die Grundlage für weitere eigene Forschungsarbeiten, dem Interessenten am Autor, an der Literaturgeschichte des 18. Jahrhunderts und ihrer Aneignung heute bietet das Handbuch eine Fülle von Informationen und Anregungen, die zugleich der besonderen Rolle von Lenz im literarischen Feld seiner Zeit gerecht zu werden versuchen. If affirmative action and other ethnicity-based social programs are justified, then J. Angelo Corlett believes it is important to come to an adequate understanding of the nature of ethnicity in general and ethnic group membership in particular. In Race, Racism, and Reparations, Corlett reconceptualizes traditional ideas of race in terms of ethnicity. As he makes clear, the answers to the questions "What is a Native American?" or "What is a Latino?" have important implications for public policy, especially for those programs (...) designed to address historic injustices and economic and social imbalances among different groups in our society. Having supplanted "race" with a well-defined concept of ethnicity, the author then analyzes the nature and function of racism. Corlett argues for a notion of racism that must encompass not only racist beliefs but also racist actions, omissions, and attempted actions. His aim is to craft a definition of racism that will prove useful in legal and public policy contexts. Corlett places special emphasis on the broad questions of whether reparations for ethnic groups are desirable and what forms those reparations should take: land, money, social programs? He addresses the need for differential affirmative action programs and reparations policies—the experiences of different ethnic groups vary greatly. Arguments for reparations to Native and African Americans are considered in light of a variety of objections that are or might be raised against them. Fur die Edition von Sulzers Schriften ist dieser Briefwechsel geradezu fundamental: Mit seinen 453 Briefen, die in 35 Jahren (1744-1779) entstanden sind, zahlt er zu den umfangreichsten Korrespondenzen Sulzers und liefert zahlreiche neue Informationen zu zentralen Themenfeldern der europaischen Aufklarung, zur Genese von Sulzers und Bodmers Schriften, zu (...) ihrem Netzwerk, insbesondere in Preuaen und in der Schweiz, sowie zu Aspekten ihres Privatlebens. Jorgensen (bio)In probing the interrelationship of myth, meaning, and education, I offer a case in point, notably, Peter Jackson's film adaptations and Howard Shore's musical scores for J. R. R. Tolkien's The Lord of the Rings trilogy—The Fellowship of the Ring, The Two Towers, and The Return of the King.1 Intersecting literature, film, and music (...) allows me to explore various perspectives or ways of meaning making associated with this myth. I then trace some of the implications of the analysis for musical and general education.I am particularly interested in the musical connections with myth evident in societies around the world and well established in the anthropological, ethnomusicological, and philosophical literatures. For example, Steven Feld finds the myth of the muni bird to be foundational to a New Guinea society in shaping musical expression and communal beliefs and practices.2 Likewise, as Lewis Rowell argues, Western music is rooted in and acquires its own mythos of person, power, and musical instruments; Dionysius, Apollo, Lachesis, Clotho, Atropos, Orpheus, Guido of Arezzo, St. Cecilia, and Thomas Mann's Doctor Faustus are among those whose impact on music are legendary, formative, and figurative.3 Associations of particular myths with operatic, orchestral, and choral repertoire in the Western classical tradition also abound, such as Wagner's operatic setting of the Lay of the Nibelung and Sibelius's evocation of the Finnish Vālhālla. Music and myth are interconnected especially in the film music of our time, for example, The Lord of the Rings trilogy, Titanic, and the Star Trek and Star Wars series.In The Lord of the Rings, my present focus, Shore's musical scores help to highlight the mythic character of Tolkien's narrative, bridge the externally perceived phenomenal world and the internal and subjective "inner world," interrelate the experience of time—especially past and present—and evoke a sense of wonder and awe that otherwise may be forgotten in pervasively [End Page 44] materialistic societies. Music's role in kindling reverence goes to the heart of what these films share that make them mythic—transcendence, profundity, ambiguity, narrativity, and an aesthetic and didactic character that arouse awe, mystery, and a heightened sense of the human condition. Here, music is primarily representational,4 serving functional as well as aesthetic/artistic roles in expressing such mythic themes as the contest between good and evil (in which good is often more fragile and the odds sometimes insurmountable) and the inevitability of death, in which human beings are often at the whim of capricious gods, natural forces, and their own weakness. It adds emotional and intellectual feeling to the visual images, pointing particular attention to specific scenes and representing the tensions built or released as the narrative and visual images unfold.Music's role in blurring past and present is particularly interesting since it is an art of time. The Lord of the Rings evokes an earlier time of crisis in Middle-earth, when the survival of humanity was in jeopardy. The soundtrack assists the moviegoer to make connections between times and travel imaginatively through time, thereby bringing alive the past and imagined future in the present moment. Boundaries between past and present become fuzzier, and one is helped in moving from one time to another. Leitmotifs are of particular interest in helping to make the ambiguity of the narrative more easily accessible and comprehensible, even at risk of oversimplifying matters—a quality evocative of music's use in the speech-song performances of the Iliad, among other ancient stories.Tolkien's fairytale is not couched for children, as is his earlier The Hobbit, but written unabashedly for adults.5 The Fellowship of the Ring can be seen as an epic fairytale with "a kind of religious significance."6 In her analysis of "life symbols"—or artistic, ritualistic, and mythic systems that are read "non-discursively," having no assigned connotation and therefore felt and grasped imaginatively and intuitively—Susanne Langer suggests that fairytales are a genre below that of myth in the continuum between dream and myth. In this paper, I disambiguate the ways in which immortality might be considered a human good and then argue that immortality is neither necessary nor sufficient condition for objective meaning in life. This paper will develop the concept of semiogenesis – a process of novel sign generation – and how instances of this process, such as agency, relate to their built environment and beyond. Section two will build on Hoffmeyer’s discussion of swarms, specifically the idea of overlapping swarms and its manifestation in the creation of termite mounds, in order to introduce three types of structure. Building upon this real-world example explored in section two, the third section will present a heuristic for (...) semiogenesis: a neuromorphic dynamic system model grounded in information and thermodynamic theory. Through the lens of this heuristic model, the penultimate section will more rigorously characterize the similarities and differences between termite and human agency in their respective built milieus. Prof. Alberto Urquidez, in an important recent article that appears in different form in his book, Redefining Racism, offers an informed, sustained, careful, multi-pronged, and sometimes original critique of the volitional analysis of racism, which I have proposed in a series of articles over the past two dozen years. Here I expand and improve VAR’s analysis of paternalistic racists and their beliefs, clarify its ‘infection’-model’s explanation of racism’s spread and variety, and lay out what it is for something to be (...) ‘characteristically’ racist, an understanding that I then use to offer a unified account of the way in which both certain physical objects and certain abstract objects can properly be called racist. Identifying and engaging some presuppositions behind Urquidez’s social, political, and moral criticisms of VAR, I respond to complaints from him and others, showing that VAR’s content is neither politically conservative nor dependent on religious doctrine, and point out that race theory would in fact profit from taking more seriously and internalizing the Christian morality of most African-Americans. The reception history of the French Revolution in France and England is well documented among Anglophone scholars; however, the debate over the Revolution in Germany is much less well known. Fichte's Contribution played an important role in this debate. Presented here for the first time in English, Fichte's work provides a distinctive synthesis of Locke's "possessive individualism," Rousseau's general will, and Kant's moral philosophy. This eclectic blend results in an unusual rights theory that at times veers close to a form (...) of anarchism. Written in 1792–93, just before Fichte moved to Jena to develop his philosophical system in a series of works—above all the Wissenschaftslehre of 1794—the Contribution provides invaluable insight into Fichte's early development. In addition, Fichte's work predates much of Kant's political philosophy, and can shed light on the rich dialogue in German political thought in the 1790s. (shrink)

This article reflects on the author's modest experience as an expert witness in two trials: Osheroff vs. Greenspan (1983), and In the Matter of Baby K (1994). Bioethicists' expertise as scholar-teachers and consultants on particular issues merits qualification by judges as expert witnesses. The article argues that a different kind of expertise – strong moral advocacy – is required to be an effective expert witness. The major lessons of expert witnessing for the author concern the demands and strains on the (...) bioethicist's role as scholar, teacher, and consultant. The Baby K case is analyzed in some detail, due to its importance for bioethics, ethics consultation, and the testimony of bioethicists on either side of the case. Rules of thumb are offered to guide decisions as to choices regarding expert witnessing, as well as a discussion of the interaction of law and bioethics. (shrink)

Ist die Theorie des „humanen Utilitarismus“ fähig, die Probleme struktureller Rationalität zu vermeiden, auf die J. Nida-Rümelin in seinen Arbeiten hingewiesen hat? Kann der humane Utilitarist zudem persönliche Projekte schützen, z.B. die Priorität familiärer Beziehungen, was Nida-Rümelin ebenfalls bezweifelt? Im Aufsatz findet eine Auseinandersetzung mit der Konsequentialismuskritik Nida-Rümelins und eine Verteidigung des humanen Utilitarismus statt. Dabei wird insbesondere dargelegt, dass Nida-Rümelins Konsequentialismuskritik alle unparteilichen Ethiken betrifft und dass nicht geklärt wird, was an die Stelle solcher Ethiken treten soll. Eine primär (...) auf die Wahrung persönlicher Integrität gerichtete Ethik schafft gerade bezüglich der von Nida-Rümelin gegen den Konsequentialismus ins Feld geführten Kooperationsprobleme größere Schwierigkeiten als sie beseitigt. In this paper, I give a new definition of microaffirmations as signals that a recipient belongs to some valued or high-status class. Microaffirmations can—but need not—lead individuals to gain a sense of confidence, belonging, and merit. I then explain the harms of microaffirmations, arguing that when microaffirmations are (...) distributed inequitably, they can have larger ramifications for injustice, harming some vulnerable groups more than others. In addition, microaffirmations can lead individual actors to make choices based on who gives them microaffirmations and where they receive them, and thus can have outsized influence over the direction of an individual’s life because individuals tend to migrate to where they feel valued, appreciated, and included. I then turn to solutions to the problems I raise. I argue we should attend to and attempt to rectify inequalities in microaffirmations because doing so can help ensure not just the absence of negative attention, but also that the presence of positive attention is flowing in a just and equitable way. Stephen Finlay’s proposed methodology for defending the central theses of his impressive Confusion of Tongues is an underexplored aspect of this work.1 1 His official methodology is analytic : A reduction of normative to non-normative vocabulary. Here, I argue that taking this official line at face-value forces the reader to conclude that the reductions at the heart of that book cannot be correct. In contrast, a philosophical methodology that does not proceed via analyses would better support those reductions, then understood (...) as non-analytic. As we’ll see below, there are independent, empirical reasons to reject a philosophical methodology that proceeds via analyses. I conclude that there is a method for the study of ethical language that better serves Finlay’s primary philosophical aims. The lesson, though, is generalizable: Given the array of normative and meta-normative theories, we want a semantics for normative discourse to be capable of expressing, we should expect that the more plausible such views will not be defended via analyses. Isaac Newton's closest approach to a system of the world in the critical period 1681–84 is provided in a set of untitled propositions concerning comets. They drastically revise his position maintained against Flamsteed in 1681 and may signal his adoption of a single comet solution for the appearances of 1680/1. Points of agreement and difference with the key pre-Principia texts of 1684–85 are analysed. He shows substantial control of the phenomena of tails which change very little in mechanical detail throughout (...) his subsequent work. An emerging theory of gravitation brings planets, their satellites, and comets under the same laws of motion, yet retains a celestial vortex and includes a singular proposition in lieu of the usual formulation of Keplers area law. The analysis raises questions on a number of issues of recent Newtonian scholarship ranging from his achievement following his correspondence with Robert Hooke in 1679 to his veneration of the wisdom of the ancients.
