This edited volume demonstrates that a virtue-centered approach to the ethical life is a consistent feature of William James’s moral reasoning from the 1880s until his death. Yet, little else remains constant within his writings on these subjects, and this inconstancy furthers interest in his work over a century later.

The practice and task of the philosophical interpretation of Scripture has been treated as a conversation-stopper within the academy. This collection corrects that tendency by offering substantive accounts of the role of Scripture in the philosophical thought of fifteen American philosophers.

Something happens on the tree of evolution between the big apes and ourselves which is (...) bound up with the development of personality; and once our branch has sprung out, a painter like Santi Raphael and a chemist like Humphry Davy both lie furled in the human beginning like the leaves in the bud. Are evolution and creation irreconcilably opposed? Is 'intelligent design' theory an unhappy compromise? Is there another way of approaching the present-day divide between religious and so-called secular views of the origins of life? Jacob Klapwijk offers a philosophical analysis of the relation of evolutionary biology to religion, and addresses the question of whether the evolution of life is exclusively a matter of chance or is better understood as including the notion of purpose. Writing from a Christian point of view, (...) he criticizes creationism and intelligent design theory as well as opposing reductive naturalism. He offers an alternative to both and an attempt to bridge the gap between them, via the idea of 'emergent evolution'. Considering the vulnerable climatic conditions in most parts of the planet, a successful transition toward a carbon-free future is a critical challenge worldwide. In this respect, around 35% of the world’s total greenhouse gas emission is associated with the power sector. To this end, a vast of electrical energy has been used by the people in buildings. Specifically, a significant amount of energy in buildings is used for heating, cooling, and ventilation. While the available literature highlights the importance of neat, (...) clean, and green electrical energy for the decarbonization of society, a critical gap exists in such literature. That is, most of the literature under this stream deals with the supply side of electrical energy, while the demand side was neglected. To bridge this critical knowledge gap, this study investigates how the CSR engagement of a hotel organization can promote the energy-related pro-environmental behavior among the employees with the intervening effect of employees’ environmental commitment and Green intrinsic motivation. Further, the conditional indirect role of altruistic values was also tested in this study. The data were collected from different hotel employees in Pakistan with the help of a self-administered questionnaire. We tested the hypothesized relationship through structural equation modeling. The results confirmed that CSR can be a potential motivator to impact the ERPEB of employees, while EMEC and GRIM mediated this relationship significantly. The findings of this study also confirmed the conditional indirect role of altruistic values. These findings offer various theoretical and practical contributions which are conversed in detail. Is rationality normative, in the sense that we ought to be rational, in our actions and attitudes? Recently, the claim that rationality is normative has faced several challenges. In this paper, I will take up these challenges, and aim to vindicate the normativity of rationality in the face of them. I will begin, in part 1, by outlining these challenges, and then discussing, and criticizing, some that have been offered to them in the literature. Substituted judgment has increasingly become the accepted standard for rendering decisions for incapacitated adults in the USA. A broad exception exists with regard to patients with diminished capacity secondary to depressive disorders, as such patients’ previous wishes are generally not honoured when seeking to turn down life-preserving care or pursue aid-in-dying. The result is that physicians often force involuntary treatment on patients with poor medical prognoses and/or low quality of life as a result of their depressive symptoms when similarly situated (...) incapacitated patients without such depressive symptoms would have their previous wishes honoured via substituted judgment. This commentary argues for reconsidering this approach and for using a substituted judgment standard for a subset of EMP/LQL patients seeking death. (shrink)

The qualities of Abraham's God, as tradition has them, are personal presence and guidance, a God who makes and keeps promises, who “covenants” with him and communicates with him directly; and who acts justly, not in a forensic sense but in a practical way.

A new public centered long-range corporate planning orientation is proposed. Underlying this orientation is the rationale that the main purpose of business activity is the satisfaction of socially desirable needs, i.e. needs that are compatible with long run public welfare. Such need satisfaction will tend to bring about improvements in the quality of private and public life. Corporate planning should thus facilitate the performance of business activities designed to achieve the satisfaction of socially desirable needs.The determination of what are socially (...) desirable needs will be based on public consensus, which corporations can periodically assess, and incorporate into their long range plans. A long-range planning procedure, incorporating social welfare considerations is developed. It is suggested that a planning procedure such as this is essential for the existence of firms in the long run. (shrink)

In the age of change in the institutional and conceptual setting in which the ancient tradition of Jewish learning would go forward, what we see in the two most important figures of the transitional generation is only the end of the old, not the beginning of the new. Saul Lieberman continued the received tradition that learning means exegesis of texts, but did not fully master the logic of that received tradition and so distorted it. Salo W. Baron undertook a new (...) intellectual tradition, one that pursued historical study in place of the exegesis of texts, but did. not really grasp the requirements of the kind of new history that he proposed to write. Announcing the advent of social history into the academy of Jewish learning, what he wrote as the economic part of that social history was merely the paraphrase of received texts, with glosses that look suspiciously like a kind of free-associative exegesis. While the one scholar demonstrated the decadence of an old tradition of learning, the other succeeded in showing only the difficulty of actually mastering the discourse of an entirely new academic world. As conceptual and theoretical discussions on environmental valuation approaches have advanced there is growing interest in the impact that valuation has on decision making. The perceived legitimacy of the outputs of valuation studies is seen as one factor influencing their impact on policy decisions. One element of this is ensuring that participants of valuation processes see the results as legitimate and would be willing to accept decisions based on these findings. Here, we test the perceived legitimacy to participants of two (...) approaches to deliberative monetary valuation, deliberated preferences and Deliberative Democratic Monetary Valuation, in the context of marine planning in the Clyde estuary in Scotland. We compare and contrast deliberated preference and deliberative democratic monetary valuation and track their emergence as responses to critiques of conventional stated preference approaches. We then present the results of our case study where we found that deliberative democratic monetary valuation produced valuations that were perceived as more legitimate that deliberated preference as the basis for decision making by those involved in the valuation process. I pursue here three related aims. First, I criticise some of the metaphysical claims made on behalf of the so-called `enactive' approach to visual experience. Secondly, I explain why the enactive view of visual experience is hard to square with the evidence in favour of the two-visual-systems model of human vision. Finally, I explore one possible way to develop the `pre-emptive perception' framework and explain why, contrary to first appearances, some of the fundamental discoveries of brain mechanisms, whose function might (...) be to underlie pre-emptive perception, do not really support the enactive approach to visual experience. I argue that comparisons of Stoic virtue to stochastic skills — now standard in the secondary literature on Stoicism — are based on a misreading of the sources and distort the Stoic position in two respects. In paradigmatic stochastic skills such as archery, medicine, or navigation the value of the skill’s external end justifies the existence and practice of the skill and constitutes an appropriate focus of rational motivation. Neither claim applies to virtue as the Stoics understand it. The stochastic (...) model of virtue almost certainly originated with Carneades and should be distinguished clearly from the Stoic account. Doing so clarifies the Stoic position and shows that it anticipates what Thomas Hurka calls a modern view of value. (shrink)

A representation's semantic property risks therefore to be deprived of causal efficacy by its physical properties . As the World Anti-Doping Code is up for revision, the paper proposes a framework for reading the Code based on a relatively literal approach and an almost exclusive focus on the ?spirit of sport? as a key element of the Code. The author argues that this single element can contribute to revealing the underlying rationale of the Code, as it serves to justify bans of doping substances and methods, in some cases without recurring to evidence sustaining the claims made. For (...) a substance/method to be banned, the Code requires that two out of three criteria be met: performance enhancement, health risk and the spirit of sport. The paper demonstrates how these provisions link to other parts of the Code, (under the rules of the Code 2009) in the absence of performance-enhancing properties combined with a health risk. The paper draws implications from these findings regarding terminological (im)precision, legal certainty/predictability, transparency/accountability, limits to arbitrary exercise of power and internal/external validity. What is the moral value of formal democratic decision-making? Egalitarian accounts of democracy provide a powerful answer to this question. They present formal democratic procedures as a way for a society of equals to arrive at collective decisions in a transparent and mutually acceptable manner. More specifically, such procedures ensure and publicly affirm that all members of a political community, in their capacity as autonomous actors, are treated as equals who are able and have a right to participate in collective (...) decision-making. Recently, a number of authors have raised what I describe as the ‘no impact’ objection. This objection focuses on the egalitarian emphasis on autonomy to cast doubt on the moral value of formal democratic procedures. It holds that individual participation in formal democratic decision-making has no impact on the eventual result, and therefore cannot be understood as an exercise in autonomy. Consequently, the ‘no impact’ objection claims that the moral value of formal democracy cannot be explained with reference to an egalitarian ideal of ‘rule by the people’. In this article, I refute this objection by complementing an egalitarian account of democracy with an account of basic autonomy. (shrink)

Europa presents, to the modern reader, the foreign political thought of four major German conservatives from the crucial period between the Second Reich and the Second World War. The texts chosen reveal the spiritual and cultural motives, of German conservatives at the turn of the century, that inspired expansionist policies and the consistent opposition to the Jewish financial rule. The lack of German translations of these important texts so far has clearly been a disadvantage to the modern historian in his (...) assessment of the philosophical significance of the Conservative, as well as of the National Socialist, foreign political ideology. The central nervous system uses feedback processes that occur at multiple time scales to control interactions with the environment. The long-latency response is the fastest process that directly involves cortical areas, with a motoneuron response measurable 50 ms following an imposed limb displacement. Several behavioral factors concerning perturbation mechanics and the active role of muscles prior or during the perturbation can modulate the long-latency response amplitude in the upper limbs, but the interactions among many of these factors had not been (...) systematically studied before. We conducted a behavioral study on thirteen healthy individuals to determine the effect and interaction of four behavioral factors – background muscle torque, perturbation direction, perturbation velocity, and task instruction – on the LLRa evoked from the flexor carpi radialis and extensor carpi ulnaris muscles after velocity-controlled wrist displacements. The effects of the four factors were quantified using both a 0D statistical analysis on the average perturbation-evoked EMG signal in the period corresponding to an LLR, and using a timeseries analysis of EMG signals. All factors significantly modulated LLRa, and their combination nonlinearly contributed to modulating the LLRa. Specifically, all the three-way interaction terms that could be computed without including the interaction between instruction and velocity significantly modulated the LLR. Analysis of the three-way interaction terms of the 0D model indicated that for the ECU muscle, the LLRa evoked when subjects are asked to maintain their muscle activation in response to the perturbations was greater than the one observed when subjects yielded to the perturbations, but this effect was not measured for muscles undergoing shortening or in absence of background muscle activation. Moreover, higher perturbation velocity increased the LLRa evoked from the stretched muscle in presence of a background torque, but no effects of velocity were measured in absence of background torque. Also, our analysis identified significant modulations of LLRa in muscles shortened by the perturbation, including an interaction between torque and velocity, and an effect of both torque and velocity. The time-series analysis indicated the significance of additional transient effects in the LLR region for muscles undergoing shortening. (shrink)

Physicians expressing opinions on medical matters that run contrary to the consensus of experts pose a challenge to licensing bodies and regulatory authorities. While the right to express contrarian views feeds a robust marketplace of ideas that is essential for scientific progress, physicians advocating ineffective or dangerous cures, or actively opposing public health measures, pose a grave threat to societal welfare. Increasingly, a distinction has been made between professional speech that occurs during the physician-patient encounter and public speech that transpires (...) beyond the clinical setting, with physicians being afforded wide latitude to voice empirically false claims outside the context of patient care. This paper argues that such a bifurcated model does not sufficiently address the challenges of an age when mass communications and social media allow dissenting physicians to offer misleading medical advice to the general public on a mass scale. Instead, a three-tiered model that distinguishes between citizen speech, physician speech and clinical speech would best serve authorities when regulating physician expression. (shrink)

My aim in this paper is to explore an affinity between early critical theory and analytical philosophy. The affinity is in a fairly unexpected area: philosophy of science. I argue that early critical theory embraces a view of science which is a natural if somewhat unfamiliar extension of the pragmatist one defended by Quine. In particular, I argue that Horkheimer has a version of the Quine-Duhem thesis (“underdetermination of theory choice by the evidence”). How do the Frankfurt and analytical versions (...) of the underdetermination thesis differ? Quine and others have taken the thesis to motivate a form of pragmatism. What this means is that it is certain interests that ultimately determine the choice of theory: chief among them, an interest in simplicity of our theories. However, the Critical Theorists offer us a distinctly historical materialist version of the underdetermination thesis, in which it is the imperatives of the prevailing mode of production, for example, capitalism, which are decisive. The result is an unfamiliar Marxist version of an otherwise familiar thesis from the analytic tradition. (shrink)

In the opening sections of his Foundations of Natural Right, Fichte argues that mutual recognition is a condition for the possibility of self-consciousness. However, the argument turns on the apparently unconvincing claim that, in the context of transcendental philosophy, conceptions of the subject as an isolated individual give rise to a vicious circle the resolution of which requires the introduction of a second rational being to ‘summon’ the first. In this essay, my aim is to present a revised account of (...) the opening arguments on which they are more convincing. In particular, I argue that the problem of a circle is genuine and may be seen to result from a relation of mutual dependence between agency and cognition which ensures that for an exercise of either capacity to take place, an exercise of the other would have already had to have taken place with the result that neither can occur. Moreover, the solution is successful. The summons prevents us from being driven around the circle once more because it is a ‘synthesis’ that reconciles the constraint to which I am subject as a cognizer of independently given objects and my freedom as a self-determining subject. This paper is a reading of Aristotle's book on justice (Book V of the Ethics) as what he says it is, a study of the disposition or inclination towards doing just (or unjust) acts. In that light, the content of Aristotle's famous treatments of distributive and corrective justice are only incidental, for their true role is as clues to a meaningful picture of the Just and the Unjust person. Aristotle's treatment of Being Just as a specific virtue is the most (...) detailed treatment he offers of any moral virtue. Being Just as distributive justice emerges as a commitment to the equal treatment of all citizens, but to an equality tempered by always contentious considerations of merited reward. Being Just as corrective justice is a commitment to protecting and repairing the sphere of each person's dignity and opportunity from damaging and sometimes malicious interactions. But more is required. For Being Just means overcoming the disordered and misdirected desire that both Aristotle and Plato call "pleonexia", wanting - tyrant-like - more-of-and-more-than. If that is overcome by re-directed libido, the virtuous will then have to integrate more subtle elements if they are to achieve an inclination to this tempered, but real equality. These elements are two. One is present only implicitly, the passion Aristotle calls nemesis, a demand that the world - and justice within the world - must never permit an evil person to go unpunished or a good one, to suffer harm. That passion cannot be admitted, but at best can only be temporarily stilled. The second impediment arises from the dynamic of human communities that are made up of diverse and actively striving individuals: such citizens, haunted by suspicion grounded in their own pleonexia, demand that the community be one of laws. That creates a true dilemma, for in Aristotle's estimation, no set of rules can cabin any virtue. The Rule of Law is in tension with the particularity of justice in real life, and that tension is ultimately only bearable through the invention of equity, the trusted deviation from the law to preserve the law. In making this abstract I have had to leave untouched the subject matter of the first and two last chapters, but in my paper I do treat these. More importantly, I also show how all political community and the inclination to seek to be a Just Person rests on a gracious act of reciprocal commitment. (shrink)

In these pages we seek to integrate two claims. First, we argue that, taken to their logical conclusions, the considerations that support a strict form of protection for tangible property rights do not call for a similar form of protection when applied to the case of copyright. More dramatically, these considerations demand, on pain of glaring inconsistency, a substantially weaker protection for copyright. In pursuing this claim, we show that the form of protecting property rights is, to an important extent, (...) a feature of certain normal, though contingent, facts about the human world. Second, the normative question concerning the selection of a desirable protection for creative works is most naturally pursued from a tort law perspective, in part because the normative structure of copyright law simply is that of tort law. What makes one individual’s experience vicarious is that it is both similar to, and caused by, another’s psychological state. Vicarious responses are mediated by the observation of another’s goal-directed or expressive action. While the evidence from cognitive neuroscience suggests the ubiquity of vicarious responses to others’ goals, intentions, sensations and emotions, the question is: is the general function of vicarious responses to understand another’s mind? In this paper, I argue for a dual view of the function of vicarious responses: while (...) empathetic responses are other-directed, contagious responses are self-centered. (shrink)
