The UK government has recently committed to adopting a new policy—dubbed ‘Martha’s Rule’—which has been characterised as providing patients the right to rapidly access a second clinical opinion in urgent or contested cases. Support for the rule emerged following the death of Martha Mills in 2021, after doctors failed to admit her to intensive care despite concerns raised by her parents. We argue that framing this issue in terms of patient rights is not productive, and should be avoided. Insofar as (...) the ultimate goal of Martha’s Rule is the provision of a clinical service that protects patient safety, an approach that focuses on the obligations of the health system—rather than the individual rights of patients—will better serve this goal. We outline an alternative approach that situates rapid clinical review as part of a suite of services aimed at enhancing and protecting patient care. This approach would make greater progress towards addressing the difficult systemic issues that Martha’s Rule does not, while also better engaging with the constraints of clinical practice. (shrink)

Over the past 50 years, postmodernism has been a progressively growing and influential intellectual movement inside and outside the academy. Postmodernism is characterised by rejection of parts or the whole of the Enlightenment project that had its roots in the birth and embrace of early modern science. While Enlightenment and ‘modernist’ ideas of universalism, of intellectual and cultural progress, of the possibility of finding truths about the natural and social world and of rejection of absolutism and authoritarianism in politics, philosophy (...) and religion were first opposed at their birth in the eighteenth century, contemporary postmodernism sometimes appeals to (and sometimes disdains) philosophy of science in support of its rejection of modernism and the enlightenment programme. Recent summaries of psychologist James H. Leuba's pioneering studies on the religious beliefs of American scientists have misrepresented his findings and ignored important aspects of his analyses, including predictions regarding the future of religion. Much of the recent interest in Leuba was sparked by Edward J. Larson and Larry Witham's commentary in Nature , “Scientists Are Still Keeping the Faith.” Larson and Witham compared the results of their 1996 survey of one thousand randomly selected American scientists regarding their religious (...) beliefs with a similar survey published eighty years earlier by Leuba. Leuba's original studies are themselves problematical. Nonetheless, his notion that different fields of science have different impacts on the religion‐science relationship remains valid. Especially significant is his appreciation of religion as a dynamic, compelling force in human life: any waning of traditional beliefs does not mean a decrease in religious commitment but calls for a new spirituality in harmony with modern scientific teachings. Leuba's studies, placed in proper context, offer a broad historical perspective from which to interpret data about religious beliefs of scientists and the impact of science and scientists on public beliefs, and opportunity to develop new insight into the religion‐science relationship. Drawing on Deleuze’s ‘Postscript on Control Societies’, our initial focus in this article will be on the role of institutions within societies of control, an analysis which brings Deleuze into the orbit of Ervin Goffman’s famous ethnographic work on total institutions. This cross-comparative analysis of Deleuze and Goffman will allow us to show how institutions of control function by sequencing ‘dividuals’ across institutional domains in a continual process of totalization. Inspired by James Williams’s recent work on the ‘process philosophy (...) of signs’, we then argue that a critique of totalizing institutions can be positively articulated as a process-oriented challenge to algorithmic technologies and as a counter-sequencing of institutional control. We conclude with some reflections on the emergent modes of resistance that challenge both institutional and technological control, and we will proffer criteria for assessing such practices in relation to the two-sided nature of critique they enact, both processual and counter-sequential. In the manuscript Idea philosophiae moralis, James Dundas, first Lord Arniston, a Presbyterian, a judge and a philosopher, makes extensive use of Stoic themes and authors. About one third of the manuscript is a close reading of Seneca. Dundas judges Stoicism from the perspective of Calvinism: the decisive complaint is that the Stoics are ‘prideful’ when they consider happiness to be within the grasp of fallen human reason. However, pride aside, Dundas is willing to recover some Stoic insights for (...) his Calvinist faith. In what ways? The promise of the practical rewards of Stoicism drives Dundas's interest in arguing that Stoicism can play a crucial psychological and moral contribution to a Christian's life. The investigation of Stoicism in the Idea philosophiae moralis sheds new light on the backdrop of the Scottish Enlightenment's relationship with Stoicism, commonly characterised as ‘Christian Stoicism’, as well as on the variety of the early modern Christian-Stoic syntheses, such as the Religio Stoici by George Mackenzie of Rosehaugh, a friend of Dundas's. Nearly four decades after David Raynor attributed to David Hume an allegorical Scots militia pamphlet from the early 1760s popularly known as Sister Peg, there is still no scholarly consensus about whether the author was in fact Hume or his friend Adam Ferguson. Using new evidence that has emerged since the appearance of Raynor’s edition in 1982 – including information about Sister Peg’s publication history, Ferguson’s handwritten corrections and revisions in the Abbotsford copy of the work, a 1767 newspaper article (...) by James Boswell and a copy of a 1775 letter by Sir John Dalrymple that both named Ferguson as the author, two volumes of Ferguson’s correspondence published in 1995, and a recently discovered letter by Ferguson from 1809 – this article seeks to resolve this controversy by establishing that Sister Peg was written by Ferguson, as his fellow militia agitator Alexander Carlyle asserted in his memoirs. In the process, the article refutes Raynor’s arguments about Ferguson’s supposed incapacity for writing a satirical pamphlet like Sister Peg and clarifies the nature of Hume’s views and actions in regard to the Scots militia cause during the Seven Years’ War. The article also throws light on several related issues affecting Hume and Ferguson’s circle. (shrink)

An important goal of ethical investment is to influence companies to improve their ethical and environmental performance. The principal means that many ethical funds employ is passive market signalling, which may not, on its own, have a significant effect. A much more promising approach may be active engagement. This paper reports on a questionnaire study of a sample of 1146 ethical investors in order to assess whether U.K. ethical investors would support more activist ethical investment and whether they would be (...) prepared to invest in companies which are failing ethically in order to do so. The results show general support for the current practice of passive signalling accompanied by "soft" engagement in the form of lobbying and the development of dialogue in order to improve corporate practice. The "harder" options of investing in companies that err in order to change them is, however, favoured by consistent minorities. (shrink)

James O. Young seeks to explain why we value music so highly. He draws on the latest psychological research to argue that music is expressive of emotion by resembling human expressive behaviour. The representation of emotion in music gives it the capacity to provide psychological insight--and it is this which explains a good deal of its value.

In “Genetic Privacy, Disease Prevention, and the Principle of Rescue,” Madison Kilbride argues that patients have a duty to warn biological family members about clinically actionable adverse genetic findings. The duty does not stem from the special obligations that we may have to family members, she argues, but rather follows from the principle of rescue, which she understands as the idea that one ought to prevent, reduce, or mitigate the risk of harm to another person when the expected harm is (...) serious and the cost or risk to oneself is sufficiently moderate. We doubt, however, whether the principle of rescue can ground a duty to warn in the cases Kilbride envisages, and we suggest that Kilbride may have underappreciated the role that special obligations could play in generating a duty to warn family members. In a rare opportunity, the authors gathered data from two matched health care providers managed by an insurance company where auditors had discovered theft by employees in one of the matched organizations. Data were gathered about the organizations' ethical work climates (EWCs). Analysis revealed statistically significant differences in EWCs across the two organizations. As predicted, the organization with the morally preferred EWCs did not have theft. Both macro- and micro-organizational influences are explored to explain these differences, along with implications for (...) practitioners and academic research. This is the first study to suggest that a priori EWCs can be useful in predicting observable behavior. (shrink)

Among the more significant developments of the twentieth century, the widespread attention given to 'rights issues' must surely justify ranking it somewhere near the top. Never before has the issue of rights attracted such a wide audience or stirred so much controversy. Until very recently 'rights' were traditionally recognized as attributable only to humans. Today, we increasingly are hearing a call to extend 'rights' to the nonhuman animal and, on occasion, to the environment. In this book, James B. Reichmann, (...) S.J., undertakes an investigation of the metaethical grounds of 'rights' theory, with special focus on the controversial issue of whether creatures other than humans can and should be considered true subjects of 'rights.' He contends that before assigning rights to this or that individual or group, whether human or not, we need to be very clear about what it is we are assigning, to whom, and why. The book argues forcefully that the various recent efforts to build a case supporting animal and environmental 'rights' fail in their quest, and that any such effort resting on a Darwinian evolutionary base is likewise condemned to fail. In furtherance of this claim the author first investigates life phenomena, followed by a detailed comparative study of knowing, communicating and doing, as these are observed in the human and the nonhuman animal. This in turn is followed by an overview of diverse views advanced by contemporary environmental ethicists and animal 'rights' advocates, including Peter Singer, Tom Regan, J. Baird Callicott, Laura Westra, and Don E. Marietta, Jr. Representative though doubtless provocative conclusions drawn from this study include the claims that: (1) Classic Darwinian theory provides no admissable premise from which to derive a theory of inherent, inalienable rights. (2) No satisfactory explanation of the origin of rights and obligation can derive save from within the context of natural law theory. (3) The human person alone unqualifiedly possesses rights. (4) The view that vegetarianism is an ethical mandate is neither compatible with the Christian world view, nor philosophically sound. ABOUT THE AUTHOR: James B. Recently there has been an outpouring of consumer frustration over rising food and energy prices. Many politicians railed against “speculators” who allegedly drove up the prices of key necessities. Is speculation unethical? This article reviews the traditional arguments against speculation. Many of the standard criticisms confuse speculation with gambling. In much the same way as ethicists now draw distinctions between usury and normal business interest, we draw a distinction between socially useful speculation and gambling. Gambling involves taking on risk with (...) no plausible expectation of making a profit. Gambling may provide entertainment value to some people, but like other addictive activities causes grave harm to a subset of users. Speculation involves taking on a business risk with a plausible expectation that a profit will result. Speculators provide an important risk bearing service by taking on risks that others do not want. They help markets to function better by helping to incorporate information into prices as well as providing liquidity. Speculators may actually reduce shortages by causing quicker price increases that motivate producers to increase production and consumers to conserve. But even socially useful speculation may have an ethical dark side. Does such speculation cause damage by adding excess volatility to prices? Speculators may contribute to price bubbles. At what point does legitimate speculation become odious “price gouging?” We also draw an ethical distinction between speculation, which seeks to benefit from changing prices, and manipulation, actions taken to push prices away from their economically appropriate levels. In conversation with James Ash, Pasi Väliaho discusses the relationship between video games, politics and the turn to affect for thinking about mediated experience. In doing so, both authors consider the promises and problematics of utilizing neuroscientific concepts for understanding modes of power that operate through the knots of image and sensation that make up contemporary media culture.

Although eighteenth-century Federalists, including James Madison, have been associated with the very contemporary idea of a transnational political order, the argument that the modern state with its centralised authority and supreme power poses a threat to liberty was already a subject of discussions during the period. The American Constitution was intended to establish a new political order, rather than a loose federation or an enlarged state. The Framers were not alone in their preoccupation with a transnational order; the German (...) philosopher Immanuel Kant struggled with the same issues of liberty and security in his political essays. This chapter examines how Madison and Kant grapppled with the problem of transnational order in the context of democracy and republicanism. It looks at the issues addressed by Kant and Madison that are closely related to those discussed today, including diversity, popular sovereignty and political violence. The chapter suggests that Kant and Madison, along with many other republicans of the time, explored the idea of government without resorting to the models of small-scale, ancient republics. (shrink)

By referring to the works of many major figures of the last century – Arendt, Boyer, Eisenstadt, Eliot, Gadamer, Goody, Hobsbawm, Kermode, Leavis, MacIntyre, Oakeshott, Pieper, Pocock, Popper, Prickett, Shils and others – I show that a theory of tradition must include insights taken not only from the study of sociology and anthropology, but also from the study of literature and (...) religion. The proliferation of separate academic subjects does not make it any less necessary for us to attempt to say in general what we are talking about when we talk about tradition. In this article I distinguish three elements which are found in traditions. I call these continuity, canon, and core. The argument is that traditions can be distinguished in terms of whether there is a core in addition to canon and continuity, a canon in addition to continuity, or only mere continuity. Together these form a theory of tradition which enables us to see what is necessary to all traditions and also what it is which distinguishes different types of tradition from each other. (shrink)

This work aligns James Buchanan’s theory of social contract with the structure of Michael Moehler’s multilevel social contract. Most importantly, this work develops Buchanan’s notions of moral community and moral order. It identifies moral community as the vehicle of escape from moral anarchy, where community is established upon a system of rules akin to James Buchanan’s first-stage social contract. Moral order establishes the baseline treatment of non-members by members of a moral community and also provides a minimum standard (...) for resolving disputes that are not resolved by the more robust social contract shared among community members. This work links the multilevel contract to polycentric social order, noting that polycentric systems may promote development of the moral order by enabling experimentation with and emulation of rules and rule systems made available by overlapping and adjacent institutions. These essays are concerned with developing a dialogue between humanism and historical materialism in human geography, and to demonstrate the creative tension which emerges through the mediation of their different frames of reference.

James McCosh considered his product of 'a labor of love', The Scottish Philosophy, Biographical, Expository, Critical, From Hutcheson To Hamilton to fall within 'what may be regarded as a new department of science, the history of thought'.' The value of the book lies, therefore, in not just its outlines of works of philosophers of the period with the views afforded of the academic life most of them led; but its sense-albeit unsure-that 'the Scottish school of philosophy' (1) after its (...) rise evolved into something less distinctive, more commonplace philosophically. McCosh could not admit that the school had declined. Noting the change, he barely hints at why it happened. The explanation, it will be argued, involves the central place assigned to belief in the doctrines of the school, so is of current interest given the undue prominence belief continues to be accorded by philosophers. Prosentential theorists claim that sentences such as “That’s true” are prosentences that function analogously to their better known cousins–pronouns. For example, just as we might use the pronoun ‘he’ in place of ‘James’ to transform “James went to the supermarket” into “He went to the supermarket,” so we might use the prosentenceforming operator ‘is true’ to transform “Snow is white” into “‘Snow is white’ is true.” According to the prosentential theory of truth, whenever a referring expression (for example, (...) a definite description or a quote-name) is joined to the truth predicate, the resulting statement contains no more content than the sentence(s) picked out by the referring expression. To assert that a sentence is true is simply to assert or reassert that sentence; it is not to ascribe the property of truth to that sentence. The prosentential theory is one kind of deflationary theory of truth. Like all deflationary theories, it provides an alternative to explanations of truth that analyze truth in terms of reference, predicate satisfaction or a correspondence relation. (shrink)

Our ability to survive in a world beset by looming global perils depends ultimately on our collective will to harness our intellects and change our behaviors. In order to respond appropriately, people must first believe that serious problems exist, that there are potential solutions, and that they have a role to play in finding and implementing them. Without such beliefs, individual change is unlikely. In order to promote belief change, it is important to understand how beliefs are learned, what their (...) functions are, and why they are so often resistant to change. These issues are discussed in this article, along with the role that social dilemmas play in inhibiting individually prosocial behavior. (shrink)
