An influential view in the ethics of self-defence is that causal responsibility for an unjust threat is a necessary requirement for liability to defensive harm. In this article, I argue against this view by providing intuitive counterexamples and by revealing weaknesses in the arguments offered in its favour. In response, adherents of the causal view have advanced the idea that although causally inefficacious agents are not liable to defensive harm, the fact that they may deserve harm can justify harming them (...) in the course of defending oneself. I argue that this strategy is ad hoc and leads to more problems than it solves. Once we allow normative facts outside our account of liability to affect a person's moral protection against harm, the lieability verdicts cannot tell us whether there is a relevant moral asymmetry between the victim and the target of defence. In conclusion, the causal view is wrong and causal responsibility for an unjust threat is not a necessary requirement for liability to defensive harm. (shrink)

Recent downward trends in corporate giving have renewed interest in the factors that shape corporate philanthropy. This paper examines the relationships between charitable contributions, firm size and industry. Improvements over previous studies include an IRS data base that covers a much broader range of firm sizes and industries as compared to previous studies and estimation using an instrumental variable technique that explicitly addresses potential simultaneity between charitable contributions and profitability. Important findings provide evidence of a cubic relationship between charitable giving (...) and firm size and evidence of strong industry effects. The plus-minus-plus regression coefficient sign pattern for the cubic firm size model suggests that small and large firms give more relative to total receipts with lower giving ratios among medium size firms. One interpretation for this finding is that small firms are close to the communities they serve while high visibility creates a need for large firm philanthropy. Strong industry effects provide evidence of inter-industry differences in giving culture and/or different public relations requirements across industries. (shrink)

The idea of public reason is central to political liberalism's aim to provide an account of the possibility of a just and stable democratic society comprised of free and equal citizens who nonetheless are deeply divided over fundamental values. This commitment to the idea of public reason reflects the normative core of political liberalism which is rooted in the principle of democratic legitimacy and the idea of reciprocity among citizens. Yet both critics and defenders of political liberalism disagree over whether (...) or not the idea of public reason permits citizens to appeal to their comprehensive conceptions of the good in public deliberation over matters of basic justice. Our aim in this paper is to provide a defense of an exclusive idea of public reason, and at the same time we aim to dispel the underlying concerns of two prominent criticisms of the idea of public reason—the concern of alienation from the political process, as expressed by religiously oriented critics, and the concern over women's equality, as expressed by feminist critics. We argue that inclusive accounts of the idea of public reason are not consistent with political liberalism's core commitments. Further, we claim, inclusive accounts of the idea of public reason deepen feminist concerns. We think that, properly understood, an exclusive account of the idea of public reason can address feminist concerns about political liberalism and avoid alienating (reasonable) religious persons in an unacceptable way. Thus, we conclude that an exclusive account of the idea of public reason is our best hope for reconciliation. (shrink)

Can and should political liberals recognize and otherwise support legal marriage as a matter of basic justice? In this article, we offer a general account of how political liberals should evaluate the issue of whether the legal recognition of marriage is a matter of basic justice. And, we develop and examine some public reason arguments that, given the fundamental interests of citizens, could justify various forms of legal marriage in some contexts. In particular, in certain conditions, the recognition of some (...) form of legal marriage may be the best way to protect the fundamental interests of women as citizens in freely chosen associations. Or, it may be that, in certain conditions, to secure the social conditions necessary for gays, lesbians and bisexuals to be free and equal citizens, some form of legal marriage can or should be recognized. We develop and test a model of pseudo-transformational leadership. Pseudo-transformational leadership is manifested by a particular combination of transformational leadership behaviors, and is differentiated from both transformational leadership and laissez-faire -leadership. Survey data from senior managers show differential outcomes of transformational, pseudo-transformational, and laissez-faire leadership. Possible extensions of the theoretical model and directions for future research are offered.

In this article, I highlight some core ideas that are important for understanding the parent-child relationship within the framework of political liberalism. I stress that, although some ideal or conception of the family is part of most, if not all, comprehensive doctrines, for political liberals, the state’s interest in the family is as a social-political institution in which certain needs of persons as free and equal citizens are met. I discuss the main needs and interests of children and parents in (...) the parent-child relationship. I consider that many children are cared for by multiple people, and I discuss how the state should address the recognition of multiple legal parents. I discuss some contexts in which conflicts arise between the interests of children and caregivers and address how such conflicts should be resolved in the politically liberal state. Although Rawls failed to offer an acceptable account of the family as part of the basic structure and did not adequately address the role of caring relationships in a just society, I hope that this article helps to show how political liberals can offer a plausible account. This book describes the adventures in Russia of Samuel Bentham, the brother of the famous law-reformer, Jeremy Bentham. Shipbuilder, technical expert and inventor, his talents were employed for several years in serving the government of Catherine II, involving him in activities both in peace and war, and in extensive travel through the Russian Empire. We agree with Penn et al. that our human cognitive superiority derives from our exceptional relational ability. We far exceed other species in our ability to grasp analogies and to combine relations into higher-order structures (Gentner 2003). However, we argue here that possession of an elaborated symbol system is necessary to make our relational capacity operational.

Psychoanalysis had a profound influence on formation of Merleau-Ponty’s thought. However, at the same time, he rejects Freud’s idea that the unconscious consists of latent mental contents that cause a certain type of behavior. Instead of a hidden experience, Merleau-Ponty argues that the unconscious is an ambiguous consciousness. In The Structure of Behavior and The Phenomenology of Perception, he specifies this ambiguity by means of the concepts of habit, bad faith, bodily expression, affective intentionality and body schema. In this paper, (...) I will present the interconnection of these aspects of the human existence, following Merleau-Ponty’s two early major works. Further, I will show the difference of Merleau-Ponty’s notion of bad faith from that of Sartre, and, finally, I will suggest a limitation of Merleau-Ponty’s approach to the unconscious. (shrink)

The feminization of agriculture narrative has been reproduced in development literature as an oversimplified metric of empowerment through changes in women’s labor and managerial roles with little attention to individuals’ heterogeneous livelihoods. Grounded in feminist political ecology, we sought to critically understand how labor and managerial feminization interact with changing agricultural practices. Working with a local NGO as part of an international, donor-funded research-for-development project, we conducted semi-structured interviews, focus group discussions, and participant observation with over 100 farmers in Mid-Western (...) Nepal in 2017. Household structure and headship are dynamic in the context of male out-migration, pushing women to take on new agricultural duties and increasing household labor responsibilities. In this context, decision-making processes related to agricultural management and new cultivation practices illustrate ongoing renegotiations of gender and cultivation practices within and beyond the household. We contend that the heterogeneity of household power dynamics muddies the empowering impacts of migration and emphasize the importance of community spaces as a locus of subjectivity formation and social value. We conclude that FPE can illuminate complexities of power, space, and individual responses to socio-ecological conditions that challenge the current feminization of agriculture framework. (shrink)

Is the history of philosophy one of philosophical disciplines? Should not one give up pursuing the traditional history of philosophy on behalf of the history of philosophical culture as a historical discipline? Considerable divergences in defining the history of philosophy and its relation to philosophy and history show profound differences in the views on philosophy itself. The differences are an essential part of the history of philosophy. This paper does not intend to give a critical assessment of all positions that (...) concern the relationship between the history of philosophy and philosophy. We shall address the issue of consequences of historicism that bear on the history of philosophy. The main negative point of reference will R. Rorty\'s standpoint, which is representative of the radical version of historicism. The American neo-pragmatist\'s manners of pursuing philosophy and the relations between them will be submitted to criticism. In the perspective of radical historicism (historical and cultural relativism) the inquiries on the history of philosophy have no strictly philosophical importance. They may be cognitively interesting only from the historical point of view, for the history of culture, to be precise. Moderate historicism does not mean acceptance for the relativistic theory of truth. It makes us reconsider the issue of the difference between true knowledge and adequate knowledge, the difference well-known in tradition. Overcoming radical historicism prepares grounds for the pursuit of the history of philosophy as a philosophical discipline, the discipline that studies the history of philosophical problems in their variability and permanence. Using the threat of a severe AIDS epidemic in a collection of rural villages in South Africa, we illustrate how men and women reconsider gendered sexualities through conversations and interactions in everyday life. We draw from data collected by local ethnographers and focus on the processes through which men and women collectively respond to the threat posed by AIDS to relationships, families, and communities. Whereas previous research has shown that individuals often reaffirm hegemonic norms about gender and sexuality in response (...) to disruptions to heteronormative gender relations, we find that the threat of AIDS provokes reconsideration of gendered sexualities at the community level. That is, our data demonstrate how men and women—through the interactions and exchanges that make up their daily lives—debate, challenge, make sense of, and attempt to come to terms with social norms circumscribing gendered sexual practices in a context where the threat of a fatal disease transmitted through sex looms large. We argue that ethnographic data are particularly useful for capturing communal responses to events that threaten heteronormative gender relations and reflect on how our findings inform theories of gender relations and processes. When we first anticipated the research project concluded with this special issue, about 8 years ago, it seemed timely and appropriate to investigate the opportunities and the challenges of self-management in mental health care. At the time self-management was well on the rise in general health care, offering both empowerment to patients and efficiency and cost-effectiveness to the health care system. It seemed a most promising approach in an era that celebrates individualistic self-reliance. And we were sure about our insight (...) that self-management in mental health care would deserve comprehensive investigation because “the self” that was supposed to do the management would itself be the core problem in psychiatric... This introduction to the special issue “Comparative Politics of Colonialism and Its Legacies” surveys recent literature in political science, sociology, and economics that addresses colonial state building and colonial legacies. Past research has made important contributions to our understanding of colonialism’s long-term effects on political, social, and economic development. Existing work emphasizes the role of critical junctures and institutions in understanding the transmission of those effects to present-day outcomes and embraces the (...) idea of design-based inference for empirical analysis. The four articles of this special issue add to existing research but also represent new research trends: increased attention to the internal dynamics of colonial intervention; noninstitutional transmission mechanisms; the role of context conditions at times of colonial intervention; and a finer-grained disaggregation of outcomes, explanatory factors, and units of analysis. My goal in this essay will be to show, contra Parfit, that the separateness of human persons—although metaphysically shallow—has a moral significance that should not be overlooked. Parfit holds that his reductionist view of personal identity lends support to consequentialism; I reject this claim because it rests on the assumption that the separateness of human persons has an arbitrariness that renders it morally insignificant. This assumption is flawed because this separateness is grounded in our 'person practices', which reflect some of (...) the morally relevant aspects of our nature: if we imagine a species of person whose members are not naturally separate from each other, it is reasonable to suppose that the morality of this different species of person would be drastically different from human morality. Thus, if consequentialists aim to offer a human moral theory, they overlook the separateness of human persons with peril. (shrink)

AGAINST THE BACKGROUND OF VARIOUS EUROPEAN LEGISLATIVE INITIAtlves dealing with medical-ethical decisions at the end of life and an introduction on the Belgian "Act on Euthanasia," in the first part of this essay I present a concise comparison between the Belgian law and the provisions of Dutch legislation. In the second part of the essay I aim at a better understanding of the Belgian legislation by documenting two opportunities that might have enhanced the outcome by addressing the complexity of end-of-life (...) decisions and the proper position of palliative care. I offer some preliminary conclusions in light of the implementation of the law in Catholic institutions as well as its first official evaluation. (shrink)

The purpose of this note is to show that the independence results for sharply bounded arithmetic of Takeuti [4] and Tada and Tatsuta [3] can be obtained and, in case of the latter, improved by the model-theoretic method developed by the author in [2].

This paper deals with the interrelationship between causal explanation and methodology in a relatively young discipline in biology: epigenetics. Based on cases from molecular and ecological epigenetics, I show that James Woodward’s interventionist account of causation captures essential features about how epigeneticists using highly diverse methods, i.e. laboratory experiments and purely observational studies, think about causal explanation. I argue that interventionism thus qualifies as a useful unifying explanatory approach when it comes to cross-methodological research efforts. It can act as a (...) guiding rationale (i) to link causal models in molecular biology with statistical models derived from observational data analysis and (ii) to identify test-criteria for reciprocal transparent studies in different fields of research, which is a shared issue across the sciences.Este artículo trata de la relación entre explicaciones causales y metodología en una disciplina biológica relativamente joven, la epigenética. Basándome en casos de la epigenética molecular y ecológica, muestro que la concepción intervencionista de la causalidad desarrollada por James Woodward capta algunos rasgos esenciales del modo en que los epigenetistas conciben la explicación causal usando métodos sumamente diversos: e.g., experimentos de laboratorio o estudios observacionales. Defiendo que el intervencionismo es útil como aproximación unificadora a la explicación cuando se trata de empresas investigadoras transdisciplinares. Puede servir como guía para (i) conectar los modelos causales en biología molecular con los modelos estadísticos derivados del análisis de datos observacionales y (ii) para identificar criterios de prueba para estudios recíprocos en diferentes ámbitos de investigación, un problema de interés común en diferentes ciencias. This paper 1 explores the potential of ‘new nature writing’ – a literary genre currently popular in the UK – as a kind of arts activism, in particular in terms of how it might engage with the environmental crisis and lead to a kind of collective politics. We note the limitations of the genre, notably the reproduction of class, gender and ethnic hierarchies, the emphasis on nostalgia and loss, and the stress on individual responses rather than collective politics. But we (...) also take seriously the claims of art to enable us to imagine other futures, suggesting that new nature writing has the potential to play a role in collective forms of environmental justice and capabilities.
