In three studies, factors influencing the incidence of fraudulent financial reporting were assessed. We examined (1) the effects of personal values and (2) codes of corporate conduct, on whether managers misrepresented financial reports. In these studies, executives and controllers were asked to respond to hypothetical situations involving fraudulent financial reporting procedures. The occurrence of fraudulent reporting was found to be high; however, neither personal values, codes of conduct, nor the interaction of the two factors played a significant role in fraudulent (...) financial reporting. Functionalism in the philosophy of mind is the doctrine that what makes something a mental state of a particular type does not depend on its internal constitution, but rather on the way it functions, or the role it plays, in the system of which it is a part. This doctrine is rooted in Aristotle's conception of the soul, and has antecedents in Hobbes's conception of the mind as a “calculating machine”, but it has become fully articulated (and popularly endorsed) only (...) in the last third of the 20th century. Though the term ‘functionalism’ is used to designate a variety of positions in a variety of other disciplines, including psychology, sociology, economics, and architecture, this entry focuses exclusively on functionalism as a philosophical thesis about the nature of mental states. This study investigated effects of codes of ethics on perceptions of ethical behavior. Respondents from companies with codes of ethics (n = 465) rated role set members (top management, supervisors, peers, subordinates, self) as more ethical and felt more encouraged and supported for ethical behavior than respondents from companies without codes (n = 301). Key aspects of the organizational climate, such as supportiveness for ethical behavior, freedom to act ethically, and satisfaction with the outcome of ethical problems were impacted by (...) the presence of an ethics code. The mere presence of a code of ethics appears to have a positive impact on perceptions of ethical behavior in organizations, even when respondents cannot recall specific content of the code. The formal semantics that we have proposed for definite and indefinite descriptions analyzes them both as variable-binding operators and as referring terms. It is the referential analysis which makes it possible to account for the facts outlined in Section 2, e.g. for the purely ‘instrumental’ role of the descriptive content; for the appearance of unusually wide scope readings relative to other quantifiers, higher predicates, and island boundaries; for the fact that the island-escaping readings are always equivalent to maximally wide scope (...) quantifiers; and for the appearance of violations of the identity conditions on variables in deleted constituents. We would emphasize that this is not a random collection of observations. They cohere naturally with each other, and with facts about other phrases that are unambigously referential.We conceded at the outset of this paper that the referential use of an indefinite noun phrase does not, by itself, motivate the postulation of a referential interpretation. Our argument has been that the behavior of indefinites in complex sentences cannot be economically described, and certainly cannot be explained, unless a referential interpretation is assumed. It could be accounted for in pragmatic terms only if the whole theory of scope relations and of conditions on deletion could be eliminated from the semantics and incorporated into a purely pragmatic theory. Background: Complex and expensive treatment options have increased the frequency and emphasis of ethical decision-making in healthcare. In order to meet these challenges effectively, we need to identify how nurses contribute the resolution of these dilemmas. Aims: To identify the values, beliefs and contextual influences that inform decision-making. To identify the contribution made by nurses in achieving the resolution of ethical dilemmas in practice. Design: An interpretive exploratory study was undertaken, 11 registered acute care nurses working in a district general (...) hospital in England were interviewed, using semi-structured interviews. In-depth content analysis of the data was undertaken via NVivo coding and thematic identification. Participants and context: Participants were interviewed about their contribution to the resolution of ethical dilemmas within the context of working in an acute hospital ward. Participants were recruited from all settings working with patients of any age and any diagnosis. Ethical considerations: Ethical approval was obtained from the local National Research Ethics Committee. Findings: Four major themes emerged: ‘best for the patient’, ‘accountability’, ‘collaboration and conflict’ and ‘concern for others’. Moral distress was also evident in the literature and findings, with moral dissonance recognised and articulated by more experienced nurses. The relatively small, single-site sample may not account for the effects of organisational culture on the results; the findings suggested that professional relationships were key to resolving ethical dilemmas. Discussion: Nurses use their moral reasoning based on their beliefs and values when faced with ethical dilemmas. Subsequent actions are mediated though ethical decision-making frames of reference including deontology, consequentialism, the ethics of care and virtue ethics. Nurses use these in contributing to the resolution of these dilemmas. Nurses require the skills to develop and maintain professional relationships for addressing ethical dilemmas and to engage with political and organisational macro- and micro-decision-making. Conclusion: Nurses’ professional relationships are central to nurses’ contributions to the resolution of ethical dilemmas. (shrink)

Philosophers have traditionally held that claims about necessities and possibilities are to be evaluated by consulting our philosophical intuitions; that is, those peculiarly compelling deliverances about possibilities that arise from a serious and reflective attempt to conceive of counterexamples to these claims. But many contemporary philosophers, particularly naturalists, argue that intuitions of this sort are unreliable, citing examples of once-intuitive, but now abandoned, philosophical theses, as well as recent psychological studies that seem to establish the general fallibility of intuition.In the (...) first two sections of this paper, I evaluate these arguments, and also the counter-arguments of contemporary defenders of tradition. In the next two sections, I sketch an alternative account of the role of philosophical intuitions that incorporates elements of traditionalism and naturalism - and defend it against other such views. In the final section, however, I discuss intuitions about conscious experience, and acknowledge that my view may not extend comfortably to this case. This may seem unfortunate, since so much contemporary discussion of the epistemology of modality seems motivated by worries about the mind-body problem, and informed by the position one wishes to endorse. But, as I argue, if conscious experience is indeed an exception to the view I suggest in this paper, it is an exception that proves - and can illuminate - the rule. (shrink)

In this paper I discuss the claim that the successful reduction of qualitative to physical states requires some sort of intelligible connection between our qualitative and physical concepts, which in turn requires a conceptual analysis of our qualitative concepts in causal-functional terms. While I defend this claim against some of its recent critics, I ultimately dispute it, and propose a different way to get the requisite intelligible connection between qualitative and physical concepts.

Molyneux's Question, that is, “Suppose a man born blind, and now adult, and taught by his touch to distinguish between a cube and a sphere... and the blind man made to see: Quaere, whether by his sight, before he touched them, he could now distinguish, and tell, which is the globe, which the cube”, was discussed by many theorists in the 17th and 18th centuries, and has recently been addressed by contemporary philosophers interested in the nature, and identity conditions, of (...) perceptual concepts. My main concern in this paper is to argue – against Evans, Campbell, and a number of other contemporary philosophers – that a test of the sort Molyneux envisioned, at least if carefully designed and administered, can indeed be a crucial experiment for the claim that we deploy the same perceptual concepts when identifying shapes by sight and by touch. I will explore some implications of this argument for a theory of recognitional concepts. And I’ll try to trace out some unhappy consequences of various alternative views. (shrink)

This new book integrates material drawn from a variety of sources – feminist theory, cultural and literary analysis, sociology and art history – in an original discussion of women′s relationship to modern and post–modern culture. The essays in the book challenge the continuing separation of sociological from textual analysis in cultural (and feminist) theory and enquiry. They address critically the question of women′s writing, exploring the idea that women may begin to define their own lives and construct their identities in (...) a patriarchal culture through the very process of writing. Contrary to Vaesen's argument that humans are unique with respect to nine cognitive capacities essential for tool use, we suggest that although such cognitive processes contribute to variation in tool use, it does not follow that these capacities arenecessaryfor tool use, nor that tool use shaped cognition per se, given the available data in cognitive neuroscience and behavioral biology.

In recent years, functionalism has emerged as the most appealing candidate for a materialistic theory of mind. Its central thesis - that types of mental states can be defined in terms of their causal and counterfactual relations to the sensory stimulations, other internal states, and behavior of the entities that have them - offers hope for a reasonable materialism: it promises type-identity conditions for beliefs, sensations, and emotions that are not irreducibly mental, yet would permit entities that are physically quite (...) different to be in mental states of the same type. Feminism, poststructuralism, postcolonialism, and Marxism, among other critical approaches, have undermined traditional notions of aesthetics in recent decades. But questions of aesthetic judgment and pleasure persist, and many critics now seek a "return to aesthetics" or a "return to beauty." Janet Wolff advances a "postcritical" aesthetics grounded in shared values that are negotiated in the context of community. She relates this approach to contemporary debates about a committed politics similarly founded on the abandonment of certainty. Neither universalist nor relativist, (...) the "aesthetics of uncertainty" provides a discourse on beauty that contemporary critics can engage with and offers a basis for judgment that is committed to assigning value to works of art. Wolff explores her position through a range of topics: the question of beauty in relation to feminist critique; the problematic status of twentieth-century English art, visual representations of the Holocaust, Jewish identity as portrayed by the artist R. B. Kitaj, refugee artists and modernism in 1940s Britain, and the nature and appeal of imagistic thinking in sociology. She addresses the desire for certainty and the timeliness of doubt and concludes with a meditation on the intersection of aesthetics and ethics, arguing that ethical issues are very much implicated in aesthetic discourse. Background: Evolving technology and scientific advancement have increased the chances of survival of the extremely premature baby; however, such survival can be associated with some severe long-term morbidities. Research question: The research investigates the caregiving and ethical dilemmas faced by neonatal nurses when caring for extremely premature babies (defined as ≤24 weeks’ gestation). This article explores the issues arising for neonatal nurses when they considered the philosophical question of ‘what if it was me and my baby’, or what they believed (...) they would do in the hypothetical situation of going into premature labour and delivering an extremely premature baby. Participants: Data were collected via a questionnaire to Australian neonatal nurses and semi-structured interviews with 24 neonatal nurses in New South Wales, Australia. Ethical considerations: Relevant ethical approvals have been obtained by the researchers. Findings: A qualitative approach was used to analyse the data. The theme ‘imagined futures’ was generated which comprised three sub-themes: ‘choice is important’, ‘not subjecting their own baby to treatment’ and ‘nurses and outcome predictions’. The results offer an important and unique understanding into the perceptions of nursing staff who care for extremely premature babies and their family, see them go home and witness their evolving outcomes. The results show that previous clinical and personal experiences led the nurses in the study to choose to have the belief that if in a similar situation, they would choose not to have their own baby resuscitated and subjected to the very treatment that they provide to other babies. Conclusion: The theme ‘imagined futures’ offers an overall understanding of how neonatal nurses imagine what the life of the extremely premature baby and his or her family will be like after discharge from neonatal intensive care. The nurses’ past experience has led them to believe that they would not want this life for themselves and their baby, if they were to deliver at 24 weeks’ gestation or less. (shrink)

A working party of academics from both professional safeguarding backgrounds and research backgrounds developed and wrote ethical guidelines on safeguarding children in research on behalf of their faculty research ethics committee. The working party encountered a lack of useful precedents while developing the guidelines leading to a lengthy process of debate and consideration of the issues. This paper explores the various issues and dilemmas arising during this process, particularly the tension between safeguarding children from abuse and maintaining research confidentiality. One (...) of the main areas of discussion was how to establish the limits of confidentiality without compromising the research in hand. The role and responsibilities of researchers in supporting children's welfare, and the development of procedures for ensuring that safeguarding is effective are discussed as key elements. In addition, the issues researchers may face when determining thresholds for intervention are considered alongside the uncertainties created by considerations of the extent to which children can give informed consent in research contexts. The paper reflects the process of considering these issues and the conclusions the working party drew as to how best to support children's welfare during research. It also outlines the key elements of the guidelines and the structures developed to ensure researchers could get advice if suspected child abuse became an issue in their research. The paper includes a short version of the guidelines which were eventually approved across the Higher Education Institute. (shrink)

This paper discusses a number of recent criticisms of ‘theoretical’ accounts of mental state concepts—that is, accounts which take these concepts to derive their meanings from the roles played by mental states in the explanation of behavior: in particular, I evaluate the claim that (insofar as they are ‘third‐personal’ or ‘theoretical’) these concepts cannot individuate mental states that intuitively are distinct, and the claim that they cannot account for what goes on in the ascription of mental states to oneself. I (...) argue (with reference to what may be the originating text of this approach to mental state concepts, Sellars’s ‘Empiricism and the Philosophy of Mind’) that, although these criticisms may have some plausibility when directed against theoretical accounts of experiential or qualitative states, they have little plausibility when directed against theoretical accounts of intentional states. In so arguing, moreover, I try to show the shortcomings of various recent ‘first‐person’ or ‘subjectivist’ views. (shrink)

There is now a wealth of information that histone proteins play a primary role in the structural and transcriptional properties of chromatin, the protein‐DNA complex which constitutes the eukaryotic genome1, 2. In light of the crucial role of histones in cellular function, it is not surprising that their structural genes are found to be controlled in conjunction with the cell cycle, with the synthesis of most histones tightly coupled to nuclear DNA replication. The evidence suggests that this linkage between DNA (...) replication and histone synthesis involves the regulated adjustment of histone mRNA levels through both transcriptional and posttranscriptional control process. The possible mechanisms underlying these diverse control processes are described here. (shrink)

This article investigates the maps of the moon produced in the mid-seventeenth century by Jesuit Giambattista Riccioli and Johannes Hevelius, whose cartographic projects competed for widespread acceptance. Although Hevelius’s Selenographia was applauded for its many detailed, self-engraved pictures of the moon, his cartography and proposed nomenclature were supplanted by Riccioli’s as offered in Almagestum novum, in spite of the latter’s simplistic pictures and promotion of geocentric cosmology. Exploring this paradox through pictorial analysis, three types of images common to both Selenographia (...) and Almagestum novum are compared, employing an analytical tool developed by Svetlana Alpers in The art of describing. A focus on this debate exposes the tensions evoked by new technologies of vision and competing cultures of visual epistemology in seventeenth-century astronomy. As both selenographers grappled with questions about the role of representation and what kinds of knowledge could be generated visually, the successes and failures of their competing projects present implications for the course of visual astronomy, as well as for our understanding of the use of ‘visual technologies’ in a period of controversy.Keywords: Johannes Hevelius; Giambattista Riccioli ; Svetlana Alpers; Astronomy; Early modern; Moon maps; Visual culture; Images in science. A segunda metade do século xx ficou profundamente marcada pela configuração de um novo diálogo com a natureza, o que aconteceu sobretudo mediante a introdução de um novo modo de ver as coisas centrado no reconhecimento da complexidade e do acaso como elementos constitutivos da realidade. Nesse sentido, o presente artigo tem por objectivo proceder a uma exposição dos princípios fundamentais desta emergente perspectiva, à qual se dá o nome de paradigma da complexidade, paradigma este que nasce a partir do (...) próprio seio das lacunas inerentes ao paradigma clássico de matriz newtoniana. Mostra-se também como até muito recentemente a ciência foi incapaz de dar atenção a aspectos como a não linearidade ou a assimetria temporal características dos processos próprios dos sistemas abertos e interactuantes com o meio circundante, como é o caso dos organismos vivos, ou seja, daqueles processos que dão propriamente sentido à temporalidade do tempo. A autora mostra ainda até que ponto este novo prisma, ou modo de ver as coisas, que impregna todas as disciplinas, requer novos instrumentos para abordar a realidade de forma qualitativa, exigência esta que, naturalmente, haveria de dar lugar a novos conceitos. Em suma, o artigo defende que o reconhecimento da complexidade do real nos impõe uma nova abertura à interdisciplinaridade e, não menos, a uma nova visão do mundo, uma, precisamente, em que este não aparece como um mero agregado de partes, mas sim como uma rede na qual tudo está interconectado e em contínua transformação. /// The second half of the 20 th -Century points towards a new dialogue with nature under a view that recognizes complexity and fate as constituent elements of reality. In this sense, the present article explains some of the basic principles underlying this new understanding of the world, which goes here by the name of complexity s paradigm, one that is born out of the hollows of the classical newtonian paradigm. At stake are issues like non-linearity or temporary asymmetry which distinguish living creatures as open and interactive systems, and give sense to the concept of time, even though until very recently science has not given enough attention to such concepts. But it is also shown how this new paradigm is pervasive across all the disciplines, whereby it requires new instruments to analyze the qualitative dimension of the real. Finally, the author of the article also claims that the acknowledgement of such complexity of the real presupposes an opening of the minds to interdisciplinary and to a vision of the world in which the real is not seen as a mere addition of pieces, but in which each portion of the real is seen in connection with everything else and as being in constant transformation. Evolving Clinical Ethics: A Working UnConference, held 5 through 7 February 2020 in Houston, Texas, brought together 91 participants from a variety of institutions, many of whom are engaged in clinical ethics work. The event followed the success of the first Clinical Ethics UnConference hosted by the Cleveland Clinic Center for Bioethics in 2018, and offered an opportunity for ethicists to share both their challenges and their solutions to clinical ethics issues. In this article we explore the emerging themes of (...) the second UnConference and identify the top 10 questions currently faced by the field. We address both unresolved issues and areas of agreement and highlight new collaborations that have been developed to work toward greater standardization in our field. (shrink)
