The Sentimental Life of International Law is about our age-old longing for a decent international society and the ways of seeing, being, and speaking that might help us achieve that aim. This book asks how international lawyers might engage in a professional practice that has become, to adapt a title of Janet Malcolm's, both difficult and impossible. It suggests that international lawyers are disabled by the governing idioms of international lawyering, and proposes that they may be re-enabled by (...) speaking different sorts of international law, or by speaking international law in different sorts of ways. In this methodologically diverse and unusually personal account, Gerry Simpson brings to the surface international law's hidden literary prose and offers a critical and redemptive account of the field. He does so in a series of chapters on international law's bathetic underpinnings, its friendly relations, the neurotic foundations of its underlying social order, its screened-off comic dispositions, its anti-method, and the life-worlds of its practitioners. Finally, the book closes with a chapter in which international law is re-envisioned through the practice of gardening. All of this is put forward as a contribution to the project of making international law, again, a compelling language for our times. (shrink)

The realism/antirealism controversy has gone on for centuries, and gives every indication that it will continue to go on for centuries. Dismayed, I take a closer look at it. I find that the question it poses--very roughly, whether scientific knowledge is true (approximately true, put forward as true, etc.) or only useful (empirically adequate, a convenient method of representation, etc.)--actually suppresses socially critical thought and discussion about science (e.g., concerning whether scientific knowledge is sexist or racist or socially harmful in (...) other ways, or whether scientific knowledge is useful for achieving the goals we have or the goals we ought to have). I find, as well, that two of the most important responses to the realism/antirealism controversy--that which construes it as concerned with science's aims and that which construes it as concerned with science's results--fail to make sufficient empirical or normative contact with science. As a consequence, they provide representations of science that either do not help scientists (or nonscientists) make informed decisions about science, or actually hinder these individuals from doing so. I conclude that we should either stop engaging in the realism/antirealism controversy entirely, or else engage in it in a more socially responsible way--by gathering the right kinds of empirical and normative data, and framing more helpful versions of the questions we want to ask. I end by responding to the strong objections sure to be voiced by my colleagues in philosophy of science. (shrink)

Two decades of critique have sensitized historians and philosophers of science to the inadequacies of conventional dichotomies between theory and practice, thereby prompting the search for new ways of writing about science that are less beholden than the old ways to the epistemological mores of theoretical physics, and more faithful to the actual practices not only of physics but of all the natural sciences. The need for alternative descriptions seems particularly urgent if one is to understand the place of theory (...) in contemporary molecular biology, a science where, until now, no division between theory and experiment has obtained, and where distinctions between representing and intervening, and more generally, between basic and applied science, are daily becoming more blurred.Indeed, the very division between theory and experiment threatens to slight the extensive and sophisticated theoretical analyses on which experimental work in contemporary molecular biology so often depends. My aim in this paper is to find a way of talking about theoretical practices in biology that is directly rooted in the mix of conceptual and material work that biologists do. As an example of such theoretical practices, I choose for the focus of my analysis the development of a model for gene regulation out of the experimental work of Eric Davidson and his colleagues at Cal Tech. In this paper I discuss the claim that the successful reduction of qualitative to physical states requires some sort of intelligible connection between our qualitative and physical concepts, which in turn requires a conceptual analysis of our qualitative concepts in causal-functional terms. While I defend this claim against some of its recent critics, I ultimately dispute it, and propose a different way to get the requisite intelligible connection between qualitative and physical concepts.

ArgumentSeveral recent works in sociology examine the manufacture of public identities through the notion of celebrity. This paper explores the imagery of Charles Darwin as a nineteenth-century scientific celebrity by comparing the public character deliberately manufactured by Darwin and his friends with images constructed by the public as represented here by caricatures in humorous magazines of the era. It is argued that Darwin’s outward persona drew on a subtle tension between public and private. The boundaries between public and private were (...) blurred by the ritual of Darwin “showing” himself in the flesh, either at home to visitors or, more rarely, on public occasions. The reputation for privacy and illness that he built up added materially to this public face. By contrast, caricatures tended to depict him as an ape. These apish representations played a significant role in associating Darwin, rather than any other thinker, with the notion of evolution, and in creating an alternative public persona over which he had no direct control. The main message of Philosophy of Science after Feminism is twofold: that philosophy of science needs to locate science within its wider societal context, ceasing to analyze science as if it existed in a social/political/economic vacuum; and correlatively, that philosophy of science needs to aim for an understanding of scientific rationality that is appropriate to that context, a scientific rationality that integrates the ethical with the epistemic. The ideal of socially responsible science that the book puts forward, in fact, maintains (...) that sound social values as well as sound epistemic values must control every aspect of the scientific research process, from the choice of research questions to the communication and application of results. And it is this that raises troubling questions for Matt Brown, Hugh Lacey, and Libby Potter. In this paper I attempt to answer their questions and make explicit exactly what is in the offing if I succeed. (shrink)

A recent study published in Nature Neuroscience purports to have answered a question posed to Locke in 1688 by his friend William Molyneux, namely, whether ‘a man born blind and made to see’ would be able to identify, immediately and by vision alone, objects previously known only by touch. The answer, according to the researchers – and as predicted by Molyneux, as well as Locke, Berkeley, and others – is ‘likely negative. The newly sighted subjects did not exhibit an immediate (...) transfer of their tactile shape knowledge to the visual domain’. Since then, however, many commentators have argued that the answer is still not clear. Moreover, in the contemporary literature on Molyneux’s Question, and more generally on cross-modal perception and the individuation of the senses, it is sometimes hard to determine what question is being investigated. Although Ainslie dismisses the hot/cool framework as pertaining only to suppression, it actually also has interesting implications for resolve. Resolve focally involves access to our future selves. This access is a cool system function linked to episodic memory. Thus, factors negatively affecting the cool system, such as stress, are predicted to impact two seemingly unrelated capabilities: willpower and episodic memory.

This article investigates conceptual and strategic relationships between corporate identity, organizational identity and ethics, utilizing the Benetton Corporation as an illustrative case study. Although much attention has been given to visual aspects of Benetton's renowned ethical brand building efforts, few studies have looked at how Benetton's employees, retail environments and trade events express ethical aspects of their well-known corporate identity. A multi-method case study, including interviews at retail outlets and trade events, sheds light on several important yet under-studied components of (...) corporate identity, including stakeholders such as retail managers and contract employees. Analysis of Benetton's operations revealed disconnection and inconsistency, as well as a failure to communicate ethical values and socially responsible attributes throughout organizational identity. Operational identity emerged as a useful complement to models of corporate identity. We demonstrate the way in which organizations may fail to capitalize on positive aspects of their organizational identity by neglecting their operational identity. (shrink)

The skills involved in contributing competently in workplace interaction include enacting attentive listenership and providing appropriate feedback to the talk of others. These sociopragmatic skills are often overlooked, and when non-native-like listener feedback does attract attention, cultural differences are commonly cited to account for differences observed. In this paper, we analyse data from recordings made by Chinese skilled migrants in New Zealand workplaces, focussing on their interactions with New Zealand mentors in authentic workplace encounters. We examine the range, frequency and (...) placement of minimal audible feedback in their workplace talk, including a discussion of repetition and collaborative completions. The analysis provides evidence that overall, these learners have acquired appropriate norms for listenership in the New Zealand workplace contexts in which they have been placed, and supports an explanation which focuses on the negotiation and development of interactional norms in the process of joining a new social group. Self-injury is a perilous and increasingly common behavior that is particularly prevalent among youth. Nonetheless, there is a deep-rooted public stigma towards people who self-injure. Consequently, people who engage in self-injury are reluctant to seek professional help or disclose their experiences to others. This article aims to combat stigma and promote help-seeking behavior by debunking the common myths surrounding self-injury in the Malaysian context. Specifically, this article aims to serve as an eye-opener for Malaysian counselors and other mental health professionals (...) to improve their multicultural knowledge, skills, and attitudes when working with those who self-injure. BackgroundMedical researchers in resource-constrained settings must make difficult moral decisions about the provision of ancillary care to participants where additional healthcare needs fall outside the scope of the research and are not provided for by the local healthcare system. We examined research stakeholder perceptions and experiences of ancillary care in biomedical research projects in Malawi. MethodsWe conducted 45 qualitative in-depth interviews with key research stakeholders: researchers, health officials, research ethics committee members, research participants and grants officers from international research funding (...) organisations. Thematic analysis was used to analyse and interpret the findings. FindingsAll stakeholders perceived the provision of ancillary care to have potential health benefits to study participants in biomedical research. However, they also had concerns, particularly related to the absence of guidance to support it. Some suggested that consideration for ancillary care provision could be possible on a case-by-case basis but that most of the support from research projects should be directed towards strengthening the public health system, emphasising public good above individual or personal benefits. Some researchers and ethics committee members raised concerns about potential tensions in terms of funding, for example balancing study demands with addressing participants’ additional health needs.ConclusionOur findings highlight the complexities and gaps in the guidance around the provision of ancillary care in Malawi and other resource-constrained settings more generally. To promote the provision of ancillary care, we recommend that national and international guidelines for research ethics include specific recommendations for resource-constrained settings and specific types of research. Only two of the many experiments described by Smith et al., as indicating metacognitive ability in nonhuman animals, involved metacognition as understood in the human literature. Of these, one gave negative results. In the other, one of two rhesus monkeys provided data suggesting that he might have metacognitive ability. The conjecture that any nonhuman animals have metacognitive ability is, therefore, tenuous.

This paper explores why ethical issues associated with mental illness have been generally neglected in the literature and texts of the discipline of bioethics. I argue that the reasons for this are both philosophical and structural, involving the philosophical framework of principlism in bioethics, in particular the privileging of the principle of autonomy, and the institutional location and disciplinary boundaries of bioethics as a profession. Other contributing factors include developments outside of bioethics, in medicine and law and in the delivery (...) patterns and funding sources of mental health services, and above all the pervasive stigma that attaches to mental illness. My goal is to show both how the attention bioethics could bring would benefit this neglected area of health care, and why attending to the issues surrounding mental illness would benefit bioethics in meeting its professional obligations as the public voice on matters of ethical significance in health care. I consider a way the concept of causation could be excised from chemical practice, suggested by Kitcher's view that causes are just a subset of unifying patterns which play a particular psychological role for us. Kitcherian chemistry is at first blush well equipped to handle explanatory tasks. However, it would force chemists to accept certain unifying patterns as explanatory, which they do not think are at all explanatory. This might head off some descriptive lines of enquiry and damage prospects for (...) the identification of potentially larger‐scale explanations. More important than this, to chemists, it could put them off from finding the explanatory patterns that are true—true because they get at the real structure of the chemical phenomena in the world. In this paper we argue that one-way quantum computation can be seen as a form of phase transition with the available information about the solution of the computation being the order parameter. We draw a number of striking analogies between standard thermodynamical quantities such as energy, temperature, work, and corresponding computational quantities such as the amount of entanglement, time, potential capacity for computation, respectively. Aside from being intuitively pleasing, this picture allows us to make novel conjectures, such as an estimate (...) of the necessary critical time to finish a computation and a proposal of suitable architectures for universal one-way computation in 1D. The objective of the study was to explore parental experiences of being offered participation in a previous neonatal research study involving venepuncture. The method employed was a questionnaire-based exploration of parents' attitudes in those approached to participate in a study of term and preterm immunization responses (Preterm Immunisation Study [PREMIS]). We explored experience of the initial approach, knowledge of study, venepuncture and views on research ‘in general’. In all, 59% of families responded. Highest response rates were for those participating in (...) PREMIS (87% term/69% preterm) and lowest in decliners (34% and 35%). Responding parents participating in PREMIS were well informed, positive about research and did not find the venepuncture problematic. Sixty percent of responding parents who declined PREMIS attributed their declining to the need for venepuncture. In conclusion, parents participating or declining a neonatal study involving venepuncture are different, but participating parents were well informed and seemed able to judge that participation was right for them such that in consenting families venepuncture itself is not problematic. The assembly of the major small nuclear ribonucleoprotein (snRNP)d̊ particles begins in the cytoplasm where large pools of common core proteins are preassembled in several RNA‐free intermediate particles. Newly synthesized snRNAs transiently enter the cytoplasm and complex with core particles to form pre‐snRNP particles. Subsequently, the cap structure at the 5/end of the snRNA is hypermethylated. The Resulting trimethylguanosine (TMG) cap is an integral part of the nuclear localization signal for snRNP particles and the pre‐snRNP particles are rapidly transported into (...) the nucleus. SnRNP particles mature when snRNA‐specific proteins complex with the particles, in some cases, just before or during nuclear transport, but in most instances after the particles are in the nucleus. In addition, U6 snRNA hybridizes with U4 snRNA to form a U4/U6 snRNP in the nucleus. The transport signals are retained on the snRNP particles and proteins since existing particles and proteins enter the reformed nucleus after mitosis. (shrink)

Multiple approaches have considered ways to understand these health issues and devise interventions that work. One such approach is community‐based participatory research. This article describes the development of a new collaborative partnership between a school of nursing and an urban social service agency using (...) community‐based participatory research as a framework. We describe the partnership’s evolution and process of data collection and analysis and evaluate the outcomes of both. We argue that community‐based participatory research involves partnerships at its core whose members, both as individuals and part of the collaboration, must be committed and nimble in the face of shifting and challenging health and social problems, recognize common issues and concerns across the boundaries of community and academia, and respect each other’s different approaches and expertise. For students whose experience with science has been primarily in the classroom, it can be difficult to identify and contact potential mentors, and to navigate the transition to a one-on-one, mentor-student relationship. This is especially true for those who are new to research, or who belong to groups that are underrepresented in research. The Entering Research curriculum offers a mechanism to structure the independent research experience, and help students overcome these challenges.
