Natural languages all contain constructions the interpretation of which depends upon the situation in which they are used. In Language and Context, Jason Stanley presents a series of essays which develop a theory of how the situation in which we speak interacts with the words we use to help produce what we say. The reason we can so smoothly operate with sentences that can be used to express very different items of information, Stanley argues, is that there are linguistically (...) mandated constraints on the effects of the situation on what we say. These linguistically mandated constraints are most evident in the cases of sentences containing explicit pronouns, such as "She is a mathematician", where interpretation of the information expressed is guided by the use of the pronoun "she". But even when such explicit pronouns are lacking, our sentences provide similar cues to allow our interlocutors to determine the information expressed. We are, in the main, confident that our interlocutors will smoothly grasp what we say, because the grammar and meaning of our sentences encodes these constraints. In defending this theory, Stanley pays close attention to specific cases of context-sensitive constructions, such as quantified noun phrases, comparative adjectives, and conditionals. Philosophers and cognitive scientist have appealed to the dependence of what is intuitively said by a sentence on the situation in which it is uttered to argue against the possibility of a systematic theory of meaning for natural language. The value problem in epistemology is rooted in a commonsense intuition to the effect that knowledge is more valuable than true belief. Call this the “guiding intuition.” The guiding intuition generates a problem in light of two additional considerations. The first is that knowledge is (roughly) justified or warranted true belief.[1] The second is that on certain popular accounts of justification or warrant (e.g. reliabilism), its value is apparently instrumental to and hence derivative from the value of true belief.[2] But (...) if knowledge is justified true belief and the value of justification is derivative from that of true belief, how is it that knowledge is more valuable than true belief? Two recent films by Pulitzer Prize-winning playwright, David Mamet, can provide opportunities for observing student reactions to ethically troublesome situations and for discussing business-communication ethics in the classroom. The key question addressed in this article is whether business-communication courses, for example, those in public relations, can encourage students to make the "metaphoric leap" and apply Mamet's messages to class readings and discussions on ethical problems or challenges. Through showing two films in their entirety and conducting focus groups among upper-level undergraduates, (...) the authors find that there is instructional value in using Mamet's films to discuss ethics in business-related settings. There is a basic methodological difference in the way anarchists and non-anarchists think about politics, often more implicit than explicit. Anarchists see politics and justice as being concerns of social institutions, norms, and relations generally – both inside and outside the state. Much of academic political philosophy talks of politics and justice as if they are definitionally concerns about what states should do, or our relationships with each other through the state. In this chapter, we argue that the anarchists are (...) on the right side of this difference. We call the insight that undergirds the anarchists’ understanding of politics and justice “methodological anarchism.” We seek to exorcise the policy framework in favor of methodological anarchism. Indeed, we believe it should be embraced by all political philosophers, not only the anarchists among their ranks. Political philosophers ought to abstain from the policy framework for two reasons. Firstly, it is analytically impoverished inasmuch as, when followed to its logical conclusion, it is unable to engage with enormous areas of analysis that are relevant to what makes a society just or unjust. Secondly, it instills subtle prejudice against other important approaches to mitigating injustice that are unconcerned with public policy. This also carries the danger of lending ideological support for existing injustices and thereby entrenching them. Accepting our critique of the policy framework and adopting methodological anarchism does not necessarily require the acceptance of any kind of substantive political anarchism. But it does mean thinking a bit more like an anarchist about how to make society more just – thus our characterization of it as “methodological.”. (shrink)

As concerns over the negative social and environmental impacts of industrial agriculture become more widespread, efforts to define and regulate sustainable agriculture have proliferated in the US. Whereas the USDA spearheaded previous efforts, today such efforts have largely shifted to Tripartite Standards Regimes (TSRs). Using a case study of the Leonardo Academy’s initiative to develop a US sustainable agriculture standard, this paper examines the standards-development process and efforts by agribusiness to influence the process. Specifically, we analyze how politics operate in (...) seemingly “depoliticized” TSRs, and how agribusiness and the USDA use “framing practices” and procedural complaints to influence the standard-development process. We contend that although governance mechanisms are a potentially powerful tool for advocates of alternative agrifood, their efficacy may be constrained by science-based requirements, an agribusiness countermovement, and a captured state. Nursing is frequently described as practical or pragmatic and there are many parallels between nursing and pragmatism, the school of thought. Pragmatism is often glancingly referenced by nursing authors, but few have conducted in-depth discussions about its applicability to nursing; and few have identified it as a significant theoretical basis for nursing research. William James's pragmatism has not been discussed substantially in the nursing context, despite obvious complementarities. James's theme of pluralism fits with nursing's diversity and plurality; his emphasis on (...) social conscience in our actions matches nursing's fundamental purpose of improving the lives of others; his continuous testing of pluralistic truths in critically reflective practice pairs well with nursing's focus on developing best-available, holistic evidence; and his conceptualization of truth as being born in practice and becoming an instrument in practice is entirely compatible with nursing's theory–practice identity. The oft-discussed theory–practice gap is seen to hinder the development of nursing knowledge. If nursing is to find its identity in knowledge development and potentiate the knowledge developed, it is imperative to identify and address that which is impeding progress. By way of the pragmatic tenets of William James, I will argue that a significant part of the theory–practice gap lies in how nursing knowledge development is operationalized, creating a false dichotomy between practice and research. I will also argue that the research–practice schism has been widened by continued philosophical and methodological infighting in the research community. I will describe how Jamesian pragmatism can be 'what works' for rebuilding relationships and supporting an engaged plurality within nursing research and bring research and practice together into a collaborative and iterative process of developing nursing knowledge. Debate over whether health care institutions or individual providers should have a legally protected right to conscientiously refuse to offer legal services to patients who request them has grown exponentially due to the increasing legalization of morally contested services. This debate is particularly acute for Catholic health care providers. We elucidate Catholic teaching regarding the nature of conscience and the intrinsic value of being free to act in accord with one’s conscience. We then outline the primary positions defended in this (...) debate and respond to critics of Catholic teaching. In so doing, we show how Catholic health care providers’ claims to conscientiously refuse to offer specific health care services are not essentially faith-based, but are founded upon publicly defensible reasons. We also address the question of whether conscientiously refusing health care providers may become complicit in moral wrongdoing or potentially cause scandal by means of disclosure or referral to another provider. The nature and time course of sleep onset (hypnagogic) mentation was studied in the home environment using the Nightcap, a reliable, cost-effective, and relatively noninvasive sleep monitor. The Nightcap, linked to a personal computer, reliably identified sleep onset according to changes in perceived sleepiness and the appearance of hypnagogic dream features. Awakenings were performed by the computer after 15 s to 5 min of sleep as defined by eyelid quiescence. Awakenings from longer periods of sleep were associated with (1) an (...) increase in reported sleepiness, (2) a decrease in the length of mentation reports, (3) a decrease in the frequency of reports of normal, wake-like thoughts, (4) an increase in the frequency of ''unusual thoughts,'' and (5) increased frequencies of formal dream features, including visual hallucination, self-representation, fictive movement, narrative plot, and bizarreness. While sleep-onset reports can include all features of rapid eye movement (REM) dream reports, the number of such features is markedly reduced at sleep onset, suggesting that this mentation is a greatly diminished version of REM dreaming. Research on firm initial public offering (IPO) performance has primarily utilized an economics of information perspective, which assumes that publicly available information is incorporated into a stock’s price when it is issued. However, the valuation process associated with IPOs remains manifest with considerable uncertainty for the prospective investor. This study argues that corporate political activity undertaken prior to the firm’s IPO acts as a signal to investors, reducing the uncertainty the market places on the value of the firm’s equity. Utilizing (...) a sample of 180 IPOs, we show that the more a firm invests in corporate political activity prior to its IPO, the better its IPO performance. These findings provide evidence that corporate political activity acts as a nonmarket signal, influencing investor behavior by reducing the information asymmetries between investors and the target firm. Hermann Lotze was an important influence for founding philosophers in major contemporary philosophical methodologies such as pragmatism (e. g. William James and Josiah Royce), phenomenology (e. g. Edmund Husserl), and analytic philosophy (e. g. Gottlob Frege). This chapter focuses on Lotze’s Logic for clues to Lotze’s widespread appeal to various contemporary philosophical movements. In particular this essay explores the logical status of Lotze’s Sigma as the sought but not yet fully understood subject. By finding in Sigma a shared term between (...) idealistic and empirical sciences, Lotze provides an interpretive middle ground between pure (a priori) and applied (a posteriori) logic, as well as between purely logical scientific inquiries (as are found in mathematics and philosophy, for instance), and applied logical inquiries into the nature of the world (as for instance in the natural sciences). Sigma may have been a powerful influence on the phenomenologists, pragmatists, and analytic philosophers who followed, having shown a way beyond seeming dichotomies of idealism vs. empiricism. Lotze shows the fruitful interaction between these two modes of logical science but also their uniqueness; in turn, he shows how logic is both a unique philosophical science and also valuably related to ethics and metaphysics. The aim of the current study was to explore the process of self-transformation as a result of coping with a major life event, and to address the role, if any, that spirituality plays within the coping and transformational process. Using grounded theory methodology, six participants were interviewed over a period of 6 months. The findings, supportive of previous research, produced a preliminary model illustrating transformation as a gradual process. The core category was identified as “openness,” in that by being open (...) to others or to the “Transcendent,” the participants were able to let go and transform. It was theorized that openness, in this sense, enables acceptance of material deriving from a realm of self beyond the everyday ego. Indeed, such a journey of transformation crucially seems to entail expanding the conception of self beyond customary limits. Understood in this way, transformation may be conceptualized as a process of continual movement into the unconscious, where the totality of the self is awakened, resulting in a reinterpretation of life purpose. The consequences of the transformation for participants were positive in nature. The role that spirituality plays within the coping and transformation process was seen to manifest as being subtle and unfolding and/or supportive. (shrink)

Many studies have shown that marijuana can negatively affect the cognitive development of adolescents. For some individuals, marijuana use may also initiate opioid use, dose escalation, and opioid use disorder. States that legalize marijuana should help adolescents through regulation of advertising and availability of marijuana-infused edibles. Such policies may assist in protecting neurodevelopment of the adolescent and young adult brain. The federal government should also remove its prohibition of marijuana sales and use, leaving their regulation to state law-makers.

Moral theory is no substitute for virtue, but virtue is no substitute for moral theory. Many critics of moral theory, with Richard Posner being one prominent recent example, complain that moral theory is too abstract, that it cannot generally be used to derive particular rights and wrongs, and that it does not improve people's characters. Posner complains that it is thus of no use to legal theorists. This article defends moral theory, and to some degree, philosophical inquiry in general, against (...) such pragmatic complaints. I argue that the primary goal of moral theorizing is not pragmatic, but theoretical. Moral theory aims at explanation, at answering certain kinds of questions about morality. Moral theory is meant to deepen our insight into morality but, to count as deepening our insight, it need not provide a formula for calculating what to do in a particular circumstance, nor must it make us more virtuous. I provide an account of the scope and nature of explanation provided by moral theory as well as an account of why such explanations can be worth having, even if they were to have few pragmatic consequences. Pp. ix + 217. $38.00, cloth.In this book Marlene Sokolon develops Aristotle's theme that virtue, both individual and social, consists of a harmonious interplay of reason and emotion. The nine chapters of Political Emotions: Aristotle and the (...) Symphony of Reason and Emotion argue for the continued relevance of Aristotle's work. The first chapter uses the metaphor of a symphony to outline Aristotle's view of emotions as necessary to the proper exercise of reason in a good society. Reason should not master emotion, Sokolon explains, but, rather, should function like a parent to train good emotional responses. Emotions are inherently political and can enrich or endanger a political order depending on how they are modulated. The second chapter assesses Aristotle's fit with current research into emotion by discussing areas where his conclusions are consistent with contemporary findings. Emotions are not reducible either to thought or to physiological reactions, they have a social component, and they involve judgments as well as perceptions. Chapters 3 through 9 consider particular emotions, following Aristotle's Rhetoric to illustrate their political and rhetorical components. Emotions have a Janus face, in that they can present a beneficial or a baneful aspect. The final chapter and conclusion connect Aristotle's account to recent work in political science, suggesting lines of future research. She explains that persuasive speech can "turn" emotional judgments and draws a parallel between rhetoric's capacity to induce audiences to adopt emotions and reason's ability to persuade individual emotional response (20). Emotions such as anger, love, fear, and even shame have roles to play in a good society. For example, anger against tyranny can provide a valuable spur to change, while well-grounded fear can motivate effective self-defense. Sokolon begins her account by discussing anger's possible merit in political decision making and ends by considering how emotions such as anger can motivate attempts to overthrow tyranny. Aristotle thus redeems seemingly negative emotions in the process of explaining their political value. Because they are potentially so powerful and because they shape perception and judgment, emotions pose threats. Love in the form of civic friendship provides an essential foundation for community stability, but excessive love can corrupt judgment by fostering improper partiality. Therefore Aristotle considers emotions such as love and hate to be limited goods. The idea that a moderate amount of hate can be good for a just society seems to strike a jarring note today, given hatred's propensity to breed bigotry, but Aristotle has in mind hatred of flatterers and the unjust.Emotions are "Janus-like" in that they can be helpful or harmful depending on how they are activated and habituated. Sokolon reiterates the idea that a good society will cultivate habits to modulate emotional response based on reason to explain each emotion's dangerous and productive potential. For example, excessive fear can corrupt deliberation, and excessive confidence can lead to disaster. A "middle" between extremes can habituate individuals to desire justice and motivate appropriate action: without appropriate confidence soldiers will not fight, and without appropriate fear citizens will not provide sufficient means of defense. However, the formal notion that we should search out a virtuous mean for each emotion based on our character and context typically lacks substantive content; the extent to which Aristotle's work might help contemporary audiences to sustain such virtue remains mostly implicit. What counts as proper emotional habituation will be radically contingent, and the book's aim is not to describe contemporary political regimes or to offer interventions. In this paper we examine the relationship between diligence and ethics and the connection between procrastination and ethical misconduct for lawyers. From there we ask the question of whether legal education does enough to teach law students good habits of time management that might minimize the kind of procrastination that so often goes hand in hand with lawyer malfeasance. Far from concluding that legal education addresses these issues adequately we advance the claim that legal education actually teaches procrastination. Drawing on (...) the work of Neil Fiore and his book: The Now Habit: A Strategic Program for Overcoming Procrastination and Enjoying Guilt-Free Play we argue that law students are often susceptible to the psychological factors that lead to procrastination: fear of failure, fear of success and resentment of authority. From there we outline aspects of legal education that feed into rather than combating these vulnerabilities. Finally we outline recommendations for how legal education could begin to take more seriously the relationship between time management and legal ethics and to model and inculcate good time management skills. Meeting the needs of individuals who experience vulnerability due to cognitive impairment presents significant challenges to caregivers. Primary caregiver responsibility is often relegated to professionals in hospitals or long-term care facilities, while proxy decision-making responsibility lies with families. The complex relationship among patients, professional caregivers, and families may be further complicated by the relative cognitive capacity of different patients. While some experience diminished cognitive capacity to such an extent that they cannot make any informed voluntary decisions, others may be able (...) to express global preferences and participate more actively in rehabilitative efforts. With reference to Catholic social teaching, I briefly establish the intrinsic dignity of human persons who experience cognitive impairment and then analyze how the web of relationships and responsibilities among patients, professional caregivers, families, and communities ought to be defined. Finally, I consider how these relationships may be optimized to enhance participation in mutually reinforced caregiving and decision making. (shrink)

This chapter considers various arguments purporting to show that respect for animal rights is consistent with "therapeutic hunting"--that is, hunting undertaken as part of a plan to control wild animal populations. It concludes that these arguments fail. It also suggests that the implications of Regan's rights view may be more sweeping than are generally recognizes: the rights view seems to rule out not only therapeutic hunting, but also subsistence hunting.

I develop a spiritual theology of the physical act of sleep. The spiritual significance of the physical act of sleep ought to be a relational trust that recognizes my place as a creature that depends on the grace of a self-sufficient provider. After distinguishing this topic from other related themes, I develop a theological anthropology of sleep by considering how sleep brings glory to God and by placing sleep within the redemption narrative. I explore sleep as a spiritual practice and (...) investigate the theme of sleep as trust in Scripture. I exposit a spiritual danger associated with sleep, the capital vice of sloth, and show how the traditional conception of this vice further illumines the spiritual significance of sleep. (shrink)

Stephen R. L. Clark has authored twelve books covering three philosophical themes: religion, duties toward animals, and politics—“Unfortunately, however, those familiar with one realm of his work, tend not to be familiar with what he has done in other areas”. Even those who may be familiar with the whole of Clark’s corpus may find it difficult to discern a coherent philosophical message among these disparate themes. Dombrowski seeks to present a comprehensive overview of Clark’s thought, and to elucidate Clark’s primary (...) philosophical concerns and prejudices, which run through all his works. However, Dombrowski’s admiration for Clark’s philosophy does not preclude him from offering his own unique analysis and critique. (shrink)

In his book, Butler notes that the phrase “classical liberal” encompasses a wide spectrum of views, from conservatism to libertarianism. Butler lays out 10 principles that characterize classical liberalism, sketches its history, and discusses the value classical liberals place on freedom and toleration. He also examines the classical liberal views of politics, government, and society, and some useful compendia for the reader.
