This Open Access book addresses the age-old problem of infinite regresses in epistemology. How can we ever come to know something if knowing requires having good reasons, and reasons can only be good if they are backed by good reasons in turn? The problem has puzzled philosophers ever since antiquity, giving rise to what is often called Agrippa's Trilemma. The current volume approaches the old problem in a provocative and thoroughly contemporary way. Taking seriously the idea that good reasons are (...) typically probabilistic in character, it develops and defends a new solution that challenges venerable philosophical intuitions and explains why they were mistakenly held. Key to the new solution is the phenomenon of fading foundations, according to which distant reasons are less important than those that are nearby. The phenomenon takes the sting out of Agrippa's Trilemma; moreover, since the theory that describes it is general and abstract, it is readily applicable outside epistemology, notably to debates on infinite regresses in metaphysics. Tom Stoneham put forward an argument purporting to show that coherentists are, under certain conditions, committed to the conjunction fallacy. Stoneham considers this argument a reductio ad absurdum of any coherence theory of justification. I argue that Stoneham neglects the distinction between degrees of confirmation and degrees of probability. Once the distinction is in place, it becomes clear that no conjunction fallacy has been committed.

This article begins with an explanation of how moral development for organizations has parallels to Kohlberg's categorization of the levels of individual moral development. Then the levels of organizational moral development are integrated into the literature on corporate social performance by relating them to different stakeholder orientations. Finally, the authors propose a model of organizational moral development that emphasizes the role of top management in creating organizational processes that shape the organizational and institutional components of corporate social performance. This article (...) represents one approach to linking the distinct streams of business ethics and business-and-society research into a more complete understanding of how managers and firms address complex ethical and social issues. This article argues for the recovery and re-incorporation of lost voices and debates into the history of political thought by focusing on the issue of sovereignty. It begins by examining why such a narrow understanding of the canon has come to dominate the sub-discipline and argues for critical approaches that treat the past as a “contested terrain” rather than an unfolding plot. It then turns to early twentieth-century Britain as an example of an era when thinkers who have been largely (...) forgotten by today’s political theorists argued loudly about the future of state sovereignty. It next focuses on a 1916 exchange of essays entitled “The Nature of the State in View of Its External Relations” by Delisle Burns, Bertrand Russell, and G.D.H. Cole, as an example of some of the most innovative and radical ideas to emerge from the period. The article concludes by arguing that re-engaging the work of these forgotten thinkers can broaden our conceptual horizons about sovereignty, speak to some of the most urgent issues of our time, and force open the concept of “the political” to radical reinterpretation. This article focuses on the question of whether Social Issues in Management (SIM) is a “field” and, if so, what kind, emphasizing specifically the recent literature on corporate social responsibility and performance (CSR/csp). Fields are defined in part by coherent bodies of knowledge that serve as guideposts for current research, and so the authors construct a simple model of CSR/csp scholarship, illustrating the relevant categories with representative publications. The authors conclude that SIM is a “low-paradigm” field but is not recognized (...) or accepted as a field by many scholars who write about CSR/csp from “outside” the field. This analysis points to the need for SIM scholars to continue to integrate useful ideas from other fields, and also to critique the work of scholars who address “failings” or “gaps” in SIM research without appropriately dealing with the existing SIM literature. The article concludes with some ideas for sustaining the institutional legitimacy of SIM and for challenging those who would “reinvent” a field with a long and fruitful history, including paying careful attention to journal review processes and the content of publications in prominent journals. The possible relationship between widespread unauthorized copying of microcomputer software (also known as software piracy) and level of moral judgment is examined through analysis of over 350 survey questionnaires that included the Defining Issues Test as a measure of moral development. It is hypothesized that the higher one''s level of moral judgment, the less likely that one will approve of or engage in unauthorized copying. Analysis of the data indicate a high level of tolerance toward unauthorized copying and limited support (...) for the hypothesis. The most plausible explanation for these findings is that software copying is perceived as an issue of low moral intensity. This study calls into question the software industry''s strategy of concentrating exclusively on institutional compliance with copyright rules, rather than working to raise the perceived moral intensity about software piracy at the individual level. As long as the issue remains low in moral intensity, the industry cannot expect significant shifts in copying behaviors. Individuals must become more aware of and concerned about the nature and magnitude of harm to society and to the rightful copyright owners from unauthorized copying before their attitudes and behaviors come to reflect higher levels of moral judgment. This article describes the theory and process of global business citizenship (GBC) and applies it in an analysis of characteristics of company codes of business conduct. GBC is distinguished from a commonly used term, “corporate citizenship,” which often denotes corporate community involvement and philanthropy. The GBC process requires (1) a set of fundamental values embedded in the corporate code of conduct and in corporate policies that reflect universal ethical standards; (2) implementation throughout the organization with thoughtful awareness of where the (...) code and policies fit well and where they might not fit with stakeholder expectations; (3) analysis and experimentation to deal with problem cases; and (4) systematic learning processes to communicate the results of implementation and experiments internally and externally. We then identify and illustrate the three attributes of a code of conduct that would reflect a GBC approach. The three attributes are orientation, implementation, and accountability. The various components of these attributes are specified and illustrated, using website examples from six global petroleum companies. (shrink)

A characteristic of contemporary analytic philosophy is its ample use of thought experiments. We formulate two features that can lead one to suspect that a given thought experiment is a poor one. Although these features are especially in evidence within the philosophy of mind, they can, surprisingly enough, also be discerned in some celebrated scientific thought experiments. Yet in the latter case the consequences appear to be less disastrous. We conclude that the use of thought experiments is more successful in (...) science than in philosophy. (shrink)

The popular view of shareholder activism focuses on shareholder resolutions and the shareholder vote via proxy statements at the annual meeting, which is treated as a "David vs. Goliath" showdown between the small group of socially responsible investors and the powerful corporation. This article goes beyond the popular view to examine where the real action typically occurs-in the Dialogue process where corporations and shareholder activist groups mutually agree to ongoing communications to deal with a serious social issue. Use of the (...) capitalized word "Dialogue" is intended to distinguish this formal process between corporations and shareholders from all the other forms of dialogue or twoway communication exchanged between a corporation and its stakeholders. The phenomenon of Dialogue between a corporation and dissident shareholders has not been analyzed in the academic literature or in the popular press because it occurs behind the scenes and out of sight from media scrutiny. Yet this is where a great deal of social change initiated by shareholder activists is negotiated. This article contributes both theoretically and empirically to the study of Dialogues between shareholder activists and corporations. We explain how Dialogues occur in the context of the shareholder resolution process and examine two Dialogues that focus on international labor issues in two industries. Then data on Dialogues during the period, 1999-2005, from the Interfaith Center on Corporate Responsibility are analyzed. This research contributes to knowledge about the Dialogue process and the emerging literature on corporation-stakeholder engagement. (shrink)

This article argues for a new direction in business ethics research. A number of widely discussed concepts popular in the business world today appear to converge around a set of practices that imply a new ethic capable of linking the competitively effective with the morally good. Seizing this opportunity requires that ethicists redirect their attention away from a traditional focus on applying existing moral theories to business practice and adopt instead a "constructivist" focus that works backward from these best practices (...) to construct a new ethic that supports them. In Ethics of Luxury renowned Canadian thinker and artist Jeanne Randolph gives us a magnum opus focusing on one of the most pressing issues facing us today – how we act morally and ethically while participating in a culture of abundance, opulence and consumerism. Randolph argues that when we use our imagination, as we do when we create, appreciate and live with art, we are acting ethically, expressing our sense of morality in a practical, material way.

This research addresses the questions: “How do ties to children and other family members influence Black drug offenders' likelihood of incarceration?” and “Is the influence similar for men and women?” Predictions were tested using 1991-1993 data for 2,785 men and 499 women convicted of cocaine offenses. Logistic regression models containing key legal and extralegal characteristics were estimated for men and women combined and separately. Measures of prior conviction and prior drug use were found to be powerful predictors of sentence for (...) both men and women. Findings suggest that judges consider “Does the offender live with a child or a family member?” and, possibly, “Is there a family member readily available to assume child care responsibilities if we incarcerate a mother who lives with a child?” when sentencing women. Among men, legal characteristics such as offense seriousness were more salient. (shrink)

Although their methodologies, areas of focus, and conclusions may diverge greatly, all philosophers in some form or another pose questions about universal truths. These individuals have elevated discourse and changed the way we interpret the world around us. Profiles of 101 of the most noteworthy individuals in the field introduce readers to the various philosophical schools of thought, as well as the ongoing questions and debates that have occupied philosophers and non-philosophers alike for centuries.

Is it coherent to speak of the probability of a probability, and the probability of a probability of a probability, and so on? We show that it is, in the sense that a regress of higher-order probabilities can lead to convergent sequences that determine all these probabilities. By constructing an implementable model which is based on coin-making machines, we demonstrate the consistency of our regress.

This paper focuses on the differing ways in which organizations send conflicting signals, in the form of contending organizational values, to their managers regarding the appropriate behavior in a given situation, and the impact that this has on the manager's decision-making process. It posits the existence of three different types of organizational value contention and examines their influence on the resulting patterns of sense-making and behavior evident in the manager's responses, based upon interview data from a cross-section of managers in (...) two organizations. Various arguments have been put forward to show that Zeno-like paradoxes are still with us. A particularly interesting one involves a cube composed of colored slabs that geometrically decrease in thickness. We first point out that this argument has already been nullified by Paul Benacerraf. Then we show that nevertheless a further problem remains, one that withstands Benacerraf s critique. We explain that the new problem is isomorphic to two other Zeno-like predicaments: a problem described by Alper and Bridger in (...) 1998 and a modified version of the problem that Benardete introduced in 1964. Finally, we present a solution to the three isomorphic problems. (shrink)

A language of care and relationship-building has recently appeared with prominence in the business literature, driven by the realities of the marketplace. Thus, it seems a propitious time to reflect on a decade of writing in feminist morality that has focussed on the concept of an ethic of care, and examine its relevance for today's business context. Is the idea of creating organizations that “care” just another management fad that subverts the essential integrity of concepts of ethical caring? Conversely, are (...) these concepts capable of beginning an important dialogue that may help us to see new possibilities for simultaneously enhancingboththe effectiveness and the moral quality of organizations in the future? Several years ago, enjoying a splendid lunch together in the city of Ghent, we cheerfully agreed to disagree on the matter; and now that Cohnitz has published his considered opinion of our views, we are glad that we have the opportunity to write a rejoinder and to explicate some of our disagreements. From 1929 onwards, C. I. Lewis defended the foundationalist claim that judgements of the form 'x is probable' only make sense if one assumes there to be a ground y that is certain (where x and y may be beliefs, propositions, or events). Without this assumption, Lewis argues, the probability of x could not be anything other than zero. Hans Reichenbach repeatedly contested Lewis's idea, calling it "a remnant of rationalism". The last move in this debate was a challenge by (...) Lewis, defying Reichenbach to produce a regress of probability values that yields a number other than zero. Reichenbach never took up the challenge, but we will meet it on his behalf, as it were. By presenting a series converging to a limit, we demonstrate that x can have a definite and computable probability, even if its justification consists of an infinite number of steps. Next we show the invalidity of a recent riposte of foundationalists that this limit of the series can be the ground of justification. Finally we discuss the question where justification can come from if not from a ground. (shrink)

Public policy decisions often require rhetorically-engaged citizens to have some understanding of the science and technology involved. On many current issues sectors of the public hold views differing from those of most scientists, and they often do not support proposals based on the scientists’ views. The overall cultural authority of science has also been challenged in the last decade by several negative trends in the sciences themselves, including widely-reported cases of fraud and failures in replication. With the support of professional (...) science organizations, science communication specialists have stepped in aggressively to address science’s communication problems scientifically. This paper will examine the assumptions behind their advice on scientific information, their recommended strategies of framing, narration, and projecting trustworthiness, and their characterizations of audiences and the nature of science itself. From the perspective of rhetorical argumentation, the science communication literature does not promote addressing audiences as citizens capable of rational argumentation. But the science of science communication is likely to remain the dominant approach to public science with the professional science community. (shrink)

Madonna Towers, Inc., the U.S. Court of Appeals for the Eighth Circuit held that the failure of a skilled nursing facility's executives to seek a legal opinion regarding a billing practice they considered valid did not meet the definition of knowingly presenting a false claim for payment to the federal government under the False Claims Act. Alleging that the facility that provided care to his aunt fraudulently submitted claims to Medicare for services provided (...) free of charge, the appellant brought this case qui tam on behalf of the federal government under the FCA.The FCA was passed by the legislature in an effort to punish and deter fraud against the federal government. The Catholic Monarchy is the short-lived dynastic union (1580-1640) between the kingdoms of Spain and Portugal. By returning on the legal, political and pragmatic foundations of this empire which cannot be called Empire (because this name belongs to the Holy Roman Empire of the cousins of Vienna), the article tries to seize better the internal functioning of this heterogeneous political set, by adopting two points of view: that of America (how the notion of Catholic Monarchy is understood in the reynos, (...) far from Madrid and Lisbon) and that of Rome (how Holy See reaches - or not - to exist in the heart of this space). It emerges from it that the pope and the Catholic King are natural allies (around the Roman Christianity) but not objectives (their purposes do not match), and that Rome and Mexico as well picture themselves not as margins of the Catholic Monarchy, but as real centers. FemaleMan_Meets_OncoMouse explores the roles of stories, figures, dreams, theories, facts, delusions, advertising, institutions, economic arrangements, publishing practices, scientific advances, and politics in twentieth- century technoscience. The book's title is an e-mail address. With it, Haraway locates herself and her readers in a sprawling net of associations more far-flung than the Internet. The address is not a cozy home. There is no innocent place to stand in the world where the book's author figure, FemaleMan, encounters DuPont's controversial laboratory rodent, OncoMouse. (...) Haraway sees the world of contemporary technoscience as a drama. Information sciences and life sciences are at the center of the dramatic action. Scenes are set in landscapes where maps of human genetic differences are stored in databases, racialized bodies are reconfigured by morphing for photographs in popular magazines, and transgenic mice important to breast cancer research are patented intellectual property. The actors are many, and not all are human. Beginning with the Modest Witness, the key figure in the Science Revolution, Haraway shows us the trouble lurking in race and gender- marked practices for attesting to matters of fact. In later scenes, Haraway explores the kinship relations among the many cyborg creatures produced in the late twentieth-century--in nuclear research, genetic engineering, reproductive technologies, computer-mediated representational practices, and mutations in biological approaches to "race.".
