Responsibility and accountability of CEOs has been a major ethical concern over the past 10 years. Major ethical dilemmas at Enron, Worldcom, AIG, as well as other well-known organizations have been at least partially blamed on CEO malfeasance. Interviews with Ken Lay, CEO of Enron, after his 2006 fraud convictions provides an opportunity to document his perceived role in the demise of Enron. Possibly no other CEO has had as much impact on the scrutiny and legalization of business ethics as (...) Ken Lay. This analysis is timely because of many information sources now available and the recent Supreme Court decisions on Enron conviction appeals. Using Ken Lay as the focal point, a review of literature provides the background for research questions to explore the role of the CEO in developing an ethical corporate culture. (shrink)

A recurring criticism of Isaiah Berlin is that he is a relativist. This essay argues that such criticisms are misplaced, as they fail to account for Berlin’s views about a common human horizon and the sense of reality. Berlin distinguishes his position from two forms of relativism – epistemological and cultural – and argues that the first entails self‐contradiction, while the other precludes mutual understanding. In response, he highlights the importance of a human horizon which involves shared moral values, and (...) provides for the possibility of mutual comprehension. Objective To develop an ethically, legally, and clinically appropriate ventilator allocation policy for AdventHealth Tampa and AdventHealth Carrollwood in Tampa, Florida, which could be enacted swiftly during the Covid-19 pandemic. Methods During Spring 2020, a subcommittee of the Medical Ethics Committee established consensus on the fundamental principles of the policy, then built on existing ethical, legal, and clinical guidance. Results The plan was finalized in May 2020. The plan triages patients based on exclusion criteria (imminent mortality), prognosis and expected benefit (...) of ventilation (using the Sequential Organ Failure Assessment), and change in prognosis over time. Decisions are made by committee in order to minimize moral distress among individual patient care providers. Conclusions Due to international concerns about healthcare resource shortages during the Covid-19 pandemic, hospitals need allocation policies informed by the crisis standard of care, the hospital’s ethical duty to plan for an emergency, and federal civil rights laws Policy Implications: This type of policy can serve as a model for other institutions to develop crisis standards of care resource allocation policies, which are a necessary component of disaster planning. Cartographies contributes to the growing debates on the value of poststructuralist theory. Grounded in a theoretical framework, it combines poststructural semiotics and a philosophy of the body. While interest in poststructuralism is well established, the currently felt need to anchor that interest in a political, material reality is where these readings gain their critical edge. They address the material - social, political and economic - effects of representation, marking anew direction in the debate.

Many modern commentators on inertial phenomena hold (or just assume) that there is no "problem of inertia", on the grounds that either (a) no explanation is needed for such phenomena or (b) the explanation is already at hand. My purpose here is to comment on both views, defending the thesis that the problem is real and still unsolved.

Sarbanes–Oxley Section 406 requires a code of ethics for top financial and accounting officers in public companies. The objective of this research is to discover the impact of a financial code of ethics on firm behavior. We performed a longitudinal tracking of firm adoption of a financial code of ethics starting in 2005. We checked these companies’ codes again in 2011 to confirm their continued implementation. Financial restatements were used as a dependent variable to measure improved financial reporting after the (...) adoption of the financial codes. I argue that the transparency of experience provides the basis of arguments both for intentionalism -- understood as the view that there is a necessary connection between perceptual content and perceptual phenomenology -- and for the view that the contents of perceptual experiences are Russellian propositions. While each of these views is popular, there are apparent tensions between them, and some have thought that their combination is unstable. In the second half of the paper, I respond to these worries by (...) arguing that Russellianism is consistent with intentionalism, that their conjunction is consistent with both internalism about phenomenology and externalism about perceptual content, and that the resulting view receives independent support from the relationship between hallucination and thought. Many alleged counter-examples to intentionalism, the thesis that the phenomenology of perceptual experiences of a given sense modality supervenes on the contents of experiences of that modality, can be avoided by adopting a liberal view of the sorts of properties that can be represented in perceptual experience. I argue that there is a class of counter-examples to intentionalism, based on shifts in attention, which avoids this response. A necessary connection between the contents and phenomenal characters of perceptual experiences can be (...) preserved by distinguishing perceptual phenomenology from the phenomenology of attention; but even if this distinction is viable, these cases put pressure on the thesis that phenomenal character can, in general, be explained in terms of mental representation. Philosophy is textual - it is written and it is read - yet today much of philosophy regards itself as a kind of science, sometimes reducing itself to a species of intellectual bureaucracy. The Doctrine of Double Effect has been challenged by the claim that what an agent intends as a means may be limited to those effects that are precisely characterized by the descriptions under which the agent believes that they are minimally causally necessary for the production of other effects that the agent seeks to bring about. If based on so narrow a conception of an intended means, the traditional Doctrine of Double Effect becomes limitlessly permissive. In this paper I examine (...) and criticize Warren Quinn's attempt to reformulate the Doctrine in such a way that it retains its force and plausibility even if we accept the narrow conception of an intended means. Building on Quinn's insights, I conclude by offering a further version of the Doctrine that retains the virtues of Quinn's account but avoids the objections to it. I The key element in the Doctrine of Double Effect (DDE) is the claim that there is a stronger presumption against action that has harm to the innocent as an intended effect than there is against otherwise comparable action that causes the same amount of harm to the innocent as a foreseen but unintended effect. Since it is relatively uncontroversial that, except perhaps in cases involving desert, it is wrong to cause harm as an end in itself, the DDE is normally invoked to distinguish morally between harm that is intended as a means and harm that is considered a merely foreseen side-effect. The two competitive currents in French philosophy initiated by Jacques Derrida and Gilles Deleuze tackle the difference between empiricism and idealism in contrary motion. In Derrida, the move is toward a critique of representation. In Deleuze, it is toward recovery of the real. Nevertheless, this paper nominates their meeting in a kind of 'radical empiricism'. Both Derrida and Deleuze engage with empiricism at certain points in their work, although many who go by that label would be surprised to hear it.

Higher education on the corporate model imagines students as consumers, choosing between knowledge products and brands. It imagines itself liberating the university from the dictates of the State/tradition/aristocratic self-replication, and putting it in the hands of its democratic stakeholders. It therefore naturally subscribes to the general management principles and practices of global corporate culture. We develop the concept of a volitional disability as an aid in understanding those patients who behave in ways that are harmful to themselves in spite of their desire to do otherwise. Using this concept enables us to describe their behavior as intentional but ‘unvoluntary’. We demonstrate the clinical reality of such behavior by giving clinical examples of the behavior of those with phobic, compulsive, and addictive disorders. We then attempt to show how some kinds of self-harming behavior of noncompliant (...) patients are similar to phobic and compulsive behavior. We propose use of the concept of volitional disability to make it easier for physicians to work with these noncompliant patients and thus to improve their ability to provide better care for them. However much one may wish for nonviolent solutions to the problems of unjust and unrestrained human violence that Glover explores in Humanity, some of those problems at present require violent responses. One cannot read his account of the Clinton administration’s campaign to sabotage efforts to stop the massacre in Rwanda in 1994 – a campaign motivated by fear that American involvement would cost American lives and therefore votes – without concluding that Glover himself believes that military intervention was morally required (...) in that case. Military intervention in another state that is intended to stop one group within that state from brutally persecuting or violating the human rights of members of another group is now known as “humanitarian intervention.” Those against whom the intervention is directed are almost always the government and its supporters, though this is not a necessary feature of humanitarian intervention. It is, however, a conceptual condition of humanitarian intervention that it does not occur at the request or with the consent of the government. The use of force within another state with the consent of the government counts as assistance rather than intervention. The principal reason that humanitarian intervention is contentious is that it seems to violate the target state’s sovereign right to control its own domestic affairs. Because humanitarian intervention is a response to human rights violations within the target state, it is regarded as altogether different from wars of defense against aggression. This paper offers a case study based on qualitative research in the burley tobacco region of central Kentucky, where farmers are urged to diversify away from tobacco production. “Replacing” tobacco is difficult for economic and material reasons, but also because raising tobacco is commensurate with a locally valued way of doing masculinity. The focus is on these two questions: How can the doing of work associated with tobacco production and marketing be understood as also doing a particular masculinity? What does (...) an understanding of farm work as a simultaneous doing of gender illuminate about the challenges of diversification away from tobacco? Asking tobacco farmers to “grow something else” is also asking them to do gender differently, suggesting that the transition away from tobacco must be understood as a gendered transition. This research, focused primarily on male farmers who continue to raise tobacco, suggests the need for gendered research with women and men who have moved away from tobacco to other crops. (shrink)

This study explores consumer expectations and attitudes related to gender-based price discrimination. Although much research has focused on pay inequalities and gender diversity, considerably less attention has been focused on situations in which men and women are charged different prices based on gender. In two studies, expectations and attitudes toward gender-based price discrimination are examined. In Study 1, two scenarios related to prices at hair salon and dry cleaning services were manipulated to measure expectations and attitudes toward gender-based price discrimination. (...) We found that the nature of the service results in expectations of price differences between men and women. We also found men expect gender-based pricing more than women. In Study 2, qualitative research was conducted to reveal the cognitions that men and women experience when exposed to gender-based price discrimination. (shrink)
