New technologies coupled with high energy prices, a desire for energy independence, and cleaner energy, have led to many energy companies investing large amounts of capital into rural places. In the last decade, along with solar and wind, unconventional shale oil and gas production has risen steeply throughout the United States boosting economic growth and stimulating wealth creation in many communities. Because farmers own or operate over half of rural lands in the lower 48 states, the possibility is high for (...) shale development to contribute to the financial well-being of farmers with land in shale regions. However, by focusing on the large royalties of some landowners, environmental and social risks that farmers encounter may be overlooked. To address the gap of farmer impacts, I examine the experiences and perceptions of crop farm owners who reside in two established shale plays: the Bakken region in North Dakota and the Marcellus region in Pennsylvania and in one emerging shale play: the New Albany region in Southern Illinois. I survey farm owners of both large and small crop farms, who farm a variety of crops both by conventional and organic methods. By having such a diverse sample of farm owners in both established shale plays and emerging shale plays, I explore how farmers’ experiences differ with respect to their finances and investments, environmental degradation as well as how their perceptions of trust in oil and gas companies and community rifts differ. Efforts to recruit and retain farmers have traditionally supported the farm business through a focus on access to land, capital, and business skills. While these efforts are critical, a small body of work indicates that these may be insufficient because they rarely account for the social and economic needs of farm households and how the (in)ability to meet these needs interacts with the development and economic viability of the farm enterprise. Social and economic needs include, but are not limited to (...) access to health insurance and health care, childcare, adequate household and retirement income, affordable housing, and food security. This article introduces a symposium intended to shed light on these underappreciated needs and how they connect to the farm enterprise. We contend that a greater understanding of farm households’ lived realities meeting their social and economic needs could lead to a paradigm shift in how we understand and support farm families’ resilience. We set the stage for the eight articles in this symposium in two ways. First, we present the theoretical and empirical reasons why considering household-level needs is crucial when working towards supporting the agricultural sector. Second, we review the literature on farm households’ social and economic needs. We then thematically summarize the key insights from the eight articles. Despite variations in topics studied, research designs, and geographical contexts, we note a clear pattern in what the authors see as the implications of their findings. Namely, they reaffirm the need to challenge the traditional view that separates household needs from farm enterprise activities and outcomes. Their collective call for stronger social and agricultural programs and policies is noteworthy and may in part be connected to the structural underpinnings of the challenges meeting social and economic needs highlighted across the articles. Sheds new light on Heidegger's early theological development.

Many contemporary philosophers accept a strong generalization of Hume's denial of necessary causal connections, in the form of Hume's dictum (HD), according to which there are no metaphysically necessary connections between distinct, intrinsically typed entities. Hume's version of his dictum occurs during his investigation into the source of the idea of causal connection. The most powerful role that HD plays in Lewis's system concerns its providing a basis for, as Lewis puts it, a "principle of plentitude" that will guarantee "that (...) the worlds are abundant, and logical space is somehow complete". Lewis's combinatorialism promises to provide a principled, extensionally adequate, and reductive generator of metaphysical modal space. Beyond combinatorialism, there are many other accounts of metaphysical modality that need to be considered, not just with an eye to extensional adequacy but also to the clear desideratum to provide an account of the space of metaphysical modality that is principled. This article examines the consequences for the res publica of the simultaneous increase in state surveillance and the restriction of the right to take photographs in public ushered in by the War on Terror. We draw on Ariella Azoulay's theorization of what she terms the civil contract of photography, or the possibility for non-state civic interaction allowed by the invention of the camera. While Michel Foucault's studies of the role of constant surveillance in disciplinary societies help us to understand our (...) increasingly panoptical public spaces, Azoulay also draws on Giorgio Agamben's theorization of the state of exception, which enables us to better understand the restriction of established rights, including the right to take photographs, in the post-9/11 context. The article asks whether these developments signify an attempt to monopolize the decision as to who constitutes the citizenry of photography, and also considers artistic and political responses to surveillance and photography restrictions in Australia and the United Kingdom. The technique of nuclear transplantation – popularly known as cloning – has been integrated into several different histories of twentieth century biology. Historians and science scholars have situated nuclear transplantation within narratives of scientific practice, biotechnology, bioethics, biomedicine, and changing views of life. However, nuclear transplantation has never been the focus of analysis. In this article, I examine the development of nuclear transplantation techniques, focusing on the people, motivations, and institutions associated with the first successful nuclear transfer in metazoans in (...) 1952. The conflict between embryologists and geneticists over the mechanisms of differentiation motivated Robert Briggs to pursue nuclear transplantation experiments as a way to resolve the debate. Briggs worked at the Lankenau Hospital Research Institute, a research facility devoted to the study of cancer. The goal of understanding cancer would play a role in the development of the technique, and the story of nuclear transplantation sheds light on the role that biomedical contexts play in biological research in the second half of the twentieth century. (Posted version is final pre-publication version.) Is there a need for a distinctively diachronic conception of metaphysical emergence? Here I argue to the contrary. In the main, my strategy consists in considering a representative sample of accounts of purportedly diachronic metaphysical emergence, and arguing that in each case, the purportedly diachronic emergence at issue either can (and should) be subsumed under a broadly synchronic account of metaphysical emergence, or else is better seen as simply a case of causation.

Humeans and non-Humeans reasonably agree that there may be necessary connections between entities that are identical or merely partly distinct—between, e.g., sets and their individual members, fusions and their individual parts, instances of determinates and determinables, members of certain natural kinds and certain of their intrinsic properties, and (especially among physicalists) certain physical and mental states. Humeans maintain, however, that as per “Hume’s Dictum”, there are no necessary connections between entities that are wholly distinct;1 and in particular, no necessary causal (...) connections between such entities (even when the background conditions requisite for causation are in place). The Humean’s differential treatment appears principled, in reflecting that commonly accepted necessary connections involve constitutional relations, whereas wholly distinct entities (notably, causes and effects) do not constitute each other. I’ll argue, however, that the appearance of principle is not genuine, as per the following conditional: Constitutional→Causal: If one accepts certain constitutional necessities, one should accept certain causal necessities. This result provides needed leverage in assessing the two main frameworks in the metaphysics of science, treating natural kinds, causes, laws of nature, and the like. These frameworks differ primarily on whether Hume’s Dictum is taken as a working constraint on theorizing; and it has proved difficult for either side to criticize the other without presupposing their preferred stance on the dictum, hence talking past one another. The arguments for Constitutional→Causal are based, however, in general and independent considerations about what facts in the world might plausibly warrant our beliefs in certain constitutional necessities involving broadly scientific entities. The Humean can respond to these arguments, which reveal a deep tension in their view, at attendant costs of implausibilty and adhocery. The non-Humean framework doesn’t face any such tension between constitutional and causal necessities, however, and so in this respect comes out ahead. (shrink)

The first part of this paper consists of an exposition of the views expressed by Pierre Duhem in his Aim and Structure of Physical Theory concerning the philosophy and historiography of mathematics. The second part provides a critique of these views, pointing to the conclusion that they are in need of reformulation. In the concluding third part, it is suggested that a number of the most important claims made by Duhem concerning physical theory, e.g., those relating to the Newtonian method, (...) the limited falsifiability of theories, and the restricted role of logic, can be meaningfully applied to mathematics. The natural law tradition in ethics and jurisprudence has undergone a revival in recent years, sparked by the work of John Finnis and the 'new natural law theorists' in the early 1980s. The ensuing decades have seen the emergence of an increasingly rich body of natural law scholarship, but this diversification has gone unnoticed by many outside the field. This article seeks to clarify the relationship between the core claims of the new natural law outlook and the more specific views (...) of individual authors. It begins by discussing the place of the new natural law theory within contemporary natural law scholarship. Self‐management programmes provide strategies to optimise health while educating and providing resources for living with enduring illnesses. The current paper describes the development of a community‐based programme that combines a transdiagnostic approach to self‐management with mindfulness to enhance psychological coping for older people with long‐term multimorbidity. The six steps of intervention mapping (IM) were used to develop the programme. From a needs assessment, the objectives of the programme were formulated; the theoretical underpinnings then aligned to the objectives, which informed programme (...) design, decisions on implementation, programme adoption and evaluation steps. Bandura's social cognitive theory informed the methods and practical strategies of delivery. Among the features addressed with participants are transdiagnostic dimensions such as fatigue, pain, breathlessness, sleep disturbances. The programme utilises mindfulness to aid coping and ameliorate the psychological distresses associated with chronicity. Findings from an initial feasibility study and subsequent pilot assisted in conceptualising our programme. In conclusion, applying IM gave the planners confidence the programme is robust and evidence‐based with clearly articulated links between the behavioural goals and design elements to obtain the desired outcomes. This article considers natural law perspectives on the nature of law. Natural law theories are united by what Mark Murphy calls the natural law thesis: law is necessarily a rational standard for conduct. The natural law position comes in strong and weak versions: the strong view holds that a rational defect in a norm renders it legally invalid, while the weak view holds that a rational defect in a legal norm renders it legally defective. The article explores the motivations for (...) the natural law position, before considering three lines of natural law argument found in the literature. I conclude by examining the arguments offered by John Finnis and Murphy in support of the weak natural law view. I suggest that these arguments fail to impugn the strong natural law thesis. Indeed, the functional argument outlined by Murphy provides a plausible route to a hybrid natural law view that incorporates both weak and strong claims. (shrink)

The recent development of a field known as experimental philosophy— in particular, its subfield devoted to moral decision making—invites us to reflect on what it means to experiment in ethics and how it is that philosophers determine the good. Furthermore, as this new discipline uses the methods of experimental psychology to examine our intuitions about such things as praise, blame, and moral responsibility, we ought to consider the relationship between ethics and our psychological makeup. To this end, it will be (...) beneficial to consider the American pragmatists’ interpretations of these issues. Ethics, for these thinkers, was both a psychological and an experimental enterprise, one in which all of our psychological capabilities are brought to bear in solving specific moral problems through the testing of hypothetical and tentative solutions. I plan to argue here that the future of experimental ethics will find itself indebted to the American past, not only in its attempts to address the empirical data it already collects but in rethinking the scope of ethics and experimentation. J. G. Fichte (1762–1814) articulates and defends a conception of autonomy as rational self-identification. This paper reconstructs this conception and examines various difficulties recognized by Fichte during the earliest phases of his career (1780s–1790s), with the heterogeneity of natural drives and freedom as the principal threat. Theoretically, this heterogeneity is overcome for Fichte by his deduction of the compound nature of humanity as a condition of rational agency. But, from the standpoint of the deliberating agent herself, this deduction is not (...) sufficient. The harmony of nature and freedom is, for Fichte, a desideratum of practical rationality, and so must be addressed as such. Fichte's argument at this point is that a further perspective on oneself must be at least implicit in the moral outlook of a deliberating agent in order for this harmony to be attained on a practical level. This is because the harmony that is achieved at the deliberative level is occasional, temporary, and fundamentally uncertain. The required perspective turns out to be religious faith, the idea that the ‘infinite task’ of morality is eternally realized in divine reason, or that there is a ‘moral world order’ in which nature and freedom are reconciled. This paper explores methodological connections between the existentialist and natural law traditions, with particular emphasis on the writings of Jean-Paul Sartre and John Finnis. Existentialist approaches to phenomenology hold promise in illuminating the epistemological foundations of natural law accounts, especially those emphasising human self-fulfilment through practical choice. Some methodological challenges common to projects in the fields of existentialist ethics and natural law are discussed. It is suggested that an existentialist perspective holds potential in reinforcing contemporary natural law responses to the (...) so-called 'fact-value distinction'. Such an approach affords a promising methodological structure for investigating the pre-moral foundations for social judgements of ethical significance, thereby providing qualified support for the type of natural law theory advocated by Finnis. The paper explores conceptual approaches to business ethics from the Japanese tradition and their potential to enhance our global approach to social and environmental sustainability, including discussion of a framework for understanding the embeddedness of the business in society. As globalization and economic and sociopolitical challenges proliferate, the nature of the connections between the USA and Asia is more important than ever. Following an expressed “pivot” or “rebalance” to Asia and the current nebulous alliances, we hope to raise the profile (...) of Japan’s potential to shape the conception and practice of business in society. We explore attempts to offer a universal business ethic, intended as guidance for businesses globally, and examine contributions of Japanese thought to these frameworks. Considering the traditional approaches of sanpoyoshi, or tri-directional welfare in business transactions, kyosei, which can mean “living and working together for the common good”, and mottainai, or “grateful and sustainable consumption,” the research explores the relationships between the private sector, government, and civil society. Further, we examine the related notion of moralogy, which has been described as a virtue-based stakeholder approach to business. We suggest that these concepts merit promoting the conception of the “homo socio-economicus” model to replace the prevailing “homo economicus” model that threatens what sound business should be. Through interviews with Japanese scholars and practitioners and exploration of Japanese cultural traditions, we present an overview of these approaches. With this perspective, we cite the case of the Tōhoku earthquake and Fukushima nuclear disaster as one illustrative example. We hope that this understanding of the embeddedness of business in society based on Japanese traditions and experience can contribute to a global conception of the role of business in society, relevant to the USA as well. Our goals are to contribute to existing discussions of Japanese business ethics and relevance to a global perspective, and to inspire ongoing exploration of applications of these ideas in teaching and scholarship. The relationship between Fichte's Wissenschaftslehre and Kant's philosophy is as important as it is ambiguous. The aim of this paper is to explore one significant and under-examined aspect of this relationship, i.e., the respective views of Fichte and Kant on the concept of God. Fichte's noteworthy divergences from Kant's discussions are described and analyzed. Fichte's explication of the concept of God is considerably sparser than Kant's. Furthermore, Fichte excludes from philosophy some of the sub-disciplines of rational theology allowed by Kant. (...) The deeper philosophical roots of these divergences are located in Fichte's radical revision of the Kantian doctrine of the “primacy of practical reason”. (shrink)

While the last several decades have seen a renaissance of scholarship on J. G. Herder (1744?1804), his moral philosophy has not been carefully examined. The aim of this paper is to fill this gap, and to point the way for further research, by reconstructing his original and systematically articulated views on morality. Three interrelated elements of his position are explored in detail: (1) his perfectionism, or theory of the human good; (2) his sentimentalism, which includes moral epistemology and a theory (...) of moral education; and (3) his theism, which deepens and justifies these other elements. Recent scholars have examined the important role of English Deism in the formation of a modern naturalistic approach to the study of human religiosity. Despite the volume of important studies of various aspects of his thought, the role of Francis Hutcheson (1694?1746) in this development has been overlooked. The aim of this paper is to show how Hutcheson develops his own account of the origins of religion, consonant with his more well-known theories in aesthetics and moral philosophy, that diverges sharply (...) from the then-prevailing Deist views. Hutcheson pioneers a psychological account of religion that anticipates the work of nineteenth- and twentieth-century scholars in important ways. At the same time, Hutcheson incorporates his account of the origins of religion into an overall vision of human flourishing. (shrink)

Recent years have witnessed a rehabilitation of early German Romanticism in philosophy, including a renewed interest in Romantic ethics. Friedrich Schlegel (1772–1829) is acknowledged as a key figure in this movement. While significant work has been done on some aspects of his thought, his views on ethics have been surprisingly overlooked. This essay aims to redress this shortcoming in the literature by examining the core themes of Schlegel’s ethics during the early phase of his career (1793–1801). I argue that Schlegel’s (...) position stands out against both the dominant Kantianism of his era, as well as against some of fellow Romantics. I show how Schlegel anticipates contemporary philosophers such as Bernard Williams, Harry Frankfurt, John McDowell, and Stanley Cavell in both his criticisms of traditional moral theory and in his attempts to develop a positive position. The principle of government neutrality, as commonly understood, enshrines the idea that government bodies ought to treat all citizens equally. I argue that the traditional interpretation of this principle in liberal constitutionalism has involved a prohibition against legal actors distinguishing between subjects on the basis of their personal characteristics. This approach is unsatisfactory, as it constrains the law's ability to respond to evolved social practices of discrimination. To illustrate this point, I draw on the writings of Jean-François Lyotard and recent (...) judicial decisions on the First Amendment to the United States Constitution. (shrink)

In this preface, we introduce Roger Schwarzschild’s body of work, as well as the papers in this volume. Because Roger’s work is so diverse and comprehensive, the book is divided into four categories: papers that address the semantics of nouns and plurals; papers on focus semantics; papers on degree semantics; and papers addressing the semantics of tense and aspect. We end with compelling arguments that Roger is the best.

The notorious difficulty of Heidegger's post-Second World War discussions of 'the gods', along with scholarly disagreement about the import of those discussions, renders that body of work an unlikely place to look for a substantive theory of religion. The thesis of this article is that, contrary to these appearances, Heidegger's later works do contain clues for developing such a theory. Heidegger's concerns about the category of 'religion' are addressed, and two recent attempts to 'de-mythologize' Heidegger's 'gods' are examined and criticized. (...) Philosophers continue to be sceptical about the possibility of constructing an existentialist ethical theory. This article explores two of the main reasons for this scepticism and draws on Jean-Paul Sartre's "Existentialism and Humanism" to suggest that there is a way around them.
