Most people presume that government is always responsible for providing solutions to pollution problems, including transportation pollution. This paper examines the validity of this argument from a minarchist libertarian, property rights principles perspective, and concludes that government cannot solve these problems using command-and-control legislation. The primary policy suggested for government to adopt is the strict adherence to property rights protection and enforcement regarding polluters, including themselves. Further encouragement of market forces could be accomplished by stopping interference within the market at (...) critical points, namely the production of roads, production and sales of automobiles, and the subsidization of alternative fuels. The precise relationship between the autonomic nervous system and emotion has been a topic of intense debate and research throughout the history of modern psychology. The present article considers some of the more influential theoretical frameworks that continue to drive contemporary research on the relationship between emotion and physiological processes. In particular, we highlight the multiple routes through which somatovisceral afference influences emotion and how this relates to the topic of emotion-specific patterns of autonomic nervous system activity.

This Essay examines debates surrounding Qu Tongzu's ‘Confucianization of law’ theory. Qu's theory claims that Chinese law underwent a process of ‘Confucianization’ starting in the Han dynasty (202 BC–220 AD) and ending and culminating in the Tang dynasty (618–907), where the Confucian concept of li and other Confucian moral teachings were introduced and incorporated into the written law. I argue that Qu's theory should be properly characterised as a theory of descriptive jurisprudence and also a form of the mirror thesis. (...) In light of this characterisation, this Essay then lays out the possible counterarguments that could be raised against Qu's theory and then situates existing scholarship in the debate in these categories. I then test Qu's theory using a case study about kinship concealment in traditional Chinese law The Essay then concludes by urging that the debate should include more jurisprudential approaches. It is well known that Bayes’ theorem (with likelihood ratios) can be used to calculate the impact of evidence, such as a ‘match’ of some feature of a person. Typically the feature of interest is the DNA profile, but the method applies in principle to any feature of a person or object, including not just DNA, fingerprints, or footprints, but also more basic features such as skin colour, height, hair colour or even name. Notwithstanding concerns about the extensiveness of databases (...) of such features, a serious challenge to the use of Bayes in such legal contexts is that its standard formulaic representations are not readily understandable to non-statisticians. Attempts to get round this problem usually involve representations based around some variation of an event tree. While this approach works well in explaining the most trivial instance of Bayes’ theorem (involving a single hypothesis and a single piece of evidence) it does not scale up to realistic situations. In particular, even with a single piece of match evidence, if we wish to incorporate the possibility that there are potential errors (both false positives and false negatives) introduced at any stage in the investigative process, matters become very complex. As a result we have observed expert witnesses (in different areas of speciality) routinely ignore the possibility of errors when presenting their evidence. To counter this, we produce what we believe is the first full probabilistic solution of the simple case of generic match evidence incorporating both classes of testing errors. Unfortunately, the resultant event tree solution is too complex for intuitive comprehension. And, crucially, the event tree also fails to represent the causal information that underpins the argument. In contrast, we also present a simple-to-construct graphical Bayesian Network (BN) solution that automatically performs the calculations and may also be intuitively simpler to understand. Although there have been multiple previous applications of BNs for analysing forensic evidence—including very detailed models for the DNA matching problem, these models have not widely penetrated the expert witness community. Nor have they addressed the basic generic match problem incorporating the two types of testing error. Hence we believe our basic BN solution provides an important mechanism for convincing experts—and eventually the legal community—that it is possible to rigorously analyse and communicate the full impact of match evidence on a case, in the presence of possible errors. In recent years, two topics have made prominent debuts in the management literature—“virtual” corporations and trust within and among organizations. These two themes are related in that trust is important to the success of the virtual corporation. This article argues that confidence in the development of virtual corporations may be premature because of what we call the Virtual Corporation Paradox. This paradox can be succinctly stated: the short-term, transient deal-making on which the efficiency of the virtual corporation rests greatly impedes (...) the development of the mutually trusting and cooperative relationships on which its success depends. We examine both economic and sociological explanations for the emergence of trust in similar situations and find both deficient. We conclude that the success of virtual corporations will ultimately depend on an ethics-based form of corporate “character” that allows firms to develop trusting relationships without the usual safeguards or social norms. Following Jean-Baptiste Say, he argued that the market was immensely creative in the discovery of new opportunities for improving human well-being and creating social harmony. He also recognized the importance of the entrepreneur, who earned a profit in contrast to the capitalist who simply earned a return for his investment. Although he was no great theorist, Bastiat demonstrated with relentless informal logic the social value of freedom. This is best (...) exemplified in his demonstration of the virtues of free trade. Bastiat anticipated modern public choice theory with his argument that people tried to use the coercive power of the state to get what they would not achieve by market transactions. He was also concerned with the moral virtue of liberty and in his final work, The Law, he showed how the modern system of law had been perverted. Instead of protecting individual rights it had become an instrument of plunder. Psychological egoism is, I suppose, regarded by most philosophers as one of the more simple-minded fallacies in the history of philosophy, and dangerous and seductive too, contriving as it does to combine cynicism about human ideals and a vague sense of scientific method, both of which make the ordinary reader feel sophisticated, with conceptual confusion, which he cannot resist. For all of these reasons it springs eternal, in one form or another, in the breasts of first-year students, and offers excellent (...) material for their philosophy instructors, who like nothing better than an edifice of sturdy appearance but with rotten foundations on which to display their skill as demolition experts. The focus of this paper is the ethics of information giving in the context of complex sales. It is argued that, while current theoriesprovide a broad framework for describing the responsibilities of sales agents, they lack adequate descriptions of the conditionscharacteristic of complex sales situations. Without an adequate model of complex sales, ethical theories will fail to provide guidanceto sales agents facing issues that arise from features of sales situations not accounted for in the theories. To motivate this claim,I develop (...) a brief case study in the area of information system sales. The problem can be remedied, however, if the theories take intoaccount the features of complex sales. A tentative list of such features is presented and their relevance to the case is discussed. Resolution-oriented dialogue has a normative structure that is largely subject to theoretical explication. This paper develops a simple model that sheds light on how moves in a reason-giving game alter the distribution of discursive commitments and entitlements. By clarifying the practice of deontic scorekeeping, we can enhance our collective capacity to resolve conflicts dialogically.

A critical survey of the major philosophical arguments that have been used to justify the institutions and policies of contemporary welfare states considers the claims of rights theory, egalitarianism, and citizenship and communitarian doctrines. It finds that these arguments are both internally confused and inconsistent with conventional welfare policies. It is argued that the welfare state itself has serious ambiguities: it claims to cater for the needy, as part of its ?public good?; obligations, yet in practice it delivers a range (...) of private goods, e.g., health, housing, education and pensions, often irrespective of need. Yet classical liberal theories of state welfare, which favor simple cash payments, are flawed in theory and potentially costly in practice, while neocon?servative theories, by imposing ?values?; on welfare recipients, undermine liberal pluralism. The author concludes that welfare philosophy should be concerned with two neglected areas: the possibility that welfare be provided outside the familiar market and state categories, and the construction of constitutional rules to prevent the middle?class ?capture?; of existing welfare states. Empirical evidence is reviewed indicating that the extraordinary aspects of the human mind are due to our species’ ability to go beyond simple “dyadic associations” and to process the relations among three items of information simultaneously. Classic explanations of the “triadic” nature of human skills have been advocated by various scholars in the context of the evolution of human cognition. Here I summarize the core processes as found in (i) the syntax of language, (ii) tool-usage, and (iii) joint attention. I (...) then review the triadic foundations of two perceptual phenomena of great importance in human aesthetics: (iv) harmony perception and (v) pictorial depth perception. In all five subfields of human psychology, most previous work has emphasized the recursive, hierarchical complexity of such “higher cognition,” but a strongly reductionist approach indicates that the core mechanisms are triadic. It is concluded that the cognitive skills traditionally considered to be “uniquely” human require three-way associational processing that most non-Primate animal species find difficult or impossible, but all members of Homo sapiens – regardless of small cultural differences – find easy and inherently intriguing. The key theoretical idea underlying this article is that an institutional equilibrium in the economic domain can be destroyed or transformed by rapid belief changes in the political domain. Events circa 1776, 1787, and 1860 in the United States are all examined in an attempt to understand the interaction between these economic and political transformations. More explicitly, the author views the economic domain as fundamentally three dimensional, characterized by the use of land, labor, and capital. In contrast to general economic (...) reasoning, he considers the equilibrium in this domain to be institutional, rather than the consequence of the interplay of economic forces. Threats, generated in the political domain, have consequences in the economic domain, and these in turn induce belief changes in the political domain. Such belief changes may bring about war, or constitutional disequilibrium, leading possibly to a new political economic stasis. (shrink)

The purpose of rational choice is to provide a grand theoretical framework for designing human institutions. Once theoretical work had shown how markets optimally aggregated preferences, attempts were made to extend the theory from markets to politics. Attempts by Downs and Olson to describe elections and collective action produced relatively poor predictions, but impelled game theorists to generalize preference?based theories to include belief formation. A consequence of this change is that the theory is no longer purely axiomatic, but draws on (...) insights about human behavior from other disciplines and empirical analysis of the role institutions play in determining beliefs. Cognitive algebra provides a theoretical foundation for judgment-decision theory through its joint solution to the two fundamental problems – true measurement of subjective values, and cognitive rules for integration of multiple determinants.
