Students in an undergraduate legal and ethical issues course continually told the authors that they did not have time to study for the course because they were busy studying for their clinical courses. Faculty became concerned that students were failing to realize the value of legal and ethical concepts as applicable to clinical practice. This led the authors to implement a transformational learning experience in which students applied legal and ethical course content in a high-fidelity human simulation (HFHS) scenario. A (...) preliminary evaluation compared the new HFHS experience with in-person and online student groups using the same case. Based on both student and faculty perceptions, the HFHS was identified as the best of the three approaches for providing a transformational learning experience regarding legal and ethical content. Spiritual/religious coping has proven to be a fertile ground for investigating health-related spirituality in action. Ken Pargament and his colleagues have successfully demonstrated that spiritual/religious coping differs significantly from previously identified coping strategies. While much has been accomplished to date, there are undeveloped theoretical and methodological avenues that appear to provide important promise for understanding the complexities of this critical domain of coping. Some scholars have failed to conceptualize and research spiritual/religious coping as a contextual, temporally bounded process. This paper (...) explores the theoretical and methodological advantages of adopting a contextually embedded, process-oriented epistemology—contextual action theory. We propose that doing so will not only address some of the inadequacies of the extant literature but also aid researchers in exploring novel dimensions of spiritual/religious coping. From a contextual action-theory perspective, spiritual/religious coping is viewed as intentional, goal-directed behaviour that is embedded in a social and relational context. This teleonomic reconceptualization enables researchers to understand the constitution and development of intentions involved in the process of spiritual/religious coping over time. Further, a contextual action theory perspective transcends the narrow, individualistic lens of coping and explores joint and collective coping processes that emerge as people draw upon spiritual/religious practices to cope with distress. Thus, spiritual/religious coping is embedded in social and relational context and as part of personal, intentional goal-directed processes over time. The novel contributions of a contextual theoretical perspective to spiritual/religious coping research and theory are illustrated through a case example. (shrink)

The University of Pittsburgh Medical Center (UPMC) "Policy for the Management of Terminally Ill Patients Who May Become Organ Donors after Death" proposes to take organs from certain patients as soon as possible after expected cardiopulmonary death. This policy requires clear understanding of the descriptive state of the donor's critical cardiopulmonary and neurologic functional capacity at the time interventions to sustain or harvest organs are undertaken. It also requires strong consensus about the moral and legal status of the donor during (...) dying and confirmation of death. There has been no need for the clarity and precision that this policy relies upon, and thus the needed research and conceptual work has not previously been generated. The empiric base and societal consensus are both too frail to provide justification for this policy at this time. (shrink)

‘Medically unexplained symptoms’, through the lens of the biopsychosocial model, are understood in mainstream psy disciplines and related literature as a primarily psychosocial phenomenon perpetuated by ‘dysfunctional’ psychology on the part of people labelled with such. Biopsychosocial discourse and practice in this field, underpinned by little empirical foundation and lacking theoretical coherency, are associated with harms sustained by people labelled with MUS. Yet, little attention is paid to the psychology of social actors and institutions whose practice and policy derives from (...) biopsychosocial theorising, or whose vested interests produce such theorising. This article contends that lack of reflexivity among psy practitioners and other social actors on individual, institutional and structural levels furthers biopsychosocial hegemony and contributes to harms. Non-reflexive behaviour on the part of practitioners within clinical and ‘therapeutic’ encounters and on the part of social actors within institutions and broader power structures is examined, and possible psychological underpinnings of non-reflexivity are explored. Notably, the concept of gain, drawn from dominant discourse around MUS, is applied broadly to explore what might be gained from eschewing reflexivity and from adhering to biopsychosocial narratives. Implications for practice, supervision, training and research are discussed, notably highlighting a need for critical reflexivity in all domains. (shrink)

Understanding the nature of science has long been a desired outcome of science education, despite ongoing disagreements about the content, structure, and focus of NOS expectations. Addressing the concern that teachers likely focus only on student learning expectations appearing in standards documents, this study examines the current state of NOS in science education standards documents from nine diverse countries to determine the overt NOS learning expectations that appeared, NOS statements provided near those learning expectations, but not identified as learning outcomes, (...) and NOS statements found in ancillary text. Findings indicate that NOS ideas rarely occur as expectations for student learning and are far more commonly found in ancillary material. Moreover, consensus was not apparent in the overt learning outcomes for students. Given the well-documented poor state of NOS instruction and the consistent lack of NOS appearing in published curriculum materials, the NOS standards appearing in nearly all documents analyzed are unlikely to provide sufficient conceptual or pedagogical support for NOS to be accurately interpreted or translated into meaningful experiences for students. The liver was used widely in early studies of polarised transport but has been largely overlooked in recent years, mostly because of the development of epithelial cell lines which provide more tractable experimental systems. The majority of membrane proteins and lipids reach the hepatocyte apical membrane by transcytosis and it remains unclear whether there is a direct route for apical targeting, although the pathways present have yet to be fully characterised. The recent development of systems that allow hepatocyte transport processes (...) to be studied in culture and the observation that transcytosis can be significantly stimulated under physiological conditions suggest that hepatocytes have a role to play in future studies of polarised transport. This review discusses the known features of polarised membrane traffic in hepatocytes and contrasts them with the characteristics of vesicular transport in other epithelial cell types. (shrink)

There is little empirical evidence showing a direct link between a capacity for statistical learning (SL) and proficiency with natural language. Moreover, discussion of the role of SL in language acquisition has seldom focused on literacy development. Our study addressed these issues by investigating the relationship between SL and reading ability in typically developing children and healthy adults. We tested SL using visually presented stimuli within a triplet learning paradigm and examined reading ability by administering the Wide Range Achievement Test (...) (WRAT-4; Wilkinson & Robertson, 2006). A total of 38 typically developing children (mean age of 9;5 years, range 6;4–12;5) and 37 healthy adults (mean age of 21 years, range 18–34) were assessed. In children, SL was significantly related to reading ability. Importantly, this relationship was independent of grade and also age. The adult data, too, revealed that SL was significantly related to reading ability. A regression analysis of the combined child and adult data revealed that SL accounted for a unique amount of variance in reading ability, after age and attention had been taken into consideration. For the first time, this study provides empirical evidence that a capacity for more effective SL is related to higher reading ability in the general population. (shrink)

In everyday life, situations in which we act adequately yet entirely without deliberation are ubiquitous. We use the term “situated normativity” for the normative aspect of embodied cognition in skillful action. Wittgenstein’s notion of “directed discontent” refers to a context-sensitive reaction of appreciation in skillful action. Extending this notion from the domain of expertise to that of adequate everyday action, we examine phenomenologically the question of what happens when skilled individuals act correctly with instinctive ease. This question invites exploratory contributions (...) from a variety of perspectives complementary to the philosophical/ phenomenological one, including cognitive neuroscience, neurodynamics and psychology. Along such lines we try to make the normative aspect of adequate immediate action better accessible to empirical research. After introducing the idea that “valence” is a forerunner of directed discontent, we propose to make progress on this by first pursuing a more restricted exploratory question, namely, ‘what happens in the first few hundred milliseconds of the development of directed discontent?’. This is so because his moral system is based on the crucial idea that nothing in the world can be called "good without qualification except a good will."1 Thus a good will is good in and of itself, without regard to any possible end. For such a will, morality is categorical, for (...) only with such an imperative can moral laws be said to be laws ofcomplete freedom, and willed without regard to any other interest. Thus autonomy is a necessary condition for a good will, because any heteronomous worth a will could achieve would by definition be conditional, and would therefore violate Kant's notion of the unconditional worth of a good will. However, it is precisely this notion of the absolute worth a good will merits on its own that would seem to bear looking into: there is something intuitively wrong with Kant's assertion that even if"it should happen that, by a particularly unfortunate fate or by the niggardly provision of a stepmotherly nature, this will should be wholly lacking in power to accomplish its purpose," it would still "sparkle like a jewel in its own right, as something that had its full worth in itselP (p. 10). The idea implied in this passage, that a good will could exist somehow apart from the world and any effects achieved therein, is problematic to say the least. How could such a will be known? The metaphor ofa "sparklingjewel" is striking, but flawed: ajewel exists in the world, for all eyes to see if they know where to look, whereas a good will exists in the hearts of men. It is for this reason thatJoseph Conrad's LordJim is a fitting supplement to understanding the implications of a Kantian view of morality, for the central concern of the novel is the moral ambiguity that results from our common obscurity ofvision into ourselves and those around us. Given this 57 58Philosophy and Literature ambiguity, which Kant recognizes when he says, "even the strictest examination can never lead us entirely behind the secret incentives, for, when moral worth is in question, it is not a matter of actions which one sees but ofdieir inner principles which one does not see" (p. 23). It seems then irresponsible still to maintain that the worth ofa good will is independent of the way of the world. Since it is evident that if results or other empirical factors are invalid tojudge intentions, then the only judge capable of assessing in advance what maxim is being acted upon is the moral agent; morality becomes a matter of strictly individual conscience or reason. The moral agent thus becomes romanticized, a lone figure needing no other guidance than that which his or her own reason can provide in order to lead a truly good life. This is further complicated by the fact that, after the first four chapters, the reader is never given an impersonal view ofJim, but instead Marlow's painstaking efforts to fit together the puzzle ofJim's character: "I don't pretend I understood him. Despite the fact that corporate law firms attract some of the most intelligent and productive minds in business today, they have failed to cultivate a workplace that facilitates healthy and balanced lives for their practitioners. Workplace stress in the sector is manifest in a culture which continues to sanction 'rite of passage' work practices which bolster earnings for those at the apex but are proving sickening to many. This culture inhibits basic ethical human interaction based on decency and respect and (...) cultivates oppression through fear of failure. Not surprisingly then, bullying is tolerated and lawyer attrition is rife, particularly for junior women lawyers. This article considers the impact of bullying in Australian corporate law firms. Foucauldian thought is utilised in order to better understand first, how the organisational culture in major law firms continues to authorise practices which prove injurious to practitioners' health and secondly, the resulting lawyer attrition. It is argued that the 'disciplinary technologies' being adopted by management function to assure an economy of power relations which not only facilitates conformity with the values and imperatives of the firm but also, the quelling of subversion and resistance to its effects. Standpoint theory is adopted to examine the workplace harms being borne by junior lawyers through a narrative 'Snapshot' of the experience of a female, mature-aged, junior lawyer working as a solicitor at a top tier Australian corporate law firm. Her detailed account illuminates recent quantitative empirical research into the experiences of Australian women lawyers and lays bare the culture of fear and workings of power, violence and marginalisation within the firm. We contribute to the literature on ethics in the professions by theorizing how global mobility precipitates professional insecurity and constrained moral agency. We present our findings of a study of accountants migrating to Canada. Using postcolonial theory and relational/poststructuralist theories of identity and ethics, we contrast the experiences of marginalized and privileged migrant accountants to show how those with “diverse” social identities are not recognized by professionals in Canada and must seek recognition from Canadian colleagues, employers, and clients to reconstitute (...) their professional identities and moral agency. We discuss the implications of the exclusion and marginalization of professionals for migrants, the profession, and society more generally. (shrink)

In this paper I argue that a greater understanding of the part of ethics in leadership will improve leadership studies. Debates over thedefinition of leadership are really debates over what researchers think constitutes good leadership. The ultimate question is not “What is leadership?” but “What is good leadership?” The word good is refers to both ethics and competence. Research into leadership ethics would explore the ethical issues of current leadership research, serve as a critical study of the field, analyze and (...) expand normative theories of leadership, and develop new theories, research questions and ways of thinking about leadership. This article explores the notion of the unconscious (das Unbewusste) in terms of its nature and constitutive manifestations in consciousness. In contrast to the psychoanalytic formulation, the unconscious is conceptualized here distinctively as sedimentation (die Sedimentierung) within the Husserlian framework. All `experiences sediment and are “stored” in a darkened, affectless region of the psyche, which is nonetheless not in any sense separated from the sphere of consciousness. Rather, the sedimented experiences move dynamically between the unconscious and consciousness, constantly affecting and (...) manifesting in the upcoming conscious activities of the subject. Based on this conceptualization, I suggest a schematic understanding of the manifestations of the unconscious, or sedimentation, in consciousness. The conceptual division of consciousness into the sphere of understanding (Verstandessphäre), sphere of affect (Gemütssphäre) and sphere of volition (Willenssphäre) allows us to speak of the corresponding threefold manifestations of the unconscious in each of these spheres as type (Typus), mood (Stimmung) and habits (Habitus). Having their genetic “origin” in sedimented experiences, these structural moments play a constitutive role in upcoming conscious activities of the intentional subject. Furthermore, I demonstrate that each of these moments is characterized by a distinctive kind of horizonality, in light of which a deepened understanding of the genetic concept of horizon-consciousness (Horizontbewusstsein) is obtained. Despite the conceptual tripartition, I emphasize at the end the essential intertwinement of the three structural moments in such conscious performance as association. (shrink)

Despite his producing voluminous writings beyond Utopia, scholarly consensus seems to be that if we want to understand the political thought of Thomas More, we must turn to this ‘little book’. This approach, however, has yielded little consensus about how to categorise More as a political thinker, as Utopia is notoriously and intentionally enigmatic. This article attempts to generate a portrait of More as a political thinker by going beyond an investigation of Utopia alone and taking into consideration those texts (...) often overlooked or rejected by scholars, primarily his polemical and religious writings. Doing so provides an outline of More as a thinker concerned with themes of natural and artificial inequality, popular authority and representation and, at the least, justifies the exercise of reading More’s work beyond Utopia.
