A g ainst this opinion, there are authors that think that l e gal control of discretionary decisions is possi b le because th e y defend the e xistence of on l y one co r rect an sw e r . Other authors reject the e xistence of on l y one co r rect an sw er or the possibility of f inding it. N e v er theless, e v en accepting that there are some aspects of discretiona r y decisions that do not der i ve from l e gal no r ms bu t from personal preferences, those preferences must be coherent with some theo r y that contains no r mat i v e l y co r rect criteria. Community ecology entered the 1970s with the belief that niche theory would supply a general theory of community structure. The lack of wide-spread empirical support for niche theory led to a focus on models specific to classes of communities such as lakes, intertidal communities, and forests. Today, the needs of conservation biology for metrics of “ecological health” that can be applied across types of communities prompts a renewed interest in the possibility of general theory for community ecology. Disputes about the (...) existence of general patterns in community structure trace at least to the 1920s and continue today almost unchanged in concept, although now expressed through mathematical modeling. Yet, a new framework emerged in the 1980s from findings that community composition and structure depend as much on the processes that bring species to the boundaries of a community as by processes internal to a community, such as species interactions and co-evolution. This perspective, termed “supply-side ecology”, argued that community ecology was to be viewed as an “organic earth science” more than as a biological science. The absence of a general theory of the earth would then imply a corresponding absence of any general theory for the communities on the earth, and imply that the logical structure of theoretical community ecology would consist of an atlas of models special to place and geologic time. Nonetheless, a general theory of community ecology is possible similar in form to the general theory for evolution if the processes that bring species to the boundary of a community are analogized to mutation, and the processes that act on the species that arrive at a community are analogized to selection. All communities then share some version of this common narrative, permitting general theorems to be developed pertaining to all ecological communities. Still, the desirability of a general theory of community ecology is debatable because the existence of a general theory suppresses diversity of thought even as it allows generalizations to be derived. Ethics is normative; ethics indicates, in broad terms, what researchers should do. For example, researchers should respect human participants. Empirical study tells us what actually happens. Empirical research is often needed to fine-tune the best ways to achieve normative objectives, for example, to discover how best to achieve the dual aims of gaining important knowledge and respecting participants. Ethical decision making by scientists and institutional review boards should not be based on hunches and anecdotes (e.g., about such matters as what (...) information potential research participants would want to know and what they understand, or what they consider to be acceptable risks). These questions should be answered through empirical research. Some of the preceding articles in this special issue illustrate uses of empirical research on research ethics. This article places empirical research on research ethics into broader perspective and challenges investigators to use the tools of their disciplines to proactively solve ethical problems for which there currently exist no empirically proven solutions. We study the preservation under projective ccc forcing extensions of the property of L(ℝ) being a Solovay model. We prove that this property is preserved by every strongly-̰Σ₃¹ absolutely-ccc forcing extension, and that this is essentially the optimal preservation result, i.e., it does not hold for Σ₃¹ absolutely-ccc forcing notions. We extend these results to the higher projective classes of ccc posets, and to the class of all projective ccc posets, using definably-Mahlo cardinals. In the author's Relative lawlessness in intuitionistic analysis [this JOURNAL. vol. 52 (1987). pp. 68-88] and An intuitionistic theory of lawlike, choice and lawless sequences [Logic Colloquium '90. Springer-Verlag. Berlin. 1993. pp. 191-209] a notion of lawless ness relative to a countable information base was developed for classical and intuitionistic analysis. Here we simplify the predictability property characterizing relatively lawless sequences and derive it from the new axiom of closed data (classically equivalent to open data) together with a natural principle (...) of invariance under finite translation. We characterize relative lawlessness in terms of a notion of forcing. Finally, we study relative lawlessness on an arbitrary fan and show that the collection of lawless binary sequences (which is comeager in the sense of Baire) has probability measure zero. The aim of this paper is to present artificial intelligence (AI) as an organ with a role in the production of judicial truth, expanding its objects, changing its procedures and reshaping the distribution of agencies within the judicial organism. To this end, it builds on Michel Foucault’s work on the procedures of truth production and the three subject forms involved: operator, spectator and object. This is then complemented by the general organological perspective proposed by Bernard Stiegler. On the basis of (...) both, we will demonstrate two realities: first, that AI is shifting truth production from the individual to the profile, and second, that the types of associations that AI is forming have the potential to curtail human agency in the production of judicial truth. Supporting the concept of DEI, yet, perturbed by the volatility that marks today’s societal and professional climate, the authors of this article examined three Eastern spiritual traditions in search of common guidelines addressing contemporary issues related to social unrest, imbued by inequity and injustice. The areas of review included Buddhist psychology, with some of its foundational concepts such as the Four Noble Truths and the Noble Eightfold Path, the concept of ahimsa (non-harming), and the understanding of the impermanence of everything (...) as inclusive managerial practices; Daoist philosophy, with its observations of oneness and equality, and holistic self-alignment with virtue through practicing tranquility; and Hinduism, which focuses on the absence of distinction between ourselves and others around us, thus forming the foundation for morality and ethical behavior with its emphasis on unity in diversity. This collective investigative journey has led us to gather some powerful common behavioral and ethical guidelines, to steer away managers from hyperindividualism and self-centeredness to a greater and consistent respect for the unity among all beings. Abstract: The legislation of continental intellectual property and copyright provide for a period of protection granting exclusive and temporary economic rights. After a certain period, protected works enter into what is called the public domain. This is often considered as the moment in which the cultural goods come under the control and domain of society as a whole. The present paper pretends to argue that, given our current economic system, the public domain actually functions more as a business opportunity for certain companies than as a real option for the public to access artistic and intellectual works. Students in urban under-resourced schools are often disengaged from the curriculum. Distributing voice to them would seem an obvious counter to their alienation, allowing them to be co-constructors rather than objects of their education. Beyond being pragmatically sound, student agency is, arguably, a psychological and moral imperative. However, what is imperative is not necessarily doable as we illustrate in two student agency high school projects. We analyze the outcomes using four previously identified factors: school context, project scope, personal gratification, and (...) assumption of genuine authority. In conclusion, we raise two issues requiring more reflection and investigation: what is the role of a teacher who is an employee of the school yet wants to help her students protest against injustice? How can agency be developmentally staged so that students become skilled in assuming responsible leadership in their schools? (shrink)
