Informed consent is valid only if the person giving it is competent. Although allegedly informed consents are routinely tendered, there are nonetheless serious problems with the concept of competence as it stands. First, conceptual work upon competence is incomplete: the concept is unanalyzed and no logic of competence has been identified. It is thus virtually impossible to reliably discern who is competent. ;Traditional work on competence has explicated three dichotomies from which the necessary conditions for the possibility of competence will (...) be identified, viz., that competence is either a global or a specific notion; is present in varying degrees or in virtue of a threshold; and may or not include appeals to consequences. Past efforts have failed to notice a fourth dichotomy: competence as an affective or cognitive notion. Failure to designate the appropriate arms of these dichotomies is responsible for there being, at present, no reliable test for competence. The inadequacies of a highly regarded particular test for competence, the mental status examination, are examined in light of this failure. ;Competence is located within the rule-governed practice of informed consent. That practice and hence, competence, is justified through a Kantian analysis of respect for persons. This analysis reveals that the logic of competence requires assessment in terms of specific rather than global concerns; degrees of ability rather than a threshold; both cognitive and affective abilities; and no appeal to consequences. ;Based upon the analyses of consent as an example of decision making within the practice of informed consent and of respect for persons, the capacities which jointly comprise competence are identified. These are the capacities to receive, recognize, and retrieve information; to reason about, relate to oneself, and rank options; to choose among alternatives; and, under certain circumstances, to defend one's choice. ;Identification of the logic of competence and explication of and justification for the capacities that comprise competence to consent provide a conceptual foundation for the crucial concept of competence that the informed consent process currently lacks. Drawing on a wide range of Kant's recorded thought beyond his Groundwork for the Metaphysics of Morals, this essay presents an overview of Kant's account of practical agency as embodied practical agency and argues against the intellectualized interpretations of Kant's account of practical agency presented by Christine Korsgaard and Henry Sidgwick. In both Kant's empirical-psychological and metaphysical descriptions of practical agency, he presents a recognizably human practical agent that is broader and deeper than the faculty of reason alone. This agent (...) chooses action from a reflective distance, but not from the complete affective distance of reason. We choose neither as reason alone, nor even as the sum of all of our ‘higher’ faculties, of cognition (including reason), feeling, and desire, in Kant's view. Instead, we choose as an agent that also has ‘lower’, ‘sensible’ faculties, of cognition (including sense), feeling, and desire, which together comprise our ‘sensibility’. These mental states of sensibility are not merely confused versions of our higher cognitions, feelings, or desires, and so different from them in degree only, but are instead distinct from our higher states in kind also; and these distinct sensible states are not dependent on our higher states and so on a commitment to the value of humanity, for example. For this reason, a choice in favour of sensible states and in opposition to the moral law need in no way undermine its own foundations and thus be incoherent, as Korsgaard and Sidgwick argue, but instead only immoral. Because Kant does not reduce the problem of immoral choice to one of insufficient reflection and ensuing confusion, he does not view moral progress in cognitive terms alone, whether in the form of a clearer understanding of the moral law, improved judgment in applying it, or deeper insight into our own nature as practical agents. Kant instead recognizes the crucial importance of cultivating our feelings and desires over the course of a lifetime both as a way to make ourselves worthy of the humanity within us directly and also as a way to facilitate future moral choices. According to Bertrand Russell, Nietzsche's only value is the flourishing of the exceptional individual. The well-being of ordinary people is, in itself, without value. Yet there are passages in Nietzsche that appear to regard the flourishing of the community as a whole alongside, perhaps even above, that of the exceptional individual. The ten essays that comprise this volume wrestle with the tension between individual and community in Nietzsche's writings. Some defend a reading close to Russell's. Others suggest that Nietzsche's highest (...) value is the flourishing of the community as a whole and that exceptional individuals find their highest value only in promoting that flourishing. In viewing Nietzsche from the perspective of community, the essays also cast new light on other aspects of his philosophy, for instance, his ideal of scientific research and his philosophy of language. Two definitions of Mach’s principle are proposed. Both are related to gauge theory, are universal in scope and amount to formulations of causality that take into account the relational nature of position, time, and size. One of them leads directly to general relativity and may have relevance to the problem of creating a quantum theory of gravity.

We develop the theory of layered posets and use the notion of layering to prove a new iteration theorem is κ-cc, as long as direct limits are used sufficiently often. This iteration theorem simplifies and generalizes the various chain condition arguments for universal Kunen iterations in the literature on saturated ideals, especially in situations where finite support iterations are not possible. We also provide two applications:1 For any n≥1, a wide variety of <ωn−1-closed, ωn+1-cc posets of size ωn+1 can consistently (...) be absorbed by quotients of saturated ideals on ωn.2 For any n∈ω, the tree property at ωn+3 is consistent with Chang’s conjecture ↠. Clinical delusions are difficult to investigate in the laboratory because they co-occur with other symptoms and with intellectual impairment. Partly for these reasons, researchers have recently begun to use hypnosis with neurologically intact people in order to model clinical delusions. In this paper we describe striking analogies between the behavior of patients with a clinical delusion of mirrored self misidentification, and the behavior of highly hypnotizable subjects who receive a hypnotic suggestion to see a stranger when they look in the (...) mirror. Based on these analogies, we argue that the use of hypnosis is a reliable method to investigate the surface features of clinical delusions. But to what extent can hypnosis successfully recreate delusions? Can it also contribute to a better understanding of delusion formation? Although clinical delusions and hypnotically induced beliefs are different in etiology, some analogies can be identified in the underlying processes that characterise them, based on the two-factor theory of delusion formation. Leonard B. Meyer has proposed that when musical tendencies or expectations are inhibited by musical ambiguity or the unexpected, those inhibitions and their subsequent resolutions are likely to be provocative or engaging. Music, Tendencies and Inhibitions will explore the relevance of this theory to music and various other disciplines, and to psychological and natural processes. Each chapter consists of two parts: a presentation and consideration of an aspect of Meyer's theory, and a more associative or rhapsodic section of "Reflections" on (...) this aspect. The book will focus on Meyer's aesthetic rather than his music-theoretical proclivities, and is intended for academics and students in various fields as well as educated non-academics. The music scene is fluctuating, Meyer suggests, in that new and original styles or techniques are continuously emerging or developing on a small scale; it is static in that many of these developments seem unrelated, and are not likely to be grasped or progress as a whole. It will be posited that this theory foreshadowed and reflects important ideologies of contemporary culture, including postmodernism. (shrink)

This is necessary because various authors try to understand this concept so that they can define the future model of European citizenship. If there exist different forms of citizenship, one of the tasks of investigation is to determine reasons for these differences. This article redraws the history of this current thoughts in a comparative perspective to be able to deal with its meaning in the context of the European construction. (...) It is suggested, following a proposal made recently by Smolin, that the most fundamental law of the universe takes this form: Among the set of all possible universes compatible with an irreducibly minimal set of structural constraints, the actually realized universe is the one which maximizes a mathematically well-defined number (the variety) that measures the structural variety of the universe (in the totality of its history). This gives expression to Leibniz's idea that the actual universe gives “the greatest variety possible, (...) but with the greatest possible order.” Two models are proposed in which the idea can be realized and its consequences tested; both are discrete in nature and satisfy highly nonlocal laws. In such a scheme a unique (finite) universe is called into being by the fundamental requirement of maximal variety (for given definition of the variety), which it is conjectured could have such a powerful ordering effect that space, time, the currently known laws of physics, and the observed structure of the universe could all appear as emergent consequences of the single underlying law. While some may argue that universities are in a state of crisis, others claim that we are living in a post-university era; a time after universities. If there was a battle for the survival of the institution it is over and done with. The buildings still stand. Students enrol and may attend lectures, though most do not. But virtually nothing real remains. What some mistakenly take to be a university is, in actuality, an “uncanny” spectral presence. The encompassing ethico-philosophical question (...) is this: what is it about spectral space and the feeling of absence with regard to the university that is important to understand? The Spectral University is characterized by the absence of what used to give the university its constitutive form and structure; of what is essential to the university as an important place of learning and growth. Of all his contributions to philosophy it is perhaps Kant's writings on ethics that are the most widely read. Kant himself posed the famous question: What should I do? In this engaging and lucid book Julian Wuerth explores the question that frames Kant's moral philosophy and places it in a contemporary context, offering a stimulating and direct path into Kant's moral thought. He opens with a helpful introduction to the main traditions in ethics prior to Kant before outlining Kant’s (...) theory of human nature - particularly his division of the soul into the faculties of cognition, feeling and desire - which is essential for understanding his moral theory. He then introduces Kant’s arguments in his famous Groundwork of the Metaphysics of Morals , above all for his famous ‘categorical imperative’, explaining the roles of humanity, self-consciousness and freedom in Kant's moral philosophy, and Kant's identification of moral action with autonomy. The second part of the book considers criticisms of Kant’s moral philosophy, including those of Sidgwick and Hegel and asks whether Kant’s categorical imperative can provide moral guidance, before turning to the dominant, constructivist interpretations of Kant's ethics today, as defended by leading philosophers such as O’Neill and Korsgaard. Julian Wuerth argues that constructivist interpretations overlook central features of Kant's account of moral agency and so conflate the demands of virtue and happiness - in effect ascribing to Kant a view that he repeatedly targeted in previous ethical traditions. The final part of the book considers Kant’s moral philosophy from a contemporary perspective. Despite important differences between them, Kant's ethics is shown to resemble virtue ethics in addressing our development as persons, advocating a lifelong process of the cultivation of both our sensible and intellectual cognitive and emotional capacities. My father really looked forward to reading my book and then was terribly disappointed when he found it was unreadable. One of the reader’s reports for the press when it was published said ‘This book is written ordinary English – there are no symbols, little of what could be called technical terminology – but this appearance is entirely misleading’.

An examination of the genre of philosophical autobiography sheds light on the role of personal judgment alongside objective rationality in philosophy. Building on Monk's conception of philosophical biography, philosophical autobiography can be seen as any autobiography that reveals some interplay between life and thought. It is argued that almost all autobiographies by philosophers are philosophical because the recounting of one's own life is almost invariably a form of extended speech act of self-revelation. When a philosopher is the autobiographer, this self-revelation (...) illuminates the interplay between thought, life, and personality. Understanding how this works allows us to address three problems of biography raised by Honderich: how to give an account of something as large and complex as a human life; how a life-story is also a judgment; and how we can justify identifying one part of a causal circumstance as 'the cause'. There is also a new ethical problem raised about the autobiographer's right to make public details of a shared private life. (shrink)

This article examines the entanglement of British criminology and undercover policing (‘Spycops’) in the UK government's response to racism in 1981. The article discusses how criminology took a strategic role within the state's ‘ law and order’ information infrastructure by analysing archival materials related to a Home Office criminological study from that same year. This infrastructure involved an explicit logistical sensibility for gathering and analysing evidence, intelligence, and data about race and racism for a ‘law and order’ agenda focused on (...) policing public order and ‘subversion’. It examines how two senior Home Office officials treated the gathering and utilisation of informational resources produced by criminologists and the Metropolitan Police Special Branch for tactical operations and perception management strategies that targeted racism and anti-racist groups as threats to public order. Reflecting on recent scholarship about security practices enabled by Big Data and machine learning, the article argues for greater attention on criminology and human sciences’ strategic and unnoticed involvement in designing and servicing contemporary ‘law and order’ informational infrastructures. It’s just crazy to think that in your own monoglot culture you’ve got all the essential tools that you need to do philosophy.

You can't go through a graduate programme in other humanities subjects and be considered competent in those fields unless you've done some work on gender and race issues. Feminist work is mainstream. In philosophy that's just not true. You could go through a philosophy degree to this day and never have a class by a woman, never have to encounter anything having to do with feminism or gender or race.
