COVID-19 is a highly contagious infection with no proven treatment. Approximately 2.5% of patients need mechanical ventilation while their body fights the infection.1 Once COVID-19 patients reach the point of critical illness where ventilation is necessary, they tend to deteriorate quickly. During the pandemic, patients with other conditions may also present at the hospital needing emergency ventilation. But ventilation of a COVID-19 patient can last for 2–3 weeks. Accordingly, if all ventilators are in use, there will not be time for (...) patients to ‘queue up’ to wait for those who arrived earlier to recover. Those who need a ventilator will die if they do not receive access to one quickly. Many nations now face the prospect that they failed to prepare appropriately for this foreseen risk of pandemic (another issue worthy of legal analysis) and that their populations will need far more ventilators than the health service can supply. For many weeks, the UK has been anticipating a surge of COVID-19 infections that could leave patients queuing in hospitals for ICU care. Luckily, social distancing has ‘flattened the curve’ and this problem might not arise. There is still a degree of risk, however, and other countries will not be so lucky. At some point, during this pandemic or the next, all countries will need to answer hard questions about whether and when scarce ICU resources (such as ventilators, beds and staff) should be either withheld or withdrawn from certain groups of patients solely for the purpose of providing them to others. Attempts to answer these questions can be found in a wide range of ICU triage protocols and ethical guidance documents, many of which embrace the foundational principle of ‘save the most lives’. In the first part of this paper a logic is defined for propositions whose probability of being true may not be known. A speaker's beliefs about which propositions are true are still interesting in this case. The meaning of propositions is determined by the consequences of asserting them: in this logic there are debates which incur certain costs for the protagonists.The second part of the paper describes the mathematics of the resulting logic which displays several novel features.

Settler-colonialism is founded in environmental racism, and environmental justice is foundational to all forms of decolonialization. Native American groups located in the Gulf Coast Region of the United States are particularly vulnerable to environmental justice issues such as climate change and oil spills due to their geographic location and reliance on the coastal region for economic and social resources. This study used the framework of historical oppression, resilience, and transcendence to explore the historic and contemporary forms of environmental injustice experienced (...) by a Native American tribe in the Gulf Coast region of the United States. This critical ethnography analyzeda series of individual, family, and focus group semi-structured qualitative interviews with a total of 208 participants. Following the critical ethnographic method, data were interpreted through reconstructive analysis using NVivo. Findings of this study reveal the continuing impact of the BP oil spill and difficulty accessing resources following the spill, complicated by the tribe’s lack of federal recognition. Additional themes include the continuing impact of coastal erosion, historical and contemporary land loss, geographic marginalization, and concerns about a loss of tribal identity when tribal members are forced to relocate. Lack of federal tribal recognition has exacerbated all of these issues for this tribe. This study supports national findings that Native American groups experience extensive historic and contemporary environmental injustices and contextualizes these findings for a Native American tribe in the Gulf Coast region of the United States. Recognizing Native American sovereignty is key to addressing the environmental justice issues described. (shrink)

Settler colonialism has contributed to disproportionate health disparities for Indigenous women, however their health experiences during pregnancy are understudied. The first author used qualitative description methodology to conduct life-course semi-structured interviews with 31 women who were members of a state-recognized Gulf Coast Indigenous tribe in the United States. Participants most often described these types of pregnancy experiences: How and From Who Learned About Pregnancy and Birth; Experiences with Miscarriage; Complications During Pregnancy; Working During Pregnancy and Lack of Post-Partum or Maternity (...) Leave and Generational Changes in Pregnancy. We discuss research implications and areas of future research based on participants' experiences. (shrink)

Cultural differences exist in the use of emotion regulation (ER) strategies, but the focus to date has been on intrapersonal ER strategies such as cognitive reappraisal. An emerging literature highlights the importance of interpersonal ER, which utilizes social cues to facilitate the regulation of emotional states. In cultures that place high value on social interconnectedness as integral to their collectivistic self-construal, including East Asian cultures, interpersonal ER strategies may be particularly effective in reducing negative affect but this has not been (...) previously tested. In this study, two groups comprising East Asian ( n = 48) and Western European ( n = 38) participants were randomly assigned to receive a priming narration depicting the use of either interpersonal (e.g., social modeling, perspective taking) or intrapersonal (e.g., cognitive reappraisal) ER strategies during a stressful experience. They were then instructed to utilize similar ER strategies in an emotion reactivity task during which they viewed high arousing negative pictorial stimuli while their heart rate (HR), heart rate variability (high frequency power – HF-HRV) and subjective affective states were measured. First we found that the East Asian group reported higher use of interpersonal ER strategies of social modeling and perspective taking in daily life. During the experimental interpersonal prime exposure, the East Asian group showed elevated HF-HRV (relative to baseline) compared to the Western European group, indicating more adaptive ER, but this pattern was not sustained during the reactivity or recovery phases. Instead, the East Asian group demonstrated increased HF-HRV and decreased HR across both prime conditions. The East Asian group also showed greater decreases in positive affect across the course of the experiment. Furthermore, individual differences in social modeling and individualistic self-construal moderated the effect of the ER prime in the East Asian group at trend levels, and main effects for perspective taking and reappraisal were observed in the Western European group. The findings support the notion that engaging in interpersonal ER strategies may be more beneficial for East Asian groups when immediately exposed to a stressful situation, as these strategies are congruent with cultural context and preferences, but our priming methodology may have limited the longer-term benefits. In this article it is suggested that George Grote’s History of Greece employed a narrative history of Greece in an attempt to resolve the philosophical problem of the compatibility of individual liberty with considerable obligations to society. His philosophical achievement has been largely ignored by modern classical scholarship, even those who follow his lead in treating fifth-century Athens as the epitome of Greek civilization. The present reading of Grote’s History is informed by John Stuart Mill’s use of Athenian examples. Outlining (...) the evidential, moral and spatial parameters of Grote’s fifth-century Athens, it is argued that Grote understood fifth-century Athens to be amodel intellectual and liberal society, in which the performance of obligations by citizens coexisted with individual and political liberty. Grote explained the decline of Athenian power in the fourth century BC by reference to the neglect of obligations, and in doing so, married historical explanation to political theory. (shrink)

This article looks at the way the Brazilian writer and educator Nísia Floresta addresses issues of race and class within her construction of nationhood. This is achieved through a consideration of the specific subject of maternal breast-feeding as discussed by Floresta in two texts, written in Brazil and France, respectively. A comparison of these works reveals a very different engagement with race and class factors in determining women's claim to citizenship. Floresta, in common with early 19th-century European feminism, believed this (...) claim to lie within the domestic sphere, primarily in the role of mother and educator. The article considers how, as a vital aspect of that role, she portrays maternal breast-feeding as both natural and patriotic. It also highlights the extent to which Floresta was influenced by the prevailing concerns of her contemporaries regarding the risks of wet nursing and the threat posed by household slaves, before going on to consider how this discourse leads Floresta to exclude black slave women from her vision of patriotic motherhood, while acknowledging the maternity of women of all classes in a European context. Patriotic concerns, shaped by racial prejudices, overshadow Floresta's feminism, prohibiting the kind of unifying discourse of motherhood, which she claimed to profess. (shrink)

Recent research in the field of New Institutionalist analysis has developed the view that institutions are grounded not only upon authoritative rules but also upon accepted practices and narratives. In this paper I am interested in the ways in which honorific practices and accounts of identity set out in ancient Greek inscriptions contribute towards the persistence of polis institutions in the Hellenistic period. A diachronic survey of Erythraian inscriptions of the classical and Hellenistic periods gives an impression of the adaptation (...) and proliferation of forms of discourse established in the classical period. It demonstrates the ongoing prominence of the rhetoric of identity in conversations that went on not only between peer polities and within real or imagined kinship groups but also in negotiations between powerful and weak state entities and in inward-facing discourses on euergetism. The regulation of stem cell research is an issue that has drawn much comment, criticism and even judicial arbitration in recent years. An emerging issue, addressed in this article, is how the fruits of that research-stem cell medicine-are likely to be regulated en route from lab to market. Taking account of the ethical, legal, social and safety issues raised by stem cell medicine and the goals of governance, the article explains the relevant regulatory instruments (e.g. the draft UK Stem Cell (...) Bank Code, the EU Directive on Human Tissue, the EU Directives on medical products and devices, and the Human Tissue Act 2004) and critically examines the framework they provide. (shrink)

The purpose of this article is to understand how historical oppression has undermined health through environmental injustices that have given rise to food insecurity. Specifically, the article examines ways in which settler colonialism has transformed and contaminated the land itself, impacting the availability and quality of food and the overall health of Indigenous peoples. Food security and environmental justice for Gulf Coast, state-recognized tribes has been infrequently explored. These tribes lack federal recognition and have limited access to recourse and supplemental (...) resources as a result. This research fills an important gap in the literature through exploring the intersection of environmental justice and food insecurity issues for this population. Partnering with a community-advisory board and using a qualitative descriptive methodology, 31 Gulf Coast Indigenous women participated in semi-structured interviews about their healthcare experiences and concerns. Through these interviews, participants expressed concerns about (a) the environmental impacts of pollution on the contamination of food and on the health of tribal members; and (b) the impact of these changes on the land, such as negatively impacting gardening practices. The authors of this study document how environmental changes have compounded these concerns and contribute to the overall pollution of food and water sources and unviability of subsistence practices, severely effecting tribal members’ health. In conclusion, we show how social and environmental justice issues such as pollution, industry exploitation, and climate change perpetuate the goals of settler colonialism through undermining cultural practices and the overall health of Indigenous peoples. When people retell stories, what guides their retelling? Most previous research on story retelling and story comprehension has focused on information accuracy as the key measure of stability in transmission. This paper suggests that there is a second, affective, dimension that provides stability for retellings, namely the audience affect of surprise. In a large-sample study with multiple iterations of retellings, we found evidence that people are quite accurate in preserving all degrees of surprisingness in serial reproduction – even when the (...) event that produced the surprisingness in the original story is dropped or changed. Thus, we propose that the preservation of affect is an implicit goal of retelling: not merely do retellers recall highly surprising events better, but rather they register all levels of surprisingness precisely and aim to surprise their implied audience to same degree. To address the complex challenge of global antimicrobial resistance (AMR), a pandemic treaty should include mechanisms that 1) equitably address the access gap for antimicrobials, diagnostic technologies, and alternative therapies; 2) equitably conserve antimicrobials to sustain effectiveness and access across time and space; 3) equitably finance the investment, discovery, development, and distribution of new technologies; and 4) equitably finance and establish greater upstream and midstream infection prevention measures globally. Biodiversity, climate, and nuclear governance offer lessons for addressing these challenges.

Data sharing – broadly defined as the exchange of health-related data among multiple controllers and processors – has gained increased relevance in the health sciences over recent years as the need and demand for collaboration has increased. This includes data obtained through healthcare provisions, clinical trials, observational studies, public health surveillance programs, and other data collection methods. The practice of data sharing presents several notable challenges, however. Compliance with a complex and dynamic regulatory framework is essential, with the General Data (...) Protection Regulation being a prominent example in a European context. Recent regulatory developments related to clinical trial transparency, trade secrecy, data access, AI training data, and health data spaces further contribute to the difficulties. Simultaneously, government initiatives often encourage scientists to embrace principles of “open data” and “open innovation.” The variety of regulations in this domain has the potential to impede widespread data sharing and hinder innovation. This edited volume, therefore, compiles comparative case studies authored by leading scholars from diverse disciplines and jurisdictions. The book aims to outline the legal complexities of data sharing. By examining real-world scenarios from diverse disciplines and a global perspective, it explores the normative, policy, and ethical dilemmas that surround data sharing in the health sciences today.
