In this paper we discuss ethical implications of the use of mobile phone apps in the control of the COVID-19 pandemic. Contact tracing is a well-established feature of public health practice during infectious disease outbreaks and epidemics. However, the high proportion of pre-symptomatic transmission in COVID-19 means that standard contact tracing methods are too slow to stop the progression of infection through the population. To address this problem, many countries around the world have deployed or are developing mobile phone apps (...) capable of supporting instantaneous contact tracing. Informed by the on-going mapping of ‘proximity events’ these apps are intended both to inform public health policy and to provide alerts to individuals who have been in contact with a person with the infection. The proposed use of mobile phone data for ‘intelligent physical distancing’ in such contexts raises a number of important ethical questions. In our paper, we outline some ethical considerations that need to be addressed in any deployment of this kind of approach as part of a multidimensional public health response. We also, briefly, explore the implications for its use in future infectious disease outbreaks. (shrink)

The concept of dignity is widely used in society, particularly in reference to human rights law and bioethics. Several conceptions of dignity are identified, falling broadly within two categories: full inherent dignity (FID) and non-inherent dignity (NID). FID is a quality belonging equally to every being with full moral status, including all members of the human natural kind; it is permanent, unconditional, indivisible and inviolable. Those beings with FID ought to be treated deferentially by others by virtue of their belonging (...) to a noble caste. FID grounds fundamental human rights, such as the rights to freedom and equality.The concept of dignity forms a network of interconnected ideas related to worth and value particularly within legal and ethical discourse; it is a rich and meaningful concept, irreducible to one or two quasi-legal principles. Fundamentally, dignity matters because it forms the foundation of civilized society; without it, serious abuse of people is more likely to occur. (shrink)

This paper responds to the commentaries from Stacy Carter and Alan Cribb. We pick up on two main themes in our response. First, we reflect on how the process of setting standards for empirical bioethics research entails drawing boundaries around what research counts as empirical bioethics research, and we discuss whether the standards agreed in the consensus process draw these boundaries correctly. Second, we expand on the discussion in the original paper of the role and significance of the concept of (...) ‘integrating’ empirical methods and ethical argument as a standard for research practice within empirical bioethics. Globalization theories posit organizational convergence, suggesting that Codes of Ethics will become commonplace and include greater consideration of global issues. This study explores the degree to which the Codes of Ethics of 157 corporations on the Global 500 and/or Fortune 500 lists include the "third generation" of corporate social responsibility. Unlike first generation ethics, which focus on the legal context of corporate behavior, and second generation ethics, which locate responsibility to groups directly associated with the corporation, third generation ethics transcend (...) both the profit motive and the immediate corporate environment. Third generation ethics are grounded in responsibilities to the larger interconnected environment. The results of the study suggest convergence, insofar as Codes of Ethics are becoming standard communication features of corporations across region and industrial sector but still manifest a primary concern with profits and those behaviors which are mandated by law. Only corporations headquartered in the European Union demonstrate a significant degree of global consciousness and reflexivity. However, there is some evidence that third generation ethics and thinking are becoming part of the corporate landscape. More then three quarters of the corporations made at least some reference to third generation ethics. (shrink)

A growing body of literature critical of ethics review boards has drawn attention to the processes used to determine the ethical merit of research. Citing criticism on the bureaucratic nature of ethics review processes, this literature provides a useful provocation for (re)considering how the ethics review might be enacted. Much of this criticism focuses on how ethics review boards _deliberate,_ with particular attention given to the lack of transparency and opportunities for researcher recourse that characterise ethics review processes. Centered specifically (...) on the conduct of ethics review boards convened within university settings, this paper draws on these inherent criticisms to consider the ways that ethics review boards might enact more communicative and deliberative practices. Outlining a set of principles against which ethics review boards might establish strategies for engaging with researchers and research communities, this paper draws attention to how _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ for the ethics review might be enacted in the day-to-day practice of the university human ethics review board. This paper develops these themes via a conceptual lens derived from Habermas’ (The theory of communicative action. Volume 1: Reason and the rationalization of society, 1984 ) articulation of ‘communicative action’ and Fraser’s (Social Text, 25(26), 56–80, 1990 ) consideration of ‘strong publics’ to cast consideration of the role that human ethics review boards might play in supporting university research cultures. _Deliberative communication_, _Engagement with researchers_ and the _Distribution of responsibility_ provide useful conceptual prompts for considering how ethics review boards might undertake their work. Population-level biomedical research offers new opportunities to improve population health, but also raises new challenges to traditional systems of research governance and ethical oversight. Partly in response to these challenges, various models of public involvement in research are being introduced. Yet, the ways in which public involvement should meet governance challenges are not well understood. We conducted a qualitative study with 36 experts and stakeholders using the World Café method to identify key governance challenges and explore how public involvement can (...) meet these challenges. This brief report discusses four cross-cutting themes from the study: the need to move beyond individual consent; issues in benefit and data sharing; the challenge of delineating and understanding publics; and the goal of clarifying justifications for public involvement. The report aims to provide a starting point for making sense of the relationship between public involvement and the governance of population-level biomedical research, showing connections, potential solutions and issues arising at their intersection. We suggest that, in population-level biomedical research, there is a pressing need for a shift away from conventional governance frameworks focused on the individual and towards a focus on collectives, as well as to foreground ethical issues around social justice and develop ways to address cultural diversity, value pluralism and competing stakeholder interests. There are many unresolved questions around how this shift could be realised, but these unresolved questions should form the basis for developing justificatory accounts and frameworks for suitable collective models of public involvement in population-level biomedical research governance. Background Policy decisions about childhood vaccination require consideration of multiple, sometimes conflicting, public health and ethical imperatives. Examples of these decisions are whether vaccination should be mandatory and, if so, whether to allow for non-medical exemptions. In this article we argue that these policy decisions go beyond typical public health mandates and therefore require democratic input.Methods We report on the design, implementation, and results of a deliberative public forum convened over four days in Ontario, Canada, on the topic of childhood (...) vaccination.Results 25 participants completed all four days of deliberation and collectively developed 20 policy recommendations on issues relating to mandatory vaccinations and exemptions, communication about vaccines and vaccination, and AEFI (adverse events following immunization) compensation and reporting. Notable recommendations include unanimous support for mandatory childhood vaccination in Ontario, the need for broad educational communication about vaccination, and the development of a no-fault compensation scheme for AEFIs. There was persistent disagreement among deliberants about the form of exemptions from vaccination (conscience, religious beliefs) that should be permissible, as well as appropriate consequences if parents do not vaccinate their children.Conclusions We conclude that conducting deliberative democratic processes on topics that are polarizing and controversial is viable and should be further developed and implemented to support democratically legitimate and trustworthy policy about childhood vaccination. Lucy O'Brien has argued that defenders of the object-dependence of singular thought should attend to mental agency. A recent trend in action theory, towards what John Maier calls ‘agentive modality’, suggests that we conceive agency in terms of the exercise of abilities, and this is how I propose to approach O'Brien's challenge. For Gareth Evans, an early defender of object-dependence, maintained that thinking is the exercise of a complex of abilities. The debate about object-dependence gives way to the question (...) whether we have what I call dedicated singular mental abilities. In arguing that we do, I defend the thesis of object-dependence. It’s not implausible to think that whenever I have a justified noninferential belief that p, it is caused by a seeming that p. It’s also tempting to think that something contributes to the justification of my belief only if I hold my belief because of that thing. Thus, given that many of our noninferential beliefs are justified and that we hold them because of seemings, one might be inclined to hold a view like Phenomenal Conservatism, according to which seemings play (...) a crucial role—perhaps the only crucial role—in the justification of our noninferential beliefs. But Phenomenal Conservatism seems to conflict, in a number of ways, with externalist accounts of justification. As a result, the attractiveness of the intuitions appealed to in support of views like Phenomenal Conservatism present something of a challenge to externalism. The purpose of this paper is to deal with that challenge by developing and defending an externalist-friendly account of the role of seemings in the formation and justification of our noninferential beliefs—an account that incorporates what is attractive in views like Phenomenal Conservatism. Because this externalist-friendly account is compatible with both externalist accounts of justification and the plausible elements of views like Phenomenal Conservatism, the challenge to externalism inspired by such views is thereby undermined. Our commentary and translation is intended to provide English readers access to the context, influences, and themes that make the article an extraordinarily important work in (...) the history of twentieth-century rhetoric. In this article, Perelman offers a powerful critique of first philosophies and anticipates the problems of radical postmodernity. "First Philosophies" remains a strikingly elegant attempt to foil what Foucault (1984, 41-42) has called the "Enlightenment blackmail of reason," the assumption held by logical positivists and radical skeptics that if reason does not yield absolute and eternal Enlightenment knowledge, there can be no knowledge.Perelman and Lucie Olbrechts-Tyteca's New Rhetoric project avoids Enlightenment blackmail by charting a third way between logical positivism and radical relativism, and "First Philosophies" sets forth the project's philosophical blueprint. Commencing in 1947 and culminating in 1958 with the publication of Traité de l'argumentation: La nouvelle rhétorique, Perelman and Olbrechts-Tyteca sought, discovered, and developed a philosophical system designed as a rapprochement between dialectic (reason and logic) and rhetoric (the art of adapting arguments to audiences). Historians of rhetoric judge the work a "grand revolution" (Meyer 1999, 259), believing it marks a rhetorical renaissance in Europe, and suggest nothing like it will appear for another 100 years after its publication (Johnstone 1971). The New Rhetoric project influenced Gadamer and a host of post-war European and American thinkers (Mootz 1998). Michael Leff calls the 1970 English translation of Traité a "bombshell" (1994, 510). Beyond its historical importance, Crosswhite suggests that the New Rhetoric project is "the single most important event in contemporary rhetorical theory" (1996, 35)and "First Philosophies" marks Perelman's turn from logical [End Page 177] positivism to rhetoric, offering prescient answers to the post-World War II crises of reason, and the ideas in the article provide the Traité'sphilosophical glue (see in particular the English translation, 62).Perelman joined many post-war theorists, including Horkheimer and Adorno (1972), in the resistance to the reign of a disembodied Enlightenment rationality. Emmanuel Levinas was a significant contributor to the field of philosophy, phenomenology and religion. A key interpreter of Husserl, he stressed the importance of attitudes to other people in any philosophical system. For Levinas, to be a subject is to take responsibility for others as well as yourself and therefore responsibility for the one leads to justice for the many. He regarded ethics as the foundation for all other philosophy, but later admitted it could also be the foundation for theology. (...) Michael Purcell outlines the basic themes of Levinas' thought and the ways in which they might be deployed in fundamental and practical theology, and the study of the phenomenon of religion. This book will be useful for undergraduate and graduate students in philosophy, theology and religious studies, as well as those with a theological background who are approaching Levinas for the first time. The release of genetically engineered organisms into the shared environment raises scientific, ethical, and societal issues. Using some form of democratic deliberation to provide the public with a voice on the policies that govern these technologies is important, but there has not been enough attention to how we should connect public deliberation to the existing regulatory process. Drawing on lessons from previous public deliberative efforts by U.S. federal agencies, we identify several practical issues that will need to be addressed if (...) relevant federal agencies are to undertake public deliberative activities to inform decision‐making about gene editing in the wild. We argue that, while agencies may have institutional capacity to undertake public deliberative activities, there may not be sufficient political support for them to do so. Advocates of public deliberation need to make a stronger case to Congress about why federal agencies should be encouraged and supported to conduct public deliberations. (shrink)

Metaethical constitutivists attempt to explain reasons or normativity in terms of what is constitutive of agency. Michael Smith has recently defended a novel form of constitutivism that he argues provides a rational foundation for morality. This article develops three main objections centered on (1) the normative significance of Smith’s conception of ideal agency, (2) whether that conception begs the question in favor of the rationality of moral requirements, and (3) whether Smith’s constitutivism provides a plausible account of the content (...) of moral requirements. The conclusion is that Smith’s constitutivism, at least in its present form, is not persuasive. (shrink)

Intuitionism can be seen as a verificationism restricted to mathematical discourse. An attempt to generalize intuitionism to empirical discourse presents various challenges. One of those concerns the logical and semantical behavior of what has been called ' empirical negation'. An extension of intuitionistic logic with empirical negation was given by Michael De and a labelled tableaux system was there shown sound and complete. However, a Hilbert-style axiom system that is sound and complete was missing. In this paper we provide (...) the missing axiom system which is shown sound and complete with respect to its intended semantics. Over and above the probable peaking of worldwide oil production as a current reality, the arrival of hard limits on all energy resources is very much nearer in the future than many people realize. The public discourse on Peak Oil and the associated arrival of hard limitson energy availability has attracted more than its share of brilliant and creative minds. In addition to scientific and technical analysts, thisgroup includes a fair number of generalists who have engaged in broader forms of (...) reflection upon the likely economic, social, political, and cultural effects of Peak Oil and other hard energy limits on the structure of current world civilization. In this paper, I select for examination three such generalists who are both especially talented and widely read by those having an interest in this topic: James Howard Kunstler, John Michael Greer, and Dmitri Orlov. My intention is to survey their central ideas in turn, with a view to forming a reasonably well-developed and concrete notion as to how the impending arrival of hard limits on energy consumption will affect the structure of built space in coming decades. I focus both on the macro-infrastructural level and on what one might term the micro-infrastructural level of the built space within which the denizens of contemporary industrial civilization live their daily lives. Theprincipal focus of the discussion will be on the situation in the United States, though many of the lines of argument presented may be applied much more broadly if suitably adjusted in light of locally prevailing conditions elsewhere. In Christ Meets Me Everywhere, Michael Cameron argues that Augustine wanted to train readers of Scripture to transpose themselves into the texts in the same way he did, by the same process of figuration that he found at its core. Tracking Augustine's developing practice of self-transposition into the figures of the biblical texts over the course of his entire career, Cameron shows that this practice is the key to Augustine's hermeneutics.

Using critical discourse analysis this study analyzes how ideologies and national identities are discursively constructed through editorial and opinion commentaries in two English-language newspapers from China and Japan on an international incident involving the two countries. The first four editorials/opinions on the East China Sea trawler collision incident from the China Daily and Daily Yomiuri are analyzed. Findings show that a variety of discursive strategies are adopted by the newspapers to construct national identity and intergroup relations, including: 1) the discursive (...) categorization of group identity, 2) the discursive re-categorization of intergroup relations, and 3) the discursive re-categorization of intragroup relations. Even though both newspapers are products of globalization, and purport to target international and cosmopolitan audiences, the reporting of the East China Sea incident closely adheres to official narratives and discourses of the respective governments. Michael-John Turp | : There is little consensus concerning the truth or reference conditions for evaluative terms such as “good” and “bad.” In his paper “Good and Evil,” Geach proposed that we distinguish between attributive and predicative uses of “good.” Foot, Thomson, Kraut, and others have put this distinction to use when discussing basic questions of value theory. In §§1-2, I outline Geach’s proposal and argue that attributive evaluation depends on a prior grasp of the kind of thing that (...) is evaluated, which is another way of saying a prior grasp of a thing’s nature. In §§3-4, I discuss the evaluation of artifacts, which provide the clearest examples of attributive evaluation. This allows me to address a series of problems apparently facing the idea of attributive goodness. In §5, I consider the neo-Aristotelian idea that we can extend attributive accounts of goodness to human lives, and I pay attention to Foot’s account of natural goodness. This leads me to consider the goodness of human life as a whole in §6. At this point. I depart from Geach’s approach and argue that questions of attributive goodness finally give rise to questions of predicative or absolute goodness. | : Il y a peu de consensus sur la vérité ou les conditions de référence pour les termes évaluatifs tels que « bon » et « mauvais ». Walgreen, Jr. Chair and Co-Director, Program in Law and Philosophy at the University of Illinois College of Law, delivered Duke Law's Annual Brainerd Currie Memorial Lecture entitled "The Elusive Quest for a Constitutional Right to Liberty." Heralding a push for higher education to adopt a more global perspective, the term "globalizing knowledge" is today a popular catchphrase among academics and their circles. The complications and consequences of this desire for greater worldliness, however, are rarely considered critically. In this groundbreaking cultural-political sociology of knowledge and change, Michael D. Kennedy rearticulates questions, approaches, and case studies to clarify intellectuals' and institutions' responsibilities in a world defined by transformation and crisis. _Globalizing Knowledge_ introduces the stakes of globalizing (...) knowledge before examining how intellectuals and their institutions and networks shape and are shaped by globalization and world-historical events from 2001 through the uprisings of 2011–13. But Kennedy is not only concerned with elaborating how wisdom is maintained and transmitted, he also asks how we can recognize both interconnectedness and inequalities, and possibilities for more knowledgeable change within and beyond academic circles. Subsequent chapters are devoted to issues of public engagement, the importance of recognizing difference and the local's implication in the global, and the specific ways in which knowledge, images, and symbols are shared globally. Considerations from evolutionary biology lead Michael Ruse, among others, to a naturalistic turn in philosophy. I assess some of the pragmatic and skeptical conclusions concerning ethics, religion, and epistemology that Ruse draws from his evolutionary naturalism. Finally, I argue that there is an essential tension between science and religion which forecloses the possibility of an ultimate reconciliation between the two as they are now understood.

"First Philosophies" remains a strikingly elegant attempt to foil what Foucault (1984, 41-42) has called the "Enlightenment blackmail of reason," the assumption held by logical positivists and radical skeptics that if reason does not yield absolute and eternal Enlightenment knowledge, there can be no knowledge.Perelman and Lucie Olbrechts-Tyteca's New Rhetoric project avoids Enlightenment blackmail by charting a third way between logical positivism and radical relativism, and "First Philosophies" sets forth the project's philosophical blueprint. Commencing in 1947 and culminating in 1958 with the publication of Traité de l'argumentation: La nouvelle rhétorique, Perelman and Olbrechts-Tyteca sought, discovered, and developed a philosophical system designed as a rapprochement between dialectic (reason and logic) and rhetoric (the art of adapting arguments to audiences). Historians of rhetoric judge the work a "grand revolution" (Meyer 1999, 259), believing it marks a rhetorical renaissance in Europe, and suggest nothing like it will appear for another 100 years after its publication (Johnstone 1971). The New Rhetoric project influenced Gadamer and a host of post-war European and American thinkers (Mootz 1998). Michael Leff calls the 1970 English translation of Traité a "bombshell" (1994, 510). Beyond its historical importance, Crosswhite suggests that the New Rhetoric project is "the single most important event in contemporary rhetorical theory" (1996, 35)and "First Philosophies" marks Perelman's turn from logical [End Page 177] positivism to rhetoric, offering prescient answers to the post-World War II crises of reason, and the ideas in the article provide the Traité'sphilosophical glue (see in particular the English translation, 62).Perelman joined many post-war theorists, including Horkheimer and Adorno (1972), in the resistance to the reign of a disembodied Enlightenment rationality. However, Perelman identified what Habermas (1987, 119) would later call the "performative contradiction" in the conclusion that radical skepticism was the only alternative to Enlightenment rationality. In "First Philosophies," Perelman responds directly to Sartre's 1943 Being and Nothingness (198; see translation below) by exposing the failure of radical skeptics to see that they had been held hostage by Enlightenment blackmail in accepting the Enlightenment criterion for truth, rejecting it, and then making skepticism an absolute. Indeed, "First Philosophies" navigates from this performative contradiction to chart a third way between Enlightenment rationality and radical skepticism with an approach that he labels regressive philosophy. Regressive philosophy, Perelman argues, provides the human community with a mode of philosophical reasoning located between the extremes of Enlightenment rationality and radical skepticism. In this space between extremes, Perelman identifies contingent truths and values dependent on a rhetorical mode of reasoning, one making moral judgments possible.To best understand "First Philosophies," we recognize the importance of historical context in the development of social theories of knowledge (see Delacampagne 1999; Kennedy 1999). The intellectual networks in which philosophers operate also influence the development of philosophical systems, as Randall Collins has aptly documented. In addition to historical context and intellectual networks, Frederick Beiser has recently noted: "[t] he best introduction to any philosophy is the biography of the person who created it" (1999, 5). He argues that textual analysis alone cannot illuminate the motivation or meaning of a philosophy. A sense of Perelman's biography and the cultural influences that gave rise to "First Philosophies" are necessary for a proper understanding of its themes. Kann man den "Theologen unter den Klassikern" aus dem Geflecht der Beziehungen zu Goethe, Schiller und Wieland losen, aus seinen Beziehungen zum Hof, zur Stadt, zur Schule in Weimar? Andererseits lebte er autonom (...) aus der Idee, das Erbe der Reformation fur eine neue Zeit umformen zu mussen.
