Cognition is embodied when it is deeply dependent upon features of the physical body of an agent, that is, when aspects of the agent's body beyond the brain play a significant causal or physically constitutive role in cognitive processing. In general, dominant views in the philosophy of mind and cognitive science have considered the body as peripheral to understanding the nature of mind and cognition. Proponents of embodied cognitive science view this as a serious mistake. Sometimes the nature of the (...) dependence of cognition on the body is quite unexpected, and suggests new ways of conceptualizing and exploring the mechanics of cognitive processing. Embodied cognitive science encompasses a loose-knit family of research programs in the cognitive sciences that often share a commitment to critiquing and even replacing traditional approaches to cognition and cognitive processing. Empirical research on embodied cognition has exploded in the past 10 years. As the bibliography for this article attests, the various bodies of work that will be discussed represent a serious alternative to the investigation of cognitive phenomena. Relatively recent work on the embodiment of cognition provides much food for thought for empirically-informed philosophers of mind. This is in part because of the rich range of phenomena that embodied cognitive science has studied. But it is also in part because those phenomena are often thought to challenge dominant views of the mind, such as the computational and representational theories of mind, at the heart of traditional cognitive science. And they have sometimes been taken to undermine standard positions in the philosophy of mind, such as the idea that the mind is identical to, or even realized in, the brain. (shrink)

The events surrounding COVID-19, combined with the mandatory quarantines widely imposed in Asia and Europe since the virus outbreak, have reignited discussion of the balance between individual rights and liberties and public health during epidemics and pandemics. This article analyses this issue from the perspectives of precaution and necessity. There is a difficult relationship between these two seemingly opposite principles, both of which are frequently invoked in this domain. Although the precautionary principle encourages the use of quarantines, including mandatory quarantines, (...) and associated restrictive measures, the principle of necessity puts a break on such measures. The COVID-19 pandemic reveals once again the different interrelations between these two principles. However, the alleged conflict between the PN and the PP is based on a superficial analysis. The relation between these two principles is far more complex, as this article will demonstrate. (shrink)

Although Chinese law imposes informed consent for medical treatments, the Chinese understanding of this requirement is very different from the European one, mostly due to the influence of Confucianism. Chinese doctors and relatives are primarily interested in protecting the patient, even from the truth; thus, patients are commonly uninformed of their medical conditions, often at the family’s request. The family plays an important role in health care decisions, even substituting their decisions for the patient’s. Accordingly, instead of personal informed consent, (...) what actually exists is ‘family informed consent’. From a Western perspective, these features of Chinese law and Chinese culture might seem strange, contradicting our understanding of doctor-patient relationship and even the very essence of self-determination and fundamental rights. However, we cannot forget the huge influence of cultural factors in these domains, and that ‘Western’ informed consent is grounded on the individualistic nature of Western culture. This article will underline the differences between the Western and the Chinese perspectives, clarifying how each of them must be understood in its own cultural environment. But, while still respecting Chinese particularities, this paper advocates that China adopt patient individual informed consent because this is the only solution compatible with human dignity and human rights. Greenwashing is a phenomenon that is linked to scandals that often occur at the supply-chain level. Nevertheless, research on this subject remains in its infancy; much more is needed to advance our understanding of stakeholders’ reactions to greenwashing. We propose here a new typology of greenwashing, based on the locus of discrepancy, i.e. the point along the supply-chain where the discrepancy between ‘responsible words’ and ‘irresponsible walks’ occurs. With three experiments, we tested how the different forms of greenwashing affect stakeholders’ (...) reactions, from both ethical and business perspectives. We developed our hypotheses by building on attribution theory, which seeks to account for how observers construct perceptions about events. We had anticipated that the more internal, controllable and intentional the discrepancy is, the greater the blame attributed to a company is, and the lower the intention to invest will be. When greenwashing occurs at a company level, this results in a higher level of blame attribution, while the intention to invest falls. Indirect greenwashing refers to a misbehaviour perpetrated by a supplier who claims to be sustainable, and which results in a less negative impact on a supplied company. We also propose the vicarious greenwashing, which occurs when the behaviour of a supplier is in breach of a company’s claims of sustainability. This type of greenwashing is nevertheless detrimental to investment. The findings here advance our understanding of how greenwashing shapes stakeholders’ reactions, and highlight the need for the careful management of the supply-chain. (shrink)

Many arguments have been made against gene editing. This paper addresses the commonly invoked argument that gene editing violates human dignity and is ultimately a subversion of human nature. There are several drawbacks to this argument. Above all, the concept of what human dignity means is unclear. It is not possible to condemn a practice that violates human dignity if we do not know exactly what is being violated. The argument’s entire reasoning is thus undermined. Analyses of the arguments involved (...) in this discussion have often led to the conclusion that gene editing contravenes the principle of genetic identity (genetic immutability) thereby subverting a requisite of human dignity and ultimately threatening human nature. This paper refutes these arguments and shows that any opposition to gene editing cannot rely on the human dignity argument. (shrink)

The Director-General of the WHO has suggested that China’s approach to the COVID-19 crisis could be the standard of care for global epidemics. However, as remarkable as the Chinese strategy might be, it cannot be replicated in other countries and certainly not in Europe. In Europe, there is a distribution of power between the European Union and its member states. In contrast, China’s political power is concentrated in the central government. This enables it to take immediate measures that affect the (...) entire country, such as massive quarantines or closing borders. Moreover, the Chinese legal framework includes restrictions on privacy and other human rights that are unknown in Europe. In addition, China has the technological power to easily impose such restrictions. In most European countries, that would be science fiction. These conditions have enabled China to combat epidemics like no other country can. However, the WHO might have been overoptimistic. The Chinese standard of care for treating COVID-19 also raises problematic issues for human rights, and the real consequences of these actions remain to be seen. (shrink)

Gilead et al. claim such diversity requires a multi-process theory, and thus is out of reach for PP, which postulates a universal canonical computation. In recent decades, psychological research on the effects of mindfulness-based interventions has greatly developed and demonstrated a range of beneficial outcomes in a variety of populations and contexts. Yet, the question of how to foster subjective well-being and happiness remains open. Here, we assessed the effectiveness of an integrated mental training program The Art of Happiness on psychological well-being in a general population. The mental training program was designed to help practitioners develop new ways to nurture their own happiness. This (...) was achieved by seven modules aimed at cultivating positive cognition strategies and behaviors using both formal and informal practices. The program was conducted over a period of 9 months, also comprising two retreats, one in the middle and one at the end of the course. By using a set of established psychometric tools, we assessed the effects of such a mental training program on several psychological well-being dimensions, taking into account both the longitudinal effects of the course and the short-term effects arising from the intensive retreat experiences. The results showed that several psychological well-being measures gradually increased within participants from the beginning to the end of the course. This was especially true for life satisfaction, self-awareness, and emotional regulation, highlighting both short-term and longitudinal effects of the program. In conclusion, these findings suggest the potential of the mental training program, such as The Art of Happiness, for psychological well-being. (shrink)

Resiliência é o nome dado à capacidade concreta das pessoas de não só superarem situações críticas, mas também de utilizá-las em seus processos de desenvolvimento pessoal. Os estudos sobre o tema se propõem a enfatizar a promoção de processos educativos que facilitem ou tornem (...) as pessoas mais resistentes e maduras para enfrentar as dificuldades que ocorrem em sua vida. A inclusão da espiritualidade como um fator de favorecimento da resiliência parece ser o de desafiar o futuro numa perspectiva de superação, considerando as adversidades como obstáculos que poderão favorecer o amadurecimento pessoal, através da ampliação da visão de mundo e do estabelecimento de novas formas de equilíbrio. Acredita-se que um professor resiliente poderá mais facilmente manter-se firme em sua tarefa de educar, transcendendo as questões meramente pedagógicas, buscando desenvolver a integralidade na prática formativa, sobretudo porque possui mais possibilidades de vivenciar a sua própria multidimensionalidade. Cuba's economical society called "Amigos del Pais" will be the first one t13 be implemented in the american colonies. As a result, the society research is a detinite factor for the con-ipreliensiond process of establisment and the illustrated institucional developnient. This article attempts to study how the economic society constitutes a ruling elite through a chain of strategies and processes in Santiago of Cuba whose function mil1 be relevant in the city later history and their people.

At the end of the XVIlI century, the Economic Society of Santiago de Cuba, began to think about the interest of establishing public schools for girls. Despite this idea was not put in practice, it provides elements to analyze the feminine education model wanted for girls, basically addressed to the acquisition of an useful and practica1 teaching, aimed at the learning of artesanal jobs.

The articles in this special edition exemplify three major issues in current debates on Sacred Plants: a) the wisdom of Indigenous understandings of sacred plants, b) beneficial emerging uses of sacred plants by non‐Indigenous people, c) the position of Indigenous wisdom for emerging uses of sacred plants.

Most courts around the world have been refusing wrongful life actions. In this paper I will argue that an epistemology of ignorance is a denial of relationality. Knowing is a series of practices. So is ignoring. And as practices, they are strategic. I have argued that knowing is a practice, of engagement or disengagement ("Practices of Knowing"), so is ignoring (Frye, Mills). I have argued that we need to recognize rationalities not countenanced in the dominant logic ("Resisting Rationality). And I have argued for disrupting the conceptual coercion of the dominant logic (...) as well as for uncertainty as a way of emerging from the form of life enacted through the mystification of dominant discourse ("Moving Toward Uncertainty"). In this paper I want to take up the question of relationality. From postions of power and the logic of oppression, an epistemology hides engagement and as a result erases contestation and resistance. From positions of marginalization and the logic of resistance, it resists coercive consensus. In both cases there is a denial of a certain kind of relationality. (shrink)

ABSTRACTWhile Spinoza stipulates an ideal moral person in the propositions on the ‘free man’ in Ethics IV, this account does not seem to be intended to function as a pedagogical tool of political relevance. Hence, it does not seem to correspond to the purpose of moral exemplarism. If we look for that kind of practical guidance, Spinoza’s political works seem more relevant. Interestingly, when we approach Spinoza’s political theory with moral exemplarism in mind, we find that instead of constructing his (...) exemplar on the idea of a supremely moral person, he emphasizes the concept of ingenium to chisel out an imperfect model of human behavior. We argue that the purpose of this is to avoid a utopian and inefficient political theory and to work out a moral practice that is capable of assisting people and communities in ethical self-transformation. Looking at work on advocacy research, this article raises concerns about researchers, exploring and illustrating four aspects of the Coloniality of Anglo-European knowledge practice possible in such research. It suggests that it is not because we are able to be scholars that we are positioned to develop knowledge of marginalized others; it is because of how we are positioned in relation to marginalized others that we are able to be scholars. This article ends with a suggestion for an epistemic shift.

Recent years have seen mounting challenge to the model of the criminal trial on the grounds it is not cost-effective, not preventive, not necessary, not appropriate, or not effective. These challenges have led to changes in the scope of the criminal law, in criminal procedure, and in the nature and use of criminal trials. These changes include greater use of diversion, of fixed penalties, of summary trials, of hybrid civil–criminal processes, of strict liability, of incentives to plead guilty, and of (...) preventive orders. The paper will assess the implications of these changes for the function of the criminal law, assessing the reasons behind them, and examining whether or not they are to be welcomed. Identifying the larger import of these changes draws attention to the changing relationship between state and citizen as well as changes in the nature of the state itself. These can in turn be attributed to a jostling among the different manifestations of the authoritarian state, the preventive state, and the regulatory state. These changes have profound normative implications for a liberal theory of the criminal law that require its re-articulation and its defence. A modest start may be to insist that where the conduct is criminal and the consequences are punitive the protections of criminal procedure and trial must be upheld. (shrink)

The goal of this article is to show that formal analysis and reconstructions may be useful to discuss and shed light on substantive meta-theoretical issues. We proceed here by exemplification, analysing and reconstructing as a case study a paradigmatic biochemical theory, the Monod-Wyman-Changeux theory of allosterism, and applying the reconstruction to the discussion of some issues raised by prominent representatives of the new mechanist philosophy. Background: Paediatric nurses often face complex situations requiring decisions that sometimes clash with their own values and beliefs, or with the needs of the children they care for and their families. Paediatric nurses often use new technology that changes the way they provide care, but also reduces their direct interaction with the child. This may generate ethical issues, which nurses should be able to address in the full respect of the child. Research question and objectives: The purpose of this review (...) is to describe the main ethical dimensions of paediatric nursing. Our research question was, ‘What are the most common ethical dimensions and competences related to paediatric nursing?’ Research design: A rapid evidence assessment. Method: According to the principles of the rapid evidence assessment, we searched the PubMed, SCOPUS and CINAHL databases for papers published between January 2001 and March 2015. These papers were then independently read by two researchers and analysed according to the inclusion criteria. Ethical considerations: Since this was a rapid evidence assessment, no approval from the ethics committee was required. Findings: Ten papers met our inclusion criteria. Ethical issues in paediatric nursing were grouped into three areas: (a) ethical issues in paediatric care, (b) social responsibility and (c) decision-making process. Conclusion: Few studies investigate the ethical dimensions and aspects of paediatric nursing, and they are mainly qualitative studies conducted in critical care settings based on nurses’ perceptions and experiences. Paediatric nurses require specific educational interventions to help them resolve ethical issues, contribute to the decision-making process and fulfil their role as advocates of a vulnerable population (i.e. sick children and their families). Further research is needed to investigate how paediatric nurses can improve the involvement of children and their families in decision-making processes related to their care plan. (shrink)

En la actual campaña electoral uruguaya de 2019, se perfila un cuadro de descontentos generalizados que desborda claramente los estándares tradicionales de la política del país. Muchos de estos descontentos se articulan con diversos factores que los autores han venido destacando en trabajos anteriores, como señales de una mutación gradual pero efectiva de la política uruguaya. En continuidad con ese abordaje de investigación, en el artículo se indagará acerca de las posibilidades efectivas de que esta mutación política adquiera proporciones realmente (...) significativas en las actuales circunstancias, con la posibilidad de confirmación de "cisnes negros" que parecen atisbarse en la campaña electoral en curso. Para ello, luego de algunos discernimientos teóricos y metodológicos, se trabajará el itinerario de distintos indicadores de opinión pública a nivel nacional durante el período 1995-2017, vinculados con el objeto de estudio planteado. O campo da pesquisa raramente consegue agregar com harmonia esta necessidade de interseccionalidade em saúde e educação. Under Chinese law, the juridical status of the embryo and the foetus is unclear, mainly because the existing legislation can be subject to diverse interpretations due to its ambiguous language. Lack of clarity with the law has led to different understandings amongst Chinese legal scholars. However, although there has been no consensus, there has been a clear tendency to deprive embryos and foetuses of legal status or personhood, thereby excluding them from entitlement to fundamental rights, an understanding reinforced by the (...) Confucian view of the beginning of life. It is expected that in the near future the Chinese courts will face issues involving embryos and foetuses more often, such as disputes over in vitro embryos. The lack of legal precedent could result in contradictory resolutions, therefore, the law should clarify the legal status of embryos and foetuses and accord to prenatal life special respect and treatment. Facial recognition is an artificial intelligence-based technology that, like many other forms of artificial intelligence, suffers from an accuracy deficit. This paper focuses on one particular use of facial recognition, namely identification, both as authentication and as recognition. Despite technological advances, facial recognition technology can still produce erroneous identifications. This paper addresses algorithmic identification failures from an upstream perspective by identifying the main causes of misidentifications (in particular, the probabilistic character of this technology, its ‘black box’ nature and its algorithmic (...) bias) and from a downstream perspective, highlighting the possible legal consequences of such failures in various scenarios (namely liability lawsuits). In addition to presenting the causes and effects of such errors, the paper also presents measures that can be deployed to reduce errors and avoid liabilities. (shrink)

The aim of the present research was to assess elite student-athletes’ perception of the dual career during the lockdown caused by the coronavirus disease 2019 pandemic, compared with a group of elite student-athletes who could develop their dual career under normal conditions. A total of 150 elite athletes who were also undergraduate or postgraduate students self-completed the “Perceptions of dual career student-athletes ” questionnaire. From them, 78 did it during the mandatory lockdown period due to the state of emergency caused (...) by COVID-19 and 72 completed it in the previous year to Rio 2016 Olympic Games. The COVID-19 group was found to spend a significantly higher number of hours per week studying, while no significant differences were observed between groups in any training time variable. Student-athletes of the COVID-19 group showed better perception of whether their sport career could help them cope with their academic career and better general perception of remote learning and the use of tasks and videoconferencing as learning support tools. A lower percentage of athletes of the COVID-19 group than of the control group wished to continue with their sport career once they finished their studies. To conclude, student-athletes of the COVID-19 group show adaptations with regard to the organization of their studies and the importance they give to them and to the services provided by dual-career programs, compared with student-athletes from an ordinary pre-Olympic year. The supply chain of the auto body industry in Duitama, Boyacá, faces challenges that affect its efficiency, such as the lack of integration of new technologies and organizational management models, limiting its competitiveness in expanded markets. The purpose of this research is to analyze the key links in the supply chain: procurement, production, distribution and organizational performance, in order to identify opportunities for improvement that promote the strengthening and sustainability of the local auto body industry. Methodologically, a qualitative approach with (...) descriptive scope is employed, using a documentary review and direct observation. The findings indicate that the main difficulty lies in the absence of integrated logistics and management strategies, which leads to the isolated operation of the links in the chain, reducing the efficiency and competitiveness of the companies. It is concluded that it is essential to develop proposals that promote the implementation of management guidelines that strengthen each link of the supply chain and are more integrative and effective, ensuring the continuity and business success of the bodywork sector in Duitama. _Contributions to Law, Philosophy and Ecology: Exploring Re-Embodiments_ is a preliminary contribution to the establishment of re-embodiments as a theoretical strand within legal and ecological theory and philosophy. Re-embodiments are all those contemporary practices and processes that exceed the epistemic horizon of modernity. As such, they offer a plurality of alternative modes of theory and practice that seek to counteract the ecocidal tendencies of the Anthropocene. The collection is comprised of eleven contributions approaching re-embodiments from a multiplicity of fields, including (...) legal theory, eco-philosophy, eco-feminism and anthropology. The contributions are organized in three parts, ‘Beyond Modernity, ‘The Sacred Dimension’ and ‘The Legal Dimension’. The collection is opened by a comprehensive introduction that situates re-embodiments in theoretical context. Whilst closely bound with embodiment and new materialist theory, this book_ _contributes a unique voice that echoes diverse political processes contemporaneous to our times. Written in an elegant and accessible language, the book will appeal to undergraduates, postgraduates and established scholars alike seeking to understand and take re-embodiments further, both politically and theoretically. During the pandemic, civil society organisations adjusted their purpose to provide support to the most vulnerable. In the midst of the first wave, Superbergamo, an initiative that grew out of local activist associations, provided groceries and medicine to the elderly, the infirm and at-risk groups during the lockdown in Bergamo, Italy. This research analyses a newspaper article from Corriere della Sera published almost two years after the event, which tells the story of Stefano ‘Kino’, one of the volunteers of Superbergamo. (...) Using Critical Discourse Analysis, we show how the mainstream media normalised the story of Superbergamo to transform a critical, radical, leftist mutual aid practice, into an example of charitable volunteering. By omitting and recontextualising central elements, the article inscribed the mutual aid practice in a catholic narrative, stripping it of any critical afflatus of the status quo. Reframed within the catholic vocabulary by the Corriere della Sera’s weekly insert ‘good news’, the story of Superbergamo becomes one that reinforces the common sensical model of catholic charitable volunteering. In March 2020, the Portuguese Government issued a remarkable regulation by which irregular migrants who had previously started the regularization procedure were temporarily regularized and thus allowed full access to all social benefits, including healthcare. The Portuguese constitutional and legal framework is particularly generous regarding the right to healthcare to irregular migrants. Nevertheless, until now, several practical barriers prevented full access to healthcare services provided by the national health service, even in situations in which it was legally granted. This decision (...) is not only remarkable in light of the fulfilling of migrants’ rights to health, as imposed by international commitments assumed by, but also in view of the fight against COVID-19. The decision is grounded both on human rights and in public health reasons. The paper is divided in two main parts. In the first one, it analyzes national State obligations with regard to healthcare provision to migrants in irregular situation. In the second part, it analyzes the Portuguese solution, using this case study to discuss the possible mechanisms to comply with such obligations. (shrink)

Meaning in sensory language is often built through figurative mechanisms, such as synesthetic metaphors, where a sensorial domain is used to talk about perceptions from a different sense, as in sweet[taste] texture[touch]. The motivation of synesthetic transfers of meaning has been studied in general and literary language, resulting in attempts to reveal universal patterns regarding the directionality of meaning transfer and sensorial conceptual preference. However, those universals have not been proven in any sensory Language for Specific Purposes (LSP). We a (...) sensory LSP corpus of olive oil tasing notes in English to explore the nature of these metaphors, test existent models and explanatory accounts and identify tendencies present in synesthetic meaning transfers. The computer-assisted semi-automatic scalable methodology followed consists of the innovative quasi-simultaneous identification of semantic incongruences and the classification of synesthetic expressions in the discourse according to the source and target sensorial domains. Results show the inadequacy of existent models to explain synesthetic behavior in olive oil tasting language. The patterns found are discussed in the light of cognitive constraints and LSP genre analysis to conclude that a multi-causal approach is needed to explain the motivation of synesthetic transfers of meaning.
