The aim of this article is to analyse the Czech legislation applicable to surrogacy cases while considering some basic social aspects. First the basic facts of surrogacy as a medical reproductive technique are discussed. Surrogacy is also considered as a social trend, and in terms of selected social aspects, such as the growing number of couples interested in surrogacy and their social status. Nevertheless, the main goal of the paper is to analyse selected legal problems as regards surrogacy and the (...) Czech legislation. Therefore, the authors describe the basic legal framework that has relevancy to surrogacy cases (establishing parenthood and adoption) and identify the most frequent problems concerning surrogacy applications using three model cases. In the concluding remarks the adequacy of Czech legislation is discussed. (shrink)

Using the technique of prepared questions, Conversations with Lukacs is a brilliant gathering of thoughts and insights covering topics as ontology, the techniques of manipulative societies, the pitfalls of combating Stalinism with Stalinist methods, and the problems of intellectuals in advanced capitalist societies. Above all, there is the restatement of Lukacs unshaken conviction that the working class, with all the changes that have occurred in its way of life and composition, is still the historical carrier of social transformation. Lukacs's interlocutors (...) in these four conversations are Hans Heinz Holz, Leo Kofler, and Wolfgang Abendroth. Each of them engages Lukacs in separate dialogues, on being and consciousness (Holz), on society and the individual (Kofler), and on the elements of scientific politics (Abendroth). Lukacs, Abendroth, and Holz work toward a "Provisional Summary" in the last conversation. The interlocutors and the editor write that "These conversations show very clearly the basis of abstraction in the experiences of everyday life.... This gives these conversations with Lukacs a more than anecdotal value; for the unmediated way in which thought is produced in conversation corresponds exactly to that primary level of experience, the data of everyday reality, whose theoretical value Lukacs emphasizes.... Jennifer Lackey (2016) challenged group acceptance accounts of justification by arguing that these accounts make the possession of evidence arbitrary and hence lead to illegitimate manipulation of the group's evidence. She proposes that the only way out is to rely on the epistemic propriety of the individual group members, which leads to a dilemma for group acceptance views: either they are wrong about justification, or they cease to rely only on group acceptances. I argue that there is a third option (...) based on general expectations of epistemic propriety that restricts the group's maximal justification. A group cannot be more justified than any individual in the group's position could be expected to be. I motivate this solution by a discussion of normative defeat and epistemic expectations as proposed by Goldberg (2018). (shrink)

The internet has become an ubiquitous epistemic source. However, it comes with several drawbacks. For instance, the world wide web seems to foster filter bubbles and echo chambers and includes search results that promote bias and spread misinformation. Richard Heersmink suggests online intellectual virtues to combat these epistemically detrimental effects . These are general epistemic virtues applied to the online environment based on our background knowledge of this online environment. I argue that these online intellectual virtues also demand a particular (...) view of cognitive integration. Online intellectual virtues are incompatible with a popular conception of extended minds proposed by Andy Clark and David Chalmers . I suggest that if we want to hold on to both a conception of online intellectual virtues and some conception of the extended mind, we have to accept a more gradual theory of cognitive integration along the lines of second-wave theories of the extended mind. This paper discusses the nature of, problems for, and benefits delivered by fictionalist strategies in metaphysics.

We seem to ascribe mental states and agency to groups. We say ‘Google knows such-and-such,’ or ‘Amazon intends to do such-and-such.’ This observation of ordinary parlance also found its way into philosophical accounts of social groups and collective intentionality. However, these discussions are usually quiet about how groups self-ascribe their own beliefs and intentions. Apple might explain to its shareholders that it intends to bring a new iPhone to the market next year. But how does Apple know what it intends? (...) How do groups get to know their own mental states? This is the question of collective self-knowledge. I argue that collective self-knowledge is a distinct phenomenon that deserves our attention. In particular I suggest: that we should be interested in collective self-knowledge, because our behaviour indicates that we already engage with collective self-knowledge in practice; that groups can collectively avow, which indicates that they have privileged and peculiar access to their own intentional states; and that collective self-knowledge is not reducible to intentional states of individuals and therefore is an independent explanandum. The so-called „Covering Law Model“ of explanation proposed by C. Hempel and R. Oppenheim was claimed to have been applied as an explanatory model in natural sciences as well as in humanities. Several objections were raised against this explanatory model during the second half of 20th century. This article considers the proposed criteria of adequacy of scientific explanation and, in particular, the possibilities and limitations connected with the idea of its applicability in the process of logical reconstruction of historical explanations. In the final part of the paper I introduce some remarks concerning the „methodological“ relation of dependence between the explanandum and the explanans which could also illuminate the proper role of this explanatory model in history. The evolutionary circuit design is an approach allowing engineers to realize computational devices. The evolved computational devices represent a distinctive class of devices that exhibits a specific combination of properties, not visible and studied in the scope of all computational devices up till now. Devices that belong to this class show the required behavior; however, in general, we do not understand how and why they perform the required computation. The reason is that the evolution can utilize, in addition to the (...) “understandable composition of elementary components”, material-dependent constructions and properties of environment (such as temperature, electromagnetic field etc.) and, furthermore, unknown physical behaviors to establish the required functionality. Therefore, nothing is known about the mapping between an abstract computational model and its physical implementation. The standard notion of computation and implementation developed in computer science as well as in cognitive science has become very problematic with the existence of evolved computational devices. According to the common understanding, the evolved devices cannot be classified as computing mechanisms. (shrink)

ABSTRACT This essay examines the exhibition of dinosaurs at the American Museum of Natural History during the first two decades of the twentieth century. Dinosaurs provide an especially illuminating lens through which to view the history of museum display practices for two reasons: they made for remarkably spectacular exhibits; and they rested on contested theories about the anatomy, life history, and behavior of long-extinct animals to which curators had no direct observational access. The American Museum sought to capitalize on the (...) popularity of dinosaurs while mitigating the risks of mounting an overtly speculative display by fashioning them into a kind of mixed-media installation made of several elements, including fossilized bone, shellac, iron, and plaster. The resulting sculptures provided visitors with a vivid and lifelike imaginative experience. At the same time, curators, who were anxious to downplay the speculative nature of mounted dinosaurs, drew systematic attention to the material connection that tied individual pieces of fossilized bone to the actual past. Freestanding dinosaurs can therefore be read to have functioned as iconic sculptures that self-consciously advertised their indexical content. (shrink)

The idea that particular legal institutions are artifacts is not new. However, the idea that the “law” or “legal system” is itself an artifact has seldom been directly put forward, due perhaps to the ambiguities surrounding philosophical inquiries into law. Nevertheless, such an idea has recently been invoked more often, though not always developed in detail in terms of what the characterization of the “law” or “legal system” as an artifact entails ontologically, and what consequences, if any, this has for (...) philosophical accounts of law. As a result, the primary aim of this paper is to attempt an inquiry into what the claim that “law” by its nature or character is an artifact entails, and what an artifact theory of law might look like. Lockean views of personal identity maintain that we are essentially persons who persist diachronically by virtue of being psychologically continuous with our former selves. In this article, I present a novel objection to this variant of psychological accounts, which is based on neurophysiological characteristics of the brain. While the mental states that constitute said psychological continuity reside in the cerebral hemispheres, so that for the former to persist only the upper brain must remain intact, being conscious additionally requires that a (...) structure originating in the brainstem—the ascending reticular activating system—be functional. Hence, there can be situations in which even small brainstem lesions render individuals irreversibly comatose and thus forever preclude access to their mental states, while the neural correlates of the states themselves are retained. In these situations, Lockeans are forced to regard as fulfilled their criterion of diachronic persistence since psychological continuity, as they construe it, is not disrupted. Deeming an entity that is never again going to have any mental experiences to be a person, however, is an untenable position for a psychological account to adopt. In their current form, Lockean views of personal identity are therefore incompatible with human neurophysiology. (shrink)

Carbon pricing is one of the most politically important approaches for the mitigation of climate change in the world today. Most political actors who are not committed to climate change denial favor carbon pricing, either as emissions trading or carbon taxation. In this article, I argue that carbon pricing should be considered unfair in most of its forms. I present a line of criticism called the Unfair Burdens Argument. It states that the most politically relevant ways to price carbon needlessly (...) burden the less affluent more than the more affluent. This is unfair because, among other things, the more affluent have on average done more to create the problem of climate change in the first place. Principles for the fair distribution of burdens under climate change mitigation like the Polluter Pays Principle, which were thought to support carbon pricing, turn out to speak against it, when interpreted properly. Although the Unfair Burdens Argument on its own cannot show that carbon pricing is impermissible, it offers important clues for what a morally permissible form of climate change mitigation would look like. Modal fictionalists face a problem that arises due to their possible-world story being incomplete in the sense that certain relevant claims are neither true nor false according to it. It has recently been suggested that this incompleteness problem generalises to other brands of fictionalism, such as fictionalism about composite or mathematical objects. In this paper, I argue that these fictionalist positions are particularly threatened by a generalised incompleteness problem since they cannot emulate the modal fictionalists’ most attractive response. I then (...) defend mathematical and compositional fictionalism by showing that the reasons for which the incompleteness problem has been thought to affect them are mistaken. This leads to the question of whether there are other fictionalist positions to which the problem does in fact generalise. I give a general account of the features of a fictionalist position that generate the incompleteness problem and argue that whenever a fictionalist position does exemplify these features then the problem can be addressed in analogy to the modal fictionalists’ preferred response. In this paper, we explore an under-investigated question concerning the class of formal models that aim at providing normative guidance. We call such models normative models. In particular, we examine the question of how normative models can successfully exert normative guidance. First, we highlight the absence of a discussion of this question – which is surprising given the extensive debate about the success conditions of descriptive models – and motivate its importance. Second, we introduce and discuss two potential accounts of (...) the success conditions of normative models. Our tentative conclusion is that the second account is more promising. (shrink)

Scholars disagree about the plausibility of preference purification. Some see it as a familiar phenomenon. Others denounce it as conceptually incoherent, postulating that it relies on the psychologically implausible assumption of an inner rational agent. I argue that different notions of rationality can be leveraged to advance the debate: procedural rationality and structural rationality. I explicate how structural rationality, in contrast to procedural rationality, allows us to offer an account of the guiding idea behind preference purification that avoids inner rational (...) agents. Jelikož má Česká republika specifický demokratický systém, pokouší se tato stať za pomoci syntetizace Heldových modelů co nejvýstižněji popsat současnou českou demokracii. Model kombinuje znaky ústavnosti v jejich formální podobě a reálné politické chování. Následně se snaží nalézt pozici demokracie ve společenském řádu za pomoci Hayekova pohledu na tuto tematiku.

This volume investigates the cut-up as a contemporary mode of creativity and important global model of cultural production. The term cut-up serves as an open container for a long list of terms and actions that describe the combination and reassembly of existing motifs, fragments, images, and ideas from diverse and disconnected origins into newly synthesized entities. Refusing any disciplinary coherence, this book assembles texts from multifarious eras and origins. At the same time, the contributors share an urgency to question the (...) dichotomy of original creation and derivative appropriation. In this way the book itself is a cut-up of previously published essays and articles that in their proximity allow for multiple readings to arise. It aims to translate the topic into a wider societal discourse to serve as both a source of inspiration and a platform for critical reflection. (shrink)

During the 1920s, researchers from the American Museum of Natural History led by Roy Chapman Andrews exported a large collection of valuable fossils from the Gobi Desert. While their expedition was celebrated across Europe and the United States, it aroused enormous controversy in China and Mongolia, especially after a new Nationalist government was formed in Nanjing during the late 1920s. Whereas Chinese scholars accused American scientists of plundering their natural heritage, Andrews argued that because dinosaurs went extinct long before the (...) creation of China, prehistoric fossils belonged equally to all mankind. This essay locates the Central Asiatic Expedition within a broader history of epistemic imperialism to explore what the controversy that it engendered reveals about the production, circulation, and accumulation of knowledge in a global context. Machine intelligence already helps medical staff with a number of tasks. Ethical decision-making, however, has not been handed over to computers. In this proof-of-concept study, we show how an algorithm based on Beauchamp and Childress’ prima-facie principles could be employed to advise on a range of moral dilemma situations that occur in medical institutions. We explain why we chose fuzzy cognitive maps to set up the advisory system and how we utilized machine learning to train it. We report on the (...) difficult task of operationalizing the principles of beneficence, non-maleficence and patient autonomy, and describe how we selected suitable input parameters that we extracted from a training dataset of clinical cases. The first performance results are promising, but an algorithmic approach to ethics also comes with several weaknesses and limitations. Should one really entrust the sensitive domain of clinical ethics to machine intelligence? (shrink)

How can the world be improved if the people inhabiting it do not believe they can transform it? A belief in such political fatalism is an important obstacle to social transformation, yet underexplored in the contemporary political theory literature. Political fatalism can be understood as a commitment to the belief that human agency cannot effectuate social transformation. In this article, I provide a typology of such political fatalism, considering its two main forms: fatalism of inevitability as the positive version that (...) humans do not have the power to affect positive social change, and fatalism of impossibility as the negative version that human agency does not play a role in avoiding negative social change such as climate catastrophe. Focussing particularly on the more pressing contemporary problem of the fatalism of impossibility, I develop three distinct dimensions along which fatalism has an impact: the cognitive, the affective, and the practical. Finally, I offer solutions, focussing on how to combine interventions on the cognitive, affective, and practical levels: historically sensitive critique, imagination, and a combination of bounded spontaneism and long-term political organisation. It is well known that Hegel exerted a major influence on the development of Marx's thought. This circumstance led Lukacs, one of the chief Marxist theoreticians of this century, to embark on his exploration of Hegelian antecedents in (...) the German intellectual tradition, their concrete expression in the work of Hegel himself, and later syntheses of seemingly contradictory modes of though. Four phases of Hegel's intellectual development are examined: "Hegel's early republican phase," "the crisis in Hegel's views on society and the earliest beginnings of his dialectical method," "rationale and defense of objective idealism," and "the breach with Schelling and " The Phenomenology of Mind."" Lukacs completed this study in 1938, but because of the imminent outbreak of war, it was not published until the late 1940s. Wright (1998) and Bar-On (2004) put pressure on the idea that self-knowledge as an explanandum should be identified with privileged belief formation. They argue that setting up the discourse on the level of belief and belief formation rules out promising approaches to explain self-knowledge. Hence, they propose that we should characterize self-knowledge on the level of linguistic practice instead. I argue against them that self-knowledge cannot be fully characterized by features of our linguistic practice. I propose that in some circumstances (...) – disagreements about one's mental states – self-knowledge plays a role, but this role cannot be described in virtue of features of our linguistic practice. I consider three objections to the argument and conclude that we should not conceive self-knowledge solely in terms of linguistic practice. (shrink)

This paper addresses a theory of intergenerational justice that we refer to as “needs-based sufficientarianism”. According to needs-based sufficientarianism, the present generation ought to enable future generations to meet their basic needs — for example, their needs for drinkable water, food and health care. Our aim is to explain and defend this theory in a programmatic way. First, we introduce what we regard as the most plausible variant of needs-based sufficientarianism. Then we argue that this variant is superior to several (...) alternative ways of thinking about intergenerational justice. In particular, we defend basic needs as the currency of intergenerational justice and sufficiency as its principle. Our arguments for these claims are neither fully comprehensive nor fully conclusive. Yet, we hope that they suffice to show that needs-based sufficientarianism is a major contender, with significant pro tanto advantages over other views. (shrink)

Subverting a once widely held Quinean paradigm, there is a growing consensus among philosophers of logic that higher-order quantifiers (which bind variables in the syntactic position of predicates and sentences) are a perfectly legitimate and useful instrument in the logico-philosophical toolbox, while neither being reducible to nor fully explicable in terms of first-order quantifiers (which bind variables in singular term position). This article discusses the impact of this quantificational paradigm shift on metaphysics, focussing on theories of properties, propositions, and identity, (...) as well as on the metaphysics of modality. In this paper I propose an account of self-knowledge based on a framework of predictive processing. Predictive processing understands the brain as a prediction-action machine that tries to minimize error in its predictions about the world. For this view to evolve into a complete account of human cognition we ought to provide an idea how it can account for self-knowledge – knowledge of one’s own mental states. I provide an attempt for such an account starting from remarks on introspection made (...) by Hohwy. I develop Hohwy’s picture into a general model for knowledge of one’s mental states, discussing how predictions about oneself can be used to capture self-knowledge. I further explore empirical predictions, and thereby argue that the model provides a good explanation for failure of self-knowledge in cases involving motor aftereffects, such as the broken escalator phenomenon. I conclude that the proposed account is incomplete, but provides a valuable first step to connect research on predictive processing with the epistemology of self-knowledge. (shrink)

L’objet de la présente contribution est d’examiner les relations qu’établissent plusieurs auteurs entre l’amélioration de l’homme, la nature humaine et l’humanisme. Après avoir défini un sens faible et un sens fort du transhumanisme, nous y avons opposé deux critiques, celle de J. Habermas et de M. Sandel, en prenant l’exemple le plus discuté dans la littérature : la possibilité d’améliorer génétiquement son enfant et avons montré qu’elles ne sont pas convaincantes : le recours au concept de la nature humaine à (...) lui seul n’aide pas à répondre à la question de savoir si l’amélioration génétique d’un enfant est morale ou non. Il en est de même de la caractérisation de l’amélioration de l’homme en terme d’humanisme. Loin d’être une justification, il peut aussi s’appliquer à toute position dite bioconservatrice : le transhumanisme peut être humaniste dans le sens heideggérien critique de la technique comme métaphysique. This very short introduction to the bibliography of modern epidemiology aims to achieve two modest goals. First, the works presented will be separated into two bodies of historical scholarship, to distinguish the history of the field as told by epidemiological practitioners from the work developed in the history of science, medicine, and public health. Second, this essay focuses on a modern history of epidemiology spanning the later nineteenth and twentieth century. These distinctions aim to capture the contours of the history (...) of epidemiology as it became a field of knowledge production and to some extent an academic discipline, a history told in part by those involved in the field themselves. The enclosed bibliography further distinguishes between geographic contributions to this historiography to capture the historical distribution of the scientific field and its associated histories. The paper claims that the rule of recognition, given the way it is presented by Hart, cannot be a constitutive rule of any legal system as a whole, but rather a constitutive rule of legal rules as elements of a legal system. Since I take the legal system to be an institutional artifact kind, I claim that, in order to account for a legal system as a whole, at least two further constitutive rules, in addition to the rule of recognition (...) as a token-element constitutive rule, are needed – one constitutive of legal officials and the other constitutive of a legal system as a token. However, given the central role the legal officials' practice occupies in establishing a particular instantiation or token of a legal system, I also claim that the rule of recognition cannot be understood as 'merely' a token-element constitutive rule but also as a legal system's implementation or concretisation rule. abstractBy appealing to the similarity between pre-vital and post-mortem nonexistence, Lucretius famously tried to show that our anxiety about death was irrational. His so-called Symmetry Argument has been attacked in various ways, but all of these strategies are themselves problematic. In this paper, I propose a new approach to undermining the argument: when Parfit’s distinction between identity and what matters is applied, not diachronically but across possible worlds, the alleged symmetry can be broken. Although the pre-vital and posthumous time spans (...) that we could have experienced are indeed analogous with respect to our identity, they are not analogous with respect to psychological continuity, which forms the basis of prudential concern. Lucretius even anticipated the Parfitian distinction. He did not, however, notice the significance that it has for his Symmetry Argument. (shrink)

When does a human being cease to exist? For millennia, the answer to this question had remained largely unchanged: death had been diagnosed when heartbeat and breathing were permanently absent. Only comparatively recently, in the 1950s, rapid developments in intensive-care medicine called into question this widely accepted criterion. What had previously been deemed a permanent cessation of vital functions suddenly became reversible. -/- A new criterion of death was needed. It was suggested that the destruction of the brain could indicate (...) the death of the organism in the presence of external life support. Soon the so-called brain death became the new worldwide standard. In recent years, however, doubts about this neurological criterion have been growing. Is brain death really our death? -/- This is the question that this thesis seeks to answer. To this end, we shall connect the medical debate about the definition of death to the philosophical debate about personal identity. While we will find that the destruction of its brain does in fact not correspond to an organism’s death, we shall also ask whether the assumption that we are essentially organisms is correct. May brain death be the ceasing to exist of a different entity? -/- Substituting clinical case reports and considerations about human physiology for the use of thought experiments, the thesis takes a novel and philosophically unconventional approach to the problem of what we essentially are. We shall analyse various pathological conditions and their respective effects on the bodily and mental characteristics of our existence. We will conclude that brain death is indeed our death – but for reasons entirely different from those cited in the original justification of this criterion. (shrink)

ABSTRACT Stephen Gardiner’s A Perfect Moral Storm offers an in-depth analysis of the ethical facets of climate change. In this paper, I contend that he nonetheless overlooks an important structural layer to climate vulnerabilities and injustices because he analyzes them implicitly interactional. I argue that climate change should rather be understood as a form of structural injustice as outlined by Iris M. Young. In this reading, the unjust socio-economic structural processes that give rise to climate change, the production and consumption (...) of fossil fuel energy, are at their core marked by (i) oppressive and dominating power relations that position agents (ii) intersecting with other structural constraints. Crucially, (iii) these structural processes arose historically, persist over time, and entrench the burden on those suffering in the future. This viewpoint improves our understanding of how the climate crisis unfolds over time in a way that augments Gardiner’s analysis. The structural approach can advance the climate justice debate both theoretically and practically. (shrink)

The role of artificial intelligence (AI) in organizations has fundamentally changed from performing routine tasks to supervising human employees. While prior studies focused on normative perceptions of such AI supervisors, employees’ behavioral reactions towards them remained largely unexplored. We draw from theories on AI aversion and appreciation to tackle the ambiguity within this field and investigate if and why employees might adhere to unethical instructions either from a human or an AI supervisor. In addition, we identify employee characteristics affecting this (...) relationship. To inform this debate, we conducted four experiments (total N = 1701) and used two state-of-the-art machine learning algorithms (causal forest and transformers). We consistently find that employees adhere less to unethical instructions from an AI than a human supervisor. Further, individual characteristics such as the tendency to comply without dissent or age constitute important boundary conditions. In addition, Study 1 identified that the perceived mind of the supervisors serves as an explanatory mechanism. We generate further insights on this mediator via experimental manipulations in two pre-registered studies by manipulating mind between two AI (Study 2) and two human supervisors (Study 3). In (pre-registered) Study 4, we replicate the resistance to unethical instructions from AI supervisors in an incentivized experimental setting. Our research generates insights into the ‘black box’ of human behavior toward AI supervisors, particularly in the moral domain, and showcases how organizational researchers can use machine learning methods as powerful tools to complement experimental research for the generation of more fine-grained insights.
