A major new interpretation of the Declaration of Independence and of the philosophical background of Thomas Jefferson at the time of its composition. Garry Wills attempts to reconstruct the intellectual atmosphere in the 18th century, and by attending to Jefferson’s draft of the Declaration in comparison with the revised draft adopted by Congress, he seeks to show that Jefferson was deeply influenced in his thought and phrasing not by John Locke, as the standing interpretation of Carl Becker holds, but by (...) the Scottish philosopher of moral sense, Francis Hutcheson. Wills’s book, then, is not only a byproduct of the recent Bicentennial, but also a contribution to the growing literature on the Scottish Enlightenment and on the role of Scottish philosophy in American intellectual history. Richard Price is remembered mainly for his work in moral philosophy, A Review of the Principal Questions and Difficulties in Morals. He also wrote widely and effectively on the political and economic problems of his time; he contributed with rare distinction to the polemical pamphlet literature which surrounded the America revolution. He was devoted to the American cause, and he analyzed and attacked British policies not only on grounds of utility but also in consideration of rationally apprehended natural rights. In (...) this regard, his most famous pamphlets are his Observations on the Nature of Civil Liberty, Additional Observations on the Nature and Value of Civil Liberty, and Observations on the Importance of the American Revolution. While the two earlier volumes, Reason and Analysis and Reason and Goodness, are devoted to the roles of reason in knowledge and morality, respectively, Reason and Belief focuses on reason in regard to religion, confined, however, to Christianity. Blanshard’s method is primarily critical; the bulk of his writings consists of the critique and demolition of views on reason, reality, and values which differ from his own. Father Lonergan, Professor at the Gregorian University in Rome, writes from the conviction that by thoroughly understanding what it is to understand, one will understand the structure of all that is and can be understood. Focussing on insight, the very essence of understanding, Father Lonergan examines illustrations of insight in mathematics, science, common sense, etc., in order to bring the reader to an insight into insight. The sometimes annoyingly prolix discussion is intended to enable the reader to grasp within his (...) own self-consciousness the structure or invariant pattern of all understanding. The advance from lower to higher standpoints of understanding is traced, and a plurality of patterns appropriate to diverse domains, each standpoint of insight exhibiting a structure of understanding correlative to an intelligibility immanent in its subject matter, is acknowledged. Yet Father Lonergan pursues insight until at last he claims to discover the unifying, universal, invariant pattern and hence the ultimate metaphysical intelligibility. This structure or pattern proves to be essentially scholastic in conception, in particular Thomistic; yet the scholasticism Father Lonergan advances contains important revisions in matters of method and content. An outgrowth of the Bicentennial. White examines the metaphysics, epistemology, and moral philosophy which influenced American revolutionary thought. Focusing on the doctrines of self-evident truth and natural law expressed in the Declaration of Independence, he elucidates them by erudite explications and critical analyses of such 17th and 18th century thinkers as John Locke, Francis Hutcheson, and Jean Jacques Burlamaqui. Traditional interpretations, best represented by Carl Becker’s The Declaration of Independence, have stressed the role of Locke. More recently, intellectual historians have (...) reassessed the Scottish influence on American thought, apparent in White’s own Science & Sentiment in America, chap. 3, and in Garry Wills’s Inventing America: Jefferson’s Declaration of Independence. Wills claims for Hutcheson the place formerly reserved for Locke as the philosopher who most directly shaped Jefferson’s thought and style in the Declaration. Currently, there is no consensus guideline as to the type or degree of donor steatosis considered acceptable for liver transplantation, and little is known about local practices in this area. The aim of this survey (...) was to evaluate current clinical practices amongst liver transplant surgeons in Australia and New Zealand in the evaluation and use of steatotic donor livers in LT.Methods: An anonymous online twelve-question survey was emailed to all practicing LT surgeons in ANZ in January 2010.Results: The response rate was 83%. Estimated prevalence of steatosis in donor livers was between 40% and 60%. In determining suitability for LT, 90% of respondents reported rejecting organs with "severe" steatosis based on visual and palpation grounds alone. A total of 68% sought further histological assessment if the donor liver looked bad and there were risk factors for steatosis. The majority of respondents performed only one biopsy of the liver, using hematoxylin and eosin staining for fat assessment. There was wide variation in the upper limit of steatosis considered to be acceptable for LT. A total of 21% of respondents still considered microvesicular steatosis a risk factor for primary graft nonfunction.Conclusion: This survey highlights the significant variation in the appraisal and use of steatotic grafts by LT surgeons in ANZ. Accurate evaluation and judicious use of mild and moderately steatotic grafts is required if we are to utilize the available donor pool best.Keywords: liver transplantation, steatosis, fatty liver, organ donors. Forty‐nine subjects judged the relevancy of sentence parts of a word problem (the Allsports problem). Patterns of subjects' judgments suggest three problem‐solving heuristics: a SETS heuristic, a TIME heuristic, and a QUESTION heuristic. Presentation of the question before the problem tends to suppress SETS and TIME heuristics. A computer program (ATTEND) is presented to simulate subjects' behavior on the Allsports problem. The program is context‐sensitive in that it can change a relevance judgment upon the acquisition of further information. This paper responds to Antje du-Bois Pedain’s discussion of the wrongfulness constraint on the criminal law. Du-Bois Pedain argues that the constraint is best interpreted as stating that φing is legitimately criminalised only if φing is wrongful for other-regarding reasons. We take issue with du-Bois Pedain’s arguments. In our view, it is neither a necessary nor sufficient condition of legitimate criminalisation that φing is wrongful in du-Bois Pedain’s sense. Rather, it is a necessary condition of legitimate criminalisation that φing is (...) what we call bare wrongful —that is, that the reasons in favour of φing are defeated by the reasons against. Though du-Bois Pedain is critical of this view, we argue that her criticisms do not convince. (shrink)

Context: The past few years have presented us with a growing amount of theoretical research (yet that is often based on neuroscientific developments) in the field of enactive music cognition. Problem: Current cognitivist and embodied approaches to music cognition suffer, in our opinion, from a too firm commitment to the explanatory role of mental representations in musical experience. This particular problem can be solved by adopting an enactive approach to music cognition. Method: We present and compare cognitivist, embodied and enactive (...) approaches to music cognition and review the current research in enactive music cognition. Results: We find that, in general, the enactive approaches to human musicality are capable of explaining the basic relationship between a musical subject and a musical object according to a pre-conceptual and pre-linguistic form of understanding related to bodily motor expertise. This explanation does not rely on on sophisticated forms of representation. Implications: Proponents of enactive music cognition should, in our opinion, focus on providing a consistent explanation of the most basic level of musical understanding. Constructivist content: We hope to invite the constructivist community to engage with the discussions on the intersection between music and enactivism. (shrink)

We present a new modeling framework for recognition memory and repetition priming based on signal detection theory. We use this framework to specify and test the predictions of 4 models: (a) a single-system (SS) model, in which one continuous memory signal drives recognition and priming; (b) a multiple-systems-1 (MS1) model, in which completely independent memory signals (such as explicit and implicit memory) drive recognition and priming; (c) a multiple-systems-2 (MS2) model, in which there are also 2 memory signals, but some (...) degree of dependence is allowed between these 2 signals (and this model subsumes the SS and MS1 models as special cases); and (d) a dual-process signal detection (DPSD1) model, 1 possible extension of a dual-process theory of recognition (Yonelinas, 1994) to priming, in which a signal detection model is augmented by an independent recollection process. The predictions of the models are tested in a continuous-identification-with-recognition paradigm in both normal adults (Experiments 1–3) and amnesic individuals (using data from Conroy, Hopkins, & Squire,2005). The SS model predicted numerous results in advance. These were not predicted by the MS1 model, though could be accommodated by the more flexible MS2 model. Importantly, measures of overall model fit favored the SS model over the others. These results illustrate a new, formal approach to testing theories of explicit and implicit memory. (shrink)

David Lewis is widely known for maintaining the bizarre thesis known as genuine modal realism (hereafter, modal realism). He argued for modal realism on grounds of serviceability in On the Plurality of Worlds. However, earlier in Counterfactuals, he proposed a different kind of argument: from talk of ways things might be to possible worlds. In this paper, I examine the evolution of the latter argument in Lewis’s thought and evaluate its place in his overall case for modal realism, especially in (...) light of the alternative theory of modality known as magical ersatzism. I argue that Lewis turns the argument on its head in his critique of magical ersatzism, but that his later commitment to Ramseyan humility subjects him to a similar criticism. Therefore, the argument is, ultimately, a poisoned pawn for Lewis. (shrink)

Over the years, participants have including many leading representatives of religion, science, and philosophy. This series has as its subject, The Development of Mind. First published in 1972, the series continues to attract widespread interest. In this volume, contributors argue about the mind from diverse analytical standpoints. The focus of the series remains the relationship between religion, science, and philosophy. This volume attempts to (...) achieve a comprehensive view of the subject of mind. The mental development of children in the light of modern psychology is discussed, and the distinction between "how" and "why" questions is put forward with clarity. The development of mind is further contrasted with the evolution of embryos in the young. The mind is considered as a capacity for intellectual activity, and as a multi-purpose program. Goal-directed behavior and language development are given importance, and issues of cosmic purpose, and the how and why of evolution, are never far from the surface of the argument. The lecturers know their opposition and their positions, and the cut-and-thrust of the discussion has much acumen and wit to it. Issues ranging from the impact of mind on theories of religion, causation, and rational will are examined in an informal, yet compelling, manner. (shrink)

Compact quantum systems have underlying compact kinematical Lie algebras, in contrast to familiar noncompact quantum systems built on the Weyl-Heisenberg algebra. Pauli asked in the latter case: to what extent does knowledge of the probability distributions in coordinate and momentum space determine the state vector? The analogous question for compact quantum systems is raised, and some preliminary results are obtained.

We make a brief review of the Kramers escape rate theory for the probabilistic motion of a particle in a potential well U(x), and under the influence of classical fluctuation forces. The Kramers theory is extended in order to take into account the action of the thermal and zero-point random electromagnetic fields on a charged particle. The result is physically relevant because we get a non-null escape rate over the potential barrier at low temperatures (T → 0). It is found (...) that, even if the mean energy is much smaller than the barrier height, the classical particle can escape from the potential well due to the action of the zero-point fluctuating fields. These stochastic effects can be used to give a classical interpretation to some quantum tunneling phenomena. Relevant experimental data are used to illustrate the theoretical results. (shrink)

A laboratory-testable, solid-state Maxwell demon is proposed that utilizes the electric field energy of an open-gap p-n junction. Numerical results from a commercial semiconductor device simulator (Silvaco International–Atlas) verify primary results from a 1-D analytic model. Present day fabrication techniques appear adequate for laboratory tests of principle.

In this chapter, we introduce the perennial and sometimes sprawling topic of properties, with a brief historical sketch from Ancient to Modern philosophy throughout various cultures and traditions. We argue that the importance of properties can be shown by explaining what explanatory work they can do in philosophical theorising across many areas of philosophy. Morgan has argued that attitudes to the medicalisation of sports are historically conditioned.While the history of doping offers contested versions of when the sports world turned againstconservative forces, Morgan has argued that these attitudes are out of step with prevailingnorms and that the World Anti Doping Agency's policy needs to be modified to better reflectthis. As an advocate of critical democracies in sports, he argues that anti-doping policy mustacknowledge and reflect these shifts in order to secure their legitimacy. In response, (...) wecritically present the World Anti-Doping Agency's policy that incorporates the Prohibited Listof Substances and Methods for athletes. We evaluate the validity of the therapy-enhancementdistinction in relation to its role in both justifying and sustaining the operation of theProhibited List. In particular, we focus on the case of thyroxine, which has been the subjectof controversy in athletic doping. While thyroxine is not currently banned, critics haveclaimed that its use in the absence of a relevant pathology is tantamount to doping. Wechallenge Morgan's claim that a conventionalist defence of the therapy-enhancementdistinction is the best available, and his conclusion that this properly supports a morepermissive stance towards performance-enhancing drug use. Furthermore, we reject hisconventionalist support for democratic line drawing in relation to doping and in particular thestatus of thyroxine with regard to the prohibited list. We offer a modified defence of the statusquo, a qualified, naturalist account of health and disease, where athletes may be prescribeddrugs that are genuine responses to medical necessity that do not, or do not typically, threatenthe goods of athletic excellence.
