Background Only a few studies have been conducted to assess physicians’ knowledge of legal standards. Nevertheless, prior research has demonstrated a dearth of medical law knowledge. Our study explored physicians’ awareness of legal provisions concerning informed consent and confidentiality, which are essential components of the physician-patient relationship of trust. -/- Methods A cross-sectional study assessed attending physicians’ legal knowledge of informed consent and confidentiality regulations. The study was conducted in nine hospitals in Dolj County, Romania. Physicians were given a questionnaire (...) with ten scenarios and instructed to select the response that best reflected their practice. We assessed the responses of physicians who claimed their practice to be entirely legal. Their legal knowledge was evaluated by comparing their answers to applicable laws. We also calculated a score for the physicians who admitted to committing a legal breach. -/- Results Of the 305 respondents, 275 declared they never committed any law violation. However, their median correct answer score was 5.35 ± 1.66 out of 10. The specialty was the strongest predictor of legal knowledge, with emergency physicians rating the lowest and non-surgical physicians scoring the highest. Physicians who worked in both private and public sectors were better knowledgeable about legal issues than those who worked exclusively in the public sector. Results indicate that physicians are aware of the patient’s right to informed consent but lack comprehensive understanding. While most physicians correctly answered simple questions, only a tiny minority identified the correct solution when confronted with ethical dilemmas. The physicians who acknowledged breaching the law, on the other hand, had a slightly higher knowledge score at 5.45 ± 2.18. -/- Conclusion Legal compliance remains relatively low due to insufficient legal awareness. Physicians display limited awareness of legal requirements governing patient autonomy, confidentiality, and access to health data. Law should be taught in all medical schools, including undergraduate programs, to increase physicians’ legal knowledge and compliance. (shrink)

This article relates two forms of political and cultural marginality and emancipation to a third one, which, in traditional patriarchal cultures, is the embodiment of marginality par excellence: that of the female self. It explores their similar positioning in the spatial and temporal economy of power relations in a detailed analysis of Irina Grigorescu Pana's novel Melbourne Sundays, a fictionallyrical account of the Romanian author's 11-year exile in Australia, read as a narrative counterpart of her critical approach to exile in (...) The Tomis Complex: Exile and Eros in Australian Literature. These two works describe an experience happening at the intersection between the author's national background – that of Romania – and the postcolonial one of her country of adoption – Australia – as they become relevant from her personal and professional experience as a woman writer. Exile is thus reflected in language, being spatially constructed by means of metaphors such as book, theatre, carnival, garden, which are also relevant for the process of identity formation. The argument mainly relies on Kristeva's theories, an approach motivated by Pana's own choice of the Kristevan discourse of love/hate in relation to the theme of exile in her fictional and critical works, since, as she remarks, exiles and lovers share a marginal, though at the same time essential, position in postcolonial cultures. BackgroundAlthough the Covid-19 epidemic challenged existing medical care norms and practices, it was no excuse for unlawful conduct. On the contrary, legal compliance proved essential in fighting the pandemic. Within the European legal framework for the pandemic, patients were still entitled to be treated equally, by a specialized physician, with the possibility of seeking a second medical opinion, in a confidential setting, following prior and informed consent. This study examines physicians’ practices regarding patients’ rights during the Covid-19 pandemic and the (...) effects of age, experience, and specialty on physicians’ behavior and preferences. Additionally, it explores the nexus of malpractice complaints, malpractice fear, and legal compliance.MethodsA cross-sectional study was conducted on a convenience sample of attending physicians and general practitioners to assess compliance with patients’ rights regulations. Respondents were physicians practicing in private and public settings in Southwestern Romania from July 2021 to May 2022.Results396 attending physicians and 109 general practitioners participated in the research. Attending physicians acknowledged patients’ rights in 55.7% of statements, while general practitioners showed a slightly higher level of compliance at 59.9%. Emergency and Anesthesia and Intensive Care physicians showed the lowest compliance. There were no significant behavioral differences based on physicians’ age, years in practice, work sector, or location. However, when faced with the question of prioritizing treatment for patients with similar medical conditions, 46.2% of attending physicians reported favoring the younger patients. This preference was common among physicians under 39. Additionally, over half of the attending physicians reported working outside their area of expertise due to staff shortages. Malpractice fear was high among physicians, although unrelated to patients’ claims, legal compliance, or working outside the scope of practice. It resulted in pressure and behavioral changes.ConclusionAdherence to patients’ rights was low during the Covid-19 pandemic. Physicians could benefit from educational and administrative support to ensure better legal compliance. Further research is needed to determine if this behavior persists beyond the pandemic context. In English, discourse reference to time involves grammatical tenses interpreted as temporal anaphors. Recently, it has been argued that conditionals involve modal discourse anaphora expressed by a parallel grammatical system of anaphoric modals. Based on evidence from Kalaallisut, this paper argues that temporal and modal anaphora can be just as precise in a language that does not have either grammatical category. Instead, temporal anaphora directly targets eventualities of verbs, without mediating tenses, while modal anaphora involves anaphoric moods and/or attitudinal verbs.

In the ongoing pandemic, death statistics influence people’s feelings and government policy. But when does COVID-19 qualify as the cause of death? As philosophers of medicine interested in conceptual clarification, we address the question by analyzing the World Health Organization’s rules for the certification of death. We show that for COVID-19, WHO rules take into account both facts and values.

Although no scholarly consensus exists on the issue, the claim that a substantive reconfiguration of the Internet has occurred in the beginning of the 2000s has settled firmly in public common sense. The label tentatively chosen for the new turn in the medium’s evolution is Web 2.0. The developments constituting this turn have been contemplated from different perspectives in technical and business publications (O’Reilly 2005), in treatises on convergence or participatory culture (Jenkins 2006; Jenkins et al. 2009), and could be (...) usefully interrogated by means of political economy concepts such as the social factory and free labor (Terranova 2004). Marked, or rather symbolically constructed, by these discursive pickets lies a field of practice that the members of the participatory culture, the produsers (Bruns 2008) of open journalism, blogs, social networking sites and other characteristic Web 2.0 applications inhabit and animate with their everyday thought, decision making and action. This paper undertakes a theoretical exploration of the user practices emerging and consolidating around the new technological and organizational models making up Web 2.0. It is informed by a qualitative study of bloggers and Facebook users conducted through focus group methodology, although the concrete empirical data are not presented here. Rather, the analysis employs the concept of technologies of the self by Foucault (1988) as a heuristic device in order to situate Web 2.0 use, first, in a long history of culturally evolved forms of self-constitution and, second, in a complex matrix of relationships with other types of technologies, namely, those of production, sign systems and power. This conceptual choice, we argue, furnishes a study of Web 2.0 use, which holds in balance its liberatory potential and its susceptibility to new forms of domination, rationalization and commodification. Despite the economic relevance and distinctiveness of family firms, little attention has been devoted to researching their nature and functioning. Traditionally, family firms have been associated both to positive and negative features in their relationships with the stakeholders. This can be linked to different orientations toward corporate social responsibility. Thus, this research aims to identify the approaches that Spanish family firms maintain about social responsibility, based on the model developed by Quazi and O' Brien Journal of Business Ethics 25, 33-51 (...) (2000). An empirical study carried out for 112 Spanish family firms gives support to our initial assumption about these organizations not being a homogeneous group in terms of their orientation towards corporate social responsibility. The differences in perceptions do not seem to be associated to biographical characteristics. These results lead to some relevant academic and practical implications that suggest interesting lines for future research. (shrink)

A range of themes—race and gender, sexuality, otherness, sisterhood, and agency—run throughout this collection, and the chapters constitute a collective discourse at the intersection of Black feminist thought and continental philosophy, converging on a similar set of questions and concerns. These convergences are not random or forced, but are in many ways natural and necessary: the same issues of agency, identity, alienation, and power inevitably are addressed by both camps. This paper explores Kant’s ambivalent views on music. It aims to show, on the one hand, how these ambivalences are in line with the modern philosophical reflection on this art; on the other hand, to show their place within Kantian aesthetics, a place that justifies Kant’s hesitations as whether to classify music as beautiful or agreeable, art or mere enjoyment, free or dependent beauty, culture or nature.

This article explores the proposal offered by Ian Hacking for the distinction between natural and social sciences—a proposal that he has defined from the outset as complex and different from the traditional ones. Our objective is not only to present the path followed by Hacking’s distinction, but also to determine if it constitutes a novelty or not. For this purpose, we deemed it necessary to briefly introduce the core notions Hacking uses to establish his strategic approach to social sciences, under (...) the assumption that they are less well known that the ones corresponding to his treatment of natural sciences. IN THE LAST PART of the Theory of Moral Sentiments, Adam Smith puts his theory in a class with those of his contemporaries Francis Hutcheson and David Hume, namely, the systems that make sentiments the principle of approbation. Despite recognizing important differences with both of them, he thinks that since he has placed the origin of moral sentiments in sympathy, and in particular the fact that we are able to enter into the motives of the agent and get pleasure from (...) finding them appropriate to their cause, sentiments are the foundation of his theory of morals. Many of Smith’s commentators, in fact almost all of the most important studies over the last few years, reaffirm the author’s self-description. However, my aim in this paper is to challenge this view by showing that Smith’s system can also be plausibly seen as a theory of practical reasoning, and in some important aspects very similar to Aristotelian ethics. Surprisingly few scholars have seen this parallel. Laurence Berns, Samuel Fleischacker, Charles Griswold, and Gloria Vivenza are the latest exceptions, identifying several points of coincidence between Adam Smith and Aristotle’s ethics. None of them, however, has tied all these similarities under a unified interpretation, such as the one I propose here: The basic analogy between these theories, and the source of those particular coincidences, is the operation of practical reason. Moreover, and besides the common elements with Aristotle’s ethics, Smith’s reconstruction of practical reason simultaneously announces some of the main features of modern accounts of ethics, such as impartiality and universality as preconditions of moral judgment. The integration of these ancient and modern elements in a single coherent theory allows Smith’s TMS to overcome the insufficiencies and paradoxes of both these traditions, and it constitutes one of the most interesting and challenging proposals of modern ethics. Der Begriff der Toleranz in der Moderne wurde erdacht mit dem Ziel, Gesellschaften zu organisieren, die sich im Umbruch befanden auf Grund des plötzlichen Eindringens von Glaubensunterschieden in die politische Raumordnung. Die Definition der Toleranz als Tugend, die auf der Nachgiebigkeit gegenüber dem Andersartigen basiert, ist ein Pseudobegriff. Die hermeneutische Veranlagung, die mit der Philosophie einhergeht, zeigt, dass die Toleranz keine schlichte moralische Tugend sein kann, sondern vielmehr eine der Beschaffenheiten der Möglichkeit rationaler Handlungen (die Arten des Seins und des (...) Sagens fallen in der Vielfältigkeit ihrer Formen zusammen). Die Geschichte der Hermeneutik zeigt seit ihren Anfängen – die exegetische Arbeit war hierbei grundlegend – die Zwickmühlen der Existenzformen der Rationalität und lässt nur ein Denken an der Grenze zu, welche ihre Grundlage ist: Es gibt keine Tatsachen, sondern Interpretationen. Implikatura skalarna jest bardzo powszechnym typem wnioskowania pragmatycznego, które polega na uznaniu przez odbiorcę za nieprawdziwe zdań zawierających terminy bardziej informatywne niż termin użyty przez mówcę, kiedy wszystkie te terminy można umieścić na jednej skali. Pierwsza część tekstu stanowi przegląd podstawowych teoretycznych podejść do implikatur skalarnych. Druga część oferuje krótki przegląd badań empirycznych na temat rozwoju implikatur skalarnych u dzieci. Ostatnia część jest bazującą na przykładzie implikatur skalarnych próbą refleksji nad wzajemnymi stosunkami między pragmatyką teoretyczną a eksperymentalną.

So far, we have focused on discourse reference to atomic individuals and specific times, events, and states. The basic point of the argument was that all types of discourse reference involve attention-guided anaphora (in the sense of Bittner 2012: Ch. 2). We now turn to discourses involving anaphora to and by quantificational expressions. Today, we focus on quantification over individuals but the analysis we develop will directly generalize to other semantic types. By this point, we have developed some articulated analyses of top-level temporal anaphora, including temporal quantification, in languages with grammatical tense and/or aspect systems, represented by English, Polish, and Mandarin. But it is still not clear how this approach might extend to temporal anaphora in a language such as Kalaallisut, which has neither grammatical tense nor grammatical aspect, but instead marks only grammatical mood and person. Most theories of mood and modal reference either ignore temporal reference or analyze modal and (...) temporal reference as unrelated phenomena. Such theories provide no inkling how temporal reference in a tenseless mood-based language can be as precise as in English. (shrink)

The concept of “critical science literacy” advanced by Susanna Priest is significant to how citizens approach scientific knowledge, but the concept is also relevant to undergraduate students majoring in the sciences, who are not necessarily becoming “critically literate” in their own disciplines. That is, future scientists are not learning how arguments are structured, meaning is made, and facts are agreed upon—specifically through communicative practices—both within and outside of the scientific community. This gap in the curriculum can be addressed through collaborative (...) efforts between rhetoricians and sociologists of science. Drawing from three major disciplinary traditions—writing studies, the rhetoric of science, and science communication—this article posits that a pedagogical intervention is necessary to improve science communication with nonexpert publics. A science writing and communication course that is grounded in the rhetoric of science and that also has sociological, philosophical, and historical components can provide science students with a critical awareness of how their discipline operates in society and teach them how to become more responsible and effective communicators. A fin del siglo XX, en Argentina, los procesos de reforma del Estado con la descentralización de competencias a provincias y municipios en áreas vinculadas a la salud, la educación y la vivienda, trajo consigo el problema de que la descentralización de las competencias no fue correspondida con el traslado de recursos. Hoy, se suman otros reclamos en los espacios locales relacionados con el acceso al suelo urbano y la vivienda digna, la sustentabilidad ambiental, la equidad de género, la disminución (...) de la brecha digital entre otras. La falta de planificación de políticas integrales de hábitat para pobladores de menores ingresos, desposeídos, migrantes, empleados en servicios en las familias consolidadas o en la ciudad, profundiza la desigualdad social y la degradación ambiental en la ciudad. Este trabajo propone el análisis de las nuevas dinámicas de acceso al suelo de manera legal implementadas desde el Estado en Pehuajó, Argentina y, para ello hace foco en el estudio crítico del uso de instrumentos normativos en relación a la incorporación de la tierra privada como políticas de inclusión de la población de bajo recursos de barrios populares. La propuesta se articula como interpretación afiliada con el discurso del Programa para América Latina y el Caribe del Instituto Lincoln de Políticas del Suelo. Desde una óptica autodefinida como progresista aplica nuevos instrumentos a la gestión del suelo urbano con la función de prevenir la informalidad y tener así una ciudad más inclusiva, mejor financiada, distribuir más equitativamente los servicios públicos y las cargas, y elegir las geotecnologías más apropiadas. The concept of heterotopia challenges political theory, which has often focused on utopic thinking. Foucault describes a heterotopia as a heterogenous space that juxtaposes in a single real place several spaces, several sites that are in themselves incompatible. Streets, squares and parks form heterotopias when their utopic purity as public space is juxtaposed with the private spaces created by the cardboard boxes and other temporary shelters of homeless people. Since citizenship has traditionally been thought of as participation in a democratic (...) public sphere, how do heterotopias of homelessness challenge the ideas about citizenship? Based on narrative research with homeless people in Poland, I show how the homeless conceive of their marginality. Their participation or non-participation in democracy is not hidden but, on the contrary, very visible in public spaces where they are included as excluded. (shrink)

Desde então, a noção de biopolítica tem polarizado as leituras da teoria de poder de Foucault e talvez haja desempenhado um papel bem mais importante do que ele jamais pretendeu. Para propor um estudo genealógico do termo “biopolítica”, é importante olhar mais de perto a noção de vida que pode haver inspirado a análise foucaultiana. Foucault (...) opera com uma noção de vida que ele não determina: vida é um correlato de técnicas e estratégias de poder e de saber, ela carece de qualquer status ontológico e é ela mesma “produzida” pela constelação de poder-saber. Europe has the most educated generation in its history, yet an alarming number of graduates are overqualified. This paper explores the intersection between education and work from the perspectives of those involved in a sector that is prone to overqualification: the call centres of Romania’s thriving business service sector. Based on over 100 in-depth interviews with young people, human resource personnel, and managerial staff at different levels of seniority, the paper maps subjective views about overqualification. Despite the objective classification of (...) employment in call centres in terms of national occupational codes, most interviewees, regardless of their role, were unlikely to read their employment through the lenses of overqualification. Young people internalised the gap between education and employment and learned not to attach strong employment-related expectations to degrees, especially those in the social sciences and humanities (non-STEM). Managers and HR staff highly regarded company-specific skills and had learned to tap into a group of graduates without clear labour market routes. The paper conceptualises the availability of jobs at the bottom of the ‘knowledge economy’ in connection with employment structures available in the economic semi-periphery and problematises politically the question of overqualification. The feminist critical deconstruction of Western culture and theology written by Luce Irigaray could be said to represent a certain branch of ecofeminist perspectives on religion. The article analyses the symbolic structures of suppression of women, body and nature and the exaltation of spirit, culture and the androcentric God, inherent in four hymns included in the new supplement to the book of hymns in the Lutheran Church of Sweden. The analysis shows that these symbolic structures are visible also in these (...) more recent hymns, even though they can be said to also consider and bring out women's experiences. Despite their `feminist' approach, they have not, on any deeper level, affected the subordination of women and the nature-given. (shrink)

W artykule podjęto problematykę znaczenia rytuałów jako praktyk pamięci zbiorowej. Rytuały stanowią istotny wymiar pamięci przeszłości, a zarazem pas transmisyjny w podtrzymywaniu ciągłości pokoleniowej. Na płaszczyźnie empirycznej odwołano się do wybranych rezultatów badań socjologicznych, dotyczących rytuałów upamiętniania oraz obrzędów o charakterze patriotycznym, w których obok sacrum świeckiego niejednokrotnie pojawia się sacrum religijne, wzmacniające ich znaczenie. Podstawą refleksji były rezultaty badań własnych, przeprowadzonych wśród młodzieży maturalnej oraz jej rodziców pod koniec pierwszej dekady XXI wieku, oraz aktualnych badań ogólnopolskich.

In this article we explore the relationship between semiotic analysis of images and quantitative analysis of vast image corpora, in particular the work produced by Lev Manovich and the Cultural Analytics Lab, called “Media Visualization.” Media Visualization has been chosen as corpus because of its metavisual operation (images are visualized and analyzed by images) and its innovating way of conceiving analysis: by visual instruments. In this paper semiotics is used as an approach to Media Visualization and taken as an object (...) of study as well, especially visual semiotics. In this sense, a comparison between visual semiotics (close reading of small corpora) and quantitative analyses of images (distant reading of vast collections) are conducted from a semiotic point of view. Post-Greimassian semiotics guides this study with respect to the issue of the image-within-an-image and metavisual visualization; Peircean semiotics is employed to explain and develop the notion of diagram. The death of Bal Keshav Thackeray, in November 2012, has led several Indian journalists and intellectuals to think over the legacy of the supreme leader of the Shiv Sena to the Indian society. The present article means to identify the reasons which have let the Indian journalists describe the bequest of Thackeray to the Indian society in terms of a legacy of fear. The article deals with Thackeray's use of fear as a tool to arise consent around his social, cultural (...) and political thinking first and, secondly, to legitimize and justify the existence and the modus operandi of the Shiv Sena. The author dwells on the way Thackeray has been able to arise and feed social and cultural fear in order to give a meaning and a sense to his political enterprise. The article argues that the most scaring aspect of Thackeray's political discourse doesn't lie in the aims pursued and in the ways they have been pursued but in the idea of social and cultural identity it is based on. This paper focuses on the contributions to natural history, particularly in methods of plant classification of the Portuguese botanist, man of letters, diplomat, and Freemason Abbé José Correia da Serra (1751-1823), placing them in their national and international political and social contexts. Correia da Serra adopted the natural method of classification championed by the Frenchman Antoine-Laurent de Jussieu, and introduced refinements of his own that owe much to parallel developments in zoology. He endorsed the view that the classification of plants (...) should be based on the establishment of affinities rather than of differences. The emphasis on affinities went hand in hand with the development of the concept of symmetry. This idea was introduced by Correia da Serra in systematics and was adopted and further developed by his friend, Augustin-Pyramus de Candolle. Correia da Serra also argued that Cryptogamia reproduce sexually, advocated extension of methods of comparative anatomy from zoology to botany, and applied them to the study of fruits. Correia da Serra was one among many of the estrangeirados, Portuguese "Europeanized" intellectuals who traveled extensively abroad in most cases to escape political or religious persecution at home. The estrangeirados were important contributors to 18th and 19th century European thinking. Most of the estrangeirados were pivotal in the introduction, dissemination and propagation of the new sciences in Portugal, but unlike most of his fellow estrangeirados, Correia da Serra was also an innovative man of science in his own right. This paper has arisen from my interest in questions ofsubjectivity of primary concern to contemporaryfeminist jurisprudence. Rather than side with anyparticular view represented in the debates surroundingthese questions, I have used Foucault's concept ofepisteme to explore the tradition of feministlegal thought. By focusing upon seventeenth-centurywomen's writings in which the earliest statementslinking law to women's oppression are to be found, thepaper argues that knowledge claims about law'sassociation with women's oppression are predicated notupon the positing of a sovereign feministconsciousness, but upon the (...) specific positivities ofknowledge which existed at the time. Theunderstanding of the birth of the feminist legaldiscourse in terms of the specific conditions of itspossibility, although historically contextualised,raises questions about the hitherto seeminglyunassailable adherence to subjectivist epistemologywhich the current feminist engagement with lawmaintains.
