In the second half of the nineteenth century, France was the main site of the controversy around the so-called eoliths, supposedly human-made tools of Tertiary Europe. In contrast to the more common situation where scientists have to make sure that an object stabilized in a laboratory is not an artifact of the lab but a natural object, in the eoliths debates the opposite was the case. The eolith proponents tried to render plausible the object's artificial, that is human, origin. In (...) their case, the objects would only be of scientific interest if they were artifacts not geofacts (naturally flaked stones). The paper ties in with existing literature on the French eoliths movement and investigates the successive eoliths debates in Britain. In Bruno Latour's terms, eoliths as archaeological evidence for Tertiary Man in Europe could gain in reality through a successful enlisting of the collaboration of human and non-human actors such as scientists, theories, publications, taxonomies, technologies, institutions, etc. Indeed, networks were established among scientists, preferably of powerful institutions, the 'tools' were integrated or denied a place in existing taxonomies of prehistoric artifacts, experiments were carried out to demonstrate their chance or designed origin, and their convergence or incompatibility with a certain theoretical framework was discussed. Arguments often revolved around questions of negative evidence, since both proponents and opponents of eoliths as tools were aware of the fact that the eoliths' strongest tie to reality would be evidence of the toolmakers themselves. Several known hominid fossils, among them those of doubtful age, were thus proposed as Tertiary shapers of the 'tools'. These hypothetical 'Englishmen' and their supposed artifacts were enmeshed in particular theories of human evolution, marked as they were by the racism and nationalism widespread at the time. In this book, Marianne Moyaert develops a new interreligious appropriation of Paul Ricoeur’s hermeneutical philosophy. Viewed in context of his philosophical, anthropological, and ethical work, Ricoeur’s fragmentary reflections on the encounters between religions provide insights on global cooperation practices and religious identity concerns.

Is the Miranda warning, which lets an accused know of the right to remain silent, more about procedural fairness or about the conventions of speech acts and silences? Do U.S. laws about Native Americans violate the preferred or traditional "silence" of the peoples whose religions and languages they aim to "protect" and "preserve"? In Just Silences, Marianne Constable draws on such examples to explore what is at stake in modern law: a potentially new silence as to justice.Grounding her claims (...) about modern law in rhetorical analyses of U.S. law and legal texts and locating those claims within the tradition of Nietzsche, Heidegger, and Foucault, Constable asks what we are to make of silences in modern law and justice. She shows how what she calls "sociolegal positivism" is more important than the natural law/positive law distinction for understanding modern law. Modern law is a social and sociological phenomenon, whose instrumental, power-oriented, sometimes violent nature raises serious doubts about the continued possibility of justice. She shows how particular views of language and speech are implicated in such law.But law--like language--has not always been positivist, empirical, or sociological, nor need it be. Constable examines possibilities of silence and proposes an alternative understanding of law--one that emerges in the calling, however silently, of words to justice. During the last decades several tools have been developed to anticipate the future impact of new and emerging technologies. Many of these focus on ‘hard,’ quantifiable impacts, investigating how novel technologies may affect health, environment and safety. Much less attention is paid to what might be called ‘soft’ impacts: the way technology influences, for example, the distribution of social roles and responsibilities, moral norms and values, or identities. Several types of technology assessment and of scenario studies can be used to (...) anticipate such soft impacts. We argue, however, that these methods do not recognize the dynamic character of morality and its interaction with technology. As a result, they miss an important opportunity to broaden the scope of social and political deliberation on new and emerging technologies.In this paper we outline a framework for building scenarios that enhance the techno-moral imagination by anticipating how technology, morality and their interaction might evolve. To show what kind of product might result from this framework, a scenario is presented as an exemplar. This scenario focuses on developments in biomedical nanotechnology and the moral regime of experimenting with human beings. Finally, the merits and limitations of our framework and the resulting type of scenarios are discussed. (shrink)

This paper explores food commoning through an ethnographic case study in Catalonia as our primary site while the Norwegian case is juxtaposed as a comparison, two agriculturally and economically different European countries. The ethnography analyses cooperation networks between organic food producers’ and consumers’ involving different nodes of community gardening initiatives, self-employed growers, local farmers and all of them under a unique cooperative integrating a community economy. The result it is a myriad of exchange practices ranging from reciprocity and barter to (...) market exchange without intermediaries through on-line platforms. Along these exchanges different options of currency intervene giving rise to novel social and cooperative relations. Similar initiatives in Norway show less variation and are less experimental regarding forms of payment but share similarities in relation to material articulations, concerns and forms of alternative practice. Although these novel forms do not represent a complete break from the more standardized supply chains, and hence from the oppositions/contradictions of production and consumption, the participants see themselves as contributing to a more general process of de-commodification of food. We explore the extent to which the meaning and moral values are mutually constituted in relation to socioeconomic exchanges and environmental caring that each person experiences based on different forms of cooperation and reciprocity. Food, we suggest, is more than a commodity on the market that we may influence through our role as consumers. It is a significant focal point connecting our lives to those of others that articulates one’s relations to society in a political manner. (shrink)

French cultural theorist and urbanist Paul Virilio is best known for his writings on media, technology, and architecture. Gathered here in _A Winter’s Journey _are four remarkable conversations in which Virilio and architectural writer Marianne Brausch look at a twentieth century characterized by enormous technological acceleration and by technocultural accidents of barbarism and horror. The dialogues in _A Winter_’_s Journey—_structured loosely around the dates 1940, 1950, 1960, and 1980—chart Virilio’s intimate intellectual biography, from his childhood lived against the unstable (...) backdrop of a heavily bombed, wartime Nantes to maturity in a crisis space that is neither entirely militarized nor yet fully civilian, but somewhere between the two. In the course of these conversations, Virilio and Brausch ultimately find hope that in understanding the events of the last century and the cultural responses spawned by them, we can create a more humane era that is more adept at handling the transformations of its technology and culture. _A Winter’s Journey _is a revealing and engaging look into the intellectual life and ideas of one of the most influential theorists of contemporary civilization. Multinational corporations (MNCs) have brought attention to the challenges of business ethics in intercultural settings. A lack of understanding regarding cultural pluralism in business ethics education has motivated some scholars to consider a broader lens, one that recognizes the influence of religion (Spalding and Franks 2012). Management awareness of the similarities and differences that stem from deeply held beliefs is essential, as unstated thoughts and feelings caninfluence starting assumptions, even before ethical decision-making processes begin. If deeply entrenched cultural traditions and (...) religious values remain implicit and/or misunderstood, collaborative efforts may be derailed due to an inadvertent lack of respect and understanding. Because many Westerners remain unfamiliar with Muslim-based beliefs, the authors advance business ethics education by offering an overview of business practices in the Middle East. A modeland exercise are presented as tools to promote awareness of cultural perspectives. This platform for understanding will help adult learners see how their personal origins can shape and influence management thought. (shrink)

Phenomenology has been adapted for use in qualitative health research, where it’s often used as a method for conducting interviews and analyzing interview data. But how can phenomenologists study subjects who cannot accurately reflect upon or report their own experiences, for instance, because of a psychiatric or neurological disorder? For conditions like these, qualitative researchers may gain more insight by conducting observational studies in lieu of, or in conjunction with, interviews. In this article, we introduce a phenomenological approach to conducting (...) this kind of observational research. The approach relies on conceptual grounding to focus a study on specific aspects of the participants’ experiences. Moreover, the approach maintains the openness to novel discoveries that qualitative research requires while also providing a structured framework for data collection and analysis. To illustrate its practical application, we use examples of hemispatial neglect—a neurologic disorder in which patients characteristically lack awareness of their own illness and bodily capacities. However, the approach that we describe can be applied more broadly to the study of complex illness experiences and other experiential alterations. (shrink)

Computational psychiatry is a quickly evolving discipline that aims to understand psychopathology in terms of computational, hence algorithmic processes. While cognitive phenomena, especially beliefs or ways of “reasoning”, can more easily be formalized, meaning re-described in mathematical terms and then entered computational models, there is speculation as to whether phenomenology might be formalizable too. In other words, there are speculations in terms of what aspects of the human experience, rather than specific cognitive processes alone, can enter computational models. Here, we (...) explore the possibility of formalizing and modeling a phenomenological account of schizophrenia, using the concepts of “minimal self” and “intentionality”. To test the applicability of these concepts for formalization and modeling, we first aim to clarify some misunderstandings around the very nature of minimal self and intentionality, namely: whether these concepts entail a “minimal” sense of self, or might be better described in “transparent” sensory-integration and information processing terms. We then try to apply the concepts to a computational logic based on Marr’s levels of description, a fundamental account for understanding the rationale of computational psychiatry. Overall, we are asking via what conditions phenomenology can enter a computational logic. (shrink)

Background Since the enactment of the euthanasia law in the Netherlands, there has been a lively public debate on assisted dying that may influence the way patients talk about euthanasia and physician-assisted suicide with their physicians and the way physicians experience the practice of EAS. Aim To show what developments physicians see in practice and how they perceive the influence of the public debate on the practice of EAS. Methods We conducted a secondary analysis of in-depth interviews with 28 Dutch (...) physicians who had experience with a complex case of EAS. Respondents were recruited both by the network of physicians working for SCEN as well as via a national questionnaire, wherein participating physicians could indicate their willingness to be interviewed. Results Three themes came up in analysing the interviews. First, the interviewed physicians experienced a change in what patients would expect from them: from a role as an involved caregiver to being the mere performer of EAS. Second, interviewees said that requests for EAS based on non-medical reasons came up more frequently and wondered if EAS was the right solution for these requests. Last, respondents had the impression that the standards of EAS are shifting and that the boundaries of the EAS regulation were stretched. Conclusions The perceived developments could make physicians less willing to consider a request for EAS. Our results also raise questions about the role of physicians and of EAS in society. (shrink)

The movement advocating the formal certification of clinical ethics consultants may result in major changes to the field of clinical ethics consultation by creating a new standard of care. The actual certification process is still in the development phase, but unanswered questions include: What will certification cost, and, Who will pay? Currently there is little salary support for ethics consultants and no regulation requiring healthcare institutions to offer clinical ethics consultation. Without the support of healthcare administrators and accreditation bodies, this (...) may remain unchanged.Healthcare administrators may be unwilling to pay for certification or professional services if accreditation bodies do not require healthcare institutions to provide certified ethics consultants’ services. If consultants will not be reimbursed or paid, they may not seek certification. If certified consultants are required, healthcare administrators may look for ways to cover the costs for providing this service, including insurance or third-party reimbursement and direct billing of patients for consultations, which may affect who performs and who participates in ethics consultation. However, this is less than ideal, as bioethicists believe ethics consultation should be available to all as part of providing safe, quality ethical care and support and guidance for patients, families, and healthcare staff.Going forward, bioethicists should study quality improvement, patient safety, and cost-savings resulting from certification-eligible clinical ethics consultants’ activities. Administrators and financial personnel can be surveyed regarding their support for the certification process. Bioethicists should enlist the help of patient rights and safety advocacy groups, professional medical associations, and healthcare administrators. Bioethicists should invite accreditation bodies, healthcare administrators, and financial personnel to collaborate in the development of the certification process. Without their support, certification may be of value only to the bioethics community, and may have little standing in actual clinical healthcare institution settings. (shrink)

Neuropalliative care developed to address the needs of patients living with life‐limiting neurologic disease. One critical consideration is that disease‐related changes to cognition, communication, and function challenge illness experiences and care practices. We conducted an ethnography to understand neuropalliative care as a phenomenon; how it was experienced, provided, conceptualized. Personhood served as our conceptual framework; with its long philosophical history and important place in nursing theory, we examined the extent to which it captured neuropalliative experiences and concerns. Personhood contextualized complex (...) losses, aligning the impact of functional and relational changes. Cognition, communication, and functional alterations stretched conceptions of personhood, insinuating it can be relational, fluid, adaptive. Although normative conceptions of personhood guided research and decision‐making, ethical considerations suggested personhood could be transformed, remade. We consider the implications of our findings through three themes. First, we examine how literature on illness experience fails to integrate the realities of people living with and dying from neurologic disease; we counter this by interrogating the concept of experience. Second, we turn to Ricoeur's work on recognition to illuminate relational conceptions of personhood to inform care practices. Finally, we reflect on how personhood can bridge the gap left by functional changes, enhance relational engagement, and promote dignity at the end of life. (shrink)

The legalization of cannabis in Canada instantiates principles of harm-reduction and safe supply. However, in-depth understanding of values at stake and attitudes toward legalization were not part of extensive democratic deliberation. Through a qualitative exploratory study, we undertook 48 semi-structured interviews with three Canadian stakeholder groups to explore opinions and values with respect to the legalization of cannabis: (1) members of the general public, (2) people with lived experience of addiction and (3) clinicians with experience treating patients with addiction. Across (...) all groups, participants tended to be in favor of legalization, but particular opinions rested on their viewpoint as stakeholders. Clinicians considered the way legalization would affect an individual’s health and its potential for increasing rates of addiction on a larger scale. People with lived experience of addiction cited personal autonomy more than other groups and stressed the need to have access to quality information to make truly informed decisions. Alternatively, members of the public considered legalization positive or negative in light of whether one’s addiction affected others. We elaborate on and discuss how scientific evidence about drug use impact values relates and how can different arguments play in democratic debates about legalization. (shrink)

We work in set-theory without choice ZF. A set is Countable if it is finite or equipotent with ${\Bbb N}$ . Given a closed subset F of [0, 1] I which is a bounded subset of $\ell ^{1}(I)$ (resp. such that $F\subseteq c_{0}(I)$ ), we show that the countable axiom of choice for finite sets, (resp. the countable axiom of choice AC N ) implies that F is compact. This enhances previous results where AC N (resp. the axiom of Dependent (...) Choices) was required. If I is linearly orderable (for example $I={\Bbb R}$ ), then, in ZF, the closed unit ball of the Hilbert space $\ell ^{2}(I)$ is (Loeb-)compact in the weak topology. Active pluralism, an idea advanced by Steve Stevaert, former leader of the Flemish Socialist political party, has been commonly accepted among most progressive citizens. It is now a political, social and pedagogical ‘hot’ topic. Anyone wishing to be perceived as ‘open’ pleads earnestly for interreligious dialogue. Instead of passive tolerance, which too often leads to indifference, the other should now be entitled to our active concern. What is more, it benefits society as a whole. Congenial as this is, the plea (...) for active pluralism remains rather vague. This vagueness has the advantage that everyone can embrace active pluralism and be a winner. However, if active pluralism is to be more than just the latest novelty it will require conceptual clarity. Only then can it be assessed on whether it succeeds in offering a better alternative to passive pluralism. In this article I reflect on the Flemish discussion on active pluralism and intend to articulate the philosophical, anthropological and hermeneutical presuppositions underlying the concept. When the University of Halle-Wittenberg founded the Interdisciplinary Centre for Research into the European Enlightenment in 1993, it was following the destiny of its history as a centre of the Early Enlightenment in Germany which affected the whole of Europe and as one of the moving forces behind the Anthropological Turn. Research foci of the Centre have been and are Enlightenment anthropology, Enlightenment in the reference field of early modem esotericism, university history, philanthropism and the Garden Kingdom of Dessau-W rlitz; (...) more recent emphasis has been on the Early Enlightenment as a field of experimentation and the foundation of cultural models for the Modern Age. The results of this research have been published since Autumn 1995 in the Centres' research publications series entitled University of Halle Series on the European Enlightenment. In addition, there have been relevant works produced outside the Centre. Two to four volumes are published annually (monographs, collected volumes, commentaries on sources). (shrink)

The Dutch pig husbandry has become a topic of public debate. One underlying cause is that pig farmers and urban-citizens have different perspectives and underlying norms, values and truths on pig husbandry and animal welfare. One way of dealing with such conflicts involves a learning process in which a shared vision is developed. A prerequisite for this process is that both parties become aware of their own fixed patterns of thoughts, actions, and blind spots. Therefore, we conducted five homogeneous focus (...) groups consisting of either urban-citizens or pig farmers. The first part of the sessions aimed to make the participants aware of their own perspectives and underlying norms and values concerning animal welfare, farm practices or consumer behavior. Then, by the use of role-play and film fragments showing the perspectives of the other party, we aimed to stimulate frame reflection. The farmers maintained their own perspective and defended their practices. They denied the perspective of the urban-citizens by portraying them as ignorant of the “factual” farm practices. They proposed the use of one-way information, but our results indicate that this is likely to fail as a strategy to support or restore public acceptance. Our case shows hardy any consensus regarding the relevance of the facts at stake and a very limited amount of shared values. However, the shared love for animals together with the recognition by the urban-citizens of the inescapable dilemma for farmers to adopt a use-framing towards animals might provide an opening for further learning strategies. Through an analysis of the vocabulary used by Latin and Greek authors to describe the decision process at work in the Roman Senate, key notions of the political culture shared by the elite of the time can be investigated. Among them, the sententia reveals a central element, shedding light upon the function of the senator and the Senate itself from an anthropological point of view, instead of the usual institutional one.

Der Begriff des Lebewesens ist einer der Grundbegriffe unserer Alltagsontologie. Die Biologie ist zwar die Wissenschaft von den lebenden Wesen, nicht aber davon, was ein Lebewesen ist. Diese Frage ist vielmehr metaphysischer Natur. Die Autorin untersucht grundlegend den ontologischen Status von Lebewesen. Sie wendet sich gegen die cartesianische Auffassung von Lebewesen als Körpern und argumentiert statt dessen für eine am aristotelischen Substanzbegriff orientierte Auffassung. Dafür verteidigt sie zunächst die allgemeine Kategorie der Kontinuanten (der "fortdauernden" Gegenstände) gegenüber prozessontologischen Einwänden, um dann (...) zu zeigen, warum Lebewesen keine Dinge sind, sondern eine eigene Kategorie von Kontinuanten bilden. In this article, I am concerned with the public engagements of Julian Huxley, Lancelot Hogben, and J. B. S. Haldane. I analyze how they used the new insights into the genetics of heredity to argue against any biological foundations for antidemocratic ideologies, be it Nazism, Stalinism, or the British laissez-faire and class system. The most striking fact—considering the abuse of biological knowledge they contested—is that these biologists presented genetics itself as inherently democratic. Arguing from genetics, they developed an understanding of (...) diversity that cuts across divisions of race, class, or gender. Human diversity rightly understood was advantageous for societal progress. Huxley, Hogben, and Haldane did not hold identical political ideals, but they all argued for democratic reforms and increased planning geared toward greater social equality, and they did so under the label of scientific humanism. Huxley took issue with the notion that evolutionary history does not carry any moral lessons for human societies. Rather than being its antithesis, evolution was the basis of human sociality. In fact, the entire future progress of individuals and communities toward a democratic world order needed to be founded on the cosmic principles of evolution—a process that had to be guided by the biological expert with a strong sense of social responsibility. Homeotic genes are subject to transcriptional silencing, which prevents their expression in inappropriate body regions. Here, we shall focus on Drosophila, as little is known about this process in other organisms. Evidence is accumulating that silencing of Drosophila homeotic genes is conferred by two types of cis‐regulatory sequences: initiation (SIL‐I) and maintenance (SIL‐M) elements. The former contain target sites for transient repressors with a highly localised distribution in the early embryo and the latter for constitutive repressors that are likely to (...) be present in all cells. We discuss how SIL‐I elements may cooperate with SIL‐M elements to promote formation of a silencing complex. We propose that this complex consists of specific non‐histone proteins, the so‐called Polycomb group proteins, and that it is anchored at SIL‐M elements and at the promoter. (shrink)

This paper discusses the definition of argumentation as a means for persuading an audience on the acceptability of a thesis. It is argued that persuasion is a goal that relates more to the communicative situation, the type of interaction or the type of discourse, rather than to the argumentative nature of it. Departing from the analysis of a short conversational sequence between people who agree on an issue and nevertheless argue, I suggest that a definition of argumentation in terms of (...) persuasion fails to account for what people are actually doing in these situations. I propose instead that several functions may be assigned to argumentation when considering the context in which it is produced: a cognitive function (which helps participants to elaborate a position on the discussed issue), and an identifying function (which enables them to portray themselves through the expression and the justification of their opinion). In the case analyzed here, a third function to which the argumentative activity contributes can also be identified, namely the enhancing of the emotional tonality of the relationship between the participants. While it becomes clear from the discussion of this argumentative sequence that the participants do not seek to persuade each other or some third party, it is not suggested that argumentation never aims at persuading an audience, but rather that persuasion cannot be considered as a defining feature of argumentation. Dans notre État laïque et démocratique, les débats relatifs aux sujets d’éthique ne semblent pas pouvoir être menés dans une ambiance apaisée. Loin d’entendre des échanges ouverts et rationnels, nous assistons à des joutes oratoires emplies de condamnations incohérentes et de prédictions aussi catastrophistes qu’infondées. Pourtant, au moment même où l’espace public et médiatique semble refuser le débat lucide et raisonnable, un nouveau territoire offre l’occasion de le mener à bien : celui des séries télévisées. Véritable phénomène culturel d’une ampleur (...) inédite, l’essor des séries télés, outre sa fonction de divertissement, permet aux questions d’éthique d’être véritablement posées et discutées. Depuis la question de la vie jusqu’à celle de la mort, depuis la question des services corporels à celle des comportements sexuels, les séries couvrent tout le champ de l’éthique contemporaine. Populaires sans céder au populisme, elles s’offrent indéniablement des outils au service de la réflexion éthique. (shrink)
