This study examines the similarities and differences in pre- and post-Sarbanes-Oxley corporate ethics codes and codes of conduct using the framework of structuration theory. Following the passage of the Sarbanes-Oxley (SOX) legislation in 2002 in the United States, publicly traded companies there undertook development and revision of their codes of ethics in response to new regulatory requirements as well as incentives under the U.S. Corporate Sentencing Guidelines, which were also revised as part of the SOX mandates. Questions that remain are (...) whether these new or revised codes are effective means of communicating changed ethical foci and attitudes in organizations. Centering resonance analysis (CRA) is used to identify differences and similarities across time and industries by analyzing word networks of 46 pre- and post-SOX corporate codes of ethics. Analyses focus on content and structure of generated word networks as well as resulting factors that emerged from the texts. Results are interpreted from the structuration perspective that content and structure of codes are constrained and enabled by system structures while they function to produce and reproduce those structures. Results indicate that corporate codes of ethics are formal discourses of ethics, laws, and control. Code structure has changed across time, with an increased emphasis on compliance in post-SOX codes. Implications for research and practice are discussed in light of findings. (shrink)

In discussions surrounding epistemology and rationality, it is often useful to assume an agent is rational or ideally rational. Often, this ideal rationality assumption is spelled out along the following lines: -/- 1. The agent believes everything about a situation which the evidence entitles her to believe and nothing which it does not. -/- 2. The agent believes all the logical consequences of any of her beliefs. -/- 3. The agent knows her own mind: if she believes P, she believes (...) that she believes P; and if she doesn't believe P, she believes that she doesn't believe P. -/- 4. The agent believes nothing of the form 'P and it is not the case that P.' -/- 5. If an agent's background belief-set satisfies 1-4 and if rationality requires the agent to add P to her belief-set, then the resulting belief-set will also satisfy 1-4. -/- While individually plausible, there are cases in which holding on to 1-5 generates paradox. Some resolve such paradoxical cases by granting 1-5 but arguing while ideally rational agents can exist, they can't possibly ever find themselves in such a situation: such case descriptions are epistemically incoherent. Others allow that rational agents can coherently find themselves in such odd circumstances, and argue that it's more reasonable to weaken our concept of ideal rationality and give up premise (2) above. However, this strategy has also been rejected. My aim in this paper is to defend the utility of positing an ideally rational agent in such paradoxical circumstances. I argue in such cases we should give up (2), in particular the assumption that (necessarily) if an ideally rational agent believes both P and the conditional, if P then Q, then she believes Q.. What's important is to hold on to the goal of positing ideal rationality: to maximize the amount of true or probably true information a thinker can justifiably believe in a given circumstance. Normally that will mean holding on to (2), but these unusual paradoxical cases are best handled by giving up (2). (shrink)

The program of the Geschichtliche Grundbegriffe, formulated primarily by Otto Brunner, Werner Conze, and Reinhart Koselleck, calls for relating conceptual change to structural transformations of government, society, and economy in German-speaking Europe. J. G. A. Pocock, of Cambridge, identified the range of alternative and competing political discourses available to early modern writers, while Quentin Skinner, also of Cambridge, treated political theories in terms of those historical contexts and linguistic conventions which both facilitate and circumscribe legitimations of political arrangements, and he (...) described such theories as intentional speech acts. Despite the differences in the German and Anglophone modes of treating political language, however, there are no major obstacles in bringing them together. The GG could profit from Pocock's technique of analysis and comparison in identifying early modern political languages, and the issues raised by Skinner about political thought and theorizing as forms of linguistic action, as well as the effect of general linguistic conventions upon available modes of legitimating political arrangements. The Anglophone mode might profit from considering the GG's non-reductive use of social history in conjunction with that of concepts, and from the GG's systematic use of contemporary sources of language and linguistic definitions. A layoff is a threatening yet common event which employees might face at some point in their working lives. In two scenario-based experiments, we investigated which actions of a layoff agent during a dismissal notification meeting may contribute to laid-off employees’ fairness judgments and negative attitudes toward the employer. In general, the extent to which layoff victims were treated with respect was consistently found to increase perceptions of interpersonal and procedural fairness and to mitigate negative attitudes toward the employer. Further (...) results showed that layoff victims preferred to be given an adequate explanation of the reasons for the layoff and to receive notice from the direct supervisor. Relationships between the layoff agent’s actions and layoff victims’ negative attitudes toward the employer were mediated by perceptions of procedural fairness. In addition, delegating the layoff agent’s task to an external consultant increased perceived psychological contract breach. Our findings have important implications for organizational justice research and for the managerial practice of implementing fair layoffs. In particular, small actions, such as treating employees with respect, might be of benefit both to humans and organizations. (shrink)

In this article Kant’s conception of practical reason is reconstructed in order to address a problem of effectiveness inherent in the space of reasons: How can actions be thought of as being free whilst at the same time being bound by the knowledge of practical necessity? Following Kant, the concept of law proves to be central to the transcendental cognition of the presuppositions of practical reasoning. The starting point of the transcendental argument is not the ordinary »moral« judgment, but the (...) capability of the power of choice. The power of choice is executed via practical judgments, which can be understood as a practical knowledge with more or less satisfactory reasons. By interpreting the »paradox of method in a critique of practical reason«, an indirect argument uncovering the undeniability of a lawful form of practical knowledge can be reconstructed. Therefore, actions cannot be understood as single events that direct reasons into a world lacking any reference to reason. Rather, no intentional action is conceivable without a connection to the form of practical knowledge. (shrink)

A central aim of Construction Grammar is to model links within the construct-i-con. This paper investigates three constructions that share one property: an atypical element in the object slot. The constructions are therefore not prototypically transitive. Structural priming (implemented with an automatic maze variant of self-paced reading) is used to test hypotheses on the relation among the Reaction Objoid (She smiled her thanks), the Cognate Objoid (She smiled a sweet smile or He told a sly tale), and the Superlative Objoid (...) (She smiled her sweetest) Construction, and between two variants of the latter (They worked (at) their hardest). Results support transitivity as gradient: intransitive COCs prime the ROC and the SOC, whereas COCs with transitives only prime the ROC. For variants of the SOC, we find evidence of asymmetric priming with the bare SOC priming the at-SOC. Within-construction priming effects in the SOC are of greater magnitude than those with the at-SOC and the latter are weaker than those of the COC and of a rather different nature than those from the ROC. This suggests that speakers, rather than creating a constructeme between the bare and the at-SOC, store distinct but closely related constructions on a cline of transitivity. (shrink)

In a debate between tolerance and intolerance one is disinclined to side with intolerance. Nevertheless that, in a sense, is what I want to do in this paper. The particular debate I have in mind is the old one between H.L.A. Hart and Patrick Devlin about the legal enforcement of moral values. It should be noted, though, that the issue has by no means been settled in the minds of many people. The proposed repeal of the British law prohibiting the (...) promotion of homosexuality (a law known as Section 28) “could destroy Scottish society,” according to Mazhar Malik of Glasgow’s Ethnic Community Resource Centre, echoing Devlin’s concern from the 1960s. In what follows I will first sketch and defend, partially, what I take to be Devlin’s communitarian argument and then attempt to explain what is wrong with it and how this should affect our estimation of the proper relation between law and morals. I will argue that at least some private ‘immorality’ can be defended without recourse to the liberal belief in a morally private sphere. In part I I look at the kind of communitarianism that can be found in Devlin’s work, in part II I support this reading of Devlin and expand on it by looking at some important passages from his work, and in part III I consider the reasons why his argument does not support legislation against gay sex, and, in fact, could be used to defend gay rights. Daß der Anteil griechischen Materials am Wortschatz der koptischen Sprache enorm hoch ist und daß er nicht nur quantitativ, sondern auch qualitativ, durch Lehnworte der meisten grammatischen und semantischen Wortklassen, konstitutive Bedeutung für das koptische Lexikon hat, ist nie bezweifelt worden. Dennoch sind alle existierenden koptischen Wörterbücher (z.B. Peyron, Spiegelberg, Crum, Westendorf) vom Standpunkt ägyptischer Etymologie und Diachronie aus zusammengestellt – die synchronen griechischstämmigen Bestandteile des koptischen Wortschatzes blieben prinzipiell ausgeschlossen, etwa vergleichbar einem Duden, der Worte wie ‚Fenster‘, ‚Mauer‘, ‚Wein‘ (...) oder ‚Ziegel‘ aussparte. Semasiologische oder onomasiologische Studien zum griechischen Lehnwortschatz waren bislang auf die Indices von Editionen und Konkordanzen vereinzelter Textcorpora angewiesen. Kein Wunder also, daß die lexikographische Erfassung der griechischen Lehnworte im Koptischen seit langem zu den dringendsten Desideraten zählt. Vor nun genau fünfzig Jahren wurde von Alexander Böhlig in Halle das Wörterbuch-Projekt griechischer Lehnworte im Koptischen begründet, nach widrigen Schicksalen ist es 1996, wiederum in Halle, neubegründet worden. After publishing the first part of Democracy in America, Tocqueville travelled through England and Ireland. With his impressions of the early industrial revolution still fresh, he read and annotated Machiavelli's Florentine Histories. Tocqueville's interest was present-minded: could Florence be used 'as an argument for or against democracy in our time?' Rejecting charges that modern democracies share the defects that bought down the Florentine Republic, Tocqueville contrasted late medieval and modern republicanisms; direct and representative democracies; the politics of city states to (...) those of larger modern nations with substantial urban and rural populations. Comparing renaissance Florence to industrial revolution Manchester and Birmingham led Tocqueville to consider redefining equality in economic rather than purely social terms. These notes suggest that in 1836, he held a view of the relationships between manufacturers and workers different from that of his later chapter 'How Industry could Give Rise to Aristocracy' in the 1840 Democracy. In der Öffentlichkeit häufig als Auswanderungsland wahrgenommen, unternahm China in den letzten Jahren verstärkt Bemühungen, qualifizierte Fachkräfte aus dem Ausland für den chinesischen Arbeitsmarkt zu gewinnen. Die Einführung eines Fachkräfteeinwanderungssystem mit abgestuften Rechten für Arbeitsmigrant:innen sollte diese Entwicklung fördern. Die vorliegende Analyse zeigt, dass diese Reform des Einwanderungssystems die Gerichtspraxis nicht verändert hat. Abseits der politischen Diskurse um die Anwerbung von internationalen Talenten und der Propagierung Chinas als Wissenssupermacht, bleibt China aufgrund der existierenden Probleme im bestehenden Rechtssystems für Arbeitsmigrant:innen unattraktiv.
