Mary Anne Warren investigates a theoretical question that is at the centre of practical and professional ethics: what are the criteria for having moral status? That is: what does it take to be an entity towards which people have moral considerations? Warren argues that no single property will do as a sole criterion, and puts forward seven basic principles which establish moral status. Any even cursory examination of what it is to exchange words about X or to exchange views about Y requires hard thought about what it is to exchange, period. How do we invest in what we give out, and how do we get it back? In kind, or differently moneyed? And, more crucial to the topic into which I am about to make a foolhardy plunge, is there such a thing as free exchange? And if so, what is it worth?How (...) do we perceive worth anyway? What relation does such perception of the invisible system of the initially visible coinage of exchange bear to present visual perception, and then to seeing? And what does perception matter anyway, in relation to writing, reading, and exchanging words? Which is primary?All these questions—in their institutional setting, or then in their freedom from context—can themselves be related to and gathered up into the notion of translation, or the carrying over from one side to, and into, another. All we can learn about speaking and the ways it is taught, reading and the ways we learn it, seeing and the ways it teaches us is translated and transported from sight and its constraints and choices to language and its own. How we read both is itself a subject of choice and constraint, of freedom and explicit value-placing, of variety and fidelity to certain ends. It is good for people to understand their insurance coverage and the reasoning that has shaped it, to be able to contribute their two cents if they want to, and to know that their plan has at least attempted to make decisons that are consistent, fair and compassionate. It is also good for them to be told that attention to cost is ethically required. Nevertheless, while following the recommendations of Wynia et al (2004) might make benefits design and administration appear (...) more fair, it will not do as much as they suggest for them to be more fair. Mary Anne Perkins re-examines Coleridge's claim to have developed a "logosophic" system which attempted "to reduce all knowledges into harmony." She pays particular attention to his later writings, some of which are still unpublished. She suggests that the accusations of plagiarism and of muddled, abstruse metaphysics which have been levelled at him may be challenged by a thorough reading of his work in which its unifying principle is revealed. She explores the various meanings of the term "logos," a recurrent (...) theme in every area of Coleridge's thought--philosophy, religion, natural science, history, political and social criticism, literary theory, and psychology. Coleridge was responding to the concerns of his own time, a revolutionary age in which increasing intellectual and moral fragmentation and confusion seemed to him to threaten both individuals and society. Drawing on the whole of Western intellectual history, he offered a ground for philosophy which was relational rather than mechanistic. He is one of those few thinkers whose work appears to become more interesting and his perceptions more acute as the historical gulf widens. This book is a contribution to the reassessment that he deserves. (shrink)

By a potential person I shall mean an entity which is not now a person but which is capable of developing into a person, given certain biologically and/or technologically possible conditions. This is admittedly a narrower sense than some would attach to the term ‘potential'. After all, people of the twenty-fifth century, if such there will be, are in some sense potential people now, even though the specific biological entities from which they will develop, i.e. the particular gametes or concepti, (...) do not yet exist. For there do exist, in the reproductive capacities of people now living and in the earth's resources, conditions adequate to produce these future people eventually, provided of course that various possible catastrophes are avoided. Indeed, in some sense of ‘potential’ there have been countless billions of potential people from the beginning of time. But I am concerned not with such remote potentialities but with currently existing entities that are capable of developing into people. (shrink)

The classification of clinical problems, such as AIDS, requires choices. Choices are made on epistemic (i.e., knowledge-based) and non-epistemic (i.e., action-based) grounds. That is, the ways in which we classify clinical problems, such as AIDS, involve a balancing of different understandings of clinical reality and of clinical values among participants of the clinical community. On this view, the interplay between epistemic and non-epistemic interests occurs within the embrace of particular clinical contexts.The ways in which we classify AIDS is the topic (...) of this paper. We consider the extent to which we construct clinical reality; we examine a suggested classification of AIDS; and we conclude suggesting that the choice regarding how to classify AIDS is the result of negotiation among participants in the clinical community. Nobody would prevent him (...) from publishing a passionate attack on what he would call the liberal view. He would of course have to state the liberal view before attacking it; he would make that statement in the quiet, unspectacular and somewhat boring manner which would seem to be but natural; he would use many technical terms, give many quotations and attach undue importance to insignificant details; he would seem to forget the holy war of mankind in the petty squabbles of pedants. Only when he reached the core of the argument would he write three or four sentences in that terse and lively style which is apt to arrest the attention of young men who love to think. That central passage would state the case of the adversaries more clearly, compellingly and mercilessly than it had ever been stated in the heyday of liberalism, for he would silently drop all the foolish excrescences of the liberal creed which were allowed to grow up during the time when liberalism had succeeded and therefore was approaching dormancy. His reasonable young reader would for the first time catch a glimpse of the forbidden fruit. The attack, the bulk of the work, would consist of virulent expansions of the most virulent utterances in the holy book or books of the ruling party. What Strauss describes here is the practice of “writing between the lines” by authors holding heterodox views, constrained by the prejudices of their audience or the vested interests of the regimes within which they write. Dans cet article, je soutiens que l’épuisement subjectif fragilise l’individualité dans l’exécution des actes intentionnels de douter, se soucier, planifier et finalement se protéger. Ces quatre actes intentionnels sont intersubjectifs puisqu’ils sont orientés vers autrui et illustrent une relationnalité imposée. L’épuisement subjectif est relatif aux individus et il affecte la subjectivité parce qu’il empêche l’individu d’entreprendre des projets existentiels individuels. Cette relationnalité imposée et toujours orientée vers autrui affaiblit l’intentionnalité d’une personne et fragilise son individualité. Une description phénoménologique révèle ces (...) actes invisibles et non quantifiables, et comment ils influencent les intentions et les actions d’un sujet. Finalement, je soutiens que l’épuisement subjectif est un phénomène négatif impliquant des risques éthiques, épistémiques, existentiels et émotionnels pour les sujets subalternes. Ainsi, ces quatre actes intentionnels, vécus dans un contexte social inégalitaire, renforcent l'épuisement subjectif et l’imposent aux sujets subalternes. (shrink)

I examine a problem or dilemma of legitimation faced by the critical theorist who takes as the object of his or her critique a totality of which she or he is a part. The dilemma is that the theorist must either illegitimately exempt her critical theory from the determining influences of the totality or lose normative authority. The critics I examine in detail are: Adorno and Horkheimer; Kant; Hegel; feminist standpoint epistemologists, in particular, Sandra Harding; Irigaray; Foucault; and Arendt. ;I (...) conclude that a purely theoretical or epistemic ground for the legitimacy of totalizing critique is impossible; philosophical critique must involve an extra-rational faith or a political commitment. However, I also argue that the project of theoretical grounding should not be abandoned. I continue this project by drawing out of the critical theorists I examined some preliminary concepts and strategies that may, after further development, serve to provide a theory of the legitimacy of critical philosophy. By and large, neither bioethicists nor economists have offered a satisfactory account of how managed care organizations should ration health care. Both disciplines would like to guarantee adequate care to all without defining adequacy. But it cannot be done. The more we rely on market forces to distribute health care, the more we need a national standard of care.
