Die liberale Theologie in Jena im ausgehenden 19. Jahrhundert ist als eigenständige Form liberaler Theologie im Sinne einer theologischen Richtung zu verstehen. Der Verfasser erhebt die fundamentaltheologischen und exegetischen Grundlagen der liberalen Jenaer Theologie in der Zuordnung von Glaube und Vernunft, Teleologie und Kausalität und entsprechend Theologie und Philosophie. Die Protagonisten (Richard A. Lipsius, O. Pfleiderer, A. Hilgenfeld u.a.) verknüpfen die kategorialen Grundannahmen Kants, Schleiermachers und Hegels, um die empirischen Materialien der Religionsgeschichte in ihrer Eigenständigkeit zu würdigen, ohne sich einer (...) begrifflichen Ordnung zu entziehen. Im Anschluss an Semler und Schleiermacher wird der Religionsbegriff zum Leitbegriff, da Religion als Lebensvorgang dem Reflexionsgeschehen Theologie vorausgeht und zur Grundanlage der menschlichen Natur gehört. Religiosität ist im subjektiven Geistesleben zu verorten, hat aber in der Beziehung des göttlichen auf den menschlichen Geist einen vorgängigen, externen Bezugspunkt. Die religionsphilosophische Verankerung der Theologie bekommt in der Exegese ihr markantes Profil durch die Verschränkung von historischer Einzelforschung und spekulativer Geschichtskonstruktion, womit eine Eigenständigkeit und Bezogenheit von historischer und systematischer Theologie gegeben ist. Craig Callender, Jonathan Cohen and Markus Schrenk have recently argued for an amended version of the best system account of laws – the better best system account (BBSA). This account of lawhood is supposed to account for laws in the special sciences, among other desiderata. Unlike David Lewis's original best system account of laws, the BBSA does not rely on a privileged class of natural predicates, in terms of which the best system is formulated. According to the BBSA, a (...) contingently true generalization is a law of a special science S iff the generalization is an axiom (or a theorem) of the best system relative to the set of predicates used by special science S. We argue that the BBSA is, at best, an incomplete theory of special science laws, as it does not account for typical features of special science laws, such as attached ceteris paribus conditions and the idealized character of law statements in these disciplines. The idea of levels of organization plays a central role in the philosophy of the life sciences. In this article, I first examine the explanatory goals that have motivated accounts of levels of organization. I then show that the most state-of-the-art and scientifically plausible account of levels of organization, the account of levels of mechanism proposed by Bechtel and Craver, is fundamentally problematic. Finally, I argue that the explanatory goals can be reached by adopting a deflationary approach, where levels of (...) organization give way to more well-defined and fundamental notions, such as scale and composition. Alfred Mele’s zygote argument is widely considered to be the strongest version of the manipulation argument against compatibilism (about free will and determinism). Opponents have focused largely on the first of its two premises and on the overall dialectic. My focus here will be on the underlying thought experiment—the Diana scenario—and on the second premise of the argument. I will argue that reflection on the Diana scenario shows that the second premise does not hold, and we will see that my (...) objection to the second premise helps to defend the claim that manipulation arguments face, in general, a dilemma. Recent years have seen an explosion of empirical data concerning arithmetical cognition. In this paper that data is taken to be philosophically important and an outline for an empirically feasible epistemological theory of arithmetic is presented. The epistemological theory is based on the empirically well-supported hypothesis that our arithmetical ability is built on a protoarithmetical ability to categorize observations in terms of quantities that we have already as infants and share with many nonhuman animals. It is argued here that arithmetical (...) knowledge developed in such a way cannot be totally conceptual in the sense relevant to the philosophy of arithmetic, but neither can arithmetic understood to be empirical. Rather, we need to develop a contextual a priori notion of arithmetical knowledge that preserves the special mathematical characteristics without ignoring the roots of arithmetical cognition. Such a contextual a priori theory is shown not to require any ontologically problematic assumptions, in addition to fitting well within a standard framework of general epistemology. (shrink)

Braddon-Mitchell in Noûs 35(2):260–277, 2001; Schrenk in The metaphysics of ceteris paribus laws. Ontos, Frankfurt, 2007). Here, we provide an ethical analysis of discrimination in private insurance to guide the application of non-discriminatory algorithms for risk prediction in the insurance context. This addresses the need for ethical guidance of data-science experts, business managers, and regulators, proposing a framework of moral reasoning behind the choice of fairness goals for prediction-based decisions in the insurance domain. The reference to private insurance as a business practice is essential in our approach, because the consequences of discrimination and predictive inaccuracy in (...) underwriting are different from those of using predictive algorithms in other sectors. Here we focus on the trade-off in the extent to which one can pursue indirect non-discrimination versus predictive accuracy. The moral assessment of this trade-off is related to the context of application—to the consequences of inaccurate risk predictions in the insurance domain. (shrink)

Robustness is often presented as a guideline for distinguishing the true or real from mere appearances or artifacts. Most of recent discussions of robustness have focused on the kind of derivational robustness analysis introduced by Levins, while the related but distinct idea of robustness as multiple accessibility, defended by Wimsatt, has received less attention. In this paper, I argue that the latter kind of robustness, when properly understood, can provide justification for ontological commitments. The idea is that we are justified (...) in believing that things studied by science are real insofar as we have robust evidence for them. I develop and analyze this idea in detail, and based on concrete examples show that it plays an important role in science. Finally, I demonstrate how robustness can be used to clarify the debate on scientific realism and to formulate new arguments. (shrink)

I argue for the possibility of a proprioceptive art in addition to, for example, visual or auditory arts, where aspects of some martial arts will serve as examples of that art form. My argument is inspired by a thought of Ted Shawn’s, one of the pioneers of American modern dance: "Dance is the only art wherein we ourselves are the stuff in which it is made.” In a first step, I point out that in some practices of martial arts (in (...) the paper I will introduce “hyongs” & “katas”), we are, too, the stuff these performances are made of. Second, I show that we, as martial arts practitioners, are not in the first place visual or auditorial observers (as common in painting or music or ballet) but introspective, proprioceptive perceivers of our bodies and their movements. (As a corollary we get that we are, in such a case, necessarily our exclusive audience.) In an third crucial step, I show that the martial arts practices referred to, hyongs & katas, and especially the proprioceptive aspects thereof, can indeed count as art. Thus, proprioceptive art is possible because some practices of some martial arts are actual existing examples of that art form. (shrink)

The relationship between psychological states and the brain remains an unresolved issue in philosophy of psychology. One appealing solution that has been influential both in science and in philosophy is Dennett’s concept of the intentional stance, according to which beliefs and desires are real and objective phenomena, but not necessarily states of the brain. A fundamental shortcoming of this approach is that it does not seem to leave any causal role for beliefs and desires in influencing behavior. In this paper, (...) I show that intentional states ascribed from the intentional stance should be seen as real causes, develop this to an independently plausible ontological position, and present a response to the latest interventionist causal exclusion worries. Although scientific realism is the default position in the life sciences, philosophical accounts of realism are geared towards physics and run into trouble when applied to fields such as biology or neuroscience. In this paper, I formulate a new robustness-based version of entity realism, and show that it provides a plausible account of realism for the life sciences that is also continuous with scientific practice. It is based on the idea that if there are several independent ways of measuring, detecting (...) or deriving something, then we are justified in believing that it is real. I also consider several possible objections to robustness-based entity realism, discuss its relationship to ontic structural realism, and show how it has the potential to provide a novel response to the pessimistic induction argument. We discuss the concept of women’s empowerment in FemTech, considering cultural and legal differences, ethical concerns, and legal consequences. We claim that it is crucial to prioritize privacy, a fundamental right, especially in the case of changes in laws related to women’s health, such as Roe v. Wade in the US.

Levels of organization are structures in nature, usually defined by part-whole relationships, with things at higher levels being composed of things at the next lower level. Typical levels of organization that one finds in the literature include the atomic, molecular, cellular, tissue, organ, organismal, group, population, community, ecosystem, landscape, and biosphere levels. References to levels of organization and related hierarchical depictions of nature are prominent in the life sciences and their philosophical study, and appear not only in introductory textbooks and (...) lectures, but also in cutting-edge research articles and reviews. In philosophy, perennial debates such as reduction, emergence, mechanistic explanation, interdisciplinary relations, natural selection, and many other topics, also rely substantially on the notion. -/- Yet, in spite of the ubiquity of the notion, levels of organization have received little explicit attention in biology or its philosophy. Usually they appear in the background as an implicit conceptual framework that is associated with vague intuitions. Attempts at providing general and broadly applicable definitions of levels of organization have not met wide acceptance. In recent years, several authors have put forward localized and minimalistic accounts of levels, and others have raised doubts about the usefulness of the notion as a whole. -/- There are many kinds of ‘levels’ that one may find in philosophy, science, and everyday life—the term is notoriously ambiguous. Besides levels of organization, there are levels of abstraction, realization, being, analysis, processing, theory, science, complexity, and many others. Many philosophers of science think that most laws of nature (even those of fundamental physics) are so called ceteris paribus laws, i.e. roughly speaking, laws with exceptions. Yet, the ceteris paribus clause of these laws is problematic. Amongst the more infamous difficulties is the danger that ‘For all x: Fx then Gx, ceteris paribus’ may state no more than a tautology: ‘For all x: Fx then Gx, unless not’. One of the major attempts to avoid this problem (and others concerning (...) ceteris paribus laws) is to claim that the subject matter of laws are ascriptions of dispositions, powers, capacities etc., and not the regular behaviour we find in nature. That we do not know whether the cetera are paria in a specific situation does not matter to the dispositionalist because the objects have the disposition regardless of the circumstances. The defence of the latter claim is that dispositions can be instantiated without being manifested. Hence, the laws that ascribe dispositions are strict and it looks as if they do not face the above mentioned problems of ceteris paribus laws. In this chapter I attempt to show that these assumptions are wrong. I hope to illustrate that not only does the ceteris paribus clause reoccur inside the dispositions, moreover, there are laws – laws about non-fundamental entities with instable dispositions – which bear a ceteris paribus clause that cannot be hidden in a disposition. J.L. Schellenberg’s Argument from Divine Hiddenness maintains that if a perfectly loving God exists, then there is no non-resistant non-belief. Given that such nonbelief exists, however, it follows that there is no perfectly loving God. To support the conditional claim, Schellenberg presents conceptual and analogical considerations, which we subject to critical scrutiny. We also evaluate Schellenberg’s claim that the belief that God exists is logically necessary for entering into a relationship with the Divine. Finally, we turn to possible variants of (...) Schellenberg’s case, and argue that the modifications necessary to accommodate our criticismas leave those variants with much less of a sting than originally suggested by his provocative formulation. Cognitive science began as a multidisciplinary endeavor to understand how the mind works. Since the beginning, cognitive scientists have been asking questions about the right methodologies and levels of explanation to pursue this goal, and make cognitive science a coherent science of the mind. Key questions include: Is there a privileged level of explanation in cognitive science? How do different levels of explanation fit together, or relate to one another? How should explanations at one level inform or constrain explanations at (...) some other level? Can the different approaches to the mind, brain, and culture be unified? The aim of this issue of topiCS is to provide a platform for discussing different answers to such questions and to facilitate a better understanding between the different strands of thinking about the right levels of explanation in cognitive science. Recently Kenneth Kendler and Peter Zachar have raised doubts about the correspondence theory of truth and scientific realism in psychopathology. They argue that coherentist or pragmatist approaches to truth are better suited for understanding the reality of psychiatric disorders. In this article, I show that rejecting realism based on the correspondence theory is deeply problematic: It makes psychopathology categorically different from other sciences, and results in an implausible view of scientific discovery and progress. As an alternative, I suggest a robustness-based (...) approach that can accommodate the significance of coherence and pragmatic factors without rejecting scientific realism and the correspondence theory of truth. According to what I call the reductive standard-causal theory of agency, the exercise of an agent's power to act can be reduced to the causal efficacy of agent-involving mental states and events. According to a non-reductive agent-causal theory, an agent's power to act is irreducible and primitive. Agent-causal theories have been dismissed on the ground that they presuppose a very contentious notion of causation, namely substance-causation. In this paper I will assume, with the proponents of the agent-causal approach, that substance-causation (...) is possible, as I will argue against that theory on the ground that it fails as a theory of agency. I will argue that the non-reductive agent-causal theory fails to account for agency, because it fails to account for agential control: it cannot explain why the stipulated irreducible relation between the agent and an action constitutes the agent's exercise of control over the action. This objection, I will argue, applies to the agent-causal theory in particular, and to the non-reductive approach in general. (shrink)

Libertarianism appears to be incoherent, because free will appears to be incompatible with indeterminism. In support of this claim, van Inwagen offered an argument that is now known as the “rollback argument”. In a recent reply, Lara Buchak has argued that the underlying thought experiment fails to support the first of two key premises. On her view, this points to an unexplored alternative in the free will debate, which she calls “chance-incompatibilism”. I will argue that the rollback thought experiment does (...) support the second key premise of the argument, and, more importantly, that libertarianism is committed to the first premise for independent reasons concerning the relationship between the normative and causal strength of the agent’s reasons. The upshot will be that chance-incompatibilism is not a promising new alternative in the free will debate, and we will see that the debate around those issues can benefit from more attention to the role of the agent’s reasons for action. The levels of selection debate is generally taken to be a debate about how natural selection can occur at the various levels of biological organization. In this paper, we argue that questions about levels of selection should be analyzed separately from questions about levels of organization. In the deflationary proposal we defend, all that is necessary for multilevel selection is that there are cases in which particles are nested in collectives, and that both the collectives and the particles that compose (...) them each separately undergo natural selection. We argue that adopting this deflationary account helps to disentangle the levels of selection and the levels of organization, and thereby contributes to advancing the levels of selection debate. Humans face many game problems that are too large for the whole game tree to be used in their deliberations about action, and very little is understood about how they cope in such scenarios. However, when a human player’s chosen strategy is conditioned on her limited perspective of how the game might progress, then it should be possible to manipulate her into changing her planned move by mentioning a possible outcome of an alternative move. This paper demonstrates that human players (...) can be manipulated this way: in the game The Settlers of Catan, where negotiation is only a small part of what one must do to win the game thereby generating uncertainty about which outcomes to the negotiation are good and which are bad, the likelihood that a player accepts a trade offer that deviates from their declared preferred strategy is higher if it is accompanied by a description of what that trade offer can lead to. It is the nature of powerful ideas that they can summarize a ground-breaking concept in a plain and simple message. In this sense, the concept of sustainability is a very powerful idea. However, although the sustainability debate has already brought about considerable conceptual progress, a pivotal dimension to sustainable development has so far been widely neglected. This article argues that in addition to the ecological, economic, and social dimension, sustainability critically depends on the moral dimension of institutional legitimacy. Against the (...) backdrop of globalization, conventional models of creating and legitimizing institutions are increasingly challenged. Therefore, it is also business that is to play an ever more important role in contributing to fair and functioning institutions. The article discusses “corporate citizenship” as an economic concept as a useful starting point for this new understanding of the business of business. In effect, the underlying objective of this paper is to present a theoretical link between the concepts of sustainability and corporate citizenship. The central thesis is that private enterprises who cooperatively take responsibility for their institutional environment strengthen the moral dimension of institutional legitimacy: They actively contribute to empowering sustainability by corporate citizenship. Interpreters of Machiavelli easily agree that his political writings have profoundly influenced our fundamental ideas of state and society, yet these interpreters rarely agree on what Machiavelli really thought. Did Machiavelli seek to recover classical republicanism in the Aristotelian tradition, or did he aspire to usher in modernity? Was he a cynic who assumed human beings to be inescapably wicked and offered technical advice to tyrants, or did he aim at some version of "the good life"? The conditional analysis of dispositions is widely rejected, mainly due to counterexamples in which dispositions are either “finkish” or “masked.” David Lewis proposed a reformed conditional analysis. This view avoids the problem of finkish dispositions, but it fails to solve the problem of masking. I will propose a reformulation of Lewis’ analysis, and I will argue that this reformulation can easily be modified so that it avoids the problem of masking. In the final section, I will address the challenge that (...) some dispositions appear to lack any stimulus condition, and I will briefly turn to the issue of reductionism. (shrink)

Many consider the nature of human consciousness to be one of the last great unsolved mysteries. Why should the light turn on, so to speak, in human beings at all? And how is the electrical storm of neurons under our skull connected with our consciousness? Is the self only our brain's user interface, a kind of stage on which a show is performed that we cannot freely direct? In this book, philosopher Markus Gabriel challenges an increasing trend in the (...) sciences towards neurocentrism, a notion which rests on the assumption that the self is identical to the brain. Gabriel raises serious doubts as to whether we can know ourselves in this way. Diese Einleitung skizziert neben einigen begrifflichen Vorbemerkungen zwei Themenfelder, nämlich den Müll und eine Gruppe von Menschen, die in der Soziologie „die Überflüssigen“ genannt werden. Einerseits wird deutlich, dass der Müll die Rückseite der materiellen Kultur in ihrer Vielfältigkeit darstellt und dass die Geschichte der materiellen Kultur immer auch eine Geschichte dessen ist, was Menschen hinter sich lassen, wessen sie sich entledigen und was sie entsorgen. Andererseits macht die soziologische Ungleichheitsforschung deutlich, dass die „Überflüssigkeit“ von Menschen in einen Zusammenhang mit (...) dem Problem der sozialen Exklusion und damit mit gezielter Ausgrenzung und funktionaler Ausschließung gebracht werden kann. In this paper, we will discuss Peter van Inwagen’s contribution to the epistemological debate about revealed peer disagreement. Roughly, this debate focuses on situations in which at least two participants disagree on a certain proposition based on the same evidence. This leads to the problem of how one should react rationally when peer disagreement is revealed. Van Inwagen, as we will show, discusses four possible reactions, all of which he rejects as unsatisfying. Our proposal will be to point to hidden (...) assumptions in van Inwagen’s reasoning and ask whether he is willing to reject at least one of these to get rid of the problem. In short, our thesis amounts to the following: Of the two epistemological claims, which we call “Weak” and “Full-blown Fallibilism”, van Inwagen cannot simultaneously accept the first and reject the latter, while this is what he seems to suggest. Revealing this potential dilemma for van Inwagen’s position will lead to a more detailed discussion of how “rationality”, “truth”, “evidence” and “justification” interrelate and how a closer look at their relation might help solving the puzzle of revealed peer disagreement. Der Aufsatz beschäftigt sich am Beispiel des deutschen "Kopftuchstreits" mit der rechtlich-politischen Auseinandersetzung um subjektive Rechte innerhalb des liberalen Rechtsstaats. Wie Christoph Menke in seiner Deutung der für den politischen Liberalismus wesentlichen politischen Konflikte gezeigt hat, bezieht sich diese Auseinandersetzung vorrangig auf zwei Fragen: Wer sollte Anspruch darauf genießen, ein politisches Subjekt zu sein, das heißt, als Gleiche oder Gleicher berücksichtigt zu werden? Welche Ansprüche politischer Subjekte könneen als schützenswerte Verwirklichung subjektiver Rechte gelten? Der vorliegende Beitrag beschäftigt sich vorwiegend mit (...) der Frage, wie die politischen Konflikte des letztgenannten Typs auf die rechtliche Auseinandersetzung um Grundrechte abfärben. Damit wende ich mich gegen ein Verständnis der Grundrechte, das diese als Garant der ethischen Neutralität eines liberalen Gemeinwesens ansieht. Ich möchte zeigen, dass der Sinn subjektiver Rechte in der liberalen Demokratie zwar unter anderem genau darin besteht, dass sie partikulare ethische Wertvorstellungen neutralisieren und die Bürgerinnen und Bürger innerhalb eines vernünftigen Rahmens vor Unterdrückung schützen. Wie eine Analyse der Entscheidungen des Bundesverfassungsgerichts (BVerfG) zum "Kopftuchstreit" zeigt, wird diese Funktion aber stets zugleich durch die partikulare Interpretation gleicher Rechte unterminiert. Dies bezeichne ich als die Dekonstruktion der Neutralität, die sich im Recht vollzieht. (shrink)

Sind die Menschenrechte primär Ausdruck einer politischen Praxis und die Idee der Menschenrechte eine Art „Überbau“, den die Praxis epiphänomenal hervorbringt? Oder ist die Praxis der Menschenrechte das Ergebnis der Verwirklichung einer normativen Idee, die unabhängig von ihr existiert? Ist die Idee der Menschenrechte die Bedingung dafür, dass es die Praxis der Menschenrechte geben kann? Oder gibt es einen Vorrang der Praxis vor der Idee? In meinem Aufsatz argumentiere ich für zwei These: 1. These: Menschenrechte sind prinzipiell unabhängig von jeder (...) bestehenden rechtlichpolitischen Praxis und sind zugleich untrennbar an bestimmte rechtlich-politische Praktiken geknüpft. Darin besteht der konstitutive Widerspruch der Menschenrechte. 2. These: Aus diesem Widerspruch folgt nicht, dass wir aufhören sollten über Menschenrechte nachzudenken und eine Politik der Menschenrechte anzustreben. Der Widerspruch hat keine lähmende Wirkung, sondern ist theoretisch und praktisch produktiv. Um diese Thesen zu plausiblisieren, werde ich zunächst einige Grundzüge von Arendts Diskussion der Menschenrechte rekapitulieren (Abschnitt 2) und ihr Postulat eines den Menschenrechten vorgelagerten „Rechts, Rechte zu haben“ diskutieren (Abschnitt 3). Ausgehend von einer kritischen Diskussion der diskurstheoretischen Weiterentwicklung von Arendts These zu einem „Recht auf Rechtfertigung“ im diskurstheoretischen Konstruktivismus von Seyla Benhabib und Rainer Forst (Abschnitt 4) werde ich einen rechtfertigungstheoretischen Dekonstruktivismus vorstellen, der das Verhältnis von Praxis und Idee der Menschenrechte als produktiven Widerspruch fasst (Abschnitt 5). This interview deals with the major themes in the work of Ruth Millikan. Her most fundamental idea is that the intentionality of inner and outer representations can be understood in analogy to biological functions. Another innovative feature is the view that thought and language stand parallel to each other. Thirdly, the basic ideas concerning the ontology and the epistemology of concepts are explained. Millikan aims at clarifying her position by contrasting it with Dretske, Fodor, Sellars, and Brandom. Advanced old age has been characterized as a biologically highly vulnerable life phase. Biological, morbidity-, and cognitive impairment-related factors play an important role as mortality predictors among very old adults. However, it is largely unknown whether previous findings confirming the role of different wellbeing domains for mortality translate to survival among the oldest-old individuals. Moreover, the distinction established in the wellbeing literature between hedonic and eudaimonic wellbeing as well as the consideration of within-person variability of potentially relevant mortality predictors has (...) not sufficiently been addressed in prior mortality research. In this study, we examined a broad set of hedonic and eudaimonic wellbeing indicators, including their levels, their changes, as well as their within-person variability, as predictors of all-cause mortality in a sample of very old individuals. We used data from the LateLine study, a 7-year longitudinal study based on a sample of n = 124 individuals who were living alone and who were aged 87–97 years at baseline. Study participants provided up to 16 measurement occasions between 2009 and 2016. Dates of death were available for 118 individuals who had deceased between 2009 and 2021. We ran longitudinal multilevel structural equation models and specified between-person level differences, within-person long-term linear change trends, as well as the “detrended” within-person variability in three indicators of hedonic and four indicators of eudaimonic wellbeing as all-cause mortality predictors. Controlling for age, gender, education, and physical condition and testing our sets of hedonic and eudaimonic indictors separately in terms of their mortality impact, solely one eudaimonic wellbeing indicator, namely, autonomy, showed significant effects on survival. Surprisingly, autonomy appeared “paradoxically” related with mortality, with high individual levels and intraindividual highly stable perceptions of autonomy being associated with a shorter residual lifetime. Thus, it seems plausible that accepting dependency and changing perceptions of autonomy over time in accordance with objectively remaining capabilities might become adaptive for survival in very old age.
