The central idea developed by the contributions to this book is that the split between analytic philosophy and phenomenology - perhaps the most impor tant schism in twentieth-century philosophy - resulted from a radicalization of reciprocal partialities. Both schools of thought share, in fact, the same cultural background and their same initial stimulus in the thought of Franz Brentano. And one outcome of the subsequent rift between them was the oblivion into which the figure and thought of Brentano have fallen. (...) The first step to take in remedying this split is to return to Brentano and to reconstruct the 'map' of Brent ani sm. The second task (which has been addressed by this book) is to revive inter est in the theoretical complexity of Brentano' s thought and of his pupils and to revitalize those aspects that have been neglected by subsequent debate within the various movements of Brentanian inspiration. We have accordingly decided to organize the book into two introductory es says followed by two sections (Parts 1 and 2) which systematically examine Brentano's thought and that of his followers. The two introductory essays re construct the reasons for the 'invisibility', so to speak, of Brentano and set out of his philosophical doctrine. Part 1 of the book then ex the essential features amines six of Brentano's most outstanding pupils (Marty, Stumpf, Meinong, Ehrenfels, Husserl and Twardowski). Purpose This paper aims to explore the ethical and social impact of augmented visual field devices, identifying issues that AVFDs share with existing devices and suggesting new ethical and social issues that arise with the adoption of AVFDs. Design/methodology/approach This essay incorporates both a philosophical and an ethical analysis approach. It is based on Plato’s Allegory of the Cave, philosophical notions of transparency and presence and human values including psychological well-being, physical well-being, privacy, deception, informed consent, ownership and property and (...) trust. Findings The paper concludes that the interactions among developers, users and non-users via AVFDs have implications for autonomy. It also identifies issues of ownership that arise because of the blending of physical and virtual space and important ways that these devices impact, identity and trust. Practical implications Developers ought to take time to design and implement an easy-to-use informed consent system with these devices. There is a strong need for consent protocols among developers, users and non-users of AVFDs. Social implications There is a social benefit to users sharing what is visible on their devices with those who are in close physical proximity, but this introduces tension between notions of personal privacy and the establishment and maintenance of social norms. Originality/value There is new analysis of how AVFDs impact individual identity and the attendant ties to notions of ownership of the space between an object and someone’s eyes and control over perception. As we move towards a more global legal community, often with accompanying injustice and violence, Mireille Delmas-Marty demonstrates an urgent need to reconstruct the national and international legal landscapes. She argues that legal reasoning can be applied to concepts such as human rights for European citizens in the new world order. The book will be of interest to all comparative European lawyers, and to social scientists and legal theorists grappling with contemporary issues in legal pluralism and globalization.

Assumed benefits from improved reputation are often used as motives to drive corporate social responsibility (CSR) initiatives. Are improved cost efficiencies among these reputation benefits? Cost efficiencies and cost management have become more relevant as revenue streams dry up in these tough economic times. Can a good reputation aid these efforts to develop cost efficiencies specifically when managing labor costs? Prior research hypothesizes that good reputation can create labor productivity and efficiency benefits. The purpose of this study is to empirically (...) investigate reputation's relationship with labor efficiency, labor productivity, and labor cost. Using a sample of highly reputable firms from Fortune's America's Most Admired Companies list and a corresponding matched sample of firms, we find that reputation is associated with improved labor efficiency and labor productivity. However, we do not find a significant association between reputation and reduced labor costs. Our study contributes to current research hypothesizing and finding efficiency benefits associated with good reputation. Documenting these potential reputation benefits has important implications for CSR activities and initiatives. It supports recent work that incorporates reputation into a more developed model of the relationship between CSR and performance (Vilanova et al.: 2009, Journal of Business Ethics 87, 57-69). This work is useful to businesses and supports strategies focused on "doing well by doing good" and maintaining healthy reputations. (shrink)

From the viewpoint of the constitutional crisis in Europe, slow UN reforms, difficulties implementing the Kyoto Protocol and the International Criminal Court, and tensions between human rights and trade, Mireille Delmas-Marty's 'journey through the legal landscape' of the early years of the 21st century shows it to be dominated by imprecision, uncertainty and instability. The early 21st century appears to be the era of great disorder: in the silence of the market and the fracas of arms, a world overly (...) fragmented by anarchical globalisation is being unified too quickly through hegemonic integration. How, she asks, can we move beyond the relative and the universal to build order without imposing it, to accept pluralism without giving up on a common law? Neither utopian fusion nor illusory autonomy, Ordering Pluralism is her answer: both an epistemological revolution and an art, it means creating a common legal area by progressive adjustments that preserve diversity. Since an immutable world order is impossible, the imaginative forces of law must be called upon to invent a flexible process of harmonisation that leaves room for believing we can agree on - and protect - common values. 'The book is timely and relevant to the practical concerns of those who work with, and within, the legal system. We must thank Professor Delmas-Marty for her fine work.' In this article I study the genesis of metaphors from an evolutionary perspective. Analyzing 414 cartoons published after the death of the cartoonists of the French satirical magazine Charlie Hebdo, I propose a metaphoric founder effect with the metaphors “PENCIL IS A WEAPON,” “PENCIL IS A CARTOONIST,” and “PENCIL IS FREEDOM,” and a subsequent metaphor drift that creates many related metaphors. Additionally, the success of these metaphors turns the pencil meme into a very efficient and fast-spreading item representing not only (...) the work of cartoonists, but also the fundamental values of Western culture, such as freedom of expression. Studying cartoons about the economic crisis and focusing on a pair of scissors as a symbol, I prove how they first turn into unambiguous metaphor for the economic crisis and then experience an evolution in order to adapt to new communication contexts. Along these processes, they undergo more complex changes such as coadaptation and speciation. This has allowed for the scissors meme as a symbol of economic cutbacks to permeate society, and for its metaphorical use to occupy many disparate communication (...) scenarios, unlike other symbolic elements that were also used, but turned out to be less cognitively efficient and therefore offered fewer evolutionary possibilities. In Building Cultures of Trust Martin Marty proposes ways to improve the conditions for trust at what might be called the "grassroots" level. He suggests that it makes a difference if citizens put energy into inventing, developing, and encouraging "cultures of trust" in all areas of life--families, schools, neighborhoods, workplaces, and churches. Because it is provocative and is based on the denigration of absent third parties, shock jock discourse stimulates reactions that go well beyond the initial circle of listeners. Trash radio supporters and detractors alike take up the hosts’ deprecating remarks, reinterpret them and put them back into circulation. As the repetitions multiply, interweaving private speech and public speech, a complex web of circulation forms, attesting to the contagiousness of the discourse and the influence of the radio hosts. In order to (...) capture and explain this mechanism of propagation, we propose a model of analysis that combines elements of linguistic, discursive and pragmatic description. The model is illustrated by a case study. We are led to observe that the extent and rate of propagation of deprecating remarks inevitably affect the image of the person targeted and, more fundamentally, tend to make an aggressive mode of expression part of the natural speechscape. We argue that many evolved biases produced through selective forces described by error management theory are likely to entail misbeliefs. We illustrate our argument with the male sexual overperception bias. A misbelief could create motivational impetus for courtship, overcome the inhibiting effects of anxiety about rejection, and in some cases transform an initially sexually uninterested woman into an interested one.

E. Machery, R. Mallon, S. Nichols and S. Stich, have argued that there is empirical evidence against Kripke’s claim that names are not descriptive. Their argument is based on an experiment that compares the intuitions about proper name use of a group of English speakers in Hong Kong with those of a group of non-Chinese American students. The results of the experiment suggest that in some cultures speakers use names descriptively. I argue that such a conclusion is incorrect, for the (...) experiment does not prove what it is purported to prove. (shrink)

This article surveys the discursive turns of a conventional historical trope: the change in the valence of alcohol (and drugs) from happy to miserable. This change is commonly told as the story of a golden age of drinking and a fall into addiction (although there is a confused relationship in many of the stories between a condition called medical alcoholism and the social behavior of drunkenness). This fall is variously dated from the fifteenth to the late nineteenth centuries (both the (...) conceptualization and the fact of alcoholism). Is this real historical change or only nominal change? Was alcoholism unknown in previous ages or has it always been around? Certain material factors (supply, absence of alternative drinks) may have impeded the visibility of alcoholism. The theory of nominal change is involved with factors like conspiratorial behavior, the conditions of scientific knowledge (i.e., the structure of investigation itself ), the baffles of categorization (heavy drinking was hidden within gluttony for most of history). Real change involves various facets of modernity and industrial capitalism: individualism and privacy, temperance, respectability, and rigid class formation, etcetera. But this shift is also a movement across class lines, from middle to lower-class drinkers. (shrink)

A variety of leech homeobox genes have been identified by homology with genes that are known to bring about the regionalization and segmentation of the anteroposterior body axis in other organisms. Embryonic expression patterns suggest a number of interphyletic similarities in the way that these genes are utilized. However, several interesting differences have also been observed. In particular, transplantation experiments in the leech embryo have shown that axially aligned patterns of homeobox gene expression are not specified by a global pattern (...) of positional cues. Rather, the leech independently establishes anteroposterior patterns of gene expression in each of five discrete stem cell lineages, and these patterns are brought into their final alignment through a process of morphogenetic assembly. According to Donnellan the characteristic mark of a referential use of a definite description is the fact that it can be used to pick out an individual that does not satisfy the attributes in the description. Friends and foes of the referential/attributive distinction have equally dismissed that point as obviously wrong or as a sign that Donnellan's distinction lacks semantic import. I will argue that, on a strict semantic conception of what it is for an expression to be a genuine (...) referential device, Donnellan is right: if a use of a definite description is referential, it must be possible for it to refer to an object independently of any attributes associated with the description, including those that constitute its conventional meaning. Some of the fundamental lessons of the so-called revolution against descriptivism that occurred in the 70s are negative and it is not immediately apparent what kind of semantic theory should emerge as regards proper names, the alleged paradigms of genuinely referential terms. Some of the claims about names, most notably Ruth Barcan Marcus’ characterization of names as tags, appear to be too picturesque to provide the basis for a positive theory and, without a theory, it would seem that the referential (...) link between name and bearer is established by pure magic. Some authors have appealed to the causal-historical picture to construct a positive theory, and have endorsed causal descriptivism, a variety of descriptivism that incorporates causal factors. I argue against causal descriptivism and I assess the demand for a positive semantic theory of names. (shrink)

This paper examines and discusses an argument for the collapse of modal distincions offered by Quine in "Reference and Modality" and in Word and Object that relies exclusively on a version of the Principle of Substitution. It is argued that the argument does not affect its historical targets: Carnap's treatment of modality, presented in Meaning and Necessity, and Church's Logic of Sense and Denotation, developed by Kaplan; nor does it affect a treatment of modality inspired in Frege's treatment of oblique (...) contexts. It is argued, nevertheless, that the immunity of those systems to Quine's argument depends on the success of their rejection of the Principle of Substitution presupposed by Quine. (shrink)

Male provisioning ability may have evolved as a “good dad” indicator through sexual selection, whereas male creativity may have evolved partly as a “good genes” indicator. If so, women near peak fertility (midcycle) should prefer creativity over wealth, especially in short-term mating. Forty-one normally cycling women read vignettes describing creative but poor men vs. uncreative but rich men. Women’s estimated fertility predicted their short-term (but not long-term) preference for creativity over wealth, in both their desirability ratings of individual men (r=.40, (...) p<.01) and their forced-choice decisions between men (r=.46, p<.01). These preliminary results are consistent with the view that creativity evolved at least partly as a good genes indicator through mate choice. (shrink)
