Poetisierende Musikbeschreibungen werden von der Wissenschaft, von Musikern und Konzertbesuchern heute mehr belächelt als ernst genommen. Durch das Ansprechen von Einbildungskraft und Gefühl haben sie aber eine Unmittelbarkeit, die der kompositionstechnischen Analyse in der Regel fehlt. Die Wurzeln einer metaphorischen Musikbeschreibung um die Wende zum 19. Jahrhundert sind dabei gleichermaßen historisch wie systematisch zu fassen. Zahlreiche Zitate aus den Fachzeitschriften bis zur Jahrhundertmitte dokumentieren die Herausbildung eines festumrissenen Bildervorrats, um musikalische Eindrücke zur Sprache zu bringen. Der kreative Umgang mit Beschreibungskonventionen (...) ist für die Musikkritiken von E.T.A. Hoffmann, Adolf Bernhard Marx, Ludwig Rellstab und vor allem Robert Schumann kennzeichnend. (shrink)

The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. "Bernard Groethuysen (1880-1946), philosophe d'origine allemande, partage, dès 1904, sa vie entre Berlin et Paris où il étudie la Révolution française et rencontre, grâce à Bergson, Alix Guillain (1876-1951), traductrice et journaliste à L'Humanité. Vivant avec leurs compagnes dans le phalanstère de la rue Campagne-Première, Groethuysen et Paulhan, devenus amis, oeuvrent à partir de 1920 à La Nouvelle Revue francaise, dont ce dernier prend la direction cinq ans plus tard : ils font découvrir Hôlderlin, Kassner, Kafka, Büchner, Musil... En 1927, (...) ils inaugurent leur collection "Bibliothèque des Idées" par l'essai majeur de Groethuysen, Origines de l'esprit bourgeois en France, "notre premier enfant", écrit-il à Paulhan. Dans son ultime lettre d'Allemagne, de 1931, il s'inquiète : "L'Histoire devrait nous donner des vacances. On en profiterait pour reprendre la vie." En août 1932, devant l'essor du nazisme, Groethuysen s'exile en France. Quant à Paulhan, le Front populaire le voit s'engager aux côtés de Jean Longuet, maire socialiste de Châtenay-Malabry. Arrive la guerre : Germaine et Jean Paulhan quittent leur maison, leur jardin, leurs animaux, dont Alix Guillain et Groethuysen, naturalisé en 1938, prennent soin. Après la défaite de l'Allemagne, le philosophe rêve encore d'utopie, mais il meurt le 17 septembre 1946. Les travaux de Groethuysen m'intéressaient, il s'intéressait aux miens", confiera Paulhan à Ponge. Ce volume prouve leur affectueuse amitié, fondée sur le travail en commun pour la NRF. Mais c'est également un document sur les réseaux intellectuels et politiques de l'entre-deux-guerres: Maria Van Rysselberghe et les amis de Gide, la princesse de Bassiano et la revue Commerce, Paul Desjardins et les Décades de Pontigny, Henry Church et la revue Mesures, Alix Guillain et le Parti communiste, Aline Mayrisch et le groupe de Colpach... Any ethics directed to future demands is confronted with two main problems. Firstly, how can we conceive a kind of future which does not only hold the past and prolong the present, but remains open for something coming in an unexpected way. Secondly, how does it happen that demands of not yet existing people really concern us? This paper tries to answer to these questions from the perspective of a responsive phenomenology based on our responding to the Other’s demands which (...) precede and exceed our own initiative. This intimates a sort of anterior future according to which we are permanently what we have to be. Leading concepts, supported by authors like Husserl, Schutz, Merleau-Ponty, Levinas, Marx and Nietzsche, are the following: generativity of life crossing the thresholds between different generations; procreation which allows for surviving in the children; projects of responsive politics and economics which take care to keep the world habitable; finally, a sort of tele-moral stimulated by Fernstenliebe which discovers traces of a future humanity in the face of the Other. This is an English translation of Waldenfels' German essay: Equality and inequality are basic elements of law, justice and politics. Equality integrates each of us into a common sphere by distributing rights, duties and chances among us. Equality turns into mere indifference as far as we get overintegrated into social orders. When differences are fading away experience loses its relief and individuals lose their face. Our critical reflections start from the inevitable paradox of making equal what is not equal. In (...) various ways they refer to Nietzsche’s concept of order, to Marx’s analysis of money, to Lévinas’s ethics of the Other, and to novelists like Dostoevsky and Musil. Our critique turns against two extremes, on the one hand against any sort of normalism fixed on functioning orders, on the other hand against any sort of anomalism dreaming of mere events and permanent ruptures. Responsive phenomenology shows how we are confronted with extraordinary events. Those deviate from the ordinary and transgress its borders, without leaving the normality of our everyday world behind. The process of equalizing moves between the ordinary and the extraordinary. What makes the difference and resists mere indifference are creative responses which are to be invented again and again. This paper provides a reconstruction and analysis of Marx’s early engagements with logic, and especially his studies of Hegel’s logic, on the one hand, and Hegel’s great if often overlooked critic Adolf Trendelenburg, on the other. It itemises the archival evidence that Marx read and planned to compose a Hegelian response to Trendelenburg’s devastating attack on dialectics in his 1840 Logische Untersuchungen – the work that arguably did more than any other single text to destroy the influence of Hegelianism (...) among German intellectuals at the time. It argues that the young Marx was a more sophisticated reader of Hegel and of philosophy in general than is typically acknowledged. Against the backdrop of these claims, it then proposes a new reading of Marx’s work from 1839 to 1842 – one that takes the emphasis off the familiar distinction between materialism and idealism, which was as much an invention of Engels’s later interpretations of the early Marx as it was an invention of Marx himself, and places it instead on what early nineteenth-century thinkers would have understood to be the more comprehensive question of logic. Epistemologists have recently noted a tension between (i) denying access internalism, and (ii) maintaining that rational agents cannot be epistemically akratic, believing claims akin to ‘p, but I shouldn’t believe p’. I bring out the tension, and develop a new way to resolve it. The basic strategy is to say that access internalism is false, but that counterexamples to it are ‘elusive’ in a way that prevents rational agents from suspecting that they themselves are counterexamples to the internalist principles. I (...) argue that this allows us to do justice to the motivations behind both (i) and (ii). And I explain in some detail what a view of evidence that implements this strategy, and makes it independently plausible, might look like. (shrink)

For decades there has been a controversial debate over how far religious faith communities are specifically engaged in ecological practices (EP). Therefore we studied four Austrian and two German Benedictine monasteries religious ethics and spirituality as a means of a driving force for initiating EP. We draw upon theories of organizational learning processes and capacity-building of sustainability to interpret our empirical findings. The majority of monasteries are highly engaged in EP, initiated either as an outcome of individual activities or through (...) a specific mostly informally acting group, but rarely an organizationally or systematically integrated goal of the monasteries, or a focus of capacity building. Monasteries follow a technical and economic decision-making process in implementing EP. Spirituality plays a limited role in the initiation of EP. The environment of monasteries–acceptance or critique against ecological practices–influences the monasteries decisions. Institutionalization of ecological practices into the monasteries organizational structure is rare. (shrink)

This paper describes the automated classification of legal norms in German statutes with regard to their semantic type. We propose a semantic type taxonomy for norms in the German civil law domain consisting of nine different types focusing on functional aspects, such as Duties, Prohibitions, Permissions, etc. We performed four iterations in classifying legal norms with a rule-based approach using a manually labeled dataset, i.e., tenancy law, of the German Civil Code ). During this experiment the \ score continuously improved (...) from 0.52 to 0.78. In contrast, a machine learning based approach for the classification was implemented. A performance of \ was reached. Traditionally, machine learning classifiers lack of transparency with regard to their decisions. We extended our approach using so-called local linear approximations, which is a novel technique to analyze and inspect a trained classifier’s behavior. We can show that there are significant similarities of manually crafted knowledge, i.e., rules and pattern definitions, and the trained decision structures of machine learning approaches. (shrink)

Phenomenologists were concerned with showing that essential structures of being, knowable by rational insight, are found more abundantly than commonly thought. Reinach shows that in the civil law there are essential structures, such as the structure of promising or of owning. These pre-positive structures provide the civil law with a foundation that can be known by philosophical insight. Though the enactments of the civil law are changeable, essential foundations are not. Of particular significance is Reinach's concept of a social act, (...) that is, of an act that addresses another and has to be heard by the other in order to be complete. Reinach shows that the essence of legally relevant acts, such as promising, comes to evidence when they are understood as social acts. (shrink)

If sociology is about society must it not also be about morality? In the nineteenth and early twentieth centuries, the identification between sociology and morality was clear cut; Marx, Durkheim, Weber, Spencer, and Veblen all dealt with moral issues and one might argue that they saw themselves as engaged in a moral vocation. Now, one might argue that the connections between sociology and moral currents have become more tenuous. Moral Culture examines what it means to be moral in contemporary social (...) and cultural life. Author Keith Tester takes the highly original and revealing step of exploring how violence today, and throughout history, affects the relatively safe and secure people who live in the west and who tend to know horror only through television and cinema screens. The book raises questions about the meaning and significance of massacres in the Balkans, Rwanda and, rather more historically, the Holocaust, and the slaughter of Vietnamese peasants by American soldiers in My Lai. It also discusses how Adolf Eichmann and the men of Charlie Company might be different from or similar to us. It answers questions about whether this is a time of moral decay or more seriously, the collapse of moral Civilization. Sociologists often claim that they make a virtue of being relevant and objective, but few have attacked these issues with the urgency and originality that Keith Tester displays in this work. Each chapter provides a historically aware account of a moral problem making it especially relevant reading for students of cultural studies, sociology, political science, and moral philosophy. In this article I shall largely make use of terms like “responding,” “responsive,” and “responsivity.” These terms are not part of traditional philosophy. They became indispensable for my own thinking when I tried to develop a theory of radical Fremdheit, of alienness or otherness. Hence I came to a sort of responsive phenomenology that does not replace current variants of phenomenology, but sets a new tone. This is what I try to show in my article. I shall proceed in four (...) steps. In the first step, dealing with the formation of the theory, I try to show how our experience of radical otherness leads to the key concept of responsivity. In the second step, I shall describe the main features of responsivity and its pathological deviations. In the third step, this perspective will be expanded by referring to co-affection and co-responsivity as elements of proto-sociality. The fourth and last step will offer a practical outlook, raising the question to what extent responsivity can be organised and institutionalised. (shrink)

Based on the argument that violence has a parasitic quality rather than an essence of its own, this article seeks to bring to light the conversion processes through which violence crystallises out of, as well as into, various phenomena. Violence is first examined in terms of the relation between perpetrator and victim with, however, an emphasis on the fact that violence cannot be reduced to the intention or the act of the perpetrator. On the contrary, violence is shown to have (...) the character of pathos and to open up a dimension of which the act itself is only a part. Further, the author argues that in being directed towards the other, violence harbours a performative contradiction: by turning the addressee into a thing to be destroyed, the addressing act cancels itself. The paper also sets out to identify the breeding grounds of violence, which, due to its capacity for conversion, can be detected in various phenomena that are not necessarily linked to violence. This means that violence can resort to various mechanisms and can emerge in multiple fields of activity: in bureaucracy, economics, medicine, politics, war, and most importantly, in everyday life, hidden under inconspicuous but sometimes pervasive forms. Finally, the metamorphoses of violence are shown to ultimately rest on the temporal character of violence, which implies that violence has a time of preparation and an aftermath. (shrink)

This book presents the views of the founders of constructivism and modern systems theory, who are still providing stimulating cues for international scientific debate. The conversations turn on the results of brain research, the breaks through of cybernetics, the linguistic determination of thought, and the intrinsic connection between epistemology and ethical practice.

The article is dedicated to the application questions of a case study method known as casuistry. In its long tradition, it focuses on an influential variant of the early modern period and reconstructs its functionality. In the course of reading recent receptions, it is noted that some studies speak of a “casuistic revival” in moral case deliberation in health care. As a result of this revival, casuistry has been modified in such a way that it guides case discussions in practice (...) with the help of a tripartite methodology. However, as it turns out, casuistry, a case comparison method of ethical judgement based on reasoning logic, is less suitable for moral case deliberations in direct patient care. This stems from the fact that casuistry is a detailed procedure of ethical learning beneficial to institutionalized ethics committees or similar forms of ethics consultation in health care. (shrink)

The Europe of many voices is founded on a balance between me and us. Even if persons, regions and countries communicate with their own voices, each voice is imbued with its inner and outer alienness, which can be represented but not replaced by others. There is no single European language, there is a variety of European languages. Interregional, international and intercultural experiences are characterized by the interweaving of one’s own and the foreign. We can be more or less close to (...) one another. Humanity can be understood only as an open horizon. Europe is not a stop on the path to a worldwide state, but a specific answer to global challenges. When the struggle for economic and military survival prevails, alienness turns into enmity. And the enemy is voiceless, just like the Barbarians. (shrink)

Acknowledging sensuous worlds, which bestow sensual qualities on life-world, we are facing the age-old problem of how to think the intra- and intermodal unity of the senses and how to explain the corresponding phenomenon of synaesthesia. In tackling this problem, we will first pay our attention to the rhythmical quality of the senses. It is situated on the very threshold of the formation of the senses. The question about the natural or artificial nature of sensory rhythms begs a further question (...) whether, at any given moment, the senses can be perfectly coherent and in tune with what affects them. Is it not true that any eurhythmics is even at its best supposed to account for the Other disturbing the rhythm by stepping out of the line? (shrink)
