Spice is also peppered throughout the Old Testament.2 The Song of Solomon recites: “Thy plants are an orchard of pomegranates, with pleasant fruits; camphire, with spikearion 28.1 spring/summer 2020 2 a vexed pharmacopeia nard and saffron; calamus and cinnamon, with all trees of frankincense; myrrh and aloes, with all the chief spices.”3 Every one of these fruits, plants and spices remained popular in the West throughout antiquity, into the Middle Ages, and beyond. As early as 3000 bc, trade routes had connected the Mediterranean to the near east. Courtesy of this “Spice Road,” ancient Mediterranean civilizations had access to a wide range of horseradishes, mustards, peppers, gingers and other spices. The Greeks and Romans had a special relationship with black pepper—so much so that four out of five recipes in Apicius’s famous 1st century cookbook4 called for a sprinkling of this sometimes-costly commodity. It is perhaps not coincidental that black pepper contains heat-producing alkaloids very similar to those found in New World chili peppers. Much has been written about the important role of chilis in South and Central American culture—a region that, by the Middle Ages, was in many respects the equal of Europe in “artistic sensibility, social complexity, and political organization.”5 The habanero and its capsainoid cousins were at the heart of the culinary and ceremonial customs of Mesoamerica, their biting heat and florid livery an apt metaphor for the “extravagant feats of human butchery”6 —very much in the tradition of the spectacular venationes of ancient Rome—for which the Aztecs at least were well known. To what extent was hot spice also a significant part of the culinary, medical and cultural landscape of the Old World? At a conference hosted by the Institute for Digital Archaeology at the University of Oxford last December, experts from Europe and North America examined the literary, historical, archaeological and scientific evidence around these questions. Their inquiry received a boost from new and rapidly developing techniques for examining the physical evidence of ancient diet and food production—laboratory techniques not available even five years ago. There was also fresh medical evidence to consider: significant research is being done in the area of chemosensation in the context of spicy foods. This Roger Michel, Alexy Karenowska, George Altshuler, Matthew Cobb 3 includes trying to understand how different so-called “TRP channels” in the nervous system process spice information— in particular, the connection between spice and endorphin levels. It appears that many of the hot spices available in antiquity could potentially trigger the same TRP channels as the capsaicin-charged Mesoamerican peppers. This creates a nice connection between old and new world spice that helps to explain and contextualize both. However, in the end, firm conclusions at the Oxford conference were scarce. It quickly became clear that more work, a greater diversity of viewpoints, better refined questions, and a change of venue were required to make additional progress. ABSTRACT This text reflects on the representativeness of the kinky hair (or afro-textured hair) as an element of racial belonging in children’s literature, based on the book Hair Love, by the African American director, producer, and writer Matthew A. Cherry. To do so, it investigates how the illustrations by Vashti Harrison, also an African American, align with the text to express a vision of black individuals and of their family without usual stereotypes. Drawing on bell hooks’ notion of (...) love, this analysis undertakes a reading that runs through both thematic and structural aspects of the narrative, hypothesizing that the book, without making direct allusions, serves as a counter-discourse to the racism that originated during slavery, the effects of which can still be felt today. From a theoretical perspective, in addition to hooks, this reading is grounded on a conceptual framework guided by the studies of Eliane Debus, Grada Kilomba and Nilma Lina Gomes. (shrink)

A popular version of anti-Humeanism is one that views fundamental properties as being irreducibly dispositional in nature, and it is a view to which I am attracted. Proponents of this view typically object to Humean regularity theories of laws on the basis that they do not explain why our world is regular rather than chaotic from moment to moment. It is thought that, for this reason, Humeanism does not provide firm enough foundations for induction. However, in this paper I argue (...) that it is far from clear how these anti-Humeans can themselves explain this regularity. This is because it is far from clear how they can explain why the entities in our world do not change their dispositional properties arbitrarily over time. This is a neglected problem, which I call the retention problem. In an attempt to solve this problem, several naturalistic explanations of retention are explored. Unfortunately, none of these explanations is free of problems, showing that dispositional forms of anti-Humeanism may not have as many advantages as some have assumed where the problem of induction is concerned. I defend a view of the structure of visual property-awareness by considering the phenomenon of perceptual constancy. I argue that visual property-awareness is a three-place relation between a subject, a property, and a manner of presentation. Manners of presentation mediate our visual awareness of properties without being objects of visual awareness themselves. I provide criteria of identity for manners ofpresentation, and I argue that our ignorance of their intrinsic nature does not compromise the viability of a theory that employs them. (...) This book examines the origins and subsequent evolution of multicellularity. The transition from unicellular to multicellular life was one of a few major events in the history of life that created new opportunities for more complex biological systems to evolve.

This paper concerns virtue-based ethical principles that bear upon agricultural uses of technologies, such as GM crops and CRISPR crops. It does three things. First, it argues for a new type of virtue ethics approach to such cases. Typical virtue ethics principles are vague and unspecific. These are sometimes useful, but we show how to supplement them with more specific virtue ethics principles that are useful to people working in specific applied domains, where morally relevant domain-specific conditions recur. We do (...) this while still fulfilling the need for principles and associated practical reasoning to flexibly respect variation between cases. Second, with our more detailed approach we criticize and improve upon a commonly discussed principle about ecosystemic external goods that are crucial for human flourishing. We show this principle is far more conservative than appreciated, as it would prohibit many technology uses that are uncontroversially acceptable. We then replace this principle with two more specific ones. One identifies specific conditions in which ecosystem considerations are against a technology use, the other identifies favorable conditions. Third, we uncover a humility-based principle that operates within an influential “hubris argument” against uses of several biotechnologies in agriculture. These arguments lack a substantive theory of the nature of humility. We clarify such a theory, and then use it to replace the uncovered humility-based principle with our own more specific one that shifts focus from past moral failings, to current epistemic limits when deciding whether to support new technologies. When Saint Thomas Aquinas makes claims such as “that which is not just seems to be no law at all” it is a bit difficult to discern what he means. Some think that Aquinas is defending what is now called the Strong Natural Law Thesis: for all X, X is a law only if X is just. Others think that Aquinas is defending what is now called the Weak Natural Law Thesis: for all X, X is a non-defective law only (...) if X is just. In this paper, focusing on Aquinas’s metaphysics, I argue that both of these interpretations are mistaken. Aquinas is primarily defending what we can call The Metaphysical Natural Law Thesis: since being and goodness are convertible, legal validity comes in degrees—and this entails that the justice of a law literally increases the amount of being a law possesses, while the injustice of a law literally decreases the amount of being a law possesses. On this interpretation, then, the injustice of a law entails an ontological attenuation of the law without entailing an ontological annihilation of the law. (shrink)

Contemporary scholarship concerning science diplomacy is increasingly taking a historical approach. In our introduction to this special issue, we argue that this approach promises insight into science diplomacy because of the tools historians of science bring to their work. In particular, we observe that not only are historians of science currently poised to chart the diplomatic aspects involved in the transnational circulation of technoscientific knowledge, materials, and expertise. They are ready to bring critical global analysis to an important phenomenon that (...) has too often been treated as a benign diplomacy device deployed by the Global North without equal reference to the Global South. Through cases discussed in the articles of the special issue, however, we see that historically, in the Global South as well as the Global North, science diplomacy has often functioned to mediate the circulation of technoscientific knowledge and materials, and its historical study helps to better illuminate the resulting knowledge-power nexus. This essay criticises ‘modest’ one‐child policies, which would impose sanctions upon parents who create multiple children. Specifically, this article considers what the state owes individuals who would be born (illegally) beneath restrictive procreative policies and argues that such policies would fail to show due respect to second‐ or third‐born individuals created beneath them. First, I argue that modest procreative restrictions (like sanctions) are likely to generate only modest compliance. I then suggest it is reasonable to think a one‐child policy fails (...) to demonstrate due respect to existing second and third children. I argue that such a policy generates an undue burden on any second or third children who would be born beneath them, before concluding by considering whether the state might be able to avoid effectively reinscribing ‘bastardy’ into its law by locating responsibility for the effects of such a policy entirely on the parents, rather than on children. In four studies, we investigated the role of remembering, reflecting on, and mutating personal past moral transgressions to learn from those moral mistakes and to form intentions for moral improvement. Participants reported having ruminated on their past wrongdoings, particularly their more severe transgressions, and they reported having frequently thought about morally better ways in which they could have acted instead (i.e., morally upward counterfactuals; Studies 1–3). The more that participants reported having mentally simulated morally better ways in which they could (...) have acted, the stronger their intentions were to improve in the future (Studies 2 and 3). Implementing an experimental manipulation, we then found that making accessible a morally upward counterfactual after committing a moral transgression strengthened reported intentions for moral improvement—relative to resimulating the remembered event and considering morally worse ways in which they could have acted instead (Study 4). We discuss the implications of these results for competing theoretical views on the relationship between memory and morality and for functional theories of counterfactual thinking. (shrink)

Nichelle Cherry (bio), and Martina Darragh* (bio)In 1995, the Joint Commission on Accreditation of Healthcare Organizations (JCAHO) expanded its patient rights standards to include requirements for assuring that hospital business practices would be ethical. Renamed “Patient Rights and Organization Ethics,” these standards are based on the realization that a hospital’s obligation to (...) its patients is derived from two relationships: the patient-provider relationship governed by “clinical ethics,” and the customer-supplier relationship governed by “business ethics.” “[This] boundary between ‘clinical’ ethics and ‘business’ ethics is not clear and in many cases is nonexistent. While marketing and admission practices are seen as issues related to ‘business’ ethics, they can lead to unneeded admissions or demand for unneeded services, both of which can unnecessarily expose the patient to the risk of side effects or complications. Likewise, underutilization of needed services is likely to lead to less than optimal health outcomes” (I. Schyve 1996, p. 17). “These new standards arose out of well-publicized concerns about abuses in which patients were admitted to hospitals unnecessarily and were discharged or transferred only after their insurance expired” (I. Schyve 1996, pp. 15–16).These abuses also sparked eloquent protests against threats to patient well-being and to the nature of the patient-provider relationship in the bioethics literature. The fiduciary responsibility of the provider to inform and to protect the patient was fragmented by insurer business practices such as gag clauses and economic credentialing of providers (VII. Scope Note 31, 1996). The background role that the institution plays, though poorly articulated historically, has been brought sharply into focus by the explosive growth of the managed practice of medicine. The context of medical ethics is no longer limited to the resolution of individual cases, but instead encompasses the adoption of institutional structures to protect and promote patient welfare (IV. Emanuel 1995, p. 335). In this new configuration, the institution and the providers are co-fiduciaries for populations [End Page 189] of patients, and the medicine that is practiced is “appropriately economically disciplined.” The expression “My patient always comes first” is no longer “... intellectually serious or morally responsible.” But, “... to be sure, both conceptually and in practice, being an economically disciplined fiduciary professional or institution is ethically unstable.... This process of delimiting and enforcing boundaries requires the development of “... a language for talking about the ethical values of the organization. If such a language does not exist, discussions about ethics become cumbersome and unlikely to occur” (IV. Cleveland Clinic Foundation 1998, p. 2).As with bioethics generally, the literature addressing organizational ethics is multidisciplinary. JCAHO’s compliance guide for its revised standards, Ethical Issues and Patient Rights, draws on a wealth of ideas from both clinical ethics and business ethics. This is often an awkward alliance. “Because the study of organizational ethics is in its infancy compared to other areas of healthcare ethics, discussions about it often seem like hot air with no palpable payoff” (I. Boyle 1998, p. 2). The fact that “... there is an ancient history that reflects widespread doubt about the moral probity of business” (II. Frederick 1995, p. 209) does not help. To begin, “Aristotle had rude things to say about business” (II. Jackson 1998, p. 401). Neural correlates of consciousness (for brevity NCC) are foundational to the scientific study of consciousness. Chalmers (2000) has provided the most informative and influential definition of NCC, according to which neural correlates are minimally sufficient for consciousness. However, the sense of sufficiency needs further clarification since there are several relevant senses with different entailments. In section one of this article, we give an overview of the desiderata for a good definition of NCC and Chalmers’s definition. The second section analyses the (...) merit of understanding the sufficiency of neural correlates for corresponding consciousness according to three relevant types of sufficiency: logical, metaphysical, and physical. In section three, a theoretical approach to consciousness studies is suggested in light of the sense in which NCC are sufficient for consciousness. Section four addresses a concern some might have about this approach. By the end, it will become apparent that our conception of NCC has important implications for research methodology, neuroethics, and the vitality of the search for NCC. (shrink)

In this paper, we examine the causal framework within which integrated information theory of consciousness makes it claims. We argue that, in its current formulation, IIT is threatened by the causal exclusion problem. Some proponents of IIT have attempted to thwart the causal exclusion problem by arguing that IIT has the resources to demonstrate genuine causal emergence at macro scales. In contrast, we argue that their proposed solution to the problem is damagingly circular as a result of inter-defining information and (...) causation. As a solution, we propose that IIT should adopt the specific interventionist causal framework that we offer and show how IIT can harness this interventionist framework to avoid the causal exclusion problem. We demonstrate how our argument remains fully compatible with the methodology, empirical data, and conceptual aims of the theory. (shrink)

The scientific challenges and ethical controversies facing human embryonic stem cell (hESC) research continue to command attention. The issues posed by patenting hESC technologies have, however, largely failed to penetrate the discourse, much less result in political action. This paper examines U.S. and European patent systems, illustrating discrepancies in the patentability of hESC technologies and identifying potential negative consequences associated with efforts to make available hESC research tools for basic research purposes while at same time strengthening the position of certain (...) patent-holders' rights. Differences between the U.S. and the European contexts may in part explain why the course of hESC research in those jurisdictions ultimately diverges. Nevertheless, questions about whether and how patenting, related agreements, and licensing practices progress and shape the field of hESC research in both the U.S., Europe, and elsewhere must no longer be marginalised. These questions are fundamentally important in determining what benefits are likely to result from hESC research. Assuring these benefits is the moral issue with which patent systems are most intrinsically concerned, and that governments must begin to directly address rather than assume or ignore. (shrink)

Can a scientific naturalist be a mathematical realist? I review some arguments, derived largely from the writings of Penelope Maddy, for a negative answer. The rejoinder from the realist side is that the irrealist cannot explain, as well as the realist can, why a naturalist should grant the mathematician the degree of methodological autonomy that the irrealist's own arguments require. Thus a naturalist, as such, has at least as much reason to embrace mathematical realism as to embrace irrealism.

The rise of populism and nationalism in the West have raised concerns about the fragility of liberal political values, chief among them tolerance. But what alternative social resources exist for cultivating the interpersonal relationships and mutual goodwill necessary for sustainable peace? And how might the lived practices of religious communities carry potential to reinterpret or re-circuit these interpersonal tensions and transform the relationship with the cultural "other" (Fremde) from "foe" (Feind) to "friend" (Freund)? This volume contributes a unique analysis of (...) this shifting discourse by viewing the contemporary socio-political upheaval through the lens of Friedrich Schleiermacher's theology, with a focus on the themes of friendship, interpersonal subjectivity, and sociability as a path beyond mere tolerance. Or so we are told, at least, by the “new realists,” or at least by some of the thinkers I’ll refer to using this term. And why shouldn’t we agree with them? If there’s anything at all to be said for the line of thinking that they advance, then today, we are at long last licensed to speak about beings once again; but apparently, (...) phenomenology deals only with consciousness, which we must admit—assuming we have a realist bone in our bodies—does not determine beings themselves at all. To persist with the phenomenological method, rather, would be to block all progress in philosophy—or so, again, some of these “new realists” will... (shrink)

This thesis offers an original theory of how we can cultivate our passionate attachments based on the Francophone interpretation of the Hellenistic conception of self-cultivation. Recently Harry Frankfurt, Bernard Williams, and Susan Wolf have argued that practical philosophers must direct more attention to how our passionate attachments radically affect our resolution to the question of ‘how one should live’. By neglecting this topic, these thinkers argue, we overlook some of the strongest and most distinctively human motivations that guide our practical (...) lives, ones that have a powerful effect on our capacity to flourish. Not only should philosophers explain how our moral obligations and prudential concerns guide our conduct, they should also explain how and why we are guided by deep-seated passionate attachments, considerations that Frankfurt, Williams, and Wolf argue provide the conditions for leading a life with a sense of meaning and purpose. Despite viewing passionate attachments as being vitally important, Frankfurt, Williams, and Wolf offer separate accounts of either why we cannot actively cultivate them, or why we cannot form a philosophical theory of doing so. If there is a way in which we can cultivate our passionate attachments, then these thinkers argue that we must look outside philosophy: to the contingency of personal preference, to self-help instruction manuals, to guidance from religious traditions, or in extremis to clinical psychology. My study aims to show that this attitude is overly pessimistic. Not only do we have reason to view passionate attachments as susceptible to growth, change, and improvement, but we should view these entities as amenable to self-cultivation. Only by understanding this process can we construct a theory of cultivating our passionate attachments. Focusing on Pierre Hadot’s and Michel Foucault’s respective accounts of Hellenistic self-cultivation, provides vital conceptual tools to formulate a theory of cultivating our passionate attachments. First, their accounts of Hellenistic self-cultivation offer the conceptual resources for a philosophical theory of how we can cultivate our passionate attachments. Second, the exercises of self-cultivation they focus on allow us to outline a practical method though which we can cultivate our passionate character. This takes the exercises of self-cultivation beyond their historical use, as well as beyond their role in the respective projects of these Francophone thinkers. Doing this brings out a significantly new dimension to the role of the passionate attachments in the flourishing life: not only are they valuable in the way Frankfurt, Williams, and Wolf suggest, but we can offer theoretical and practical accounts how we can cultivate them based on the Hellenistic conception of self-directed character change. Previous research on the use of diagrams for argumentation instruction has highlighted, but not conclusively demonstrated, their potential benefits. We examine the relative benefits of using diagrams and diagramming tools to teach causal reasoning about public policy. Sixty-three Carnegie Mellon University students were asked to analyze short policy texts using either: 1) text only, 2) text and a pre-made, correct diagram representing the causal claims in the text, or 3) text and a diagramming tool with which to construct their own (...) causal diagram. After a pretest and training, we tested student performance on a new policy text and found that students given a correct diagram significantly outperformed the other groups. Finally, we compared learning by testing students on a third policy problem in which we removed all diagram or tool aids and found that students who constructed their own diagrams learned the most. We describe these results and interpret them in a way that foreshadows work we now plan for a cognitive-tutor on causal diagram construction. (shrink)

What critics have failed to notice is that Isabella’s non-answer is not a unique or singular moment in the play. In fact, this paper will apply the theories of Slavoj Žižek to argue that the logic of subtraction, the negative gesture of non-compliance to which Isabella gives especially pronounced form, is fundamental to the structure of the play in its (...) entirety. Two characters in particular, Isabella and Barnardine, demonstrate the possibility of occupying a subjective orientation that is at once under the sway of the law and aware of the law’s incomplete hold on the subject. Ultimately, I will show that the logic of subtraction and refusal has important implications for how the play understands the potential political power of various forms of labor, especially sexual labor. How should contemporary Thomistic theologians speak of providence and predestination? This essay suggests that St. Catherine of Siena’s approach to the doctrine provides a model for Thomistic theology today. After examining biblical teaching and the guidelines proposed by the Catechism of the Catholic Church, I explore in some detail the positions of Hans Urs von Balthasar and Jacques Maritain, both of whom sought to overcome what they perceived to be difficulties in the Thomistic account of predestination. This chapter follows Conee and Feldman in assuming the traditional conception of the mental. Thus, the author takes it that mentalistic evidentialism is inconsistent with process reliabilism. It examines Goldman's critique of evidentialism's account of the justification of memory beliefs and discusses a problem for Goldman's own reliabilist account of memory beliefs. The chapter distinguishes two sorts of epistemic status at issue and not usually clearly separated in these debates, historical justification vs. justification to retain a belief. It raises doubts (...) about the resources of reliabilism for explaining justification to retain beliefs; and makes a plea for a less ambitious account of justification to retain beliefs, a restricted form of epistemic conservatism. The chapter argues that the conservative account that the author recommend represents a kind of neutral baseline, insofar as there are both reliabilist‐friendly as well as evidentialist‐friendly arguments for it. To corroborate the music and social bonding hypothesis, we propose that future investigations isolate specific components of social bonding and consider the influence of context. We deconstruct and operationalize social bonding through the lens of social psychology and provide examples of specific measures that can be used to assess how the link between music and sociality varies by context.

Recent high-profile lawsuits have supported competing narratives that alternately depict civil litigation as an essential instrument of the rule of law and a threat to the ideal. This essay argues that each narrative captures an important element of truth and that Gerald Postema’s account of the rule of law in his book Law’s Rule helps us (albeit unwittingly) to see why. While Postema presents recourse for alleged abuses of power as a universal and enduring facet of the rule of law, (...) his conception of recourse turns out to resemble core features of the kind of adversarial litigation process exemplified by the U.S. federal civil justice system. Yet such a system both promises to promote and threatens to undermine each of the three principles that Postema claims are entailed by his understanding of the rule of law—namely, sovereignty, equality, and fidelity. Realizing recourse thus requires confronting difficult tradeoffs within each of those principles, as well as within the overarching rule-of-law ideal. And if the rule of law can’t be instantiated unequivocally in any particular set of institutions, then perhaps we should be more willing to treat the ideal as a subject of politics rather than just a constraint on it.
