We give examples of calculi that extend Gentzen’s sequent calculusLKby unsound quantifier inferences in such a way that derivations lead only to true sequents, and proofs therein are nonelementarily shorter thanLK-proofs.

There are two bodies of literature, one offering theories of the legitimacy of domestic institutions like states, another offering theories of the legitimacy of international institutions like the IMF. Accounts of domestic legitimacy stress the importance of democratic procedure, while few to no theorists make democracy a necessary condition for the legitimacy of international institutions. In this paper, I ask whether this asymmetry can be defended. Is there a unified higher-order theory which can explain why legitimacy requires democracy in the (...) domestic context, but not in the international context? I argue that no proceduralist higher-order theory succeeds, and that we need to look for other solutions. (shrink)

Some authors have argued that legitimacy without authority is possible, though their work has not found much uptake in mainstream political philosophy. I provide an improved model how legitimate political institutions without authority are possible, the Transmission Model, which I couple with a thin substantive position, the Moral Value View. I defend the model against three common objections.

Some moral value is transparent just in case an agent with average mental capacities can feasibly come to know whether some entity does, or does not, possess that value. In this paper, I consider whether legitimacy—that is, the property of exercises of political power to be permissible—is transparent. Implicit in much theorising about legitimacy is the idea that it is. I will offer two counter-arguments. First, injustice can defeat legitimacy, and injustice can be intransparent. Some European countries legally recognise a “right to roam”—a right to freely traverse across land, even if privately owned. Political philosophers have paid little attention to the right, and have often conceptualised property rights to include strong claim-rights to exclude others. I offer an account of the right to roam, and consider whether it can be philosophically justified on a left-liberal account of property. After finding a defence in terms of the interests served by the right lacking, I suggest that (...) the most promising defence of the right to roam is that it serves as a symbolic reminder of a fundamental type of social equality. One of the most common arguments in favour of the state's authority is that without the coordinating hand of political institutions, we could not achieve important moral benefits. I argue that if we understand authority correctly, then coordination cannot even in principle establish that coordinators have political authority.

Traditionally, the manufacturer/operator of a machine is held (morally and legally) responsible for the consequences of its operation. Autonomous, learning machines, based on neural networks, genetic algorithms and agent architectures, create a new situation, where the manufacturer/operator of the machine is in principle not capable of predicting the future machine behaviour any more, and thus cannot be held morally responsible or liable for it. The society must decide between not using this kind of machine any more (which is not a (...) realistic option), or facing a responsibility gap, which cannot be bridged by traditional concepts of responsibility ascription. Two crucial distinctions regarding political competence must be made. First, the mere probability that you will make a morally right decision (reliability) is distinct from your ability to skillfully make a decision (competence). Empirical and normative accounts have focused primarily on reliability, but competence is more important if we take central normative commitments seriously. Second, the competence you have on your own (direct competence) is distinct from the competence you have in contributing to some collective enterprise (contributory competence). Direct competence (...) is likely to be extremely demanding in a democratic context, so we should move to a contributory account of competence. (shrink)

In the current paper we re-examine the concepts of attack semantics and collective attacks in abstract argumentation, and examine how these concepts interact with each other. For this, we systematically map the space of possibilities. Starting with standard argumentation frameworks (which consist of a directed graph with nodes and arrows) we briefly state both node semantics and arrow semantics (the latter a.k.a. attack semantics) in both their extensions-based form and labellings-based form. We then proceed with SETAFs (which consist of a (...) directed hypergraph of nodes and arrows, to take into account the notion of collective attacks) and state both node semantics and arrow semantics, in both their extensions-based and labellings-based form. We then show equivalence between the extensions-based and labellings-based form, for node semantics and arrow semantics of AFs, as well as for node semantics and arrow semantics of SETAFs. Moreover, we show equivalence between node semantics and arrow semantics for AFs, and equivalence between node semantics and arrow semantics for SETAFs (with the notable exception of semi-stable). We also provide a novel way of converting a SETAF to an AF such that semantics are preserved, without the use of any “meta arguments”. Although the main part of our work is on the level of abstract argumentation, we do provide an application of our theory on the instantiated level. More specifically, we show that the classical characterisation of Assumption-Based Argumentation (ABA) can be seen as an instantiation based on a SETAF, whereas the contemporary characterisation of ABA can be seen as an instantiation based on a standard AF. Our theory of how to convert a SETAF to an AF can then be used to account for both the similarities and the differences between the classical and contemporary characterisations of ABA. Most prominently, our theory is able to explain the semantic mismatch for semi-stable semantics that arises in the ABA instantiation process. (shrink)

The New Testament, while rejecting any superficial connection between illness and sin, does not reject a possible connection between illness and a person's relationship with God. An example can be seen in the story of the young blind man who was healed. His blindness does not result from any fault he or his parents had committed but apparently from God's wish to reveal his own healing power. The inner blindness of the Pharisees is a different type of blindness far more (...) difficult to heal. The blind young man was actually healed, not only in body but also in soul. Such miraculous healings are rare nowadays. However, if one takes a closer look at modern genetics and psycho-neuro-immunological findings, one may come to a better understanding of how miracle healings are linked to man's inner life and therefore also to his religiousness. Many diseases have genetic backgrounds. Defective genes, however, do not necessarily lead to subsequent illness. Genes have to be switched on or off. Only activated genes trigger pathological change. The human brain and all of man's thinking and feeling are intimately connected with such activations. We may thus conclude that both inner life and religious outlook on life are relevant to the origin and development of diseases. (shrink)

It is increasingly common in the philosophical literature to claim that political legitimacy, normatively understood, comes in degrees. However, most authors fail to specify what talk of degrees means, and the notion remains opaque. Using the Hohfeld schema as a guide, I survey possible accounts, distinguishing them into “width”, “depth”, and “weight” proposals. I argue that each fails to provide a convincing account of scalar legitimacy. Thus, talk of degrees of legitimacy, as currently used, is in serious need of explanation.

In his action theory, John Dewey makes use of the concept of capability to highlight the way human capacities depend on the environment and the character of an agent. In his capability approach, Amartya Sen likewise refers to the environment by discussing the role of conversion factors. Yet, he abstains from a discussion of character development, presumably in order to allow for a variety of conceptions of the good and ways in which characters can develop. In this paper, I develop (...) the outlines of a pragmatist capability theory by enriching the core concepts of Sen’s capability approach with the Deweyan notions of habit and character. In this way, the role of the environment in the capability approach can be reaffirmed and supplemented by a notion of character development. Subsequently, I explore the implications of this framework for Sen’s notions of impartiality and freedom. The result is a pragmatist capability theory which builds on Sen’s conceptual framework and puts additional emphasis on character development and sensitivity to one’s environment. (shrink)

In this paper, we provide a re-interpretation of qualitative and quantitative modeling from a representationalist perspective. In this view, both approaches attempt to construct abstract representations of empirical relational structures. Whereas quantitative research uses variable-based models that abstract from individual cases, qualitative research favors case-based models that abstract from individual characteristics. Variable-based models are usually stated in the form of quantified sentences. This syntactic structure implies that sentences about individual cases are derived using deductive reasoning. In contrast, case-based models are (...) usually stated using context-dependent existential sentences. This syntactic structure implies that sentences about other cases are justifiable by inductive reasoning. We apply this representationalist perspective to the problems of generalization and replication. Using the analytical framework of modal logic, we argue that the modes of reasoning are often not only applied to the context that has been studied empirically, but also on a between-contexts level. Consequently, quantitative researchers mostly adhere to a top-down strategy of generalization, whereas qualitative researchers usually follow a bottom-up strategy of generalization. Depending on which strategy is employed, the role of replication attempts is very different. In deductive reasoning, replication attempts serve as empirical tests of the underlying theory. Therefore, failed replications imply a faulty theory. From an inductive perspective, however, replication attempts serve to explore the scope of the theory. Consequently, failed replications do not question the theory per se, but help to shape its boundary conditions. We conclude that quantitative research may benefit from a bottom-up generalization strategy as it is employed in most qualitative research programs. Inductive reasoning forces us to think about the boundary conditions of our theories and provides a framework for generalization beyond statistical testing. In this perspective, failed replications are just as informative as successful replications, because they help to explore the scope of our theories. (shrink)

Closed systems are mental artefacts whose structure can neither be explained in terms of innate dispositions nor in terms of the mechanism of natural selection and which stands in contradiction to the conditions of the possibility of information transfer. Kant takes the formal structure of pure mathematics as a guarantor for his reconstruction of a closed system of the subject's structures of knowledge a priori, thereby giving rise to the problem of a normative interface between interior system and exterior information (...) – a problem which is, in this form, not to be solved. By tracing the structure of generative grammar and formal logics back to innate modules, respectively, Chomsky and Fodor are creating the same interface problem, whose basic structure has not yet received the necessary attention. This paper argues that throughout his intellectual career, Hobbes remains unsatisfied with his own attempts at proving the invariant advisability of contract-keeping. Not only does he see himself forced to abandon his early idea that contractual obligation is a matter of physical laws. He also develops and retains doubts concerning its theoretical successor, the doctrine that the obligatoriness characteristic of contracts is the interest in self-preservation in alliance with instrumental reason - i.e. prudence. In fact, it is during his work (...) on Leviathan that Hobbes notes the doctrine's main shortcoming, namely the limitation of its dialectical potential to cases in which contract-breakers are publicly identifiable. This essay shows Hobbes's doubts about his Leviathan's treatment of contractual obligation by way of a close reading of its central 15 th chapter and an analysis of some revealing shifts between the English Leviathan and the Latin edition. The paper ends by suggesting that Hobbes's awareness of the flaws at the heart of his political philosophy helps account for some striking changes in his latest writings. (shrink)

There has been little debate in political philosophy about whether the intentions of governments matter to the legitimacy of their policies. This paper fills this gap. First, I provide a rigorous statement of political anti-intentionalism, the view that intentions do not matter to political legitimacy. I do so by building on analogous debates in moral philosophy. Second, I sketch some strategies to defend political anti-intentionalism, which I argue are promising and available to a wide range of theories of legitimacy. Third, (...) The integration of ethics into the day-to-day work of research and innovation is an important but difficult challenge. However, with the Aachen method for identification, classification and risk analysis of innovation-based problems an approach from an engineering perspective is presented that enables the integration of ethical, legal and social implications into the day-to-day work of R&I practitioners. AMICAI appears in particular capable of providing a procedural guidance for R&I practitioners based on a method established in engineering science, breaking down the (...) object of consideration into partial aspects and prioritizing the innovation-based problems in dependence of potential risk. This enables the user to apply AMICAI continuously during all stages of the research and development process and to analyze and choose between certain sociotechnical alternatives. In this way, problems that affect ethical, legal, and social aspects can be understood, reflected and considered in the mostly technically focused R&D process. The paper gives a general guidance about AMICAI by describing principles and assumptions, providing the steps of analysis and application aids, giving an example application, explaining the necessary adjustments of AMICAI compared to the methodical basis of failure mode, effects, and criticality analysis and discussing the advantages and limits. AMICAI’s simple applications can stimulate interdisciplinary cooperation in the R&D process and be a starting point for the development of an “open RRI risk analysis platform” allowing society to evaluate innovation-based problems. A foundationalist account of the justification of our empirical beliefs is committed to the following two claims: (1) Sense experience is a source of justification. (2) Some empirical beliefs are basic: justified without receiving their justification from any other beliefs. In this paper, I will defend each of these claims against an objection. The objection to (1) that I will discuss is due to Donald Davidson. He writes: The relation between a sensation and a belief cannot be logical, since sensations (...) are not beliefs or other propositional attitudes. What then is the relation? The answer is, I think, obvious: the relation is causal. Sensations cause some beliefs and in this sense are the basis or ground of those beliefs. But a causal explanation of a belief does not show how or why the belief is justified. [1] There are two important thoughts in this passage. The first of these is explicitly expressed, the second implied: (3) Sense-experiential states are devoid of propositional content. (4) Necessarily, if a mental state can play the role of a justifier, it has propositional content. (3) and (4) entail that a sense-experiential state cannot play the role of a justifier. If that is true, then (1) is false. This, in any case, seems to me to be Davidson's argument. In response to it, I accept (4) but reject (3). This is an unusual move for foundationalists, who tend to accept (3) and deny (4). Nevertheless, it is what I take to be the right move. (shrink)

This article examines the meta-philosophical rift which runs through the Pittsburgh School of contemporary philosophy. The rift is a disagreement about the appropriateness and likelihood of success of the kind of attempt at philosophical explanation in which implicitly mastered conceptual practices are reconstructed by way of combining simple and easily surveyable practical rules. While for Robert Brandom, such explanations can yield a genuinely better understanding of the target practice or vocabulary, and are thus an appropriate instrument for analytical philosophy, John (...) McDowell considers them symptomatic of a wholly mistaken view of discursive practice, and takes their failure to be inevitable. According to McDowell, the futility of (“linear”) philosophical reconstructions is due to the holistic structure of linguistic competence and hence intentionality itself: distinct concrete conceptual practices presuppose each other in holistic (and hence circular) ways. This article defends Brandom’s thesis of the compatibility of the holism cited by McDowell on the one hand, and the possibility of philosophical explanation on the other, using a concrete example of a successful reconstruction which could be described as “linear” in McDowell’s sense. Finally, two possible answers in support of McDowell’s scepticism are discussed with a view to establishing room for a continuation of the debate. (shrink)

Schopenhauer gilt als Vorreiter oder erster Vertreter der Lebensphilosophie, wie sie später von Dilthey, Nietzsche, Bergson und anderen entfaltet wurde. Im Unterschied zur klassischen Lebensphilosophie und zu den an sie anknüpfenden ethischen Entwürfen wird das Leben bei Schopenhauer aber nicht als Zweck betrachtet, sondern als Mittel zu einem anderen Zweck, nämlich für die Ethik, die in der Verneinung des Willens zum Leben gipfelt. Schon in den frühesten handschriftlichen Aufzeichnungen verwendet Schopenhauer verschiedene Metaphern, um das Leben als Medium der ethischen Erkenntnis (...) zu charakterisieren. Besonders häufig tritt dabei das Bild vom Leben als Spiegel auf, in dem der Mensch sein eigenes Wesen und damit auch das Wesen der Welt erblickt. Im Hauptwerk wird dann dieses Bild vom Begriff der Objektivation des Willens abgelöst. Insofern die höchste und deutlichste Objektivation des Willens der Lebenslauf des menschlichen Individuums darstellt, ist Schopenhauers Lebensbegriff eng mit seiner Charakterlehre verknüpft. In dem Beitrag wird das verwickelte Verhältnis von Leben, Erkennen und Ethik vor dem Hintergrund der proto-hermeneutischen Metaphysikkonzeption Schopenhauers anhand der Entwicklung der Spiegelmetapher betrachtet. Schopenhauer is said to be precursor or first exponent of the philosophy of life as it has been developed later on by Dilthey, Nietzsche, Bergson and others. However, in contrast to classical philosophy of life and to the ethical conceptions going back to it, in Schopenhauer life is not viewed as an end but as a means to another end, namely to the ethics which culminates in the denial of the will-to-live. Already in the earliest hand-written manuscripts Schopenhauer uses different metaphors in order to characterize life as a medium of ethical knowledge. In particular the image of life as a mirror in which a human being sees his own nature and thus realizes the essence of the world often occurs. In the mature work this image is replaced by the concept of objectivation of will. As far as the highest and clearest objectivation of will is the life story of a human individual Schopenhauer’s concept of life is bound up with his theory of character. In my essay I consider the complicated relationship between life, knowledge and ethics in Schopenhauer on the background of his proto-hermeneutic metaphysics by following the development of his use of the mirror-metaphor.
