Public health legal preparedness begins with effective legal authorities, and law provides a key foundation for public health practice in the United States. Laws not only create public health agencies and fund them, but also authorize and impose duties upon government to protect the public's health while preserving individual liberties. As a result, law is an essential tool in public health practice and is one element of public health infrastructure, as it defines the systems and relationships within which public health (...) practitioners operate.For purposes of this paper, law can be defined as a rule of conduct derived from federal or state constitutions, statutes, local laws, judicial opinions, administrative rules and regulations, international codes, or other pronouncements by entities authorized to prescribe conduct in a legally binding manner. Public health legal preparedness, a subset of public health preparedness, is defined as attainment of legal benchmarks within a public health system. (shrink)

At the heart of ethics reside the concepts of good and bad; they are at work when we assess whether a person is virtuous or vicious, an act right or wrong, a decision defensible or indefensible, a goal desirable or undesirable. But there are many varieties of goodness and badness. At their core lie intrinsic goodness and badness, the sort of value that something has for its own sake. It is in virtue of intrinsic value that other types of value (...) may be understood, and hence that we can begin to come to terms with questions of virtue and vice, right and wrong, and so on. This book investigates the nature of intrinsic value: just what it is for something to be valuable for its own sake, just what sort of thing can have such value, just how such a value is to be computed. In the final chapter, the fruits of this investigation are applied to a discussion of pleasure, pain, and displeasure and also of moral virtue and vice, in order to determine just what value lies within these phenomena. It’s not implausible to think that whenever I have a justified noninferential belief that p, it is caused by a seeming that p. It’s also tempting to think that something contributes to the justification of my belief only if I hold my belief because of that thing. Thus, given that many of our noninferential beliefs are justified and that we hold them because of seemings, one might be inclined to hold a view like Phenomenal Conservatism, according to which seemings play (...) a crucial role—perhaps the only crucial role—in the justification of our noninferential beliefs. But Phenomenal Conservatism seems to conflict, in a number of ways, with externalist accounts of justification. As a result, the attractiveness of the intuitions appealed to in support of views like Phenomenal Conservatism present something of a challenge to externalism. The purpose of this paper is to deal with that challenge by developing and defending an externalist-friendly account of the role of seemings in the formation and justification of our noninferential beliefs—an account that incorporates what is attractive in views like Phenomenal Conservatism. Because this externalist-friendly account is compatible with both externalist accounts of justification and the plausible elements of views like Phenomenal Conservatism, the challenge to externalism inspired by such views is thereby undermined. Machine learning algorithms pervade contemporary society. They are integral to social institutions, inform processes of governance, and animate the mundane technologies of daily life. Consistently, the outcomes of machine learning reflect, reproduce, and amplify structural inequalities. The field of fair machine learning has emerged in response, developing mathematical techniques that increase fairness based on anti-classification, classification parity, and calibration standards. In practice, these computational correctives invariably fall short, operating from an algorithmic idealism that does not, and cannot, address systemic, Intersectional (...) stratifications. Taking present fair machine learning methods as our point of departure, we suggest instead the notion and practice of algorithmic reparation. Rooted in theories of Intersectionality, reparative algorithms name, unmask, and undo allocative and representational harms as they materialize in sociotechnical form. We propose algorithmic reparation as a foundation for building, evaluating, adjusting, and when necessary, omitting and eradicating machine learning systems. (shrink)

Da diese Tafel, zusammen mit der Kategorientafel (die von ihr abhangt) das Herzstuck von Kants Hauptwerk ausmacht, gilt das Problem von jeher als Kernproblem der Kantinterpretation. Uberraschenderweise kann es durch sorgfaltige immanente Textauslegung gelost werden: Nachweisbar ist, dass das Leitfadenkapitel, also der unmittelbare Kontext der Urteilstafel innerhalb der Kritik, eine dicht geschriebene Argumentationsskizze zu einem strengen Vollstandigkeitsbeweis enthalt, (...) dessen Uberzeugungskraft nichts zu wunschen ubriglasst. Fur die Rekonstruktion dieses Beweises kommt es zunachst auf eine genaue Analyse der Behauptungen an, die Kant mit der Urteilstafel aufstellt. Diese Analyse prasentiert das erste Kapitel. Das zweite bietet dann einen ausfuhrlichen Satz-fur-Satz-Kommentar zu der fur den Vollstandigkeitsbeweis einschlagigen Textpassage und rekonstruiert ihn in allen Details. Das dritte Kapitel schliesslich untersucht den Begriff von 'formaler Logik', den Kant voraussetzt und von dem seine Behauptung abhangt, die in der Urteilstafel vorgenommene Aufzahlung logischer Formen sei vollstandig. Der im Anhang abgedruckte Essay behandelt die bis heute kaum beachtete Auseinandersetzung, die Gottlob Frege in seiner Begriffsschrift von 1879 mit der kantischen Urteilstafel Punkt fur Punkt gefuhrt hat. Freges Kritik an ihr wird im ersten Teil des Anhangs dargestellt und erlautert. Im zweiten Teil wird dann gezeigt, dass diese Kritik in allen Punkten auf grundlegenden Irrtumern und Missverstandnissen beruht. Als besonders schwerwiegender und folgenreicher Irrtum stellt sich Freges Ansicht heraus, die Regeln dessen, was Kant als formale Logik ansah, seien aus dem Axiomensystem der Begriffsschrift ableitbar. The release of genetically engineered organisms into the shared environment raises scientific, ethical, and societal issues. Using some form of democratic deliberation to provide the public with a voice on the policies that govern these technologies is important, but there has not been enough attention to how we should connect public deliberation to the existing regulatory process. Drawing on lessons from previous public deliberative efforts by U.S. federal agencies, we identify several practical issues that will need to be addressed if (...) relevant federal agencies are to undertake public deliberative activities to inform decision‐making about gene editing in the wild. We argue that, while agencies may have institutional capacity to undertake public deliberative activities, there may not be sufficient political support for them to do so. Advocates of public deliberation need to make a stronger case to Congress about why federal agencies should be encouraged and supported to conduct public deliberations. (shrink)

There has been considerable debate regarding the relative merits of two theses about moral obligation known as actualism and possibilism. Both theses seek to give expression to the general idea that one ought to do the best one can. According to actualism, one’s obligations turn on what would happen if one chose some course of action, whereas, according to possibilism, they turn on what could happen if one chose some course of action. There are two strands to the debate: the (...) substantive verdicts that the two theses render in particular cases, and the accounts that they yield of the conceptual structure of moral obligation. Possibilism is conceptually appealing, whereas actualism is not, but the latter may seem to render superior substantive verdicts. In this paper, it is argued that, by turning from the objectivist’s emphasis on what is actually best to the prospectivist’s emphasis on what one’s evidence indicates is best, possibilists can provide an account of moral obligation that is both conceptually and substantively attractive. Contemporary psycholinguistic models place significant emphasis on the cognitive processes involved in the acquisition, recognition, and production of language but neglect many issues related to the representation of language-related information in the mental lexicon. In contrast, a central tenet of network science is that the structure of a network influences the processes that operate in that system, making process and representation inextricably connected. Here, we consider how the structure found across phonological networks of several languages from different language families may (...) influence language processing as we age and experience diseases that affect cognition during the typical and atypical acquisition of new words, during typical perception and production of speech in adults, and during language change over time. We conclude that the network science approach may not only provide insights into specific language processes but also provide a way to connect the work from these domains, which are becoming increasingly balkanized. Many Sides is the first full-length study of Protagorean antilogic, an argumentative practice with deep roots in rhetorical history and renewed relevance for contemporary culture. Founded on the philosophical relativism of Protagoras, antilogic is a dynamic rather than a formal approach to argument, focused principally on the dialogical interaction of opposing positions (anti-logoi) in controversy. In ancient Athens, antilogic was the cardinal feature of Sophistic rhetoric. In Rome, Cicero redefined Sophistic argument in a concrete set of dialogical procedures. In turn, (...) Quintilian inherited this dialogical tradition and made it the centrepiece of his own rhetorical practice and pedagogy. Many Sides explores the history, theory, and pedagogy of this neglected rhetorical tradition and, by appeal to recent rhetorical and philosophical theory, reconceives the enduring features of antilogical practice in a dialogical approach to argumentation especially suited to the pluralism of our own age and the diversity of modern classrooms. Over and above the probable peaking of worldwide oil production as a current reality, the arrival of hard limits on all energy resources is very much nearer in the future than many people realize. The public discourse on Peak Oil and the associated arrival of hard limitson energy availability has attracted more than its share of brilliant and creative minds. In addition to scientific and technical analysts, thisgroup includes a fair number of generalists who have engaged in broader forms of (...) reflection upon the likely economic, social, political, and cultural effects of Peak Oil and other hard energy limits on the structure of current world civilization. In this paper, I select for examination three such generalists who are both especially talented and widely read by those having an interest in this topic: James Howard Kunstler, John Michael Greer, and Dmitri Orlov. My intention is to survey their central ideas in turn, with a view to forming a reasonably well-developed and concrete notion as to how the impending arrival of hard limits on energy consumption will affect the structure of built space in coming decades. I focus both on the macro-infrastructural level and on what one might term the micro-infrastructural level of the built space within which the denizens of contemporary industrial civilization live their daily lives. Theprincipal focus of the discussion will be on the situation in the United States, though many of the lines of argument presented may be applied much more broadly if suitably adjusted in light of locally prevailing conditions elsewhere. Considerations from evolutionary biology lead Michael Ruse, among others, to a naturalistic turn in philosophy. I assess some of the pragmatic and skeptical conclusions concerning ethics, religion, and epistemology that Ruse draws from his evolutionary naturalism. Finally, I argue that there is an essential tension between science and religion which forecloses the possibility of an ultimate reconciliation between the two as they are now understood.

ABSTRACT In this paper we define two logics, KLn and BLn, and present tableau-based decision procedures for both. KLn is a temporal logic of knowledge. Thus, in addition to the usual connectives of linear discrete temporal logic, it contains a set of unary modal connectives for representing the knowledge possessed by agents. The logic BLn is somewhat similar; it is a temporal logic that contains connectives for representing the beliefs of agents. In addition to a complete formal definition of the (...) two logics and their decision procedures, the paper includes a brief review of their applications in AI and mainstream computer science, correctness proofs for the decision procedures, a number of worked examples illustrating the decision procedures, and some pointers to further work. Two brainless curs, Alan Brinton and Douglas Walton, have recently had the impudence to suggest that several of my views on argumentum ad baculum are mistaken. While hardship and toil await them in this life and eternal damnation in the next, punishment begins with this paper. In it, I clarify my position, defend my views, and critique their arguments. Last, I argue ad baculum against both of them, threatening both with the loss of reputation, employment, and respect unless they repudiate (...) every objection raised against me and publicly abase themselves. This paper begins the development of a pragmatics of emotion based on the pragma-dialectical programme, Externalization, Socialization, Functionalization, and Dialectification, applied to the emotional mode of argumentation. The first step points out a systematic equivocation within pragma-dialectics between the notion of argument and that of 'dialectics.' With this cleared, it is shown that each of the first three main assumptions can be altered to accommodate a non-logical mode of communication. However, dialectification, insofar as it is actually defining of the dialectical (...) mode, must be created anew. A defining assumption for emotionality is presented as a replacement for dialectification. (shrink)

Hobbes, Leviathan, chap. 4 (L a RiTHMETic leads to philology, and philology leads to crime."1 This is both XXthe plot and die pessimism of Ionesco's The Lesson. As the drama unfolds, the spectator watches the world of progress-through-education crumble and a world oflust (...) and murder rise in its ruins. What has gone wrong? In a word, the life oflogic has become the logic oflife. To understand Ionesco's lesson, we must examine the (largely implicit) logic and philosophy of language of his Lesson. Logic, whether die classical syllogistic logic of Aristode, the modern symbolic logic of Russell and Whitehead, or die dialectical logic of Hegel, has two essentia ] components: a syntax, which distinguishes permissible from impermissible combinations and inferences, and a semantics, which allows interpretation and thus fills out the purely formal shell provided by the former. Ionesco's strategy is to show how each of these components as diey have come to be developed philosophically is inadequate to its real content — life, and how, together, they lead, at least metaphorically, to life's devastation. These diree conceptual moments correspond to the three dramatic divisions of the play, marked out by the interruptions of die maid. Ionesco begins with the methodology of logic, syntax, and focuses on arithmetic, which, we are told, "is more a method than a science" (p. 50). Since the time of Descartes, arithmetic, or more generally mathematics, has been the academic discipline par excellence, the study diat all of the empirical sciences have aspired to. So completely has the idea of the mathematical nature of reality impressed itself upon us diat for many people it has acquired the status of an 229 230Philosophy and Literature unquestioned, and even unquestionable, assumption. And for many in this group, including the Professor, it is more dianjust an assumption; it is a way of life. "Let us arithmetize a little," he says to his pupil (p. 51), and his neologism refers not just to a subject matter, arithmetic, but to a way of dealing with subject matters and, ultimately, to a way of dealing with the whole of reality. The noun "arithmetic" has become a verb, and the ascendancy of abstract method has begun. Formal logic, in adi diree of its classic Western forms, is now subjected to sustained and specific criticism. Generally speaking, the Pupil represents Aristotelian and Russellian humanism, a view based on an optimistic belief in man's capacity for direct knowledge, in understanding through analysis by fine distinctions between terms, and in the elimination of paradoxes, both in logic and life. The Professor, again roughly speadcing, represents Hegeliainism, a view based on an optimistic belief in die capacity of reason to unify all oppositions and to overcome, through a higher syndiesis, the fundamentally paradoxical nature of all phenomena, including life itself. Thus, at die level of formal logic and ontology, the Professor amd the Pupil aire diametrically opposed, united only in their uncritical reliatnce upon a method of reason. This philosophical opposition is in turn correlated with a psycho-physical opposition: the Professor is male, old, retiring, and initially lifeless; the Pupil is female, young, forwaurd, amd initiadly vivacious. The confrontation of the two embodied philosophical/ psychological principles over die matter of arithmetic makes dieir opposition manifest and demonstrates, for the first time in the play, die utter inability of bodi philosophical traditions to maintain a grip on reality. This confrontation is also a struggle, one which the fresh, straightforward, vital Pupil begins with great success. She is "magnificent" in addition, and claims she can "count to infinity" — an ability which would vindicate her confident, optimistic belief in man's mental capacities, but an ability, nevertheless, which is logically impossible to possess, since "infinity" is not the name of a particulatrly large number, ais she seems to think. Her claim to understand reveals her as limited and ignorant of the deeper and paradoxical nature of her subject, and thus as in need of further, more abstract lessons. This essay develops a theory of identities, selves, and ‘the self’ that both explains the sense in which selves are narratively constituted and also explains how the self relates to a person's individual autobiographical identity and to their various social identities. I argue that identities are the contents of narratively structured representations, some of which are hosted individually and are autobiographical in form, and others of which are hosted collectively and are biographical in form. These identities, in turn, give rise (...) to selves of various sorts—true selves, autobiographical selves, public and private selves, merely possible selves, and so on—which are the characters (or presupposed subjects) that appear in our various identities. Although the theory I develop bears some obvious affinities with the view that selves are fictional characters, the two views are in fact distinct, for reasons explained at the end. (shrink)

Since the arrival of Translational Medicine, as both a term and movement in the late 1990s, it has been associated almost exclusively with attempts to accelerate the “translation” of research-laboratory findings to improve efficacy and outcomes in clinical practice. This framing privileges one source of change in medicine, that from bench-to-bedside. In this article we dig into the history of translation research to identify and discuss three other types of translational work in medicine that can also reshape ideas, practices, institutions, (...) behaviours, or all of these, to produce transformations in clinical effectiveness. These are: making accessible state-of-the-art knowledge and best practice across the medical profession; remodelling and creating institutions to better develop and make available specialist knowledge and practice; and improving public and patient understandings of disease prevention, symptoms and treatments. We do so by examining the work of William S. C. Copeman, a dominant figure in British rheumatology from the 1930 through the late 1960s. Throughout his long career, Copeman blended approaches to “translation” in order to produce transformative change in clinical medicine, making his work an exemplar of our expanded notion of TM. This article is an examination of Borden Parker Bowne’s account of diachronic personal identity. Specifically, it addresses the question of whether the kind of permanence that Bowne ascribes to persons in his analyses of memory and thought is consistent with his more general views about diachronic identity when framed within the context of his accounts of being and substance. The first section provides an examination of how Bowne understands the permanence of selves, with an emphasis on his repeated insistence that (...) they must remain numerically identical across time to make sense of certain kinds of experiences. Section II examines his embrace of a theory of being that is in some ways a forerunner of process philosophy. The article concludes by suggesting that this deeper metaphysical account of being as becoming stands in tension with what he says about the abidingness of persons. (shrink)
