The task of this work is to make a comparison of subjectivity in the philosophy of Frederic Nietzsche and Soren Kierkegaard in the context of modern metaphysics. It turns out that despite the fact that our XIX century philosophers were trying to go beyond the definition of modern subject by using two separate methods, their thought is marked with similar assumption. It is natural that their projects did not succeed in breaking down the modern metaphysics, but instead it resulted in (...) bringing to an end the possibilities that these metaphysics enabled. This end means a radical defining of a subject as the one who "came out of Matrix" - he is no longer obliged to follow any outside rules. He invents the rules on his own and no one can have an authority over his deeds. Following further consideration it turns out that similarity of two titular philosophers is a solidly grounded thesis and a reference of these conclusions to metaphysics enables us to take up a new look at the shape of modern times. As a result a new philosophy is possible: it is a philosophy which doesn't consider a superman or knight of faith as a culmination of it's thinking, but as a beginning of it. (shrink)

Consciousness can be measured in various ways, but different measures often yield different conclusions about the extent to which awareness relates to performance. Here, we compare five different subjective measures of awareness in the context of an artificial grammar learning task. Participants expressed their subjective awareness of rules using one of five different scales: confidence ratings , post-decision wagering , feeling of warmth , rule awareness , and continuous scale . All scales were equally sensitive to conscious knowledge. PDW, however, (...) was affected by risk aversion, and both RAS and SDS applied different minimal criteria for rule awareness. CR seems to capture the largest range of consciousness, but failed to indicate unconscious knowledge with the guessing criterion. We close by discussing the theoretical implications of scale sensitivity and propose that CR’s unique features enable a finer assessment of subjective states of awareness. (shrink)

We give a few results concerning the notions of causal completability and causal closedness of classical probability spaces . We prove that any classical probability space has a causally closed extension; any finite classical probability space with positive rational probabilities on the atoms of the event algebra can be extended to a causally up-to-three-closed finite space; and any classical probability space can be extended to a space in which all correlations between events that are logically independent modulo measure zero event (...) have a countably infinite common-cause system. Dating and hookup apps (DHAs) are now widely used and may be transforming our intimate relationships. The apps are beneficial in fostering intimate connections among those who are lonely, who are members of minority or marginalized groups, or who live nomadic lifestyles because of work or recreational travel. However, the wider social and relational changes that DHAs portend are merely beginning to be seriously discussed by academics (Arias et al., 2017). In this chapter, we employ concepts from the philosophy of (...) technology that inform our analysis of these changes. We also collate some of the morally significant impacts of DHAs and present some of the elements of the architecture of DHAs that facilitate them. Although there are many reasons to be concerned about DHAs, we argue that there is room for cautious optimism that DHAs may be vehicles of positive social and moral change. (shrink)

Indicative conditionals and tendency causal claims are closely related (e.g., Frosch and Byrne, 2012), but despite these connections, they are usually studied separately. A unifying framework could consist in their dependence on probabilistic factors such as high conditional probability and statistical relevance (e.g., Adams, 1975; Eells, 1991; Douven, 2008, 2015). This paper looks at the Catholic justification of medical interventions in ectopic pregnancies. The paper first shows that the way how Double Effect Reasoning is often applied to ectopic pregnancies is not consistent with the way Aquinas introduces this mode of reasoning. The paper then shows certain problems in common defences of the use of salpingectomies. The paper then re-evaluates the medical interventions used in the management of ectopic pregnancies, with both a focus on the aim of the treatment and (...) the timing of the treatment. (shrink)

During the 20th century, witnessing outgrew its original affiliations with legal evidence and religious belief and became a social vocation in its own right. This essay explores the ethical expertise with which witnessing has been infused as the witness became the deferred result of a process of subjective transformation by probing some of the meta-testimonial discourses that emerged in response to the Great War, the Holocaust, and Third World emergencies. Against the ethical redefinition of witnessing advanced by Jean-François Lyotard, Shoshana (...) Felman, and Giorgio Agamben, it analyses ethical witnessing as a practice of self that binds individual autonomy to institutional platforms, technological innovations, and reflective procedures that tackle the pitfalls of witnessing, maximize its potential, and trace its most adequate and resonant forms. The purpose of this article is to discuss Kant’s concept of juridical state as the foundation of the contemporary rule of law. Therefore, the article tries to answer two questions: (1) what character can be attributed to Kant’s concept of juridical state taking into account the obligations arising from it; (2) can the analysis of the Kantian juridical state have any impact on the contemporary understanding of the rule of law and if so, what can this impact be. In order (...) to accomplish this task, moral presuppositions of Kant’s juridical state are discussed, according to the commonly accepted view that Kant’s political philosophy is closely linked with his moral and ethical reflection. Then, two interpretations of Kant’s juridical state – the liberal one and the authoritarian one – are analysed. The crucial difference between these interpretations lies in establishing the circumstances in which the duty of obedience to state power should be carried out. Then, Kantian juridical state is compared with two ways of understanding the rule of law – the material one and the formal one – in order to evaluate whether the rule of law should be considered as continuity of or rupture with the Kantian concept. It causes many difficulties for jurisprudence to define the notion of judicial activism. At the very beginning it had rather a journalistic character, but but over time it has become a serious charge against these judges who act on the basis of their vision of what the law ought to be like rather than what it actually is like. On the ground of the polish legal theory the echoes of the dispute about judicial activism are reflected in the discussions about (...) the nature of legal interpretation. Transposing the problem of activism into the problem of interpretation allows the use of analysis tools that were previously unavailable. One of these tools are concepts emerged on the neopragmatist philosophy of Stanley Fish. Fish tries to describe the nature of the interpretation in the context of reader-response criticism and the concept of interpretive communities. Application of Fish's philosophy in the field of legal theory provides constructive conclusions about the concepts of judicial activism and judicial law-making. (shrink)

This paper provides an analysis of the way in which two foundational principles of medical ethics–the trusted doctor and patient autonomy–can be undermined by the use of machine learning (ML) algorithms and addresses its legal significance. This paper can be a guide to both health care providers and other stakeholders about how to anticipate and in some cases mitigate ethical conflicts caused by the use of ML in healthcare. The purpose of the paper is to analyze the thesis that an agreement between representatives of two different cultures can and should be reached at a theoretical level. The author tries to verify the Theory of Communicative Action proposed by Jürgen Habermas in the light of philosophical reflections of American neopragmatist Stanley Fish. Habermas is one of the most important and widely read social theorists in the post-Second World War era. He is also one of the authors of the concept (...) of deliberative democracy, which holds that, for a democratic decision to be legitimate, it must be preceded by authentic deliberation – disinterested exchange of reasons – not merely the aggregation of preferences that occurs in voting. The foundation of deliberative democracy is, according to the German thinker, a communicative action based on communicative rationality. Stanley Fish, in turn, is one of the most eminent American philosophers of the twentieth and twenty-first centuries. The main area of his scientific activity is the theory of literature, law, and history. In the course of his reflections, Fish constructed the concept of an interpretive communities, which implies an original view on the nature of the process of cognition, status of human convictions or beliefs, nature of communication situation and capabilities of theory. The final conclusion stemming from the reflection on Fish’s philosophy explains why Habermas’ theory is not an adequate tool to reach an intercultural agreement. (shrink)

Autor pokazuje, w jaki sposób oba te fenomeny wymagają zradykalizowanej formy redukcji fenomenologicznej, która zostaje określona jako redukcja responsywna. Pozwala to na uchwycenie centralnej roli, jaką problemy obcości i przemocy odgrywają w rozwijanej przez Waldenfelsa responsywnej etyce.

The review concerns the book Kapitalizm sieci (Network Capitalism). After discussing the structure of the book, a deeper reflection is made on some of the themes of the publication. The question of ideology that emerge as a response to the course of the digital transformation is addressed. Then the issue of primary accumulation and how it plays out in the digital space is tackled. Finaly, the digital space is situated in the context of material infrastructure.

The article is proving that works arisen from the tradition of wishing carol, in which titles appeared a formula „Carol, The New Year and the Generous Day”, constitute a separate literary genre. What is more, works, which belong to it could exist in two forms: unified and cyclical. The genesis of the genre is regarded to appear in combining into one group the motives and symbols of the Christian holidays (from the Christmas through the Circumcision / the New Year to (...) the Epiphany). These types of lyrics were printed from the very beginning to the half of the 17th century. The article therefore is creating the profile of dozen texts saved to our times. (shrink)

We discuss the role of the notion of information in the description of physical reality. We consider theories for which dynamics is linear with respect to stochastic mixing. We point out that the no-cloning and no-deleting principles emerge in any such theory, if law of conservation of information is valid, and two copies contain more information than one copy. We then describe the quantum case from this point of view.

This paper focuses on one of the metaphysical problems for theistic evolution which is the problem of evolutionary transition from one specified substantial form to another. According to the evolutionary account, new substantial forms appear owing to accidental changes in previously existing substances. However, the accidental change may only lead to production of new accidents not entirely new distinct substantial forms. The solutions proposed by modern Thomists head in two directions: One is the reduction of the number of substantial forms (...) ; the other consists of diminishing substantial form altogether. Both proposals stray from classical metaphysics. The evolutionary account of the origin of species ultimately needs to challenge the real existence of species and leads to nominalism. As such it cannot be reconciled with classical metaphysics. (shrink)

“Is logic a physical variable?” This thought-provoking question was put forward by Michael Heller during the public lecture “Category Theory and Mathematical Structures of the Universe” delivered on 30th March 2017 at the National Quantum Information Center in Sopot. It touches upon the intimate relationship between the foundations of physics, mathematics and philosophy. To address this question one needs a conceptual framework, which is on the one hand rigorous and, on the other hand capacious enough to grasp the diversity of (...) modern theoretical physics. Category theory is here a natural choice. It is not only an independent, well-developed and very advanced mathematical theory, but also a holistic, process-oriented way of thinking. (shrink)

This paper examines some of the philosophical positions explaining the interpretation of artwork as related to its ontology and the concept of creativity. A theory of interpretation necessarily involves a certain ontological position answering questions such as: What is the object of interpretation?; What is a work of art? The same close relation one can find between a theory of interpretation and the creativity, i.e. the questions such as In what sense (if at all) is a work of art created?; (...) What is created by an artist and what by the observer/reader/listener of a work of art?. Our interpretation and its results depend on answers to these questions. In conclusion the author gives an outline of his own position on the interpretation of a work of art in the context of the creativity and the ontology of the former. (shrink)

The aim of the article is to analyze the change of the Russian Federation’s international image in the light of two significant events: the Olympic Winter Games in 2014 in Sochi and the annexation of Crimea. According to the first hypothesis, one of the main aims for hosting the Olympic Games was to improve the international prestige of Russia. Shortly after the Olympics Russia increased its activity in Eastern Ukraine, which resulted in the annexation of the Crimean Peninsula. Therefore the (...) article is also aimed to investigate whether by annexing Crimea Russia squandered the possible positive effects of hosting the Olympics in terms of its international image. This article describes the author’s model of university of the new humanism, whose foundations were formulated in 2013 (Kokowski 2013a, 2013b). It considers this issue in the context of: a) the science of science, including the growing importance of scientometrics and bibliometrics, b) the current discussion on the reform of the system of science and higher education in Poland, and c) the history of the idea of the university.

This article presents a new model aimed at predicting behavior in games involving a randomized allocation procedure. It is designed to capture the relative importance and interaction between procedural justice (defined crudely in terms of the difference between one’s expected payoff and average expected payoff in the group) and distributive justice (difference between own and average actual payoffs). The model is applied to experimental games, including “randomized” variations of simple sequential bargaining games, and delivers qualitatively correct predictions. In view of (...) the model redistribution of income can be seen as a substitute for vertical social mobility. This contributes to the explanation of greater demand for redistribution in European countries vis-a-vis the United States. I conclude with suggestions for further verification of the model and possible extensions. (shrink)

Ukazano zdolności bycia sobą do wykraczania poza wzorzec bycia tym samym, ujawniające się w analizach charakteru i dochowanego słowa oraz umożliwiające ukonstytuowanie „tego, który jest sobą samym”. Opisano również rolę inności, która wykraczając poza aspekty tożsamości „tego, który jest (...) sobą samym” umożliwia konstytucję „tego, który jest sobą samym, jak i kimś/czymś innym”. (shrink)

This volume of the Logica Yearbook series brings together articles presented at the annual international symposium Logica 2013, Hejnice, the Czech Republic. The articles range over mathematical and philosophical logic, history and philosophy of logic, and the analysis of natural language.

A first impulse to write this article came from noticing, while reading Descartes' "Meditations", that author gives different meaning to the idea of "doubt" in each part of book. In First Meditation "doubt" has a function of a unique method of research, first step to build new, strictly rational and scientific knowledge – in contrast to the former collection of unjustified and un-proved or even false conceptions. Therefore "doubt" has positive value. So why does Descartes in his evidence of God's (...) existence in Third Meditation, talks about "doubt" as if it were imperfection and weakness of human nature? As if it were something worthless and part of "nothingness"? The only way to resolve this contradiction is to consider thoroughly what the role of "doubt" is in each part of "Meditations". Then, it will be clear that in Descartes' "Meditations" problem of knowledge is strictly attached to problem of existence, and how order of cognition changes without notice into cognition of Divine Order. After the US Supreme Court’s reversal of Roe v. Wade, a number of states have immediately banned abortion. Pro-choice activists are responding by promoting medication abortions – a do-it-yourself form of abortion. Women can take pills at home to induce an abortion in the first few weeks of pregnancy. -/- The Biden Administration [1] has backed the abortion pill, too. Attorney-General Merrick B. Garland and Health and Human Services Secretary Xavier Becerra both issued statements endorsing it. -/- “We stand ready (...) to work with other arms of the federal government that seek to use their lawful authorities to protect and preserve access to reproductive care,” said the Attorney-General. “In particular, the F.D.A. has approved the use of the medication mifepristone. States may not ban mifepristone based on disagreement with the F.D.A.’s expert judgment about its safety and efficacy.” -/- As the New York Times [1] has noted, this sets the scene for legal battles. The obvious one is: will anti-abortion states prosecute medication abortions? -/- But – based on experience in the United Kingdom - the use of the abortion pill could give pro-life doctors headaches as well. -/- In the past year, UK has witnessed the saga of two Catholic doctors who have been brought in front of the professional regulator, the General Medical Council, after accusations of professional misconduct. Their crime? They had supplied abortion pill reversal (APR) treatment to women. Accusations of this misconduct have been brought forward by pro-choice organisations [2]. -/- The problem is that some women might panic when they discover that they are pregnant or are pressured to make a rash decision. They obtain abortion pills, often without seeing a doctor faceto- face, and soon after taking the first pill, they regret their decision. -/- Is it too late for them to save their pregnancy? Not necessarily. -/- A treatment developed in the US works about half the time. It involves the woman taking progesterone after the first abortion pill to counteract the abortifacient action of the drug. -/- Seventy-three women in the UK are reported to have taken a full APR course, of whom, 38 – more than half — successfully remained pregnant. Admittedly, the procedure is controversial [3], with pro-choice writers denouncing it as unproven, unscientific, and unethical. This has triggered some healthcare practitioners and scholars to analyse the commitments of the pro-choice movement to APR. In a recently published paper in The New Bioethics [4], two colleagues, Dominic Whitehouse and Steven Bow, and I argue that those espousing a pro-choice worldview should actually support abortion pill reversal and that the current evidence indicates that they should actually be doing it. -/- While some pro-choice activists might be happy simply to expand women’s reproductive choices, some might also want to ensure that these choices are safe and effective at achieving the desired outcome, which in principle includes maintaining a pregnancy. -/- We then review the scientific evidence with respect to the ability of APR to halt an abortion, look at the potential impact of APR on mental health, as well as its procedural safety. While highlighting that gold-standard evidence is lacking, we note that APR is associated with about two times higher rate of embryo survival compared to not completing the full early medical abortion course, that there is large agreement in the literature that women who are ambiguous about abortion are at risk of poorer mental health outcomes after abortion (and argue that women who request APR fall into this category), and highlight that there is no evidence that APR is more dangerous than abandoning an initiated early medical abortion. -/- The latter fact is important, as the results of the only randomised-controlled trial of APR have been at times misrepresented in the media [5.6], creating the impression that APR is not safe while most of the adverse effects occurred in the study group that did not receive APR. As our paper argues, with respect to APR the two UK doctors were “champions of women’s choice and should be congratulated, not condemned, by pro-choice advocates”. -/- While the cases against the two doctors have now been dropped (and there have even been accusations against a member of one of these pro-choice organisations that they pressurised a patient into complaining about one of the doctors and twisted the patient’s experience of the treatment [7]), we argue that it is important to set-up systems to facilitate the future provision of APR to protect both patients and healthcare staff. -/- Our conclusion is that, while being open to any change in evidence, those espousing a pro-choice outlook should “support calls for an APR framework that will protect women and the healthcare professionals caring for them” “and certainly not oppose” APR. -/- The debate over abortion pill reversal will be heading to the United States soon. It is quite possible that it will be denounced as dangerous misinformation. It’s not. W państwach, które określają się demokratycznymi, są takie cykliczne momenty, które mobilizują sporą część społeczeństwa. Mobilizacja ta widoczna jest w różnych obszarach, które dotyczą przestrzeni publicznej: w jednostkach samorządu terytorialnego, w organach władzy samorządowej i centralnej, w środkach społecznego przekazu, we wspólnotach religijnych itd. Ta pewnego rodzaju „nadaktywność” wynika z tego, iż w porządku demokratycznym władze są wybierane przez lud poprzez akt wyborczy. Doświadczenie życiowe oraz przykład polskiej demokracji po 1989 r. pokazuje, iż powyższe założenia w przeważającej części nie zawsze (...) są realizowane. Można jednak mówić o przynajmniej dwóch niepożądanych działaniach kandydatów w ramach kampanii wyborczej: obietnicach wyborczych i korupcji wyborczej. Celem artykułu jest przedstawienie problematyki dotyczącej korupcji wyborczej w świetle etyki personalistycznej. Wybór, pomimo że subiektywny, wydaje się uzasadniony z tego powodu, iż personalizm dotyka kwestii problemów społeczno-politycznych z perspektywy koncepcji dobra wspólnego. (shrink)

Historiography is becoming more critical of the typology/ population dichotomy introduced by Ernst Mayr. Therefore, one should look again at the problem of species in non-Darwinian theories: neo-Lamarckism and orthogenesis, and consider the possibility that this problem was overly simplified. What can be seen in both of them is the existence of a tension between the idea of evolution and the essence of species. In neo-Lamarckism, this tension was resolved by recognizing species as static entities which changed only when triggered (...) by external stimulus. In orthogenesis, evolution was seen as constant phenomena and species – as naturally changeable entities. However, orthogeneticists assumed that not only species, but also whole phyletic lines had essences that constrained their further evolution. Thus, in both cases we can see interpretation of species in tune with essentialism, but essentialism is widely differently integrated with each of these concepts of evolution. (shrink)
