Recent advances in the field of statistical learning have established that learners are able to track regularities of multimodal stimuli, yet it is unknown whether the statistical computations are performed on integrated representations or on separate, unimodal representations. In the present study, we investigated the ability of adults to integrate audio and visual input during statistical learning. We presented learners with a speech stream synchronized with a video of a speaker’s face. In the critical condition, the visual (e.g. /gi/) and (...) auditory (e.g. /mi/) signals were occasionally incongruent, which we predicted would produce the McGurk illusion, resulting in the perception of an audiovisual syllable (e.g. /ni/). In this way, we used the McGurk illusion to manipulate the underlying statistical structure of the speech streams, such that perception of these illusory syllables facilitated participants’ ability to segment the speech stream. Our results therefore demonstrate that participants can integrate audio and visual input to perceive the McGurk illusion during statistical learning. We interpret our findings as support for modality-interactive accounts of statistical learning. (shrink)

This Article uses major and recent CJEU labor law case as a springboard to examine and critique the CJEU’s doctrinal frameworks, conceptual constructs and decision-making practice. It analyzes the institutional, legal, political and other consequences of the CJEU’s Viking judgment as a means of critiquing the Court’s increasingly profligate yet systematic approach to fundamental rights and freedoms. The resulting description claims that the European legal order is increasingly characterized by omnipresent layers of powerful judges who explicitly “balance” fundamental rights and (...) freedoms to resolve hotly contested social issues, even when those issues manifest themselves as private law disputes. The Article explains how the imposition of the CJEU’s “fundamentalist” framework impacts powerfully upon, and increasingly threatens, the domestic labor law regimes of Europe. The Article leverages this example to advance several general critiques of the Court’s increasingly dominant “fundamentalist” approach. The Court’s approach fails to treat fundamental rights as fundamental in any meaningful sense. It tramples unnecessarily on important institutional and jurisdictional distinctions, mistakenly redistributing competences not only between Member States and the European Union, but also within the Member States themselves. Finally, the Court’s approach increasingly subsumes all domestic institutions and individuals under a single, undifferentiated and ultimately simplistic normative schema that preempts many of the institutional structures and solutions that might - and in many cases, recently did - skillfully govern significant portions of the European legal field. Judicial Deliberations compares how and why the European Court of Justice, the French Cour de cassation and the US Supreme Court offer different approaches for generating judicial accountability and control, judicial debate and deliberation, and ultimately judicial legitimacy. Examining the judicial argumentation of the United States Supreme Court and of the French Cour de cassation, the book first reorders the traditional comparative understanding of the difference between French civil law and American common law judicial decision-making. It then uses this analysis (...) to offer the first detailed comparative examination of the interpretive practice of the European Court of Justice. Lasser demonstrates that the French judicial system rests on a particularly unified institutional and ideological framework founded on explicitly republican notions of meritocracy and managerial expertise. Law-making per se may be limited to the legislature; but significant judicial normative administration is entrusted to State selected, trained, and sanctioned elites who are policed internally through hierarchical institutional structures. The American judicial system, by contrast, deploys a more participatory and democratic approach that reflects a more populist vision. Shunning the unifying, controlling, and hierarchical French structures, the American judicial system instead generates its legitimacy primarily by argumentative means. American judges engage in extensive debates that subject them to public scrutiny and control. The ECJ hovers delicately between the institutional/argumentative and republican/democratic extremes. On the one hand, the ECJ reproduces the hierarchical French discursive structure on which it was originally patterned. On the other, it transposes this structure into a transnational context of fractured political and legal assumptions. This drives the ECJ towards generating legitimacy by adopting a somewhat more transparent argumentative approach. (shrink)

Asimismo, se buscará mostrar cómo dichos conceptos se relacionan y se enmarcan en una investigación más amplia sobre la pregunta por el sentido del ser. (...) En síntesis, el objetivo de este escrito es desarrollar un acercamiento a los conceptos de existencia y ser-en-el-mundo o estar-en-el-mundo y su relación y lugar dentro de la indagación heideggeriana que se cuestiona por el sentido del ser. Además, se indicarán, a grandes rasgos, algunas similitudes y vínculos entre el pensamiento de Heidegger y el de Ortega y Gasset y Sartre, teniendo siempre como puntos de referencia los conceptos centrales que aborda este trabajo. Bruce Kogut's writing has sketched a theory of human motivation that sees managers as social, often altruistic, sometimes as selfish, who care about their colleagues and their status among them. For the first time this book collects together key pieces that show how this view works in application to practical managerial issues.

For human interaction, it is important to understand what emotional state others are in. Especially the observation of faces aids us in putting behaviours into context and gives insight into emotions and mental states of others. Detecting whether someone is nervous, a form of state anxiety, is such an example as it reveals a person’s familiarity and contentment with the circumstances. With recent developments in computer vision we developed behavioural nervousness models to show which time-varying facial cues reveal whether someone (...) is nervous in an interview setting. The facial changes, reflecting a state of anxiety, led to more visual exposure and less chemosensory (taste and olfaction) exposure. However, experienced observers had difficulty picking up these changes and failed to detect nervousness levels accurately therewith. This study highlights humans’ limited capacity in determining complex emotional states but at the same time provides an automated model that can assist us in achieving fair assessments of so far unexplored emotional states. El objetivo del estudio se orientó a analizar el desarrollo socioemocional de niños(as) con habilidades diferentes que participaron en actividades de equinoterapia en la ciudad de Lima. La muestra del estudio, realizado con diseño fenomenológico, estuvo constituida por los padres o madres de familia que participaron en la implementación de actividades de equinoterapia y ofrecieron información de sus hijos(as) con autismo, síndrome de Down o trastorno por déficit de atención con y sin hiperactividad. El recojo de datos se utilizó un (...) cuestionario de preguntas abiertas que se enfocaron en las áreas social y emocional del desarrollo de niños(as), el cual fue administrado a 25 informantes, número que se alcanzó por saturación. Se encontró como resultado que los(as) niños(as) que participan en actividades de equinoterapia con enfoque holístico se ve favorecido su desarrollo socioemocional, referente a la relación de apego y control de emociones en el área emocional, y las relaciones. Corruption in public administration is a serious problem that negatively affects society and the functioning of the State. It is essential to address this issue effectively to promote transparency, integrity and trust in government institutions. This research aims to review the existing literature on the evaluation of corruption and its effects on the effectiveness of public administration. Three research questions were posed following the PICO methodology (1) What is the effect of corruption on the population's trust in government institutions?, (2) (...) What mechanisms to prevent and combat corruption in public administration have been implemented in different countries?, (3) What is the impact of corruption on government efficiency? The investigations were carried out using the Scopus database and Web of Science for which inclusion and exclusion criteria were applied to identification, screening and including 40 relevant articles. The results elucidate citizens' perception of corruption in public administration, as well as the sources that cause this scourge. In addition, the key findings of the review are presented, including the mechanisms to prevent and combat corruption implemented in different contexts. It is concluded that to combat corruption requires a joint effort from society, the government and entities in order to promote transparency and strengthen institutions, which in turn will contribute to building a more just and trustworthy society. El objetivo de la investigación es demostrar que la aplicación del Flipped Classroom mejora el nivel de logro del aprendizaje significativo en estudiantes universitarios. Para la recolección de datos en los grupos control y experimental se aplicaron dos instrumentos: el pre-test y el post-test. Concluido con la aplicación de los talleres basados en la metodología FC, en el postest se observó que en el grupo control, 26 estudiantes obtuvieron una calificación aprobatoria y 11 reprobatoria, mientras que en el grupo experimental, (...) 38 estudiantes, de acuerdo a los criterios de evaluación, todos lograron una calificación aprobatoria. This essay provides a rationale for a regulated market for human oocytes. Although the commodification of human oocytes raises important moral concerns, these concerns do not justify laws banning commerce in human eggs. Given the burgeoning ART industry and the growing oocyte market, the most prudent course of action is to develop regulations for the human oocyte market that are designed to protect and promote important social values, such as health, safety, liberty, and respect for human life. Other responses, such (...) as banning the sale of eggs altogether or allowing donors to be compensated only for their services, would either create a black market or would lead to corruption and abuse. Society still needs to debate specific rules and policies that should govern the human egg market, but further discussion of that important task is best left to legislative bodies and other commentators. The very purpose of traditional—especially religious—education is to induct the young into a unique vision of reality. When the compelling religious vision conflicts with other visions, extremist confrontations may result. This paper explores ways to 'square the circle' of the educational conundrum of how to educate for fervent commitment to tradition without precluding autonomy and diversity, both within the tradition but especially vis-à-vis outsiders. Some liberal educators see educating for autonomy as an antidote to extremism, but such an approach is (...) found wanting both ethically and empirically. Reinforcing the roots of toleration within religious traditions is offered as a more effective alternative. (shrink)

We have conducted a home-based study of children′s dream reports in which parents used open-ended interviewing styles to collect 88 dream reports from their 4- to 10-year-old children in the comfortable and supportive environment of their own homes. Particular attention was paid to formal properties including characters , settings, self-representation, and bizarreness. In contrast to previous studies, our data indicate that young children are able to give long, detailed reports of their dreams that share many formal characteristics with adult dream (...) reports. Because this wide range of dream mentation is only revealed to trusted confidants in a familiar and comfortable environment, an important implication is that the sleep laboratory may not be the best source of naturalistic dream data. Contemporary critics have argued that medieval philosophers have transmitted a concept of divine omnipotence that is self-contradictory. This study of the first Latin treatise on omnipotence places it in its patristic and early medieval context and demonstrates that for Peter Damian divine omnipotence stands beyond contradictiion.

Being able to estimate quantity is important in everyday life and for success in the STEM disciplines. However, people have difficulty reasoning about magnitudes outside of human perception. This study examines patterns of estimation errors across temporal and spatial magnitudes at large scales. We evaluated the effectiveness of hierarchical alignment in improving estimations, and transfer across dimensions. The activity was successful in increasing accuracy for temporal and spatial magnitudes, and learning transferred to the estimation of numeric magnitudes associated with events (...) and objects. However, there were also a number of informative differences in performance on temporal, spatial, and numeric magnitude measures, suggesting that participants possess different categorical information for these scales. RESNICK OVER THE PAST SEVERAL YEARS a good deal of attention has been focused on the philosophical literature of the late eleventh and early twelfth centuries in an attempt to locate the origins of nominalism? As part of this effort, several scholars have attempted to come to a new and better appreciation of one of the most vilified figures of the late eleventh century, namely Roscelin of Com- (...) pi~gne, whose logical doctrine, sometimes described as "proto-nominalism" or "vocalism, ''2 represents an early stage in the development of twelfth-century logical thought. Some have attempted simply to reconstruct, on the basis of the little material available to us that describes Roscelin's views, a less polemical and more coherent account of his theory of universals.3 Others have attempted to identify additional writings -- both published and unpublished -- that may prop- erly shed light on Roscelin's philosophy.4 All, however, would agree on Roscelin's significance for the history of philosophy at the beginning of the twelfth-century renaissance. This article discusses some ethical issues that can arise when researchers decide to increase the amount of payment offered to research subjects to boost enrollment. Would increasing the amount of payment be unfair to subjects who have already consented to participate in the study? This article considers how five different models of payment—the free market model, the wage payment model, the reimbursement model, the appreciation model, and the fair benefits model—would approach this issue. The article also considers several practical problems (...) related to changing the amount of payment, including determining whether there is enough money in the budget to offer additional payments to subjects who have already enrolled, ascertaining how difficult it will be to re-contact subjects, and developing a plan of action for responding to subjects who find out they are receiving less money and demand an explanation. I argue that it is possible literally to perceive the emotions of others. This account depends upon the possibility of perceiving a whole by perceiving one or more of its parts, and upon the view that emotions are complexes. After developing this account, I expound and reply to Rowland Stout's challenge to it. Stout is nevertheless sympathetic with the perceivability-of-emotions view. I thus scrutinize Stout's suggestion for a better defence of that view than I have provided, and offer a refinement (...) of my own proposal that incorporates some of his insights. (shrink)

The challenge of teaching classic religious texts with flawed moral messages from a contemporary point of view is examined in the case of the Beautiful Captive of War (Deuteronomy 21:10–14). A moral dilemma is generated by contradictory ethical stands within the Jewish tradition, between which students have to choose. This dilemma is explored in the context of a kind of religious education which strives for critical commitment to sacred tradition. That kind of education is analysed for its roots in self‐persuasion, (...) moral agency in complex social settings and an educational philosophy based on norms and conscience. Other issues explored are sexual education, international human rights, the relationship of abstract moral vignettes to real‐life situations and behaviour and the relationship of religious to moral education. Cloth, $68.95.This is a peculiar book that depicts thirteenth-century natural philosophy as wholly dependent on the theological interests of the mendicant orders. For the Friars, “Natural philosophy was a study (...) in which the central concerns were the detection, admiration and appreciation of God’s existence, goodness, providence, munificence, forethought and provision for His creation” (4). Although conceived as “a positive contribution to the discipline of the history of science” (3), the work begins and ends with the claim that medieval natural philosophers were not engaged in science.One difficulty is that the authors never make clear what they mean by science, although they evidently understand that it entails a repudiation of metaphysics and a doctrine of nature’s radical autonomy. Consequently, for French and Cunningham medieval “science” is a mythic construct of modern historians, since “[t]here was no scientific tradition (in the modern sense of the term ‘scientific’) of looking at nature in the thirteenth century, only a religio-political way of doing so” (273).Thus, when summarizing the accomplishments of Roger Bacon, they note that “[Bacon] has been credited, along with Grosseteste, with creating early ‘experimental science’. Bacon could not of course have been a ‘scientist’ because he lived in the wrong [End Page 623] age for this” (238). This seemingly casual conclusion is rather stunning not only in its own right, but also as a revelation of the authors’ own effort to disenfranchise medieval ‘scientists’ for having had the misfortune of living too soon.French and Cunningham propose that polemical or apologetical interests urged the Friars to study nature as a response to various heretics and especially the Cathars who, seemingly like moderns, sought to disengage the natural world from the Christian God, while using the vocabulary of Aristotle’s libri naturales. However this central argument demands better support. Since the authors can cite only one surviving Cathar text—De duobus principiis (ca. 1230)—almost everything known of this group is derived from anti-Cathar polemics. Based on this single text the authors can say no more than that it used “what looks very much like a commentary on Aristotle’s Physics or Metaphysics,” (134) but fail to identify more precisely its sources. It is clear that thirteenth-century orthodox polemics increasingly relied on Aristotelian materials, but the conclusion that natural philosophers did so only in response to heretics who beat them to the Aristotelian punch seems tendentious. The historian will likely remain unconvinced that the unparalleled translating activity of the late eleventh and twelfth centuries—the rendering into Latin of Arabic scientific knowledge (as in Constantine the African’s Pantegni or Adelard of Bath’s Quaestiones naturales), Greek medical literature (e.g. Galen’s Methodus medendi translated by Gerard of Cremona and Burgundio of Pisa) and mathematics (e.g. Euclid’s Optics, Theodosius’s Spherics, Archimedes’ On the Quadrature of the Circle, and Ptolemy’s Tetrabiblos and Almagest) culminating with thirteenth-century translations of Aristotle’s biological works—should all have stemmed from a preoccupation with heresy.A further shortcoming of this book is the limited attention given to works on natural philosophy by the Friars themselves. The book’s first seven of eleven chapters explore the educational establishments in which natural philosophy arose: first monastic and cathedral schools, and then the universities. The works of individual Friars receive only the briefest summary. Among the Dominican natural philosophers Albertus Magnus—the patron saint of scientists and one of a very few scholastics to have commented on all of Aristotle’s biological works—is awarded only five pages. For his mastery of Aristotle’s libri naturales Albertus has been called “the dominant figure in Latin learning and natural science of the thirteenth century.” (Cf. Lynn Thorndike, History of Magic and Experimental Science [New York: Macmillan, 1929], 2:521) Albertus described not only the natural world but also explored the philosophical foundations for scientific knowledge. While historical cultural materials inform users of the past, they may also contain language that perpetuates long-entrenched patterns of discrimination. In organizing and providing access to such materials, cultural heritage institutions must negotiate historical language and context with the comprehension and perspectives of modern audiences. Excerpted from a larger project exploring representation and access around historical terminology and personal identity, the present work offers insight into how knowl­edge organization systems may be used to help modern users confront and make sense (...) of past, discriminatory language in the archive. Using keywords drawn from the titles of 19th and 20th sideshow performer photographs, this work details the construction of a mapping dictionary that brings together corresponding terminology from several vocabulary sources along with annotations designed to explain historical terms to modern audiences. The development of this dictionary revealed several major types of problematic and potentially discriminatory language including historical euphemisms, misnomers, outdated terms, and sensationalist monikers. The finished dictionary offers opportunities to address these through explanatory annotations and to provide a richer, multi-perspective approach to subject analysis for these and other historical materials. This article consists in a critical examination of an argument which purports to prove that many scientific hypotheses held to be probable are actually certain. The argument rests on the assumption that since the nonphilosopher would say of many scientific hypotheses that they are certain and would deny that the best-established hypotheses are merely probable, philosophers who say that no scientific hypotheses are certain must be mistaken. This study provides a reappraisal of the eleventh-century controversy over the value of logic in theology on the basis of close exegesis of the central texts by Peter Damian, Lanfranc of Bec, Berengar of Tours and Anselm of Canterbury.

Archives are responsible for presenting historical materials to users while also placing them in context. Historical individuals and their identities pose specific challenges for the archive, including how to negotiate changing cultural perspectives on identity and how to convey and explain contexts to modern audiences. Contemporary subject representation practices in cultural heritage tend to offer a reductivist view of personal identity. Using a collection of visual images of nineteenth and twentieth century sideshow performers, the present work explored a faceted approach (...) to representing personal identity in order to: 1) offer a more holistic view of historical individuals, their identities, and relationships; and 2) help place historical terms and perspectives into context in order to better support user understanding. Utilizing an inductive approach, the researchers developed a framework of seven facets of personal identity. A textual keyword analysis of existing title metadata for images in the collection was implemented in order to identify distinct individuals depicted and any facets associated with them. Finally, collection-based language and closest matches from several controlled vocabularies were used to assign values to the facets for all individuals. The resulting metadata offers a flexible, richer, more holistic analysis of personal identity for these materials, while also exposing some deeper issues concerning identity, performance, and visual imagery. Opportunities exist for further automation and application of this faceted system to other historical collections. (shrink)
