This work offers a systematic interpretation of the problematics of disinterest in the Critique of Aesthetic Judgment. It examines Kant's thesis that the judgement of taste is free of considerations of morality or utility. Dahan Fan carefully traces Kant's differentiation between the agreeable, the good, and the beautiful, thus casting the relationship between the interests of reason and aesthetic disinterest in a new light.

An accessible yet rigorous introduction to the influential French philosopher Gilbert Simondon's philosophy of individuation. Gilbert Simondon, one of the most influential contemporary French philosophers, published only three works: L'individu et sa genèse physico-biologique and L'individuation psychique et collective, both drawn from his doctoral thesis, and Du mode d'existence des objets techniques. It is this last work that brought Simondon into the public eye; as a consequence, he has been considered a “thinker of technics” and cited often in pedagogical reports (...) on teaching technology. Yet Simondon was a philosopher whose ambitions lay in an in-depth renewal of ontology as a process of individuation—that is, how individuals come into being, persist, and transform. In this accessible yet rigorous introduction to Simondon's work, Muriel Combes helps to bridge the gap between Simondon's account of technics and his philosophy of individuation. Some thinkers have found inspiration in Simondon's philosophy of individuation, notably Gilles Deleuze and Félix Guattari. Combes's account, first published in French in 1999, is one of the only studies of Simondon to appear in English. Combes breaks new ground, exploring an ethics and politics adequate to Simondon's hypothesis of preindividual being, considering through the lens of transindividual philosophy what form a nonservile relation to technology might take today. This article aims at understanding how "ethical public issues" are created, and dealt within a public arena. Here, we view ethical public issues as social constructs, which are the results of issue framing contests. Such an approach will enable us to understand how ethical public issues emerge and are shaped by strategizing actors (including firms, NGOs, the media, and governments), in an attempt to impose their own definition and preferred solution to the issue. We also propose key factors which explain (...) the success of a framing attempt, and evidence of such success. The empirical case of the labor conditions in West Africa's cocoa industry is used to illustrate this theoretical framework and methodological approach. (shrink)

The article presents a novel normative model of shared responsibility for remedying unjust labor conditions and protecting workers’ rights in global supply chains. While existing literature on labor governance in the globalized economy tends to focus on empirical and conceptual investigations, the article contributes to the emerging scholarship by proposing moral justifications for labor governance schemes that go beyond voluntary private regulations and include public enforcement mechanisms. Drawing on normative theories of justice and on empirical-legal research, our Labor Model of (...) Shared Responsibility introduces three main claims: First, that responsibility for protecting and promoting labor standards in global supply chains should be shared by all private and institutional actors involved (whether directly or indirectly) in the production and distribution processes. Second, we offer a normative model for allocating responsibility among the various actors, based on five principles: connectedness, contribution, benefit, capacity, and power. Last, we demonstrate how the normative model could be implemented through various national and international institutional mechanisms. (shrink)

The growing popularization of stakeholder theory among management scholars has offered a useful framework for understanding the multiple and interdependent roles of government and business in an increasingly challenging political and regulatory environment. Despite this trend, attention to the role and responsibility of government to protect citizen rights has been limited. To the two traditional stakeholder theory views of government where the focal organization remains the firm, we propose to add two views by pivoting the government’s place and making it (...) the focal organization. We thus describe governments as serving four roles in the business–government–society nexus. For each role, we analyze typical governmental activities/behaviors, relationships with firms’ stakeholders, as well as the challenges and limits to these roles. We also focus on the central notion of salience amplification, as a means of checks and balances across stakeholders in order to safeguard citizen rights and reveal the greater good. (shrink)

In this chapter, Dahan Katz defends relational conceptions of retribution and desert. She clarifies the ways in which such relational conceptions avoid major worries associated with retributive theory, while addressing further worries that arise distinctively with respect to such an approach. In doing so, Dahan Katz provides further defense of the response-retributive theory of punishment that she has proposed elsewhere, while defending a wider set of views within the retributive tradition.

The potential of memory modification techniques (MMTs) has raised concerns and sparked a debate in neuroethics, particularly in the context of identity and authenticity. This paper addresses the question whether and how MMTs influence authenticity. I proceed by drawing two distinctions within the received views on authenticity. From this, I conclude that an analysis of MMTs based on a dual-basis, process view of authenticity is warranted, which implies that the influence of MMTs on authenticity crucially depends on the specifics of (...) how memory modification would eventually work. Therefore, I continue with a systematic analysis of possible properties of MMTs in which I distinguish between the dimensions of memories and the kinds of experiences that can be modified as well as the properties of the process of memory modification. The impact of MMTs on authenticity is analyzed regarding the possible properties of MMTs and based on a narrative approach to authenticity which fulfills the requirements of a dual-basis, process view of authenticity. Lastly, I explore the potential of MMTs to shift the balance between self-discovery and self-creation within authenticity and thereby alter the concept itself as well as the value of authenticity. Misunderstanding was the main reason for refusal.Before birth, three situations can compromise parents’ consent: the mother already consented to participate in other studies, the absence of the father during the interview and the feeling that the baby’s birth is not an imminent possibility.ConclusionsConfronting parents and physicians’ perspectives in research can help us reach answers to sensitive issues such as content and timing of information. This paper offers a response retributive theory of punishment, taking the role of the punisher as well as the relations between the parties to punishment to be central to retributive justification. It proposes that punishment is justified in terms of the ethics of appropriate response, and more precisely, in terms of the duty agents have to dissociate from the devaluation inherent in the culpable wrongdoing of others. The paper demonstrates that on such account, while the harm and suffering involved in (...) punishment are rightly imposed, they are not good, grounding a further duty to mitigate our retributive practices. The result is a moderate vision of retributive justification, which has the resources to justify, not only criminal punishment, but punishment as imposed across a wide variety of relations: private, institutional and political. The profound changes in personality, mood, and other features of the self that neural interventions can induce can be disconcerting to patients, their families, and caregivers. In the neuroethical debate, these concerns are often addressed in the context of possible threats to the narrative self. In this paper, I argue that it is necessary to consider a dimension of impacts on the narrative self which has so far been neglected: neural interventions can lead to a loss of meaning of actions, (...) feelings, beliefs, and other intentional elements of our self-narratives. To uphold the coherence of the self-narrative, the changes induced by neural interventions need to be accounted for through explanations in intentional or biochemical terms. However, only an explanation including intentional states delivers the content to directly ascribe personal meaning, i.e., subjective value to events. Neural interventions can deprive events of meaning because they may favor a predominantly biochemical account. A loss of meaning is not inherently negative but it can be problematic, particularly if events are affected one was not prepared or willing to have stripped of meaning. The paper further examines what it is about neural interventions that impacts meaning by analyzing different methods. To which degree the pull towards a biochemical view occurs depends on the characteristics of the neural intervention. By comparing Deep Brain Stimulation, Prozac, Ritalin, psychedelics, and psychotherapy, the paper identifies some main factors: the rate of change, the transparency of the causal chain, the involvement of the patient, and the presence of an acute phenomenological experience. In recent papers, Eric Schwitzgebel argues that if physicalism is true, then the United States is probably conscious. My primary aim here is to demonstrate that the source of Schwitzgebel’s conditional argument is the “Problem of Other Minds,” which is a general problem; wherefore, Schwitzgebel’s conclusion should be revised and applied not only to physicalism, but to most contemporary theories of the mind. I analyze the difference between Schwitzgebel’s argument and other arguments against functionalism, arguing that the difference between them (...) is rooted in referring to the causal role of the whole system, rather than referring to the casual role of the system’s parts. This key difference between functionalism and behaviorism explains why the source of Schwitzgebel’s argument stems from the problem of other minds. I conclude that however counterintuitive from a metaphysical point of view, the United States may have its own stream of consciousness, but it has nothing to do with physicalism in particular. Despite the growing global consensus regarding the need to ensure minimal labour standards such as adequate safety and health conditions, freedom of association, and the prohibition of child labour, millions of workers across the world continue to work in horrific conditions. Who should be held responsible, both morally and legally, for protecting workers' rights? What moral and legal obligations should individuals and institutions bear toward foreign workers in their countries? Is there any democratic way to generate, regulate, and enforce labour (...) standards in a global labour market? This book address these questions by taking a fresh look at the normative assumptions underlying existing and proposed international labour regulations. By focusing on international labour as a particular sphere of justice, it seeks to advance both the contemporary philosophical debate on global justice and the legal scholarship on international labour. In this paper, I address the theory of excuse, or more precisely, exculpatory excuse, and the question of what it is that justifies the category of excuse. I address different potential grounds for the law of excuse, which are often run together in ways that confound rather than clarify, focusing on the role of blamelessness and unfairness of expectations in the theory of excuse.

Postpartum mood disorders develop shortly after childbirth in a significant proportion of women and have severe effects. Two evolutionary explanations are currently available. The first is that poor postpartum mental health is a consequence of an evolutionary trade-off – a compromise of neurological changes in the maternal brain during pregnancy which, on the one hand, maintain pregnancy, and on the other, increase the likelihood for postpartum women to develop psychopathology. The second explanation is that poor postpartum mental health is a (...) disease of civilization. This theoretical paper demonstrates that both explanations ignore the crucial event of childbirth. I elaborate on environmental features of childbirth, a physiological process that is substantially different in the current versus evolutionary childbirth and postpartum setting, and argue that maternal brain neuroplasticity and biochemical alterations are not an evolutionary trade-off, but an adaptation. Additionally, the incidents of poor postpartum mental health are better viewed as a maladaptation of the typical modern environments – an evolutionary mismatch. Thus, the potential to suffer from poor mental health in postpartum is an external, contingent happening, dependent on contemporary childbirth and postpartum environments, and not due to any essential property women possess as a result of evolutionary compromise. In fact, women are probably adapted to feel like superwomen right after birth, a state of mind that is an aid in adapting to motherhood. Distinguishing between evolutionary concepts in the context of pregnancy, birth, and motherhood is vital for developing more accurate preventions and interventions. (shrink)

This paper presents a functional genealogy of essentialist authenticity. The essentialist account maintains that authenticity is the result of discovering and realizing one’s ‘true self’. The genealogy shows that essentialist authenticity can serve the function of supporting continuity in one’s individual characteristics. A genealogy of essentialist authenticity is not only methodologically interesting as the first functional genealogy of a contingent concept. It can also deepen the functional understanding of authenticity used in neuroethics, provide a possible explanation for the prevalence of (...) the idea of an essentialist true self and justify the use of the ideal of authenticity. First, essentialist authenticity is defined and explained through the work of Jean-Jacques Rousseau. Second, a general need to have steady characteristics is derived from basic human practices. Third, circumstances that make it more challenging to steady oneself are identified and shown to have become more prevalent in the age of modernity when the ideal of authenticity emerged. Finally, it is shown how essentialist authenticity helps to steady the self. (shrink)

Novel technological devices, applications, and algorithms can provide us with a vast amount of personal information about ourselves. Given that we have ethical and practical reasons to pursue self-knowledge, should we use technology to increase our self-knowledge? And which ethical issues arise from the pursuit of technologically sourced self-knowledge? In this paper, I explore these questions in relation to bioinformation technologies (health and activity trackers, DTC genetic testing, and DTC neurotechnologies) and algorithmic profiling used for recommender systems, targeted advertising, and (...) technologically supported decision-making. First, I distinguish between impersonal, critical, and relational self-knowledge. Relational self-knowledge is a so far neglected dimension of self-knowledge which is introduced in this paper. Next, I investigate the contribution of these technologies to the three types of self-knowledge and uncover the connected ethical concerns. Technology can provide a lot of impersonal self-knowledge, but we should focus on the quality of the information which tends to be particularly insufficient for marginalized groups. In terms of critical self-knowledge, the nature of technologically sourced personal information typically impedes critical engagement. The value of relational self-knowledge speaks in favour of transparency of information technology, notably for algorithms that are involved in decision-making about individuals. Moreover, bioinformation technologies and digital profiling shape the concepts and norms that define us. We should ensure they not only serve commercial interests but our identity and self-knowledge interests. (shrink)

Seyla Benhabib’s article, “Twilight of Sovereignty or the Emergence of Cosmopolitan Norms” offers a penetrating analysis of the contemporary global order and suggests a normative approach by which to mend its structural failures—viewed from the democratic ideal of popular sovereignty and guided by what she calls “cosmopolitan norms.” The authors take issue with Benhabib's position on both the descriptive and the normative grounds, and make three critical points in this matter: the first two points concern Benhabib's descriptive portrayal of the (...) global order. The third critical point concerns her normative position, i.e., her ideal of the good polity, displayed through her idea of “democratic iteration” operating through global civil society. The critical assessment of Benhabib's views ensues from the authors’ endorsement of the transformationalist position—the state, although somewhat undermined by global processes, still possesses considerable power and maintains a crucial role in determining the trajectory of these processes. Les correctoires sont des recueils de notes critiques sur le texte (latin) de la Vulgate. Est donné comme exemple le correctoire Sorbonne II (ms. BnF lat. 15554, seconde partie) sur Osée. On y perçoit la richesse des sources (texte massorétique, vieilles latines et manuscrits de la Vulgate, Pères de l’Église, autres correctoires) et on a un exemple de la méthode : les auteurs comparent les textes de leurs bibles au texte massorétique pour déterminer les interpolations, les omissions et les modifications (...) ; ils sont attentifs aux questions de ponctuation. Résumé Dans cet hommage à la Commission Léonine, l’auteur souligne la qualité très remarquable des introductions aux éditions des commentaires bibliques de saint Thomas (Job et Isaïe) et montre en quoi elles peuvent nous aider à connaître le texte courant de la Vulgate au xiii e siècle (dit « texte parisien »). Est posée la question de l’utilisation par Thomas du correctoire de Hugues de Saint-Cher et de la Bible de Saint-Jacques.

Parmi les versets du Pentateuque qui régissent la conduite à l’égard des étrangers, on étudie les commentaires médiévaux d’Ex 22, 21 et 23, 9, Lv 19, 33-34 et 25, 23, Dt 10, 19. Les lexiques (Papias, Huguccio de Pise, Jean de Gênes) permettent de préciser le sens des mots qui désignent l’étranger dans la Vulgate, advena et peregrinus. Les commentateurs (de Raban Maur à Dominique Grima) développent les raisons de cette exigence d’hospitalité : la compassion, l’amour du prochain, le fait (...) que les Hébreux aient été eux-mêmes étrangers en Égypte, la terre appartient au Seigneur. L’exégèse spirituelle assimile les étrangers aux pécheurs qui se repentent. (shrink)

Cet article a pour objet l’étude des commentaires médiévaux de l’épître à Philémon. Après avoir examiné la place de l’épître dans les bibles médiévales, avec ses prologues et ses divisions, puis la traduction latine de la Vulgate et l’histoire du texte, à travers surtout les notes critiques des correctoires, on envisage les prologues des commentaires puis les techniques d’exégèse : divisio textus, étude sémantique, analyse rhétorique, distinctiones et quaestiones. L’étude thématique se limite aux éléments historiques et au traitement du problème (...) de l’esclavage. En annexe, on trouvera la liste des commentaires utilisés, les textes des correctoires sur Philémon et les textes des prologues. (shrink)

Deux lignes caractérisent l’exégèse médiévale de la Bible : elle s’inscrit dans une tradition de réception de la Parole divine, elle considère sa lecture comme un progrès infini. Les Pères représentent le fondement de cette tradition exégétique. Peut-être plus, même : ayant aussi bénéficié de l’inspiration, ils font partie eux-mêmes d’une Écriture sacrée, qui dépasse le canon des textes bibliques. On étudie donc ici, notamment à travers un texte d’Henri de Gand, cette notion des Pères comme sacra Scriptura. Puis on (...) note que certains ouvrages ont joué un rôle déterminant – aux Pères s’ajoutent des auteurs du haut Moyen Âge et même du xii e siècle. L’une des manifestations les plus claires de cette présence est le commentaire anthologique, qui fleurit dans le haut Moyen Âge, mais se poursuit au moins jusqu’à la Catena aurea de Thomas d’Aquin. L’utilisation des Pères est multiple : on ne craint pas d’opposer leurs vues, notamment dans la questio, on recherche aussi dans leurs œuvres des traces des traductions anté-hiéronymiennes. (shrink)

Paradigme même du diagramme, l’arbre a fait l’objet des convocations les plus variées dans des domaines et aux fins les plus diverses : outil mnémotechnique, modèle d’organisation de la connaissance, hiérarchies conceptuelles, relations généalogiques, processus héréditaires, modélisation de l’histoire ou de l’évolution naturelle, etc. De l’arbre de Porphyre à l’arbre des encyclopédistes, de l’arbre darwinien de la vie aux arbres de l’histoire littéraire de Franco Moretti, les diagrammes arborescents témoignent d’une capacité apparemment infinie à se laisser réactiver pour délivrer des (...) potentiels inédits, quitte parfois à faire émerger des contre-figures comme le rhizome de Deleuze et Guattari, ou encore le corail de Darwin. Cette capacité de métamorphose de l’arbre, qui est explorée ici, explique pourquoi il est souvent considéré comme le diagramme des diagrammes. (shrink)

Les exégètes médiévaux ont-ils une attitude particulière à l’égard des récits de la Bible que nous faisons aujourd’hui entrer dans la catégorie du « mythe »? On voudrait répondre à cette question à partir de l’étude des généalogies des chapitres 4 et 5 de la Genèse dans les commentaires composés entre le xii e et le xiv e siècles en Occident. Celles du chapitre 4 (v. 17-22) sont considérées comme un mythe sur les origines de la culture – la vie (...) pastorale, le travail des métaux, la musique, le tissage –, celles du chapitre 5 posent des problèmes divers, notamment du fait de la longueur de la vie des personnages nommés. Il semble que les commentateurs du Moyen Âge soient moins sensibles à la dimension « historique » de ces textes qu’aux enseignements que nous pouvons en tirer sur les fondements de la conduite humaine. L’analyse qu’ils font des structures de ces textes (utilisant notamment la valeur symbolique attachée aux nombres et mettant en relief les différences d’agencement) et les applications tropologiques qu’ils en tirent, puisznt dans l’Écriture sainte les enseignements d’une Parole adressée en permanence à l’homme, permettent de constater que les procédures qu’ils mettent en œuvre sont proches de celles d’une certaine analyse des mythes aujourd’hui.
