This article describes the Vaccine/Injury Project Corpus, a collection of legal decisions awarding or denying compensation for health injuries allegedly due to vaccinations, together with models of the logical structure of the reasoning of the factfinders in those cases. This unique corpus provides useful data for formal and informal logic theory, for natural-language research in linguistics, and for artificial intelligence research. More importantly, the article discusses lessons learned from developing protocols for manually extracting the logical structure and generating the logic (...) models. It identifies sub-tasks in the extraction process, discusses challenges to automation, and provides insights into possible solutions for automation. In particular, the framework and strategies developed here, together with the corpus data, should allow “top–down” and contextual approaches to automation, which can supplement “bottom-up” linguistic approaches. This article examines the change which occurred in discussions of cultural transmission between the Enlightenment and the liberal outlook of the nineteenth century. The former is exemplified mainly by eighteenth-century historical discussions, the latter by the thought of Alexis de Tocqueville. An interest in the influence of advanced Western cultures on seemingly inferior non-Western societies was consistent throughout the eighteenth and nineteenth centuries. It was manifested mainly in discussions of the barbarian conquest of the Roman Empire on the one hand, (...) and of European colonial policies on the other. The sources discussed here evinced a clear Eurocentric chauvinism, yet were inherently non-racial in nature. While many Enlightenment intellectuals retained a generally positive view of cultural transmission, Tocqueville's post-revolutionary outlook was more pessimistic. (shrink)

Recent defenders of metaethical constructivism (like Christine Korsgaard, Sharon Street, Aaron James, and Carla Bagnoli) argue that this view can be shown to represent a new, free-standing alternative to familiar approaches in metaethics. If they are correct, traditional discussions in metaethics have overlooked an important position, one that is supposed to adequately explain the nature of our ethical thinking and practice while avoiding the kinds of objections that traditional views struggle with. However, what form constructivism should take and whether constructivists (...) can make good on this ambitious claim remains extremely controversial. This article starts out with a brief account of the origins of contemporary discussions of constructivism. It then moves on to canvass the main motivations and arguments for constructivism along with the various ways in which the view has been interpreted. In the second half of the article, it introduces a serious challenge to the ambitious claim that constructivism represents a new, free-standing approach in metaethics and concludes by entertaining a very recent proposal that this challenge might overlook. From the very beginning German dentists and their scientific and professional organizations were involved in the disastrous developments following the Nazi assumption of power of 1933. After purging and both organisational and ideological streamlining which had been comparatively rapidly accomplished in 1933/34 a development started which was characterized by extreme professional confrontation and lust for power in close entanglement with Nazi health policy objectives and deformation of scientific dentistry. A decisive role was assigned to the Reichszahnärzteführer Ernst Stuck (1893-1974) who (...) was the highest representative of the dental profession throughout the Nazi Regime. However, up to the present his life and position has not been thoroughly researched. What is more, history of dentistry has been looking at his activities in a merely cursory and appeasing way.In fact, his function as Reichszahnärzteführer needs to be critically scrutinized and evaluated. The philosopher Roberto Unger and the physicist Lee Smolin have recently argued that the current explanatory framework of cosmology, which presumes a timeless background of unchanging physical laws, should be replaced by a thoroughly relational framework in which time is fundamental and all laws are subject to change. Within this alternative framework, however, Unger and Smolin find themselves confronted by a dilemma: either the laws of nature evolve according to some higher set of “meta-laws,” which reinstates a timeless background at (...) a higher level, or the laws of nature evolve randomly and the path of inquiry is blocked. In response to this dilemma, the authors propose a theory of causal events as singular, freely chosen, and self-determined optimalities constrained only by their intrinsic relations to all other events. What is the relationship between creation, contemplation, human flourishing, and moral development? Nathaniel Warne's Josef Pieper on the Spiritual Life offers a sophisticated answer to this question through a systematic analysis of philosopher Josef Pieper's (1904-1997) thought. Warne's examination centers on the role of contemplation and creation in (...) Pieper's thinking, arguing that contemplation of the created order is a key feature of earthly happiness. By emphasizing the importance of contemplation, Pieper illustrates the deep interconnections between ethics, creation, and spirituality. For Warne, to posit a binary between the contemplative life and active life creates a false dichotomy. Following Pieper, Warne claims that theology and spirituality cannot be bracketed from ethics and social action--indeed, our lived experience in the world blurs the lines between these practices. Contemplation and action are closer together than are typically assumed, and both have important implications for both our spiritual development and our engagement with the world around us. Ultimately, Warne's emphasis on creation and contemplation represents an attempt to resist a view of ethics and the spiritual life that is divorced from our environment. In response to this view, Warne argues that we need a renewed sense that creation and place are important for self-understanding. Contemplation of creation is, at bottom, a form of communion with God--we thus need a more robust sense of how ethics and politics are rooted in God's creative action. Patient preference predictors aim to solve the moral problem of making treatment decisions on behalf of incapacitated patients. This commentary on a case of an unrepresented patient at the end of life considers 3 related problems of such predictors: the problem of restricting the scope of inputs to the models (the “scope” problem), the problem of weighing inputs against one another (the “weight” problem), and the problem of multiple reasonable solutions to the scope and weight problems (the “multiple reasonable models” (...) problem). Each of these problems poses challenges to reliably implementing patient preference predictors in important, high-stakes health care decision making. This commentary also suggests a way forward. Twentieth-century developments in logic and mathematics have led many people to view Euclid’s proofs as inherently informal, especially due to the use of diagrams in proofs. In _Euclid and His Twentieth-Century Rivals_, Nathaniel Miller discusses the history of diagrams in Euclidean Geometry, develops a formal system for working with them, and concludes that they can indeed be used rigorously. Miller also introduces a diagrammatic computer proof system, based on this formal system. Phillip Cary argues that Augustine invented or created the concept of self as an inner space--as space into which one can enter and in which one can find God. This concept of inwardness, says Cary, has worked its way deeply into the intellectual heritage of the West and many Western individuals have experienced themselves as inner selves. After surveying the idea of inwardness in Augustine's predecessors, Cary offers a re-examination of Augustine's own writings, making the controversial point that in his (...) early writings Augustine appears to hold that the human soul is quite literally divine. Cary goes on to contend that the crucial Book 7 of the Confessions is not a historical report of Augustine's "conversion" experience, but rather an explanation of his intellectual development over time. So holds the scholarly communis opinio, at any rate, based primarily on Carolus Sigonius' emendation of Livy 23.23.6. This article shows Sigonius' emendation to be fatally flawed, however, and popular election to be a legal requirement for senatorial enrollment – and not just a social desideratum. This prerequisite is shown to originate in the fourth-century lex Ovinia, with ramifications for models of aristocratic rule at Rome, mid-Republican (...) political developments, and the curia itself. Walter Burley claims throughout his career that the mind can make a statement out of things. Since things include entities that exist outside of the mind, Burley appears to be claiming that the mind can form a statement out of things that exist outside of it. Most scholars of Burley offer a deflationary reading of this claim, arguing that it confuses two distinct but closely related philosophical issues: the nature of propositional content, on the one hand, and the role of (...) facts in a compelling account of truth, on the other. But I argue that Burley means exactly what he says: that the mind can, quite literally, form statements out of things that exist outside of it. In Burley’s account, statements of this sort function as the propositional contents of our thoughts and written or uttered sentences. This account of propositional content is motivated by three more fundamental theses to which Burley is committed: referentialism, compositionality, and a claim about truth-conditionality I call intellectualism. Philadelphia: U of Pennsylvania P, 2008, xii + 254 pp.Sahar Amer’s Crossing Borders adds to the expanding bibliography on medieval sexualities by showing the resonances between certain female same-sex relationships in medieval French literature and analogous, though generally more explicit, relationships between women (...) in the medieval Arabic tradition. In the process, sexuality becomes a way of talking about the porous boundaries that constitute the field of Old French, and perhaps even Western, literature as such.Amer’s book couldn’t have arrived at a better time, as Sarkozy’s French government once again, in the name of French values, intervenes in the debates around religion and clothing in the public sphere, debates in which the old divides between France and its constitutive others—in this case, certain kinds of Islam and certain kinds of women— have once again come to the fore. By proposing that “medieval French writing is essentially a hybrid, cross-cultural project” (163), Amer contributes not just to the emerging sense of the Middle Ages’ postcoloniality (as articulated by Jeffrey Jerome Cohen and Sharon Kinoshita, among others) but also to the work being done by intellectual historians and cultural theorists such as Joan Scott and Diane Rubenstein on the fantastic investments that take place within and around French universalism (which could be said to inform the idea of the literary no less than the idea of the citizen).Crossing Borders begins with the notion of borders as “fluid spaces of cultural exchange, adaptation, and collaboration” (ix), and it is the emphasis on a more general sense of cultural exchange, more than the fact of borders per se, that will permeate the chapters that follow. (In fact, the border, like “the lesbian,” Amer’s polemical term of choice for the women she describes, may be important for her argument precisely insofar as it resists visibility, as it remains to some extent difficult to locate.) Amer’s reading of Old French texts, in dialogue with a handful of medieval Arabic narratives and erotic compilations, proceeds from an understanding of medieval culture in which there is “a continuity rather than a rupture between medieval and modern conceptions of alternative [End Page 156] sexualities” (9), and in which it is possible to argue for influences that are tough, if not impossible, to trace empirically. According to this logic, ideas and stories may have circulated “next to” more tangible material goods taken to and from the Arab Islamicate world (13), and French authors may have “culled some elements from Arabic material and wove[n] them into a literary fabric to suit their audience’s sensibilities” (163). This attentiveness to what “may have” happened (e.g., 44, 110) is one of the signature gestures of Amer’s critical poetics, which I am tempted to describe as an imaginative historicism, committed at once to the explanatory power of historical context and to what Amer will repeatedly call the “imagination of the audience” (e.g., 79).After an initial chapter outlining this “cross-cultural” poetics of contextualization and imaginative investment, chapter 2, “Crossing Linguistic Borders,” is dedicated to seven stanzas of a late twelfth-century poem, Étienne de Fougères’s Livre des manières, in which a long description is given of women who go “against Nature” by “join[ing] shield to shield without a lance” (32). In other words, what would it mean to think criticism as a mode of taking (and making) time? What if one of the most crucial things we do when we read and write—but also, and still more importantly, when we look at or participate in the world—is to wait? This essay aims to give space, and time, to the question of critical attention, even as it will become clear that aiming is really the last thing anyone can be expected to do while they wait.What, then, could it mean to be critically attentive? That is to say, how might it be possible to give an account of those processes and states of suspension and expectation that lie within the moment or the sequence of critical attention? This question may seem less obvious—although there’s nothing wrong with the obvious—if we recall the resonance that attention has, in French or Italian for example, with certain words for waiting, with attente or attesa; if we take seriously how attending to something or someone may also be to wait for them. Aesthetic perception, in other words, wants to take; but it ends up being taken. And when it is a matter of wanting—indeed, when it is a matter of being literally for the taking—the question and the encounter become more than just aesthetic. “Attention,” Simone Weil says, “consists of suspending our thought, leaving it detached, empty, [End Page 43] and ready to be penetrated by the object.”1 To wait for the world, for Weil, is to prepare to be entered by that (or perhaps another) world. This paper focuses on the first iteration of Thrasymachus’ claim as reported in Book I of Plato’s Republic that ‘justice is the interest of the stronger’, namely, a ‘political’ interpretation, according to which ‘justice is the interest of the stronger party in each polis as established in the law’. The author contends that this argument is logically and rhetorically distinct from Thrasymachus’ subsequent restatements of his position in Republic I. The ‘political’ version of the Thrasymachean position enjoyed currency after the (...) composition of the Republic — and in a way that was not entirely negative. The current paper examines two cases of this reception: the first, in Plato’s own late work, the Laws, where he reengages with the Thrasymachean doctrine; the second, in the De republica Anglorum of Sir Thomas Smith, an early modern theorist who self-consciously defended Thrasymachus’ theory of justice. The paper’s immediate purpose is to suggest that Thrasymachus’ conception of ‘political’ justice, in particular, has far more coherence and power than the supposed ‘refutation’ of it in the Republic might leads us to believe.
