The Patient Self-Determination Act (PSDA) requires hospitals to ask patients upon admission whether they have an advance directive. Although the PSDA has received extensive criticism, little attention has been paid to the cost of the law, either during its legislative course or following its implementation. Nonetheless, several tangible and intangible costs are associated with the PSDA. Such costs may be incurred by different parties. This paper examines the costs and benefits of the PSDA and illustrates the extent of some of (...) its tangible costs. The incremental start-up cost for one institution's response to the PSDA is estimated to be $49,304 ($1.31 per admission) and the total implementation cost of the program to be $114,528. In addition, the national incremental start-up cost for hospitals to implement the PSDA is estimated to be between $43,625,114 and $101,569,922. Finally, the potential implications of the PSDA for future governmental health care ethics regulation are discussed. (shrink)

The use of cost-benefit analysis (CBA) in environmental decision-making and the contingent valuation (CV) technique as input into traditional CBA to elicit environmental values in monetary terms has stimulated an extensive debate. Critics have questioned the appropriateness of both the method and the technique. Some alternative suggestions for the elicitation of environmental values are based on a social process of deliberation. However, just like traditional economic theory, these alternative approaches may be questioned on their implicit value judgements regarding the legitimacy (...) of the social-political organisation of the process of value elicitation. Instead of making assumptions a priori, research efforts should be focused on the processes by which actual public attitudes and preferences towards the environment can best be elicited and fed into environmental or other public policy decision-making. In the study presented in this paper, support was found for both the individual WTP based approach and a participatory social deliberation approach to inform the environmental decision-making process, suggesting that a combination of both approaches is most appropriate. This article draws attention to a pattern of development within science and other intellectual research communities that has received virtually no mention. We propose that subsequent dominance of a research community by a figure responsible for significant innovation often delays progress in the field. During the period in which the revolutionary continues to influence research in a community, far too frequently the effect is to freeze progress within the limited directions which the revolutionary sanctions.

This study continues the anti-realist’s quest for a principled way to avoid Fitch’s paradox. It is proposed that the Cartesian restriction on the anti-realist’s knowability principle ‘ϕ, therefore 3Kϕ’ should be formulated as a consistency requirement not on the premise ϕ of an application of the rule, but rather on the set of assumptions on which the relevant occurrence of ϕ depends. It is stressed, by reference to illustrative proofs, how important it is to have proofs in normal form before (...) applying the proposed restriction. A similar restriction is proposed for the converse inference, the so-called Rule of Factiveness ‘3Kϕ therefore ϕ’. The proposed restriction appears to block another Fitch-style derivation that uses the KK -thesis in order to get around.. (shrink)

Power theorists are divided on the question of whether individual powers are single-track (for a single manifestation type) or are multi-track (capable of producing distinct manifestation types for distinct stimuli). EJ Lowe has recently defended single-tracking, arguing that the multi-tracker can provide no adequate reason for treating powers as capable of having multiple manifestation types, and claiming that putative instances of multi-track powers are either single-track powers in need of unifying descriptions or are merely several single-track powers. I respond to (...) Lowe on behalf of the multi-tracker, first by arguing that he overlooks the extra-empirical features of the debate, then by posing a dilemma for any single-track account of powers concerning the single-tracker’s ability to appropriately deal with fine-grained manifestation types. I present a general theory of abstraction operators which treats them as variable-binding term- forming operators, and provides a reasonably uniform treatment for definite descriptions, set abstracts, natural number abstraction, and real number abstraction. This minimizing, extensional and relational theory reveals a striking similarity between definite descriptions and set abstracts, and provides a clear rationale for the claim that there is a logic of sets (which is ontologically non- committal). The theory also treats both natural and real numbers as answering (...) to a two-fold process of abstraction. The first step, of conceptual abstraction, yields the object occupying a particular position within an ordering of a certain kind. The second step, of objectual abstraction, yields the number sui generis, as the position itself within any ordering of the kind in question. (shrink)

All parties to the proceedings that follow concur with DS. The question is whether there is anything more to truth than can be gleaned from DS alone. Deflationism holds that there is nothing more to truth than this. Now it would appear that 'warrantedly assertible' can play the role of T in DS. Hence it would appear that the deflationist would be able to identify truth with warranted assertibility.

Mitochondrial function is achieved through the cooperative interaction of two genomes: one nuclear (nuDNA) and the other mitochondrial (mtDNA). The unusual transmission of mtDNA, predominantly maternal without recombination is predicted to affect the fitness of male offspring. Recent research suggests the strong sexual dimorphism in aging is one such fitness consequence. The uniparental inheritance of mtDNA results in a selection asymmetry; mutations that affect only males will not respond to natural selection, imposing a male‐specific mitochondrial mutation load. Prior work has (...) implicated this male‐specific mutation load in disease and infertility, but new data from fruit flies suggests a prominent role for mtDNA in aging; across many taxa males almost invariably live shorter lives than females. This study examines how the Gödel phenomena are to be treated in core logic. We show in formal detail how one can use core logic in the metalanguage to prove Gödel’s incompleteness theorems for arithmetic even when classical logic is used for logical closure in the object language.

Abstractabstract:In his Pragmatism lectures, William James argued that philosophers' temperaments partially determine the theories that they find satisfying, and that their influence explains persistent disagreement within the history of philosophy. Crucially, James was not only making a descriptive claim, but also a normative one: temperaments, he thought, could play a legitimate epistemic role in our philosophical inquiries. This paper aims to evaluate and defend this normative claim.There are three problems for James's view: (1) that allowing temperaments to play a role (...) within inquiry replaces philosophical disagreement with psychological difference; (2) that including temperaments would allow arbitrary elements to influence the outcome of inquiry; and (3) that such a view assumes an implausible metaphysical picture. Through clarifying the nature of temperaments, and what counts as a satisfactory philosophical theory on a pragmatist account, this paper presents an interpretation of James's metaphilosophical claims that can provide satisfactory responses to these problems. AGM-theory, named after its founders Carlos Alchourrón, Peter Gärdenfors and David Makinson, is the leading contemporary paradigm in the theory of belief-revision. The theory is reformulated here so as to deal with the central relational notions 'J is a contraction of K with respect to A' and 'J is a revision of K with respect to A'. The new theory is based on a principal-case analysis of the domains of definition of the three main kinds of theory-change (expansion, contraction and (...) revision). The new theory is stated by means of introduction and elimination rules for the relational notions. In this new setting one can re-examine the relationship between contraction and revision, using the appropriate versions of the so-called Levi and Harper identities. Among the positive results are the following. One can derive the extensionality of contraction and revision, rather than merely postulating it. Moreover, one can demonstrate the existence of revision-functions satisfying a principle of monotonicity. The full set of AGM-postulates for revision-functions allow for completely bizarre revisions. This motivates a Principle of Minimal Bloating, which needs to be stated as a separate postulate for revision. Moreover, contractions obtained in the usual way from the bizarre revisions, by using the Harper identity, satisfy Recovery. This provides a new reason (in addition to several others already adduced in the literature) for thinking that the contraction postulate of Recovery fails to capture the Principle of Minimal Mutilation. So the search is still on for a proper explication of the notion of minimal mutilation, to do service in both the theory of contraction and the theory of revision. The new relational formulation of AGM-theory, based on principal-case analysis, shares with the original, functional form of AGM-theory the idealizing assumption that the belief-sets of rational agents are to be modelled as consistent, logically closed sets of sentences. The upshot of the results presented here is that the new relational theory does a better job of making important matters clear than does the original functional theory. A new setting has been provided within which one can profitably address two pressing questions for A GM-theory: (1) how is the notion of minimal mutilation (by both contractions and revisions) best analyzed? and (2) how is one to rule out unnecessary bloating by revisions? Milton Friedman's famous methodological essay contains, along with much else, some strands that look as though they were taken from the “empirical-scientific” fabric described by Karl Popper. Think, for example, of Friedman's conviction that the way to test a hypothesis is to compare its implications with experience. Or of his more or less explicit espousal of the view that while no amount of facts can ever prove a hypothesis true, a single “fact” may refute it. Or of his assertion that (...) hypotheses are to be accepted only as provisionally true, and then only after repeated efforts to refute them have failed. The appearance of these Popperian ideas is not surprising. (shrink)

ABSTRACT The well-known AGM-theory-contraction and theory-revision, due to Alchourrón, Gärdenfors and Makinson, relies heavily on the so-called postulate of recovery. This postulate is supposed to capture the requirement of “minimum mutilation”; but it does not. Recovery can be satisfied even when there is more mutilation than is necessary. Recovery also ensures that very often too little is given up in a contraction, in this paper I bring out clearly the deficiencies of the AGM-theory in these two regards, showing how it (...) is doubly off-beam. I show that some of the most serious inadequacies of the AGM-theory derive from early claims in some of its founding contributions, claims that have not been seriously questioned within the tradition since. The upshot of these investigations is that recovery cannot, and should not, be recovered. Theory contraction is hysteretic. Whether the AGM-theory can now recover is a good question. (shrink)

Some ideas gain currency as soon as there is a linguistic medium of exchange. Truth is one such. Its role in our intellectual economy is much like that of money in the real one. Canonical warrants to make assertions are like gold bars. Truth-claims are like paper money: promises to produce gold bars on demand.

This study takes a careful inferentialist look at Graham Priest’s Logic of Paradox. I conclude that it is sorely in need of a proof-system that could furnish formal proofs that would regiment faithfully the “naïve logical” reasoning that could be undertaken by a rational thinker within LP.

We investigate the theories of linear algebra, which were originally defined to study the question of whether commutativity of matrix inverses has polysize Frege proofs. We give sentences separating quantified versions of these theories, and define a fragment in which we can interpret a weak theory V 1 of bounded arithmetic and carry out polynomial time reasoning about matrices - for example, we can formalize the Gaussian elimination algorithm. We show that, even if we restrict our language, proves the commutativity (...) of inverses. (shrink)

Historians have often argued that from the mid‐sixteenth century onward Italian science began to decline. This development is often attributed to the actions of the so‐called Counter‐Reformation Church, which had grown increasingly intolerant of novel ideas. In this article, I argue that this interpretation of the history of science is derived from an Italian liberal historiographical tradition, which linked the history of Italian philosophy to the development of the modern Italian state. I suggest that although historians of science have appropriated (...) parts of this distinctive narrative to underpin their account of Italy's seventeenth‐century scientific decline, they have not always fully appreciated its complexity. In this article, I consider the work of two scholars, Francesco de Sanctis and Benedetto Croce. Both explicitly suggested that although the actions of the Church caused Italy to enter into a period of decline, they in fact argued that science represented one of the few areas in which Italian intellectual life actually continued to thrive. Discussions of William Lambarde’s interests as a reader have usually focused on his strategies of tracing place names and etymologies in the margins of his books, tying him in with a larger subsection of the Tudor reading public who annotated books in a similar fashion. This article surveys the annotations in Lambarde’s early books to trace the evolution of his reading over time and in collaboration with his contemporaries. In so doing, it explores the uses that Lambarde found for his (...) books beyond organising information within them or excerpting material for publication. The process, as well as the products, of Lambarde’s reading, was shared among his fellow antiquarians and members of the Inns of Court, for whom reading was both a professional practice and a means to communicate privileged information. When juxtaposed with the equally collaborative drafting and reception of his published work the annotations preserved in Lambarde’s books paint a dynamic and evolving picture of his reading practices. Over the course of his lifetime, Lambarde returned to the books in his library, with new questions or acquisitions prompting the re-reading of earlier acquisitions and occasioning new discoveries in them. Lambarde’s habit of marking up and circulating copies of his own published works, as well as the books he owned, publicised both his reading practices and the knowledge they generated about the past to his scholarly and professional companions. Static depiction of motion, particularly lines trailing behind a mover, has long been of interest in the psychology literature. Empirical research has demonstrated that these “motion lines” benefited motion comprehension in static images by disambiguating the direction of movement. Yet, there is no consensus on how those lines derive their meaning. In this article, we review three accounts suggesting different interpretations of what motion lines represent. While a perceptual account considers motion lines originating from motion streaks in the primary visual (...) cortex, metaphorical and lexical accounts propose them as graphical conventions that should be learned—either through resemblance to sensory experiences (e.g., natural path marks) or directly being mapped to a conceptual category of paths. To contrast these three accounts, we integrate empirical research on motion lines and their understanding. Overall, developmental, proficiency, and cross-cultural variances indicate that the understanding of motion lines is neither innate nor universal, thus providing less support for lines having a purely perceptual origin. Rather, we argue the empirical findings suggest that motion lines are not iconic depictions of visual percepts but are graphical conventions indexing conceptual path information, which need to be learned and encoded in a visual lexicon.
